Story of Grandpa, Ely and I -- Page 1 of 12
THE STORY OF GRANDPA, ELY AND I
In 2001, I told my parents that I was getting ready to ask my grandparents for a copy of the will, and then one week later my
grandparents were in a terrible car accident on their way home from a family party – my mother told me it was not a good
time to ask (Note: But it was a good time for my dad to coerce and manipulate a new will). Grandpa told me that he believed
My grandfather, Carlton Leonard, left Illinois and moved to So.
California when he was in his early 20’s. There, he married my
grandmother, Hazel, when my father, Glenn Lear, was a young adult.
As for myself, I was born in 1954, a premature baby with a Learning
Disability due to my father’s alcoholism. Ever since I was a very young
boy, my parents would drop me off at my grandparents for entire
weekends, where the three of us spent a lot of time together and at
their Campo property and home in Imperial Beach, CA. My
grandparents were always happy to have me, called me “Dano”, and
Grandpa would take me everywhere and say “this is my grandson”.
My grand-parents and I were very close and loved each other, and
they always asked my parents if I could spend the weekend. Grandma
always kept Grandpa and I busy. Even though I was only 2 feet tall
they made me feel 10 feet tall. My grandparents came to all the family
gatherings (Easter, Thanksgiving, Christmas, Birthday Parties, etc.).
As I grew up, I would tell my grandparents everything going on in my
life; such as, passing a landscaping certificate, a real estate license,
and contractor’s license before telling anyone else, even my own
parents. My grandparents and I had a special bond, and I always
thought of myself as the chosen one. My grandparents always owned
dogs and treated them as their children. An example of my grandparents love and devotion to their dogs is when they would
visit at family gatherings with their dogs; they would go so far as to leave if there was no shade for their dogs. In 1992, my
grandparents had me meet with them at my parent’s home. My grandfather told me a dog jumped the fence, got their dog
pregnant, that he wanted me to have one of the puppies, and he said that if I took the puppy he would make me his heir. My
grandma called me back after two days and told me “Grandpa loves you and he is serious”, and she told me “Grandpa has
a few friends who want the puppy, but he won’t give anyone the puppy but you because he wants you to be his heir”. Two or
three weeks later, my grandparents met with me again at my parent’s home. My grandpa told me that if I took the puppy that
he would make me his heir, he said “I have a few friends and family I want to give a little money to, but I want you to be my
full heir”. My grandpa told me “quid pro quo”, I said “what does that mean”, and my grandpa said “it means you don’t get
something for nothing”. I said “you got a deal” and we shook hands, and Grandpa said “take good care of him”. (Note: My
grandparents wanted me to be their heir and the dog was a bonus.) A little while later, my grandma asked me how to spell
my name, and then shortly after that my grandma told me that my grandpa took care of me (regarding the Will). In 1993, I
drove my grandparents to Campo and Grandpa asked to stop at a lawyer’s office on 3rd Ave. in Chula Vista (I remember the
location from the Bank of America across the street) – Grandpa said he would be right back that he had to go in and sign
something for me in the lawyer's office (the Will). I recall my grandparents saying the lawyer's name, Floyd Willoughby, on several occasions. I was very excited and told my parents, Jean and Glenn Lear, what Grandpa had done (little did I know,
but my dad was jealous and began plotting how to overthrow Grandpa’s wishes/will). Once when Ranger, the name we
chose for the puppy, was a couple of years old he swallowed a fish hook and I did not have enough money for the vet bill. I
called Grandpa and he said “I don’t care if it’s $5,000, just go be with Ranger”, and Grandpa paid the $1,200 vet bill (Note:
Grandpa was extremely thrifty, such as only giving $1 in birthday cards). Over the years, we took Ranger to my
grandparents for visits and when they would visit at my home Ranger would sit next to Grandpa. Ranger’s doctor knows the
story about Grandpa, Ranger, and I. Audio proof of Ed Leonard/Glenn Lear/Mr. Appel/Cindy Aguilar discussing that Dan is
the full heir (that Carl & Hazel left everything to Dan) available upon request.
my father messed with the brakes; however it was Javier Appel who worked on my grandparent’s cars. In 2013, we found a
witness (who lived in Imperial Beach at that time) to the 2001 car accident, helped them out of the car, and stated to us
there was a problem with the brakes. Grandma was hurt very badly, broke her neck, had a mouth full of stitches, and
remained debilitated until her death 3/30/2003 (one month from the age of 90) (Note: At Grandma’s funeral I wanted to
share the story about the dog and the will, and again my mother told me it was not a good time to talk). Only recently, did I
discover that their wills had been rewritten, through my father’s and Ed Leonard’s (Grandpa’s nephew) manipulations, in
May 2002. My grandma supposedly signed with two witnesses, Mr. Javier Appel (who she did not trust, and she told others
he was too much into their business), and the other signature was by someone who does not exist (address used does not
exist) (Note: Recent discoveries from my dad’s paperwork states that the lawyer was not present, but she stated she was
present at my grandma’s signings). My grandpa had to sign over 20 documents in one day with three different notaries while
his wife was laid up with a broken neck from the accident, and the notary used for Grandma’s will states that she is of good
sound mind and understands everything (a setup) – Grandma’s death certificate says that her cause of death is “debility &
decline” and “end stage Alzheimer’s dementia”. This is UNDUE INFLUENCE. I had a meeting with my father on May 26,
2010, and he said he intercepted my will and met Grandpa at the lawyer’s (a few seconds later, my father changed his story
and said he took Grandpa to the lawyer’s).
Around 2001 my father hired Cynthia (Cindy) Aguilar to clean Grandpa’s home (Cindy had been one of Grandpa’s tenants,
NO criminal background check was ever performed on her, she is a pathological liar, and is a kleptomaniac) and Javier
Appel to be Grandpa’s chauffer (Cindy was a former friend of Mr. Appel’s, and NO criminal background check was ever
performed on him). Cindy was recommended by Mr. Appel and Mr. Appel was recommended by Ricardo Provenlio (Note: I
spoke with Ricardo in 2010. He said he knew a lot but would only talk in court. He said he did a lot of work for Carl and was
never paid a dime. I called him again not long after, and he denied knowing anything and would not help us. Due to his first
conversation being friendly and his second conversation being rude, it was apparent he had spoken with Mr. Appel after our
first conversation.) Mr. Appel would drive my grandpa around, including 100 mile roundtrips to Campo, when he was taking
40 pills a day [including morphine]). Mr. Appel performed several jobs for Grandpa (through Ed Leonard), including:
caretaking, bookkeeping, and managing the caretakers. Mr. Appel and Ed would tell Adult Protective Services that Mr.
