DETERMINATION AND REPORT OF THE REMUNERATIONTRIBUNAL

NO. 5 OF 2003

Alternative Vehicle Request—Judge Brian Gilchrist

1. The Remuneration Tribunal received a request from JudgeBrian Gilchrist in relation to the use of the conveyanceallowance to obtain a vehicle from Fleet SA, which is notmanufactured in South Australia. The request is due to hisfamily circumstances as none of the vehicles made in SouthAustralia have a large enough seating capacity toaccommodate his family.

2. Senior Judge Jennings has provided a letter of support forJudge Gilchrist’s request and advised that he has nodifficulty in the alternative vehicle forming part of the fleetof vehicles provided to the Judges of the IndustrialRelations Court of South Australia.

3. The Tribunal sought advice from the Commissioner forPublic Employment in relation to how similarcircumstances would be treated for public sectorExecutives. The advice received supported the request.

4. The current determination relating to ConveyanceAllowances (Determination 5 of 2001) states:

‘an alternative vehicle may be supplied where requiredbecause of a Judge’s, Court Officer’s or StatutoryOfficer’s disability. The annual charge for the use of thevehicle will be calculated on the same basis as thecalculation made by the Commissioner for annualcharges for use of motor vehicles by Executives.’

5. The Remuneration Tribunal has considered JudgeGilchrist’s request, the comments of Senior Judge Jennings,and having regard to similar circumstances for Executiveshas no objection to the proposal. However, as the requestedvehicle is not in the schedule of vehicles in the currentConveyance Allowance Determination of the Tribunal, theTribunal makes this specific determination to allow JudgeGilchrist to be supplied with a Toyota Tarago Wagon.Judge Gilchrist will be required to pay the differencebetween the annual charge payable determined by theCommissioner for Public Employment for a Berlina sedan,less the sum of $758 and the annual charge payabledetermined for the Toyota Tarago, less the sum of $758.

6. The current annual charges payable, as determined byCommissioner for Public Employment, are $12 312 for aBerlina sedan and $14 012 for a Toyota Tarago GLi 8seater, 2.4 L Automatic, 4 door Wagon.

7. All other conditions of the current Conveyance Allowance(Determination 5 of 2001) as amended from time to timecontinue to apply.

Date of Operation

This determination will come into operation as from 15September 2003.

FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act1982, Tom Robinson, Coorong Cockles Pty Ltd, P.O. Box 659,Goolwa, S.A. 5214 (the ‘exemption holder’), or a person acting ashis agent, is exempt from clause 109 of Schedule 1 of theFisheries (General) Regulations 2000 but only insofar as he maytake Goolwa cockles (Donax deltoides) from Goolwa Beachduring the period 18 October to 21 October 2003 (the ‘exemptedactivity’) subject to the conditions set out in the Schedule below:

SCHEDULE 1

1. The exemption holder may take a maximum of 100 kg ofGoolwa cockles (Donax deltoides) in total during the period 18October to 21 October 2003.

2. Before taking any cockles pursuant to this notice, theexemption holder must contact the PIRSA Fisheries ComplianceUnit on 1800 065 522, at least 24 hours prior to commencing theexempted activity and provide the following information:

• details of the persons who will be undertaking theexempted activity;

• the proposed locations on Goolwa Beach at which theexempted activity is to be conducted;

• the dates on which the exempted activity is to beconducted;

• the quantity of cockles expected to be taken on those dates.

3. While engaging in the exempted activity, the exemptionholder or a person acting as his agent must be in possession of acopy of this notice. Such notice must be produced to a PIRSAFisheries Compliance Officer if requested.

4. The exemption holder must not contravene or fail to complywith the Fisheries Act 1982, or any regulations made under thatAct, except where specifically exempted by this notice.

This proclamation may be cited as the Statutes Amendment (Road Safety Reforms)(Commencement) Proclamation 2003.

2—Commencement of Act and suspension of certain provisions

(1) The Statutes Amendment (Road Safety Reforms) Act 2003 (No 8 of 2003) (the AmendmentAct) will come into operation on 19 September 2003.

(2) The operation of—

(a) sections 5 to 23 (inclusive) of the Amendment Act; and

(b) section 25 of the Amendment Act; and

(c) sections 27 to 34 (inclusive) of the Amendment Act,

are suspended until a day to be fixed by subsequent proclamation.

1—Short title

These regulations may be cited as the Occupational Health, Safety and Welfare VariationRegulations 2003.

2—Commencement

These regulations will come into operation 12 months after the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specifiedregulations varies the regulations so specified.

