Gawler East Development Plan Amendment—Prepared by the Minister—Draft For Public Consultation
NOTICE is hereby given that the Minister for Urban Development and Planning, pursuant to sections 24 and 26 of the Development Act 1993, has prepared a draft Gawler East Development Plan Amendment (DPA) to amend the following Development Plans:
• Corporation of the Town of Gawler;
• The Barossa Council.
The draft DPA proposes to rezone approximately 400 hectares of land on the eastern fringe of the township of Gawler (one of the new areas included in the adjusted urban boundary), along with some of the areas adjacent to it that were already in the urban boundary, to allow for residential development and associated community facilities. The area contains a disused quarry (referred to as the ‘Rinker’ site) which is intended to be rehabilitated.

The land encompasses portions of the suburbs of Gawler East, Gawler South (within the Town of Gawler) and Kalbeeba (within The Barossa Council).
The draft DPA will be on public consultation from Thursday, 21 May 2009 to Thursday, 16 July 2009.
Copies of the draft DPA are available during normal office hours at the Department of Planning and Local Government, Level 5, 136 North Terrace, Adelaide and the following locations:
• The office of The Barossa Council, 43-51 Tanunda Road, Nuriootpa, S.A. 5355.
• The office of the Corporation of the Town of Gawler, 89 Murray Street, Gawler, S.A. 5118.

The public meeting may not be held if no submissions are received or if no-one requests to be heard. FISHERIES MANAGEMENT ACT 2007: SECTION 115
TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, the holder of a Prawn Fishery Licence issued pursuant to the Fisheries Management (Prawn Fisheries) Regulations 2006, for the Gulf St Vincent Prawn Fishery listed in Schedule 1 (the ‘exemption holders’), or their registered masters, are exempt from the notices made under section 79 of the Fisheries Management Act 2007, prohibiting the taking of western king prawns (Melicertus latisulcatus) but only insofar as the exemption holders shall not be guilty of an offence when using prawn trawl nets in accordance with the conditions of their fishery licence for the purpose of stock assessment survey (the ‘exempted activity’), subject to the conditions contained in Schedule 2.

1. The exemption is valid from 0630 hours on 19 May 2009 until 0630 hours on 21 May 2009.
2. All trawling activity must be completed by 0630 hours on each day with nets out of the water.
3. The exemption holder must comply with instructions from the SARDI Stock Assessment Co-ordinator and work within the allotted survey trawl stations.
4. All fish, other than prawns, southern calamary (Sepioteuthis australis) and slipper lobster (Ibacus spp.) taken during the exempted activity for stock assessment purposes, are to be returned to the water immediately after capture.
5. Prawns, southern calamary and slipper lobster taken pursuant to the exempted activity must not be retained by the exemption holder, their agent, crew or any other person.
6. Prawns, southern calamary and slipper lobster taken pursuant to the exempted activity must be disposed of by the exemption holders in accordance with the ‘GSV Prawn Fishery Survey Participation Agreement’ and must not be retained by the exemption holder, their agent, crew or any other person.
7. While engaged in the exempted activity or while unloading the survey catch, the exemption holder must have on board their boat or near their person a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested.
8. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any other regulations made under that Act except where specifically exempted by this notice.

NATIONAL ELECTRICITY LAW
UNDER section 41 of the National Electricity Law (NEL), the Australian Energy Market Commission (AEMC) gives notice of the following direction from the Ministerial Council on Energy (MCE), received on 11 May 2009.
Pursuant to section 41 of the NEL, the MCE directs the AEMC to conduct a review of the effectiveness of National Electricity Market (NEM) security and reliability arrangements in light of recent extreme weather events. In identifying options for addressing issues raised by these events, the AEMC shall have regard for the need for actions to be proportionate, as well as the value of stability and predictability in the energy market regime.
The AEMC’s review is to provide advice in relation to the generation and transmission elements of the power system. While matters relating to the performance standards of distribution networks are the responsibility of jurisdictions, the MCE appreciates any advice the AEMC can provide to ensure network security and reliability. This review should be consistent with, and draw on, a number of reviews and rule change proposals being progressed by the AEMC and the Reliability Panel.
In the context of extreme weather related events such as droughts, heatwaves, storms, floods and bushfires, the AEMC is directed to:
• examine the current arrangements for maintaining the security and reliability of supply to end users of electricity and provide a risk assessment of the capability of those arrangements to maintain adequate, secure and reliable supplies,
• provide advice on the effectiveness of, and options for cost-effective improvements, to current security and reliability arrangements, and, if appropriate,
• identify any cost-effective changes to the market frameworks that may be available to mitigate the frequency and severity to the security and reliability of the power system.
The MCE considers that any recommendations arising from the review should also identify, where applicable, possible benefits or lessons for the broader energy market framework.
The MCE does not anticipate that this review will result in a fundamental revision of the electricity market design.
The AEMC is to report by 29 May 2009 on measures that are currently under consideration that would improve system reliability and security and any further cost-effective measures that could be taken in the short term that would impact on system reliability for the summer of 2009-2010.
The AEMC is to report by 30 October 2009 on any cost-effective changes that could be made to energy market frameworks that would improve system reliability in the longer term and contribute to the more effective management of system reliability during future extreme weather events.

