AMENDMENT TO THE SALISBURY (CITY) DEVELOP- MENT PLAN

Preamble It is necessary to amend the Salisbury (City) Development Plan dated 22 August 2013.

NOTICE PURSUANT to Section 29 (2) (b) (ii) of the Development Act 1993 (the Act), I, John Rau, being the Minister administering the Act: 1. Amend the Salisbury (City) Development Plan dated 22

August 2013 by replacing the following ‘form of development’ in the non-complying list of the Industry Zone:

‘Road transport terminal where it is located in the Infrastructure Policy Area 9’.

with: ‘Road transport terminal where it is located in the

Infrastructure Policy Area 9 at Walkley Heights’. 2. Fix the day on which this notice is published in the Gazette

as the day on which the Amendment will come into operation.

Part 6—Registration of Political Parties NOTICE is hereby given that the following application for registration as a registered political party under the provisions of PART 6 of the Electoral Act 1985, has been received. Any elector who believes that the party should not be registered: • because the party does not have as a purpose, the

promotion of the election to the State Parliament of its endorsed candidate(s); or

ENVIRONMENT PROTECTION ACT 1993

Granting of an Exemption THE Environment Protection Authority has issued an Exemption to Ottoway Engineering Pty Ltd to be exempted from Section 34 of the Environment Protection Act 1993, in respect of the requirements of Clause 23 of the Environment Protection (Noise) Policy 2007, to exceed permitted noise levels on a non-domestic Premises. This Exemption relates to night roadwork activities at the road intersection of Coghlan and Victoria Roads, Outer Harbor for the period of 30 August 2013 through to 31 December 2013 inclusive. It is anticipated that any night-time construction works to install a new pipeline will be undertaken over a weekend beginning at 12 midnight on Friday and concluding at approximately 2.30 a.m. on the following Monday, when conducive weather conditions permit such works to be undertaken. Approval of Category B Containers I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Approval of Category B Containers Approve as Category B Containers, subject to the conditions in subclauses 1, 2, 3 and 4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; and (d) the name of the holders of these approvals. (1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for

containers of that class. The Authority specifies the following refund markings for Category B Containers: (i) ‘10c refund at collection depots when sold in S.A.’, or (ii) ‘10c refund at S.A./N.T. collection depots in State/Territory of purchase’. (2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to

containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B Containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

BY virtue and in pursuance of Section 72 of the Supreme Court Act 1935 and all other enabling powers, We, Judges of the Supreme Court of South Australia, make the following Supreme Court Civil Rules 2006 (Amendment No. 24). 1. These Rules may be cited as the Supreme Court Civil Rules 2006 (Amendment No. 24). 2. The Supreme Court Civil Rules 2006 are amended as set out below. 3. This amendment will commence on 1 October 2013, or upon its gazettal, whichever is the later. 4. A new Rule 140A is inserted after Rule 140 as follows: ‘Rule 140A—Documents comprising or recording pleaded facts (1) A party may, within seven days after the filing of the first defence or

affidavit in lieu of a defence in an action, file and serve a notice requiring each party to produce for inspection by any other party all documents in the party’s possession which:

(a) are referred to in a pleading or affidavit filed in lieu of pleadings; or (b) evidence key events referred to in a pleadings or affidavit filed in lieu

of pleadings. (2) Subject to subrule (3), a party on whom a notice is served under subrule

(1) must produce for inspection by any other party the documents referred to in that subrule:

(a) in respect of pleadings or affidavits already filed, within seven days; and

(b) in respect of any later pleading or affidavit, at the time of filing of that pleading or affidavit.

(3) If a party objects to producing a document for inspection on the grounds of privilege, or other ground, the party must inform in writing each other party of that objection, the nature of the privilege claimed and the grounds on which it is claimed.’

(4) For the avoidance of doubt, Rule 145 does not apply to the obligations of a party under this rule.

Tobacco Products Regulation (Exemption—Maggie Stone) Proclamation 2013 under section 71 of the Tobacco Products Regulation Act 1997

1—Short title This proclamation may be cited as the Tobacco Products Regulation (Exemption—Maggie Stone) Proclamation 2013.

2—Commencement This proclamation comes into operation on the day on which it is made.

3—Interpretation In this proclamation—

Act means the Tobacco Products Regulation Act 1997;

prescribed period means the period commencing on 8 October 2013 and ending on 17 December 2013;

prescribed production means the stage production of Maggie Stone produced by the State Theatre Company of South Australia.