Part 2—Variation of Occupational Health, Safety and WelfareRegulations 1995

4—Variation of regulation 2.2.5—Toilets

(1) Regulation 2.2.5(3)(c)—delete paragraph (c) and substitute:

(c) if situated at a temporary workplace—

(i) within the metropolitan area or a township—must be a waterclosetattached to a sewer or septic tank, or a water flush chemical closet;

(ii) outside the metropolitan area or a township—must be a waterflush chemical closet, an earth closet, or a system that complieswith the Public and Environmental Health Act 1987; and

(2) Regulation 2.2.5(3)—after paragraph (c) insert:

(d) must be maintained in a clean and hygienic working condition.

(4) However, a toilet need not be provided at a temporary workplace if—

(a) premises with a clean and hygienic toilet facility are reasonablyaccessible on the site; and

(b) the owner of the premises has given permission for peopleworking on the site to use the facility; and

(c) the number of people working on the site at any one time does notexceed 5 people.

(4) Regulation 2.2.5—after subregulation (5) insert:

1—Short title

These regulations may be cited as the Education Variation Regulations 2003.

2—Commencement

These regulations will come into operation four months after the day on which they aremade (see Subordinate Legislation Act 1978 section 10AA).

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specifiedregulations varies the regulations so specified.

5—Substitution of regulation 7

Regulation 7—delete the regulation and substitute:

Part 2A—Control of trespass and misbehaviour onschool premises etc

7—Definitions

(1) In this Part—

authorised person, in relation to a school, means—

(a) a member of the police force; or

(b) an officer of the teaching service; or

(c) a person appointed under section 9(4) of the Act to teach at theschool; or

(d) a person authorised by the Minister for the purposes of this Part;

prohibition notice—see regulation 7C.

(2) For the purposes of this Part, a person trespasses on school premises if—

(a) the person is on school premises between the hours of 12.00midnight and 7.00 a.m. unless the person—

(i) carries a security pass issued by the Director-Generalauthorising the person to be on those premises at thattime; or

(ii) carries a security pass issued by the Commissioner ofPolice authorising the person to be on those premises atthat time; or

(iii) carries the written permission of the head teacher to be onthe premises at that time; or

(b) the person fails to provide sufficient reason for being on thepremises after being requested to do so by an authorised person.

(3) For the purposes of this Part, a person misbehaves on school premises orpremises used in connection with a school if the person, while on thepremises—

(a) uses offensive language; or

(b) puts or threatens to put at risk the safety or welfare of anotherperson; or

(c) behaves in an offensive, disorderly, intimidating or violent manneror threatens to behave in such a manner.

7A—Offence to trespass or misbehave on school premises etc

A person who trespasses on school premises or misbehaves on schoolpremises or premises used in connection with a school is guilty of anoffence.

Maximum penalty: $200

Expiation fee: for an offence not involving violence—$50.

7B—Power to request person to leave school premises etc

(1) If an authorised person reasonably suspects a person of—

(a) trespassing on school premises; or

(b) misbehaving on school premises or premises used in connectionwith a school; or

(c) committing or threatening to commit any other offence on schoolpremises or premises used in connection with a school,

the authorised person may request the person to leave the premises.

(2) A person who has been requested to leave premises under subregulation (1)must not remain on the premises or return or attempt to return to thepremises within 24 hours.

Maximum penalty: $200.

Expiation fee: $50.

7C—Power to bar person from school premises etc

(1) If a head teacher is satisfied that a person has—

(a) trespassed on school premises; or

(b) misbehaved on school premises or premises used in connectionwith a school; or

(c) committed or threatened to commit any other offence on schoolpremises or premises used in connection with a school,

the head teacher may, with the approval of the Director-General, issue theperson with a prohibition notice, being a notice in writing served on theperson personally or at his or her last known address, barring the person,unconditionally or subject to conditions, from entering or remaining on thepremises specified in the notice for a period not exceeding 3 monthsspecified in the notice.

(2) A person who contravenes or fails to comply with a prohibition notice isguilty of an offence.

Maximum penalty: $200.

Expiation fee: $50.

7D—Minister may review prohibition notice

(1) A person who is barred from premises under a prohibition notice for aperiod exceeding 2 weeks may apply to the Minister for a review of thenotice.

(2) The Minister may, on the hearing of an application for a review of aprohibition notice, confirm, vary or revoke the notice.

(3) A prohibition notice continues to apply pending a determination by theMinister of an application for review of the notice.

7E—Power to restrain, remove or refuse entry

An authorised person may, if necessary, use reasonable force—

(a) to restrain on school premises or premises used in connection witha school any person who, in the opinion of the authorised person,is posing an immediate threat to the safety of another person, so asto prevent the person from causing harm to that other person; or

(b) to remove from school premises or premises used in connectionwith a school any person who, in the opinion of the authorisedperson, is posing an immediate threat to the safety of anotherperson on the premises; or

(c) to remove from premises, or prevent the entry to premises of, anyperson who has been requested to leave the premises under thisPart during the previous 24 hours or who is barred from thepremises under a prohibition notice.