PURSUANT to section 128 of the Natural Resources Management Act 2004, I, Jay Weatherill, Minister for Environment and Conservation, hereby authorises the taking of water from wells within the McLaren Vale Prescribed Wells Area prescribed under the Water Resources (McLaren Vale Prescribed Wells Area) Regulations 1990, as set out within Schedule A below for the purposes set out in Schedule B and subject to the conditions specified in Schedule C. The water user must not adjust or alter the meter without the Minister’s authority. 9. The water user must not permit sand, soil or any other material to be deposited on or around a meter. 10. The water user must not permit deposits of sand, soil or any other material to build up around a meter. 11. The water user must keep vegetation cleared away from the meter. 12. The water user must not damage or destroy the meter.

IN pursuance of a precept from the District Court of South Australia to me directed, I do hereby give notice that the said Court will sit as a Court of Oyer and Terminer and General Gaol Delivery at the Courthouse at Port Augusta on the day and time undermentioned and all parties bound to prosecute and give evidence and all jurors summoned and all others having business at the said Court are required to attend the sittings thereof and the order of such business will be unless a Judge otherwise orders as follows:
Monday, 1 June 2009 at 10 a.m. on the first day of the sittings the only business taken will be the arraignment of prisoners in gaol and the passing of sentences on prisoners in gaol committed for sentence; the surrender of prisoners on bail committed for sentence; the surrender of persons in response to ex officio informations or of persons on bail and committed for trial who have signified their intentions to plead guilty and the passing of sentences.
Juries will be summoned for Tuesday, 2 June 2009 and persons will be tried on this and subsequent days of the sittings.

PURSUANT to section 44 of the Radiation Protection and Control Act 1982, I, Keith Baldry, Director of the Radiation Protection Division of the Environment Protection Authority, being a person to whom the powers of the Minister under that section have been delegated under the Act, exempt the specified employer, VivoPharm Pty Ltd from the requirements of Regulation 18 of the Radiation Protection and Control (Ionising Radiation) Regulations 2000, subject to the following conditions:
(1) the radiation worker handles only unsealed radioactive H-3 in Type C premises; and

A COMPLETE hydrographic survey of all berths and the channel of the Port Adelaide River has recently been carried out. This survey has shown that portions of a number of berths are not at their declared depths, namely:
Flinders Ports are about to commence a maintenance dredging program to correct this situation.
Mariners intending to use these berths in the Port Adelaide River should contact Flinders Ports on (08) 8447 0623 to confirm the maximum allowable draft until further notice.

WATERWORKS ACT 1932
Restrictions on the Use of Water—Eyre Peninsula
PURSUANT to section 33A of the Waterworks Act 1932, the South Australian Water Corporation (SA Water) with the approval of the Minister for Water Security with effect from midnight on 30 June 2009 revokes the notice of Eyre Peninsula water restrictions imposed by notice dated 3 December 2002 (published in the Government Gazette on 5 December 2002) and, further pursuant to section 33A of the Waterworks Act 1932, SA Water with the approval of the Minister for Water Security with effect from 1 July 2009, until further notice hereby prohibits, restricts and regulates the purposes for which water supplied to properties by SA Water may be used, the manner in which water may be used, and the means by which water may be used, and the times at which water may be used as set out in the Schedule within the following Water Districts (‘WD’) and Country Lands Water Districts (‘CLWD’) on the Eyre Peninsula: Arno Bay WD, Ceduna WD, Cleve WD, Coffin Bay WD, Cowell WD, Cummins WD, Haslam WD, Kimba WD, Lipson WD, Lock WD, Louth Bay WD, Minnipa WD, Poochera WD, Port Lincoln WD, Port Neill WD, Rudall WD, Smoky Bay WD, Streaky Bay CLWD, Streaky Bay Township WD, Tod River CLWD, Tumby Bay WD, Ungarra WD, Warramboo WD, Wirrulla WD, Wudinna WD, Yaninee WD and Yeelanna WD or from a pipeline situated within any of the above Water Districts or Country Lands Water Districts (either directly or indirectly).

