External Affairs Minister Salman Khurshid, who recent- ly visited Colombo, is learnt to have told his Sri Lankan inter- locutors that India was seized of the issue and would soon take a final decision on it, sources said here today. However, Khurshid con- firmed that he himself would take part in the CHOGM For- eign Ministers’ meet to be held ahead of the summit. He will have to shell out more than he pocket- ed as arbitration fee. The Commissioner, Jaland- har division, was today asked by the Punjab and Haryana High Court to refund the amount collected by him as fee for arbitration work. He has also been asked to pay pro- portionate interest received by him in his bank account. “It has been a unique endeav- our of the respondent to aggran- dise and enrich himself by this method,” the high court ruled. The court also directed the state government to refund the amount so received from Ladhar to the farmers con- cerned. The Bench also imposed cost of Rs 20,000 on Ladhar for his conduct. Taking up the PIL filed by advocate HC Arora, Division Bench of Chief Justice Sanjay Kishan Kaul and Justice Augustine George Masih passed the orders after coun- sel for the Union of India Onkar Batalvi argued that IAS officers could not claim or fix fee for arbitration cases, without any sanction from the competent authority; and arbi- tration in land acquisition cases was a part of normal duty of such officers. The Bench asserted the officer was “not entitled to retain and claim any amount whatsoever”. “The respondent is a mem- ber of the IAS and is governed by the rules arising from the course of this employment. It is not his whim and fancy to generate income from other sources in the course of this employment, if the same is not permitted by the Central Government or the state gov- ernment, depending on where he is posted. “The respondent was posted at the relevant time with the state of Punjab. It is interesting to note that apart from him, no one else has claimed any fee whatsoever for performing duties of an arbitrator.” TRIBUNE NEWS SERVICE SRINAGAR, OCTOBER 11 A jawan was killed as the Army foiled another infil- tration bid in the Keran sec- tor of Kupwara district on the intervening night of Thursday and Friday. The firing took place in the Kachal area days after the counter-infiltration opera- tion in Shalabato Keran, 130 km from here, against a group of around 40 mili- tants was called off after 15 days on October 8. Spokesperson for Srinagar- based 15 Corps Naresh Vig said the soldier was killed while foiling an infiltration bid in the Kachal area, around 20 km from Shalabato. “We foiled another infiltra- tion bid last night and in the firefight, which began at 9.30 pm on Thursday, a soldier was injured who later succumbed to his injuries,” Vig said. “The firing started when a group of militants was chal- lenged by troops in the area,” he added. A search operation was launched in the area and it was believed that militants returned to Pakistan-occupied Kashmir. The slain solider was identi- fied as Patil Mahadeven of 15 Rashtriya Rifles. The cyclone, which according to IMD chief LS Rathore has a “quite high damage potential”, will hit the coast with a storm surge of three metres and move north- west causing heavy rains in Jharkhand, Chhattisgarh, Bihar, West Bengal and east Uttar Pradesh. It is the biggest cyclone in years to hit Odisha and expect- ed to make a landfall near Gopalpur in Ganjam district after crossing an area between Paradip in Odisha and Kalin- gapatnam in Andhra. Rathore identified Ganjam, Khurda, Puri and Jagatsinghpur dis- tricts in Odisha and Srikakalum in Andhra Pradesh as the areas expected to be worst hit.     In another sign of changingsocial mores in the IndianArmy, another officer-jawanfracas has been reported, thistime from Meerut. Two offi-cers and a jawan of the 10thSikh Light Infantry (SLI)battalion have been injuredin an incident that occurredlast evening.

    The incident has occurredjust two months after theArmy assured the DefenceMinistry that 'correctivesteps' had been taken fol-lowing three similar inci-dents in the recent past.

    In turn, the Defence Minis-ter AK Antony informed theParliament on August 8 thisyear: "Measures like betterman management and ade-quate grievance redressmechanisms have been put inplace to address the causativefactors (of tensions betweenofficers and jawans)".