4—Application of proclamation This proclamation applies to the following persons:

(a) a person employed by, or in relation to, the prescribed production;

(b) an occupier of the Space Theatre, Adelaide Festival Centre;

(c) an employer with responsibility for a workplace consisting of the Space Theatre in relation to the prescribed production.

5—Exemption from section 46 of the Act (1) A person to whom this proclamation applies is exempt from the operation of section 46 of

the Act in relation to smoking occurring in the course of a performance or rehearsal of the prescribed production during the prescribed period.

(2) An exemption under this clause is subject to the following conditions:

(a) smoking may only occur on a stage on which the prescribed production is being performed or rehearsed, or in a rehearsal room used in relation to the prescribed production;

(b) the area in which smoking may occur under the exemption must be well ventilated;

(c) the audience for a performance of the prescribed production must be warned that there will be smoking during the performance;

(d) a person may only smoke a tobacco product of a kind contemplated by paragraph (g) of the definition of tobacco product in section 4 of the Act.

(b) the person has been refunded a contribution from the Fund (other than a refund for low value cattle contributions determined in accordance with regulation 6A).

Regulation 6A—delete the regulation and substitute:

6A—Refunds for low value cattle contributions (1) A person who has paid low value cattle contributions during a financial

year may, at any time until 31 July in the following financial year, by notice in writing to the Minister, make a claim for a refund for those contributions.

(2) A person claiming a refund under subregulation (1) must supply the Minister with—

(a) evidence acceptable to the Minister of the contributions in respect of which the claim is made; and

(b) if required by the Minister, verification of that evidence in the form of a statutory declaration.

(3) If the person satisfies the Minister that the person is entitled to a refund under this regulation for contributions paid by the person, the Minister must refund to the person the total amount of those contributions.

6B—Refunds for contributions other than low value cattle contributions

(1) A person who has paid contributions (other than low value cattle contributions) during a financial year may, within the 12 months following that financial year, by notice in writing to the Minister, make a claim for a refund for those contributions.

(2) A person claiming a refund under subregulation (1) must supply the Minister with—

(a) evidence acceptable to the Minister of the contributions in respect of which the claim is made; and

(b) if required by the Minister, verification of that evidence in the form of a statutory declaration.

(3) If the person satisfies the Minister that the person is entitled to a refund under this regulation for contributions (other than low value cattle contributions) paid during a financial year, the Minister must refund to the person an amount determined in accordance with the following formula:

(i) the reasonable operating and management expenses of the body;

(ii) promoting the cattle industry;

(iii) participation of the body in regional, State or national cattle industry forums;

(iv) undertaking or facilitating research and development, or the collection and dissemination to cattle producers of information, relevant to the cattle industry and, in particular, to the improvement of practices in the industry;

(v) fees for affiliation of the body with regional, State or national bodies representing or promoting the interests of the cattle producers;

(vi) other purposes of the body;

(2) Regulation 7(2)—delete "under a program funded under subregulation (1)(c)" and substitute:

funded by payments from the Fund

10—Insertion of regulation 7A After regulation 7 insert:

7A—Exchange of information The Minister may provide a body to which payments are made out of the Fund under regulation 7(1)(da) with information identifying persons who have paid or been refunded contributions under these regulations.

4A—Instruments of unlawful gaming (1) Pursuant to section 59A of the Act, an amusement machine with the

characteristics of a gaming machine (within the meaning of the Gaming Machines Act 1992) is declared to be an instrument of unlawful gaming.

(2) For the purposes of this regulation—

(a) an amusement machine includes any device designed or adapted for the purpose of enabling a person to participate in a game of amusement; and

(b) an amusement machine will be taken to have the characteristics of a gaming machine if—

(A) it simulates the operation of a gaming machine by the use or depiction of a spinning reel; or

(B) it is marked as a gaming machine or pokie or is described in any advertising, instructions or packaging as a gaming machine or pokie; or

(C) in the instructions for its operation, or in its operation, it uses or displays a word associated with gambling such as gambling, bet or jackpot or a derivative of such a word.

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.

(iii) by a method involving spraying,

the person is guilty of an offence. Maximum penalty: $10 000.

(3) If a person uses an agricultural product of a kind specified in the left column of the table in Schedule 2 Part 2 as referred to in subregulation (2)(c), the person must—

(a) make a record of that use in a manner and form approved by the Minister; and

(b) keep that record for a period of 2 years from the date of the making of the record; and

(c) keep the record readily accessible for inspection on request by an authorised officer.

Maximum penalty: $2 500. Expiation fee: $210.