Appel did all this because he claimed he was Grandpa’s best friend (but Grandpa told me that he was afraid of Mr. Appel
having too much power over him, and that he’s trying to fire Mr. Appel and Cindy but Ed overruled Grandpa’s wishes). Ed
knows how Grandpa was treated because it was part of their plan together to take down Grandpa (my son, Ely, and I heard
this on the audio recordings and the police have done nothing). Mr. Appel also claimed that he was not paid and that
Grandpa took him out to lunch now and then as payment, but Mr. Appel was paid under the table (Note: Mr. Appel would
take Grandpa to the bank and keep some of the cash, and after Grandpa’s death he was caught by a couple of young
relatives with a safe box full of cash [he told them “drop that, it’s full of cash”, “your grandfather wanted me to have some
money because I can’t work anymore” (Mr. Appel was old and on disability), and “this is where you hide your money if you
don’t want the IRS to find it”]). A review of Grandpa’s bank account will reveal that the cash taken out of the bank weekly
was far more than necessary for a house-ridden elder. After my grandparent’s 2001 accident, my parents moved into the
little house in back of my grandparent’s home – they helped look after Grandma and their bookkeeping. Shortly after
Grandma’s death in 2003, my parents took off on a short vacation. When they came back, Grandpa changed the locks on
his homes and kicked my parents out. Elia, my grandparent’s best friend and renter told us in that in 2003 Cindy stole some
items from Grandpa and blamed it on my parents (Note: At this time, Cindy was working for Ed. Cindy manipulated the
situation because Ed lives back East and it would be easier to steal from Carl). Shortly after my parents removal from
Grandpa’s property, Ed Leonard (Grandpa’s nephew from Illinois who he had only met once his entire life at a family
reunion in 1972 and once about three months before my grandparents car accident in 2001 [Note: My parents went back to
Illinois in 2001 and that is when Ed appeared out of nowhere in California]) stepped in sideways and took over Grandpa’s
affairs and became Power of Attorney (POA) (Note: In May 2009 I asked my grandpa “what did you ever do with Ed” and
he answered “nothing, not one thing” [a licensed caretaker was present to witness this]). Cindy (an unlicensed caretaker
with a criminal record, who writes her own checks [Note: Cindy’s daughter worked for a short time for Grandpa but was
caught and convicted of stealing his checks]) was the main caretaker and Mr. Appel took over Grandpa’s bookkeeping (Mr.
Story of Grandpa, Ely and I -- Page 2 of 12
Appel wouldn’t let Grandpa see his own mail and in 2009 began taking the mail to his own home, and Mr. Appel had
Grandpa sign papers and checks without telling him what he was signing even when Grandpa asked and Mr. Appel would
say “shut up and sign”). A big free-for-all over Grandpa’s assets – Ed didn’t care because he was stealing the larger
money. Elia took care of Grandpa on the weekends as a promise to Grandma to look after Grandpa after her death (Elia
was a renter next door and her pay was a reduction on her rent – Elia was Grandpa’s and Grandma’s true best friend for
35 years). Elia would tell me about Cindy, but it was so hard to believe until after Grandpa cried out to me for help on
Father’s Day 2007, and I ran down there to his home and started living there to protect him.
When I would come over to visit my grandparents, they were always happy to see me, but after Grandma’s death, Grandpa
became a little distant to me when I would come over to visit & would not hug me (Grandpa would say “I can’t hug you” &
look up at Cindy). I later discovered that Cindy, Mr. Appel, Ed, my parents, & other family members were making up stories
about me to Grandpa & telling him that I was crazy & was controlling him. Grandpa fell on 6/11/07 & I visited him in the
hospital. Grandpa believed he was pushed & told this to me the next week (audio available). I visited my grandpa when he
returned home from the hospital, & Cindy invited me to move into the house in the back (Why? To set me up for a crime).
After 6/17/07, Cindy acted like she didn’t know why I was living in the little house. Cindy & Mr. Appel (with Ed’s knowledge)
were overdrugging Grandpa daily (Cindy would also give Grandpa more than one glass of wine within 2-3 hour periods
while he was being over-drugged with Ativan), Grandpa was kept a hostage in his own home (Stockholm Syndrome), &
along with Ed/Jerry/my dad/my ex-wife Vicky they called themselves a “loop”, they wanted Grandpa dead and me out of the
way or in jail.
On Father’s Day, 6/17/07, Elia called me and said that my grandfather wanted to meet me at a local Denny’s Restaurant.
When we got there, my grandpa wanted us to go to another location because he was afraid he was being followed (we
found out later on an audio recording that he was being followed by Mr. Appel). We all met at another Denny’s Restaurant in
La Mesa. Grandpa told me that Mr. Appel had hit him on top of his head, on top of his stitches, with a checkbook (Mr. Appel
claims to be a Pastor at a local church). Grandpa wanted to go see my dad, who lived in Arizona at the time. I called my
dad and he told me not to bring him across state lines (we found out the next day that my dad immediately called Ed
[through later audio recordings, we also discovered that my dad’s orders from Ed were to keep me away and to keep me
under control]). Elia and I then took Grandpa to my home for about an hour, we had a nice visit with my children, and
Grandpa also asked my son, Ely Leeyer, for help (Ely and I were Grandpa’s best family friends). We took Grandpa home
and Mr. Appel was sitting at the kitchen table. Mr. Appel asked Grandpa if he wanted another bump and waived his cane in
the air, then Mr. Appel left. My grandpa asked me to move in to protect him. Grandpa told me he was afraid he was being
bugged, and I said “if you’re afraid you’re being bugged, let’s bug them”. We told Grandpa we wanted to place tapes in the
home and he said “be careful” (Note: We talked to Paul Greenwood, Deputy DA of Elder Abuse Prosecution, and he told
Marcia and I that we could tape in the home. It was at this time that I told Mr. Greenwood that they were going to try to kill
my grandpa by over drugging him. Mr. Greenwood instructed me how to tape and even told me not to worry if it’s hard to
hear because he had ways to make it louder and clearer). I moved in on 6/17/07 and Grandpa asked me to sleep in his
house that evening. The evening of 6/17/07, Grandpa told us he was afraid for his life and his estate by those responsible
for his care, and he told us he wanted to let Mr. Appel and Cindy go (that he didn’t trust them) and he overheard them
talking about his money (Grandpa even called Ed and told him that he wanted to get rid of Mr. Appel and Cindy, that he was
afraid about his money, and to call the police. Ed ignored the request.). At this time, Grandpa did not know that he was
being setup for the last several years (since 2001), and I was also being setup for the future to steal the will from me and
Grandpa.