    Army officials here con-firmed yesterday's incidentsaying a court of inquiry hasbeen ordered. Sources saidthe incident occurred when aboxing match between twocompanies of the battalionended in fracas. Tempers ranhigh when the decision of thereferee - a person from the

    same regiment - was disput-ed by one of the boxers. Abattalion has four companiesand sporting events such asboxing, athletics, basketballand volleyball are conductedto keep the men fit.

    The 10th Sikh LightInfantry is nowadays basedin Delhi. It had been sent toMeerut for training and waslocated at place Debathua,some 15 kms from Meerut.

    Sources said both theinjured officers are Major.One of them is the Second-in-Command of the battalion.The commanding officer hadreportedly left the boxing areawhen the incident occurred.

    One version, corroboratedby two sources, is that duringthe boxing match one of theboxers was losing and hewanted to forfeit the matchwhich was not appreciatedby the officer in charge of hiscompany.

    The incident has comeabout just two months afterAntony, while replying toParliamentarians, termed theprevious cases as 'aberra-tions' and assured these "donot indicate declining disci-pline and leadership stan-dards in the Army".

    This year alone, punishmenthas been handed in three sep-arate cases which occurred inthe past couple of years.

    In March this year, anArmy Court of Inquiry rec-ommended disciplinaryaction against 168 personnel,including four officers, 17junior commissioned offi-cers and 147 jawans, for theunprecedented clash thattook place between officersand jawans in the 226artillery regiment at Nyomain south-eastern Ladakh inMay 2012. Those facingaction include the command-ing officer of the unit.

    Talwar (94) passed away at aGurgaon hospital on Thurs-day after a brief illness. Amongthose who attended the funer-al included Naresh Mohan,Trustee, The Tribune Trust,Punjab MPNaresh Gujral, for-mer MPTarlochan Singh, for-mer Delhi Police Commission-er YS Dadwal and JusticeRajinder Sachar (retd).

    Former Chief Justice of thePunjab and Haryana HighCourt Justice Shanti SarupDewan is all set to bestow onhis son Suvir what he couldnot win in a legal battle.

    Available information sug-gests Chief Justice Dewanhas expressed willingness tobequeath through will one-third share in his Sector 11house to Suvir. The remain-ing share will be dividedbetween his two daughters.

    Chief Justice Dewan hasalso refused to accept fromSuriv Rs 50,000 costsordered by the Punjab andHaryana High Court to bepaid to the elderly couple.

    Suvir, meanwhile, hascomplied with the SupremeCourt orders and vacated the

    Sector 11 house. The devel-opments took place less thana week after the SupremeCourt refused to come toSuvirs rescue.

    An advocate, Suvir wasstaying on the first floor ofthe house with his family;and was using a portion ofthe ground floor to run hisoffice. Justice Dewan andhis wife Romilla were alsostaying on a part of theground floor.

    The crux of the disputebetween the father and son isthe house. Chief JusticeDewan has been claimingthat it was his self-acquired

    property; and had executed aWill disinheriting Suvir fromall his moveable or immov-able assets.

    Suvir, on the other hand,has been arguing that it wasHindu Undivided Familyproperty as shown in theincome tax returns. As such,he argued his sisters had noright in the property.

    Taking up the matter, aDivision Bench of the Pun-jab and Haryana High Courton September 25 askedSuvir to vacate the houseand pay Rs 50,000 to the eld-erly couple towards cost oflitigation in 15 days.

    The Bench had ruled:Other than the obliquemotive to grab the property atChandigarh and keep posses-sion of the same against thewishes of the owner, there canbe no other reason, the Benchhad asserted.

    In fact, it was quite clearduring the course of argu-ments that not only therespondent (Suvir Dewan)wants to deprive the appel-lant (Justice Dewan) to dealwith his property as per hiswishes, but wanted to grabthe whole property for him-self denying the share ofhis sisters.

    The Bench had passed theorders after Chief JusticeDewan, 85, and his 74-year-old wife moved the courtabout four months ago, assert-ing they deserve to live a lifeof dignity and honour.

    It will cause extensivedamage to the horticultureand agriculture crops.

    Crops are at a maturity stageand the IMD has been issuingregular warnings to farmers,advising them to take precau-tionary measures.