Hackham South East Development Plan Amendment— Public Consultation

NOTICE is hereby given that the City of Onkaparinga, pursuant to Sections 24 and 25 of the Development Act 1993, has prepared a Development Plan Amendment (DPA) to amend its Development Plan. The Hackham South East DPA is in response to the land being brought into the urban boundary in 2007 by the State Government. Given the localities proximity to existing built up areas and significant infrastructure investment in the region (such as the Southern Expressway duplication and Seaford rail line extension), this land will contribute to the State Government’s objective of a 15-year zoned supply of land for residential development. The area affected by the proposed DPA is generally described as the land situated east of Gates Road, north of Hepenstal Road and south of Penneys Hill Road/Penneys Rise in the suburbs of Hackham and Onkaparinga Hills. Currently the land is Rural Living Zone with allotments in the order of one hectare (10 000m²). The DPA proposes to change the Onkaparinga Development Plan by introducing a Residential Zone and Local Centre Zone. Public consultation on the DPA will be from Thursday, 12 September 2013 to Friday, 1 November 2013.

LIGHT REGIONAL COUNCIL DEVELOPMENT ACT 1993

Better Development Plan (BDP) Conversion Development Plan Amendment—Draft for Public Consultation

THE Light Regional Council has prepared a draft ‘Rural Living’ Development Plan Amendment (DPA) which is now released for public consultation. Council has worked to produce updated Rural Living Zone policy content which better reflects community aspirations for these areas consistent with the outcomes of the ‘Non-Urban Living/Rural Lifestyle Study’, completed in 2009. This will assist in guiding how development takes place into the future. The DPA aims to achieve the following: • Revision of land division criteria enabling smaller

allotments to be created in nominated parts of the Gawler Belt area;

• General changes to allotment configuration requirements across all areas;

• Changes to requirements relating to the parking of heavy vehicles in certain areas; and

• More formal recognition of the railway corridor between Gawler and Roseworthy, and the introduction of policy guidance to protect both development within proximity of the corridor and the corridor itself into the future.

From 12 September 2013 to 11 November 2013 the draft will be available for public inspection during office hours (9 a.m. to 5 p.m.) at Council’s Offices at 93 Main Street, Kapunda, or 12 Hanson Street, Freeling. Elector Representation Review NOTICE is hereby given that the District Council of Mount Barker has reviewed its composition and elector representation arrangements, in accordance with the provisions of Section 12 (4) of the Local Government Act 1999. Pursuant to Section 12 (13) (a) of the said Act, the Electoral Commissioner has certified that the review undertaken by Council satisfies the requirements of Section 12 of the Local Government Act 1999 and may therefore be put into effect as from the day of the first general election held after the expiration of five months from the publication of this notice. The revised representation arrangements are as follows: The District Council of Mount Barker will comprise the Mayor (as the principal member) and 10 Ward Councillors. The Council Area will be divided into three wards, as defined in the following Schedules, with North Ward and Central Ward each being represented by four Ward Councillors and South Ward being represented by two Ward Councillors.

THE FIRST SCHEDULE North Ward: Alter and adjust the boundaries of the existing North Ward as follows: Beginning at the only point where the Mylor suburb boundary meets both the Adelaide Hills Council boundary and the

Hahndorf suburb boundary, the new North Ward boundary follows the District Council of Mount Barker boundary to the northern most point of the Council Area and then runs south along the District Council of Mount Barker boundary until it meets the Alexandrina Council boundary. North Ward boundary then runs north-west along the District Council of Mount Barker boundary until the point where the Callington and Saint Ives suburb boundaries meet the Alexandrina Council boundary. It then heads north-west along the Saint Ives and Petwood suburb boundaries until it meets the South Eastern Freeway, continuing north along the South Eastern Freeway until it meets the Paechtown suburb boundary. It then follows the Paechtown boundary followed by the Hahndorf suburb boundary until it returns to the point where the Hahndorf and Mylor suburb boundaries meet the Adelaide Hills Council boundary.

The changes are more particularly delineated on the plan published herewith and marked ‘A’ and ‘C’. The name ‘North Ward’ to be retained.

THE SECOND SCHEDULE Central Ward: Alter and adjust the boundaries of the existing Central Ward as follows: Beginning at the point where Paechtown, Hahndorf, Totness and Mount Barker suburb boundaries meet, the new Central Ward

boundary follows the South Eastern Freeway eastward until it meets the Petwood suburb boundary. It then turns north, followed by south-east along the Petwood and Saint Ives suburb boundaries until it meets the Alexandrina Council boundary. Turning north-west, it continues along the Saint Ives suburb boundary, followed by the Petwood, Mount Barker Springs and Mount Barker suburb boundaries until returning to the point where Paechtown, Hahndorf, Totness and Mount Barker suburb boundaries meet.