The next day, 6/18/07, my dad called and said Cindy said that Grandpa told her that I took Grandpa’s wallet and money and
wouldn’t give it back to him, and that I was trying to get Grandpa to sign papers (Note: Cindy had not called Grandpa (or
vice versa) and Cindy had not been over to the house, these are huge lies Cindy told Ed to get me in trouble), I told my dad
that’s a lie. Cindy came over and started yelling at me. Ed called and talked to Cindy and you could hear that she was telling
Ed “yes, that’s what he told me”. Cindy left just when my dad called again, my dad wanted to speak with Grandpa. Grandpa
said he could not hear and asked me to tell him what my dad wanted. My dad asked, again, if I took Grandpa’s wallet and
Story of Grandpa, Ely and I -- Page 3 of 12
tried to get him to sign papers, and Grandpa said “hell, no”. Ed called back and threatened Grandpa with a rest home and
told him not to give me any keys to the office. Grandpa and I met with Elia. Grandpa was calm with us and we felt like a true
group of special family (Grandpa named us “The Three Amigos”). We discussed the commotion and threats that had just
occurred. Grandpa said “they’re trying to isolate me from my friends”, “I’m afraid they might kill me”, “they have that threat
to put me in a rest home, and I don’t want to go to a rest home”, “they may have gotten me to sign something, I’m getting
older and I didn’t know what was good”, “I’m just interested in staying alive”, “I don’t want either of you two to get hurt
either”, and asked us not to give up and said “don’t give up even if I do”.
I was living in the little house in the back (at Grandpa’s request to protect him) until: 1) I heard Ed threaten me with a
“Contract” (we heard them say Ely’s name, but they were whispering in a lower voice, and the authorities have never tried to
hear this); and 2) Cindy called me on 6/22/07 & said that Grandpa thinks the other girls & Mr. Appel are in cahoots to put
him in a resthome & she said that Grandpa trusted me (& she fake cried) & that Grandpa wanted me to stay the weekend
inside the house (Note: I had stayed weekends on his couch before) --then I received another call from our friend Elia that
Cindy was just talking to some guy on the other side of the wall & it looked kind of shady and she said "so I thought I would
call you" -- I stayed away because it was a set up & felt Grandpa would be safer if I stayed away for the weekend. I moved
out because I was afraid for my life, and for the next three ½ months my friend, Marcia, & I woke up at 3 am every morning
and drove from East County to Imperial Beach to visit with Grandpa (to give him strength while I tried to get help for him)
until just before 6 am (when Cindy’s shift began). I would go back home to get ready for work by 6:30 am.
Several conversations were caught on audio recordings regarding my place in the will:
1. On 6/21/07 am, Ed says "this is about a puppy dog, Carl left all of everything he had to Daniel" and Mr. Appel says "do
you want to me to do something", and Ed says "yeah". Then Ed says “we’re buds” (referring to me) and Ed and Mr. Appel
laugh, and Mr. Appel says “and you’re going to try to take everything”. Then Mr. Appel says “it’s better you than him”.
2. On 6/21/07 pm, Cindy, Mr. Appel, Ed, and a licensed caretaker present. Cindy tells Ed “Carl and Daniel talked about the
dog last night, and that Daniel was his heir, and Carl said yeah you're my heir, and Daniel said because I took care of
Ranger”. Ed says “if I hear about that dog again one more time”.
3. On 7/18/07, Glenn says "Here's the deal, you're going to hear a whole bunch of talk, you know that Carl should be fair
with Daniel, you know that he owes him money". Ed says "yeah". Glenn says "he gave him all his income with Hazel but
said I should have known better. Anyways . . . a nightmare. He probably would have done it, but had some time, once it's
over it's over, then it's over". Ed says "yeap, you came on strong when you were trying to ask for it. I know how a Leonard
thinks". Glenn says "you better, you're one of them". Ed says "I mean there's a way. You never want to go for what you want
to start with, you kinda have to go around".
My son, Ely, and I owned a construction company, and Ely gave me time off and funds to save Grandpa from elder abuse
and embezzlement while Ely ran the company (Note: Between 2007 to 2011, I lost over $100,000 for lawyer fees, PI fees,
audio recorders, office supplies, gas, etc.). Ely loved Grandpa very much and would visit him by himself (and sometimes
with his wife, Laurie) quite often (there were always pictures of Ely around Grandpa’s home). Grandpa thought the world of
Ely, his special great-grandson. Ely and I were the most important people on earth (besides Grandma), and my
grandparents left their estate to us.
In August 2007, we discovered that Cindy was caught shoplifting at Albertsons in Imperial Beach in the latter months of
2006. She was caught three times and was barred from the store. In addition to being caught shoplifting, she had Grandpa
with her (this put Grandpa in harm’s way). When we learned about this incident, I contacted the Albertsons Regional Office
and they said they would look into it – I also went to the store and talked to a manager and the clerk who caught Cindy. I
was told that the police were not contacted and a record was not filed because it was too much paperwork (these laws need
to be changed, especially when an elder is used as a human shield).
Cindy has a record of harassment charges from a number of people (including threats of bodily injury to an 8 year old) and
would use Grandpa’s address (including calling him her rich uncle) in court documents. Cindy has a desire to pit family
Story of Grandpa, Ely and I -- Page 4 of 12
members against each other. (Note: Cindy worked in Coronado taking care of other elders after she was fired from taking
care of my grandpa in 2009, with verbal references from Ed Leonard. There is an incident of elder/family harassment in
Coronado that went to court in 2012 [the daughter was given a Restraining Order and her mother was given an Elder
Restraining Order against Cindy]).
In October 2007, Cindy was convicted of felony theft (because she was caught by the law shoplifting so many times) and
she continued to take care of my grandfather (a multi-millionaire elder) with an ankle bracelet. Ed found out about the
October incident in January 2008 and continued to let her work (Note: Ed told Mr. Appel that Cindy assured him she never
stole from my grandfather, and they laughed). A recent discovery was made that a credit card in Grandpa’s name was
reported to the police in November 2008 (we had suspected that Cindy had taken out a credit card because of her
obsession with getting the mail before anyone else and her sneaky phone calls) – this discovery was made in 2011 when
the San Diego police told us there was a record (this record was covered up by Ed).