WATER RESTRICTIONS—LEVEL 3—ENHANCED—EYRE PENINSULA
PURPOSE WATER RESTRICTIONS
GARDENS and LAWNS Watering cans and buckets may be used at any time to water outdoor trees, shrubs, plants and lawns.
Hand-held hoses fitted with a trigger nozzle or drip-watering system may be used for a maximum of 3 hours per week to water outdoor trees, shrubs, plants and lawns in accordance with the following:
• Even numbered properties on Tuesday and Saturday between either 7-10 a.m. or 4-7 p.m.
• Odd numbered properties on Wednesday and Sunday between either 7-10 a.m. or 4-7 p.m.
All sprinkler systems are prohibited for use in watering outdoor trees, shrubs, plants and lawns.
SPORTS GROUNDS and RECREATIONAL FACILITIES
Hand-held hoses fitted with a trigger nozzle may be used on any day but only before 8 a.m. or after 8 p.m.
Watering cans and buckets may be used at any time.
Sprinkler systems may be used once a week between the hours of 8 p.m. and 8 a.m. The day of the week and time of operation for each of the sprinkler systems is to be determined in conjunction with SA Water and subject to a permit.
Testing of sprinklers will not be permitted without prior approval of SA Water.
HARD SURFACES Water must not be used to wash paved or concreted areas, decking, walls or roofs of a building at any time unless it is necessary to do so to protect public health, ensure safety of people using the area, ensure the health and welfare of animals using the area or in case of accident, fire or other emergency.
Windows may be cleaned from a bucket filled directly from a tap.
FOUNTAINS and PONDS A fountain, pond or water feature that does not recycle water must not be operated and must not be topped up unless it supports fish.
The level of water in a fountain, pond or water feature that recycles water may be topped up only with water from a hand-held hose or bucket.
SWIMMING POOLS and SPAS
Existing pools and spas must not be refilled from empty. The level of water in a swimming pool or spa that has been previously filled with water may be topped up or maintained only with water from a hand-held hose or bucket. New pools or spas may be filled only under the authority of a permit from SA Water. A permit will not be granted unless there is proof a cover has been purchased to prevent water loss through evaporation. Children’s wading pools must not be filled with more than 250 litres of water.
WASHING CARS and BOATS Water must not be used to wash a vehicle except by means of a commercial car wash or a bucket filled directly from a tap. Hoses are not to be used. Boat owners are permitted to flush out motors and rinse off metal parts to prevent corrosion.
BUILDING DEVELOPMENT/ CONSTRUCTION ACTIVITIES
Water must not be used for dust suppression and compaction unless it is applied from a hand-held hose fitted with a trigger nozzle or directly from a motor vehicle designed and approved to carry/deposit water.
FARMS or RURAL PROPERTIES USING SA WATER SUPPLY
A farm dam or tank must not be filled with water unless it is being used for domestic or stock consumption or fire-fighting. A permit is required to fill a dam or tank for any other reason. If a rainwater tank has been plumbed directly into a house by a licensed plumbing contractor it is acceptable to have a quantity of mains water in the tank.