    Odisha, AP brace for severe cycloneNAMING OF CYCLONESPhailin has been given its name by Thailand. It means sapphire in Thai.The Regional Specialised Meteorological Centre in the IMD has theresponsibility of christening all cyclones that hit India, Pakistan, Oman,Bangladesh, Maldives, Sri Lanka, Myanmar and Thailand. The identifi-cation system is as per names suggested by these countries and cov-ers the Indian Ocean - both the Arabian Sea and the Bay of Bengal. As per met officials, assigning a name, rather than a number or the datemakes it easier to track and remember a particular cyclon.

    INTERESTING HISTORYHurricanes in the beginning of the century used to be deadly, thereforeusually named after politicians.     The zila parishad runs 30health centres and 18 veteri-nary dispensaries in the ruralarea of the district. Apharma-cist and a Class IV employeeare posted at each dispensa-ry on a contract basis at amonthly salary of Rs 7,000

    and Rs 3,000 respectively.Since employees of the

    parishad have not been paidsince June, several staffmembers have had to bor-row from money lenders ata hefty rate of interest.

    Surprisingly, the authori-ties remained oblivious totheir plight. AdditionalDeputy CommissionerAmarjit Singh Shahi was

    not aware of the issue andadvised this reporter to con-tact Zila Parishad SecretaryPreetinder Singh Bains.

    Principal Secretary, Health,Vini Mahajan today said thatextensive research hadshowed that e-cigarettes con-tained nicotine in a liquidform which could be lethal.The cigarettes were invisibleat roadside stalls and bigshopping malls. However,social networking sites andpersonal emails were floodedwith discount offers promot-ing e-cigarettes. Dr Rakesh

    `100 cr drug haul in Patiala

    The Additional DGP, Lawand Order, Dinkar Gupta,and Patiala Senior Superin-tendent of Police (SSP)Hardyal Singh Mannclaimed that Rs 100-croreworth synthetic drugs such asparvon forte, parvon spas,proxyon and spasmocip plusmade from dextro-propoxyphene hydrochloridesalt and banned under theNarcotics, Drugs and Psy-chotropic Substances Act,1985, had been recoveredfrom Karnal-based PioneerPharmaceuticals and Prime

    Pharmaceuticals.The unit was manufactur-

    ing banned drugs and sup-plying these to various partsof the country through a net-work of commission agents,Gupta said.

    He said the recovered drugsincluded 90 kg diphenoxy-late hydrochloride, 65 kgcodeine phosphate and 25 kgpowder (180 kg in all).

    Besides, 7,10,000 capsulesof parvon forte nand spasmo-cip pluse, 6,600 bottles of fan-cidryl, a cough syrup, sevenbags containing blank shellsof capsules and other materi-al required for preparing thesedrugs had been seized.

    Sources said the drug deal-

    ers fled after setting ablazetwo trucks carrying the con-traband.

    "We have taken picturesand are conducting raids tonab the smugglers. Influen-tial persons based in Ludhi-ana and Amritsar who areclose to some politicians arealso under the scanner," theysources said.

    "Owners of the Karnal unit,Prithvi Singh Chaudhary andhis son Pradip Chaudhary,fled abandoning their Innovafollowing the raid. Theywere said to be well- con-nected. The Additional DGPsaid that the border zone hadregistered FIRs against 52top smugglers.

    The records available withthe Health Department state asof October 10, 92 personswere suffering from the dis-ease. District Health OfficerDr Kulwinder Singh said 15teams of health officials hadbeen constituted to survey theaffected areas on a regularbasis. He said to check thespread of dengue the authori-ties fogged the area fromwhere a case was reported.

    An unexpected spell of rainaccompanied by strongwinds came as a bolt fromthe blue for basmati growersin Majha region as it hastriggered apprehensions oflarge-scale loss to the crop.

    Talking to The Tribune,Amritsar Chief AgricultureOfficer Dilbagh SinghDhanju said the rainfall hadled to the flattening of theripened basmati crop, addingthat this would lead to dis-colouration of the grain.