On or about December 29, 2007, Grandpa was hospitalized for pneumonia (he had been sick with the flu and Cindy had
taken him outside to go to the store several times while he was ill [she liked to take him to the store so she could steal the
change]). Marcia and I visited Grandpa on December 30, 2007, after Elia called me from Grandpa’s hospital room and said
Grandpa wanted to see me. Grandpa expressed to us that he was afraid of Mr. Appel (he was afraid Mr. Appel wanted to kill
him and steal his money) and wanted to let Mr. Appel and Cindy go (I stated that we could call Ed and discuss it with him
when we got home). I did not want to cause problems, so I asked the nurse on duty to listen to his fears. The on-duty nurse
wrote a report about Grandpa being afraid of Mr. Appel and stated that Mr. Appel could not be with Grandpa alone. We
returned on December 31, 2007, and Grandpa wanted the three of us to be the ones to take him home (Elia, Marcia, and I)
so when Cindy showed up Grandpa asked me to ask Cindy to take the day off. I went to the front counter and repeated
what Grandpa said and Cindy went ballistic. She started yelling and took her phone down the hall and called Ed (Cindy was
yelling and talking loud while in front of other sick patients’ rooms). Ed sent something to the front counter and had us
evicted from the hospital. (Note: Grandpa was shaking before we all arrived, he was calm while we were visiting, and began
shaking again when we were evicted from the hospital). Ed arrived in San Diego on 1/1/08 and we happened to have a
recorder still running in the home. From the audio recordings, we discovered that Cindy told a huge lie to Ed that I was
attempting to have Grandpa sign Power of Attorney papers, she said that Elia and Marcia were encouraging him to sign,
and that a security guard witnessed all of this (not only was this a huge lie, but the security guard was our witness not hers
[we have proof Cindy lied]). Ed spent the day calling all the Social Service Agencies he could find to complain about us and
press charges against all three of us (using Cindy’s lie to prosecute us). Ed knew Cindy was a pathological liar, but he used
her lies as fact. Ed called his cousin, Jerry Kistler, and told him “I think we’ve finally got him” and “we can have them thrown
in jail for a year or 2”. Ed even called the stockbroker to complain about me (why?). Ed fired Elia over the hospital incident,
but she had done nothing wrong (Note: Cindy said “one down, one to go”). The case was dropped after Marcia called
Deena Hernandez, Adult Protective Services, and told her Cindy was lying (we had communicated with her previously, and
she believed us [Deena told Marcia that she knew “Danny” only had the best interests of his grandfather]). On 1/24/08, Ed
told Mr. Appel that Deena Hernandez called him to tell him that she was closing the case, that she talked with her
supervisor, and that they both felt he should let Cindy go. Ed said “why” and Ms. Hernandez said “because you can’t have a
felon working for your Uncle”, Ed said “what if I have a different opinion of that” and “what are the ramifications”. Ms.
Hernandez told him he will be liable. Ed said “who’s going to sue me, my cousin Jerry?” and he laughed. (See Tab 13
“Sharps Hospital Report” for complete hospital incident.)
Over the next 2 ½ years, I left audio recorders in the home and caught elder abuse of all types. I reported to the authorities,
but no one ever investigated beyond listening to a couple of audio snippets. (Note: We still have over 1,000 hours that we
have never heard). We reported abuse to Adult Protective Services of San Diego County three times within a 2 ½ year
span, once by my sister Carlene and her daughter Krista, and once by my son Ely on 6/15/08 (when Grandpa fell on Mr.
Appel’s time, was not taken to hospital for over 5 hours, and his injuries included a broken nose), and no one ever
contacted Ely back. Every time we contacted Adult Protective Services, they would contact Ed and tell him I just came by.
Grandpa was coached by Mr. Appel and Cindy to be quiet whenever Adult Protective Services came by or they would put
Story of Grandpa, Ely and I -- Page 5 of 12
him in a home (this was caught on audio. Others involved in the conspiracy would call Cindy's home and go to her home to
visit her (why? did they visit other workers - no). Carl fired Cindy a couple of times, and Ed always hired her back. She told
me (with Carl sitting in the living room) in 2007 "I'm not going anywhere, whether he likes it or not, I'm in it for the long run".
In July 2008, we supplied Adult Protective Services with a few audio recordings of Cindy verbally/mentally abusing Grandpa
& giving him too much wine (Elia's daughter, Venus left the recordings at Alejandra Soto's office). Alejandra Soto, Adult
Protective Services, visited Ed & Margaret (Ed’s wife) at Grandpa’s home on 7/11/08 (we had a tape recorder running in the
home the entire day), and she told them about the audio recordings and about her concerns. Ed and Margaret said the
recordings were illegal, the verbal abuse was only banter and that Grandpa was allowed one glass of wine a day (Note:
several recordings were of Cindy giving Grandpa several glasses of wine within two hour periods). Alejandra also talked
about her concerns regarding Mr. Appel (this was due to the fall on 6/14/08 [entire episode caught on tape] when Mr.
Appel fell asleep while watching Grandpa – Grandpa fell at 3 pm, was not taken to the hospital until 8 pm, almost bled to
death, suffered face cuts/bruises/broken nose, and Adult Protective Services caught Mr. Appel lying about how he fell and
the timing of how long he waited to take him to the hospital), she gave Ed information for a company that could take over his
duties and oversee the situation, and Ed told Alejandra that Mr. Appel is not paid and that Mr. Appel is his surrogate (Note:
Mr. Appel was paid cash under the table every time he took Grandpa to the bank). Margaret told Alejandra that if they let
Cindy and Mr. Appel go, then “those two” (Elia and I) will take over. After Alejandra left, Ed and Margaret told Mr. Appel and
Cindy we were taping and they allowed Mr. Appel and Cindy to continue taking care of Grandpa. Also on 7/11/08, Mr.
Appel told Margaret (Ed’s wife) that Cindy was stealing from Grandpa (and one way she was stealing was that she was
keeping the change from when she took him shopping); Margaret told Mr. Appel that there were more problems if Cindy was
gone; Margaret told Mr. Appel to leave smaller bills and that if she kept the change it’s not going to matter because he can’t
see; Margaret said “it’s not a priority issue”; and Margaret told Mr. Appel “the thing of it is you keep those two at bay”. Ed &
Margaret’s main concern was to keep us away from Grandpa at all costs.
In January 2009, a licensed caretaker from Stay at Home Solutions was fed up with Cindy abusing Grandpa and getting
away with it (she had been told by her boss to stay out of it, that he was a rich old client & they didn’t want to cause waves –
and she was aware that we were trying to get Adult Protective Services to listen to us, but we were constantly stonewalled).
She complained to Kathy Ocampo, Social Services for Hospice, about Cindy giving Carl too much wine and abusing him.