PURPOSE WATER RESTRICTIONS
COMMERCIAL NURSERIES and GARDEN CENTRES
Hand-held hoses fitted with a trigger nozzle, watering cans, buckets and drip-watering systems may be used at any time to water plants in commercial nurseries and garden centres. Sprinkler systems may be used between the hours of 8 p.m. and 8 a.m. On days when the maximum temperature is forecast to exceed 30 degrees sprinkler systems may also be used between the hours of 1 p.m. and 2 p.m.
CARAVAN and CAMPING SITES
PERMITS ARE REQUIRED TO WATER OUTSIDE THE GARDEN AND LAWN GUIDELINES. Permits allow watering under the following conditions: October-March Grassed sites that have been damaged by cars, caravans and/or tents may be watered with a
sprinkler for not more than 30 minutes on the day the area is vacated. If grassed areas are not being used then they may be watered with a sprinkler no more than once per week, for no more than 30 minutes at any time.
April-September Grassed sites that have been damaged by cars, caravans and tents may be watered with a
sprinkler no more than once per week at any time for no more than 30 minutes at any time.
Using water in a manner other than in accordance with the specified restricted use of water above is prohibited except under authority of a permit issued by SA Water pursuant to the Waterworks Regulations 1996.

NOTICE is hereby given that the Minister for Urban Development and Planning has approved the establishment of a Car Parking Fund by the Clare & Gilbert Valleys Council, pursuant to section 50A of the Development Act 1993.
The Car Parking Fund applies to the following designated area of the Clare and Gilbert Valleys Development Plan, the District Centre Zone, as designated on Maps CGV/23, CGV/25, CGV26 respectively of the Clare & Gilbert Valleys Council Development Plan. The fund shall be known as the Clare & Gilbert Valleys Council Clare Car Parking Fund. The Council has determined that the contribution rate per car parking space will be $3 500 (GST exempt) for development approval providing cash payment in lieu of car parking spaces. The rate may be varied by further determination, notice of which will be published in the Gazette.
Pursuant to section 50A of the Development Act 1993, the Car Parking Fund will come into operation upon publication of this notice.

DEVELOPMENT ACT 1993
Cleve Coastal and General Development Plan Amendment— Draft for Agency and Public Consultation
NOTICE is hereby given that the District Council of Cleve has, pursuant to section 24 of the Development Act 1993, prepared a draft Development Plan Amendment to amend the DC Cleve Development Plan.
The Development Plan Amendment will amend the DC Cleve Development Plan by:
• Converting the existing Development Plan to the Better Development Plan format which includes the replacement of general and council wide policy with a range of general policy modules and the replacement of existing zone names and zone policy with new zone names and policy suitably amended to meet local circumstances.
• Redefining the boundary of the Coastal Conservation Zone to ensure that the outcomes sought in the Eyre Peninsula Coastal Development Strategy are more readily achieved.
• The creation of an Airfield Zone on the eastern boundary of Cleve.
• The deletion of the Tourist Accommodation Zone in the southern portion of the Cleve township and its replacement with a Residential Zone.
In order to prevent inappropriate development and promote orderly planning, the draft DPA has been granted ‘interim authorisation’ by the Minister, giving the amendment immediate effect.
Copies of the draft Development Plan Amendment will be available for public inspection and purchase during normal office hours at the Council Office, 10 Main Street, Cleve and on the Council website at www.cleve.sa.gov.au.
The draft Development Plan Amendment will be on display from 21 May 2009 until 23 July 2009.
Written submissions regarding the draft Development Plan Amendment should be submitted no later than 5 p.m. on 23 July 2009. All submissions should be addressed to Tony Siviour, Chief Executive Officer, District Council of Cleve, P.O. Box 36, Cleve, S.A. 5640 and should clearly indicate whether you wish to be heard in support of your submission.
Copies of all submissions will be available for inspection by interested persons at the District Council of Cleve Offices, 10 Main Street, Cleve from 27 July 2009.
A public meeting will be held on 12 August 2009 at the Council Offices, 10 Main Street, Cleve, at which time interested persons may appear to be heard in relation to the draft Development Plan Amendment and the submissions. The public meeting will not be held if no submissions are received or if no submission makes a request to be heard.

Review of Elector Representation—Extension of Public Consultation Period

DUE to one existing vacancy and a second vacancy created by the election of Councillor Brenton I. Vanstone to the position of Mayor, a supplementary election will be necessary to fill two Area Councillor vacancies.
The voters roll for this supplementary election will close at 5 p.m. on Friday, 29 May 2009.
You are entitled to vote in the election if you are on the State electoral roll. If you have recently turned 18 or changed your residential or postal address you must complete an electoral enrolment form, available from post offices or online at www.ecsa.sa.gov.au.
