ORDER PURSUANT TO SECTION 42 (2)

Dissolution of Association

WHEREAS the Corporate Affairs Commission (‘the Commission’) pursuant to Section 42 (1) of the Associations Incorporation Act 1985 (‘the Act’) is of the opinion that the undertaking or operations of The Women’s Housing Association Incorporated (‘the Association’) being an incorporated association under the Act are being carried on, or would more appropriately be carried on by a company limited by guarantee incorporated under the Corporations Act 2001 (Commonwealth) and whereas the Commission was on 24 December 2013, requested by the Association to transfer its undertaking to Junction Housing Limited (ACN 160 344 712), the Commission, pursuant to Section 42 (2) of the Act does hereby order that on 30 April 2014, the Association will be dissolved, the property of the Association becomes the property of Junction Housing Limited and the rights and liabilities of the Association become the rights and liabilities of Junction Housing Limited.

FISHERIES MANAGEMENT ACT 2007: SECTION 79

TAKE note that the notice made under Section 79 of the Fisheries Management Act 2007, dated 7 January 2014, and published in the South Australian Government Gazette dated 9 January 2014, on page 5, being the first notice on that page, referring to the Spencer Gulf Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a Spencer Gulf Prawn Fishery Licence to use prawn trawl nets in the areas specified in Schedule 1, during the period specified in Schedule 2, and under the conditions specified in Schedule 3.

SCHEDULE 3

1. The co-ordinates in Schedule 1 are defined as degrees decimal minutes and based on the World Geodetic System 1984 (WGS 84).

2. No fishing activity may be undertaken during the daylight hours from 0630 hours to 2000 hours on any day during the period specified in Schedule 2.

3. Fishing must cease in an area if the average prawn bucket count for all vessels exceeds 220 prawns per bucket count.

4. Fishing must cease in the fishery if the average catch per vessel, per night (for all vessels) drops below 400 kg.

5. No fishing activity may occur without the authorisation of Co-ordinator at Sea, Greg Palmer, or other nominated Co-ordinator at Sea appointed by the Spencer Gulf and West Coast Prawn Fishermen’s Association.

6. The authorisation of the Co-ordinator at Sea must be in writing, signed and record the day, date and permitted fishing area within the waters of Schedule 1 in the form of a notice sent to the fishing fleet or vary an earlier authorisation issued by the Co-ordinator at Sea.

7. The Co-ordinator at Sea must cause a copy of any authorisation for fishing activity or variation of same, made under this notice to be emailed to the Prawn Fisheries Manager immediately after it is made.

8. The Co-ordinator at Sea must keep records of all authorisations issued pursuant to this notice.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, David Jonathan Smith of Surfsafe Pty Ltd, 8/15 Carbon Court, Osborne Park, W.A. 6009 (the ‘exemption holder’), is exempt from Section 71 (2) of the Fisheries Management Act 2007, but only insofar as he may undertake the activities specified in Schedule 1, in the area specified in Schedule 2, subject to the conditions set out in Schedule 3 from 28 March 2014 until 28 February 2015, unless varied or revoked earlier.

SCHEDULE 1

Cause or permit interference with free swimming White Sharks (Carcharodon carcharias) through the use of electronic shark deterrent devices and baits.

SCHEDULE 2

Within the waters of the Neptune Islands Group (Ron and Valerie Taylor) Marine Park and the Neptune Islands Conservation Park.

SCHEDULE 3

1. No shark of any species may be taken from the water.

2. The exemption holder may only undertake the exempted activity with a shark cage diving operator licensed under the National Parks and Wildlife Act 1972.

3. The exemption holder must not deliberately harass, provoke or encourage a White Shark in an attempt to change its normal behaviour by undertaking the exempted activity.

4. When using bait as an attractant for the shark, the bait must be attached to a length of rope by natural fibre twine of no less than 30 cm in length.

5. The exemption holder must not intentionally feed sharks or reward sharks with food.

6. Before undertaking the exempted activity, the exemption holder must notify PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption notice at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. ME9902690.

7. While engaged in the exempted activity the exemption holder must be in possession of a copy of this notice and such a notice must be produced to a PIRSA Fisheries Officer immediately upon request.

8. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

9. The exemption holder must not conduct any other fishing activity including recreational fishing whilst undertaking the exempted activity.

This notice does not purport to override the provisions or operation of any other Act including but not limited to the Marine Parks Act 2007. The exemption holder and his agents must comply with any relevant regulations, permits, requirements and directions from the Department of Environment, Water and Natural Resources when undertaking activities within a marine park.

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, Ashley Murphy of the School of Biological Sciences, Monash University, Vic. 3800, (the ‘exemption holder’) or an employee of Monash University acting as his agent, is exempt from the provisions of Section 70 of the Fisheries Management Act 2007 and Regulation 7 and Clauses 72 and 96 of Schedule 6 and ‘other waters’ as defined in Schedule 7 of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder may collect species described in Schedule 1, from the waters described in Schedule 2, using the gear specified in Schedule 3 (the ‘exempted activity’), subject to the conditions set out in Schedule 4 of this notice, from 27 March 2014 until 31 December 2014, unless varied or revoked earlier.

SCHEDULE 4

1. The specimens collected by the exemption holder and his agent are for scientific and research purposes only and must not be sold.

2. The use of bait must be in line with the provisions of Section 78 of the Fisheries Management Act 2007 and in particular no aquaculture, exotic or noxious species may be used or deposited in to the water.

3. All native species other than those described in Schedule 1 must be immediately returned to the water. All non-native fish must be destroyed and disposed of appropriately.

4. A maximum of 20 specimens per species, per collection site, may be retained by the exemption holder pursuant to this notice.

