ESTABLISHING THE ORGANIZED HAMLET OF DEER VALLEYPursuant to sections 50, 55, and 61 of The Municipalities Act, an application has been received requesting the

establishment of an Organized Hamlet within the Rural Municipality of Lumsden No. 189.

IT IS HEREBY DECLARED THAT the lands described as follows and shown on the attached map in Appendix A be declared an Organized Hamlet, and shall be known as the Organized Hamlet of Deer Valley:

All those portions of Township 19, Range 21, West of the Second Meridian, Saskatchewan and described as:

(1) The north-east and south-east quarters of Section 7 lying to the right bank of Pile of Bones Creek;

(2) The south-east and south-west quarters of Section 8 lying to the right bank of Pile of Bones Creek;

(3) The north-west quarter of Section 8 lying to the south-west of a line joining the south-east corner of the quarter section with a point on the western Boundary of the quarter section a distance of 298 m south from the north-west corner of the quarter section;

(4) Block A, Plan No. 00RA29005 in the north-east quarter of Section 5 lying to the north of the right bank of Pile of Bones Creek, and as referred to by the bold dashed line shown on the sketch and attached hereto as Schedule A; and

(5). The original road allowance lying easterly from and adjacent to the north-east and south-east quarters of Section 7 which lies to the north of the right bank of the Pile of Bones Creek.

IT IS FURTHER ORDERED THAT:

1 The first meeting of the voters of the Organized Hamlet of Deer Valley shall be held on Tuesday, November 1, 2016 at 7:00 p.m., in the Deer Valley Golf Clubhouse, 10 Deer Valley Rd. (Parcel A, Plan No. 101174082, Ext. 14, in the north-west quarter 08-19-21 W2M), Saskatchewan.

2 Darcie Cooper, administrator for the Rural Municipality of Lumsden No. 189, is appointed to make the necessary arrangements for the first meeting of the voters, including publication of the notice and shall chair the first meeting of the voters.

3 A three person board shall be elected at the first meeting of the voters. The terms of office for each of the board members shall be as follows:

(a) one Hamlet Board Member shall hold office for a two-year term which will expire at the annual meeting of the voters in 2018; thereafter, subject to clause 68(3)(b) of The Municipalities Act, the board member will hold office for a four-year term;

(b) one Hamlet Board Member shall hold office for a three-year term expiring at the annual meeting of the voters in 2019; thereafter, subject to clause 68(3)(b) of The Municipalities Act, the board member will hold office for a four-year term;

(c) one Hamlet Board Member shall hold office for a four-year term which will expire at the annual meeting of the voters in 2020; thereafter, subject to clause 68(3)(b) of The Municipalities Act, the board member will hold office for a four-year term; and

(d) unless there is a vacancy to fill for an unexpired term, there will be no election for a board member in 2021.



4 The first meeting of the Organized Hamlet Board shall be on Tuesday, November 1, 2016 in the Deer Valley Golf Clubhouse, 10 Deer Valley Rd. (Parcel A, Plan No. 101174082, Ext. 14 in the north-west quarter 08-19-21 W2M), Saskatchewan following the first meeting of the voters.

5 The effective date of this order is December 31, 2016.

COURT OF QUEEN’S BENCH FOR SASKATCHEWAN – AMENDMENTS TO THE QUEEN’S BENCH RULES

The Queen’s Bench Rules are amended, effective the 1st day of October, 2016, in the manner set forth below:

Part 2 amended

1 Subrule 2-14(1) is amended by repealing clause (b) and substituting the following:

“(b) the minor is represented by a lawyer appointed by The Saskatchewan Legal Aid Commission”.

Part 13 amended

2(1) Part 13 is amended in the manner set forth in this section.

(2) The information note following the Part 13 heading is repealed and the following substituted:

“

What this Part is about: This Part contains rules respecting calculating time. It also deals with various administrative matters, including the filing of documents and certification of copies of original documents. The Part also has rules concerning the contents of pleadings, affidavits, exhibits, funds in Court, proceedings by and against persons who have obtained a fee waiver certificate pursuant to The Fee Waiver Act, and transfer of proceedings under The Court Jurisdiction and Proceedings Transfer Act.

”.