Cindy found out and told her that she knew she was the one who complained (that it was not Dan this time). Cindy told her
that her aunt works for Adult Protective Services (Cindy’s Aunt Karina works at Adult Protective Services, and we found a
Karina Valdez, Social Services In-House Supportive Services, at Adult Protective Services [her birthday is May 16] – to-date
no one has followed up on our evidence). That evening when the licensed caretaker went to her car, the tires were slashed
– she went to file a report with the police and was told it was her word against the others. Cindy also threatened people,
frequently, that she had relatives in the Hells Angels. Ed and Margaret told both girls not to fight. In February 2009, Cindy
became meaner in her abuse of Grandpa (a pattern of Cindy whenever she was caught about anything). The verbal abuse
was so bad that Cindy even told Grandpa that she was going to kill him. Grandpa told Mr. Appel that he was afraid Cindy
was going to try to kill him. (Note: Cindy did not want anyone else watching Grandpa, she was responsible for the removal
of at least three other caretakers [one left because she was afraid for her safety after Cindy threatened her & set her up for
missing pills; Elia was fired after being set up by Cindy over the hospital incident; and one was fired after being set up for
over-drugging Grandpa when he fell on 6/14/08]. Also, another caretaker (Ruth) was threatened by Mr. Appel over the
6/14/08 fall -- Ruth was asking Mr. Appel how Grandpa fell & Mr. Appel said "if you don't quit asking so many questions,
you're going to look like him".)
Ed fired Cindy in March 2009 because it was getting too hot keeping her employed, she was fighting with another caretaker
for turning her in to Social Services (Note: Was the November 2008 credit card fraud one reason she was fired? And if so,
why wasn’t she turned over to the police for it.). Ed allowed Cindy to continue to visit & contact Carl, & was even invited to
Carl’s 100th birthday party & funeral (Note: Ed should not have allowed her to return or contact Grandpa).
Ed slandered me with lies to everyone (Social Services, Hospice, the stock broker, other caretakers, etc.), he told them I
was crazy (I only have a Learning Disability with paperwork), that I made prank phone calls (these were made by Cindy and
Story of Grandpa, Ely and I -- Page 6 of 12
we have audio proof), that I attempted to get Carl to sign POA papers at the hospital (this is a lie told by Cindy, See Tab 13),
and that I have done this before (See Tab 1, Document 5).
My grandpa was worth about $50 million and no one has ever investigated the finances for financial abuse. Cindy and Mr.
Appel were stealing from the cash/bank accounts and Ed had control of the stocks (Ed did not receive/review bank account
statements, and Cindy and Mr. Appel had free reign to his cash/bank account [Cindy would write her own checks]). After
Grandpa’s death, family members told me that a lawyer letter to my dad stated that Grandpa’s estate is worth $11 million
(the “Trust Balance Sheet” for 12/29/09 shows this amount was changed to $8 million), but this amount is much less than
should be there, so Ed had to have liquidated stock assets before Grandpa passed away. A financial investigation will prove
embezzlement at many levels. (Note: I was completely taken out of the redone will, but it had been Grandpa’s and
Grandma’s wishes that I be taken care of by them). Three interesting pieces of information are: 1) My brother reminded me
that many years ago Grandpa held a family party to celebrate a $7 million real estate transaction; 2) Sempra stocks should
be much higher (years before Grandma died, my brother asked Grandma and Grandpa for an interview with SDG&E and
he was surprised when the interview was with the President of the company); 3) On 1/29/09 Ed, Margaret (Ed’s wife), Mr.
Appel, and the stock broker talked with Grandpa in his home about how many CDs and how much money he had at the
banks, but a review of the Trust Balance Sheet shows a different amount (Note: How could a house-ridden 99 yr. old elder
with bad eye sight spend hundreds of thousands of dollars in the ten months prior to his death). A new trust balance sheet
has just been discovered (that is supposed to represent June 30, 2010 but was printed the same day as the trust balance
sheet that is supposed to represent December 29, 2009) and all the bank amounts have been moved around so that it
appears there was more money in the banks. Also, 12/29/09 balance sheet shows a car worth $4,500 and it is not listed on
6/30/10 balance sheet (this car was given to Mr. Appel). Another document has just surfaced showing $30,000 was given to
Mr. Appel in April 2011 (and $995 on June 8, 2010), and the document claims that Mr. Appel was never paid by Grandpa.
On one of the last audio tapes Ed discussed with Mr. Appel how to get $45,000 to him without Carl finding out and
suggested to use his son’s name (this was for a leg injury Mr. Appel claimed was from lifting Grandpa, but he had this injury
for years). (Note: Mr. Appel took Grandpa to the bank every week and kept some money as payment under the table [one
audio recording mentions $300 a week], and Mr. Appel had a safe box full of cash after Grandpa’s death (caught by two
young relatives) – how much money did Mr. Appel get away with?)
Ed and Mr. Appel (mostly in 2009) would have Grandpa sign documents without telling him what they were, Grandpa was
told “shut up and sign it” and “just sign it”. Ed would take these documents back to Illinois and Mr. Appel would take papers
home. (Note: Grandpa’s eyesight was deteriorating and he could not read the documents.) On one occasion (early 2009)
Mr. Appel took Grandpa to the bank about a mile down the street, they were gone two hours, and when they returned a man
came to the house. Mr. Appel said “you got here quick”, and Mr. Appel said it was to complete the transfer they started in
the bank for $100,000. Grandpa was given papers to sign and was told “just sign”.
We contacted Paul Greenwood several times; he told us that we needed an incident report before he could do anything
(when we first contacted Paul Greenwood, his Assistant, Norie, looked up Cindy’s criminal background and told us “she
shouldn’t be watching anybody, she shouldn’t be watching anyone’s dog" and then she told me to keep a log). We reported to
Adult Protective Services three times, we went to the police (the police told us to leave or we would go to jail – Ed had them
in his back pocket [Ed said “they can go to the police all they want, but they won’t get anywhere” and he and Mr. Appel laugh
about it]). With the help of a Private Investigator (Darryl Carlson), in September 2009, we got the police to start an
investigation. Shortly after the police investigation began, my PI and I visited Mr. Greenwood’s office (we were not able to see
Mr. Greenwood personally). I pleaded to his office for something to be done as soon as possible because of Grandpa’s age,
that this has been going on for a long time, that I am afraid for my family and my safety, but they put us at the end of the line.