    He said it had rained heav-ily in and around Amritsar,while Ajnala and Majithaareas had reported moderaterainfall. He said the Agricul-ture Department would takestock of the exact lossestomorrow. The farmers wereexpecting a bumper harvestof basmati, but the rainfallseemed to have hit theirhopes adversely.

    Besides the crop, the paddyproduce of farmers lying ingrain markets for procure-ment also got damaged.

    The Delhi Sikh GurdwaraManagement Committee(DSGMC) today appealedto the Sikh community inDelhi to boycott formerDSGMC president ParamjitSingh Sarna for makingone of his aides file a crim-inal petition in the DelhiHigh Court, challenging theauthority of Akal TakhtSahib, the highest temporalseat of the Sikhs.

    The DSGMC president,Manjit Singh (GK), saidwhen the gurdwara com-mittee announced in Junethis year to raise a memo-rial to the 1984 carnagevictims at Gurdwara Rak-abganj Sahib, Sarna moveda petition before the DelhiHigh Court, objecting tothe proposed memorial.

    Subsequently, Akal Takhtissued a notice to Sarnaand the latter withdrew thepetition. To gain lost polit-ical ground, Sarna askedone of his aides to file apetition in the High Court,challenging the authority ofAkal Takht Sahib, ManjitSingh alleged.

    Addressing a press con-ference, he said Sarna hadbackstabbed the Sikhs.Sarna, when approached,

    said: I have nothing to dowith the petition filed byJatinder Singh Saili in theDelhi High Court. I hadfiled a case when theDSGMC announced con-struction of the memorial atRakabganj Sahib. But Iwithdrew it on the advice ofAkal Takht Sahib.

    He said Saili had contest-ed the DSGMC electionsin 2007 as Manjit Singhsman. Despite repeatedattempts, Saili could not becontacted for comment.

    A day after differences inthe Punjab unit came to thefore in the presence of Con-gress vice-president RahulGandhi in Sangrur, theparty high command todayannounced a coordinationpanel for the smooth func-tioning of the faction-rid-den Punjab Pradesh Con-gress Committee (PPCC).

    Approved by Congresspresident Sonia Gandhi, thecommittee has PPCC pres-ident Partap Singh Bajwaas its convener.

    It includes two seniorleaders representing theScheduled Castes andOBCs Mohinder Kaypeeand Lal Singh.

    Former Chief MinisterCapt Amarinder Singh hasnot been named in thepanel. Also, none of thepanel members are countedamong his confidantes.

    The six-member commit-tee convened by Bajwacomprises AICC generalsecretary in charge of Pun-jab affairs Shakeel Ahmed,secretary in charge HarishChoudhary, Congress Leg-islature Party Leader SunilJakhar, former Punjab PCCchief and special invitee tothe Congress Working

    The committee, formed ata time when the PPCC isyet to be reconstituted, willface the daunting task ofuniting the party ahead ofthe Lok Sabha electionsnext year.

    While forming the panel,the party president has donethe balancing act by includ-ing prominent Jat, OBC andSC leaders from the state.

    Importantly, Lal Singhhas managed a plum posi-tion in the Punjab Congress

    soon after he publicly dis-tanced himself from CaptAmarinder Singh.

    In April this year, LalSingh had openly ques-tioned the absence of CaptAmarinder Singh and hisson Raninder Singh at afunction organised inPatiala to host Bajwa onhis first visit to the cityafter taking charge as PPCCpresident. Kaypee, onceconsidered close to CaptAmarinder Singh, has alsodrifted away from the for-mer Chief Minister. He isnow his own man.

    Capt Amarinder Singhswaning influence is evidentfrom the fact that none ofhis aides have found a placeon the coordination panel ata critical time when theCongress is gearing for theGeneral Election.     State decides to adoptRight to Education Act

    Three years after the land-mark Right of Children toFree and Compulsory Edu-cation (RTE) Act was rolledout in India, the state of J&Khas decided to extend theCentral law to its territory.