5. Voucher specimens collected pursuant to this notice must be lodged with Monash University Victoria or South Australian Museum. Specimens taken to Victoria cannot be returned or released in South Australia pursuant to this notice.

6. Before conducting the exempted activity, the exemption holder or agent must treat all nets and traps with a sterilising agent registered with the Australian Pesticides and Veterinary Medicines Authority and its use is within environmental protection legislation, including Environmental Protection (Water Quality) Policy 2003, to reduce the risk of translocation of any disease or pathogen.

7. The exempted activity may be conducted on the exemption holder’s behalf by nominated agent, Nicholas Moran of Monash University.

8. Before conducting the exempted activity, the exemption holder or agent must contact PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity. The exemption holder and agent should have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related issues. Exemption No. ME9902683.

9. Within 14 days of expiry this notice, the exemption holder must provide a report in writing to the Executive Director, Fisheries and Aquaculture, (G.P.O. Box 1625, Adelaide, S.A. 5001), giving the following details:

• the date, time and location of collection;

• the description of all species collected; and

• the number of each species collected.

10. While engaging in the exempted activity, the exemption holder and his agent must be in possession of a copy of this notice. This notice must be produced to a Fisheries Officer if requested.

11. The exemption holder and agent must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

12. That you have approved permits from other Government departments to undertake the activity specified in this permit.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, the holder of a prawn fishery licence issued pursuant to the Fisheries Management (Prawn Fisheries) Regulations 2006 for the West Coast Prawn Fishery listed in Schedule 1 (the ‘exemption holders’) or their registered master are exempt from closure notices made under Section 79 of the Fisheries Management Act 2007, published in the South Australian Government Gazette, referring to the West Coast Prawn Fishery insofar as the exemption holder may use prawn trawl nets in accordance with the conditions of their fishery licence for the purpose of undertaking a prawn survey (the ‘exempted activity’) during the period specified in Schedule 2, subject to the conditions contained in Schedule 3. 2. For the purposes of this notice the trawl survey areas cannot include any waters of a habitat protection zone or sanctuary zone of any marine park established under the Marine Parks Act 2007.

3. The registered master must keep a ‘skippers log’ to record catch information during the survey.

4. All fish, other than King Prawns, Southern Calamari, Gould’s Squid, Scallops, Octopus and Balmain Bugs taken during the exempted activity for survey purposes, are to be returned to the water immediately after capture.

5. While engaged in the exempted activity or unloading the survey catch, the exemption holder must have a copy of this notice on board the boat or near his person. This notice must be produced to a Fisheries Officer if requested.

This notice does not purport to override the provisions or operation of any other Act including, but not limited to, the Marine Parks Act 2007. Road Closure—Holm Hill Road, Black Springs/Mintaro

BY Road Process Order made on 5 August 2013, the Clare and Gilbert Valleys Council ordered that:

1. The whole of Holm Hill Road extending eastwards from Section 4, Hundred of Stanley to Dunns Road and the un-named public road south of Water Reserve Road adjoining the western boundaries of Allotments 2 and 5 in Filed Plan 217245, more particularly delineated and lettered ‘A’ on the Preliminary Plan No. 12/0047 be closed.

2. Transfer the whole of the land subject to closure to Joanne Valeska Gebhardt and David Peter Gebhardt in accordance with the Agreement for Transfer dated 5 August 2013 entered into between the Clare and Gilbert Valleys Council and J. V. and D. P. Gebhardt.

On 26 November 2013 that order was confirmed by the Minister for Transport and Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 92596 being the authority for the new boundaries.

Pursuant to Section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.

NATIONAL PARKS AND WILDLIFE (NATIONAL PARKS) REGULATIONS 2001

National Parks and Wildlife Reserves—Fire Restrictions

PURSUANT to Regulation 16 of the National Parks and Wildlife (National Parks) Regulations 2001, I, Vicki Michelle Linton, Acting Director, Regional Co-ordination, Partnerships and Stewardship, formerly entitled Director, Public Land Management and Operational Support, Regional Services, authorised delegate of the Director of National Park and Wildlife, impose fire restrictions for National Parks and Wildlife Reserves located in the Kangaroo Island South Australian Country Fire Service Fire Ban District as listed in Schedule 1 below.

The purpose of these fire restrictions is to ensure the safety of visitors using the Reserves, and in the interests of protecting the Reserves and neighbouring properties.

Lashmar Conservation Park: All wood fires or solid fuel fires are prohibited throughout the year. Gas fires are permitted other than on days of total fire ban.

Exception: Antechamber Bay Campground—All wood fires or solid fuel fires are prohibited from 1 December 2013 to 4 April 2014, fires are permitted outside of these dates in designated areas only. Gas fires are permitted other than on days of total fire ban.

All other Reserves: All wood fires or solid fuel fires are prohibited throughout the year. Gas fires are permitted other than on days of total fire ban.

Notice of Scheme for Audits and Inspections

BY Instrument of Delegation dated 18 March 2013, the Chief Executive of the Department for Health and Ageing delegated the powers, functions, duties and responsibilities vested in or imposed on him under Section 20 of the Safe Drinking Water Act 2011, to the person holding or occupying the role as Chief Public Health Officer, Department for Health and Ageing.

I, Dr Stephen Christley, Chief Public Health Officer, Department for Health and Ageing, delegate of the Chief Executive of the Department for Health and Ageing, hereby determine, pursuant to Section 20 of the Safe Drinking Water Act 2011, that specified classes of drinking water providers listed and described in Column 1 of the attached Schedule will be subject to either audits or inspections as listed in Column 2, being audits or inspections every year or every 2 years as provided in Column 3, which will be completed by appropriately approved auditors or inspectors as from time to time determined by the Chief Executive of the Department for Health and Ageing, or delegate.

This notice will take effect on 1 July 2014, and has effect until varied or substituted.