Marcia and I visited Grandpa four days before he passed away, and he was overly-drugged by the two caretakers Elena and
Edith (two caretakers from Stay at Home Solutions brought in after Cindy was fired) and couldn’t even open his eyes. The two
caretakers were singing (so he couldn’t talk to us) and kept trying to stick a half-eaten cough drop in his mouth (he could
have easily choked) – Grandpa told me “help me”, “love you”, and “sorry” – I cried, but could not call the police because they
would turn it on me. Grandpa died on 12/28/09, and we called Detective Lazare (the Detective assigned our case) the
Story of Grandpa, Ely and I -- Page 7 of 12
next day and requested an autopsy (we were suspicious that the two caretakers, Elena and Edith, were over-drugging
Grandpa at the direction of Mr. Appel). We could not reach Det. Lazare, so we contacted Paul Greenwood and he said
leave a message for Det. Lazare, and I said “I’m telling you Paul, because you’re her boss”. An autopsy was never
performed. Det. Lazare told us she was closing the case, that my grandpa died at 100 and the tapes did not prove anything,
she said she cannot do anything with audio because she cannot see it. Paul Greenwood told us he was backing his
Detective. Mr. Greenwood and her Sergeant told us that Det. Lazare had 52 cases (they both spoke with Ed and we were
stonewalled again). I told Paul Greenwood from the beginning that these people (Cindy, Mr. Appel, and Ed) were going to
try to kill him by overdrugging him – two lawyers and a PI also complained to Paul Greenwood that I had real evidence –
and there was no autopsy or suspicious death recorded. Ed Leonard had the authorities in his back pocket (Note: Ed is a
rich nephew worth multi-millions (so he claims) (Note: A lawyer, Steve Boehmer, recently looked up his finances and only
saw that he makes $56,000 a year from his farm). Ed once held a political function on his ranch for the first Obama
campaign. Ed held a high position on the IFC (Illinois Finance Committee) which was a pet program of Blagojevich, the
former IL Governor who tried to sell Obama’s Senator seat. Ed made contributions to Blagojevich and Ed’s daughter, Anna
Leonard, received an IL Assistant State Atty General job. Ed has judges in his family. Ed is a charmer with a Chicago mob
mentality and influenced the authorities against taking any action [he spoke with Det. Lazare and Paul Greenwood], and
Anna Leonard spoke with the DA. Kathy Ocampo, Hospice Social Services, told one of the licensed caretakers in 2009 that
she believed Ed does not care about his Uncle.)
At Grandpa’s funeral in January 2010, my family was not mentioned and not allowed to speak at the service, and my
parents were not invited to ride in the limousine. I saw Ed point me out to the Police who were on hand for the drive to the
cemetery (my immediate family asked me to keep quiet, so I kept quiet, but I did not want to). Shirley Kistler (Jerry’s wife
[Jerry is Ed’s cousin]) gave the speech at the service. Shirley only mentioned their family (and it was apparent she did not
know his life at all, because his life was in San Diego with my family), there were no photos shown of my family, and
Shirley called Cindy an “Angel” and said that Mr. Appel was Grandpa’s “best friend” (both lies). The minister, Rev. Solomon
from Hospice, said that Grandpa met with him a couple times and he said “Carl was worried that he wasn’t going to go to
heaven”. At the end of the church service, Pat Ahern (Grandpa’s Stockbroker) came up to me and said “how much money
do you think your Grandpa had?”, I replied “50 million”, Pat gave me a strange look like “uh” and walked away (Note: Pat
and I had never met (I recognized him from pictures on the Internet), he did not ask who I was or say “hello”, he just asked
this question and walked away). At the cemetery, the minister gave his condolences to the Leonard family and did not
mention me or my family (who he had spent most of his life with). Ed, Jerry, and their wives left before Grandpa was
lowered into the ground, and my father followed them. Cindy, her husband, and their daughter were at the funeral and left
early (Note: Grandpa’s home was broken into while everyone else was still at the funeral dinner, valuables were stolen out
of the house, and sentimental items between my grandpa and I [bows/arrows, old pipes, a special hat, etc.] were broken or
stolen on purpose against me).
I went to Grandpa's home after it had been sold. I spoke to a relative of the owner who was doing some
construction work and asked if they found any papers in the walls, he said they didn't but they sure burned a lot of
papers -- he showed me a deep hole that had been dug with paper ashes and stuck a stick in it to show me it was
very deep, and he thought that was odd and wanted me to see it (this hole was right next to the little office in the
ground).
I have not stopped trying to get justice for my grandpa’s abuse. In an attempt to reunite my family (my siblings and my
parents) and get their assistance, I attempted the following family meetings:
1.) In March 2010, I had my siblings to my home. I played them audio recordings and showed them documentation, but
they did not want to believe the audio recordings and any involvement by my dad (Note: we gave them some audio
recordings to take with them). The next week my siblings all went to visit my parents (without me) to discuss my evidence
with them. After their visit at my parent’s home, the first thing that was told to me was “why should you get all grandma’s
property too?”, and "dad was afraid you were getting everything".
Story of Grandpa, Ely and I -- Page 8 of 12
2.) On May 26, 2010, I met with my parents at my brother Matt’s home (Matt Lear is Facilities Manager for Public Works/City of El Cajon) to try to work together as a family and protect my dad (if he will tell the truth). The first thing my father
said was that my brother told him I would have split it with him (referring to the will), and that he just wanted me to know
that he believes I would have. My father became irate and said “you ain’t got shit, just get the hell out of here, quit spending
your money because you’re not going to get anywhere, go on, get get, shoo shoo, we’ll see your ass in court, you ain’t got
shit”. As they were leaving, my sister Brenda said “I told them to give you a million dollars because Grandma told me you
were supposed to get a million dollars for taking care of the dog”, my father gave her a button your lip hand signal (his
fingers to his lip), and they drove off. I grew up in the “Leave it to Beaver” days, and I thought my family loved me. I thought
we were very close, and my dad never spoke to me like this, or anybody ever. At that time I found myself with no parents,
siblings, aunts/ uncles, nephews/nieces. Everybody knew but my kids and I that the will was changed (even my ex-wife
knew and didn’t tell my kids and me – she said “I didn’t want to get in the middle of you and your parents”).
3.) My brother told me that he believes Ed is a thief who has taken advantage of our father. In February 2011, my parents
asked me to come to their home and to bring Marcia and my lawyer. I thought my dad was going to come clean about the
will because he was dying from Parkinson’s, so I hired an estate lawyer, Dick Murphy, to go with us (we found him in the
Yellow Pages and met him for the first time on that date). We went to my parent’s home on February 25, 2011. When we
arrived at my parent’s home in Alpine (a home they just bought with funds they were due from Grandma’s estate) my
mother cleared the coffee table and told the lawyer he could put everything there, but we did not because we believed the
visit was regarding my dad coming clean about the will and we brought an estate lawyer we had just hired (it was
immediately clear that my parents did not want to tell the truth, but wanted to see what evidence we had that the estate
was worth more than Ed had provided in the Final Trust Balance Sheet, because they believe Ed is stealing from them and
wanted to see what papers I have that might help them). I spoke to them about Ed coming out of nowhere (that Grandpa
had only met Ed once at a family reunion in 1972, and that I knew mom and dad went back to Illinois around 2001 and met
with Ed regarding Grandpa’s estate). My mom then told a wild tale: she said that was not true that Ed had been out a lot
and that my sister Pam was going to marry Ed at one time – Pam had a bewildered look on her face, the family chuckled,
and asked Pam when they were dating. My dad went in the backroom and called Ed, after he talked in the back for a few
minutes he brought the phone into the living room, the phone was placed on speakerphone and Ed was asked about
Grandpa’s assets that had not been sold yet. I asked my brother to ask Ed what was in the bank vault and Ed said there
was just an old vehicle registration and some old papers that he gave to the lawyer (he asked twice and Ed said the same
thing twice) – Grandpa kept valuables and my will in that vault (the lawyer, Mr. Willoughby, told me he tells all his clients to
keep a copy in their bank vault). After the phone call, I played some audio recordings of my dad and Ed saying that my
grandparents gave everything to me – this made them mad and they kicked me out (I was only trying to bring everyone
together to work together). As we were leaving, my mom said “I’m going to have you two investigated by the FBI”. Ed had
them brainwashed that he was a “sweet, old farmer”. My father was jealous, and in 2001 began the downward spiral of
Grandpa and Grandma’s abuse/ embezzlement/murder to assure his place in the will.