(3) Division 5 is repealed and the following substituted:

“DIVISION 5

Proceedings By and Against Fee Waiver Certificate Holders

“Interpretation of Division and rules re Fee Waiver Certificate Holders

13-42(1) In this Division:

‘certificate holder’ means a person who has obtained a fee waiver certificate that is issued, or deemed to be issued, by the Court for the purposes of proceedings in the Court; (« détenteur de certificat »)

‘fee waiver certificate’ means a fee waiver certificate issued pursuant to The Fee Waiver Act; (« certificat de dispense des droits »)

‘local registrar’ means the local registrar at the judicial centre at which the matter is proceeding or intended to proceed; (« registraire local »)

‘material change in circumstances’ means a material change in circumstances as defined in The Fee Waiver Regulations. (« changement important de situation »)

(2) A certificate holder may take, defend or be a party to any legal proceedings in the Court on the terms and conditions mentioned in this Division.

“Application for certificate

13-43 A party seeking to obtain a fee waiver certificate for the purposes of proceedings in the Court shall apply to the local registrar in accordance with The Fee Waiver Act and The Fee Waiver Regulations.

“Holders of previously-issued certificates

13-44(1) A party seeking to rely on a previously-issued fee waiver certificate for the purposes of proceedings in the Court shall:

(a) apply to the local registrar for a waiver of the requirement to apply for a fee waiver certificate; and

(b) provide evidence, satisfactory to the local registrar, that:

(i) the applicant is the holder of a valid fee waiver certificate that was issued within the previous 12 months by another court or a public body pursuant to The Fee Waiver Act; and

(ii) the applicant has not experienced a material change in circumstances since the fee waiver certificate was issued.

(2) If, on an application pursuant to subrule (1), the local registrar waives the requirement for the applicant to apply for a new fee waiver certificate, the previously-issued fee waiver certificate is deemed, in accordance with subsection 3(8) of The Fee Waiver Act, to be a fee waiver certificate issued by the Court.

“Material change in circumstances

13-45(1) If a certificate holder’s lawyer learns that the certificate holder has experienced a material change in circumstances, the lawyer must immediately report that fact, in writing, to the local registrar at the judicial centre at which the matter is proceeding or intended to proceed.

(2) Nothing in subrule (1) alters a certificate holder’s obligation pursuant to The Fee Waiver Regulations to report a material change in circumstances.

“Security for costs; issuance of certificate after order

13-46(1) If an order for security for costs has been made against a person applying for a fee waiver certificate, the fee waiver certificate must not be granted until after 2 days’ notice to the party who has obtained the order for security for costs or the party’s lawyer.

(2) A party mentioned in subrule (1) or the party’s lawyer has the right to be heard on the application for a fee waiver certificate.

(3) Unless the Court orders otherwise, if a fee waiver certificate is granted:

(a) the filing of the fee waiver certificate supersedes any previous order obtained by any other party for security for costs as against the certificate holder; and

(b) no order for security for costs shall be issued after that date against the certificate holder.

Security for costs: See Division 4 of Part 4 regarding obtaining an order for security for costs.

Order for costs: The Court may make an order for costs to or against a certificate holder in accordance with section 7 of The Fee Waiver Act and Part 11 of these rules.

“Leave required by certificate holder re involvement in legal proceedings

13-47 No certificate holder may take, defend or be a party to any legal proceedings pursuant to this Division without leave of:

(a) the Court;

(b) the judge before whom the matter is heard; or

(c) the court or judge to whom the appeal is taken.

“Stay of proceedings

13-48 Unless the Court orders otherwise, nothing in this Division operates as a stay of any proceedings.


“Confidentiality

13-49 Unless the Court orders otherwise, any information disclosed on an application for a fee waiver certificate pursuant to this Part shall be kept confidential and not made available to any person other than:

(a) the applicant;

(b) the applicant’s lawyer; and

(c) the Court”.

Part 17 amended

3(1) Part 17 is amended in the manner set out in this section.

(2) Rule 17-1 is amended by repealing the definition of “needy person”.

(3) The Information Note that follows rule 17-4 is amended by deleting the definitions listed under rule 13-42 and substituting the following:

« registraire local » Registraire local du centre judiciaire où l’affaire est en cours ou prévue. (“local registrar”)

(2) Un détenteur de certificat peut poursuivre, se constituer défendeur ou être partie dans toute instance judiciaire devant la Cour, aux conditions énoncées dans la présente section.

« Demande de certificat

13-43 La partie qui souhaite obtenir un certificat de dispense des droits en vue d’une instance devant la Cour s’adresse au registraire local conformément à la loi intitulée The Fee Waiver Act et au règlement intitulé The Fee Waiver Regulations.

« Détenteurs de certificats préexistants

13-44(1) La partie qui souhaite utiliser un certificat de dispense des droits préexistant en vue d’une instance devant la Cour doit :

a) demander au registraire local d’être dispensé de l’obligation de demander un certificat de dispense des droits;

b) fournir, à la satisfaction du registraire local, les preuves suivantes :

(i) la preuve qu’il est détenteur d’un certificat de dispense des droits valide qui a été délivré dans les 12 mois précédents par une autre cour ou un organisme public conformément à la loi intitulée The Fee Waiver Act,

(ii) la preuve qu’il n’a pas connu de changement important de situation depuis la délivrance de son certificat de dispense des droits.