    The modalities for theextension have beenworked out at the level ofthe state and the adoptionwill happen in the Assem-bly in the next Budget Ses-sion. The Minister forHigher Education for J&Khas informed the HRDMinistry about the decisionand demanded 90:10 cost-sharing pattern between theCentre and the state insofaras funding under the law isconcerned.

    The RTE Act being aCentral law does not applyto J&K, which enjoys spe-cial status under Article370 of the Constitution. Itsthe constraint of fundingwhich has compelled us toextend the Central law tothe state. The state govern-

    ment has made up its mindand we hope to get the RTEAct, 2009, passed by theJ&K Assembly in the nextBudget Session. The adop-tion would help us getfunds and make us account-able in respect of meetingschool infrastructure-relat-ed deadlines prescribed inthe Act, J&K Higher Edu-cation Minister Moham-mad Akbar Lone told TheTribune today.

    The state has requested theHRD Ministry to treat it ona par with northeasternstates while finalising thefunding pattern, which forthe rest of the country is65:35 (Centre-state share).For the North-east this pat-tern is 90:10.

    An analysis of theprogress made under theRTE Act (whose infrastruc-ture-related deadlineexpired on March 31 thisyear) reveals that J&K has along way to go. Only 21.39per cent of the schools in thestate (4,789 out of 22,746)have common toilets and23.12 per cent (5,175 gov-ernment schools) have sep-arate girls toilets. This ismuch less than the nationalaverage of 65 per centschools with girls toilets.

    Even on the other twoinfrastructure indicators drinking water availabilityand ramps for the conven-ience of children with spe-cial needs J&K farespoorly. Nationally, 94.26 per

    cent of all governmentschools have drinking waterfacility in place. The per-centage for J&K however isjust 79.68 (18,123 schoolsout of the total 22,746 gov-ernment schools).

    So far as the ramps go, thestate is among the worstwith only 13 per cent of theschools equipped withramps at a time when thenational average of schoolswith ramps is 61.63 per cent.When asked why the statewas lagging behind, Lonesaid financial crunch washampering improvementefforts and the adoption ofthe Central law would helpthe state address criticalgaps in the elementary levelschool infrastructure.

    The RTE Act (whichpromises free and compul-sory education to childrenaged 6 to 14 years) hadprescribed the completionof school infrastructure-related targets across Indiaby March this year. Thesetargets are yet to be metand all states have beengiven extension.

    Likely to pass the Act in the next Budget SessionThe RTE Act being a Central law does not apply

    to J&K, which enjoys special status under Article370 of the Constitution. Its the constraint offunding which has compelled us to extend theCentral law to the state. The adoption would helpus get funds and make us accountable in respectof meeting school infrastructure-related deadlinesprescribed in the Act

    The J&K Legislative Councilon Friday rejected a resolu-tion seeking 50 per cent reser-vation for women in profes-sional and technical colleges.

    The resolution was movedby a legislator of the rulingNational Conference, DrShehnaz Ganai, who sought50 reservation for women inprofessional and technicalcolleges to empower womenin the state.

    In 1996, Dr Farooq sahib(Farooq Abdullah) took arevolutionary step when hereserved 50 per cent seats forwomen in medical collagesin Jammu and Kashmir.Now you see half of the doc-tors in hospitals are women,Shehnaz Ganai said in theUpper House on the last dayof the session. But if we seethe share of women in otherdepartments in the state, it isvery poor, she said, addingthat it was necessary for theHouse to pass the resolutionon reservation for women.

    Minister for Planning andDevelopment Ajay Sadho-tra, however, spoke against50 per cent reservation forwomen. Our government is

    for women empowerment,but I insist that womenshould compete in variousfields and not look for reser-vation, he said.

    Sadhotra was interrupted byNC member Devender SinghRana, who described the for-mers statement as an act ofmale chauvinism.

    Peoples Democratic Party(PDP) member Nayeem Akhtarand Congress MLC JahangirMir also supported the resolu-tion in their speeches.

    leader Rana, the Congressand the PDP buoyed Ganai,who pressed for a vote onthe resolution.