On April 15, 2011, I received an unknown phone call and they asked if I was Daniel Leeyer and hung up. I immediately hit
redial and they answered “FBI”, you could hear it was an office in the background, and they hung up. The phone number
showed up as “00”, but could not be redialed again.)
On Easter 2011, my 29 year old son Ely listened to some audio recordings with a new set of headphones (“Monster Beats”
by Dr. Dre). After listening, Ely’s jaw dropped and he told me “Dad, I thought you were only supposed to get a million
dollars”, I said “no son, I’m the full heir, I just don’t brag about it” (Ely was not about to break up the family over one million
dollars). Ely was my only child invited to my parent’s house, because they thought they had control over him and wanted
to get information about what I was up to (I have a learning disability with paperwork and Ely is very intelligent – my
parents [and all of their coconspirators] were never worried about me, but they were worried about Ely). Ely and I took care
of each other, Ely always was my best friend and strength, our leader. Ely left to go to my parent’s Easter celebration (no
one else in my immediate family was invited) at my sister’s home. Ely visited with everyone for awhile (even played some
golf in their backyard) and as he was leaving he confronted my dad. Ely told my dad “I know the truth, I heard the tapes”, my
Story of Grandpa, Ely and I -- Page 9 of 12
dad said “your dad is crazy”, Ely said “no, he’s not”, my dad said “let’s go outside and talk”. Another family member went
outside and my dad did not have a chance to talk to Ely and my dad left. (Note: My dad would have called Ed the minute he
got home, because he always did.) Ely went back inside and told my sister, Brenda, that his dad has all the evidence he
needs to break down the current will (this is the will written May 2002 that Grandpa signed under duress/threats to remove
me from the inheritance so my dad, Ed, Jerry Kistler, Leonard Dirksen and their wives could take everything – it’s all caught
on tape several times and we have witnesses) and Ely then told Brenda “we just need to get the name of the lawyer that
Grandpa had before”. Brenda said “I’ll ask Cindy, she’ll know”, and Ely yelled at her and said “no you won’t, Cindy’s the one
that’s been telling Grandpa she’ll kill him, she’s the bad person” – then Ely left (Note: Brenda would have called Cindy and
Cindy would have called Ed). Two days after Ely visited my family on Easter and my dad called Ed, Ed's lawyer requested funds to pay Javier Appel $30,000 as soon as possible - See Document 8 (odd that this was not done sooner and why at this time). A few days after Ely visited my family on Easter, Ely called his motorcycle case lawyer in search of legal assistance for me regarding my will.
On May 18, 2011, Ely was shot in his garage and passed away on May 19, 2011. I discovered shortly after, that some
workers at a competing waterproofing company had been discussing that Ely was about to receive a lot of money from a
motorcycle case and that Ely was going to help his father get a lawyer to go after his grandfather’s will – the discussion was
between “Gary Slavin” (who had been a good friend to Ely and me) and his coworker “Doug Miner” (who has been working on
Grandpa’s Campo home for Mr. Javier Appel). A week after Ely’s passing, I found out that Doug had been bad-mouthing Ely
both in the town of Campo and at construction sites, as our waterproofing company has taken jobs away from their company
and their income has dramatically dropped. (Note: Doug talked with Mr. Appel, and Mr. Appel called Ed, See Document 8 regarding $30,000 paid to Mr. Appel during this time frame). I called Gary (about one week after Ely was shot) and asked him about what was said to whom, and he told me “oh shit, I didn’t want anything like that to ever happen to Ely”. My ex-wife Vicky
is the one who told Gary everything about Ely receiving monies from his court case and helping his father go after the will, she
also gave Gary bid numbers/inside information for a multi-million dollar construction job (and other jobs) one week after Ely’s passing and deleted data off the computer. UPDATE: June 2014, Marcia and I went to Grandpa’s Campo property to eat lunch in the driveway. As we were travelling on the road, we saw Doug Miner's mailbox and I was showing Marcia the boundary line of Grandpa's property to Doug's property (we never knew he was right next door, I thought he lived further down the street) and then I saw Doug come out of his barn. Doug flung his arms from behind his back (he might have been hiding a gun behind him because of the way he flung his arms away from his back) and into the air waving a gesture and yelling “Dan, what the fuck? What the fuck, Dan?” and started to walk towards us like he was looking for a fight and we just left without a word or response. We had our lunch in grandpa's driveway and left. My sister, Brenda just told me that in June or July 2014, Ed called her and told her that Mr. Appel got a call from Doug (a neighbor in Campo, California) stating that Danny Leeyer was up at the Campo house. He said Danny was telling him that the house was his and it wasn't for sale, and a few other things that she can't remember. Ed sold the property immediately in July 2014. Brenda also told me that Ed is a nice guy and gave them each $10,000, but not me (Note: This all took place during the same time frame as PERT came after Dan.)
It is important to note that all those involved in the abuse/embezzlement/murder of my grandpa do not want to be caught – they
are not worried about me, but Ely was smart and was the President of our waterproofing construction company – now they have
a problem. Ely told them he knows the truth now and he’s getting a lawyer to get the will for his dad. Just a month after Ely was
shot, Marcia and I saw my parents in a store parking lot, my mother got out of her car, we parked in back of her, I yelled "hey mom", and my mother yelled "ha ha you're living in hell", and I just left (we never got out of our vehicle). My brother told me recently that my mother then called my brother and said I parked next to her so close she couldn't get out of the car and yelled at her, he then had the police go over and write up a report against me (I was long gone) (Notes: 1) I do not know if my brother is telling me the truth because I have seen no documentation; 2) My desire is to forgive my mother if she will tell the truth [she even sent me a Christmas Card for the first time in about 5 years]).
I found one of Ely’s journals from December 2010. There is an entry that Ely made a call to Joel Bryant. Joel Bryant is a civil elder
abuse attorney, who we have seen on a couple of occasions (I had no idea that Ely had contacted him).