(2) Lorsque, sur demande présentée en vertu du paragraphe (1), le registraire local dispense le requérant de l’obligation de demander un nouveau certificat de dispense des droits, le certificat préexistant est réputé avoir été délivré par la Cour en application du paragraphe 3(8) de la loi intitulée The Fee Waiver Act.

« Changement important de situation

13-45(1) L’avocat du détenteur de certificat qui apprend que le détenteur de certificat a connu un changement important de situation en fait rapport immédiatement, par écrit, au registraire local du centre judiciaire où l’affaire est en cours ou prévue.

(2) Le paragraphe (1) ne change en rien l’obligation qui incombe au détenteur de certificat de signaler tout changement important de situation en application du règlement intitulé The Fee Waiver Regulations.


« Délivrance d’un certificat après une ordonnance de sûreté en garantie des dépens

13-46(1) Si la personne qui demande un certificat de dispense des droits a fait l’objet d’une ordonnance de sûreté en garantie des dépens, le certificat ne peut être accordé qu’après préavis de 2 jours à la partie qui a obtenu l’ordonnance ou à son avocat.

(2) La partie visée au paragraphe (1) ou son avocat a le droit de se faire entendre à l’audition de la demande de certificat de dispense des droits.

(3) Sauf ordonnance contraire de la Cour, lorsqu’un certificat de dispense des droits est accordé :

a) le dépôt du certificat de dispense des droits supplante toute ordonnance antérieure de sûreté en garantie des dépens obtenue par une autre partie contre le détenteur du certificat;

b) aucune autre ordonnance de sûreté en garantie des dépens ne peut être émise par la suite contre le détenteur du certificat.

Sûreté en garantie des dépens : Se reporter à la section 4 de la partie 4 en ce qui concerne l’obtention d’une ordonnance de sûreté en garantie des dépens.

Ordonnance relative aux dépens : La Cour peut rendre une ordonnance relative aux dépens en faveur ou à l’encontre d’un détenteur de certificat en vertu de l’article 7 de la loi intitulée The Fee Waiver Act et de la partie 11 des présentes règles.

« Obligation du détenteur de certificat d’obtenir l’autorisation d’ester

13-47 Le détenteur de certificat ne peut ester en justice comme demandeur, défendeur ou autre partie sous le régime de la présente section sans autorisation, selon le cas :

a) de la Cour;

b) du juge saisi de l’affaire;

c) du tribunal ou du juge saisi de l’appel.

« Suspension de l’instance

13-48 Sauf ordonnance contraire de la Cour, la présente section n’entraîne pas suspension de l’instance.

« Confidentialité

13-49 Sauf ordonnance contraire de la Cour, tout renseignement fourni dans le cadre d’une demande de certificat de dispense des droits régie par la présente partie est tenu confidentiel et ne peut être communiqué qu’aux personnes suivantes :

a) le requérant;

b) l’avocat du requérant;

c) la Cour ».


3(1) La partie 17 est modifiée de la façon énoncée au présent article.

NOTICE TO ADVERTISERS

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the Monday of the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m. of the previous Friday. Please allow yourself at least one full week to ensure mail delivery of Gazette submissions. Publication of any material received late will be delayed until the following week’s issue.

All material for publication in The Saskatchewan Gazette must be submitted electronically (MS Word or WordPerfect) accompanied by a signed hard copy to the Office of the Queen’s Printer, Saskatchewan Justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].

Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.

Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.

The minimum charge for publication of notices not specified below is $16.00 for each notice, which sum shall accompany the material when forwarded for publication.

AVIS AUX ANNONCEURS

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera remise au numéro de la semaine suivante.

Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement (MS Word ou WordPerfect) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1, tél. 306-787-2367, ou par courriel: [email protected].

Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites lisiblement en lettres moulées et doivent apparaître immédiatement en dessous de la signature écrite.

Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients non gouvernementaux. Les chèques ou les mandats doivent être établis à l’ordre du fonds renouvelable de l’Imprimeur de la Reine. Veuillez y inclure la TPS en plus des tarifs réguliers au taux de 5 % pour chaque article cité ci-dessous dans la catégorie « soumis à la TPS ».

Le prix minimal pour la parution d’avis non inclus dans la liste ci-dessous, est de 16 $ par avis. Le paiement devra accompagner le matériel envoyé aux fins de parution.