    But when the resolutionwas put to vote, except Ganaiand the PDP members no onesupported the resolution.Rana and Mir, who in theirspeeches supported womenreservation, did not vote infavour of the resolution.

    The resolution on womenreservation in professional andtechnical colleges was laterdropped by the Upper House.

    Religious nationalism is abhorrent: High Court

    Stating that terms likeHindu nationalism, Muslimnationalism or Sikh nation-alism are abhorrent andantithesis to the Constitu-tion and not recognised by it,the Jammu and KashmirHigh court in a landmark rul-ing has said if India has tosurvive then only Indian-ism has to be there and allother isms have to disap-pear from the firmament ofthe country.

    The court also said therewas no need to bring in theterm secularism in the Pre-amble of Constitution, as thisexpression had evoked a sharpreaction and divided the peo-ple of India into pigeon-holes of different isms.

    These observations weremade by the High Court in itsjudgment while allowing apetition by Kashmiri Pan-

    dits, who had soughtissuance of directions tothe state government andother official respondentsfor protecting and preserv-ing some of their religiousplaces in the Valley.

    Their grievance was thatuncouth attempts havebeen made by some localsand non-locals to changethe status of their reli-gious places into commer-cial places.

    In our constitutionalscheme, a citizen of India isonly an Indian. No personcan claim himself to be aHindu nationalist, Muslimnationalist, Sikh nationalist,Buddhist nationalist orChristian nationalist, thesingle bench of JusticeMuzaffar Hussain Attarobserved in its 22-page judg-ment delivered on Friday.

    Saying that the constitu-tional provisions, in loudand clear terms forbid the

    use of such expressions, thecourt held that any personpersisting with their usehad to be dealt with and pro-ceeded against in accordancewith the mandate containedin the Constitution and otherlaws of the land.

    As already stated, Indiabelongs to Indians, whoconstitute one nation. TheConstitution of India doesnot recognise Hindu nation-alism, Muslim nationalism,Sikh nationalism, Buddhistnationalism or Christian

    nationalism, it said.These expressions denote

    that there is a Hindu nation,Muslim nation, Sikh nation,Buddhist nation or Christiannation. These expressionsor thoughts are antithesis andabhorrent to the Constitutionof India, the court observed.

    The J&K High Court held:If India, which is created byits Constitution, which wethe people have given toourselves, has to survive,then it is only Indianismwhich has to be there and all

    other isms have to disap-pear from the firmament ofthe country called India.

    It further held that therewas no need to bring in sec-ularism in the Preamble ofthe Constitution, as thisexpression has evoked sharpreaction from a section ofpopulation and dividedpeople of the country intodifferent pigeon-holes ofdifferent isms.

    Observing that the Statehas no religion, the J-KHigh court has directed allthe constitutional and statu-tory authorities in India tostop the persons in theirtracks who attempt to sub-vert the Constitution.

    It also directed the ChiefElection Commission toinvoke provision of lawagainst persons who seekrecourse to religious nation-alism and pose a threat to theConstitution and preventsuch people from seeking

    election to Parliament orstate legislatures.

    Stating that the J&K Gov-ernment and its authoritieswere duty bound to redressall genuine and just griev-ances of the petitioners, thecourt directed them to consid-er the pleas of the petitionersin accordance with law.

    The petitioners had sub-mitted that the secularcharacter of the Constitutionwould require the state andits authorities to protect thereligious places of the Kash-miri Pandits in the Valley.

    The petitioners had alsosubmitted that somemahants, who in somecase are non-Kashmiri Pan-dits, have illegally andunauthorisedly createdthird-party interest in theirproperties, which are nowbeing used for commercialpurposes. The petitionershad sought the eviction ofthese illegal occupants.

    Militant attackfoiled in Pulwama

    Policemen guarding aminority community local-ity in Koil village of Pul-wama district today foiled amilitant attack on a policepost and grabbed an INSASrifle from one of the mili-tants which was snatchedaway from a CRPF jawantwo days ago.

    The militants, however,managed to flee. Mean-while, the police claimedthat the INSAS (IndianSmall Arms System) riflerecovered was the one thatwas snatched by militantsfrom a CRPF personnel inthe Tral area two days ago.