Story of Grandpa, Ely and I -- Page 10 of 12
In searching for my will I found Michael Green, a lawyer located in a section of Chula Vista where my grandpa did some of his
personal business (I remembered this area from when my grandparents took me there about 20 years ago, and my grandfather
said he had to go into the lawyer’s office and sign something). Michael Green states he does not have the will, but his
comments change every time he speaks to someone. (Note: Michael Green took over his law practice from Floyd Willoughby
over 17 years ago, so it was actually Floyd who did the will in 1993. Floyd left all his files/clients with Michael.)
We had an appointment with the Chief of Police on January 26, 2012 (we gave him everything we had and even talked to him in
his office for about an hour - we enjoyed meeting him, and believed he would do something, but we never received a follow-up).
We talked to the Chief’s Secretary the last week of August 2013 to ask about a follow-up, and never received one.
A couple of weeks before we were able to see Chief Lansdowne, I talked to the San Diego Police Officers at the front counter
to begin my request to see the Chief. Officer Harvey #4534 asked me what’s going on and I started to tell him. He asked me
if I was off my medication, what kind of medication did I take, he told me you’re not going to see the Chief until you get a
doctor’s notice that you’re mentally OK, and escorted me to the door in front of everybody and belittled me and made me feel
threatened.
I went to my car and made a call to Internal Affairs. Sgt. Shawn Takeuchi told me to come back in and he escorted me right
past the Officer who was rude to me (my friend Marcia came in with me this time). First I complained about the Officer at the
front counter, and then we told him why we wanted to see the Chief. Sgt. Takeuchi looked up Carlton Leonard in the police
records, and he told us he could not find anything except a November 2008 report where someone took out a credit card in
Carlton’s name (we had suspected Cindy did this for some time because Elia [Carl’s best friend/weekend caretaker told us
that Cindy always came by before the mail arrived}, but it had never been verified).
We went to see the FBI on January 6, 2012 and gave them a smaller version of our transcripts/audio recordings, but never heard
back from them (this was our second time, as we previously went to the FBI back in 2008 with our lawyer - no response).
In January 2012, I contacted Paul Greenwood and told him that I have evidence on the financial abuse and that no one has ever
looked at it. He told me to take it to the South Bay Police Dept. so they can give it to him. I took it down to the South Bay Police
Dept. and spoke with Officer Cardona. Officer Cardona said she could not give it to Mr. Greenwood without talking to him first, she
said she tried to reach him, I got the runaround and no one ever took it, and she said I had to come back down and pick it up.
When I first spoke with Paul Greenwood’s office in 2007, I spoke with Norie, his assistant – Norie looked up Cynthia Sue Aguilar’s criminal background and told me “she shouldn’t be watching anybody, she shouldn’t be watching anyone’s dog” and she told me to keep a log.
We have also sent evidence packages to the following list:
1. All San Diego News & Union/Tribune & even LA news stations and papers (they will not give us the time of day)
2. National News programs (such as 20/20, etc.) - no response
3. Senators - they say they can't do anything
4. National Elder Abuse - no response
5. State Attorney General's Office - they say they can't do anything
6. California Governor Jerry Brown – he stated to contact State Attorney General’s Office
Story of Grandpa, Ely and I -- Page 11 of 12
One week before Ely was shot, we (Marcia, Vicky (my ex-wife), and I) met with Hardy Gold, State Deputy Attorney General for
Elder Abuse, and to tell him that I was afraid for my family’s lives. He listened to us for two hours and looked at a list of audio
recordings, but told us it was out of his jurisdiction because Grandpa was not in a rest home or a group home. He told us he has
been in this field for over 20 years and he wouldn’t have given us 5 minutes if he didn’t believe we had something. All he could do
was give us advice on how to proceed. He told us we need to locate the will and follow the money trail and we needed to find
wrongdoings by the Power of Attorney. He told us that criminals slip up and make mistakes, and that there are possibly people
who were not paid or agreements not kept. Vicky should have told him all she knew, I asked her why didn’t you speak up, she
said “he’s not the right person to tell”, and I disagreed. (Note: After Ely was shot, Vicky told me and our kids “they’ve been stealing
your will for over 10 years”.)
My father, Glenn Lear, passed away January 2013 and my family attempted to hide it from me (they did not even have a funeral).
I found out through a family friend calling to offer his condolences and I confirmed it through the San Diego County Recorder’s
Office. I’ve asked my brother, Matt Lear, and my sister, Brenda Bonn, for a copy of my dad’s will, but they will not give it to me.
I have been talking to and giving my evidence to Ely’s SD Sheriff’s Homicide Det. Palmer, and our family and I have had several
meetings in 2011. Det. Palmer had reviewed my evidence with me in April 2014, but was taking too long to get back to me for
another meeting to continue reviewing my evidence, so I forwarded this flash drive to those who could help move the investigation
along. Apparently, I angered Det. Palmer’s superiors and there was an attempt to 5150 me on July 30, 2014. I did not come out of
the house that day, but on August 6 we received an email that Det. Palmer was at the DA’s office, so we packed a few items and
a tent. We were going to come home the first week of November, but another group came up to my home on November 5 looking
for me (unknown if they possessed a fake badge) – did this come from Edward Leonard or Applied Restoration. We are still in
hiding waiting for the truth to come out and feeling like I have no freedom to keep investigating and just walk around like a normal
person. I’ve lived in San Diego all my life and now I’m being kicked out of town – on 7/30/14 the officer in SWAT gear stood right
in front of my window to scare me and I will never forget his face. All I ever wanted was a real investigation – wouldn’t you if this
happened to your son or daughter? Because I know it’s been a setup.
My brother Matt and sister Brenda have recently begun to assist me, as they are interested in finding embezzlement by Edward
Leonard. My brother Matt believed our grandfather’s estate to be at least $30 million and that he once saw a check for $7 million
on grandpa’s table. Brenda and Matt want to do a forensic accounting to all the banks and to check for forged signatures. We
know our family has been ripped off for millions. The next step is a Tort Challenge, Tortious Interference with an Expectancy of Inheritance or Gift.
I have not stopped in my pursuit for justice for my son, Ely, for my grandparents, and for our family. I need everyone to call the
news stations and demand a story be made, please, so that I know when it’s safe to come home, back to San Diego and to keep
my kids safe from the crooks and the San Diego authoritative agencies.

With Ely’s death and all this trauma, I had to close my business (Note: Our company was doing around $2 million and was on the
verge of $5 million.). The “loop” stole my retirement money, I am currently unemployed, I have no income (we are surviving on Marcia's small pension), have possession of my son’s three dogs (I had two, this makes five dogs [Note: one of my dogs passed
away because I lacked the funds for a thorough vet examination that would have saved her life]), & I have lost my home of 30 yrs.