    Police said three militantsreached the entrance of thepolice post and tried to fire upon the policeman on duty.

    The police personnel, how-ever, overpowered the mili-tants and snatched theweapon from one of them,said Pulwama Superintendentof Police (SP) Javed Ahmad.

    He said while a scufflewas going on between themilitants and the police-man, a sentry on the secondstorey of the post fired sev-eral rounds at the militants.

    The militants, however,managed to flee the scene,said the SP. A cordon hasbeen laid in the area and amanhunt launched.

    Sources said panicgripped the area after gun-shots were heard.

    The suspected militantshad, however, managed tomake an escape, leavingthe security forces highand dry.

    SC slaps `50,000 fine onHaryana, pulls up HC

    NEW DELHI, OCTOBER 11

    The Supreme Court hasdirected the state govern-ment to pay Rs 50,000 to for-mer Haryana Public ServiceCommission (HPSC) Chair-man GL Batra by way ofcost for forcing him to fighta 16-year-long legal battlesince 1997 for pay andallowances despite his retire-ment in 1999.

    A Bench comprising Jus-tices KS Radhakrishnan andAK Sikri also pulled up thePunjab and Haryana HighCourt for its failure to rem-edy the illegality meted outto Batra, who was the senior-most Additional Secretary inthe Lok Sabha at the time of

    his appointment as HPSCChairman on July 6, 1994.

    The SC set aside the HCjudgment and quashed thetwo state government ordersby which Batras salary wasreduced, besides directingthe state to pay all conse-quential benefits to theretired official.

    The HPSC Chairmanenjoyed constitutional statusand as such the state had nopower to reduce the pay,especially when no masterand servant relationship hasbeen established between aconstitutional appointee andthe state government, theSC ruled in its October 7verdict made available today.

    As Additional Secretary inthe Lok Sabha, Batra wasgetting a salary of Rs 7,500

    a month while on appoint-ment as HPSC Chairman, hissalary was fixed at Rs 7,000.On a representation, the stategovernment raised it to Rs7,500 but withdrew the orderin 1996 and started recover-ing the excess payment. Ayear later, it brought downthe salary further to Rs 4,135a month, forcing Batra toapproach the HC.

    By dismissing his writ peti-tion on November 4, 2009,after conveniently sidetrack-ing and overlooking thelegal points that were infavour of Batra, a DivisionBench of the HC had com-mitted a serious error of thehighest order which is clear-ly inadmissible, the SC held.

    In a similar case involvingHPSC member Ram Phal

    Singh who had been appoint-ed along with Batra, a Judgeof the HC had ruled in favourof Singh. Citing this ruling,another Division Bench ofthe HC had given a similarverdict which was ultimate-ly upheld by the SC.

    Batra had brought all thesefacts to the notice of theBench which chose to ignoreit, the SC pointed out. TheDivision Bench should havereferred the matter to a larg-er Bench, if it was in dis-agreement with the judge-ment of the single Judgewhich had already beenaffirmed by a coordinateBench and on the doctrine ofmerger, the judgment of thesingle Judge had merged withthat of the Division Bench,the apex court explained.

    Residents of Janata Colonydemonstrated in front ofChief Minister BhupinderSingh Hooda's residencehere this afternoon in protestagainst the alleged kidnap-ping of a local jeweller's 21-year-old son last evening.

    Suresh Mittal told media-persons after the protestthat his nephew SandeepJain was kidnapped byunidentified persons whenhe was returning home inhis Maruti car from theirfarmhouse, about 12 kmfrom here on the Rohtak-Bhiwani highway, and therewas no clue till now.

    He said Sandeep was kid-napped around 6:30 pmwhen he was driving backafter fetching milk from thefarmhouse and the familyreceived a call in whichSandeep appealed for help.None of the kidnappers had

    contacted the family till 5 pmtoday, he claimed.

    Suspecting that Sandeepwas kidnapped for ransom,he said his nephew did nothave enmity with anyone.

    He demanded that the mattershould be handed over to thecrime branch for safe recov-ery of the victim and thearrest of the culprits.

    ily preferred to remain mumon the matter. Police offi-cials claimed that the matterwas being probed on a fast-track basis and was likely tothe resolved soon.

    Supply of contaminated waterstopped to Ambala village

    With the authorities sus-pending the supply of con-taminated water in theaffected Indira AvasColony of this village, thesituation is inching back tonormal. However, thosewho have already gotinfected are undergoingtreatment at various health-care centres.

    It was learnt that the vil-lagers were being supplied

    water from a 50-foot-deeptubewell located in nearbyNagal village. The HealthDepartment has declaredthat any water availableabove the depth of 450 feetin this area was unfit forhuman consumption.

    The villagers protested asto why the authorities concerned had not installeda 450-foot-deep tubewellto supply drinking water to them.

    Deputy Commissioner KM Pandurang visited thevillage today and assuredthe residents that all possible steps would betaken to redress their drink-ing water problem.

    Health officials stationedin the village for the pastfour days said that thenumber of diarrhoea casesbeing reported at the spe-cial health camp set up inthe village had gone downsubstantially. As of now,48 patients were undergo-ing treatment at varioushealthcare centres and pri-vate hospitals.

    They also distributedchlorine tablets among thevillagers and advised themnot to consume water with-out boiling it properly. ThePublic Health Departmenthas been asked to ensurethe supply of clean drink-ing water to the residents.

    The Haryana Lokayukta,Justice Pritam Pal, todayissued notices to the ChiefSecretary and certain elec-tronic channels to submitevidence in the cash-for-CLU case showing CDs ofcertain Congres MLAs ortheir kin allegedly demand-ing money for CLU licences.

    The main Opposition, theINLD, had released clip-pings of five CongressMLAs, Ram Kishen Fauji,Vinod Bhayana, Naresh Sel-wal, Jarnail Singh and Ram

    Niwas Ghorela, two clip-pings of Congress MLASampat Singhs son andChief Parliamentary Secre-tary Jaleb Khans son,besides those of Congress-man Sanjay Chokkar, onSeptember 6.

    The release of CDs by theINLD had raised a politicalstorm in the state and forcedthe Hooda Government tomake a reference to theLokayukta to ascertain ifthere was any transaction ofmoney as shown in the CDs.

    Sources said the Lokayuk-ta might issue a notice to theINLD as well.

    However, the INLD hasalready rejected a probe bythe government-appointed

    judge with senior INLDleader Abhay Chautalademanding that the inquiryshould be conducted by a sit-ting judge of the high court.Even the BJP has demandeda probe by the CBI.

    The Hooda Governmentsdecision for a Lokayuktaprobe was seen as a smartmove to put the issue in coldstorage as it would takeseveral months for the probeto be completed due to asevere staff crunch in theoffice of the Lokayukta.Even in the event of the sub-mission of the report, itsfindings would only be rec-ommendatory in nature andnot binding on the govern-ment, sources asserted.

    ` 215.95-cr action planfor womens security

    CHANDIGARH, OCTOBER 11

    The Haryana Governmenthas prepared a Rs 215.95-crore action plan under theNirbhaya Fund of the Centrefor strengthening measuresto curb or deal with crimesagainst women.

    Additional Chief Secretaryfor Home Samir Mathur saidthe Centre had set up Nirb-haya Fund of Rs 1,000 crorefor securing various meas-ures and policies for the pro-tection of women in the coun-try which could be drawn bystates for implementingschemes and programmes toensure security of women.

    The Rs 215.95-crore actionplan had been prepared bythe state government for

    funding under NirbhayaFund to create a strong pro-tection mechanism whichwould ensure security forwomen in the state, he added.

    He said the action planconsisted of women-onlypolice stations, mahilaPCRs, anti-human traffick-ing units, outdoor surveil-lance system, police-com-munity liaison, victim coun-selling centres, women andchild desks at police sta-tions, awareness and self-defence training, increasein strength of womenpolice, protection officerunder Domestic ViolenceAct for each police stationand augmentation of DNAanalysis facility.
