ALPHERA Financial Services is a division of BMW Financial Services (South Africa) (Pty) Ltd., an Authorised Financial Services and Registered Credit ProviderNCRCP2341.
This document contains the ALPHERA Financial Services Care and Cosmetic Cover Policy wording. The details ofthisPolicydocumenthavebeensetoutforYourinformation.ThisPolicyisunderwrittenbyGuardriskInsuranceCompanyLimited(LicenceNo.75),hereafterreferredtoas(Guardrisk)andAdministeredbyPinnAfrica Insurance Underwriting Managers (Pty) Ltd. (FSB No. 39123), hereafter referred to as (PinnAfrica) which are Authorised Financial Services Providers.
ThisPolicyhasspecificallybeendesignedtoenabletheInsuredtoaffordablyrepairandrestoretheInteriorand/or Exterior of their Vehicle in the event of minor damage,causedbydaytodaymotoring.Thismotoringconcept will ensure The Vehicle remains in perfect showroom condition, free from chips, minor dents and light scratches.
Intheeventofanyconflictbetweentheprovisionsofthis Policy and that of any other document as mentioned herein, the provisions of this Policy shall prevail.
In return for the Insured paying the Premium and continuing to meet all the conditions for cover, Guardrisk will provide insurance cover under the ALPHERA FinancialServicesCareandCosmeticPolicyasdescribedin this document.
Guardrisk agrees and undertakes in favour of the Insured’s named in the Schedule of Insurance to pay the benefitsdescribedinthePolicysubjectto:
• theactualreceiptbyGuardriskatitsheadofficeofthecorrectandsufficientPremiumorPremiums;
• the truth and accuracy of the information given in theInsured’sScheduleofInsurance;
• the Terms and Conditions contained herein or endorsed hereon.

“Approved Repair Centre”ApprovedRepairCentresaccreditedbytheRMI(RetailMotorIndustryOrganisation).
“Appointed Representative”ReferstothepersonwhoisauthorisedbyPinnAfricaInsuranceUnderwritingManagers to carry out regulated activities concerning the Policy.
“Date of Occurrence”The date, within the Period of Insurance, on which the Insured Event happens.
“Days”OrdinaryDays,includingweekendsandpublicholidays.ADayshallalsomean acontinuous24(TwentyFour)hourPeriod.
“Event”TheEventwhichgaverisetoYourclaim.
“His / Her”For “His” and “He” read “Her” and “She” where the Insured is female.
“Insured” An Insured shall mean a person or legal entity who has successfully applied for this Policy Schedule of Insurance and paid for it in full.
“Insurer”ShallmeanGuardriskInsuranceCompanyLimitedLicenceNo.75.
“Maximum Indemnity”• OurMaximumIndemnityforExteriorCoverclaimsisequaltoR7000
(SevenThousandRand)perclaimuptoamaximumofR28000 (Twenty-EightThousandRand)overthetermofthePolicy.
• OurMaximumIndemnityforInteriorCoverclaimsisequaltoR3000 (Three Thousand Rand) per claim up to a maximum of R12 000 (Twelve Thousand Rand) over the term of the Policy.
• OurMaximumIndemnityfortheInsideOutCoverexteriorclaimsisequal toR7000(SevenThousandRand)perclaimuptoamaximumofR28000(Twenty-EightThousandRand)overthetermofthePolicyandinterior claimsisequaltoR3000(ThreeThousandRand)perclaimuptoamaximumofR6000(SixThousandRand)overthetermofthePolicy.Thetotalamountallowedperpolicy,isanamountofbutnotexceedingR34000(ThirtyFourThousand Rand).
“Misrepresentation”Conscious decision to change the facts as they are, to mislead an interested party. This shall also mean the failure to disclose material information at the date of applicationthathadtheInsurerbeenawareofwouldhaveresultedinthePolicynotbeingissued.
“Period of Insurance”As stated in the Schedule of Insurance issued in terms of this Policy.
“PinnAfrica Insurance Underwriting Manager”The Underwriting Manager is PinnAfrica Insurance Underwriting Managers (“PinnAfrica”)whoismandatedbyGuardrisktounderwriteandadministerthePolicy. PinnAfrica is an authorised Financial Services Provider (FSP No. 39123).
“Policy”The Schedule of Insurance.
“Premium”ThemonthlyortermamountpayableasstatedintheScheduleofInsuranceoranyendorsement issued in terms of this Policy.
“Pre-existing Damage”Damage that existed prior to the inception of this Policy as well as any damage that was not claimed on prior claims.
“Premium Due Date”ThePremiumpaymentdateonorbeforethedateappearingontheSchedule of Insurance.
“Schedule of Insurance”TheSchedulecontainingYourdetailsandthedetailsofTheVehicle,PeriodofInsurance,Premiumpayable,bankdetailsandaddress.
“Term Cover”WherethefullPremiumforthePeriodofthecoverhasbeenreceivedinadvance.
“The Vehicle”TheVehicledescribedintheScheduleofInsuranceandwhichmaybeanyofthefollowing:lightmotorvehicles,minibuses(maximum16(sixteen)seater),caravans,light delivery vehicles and panel vans all with a gross vehicle mass of not more than 3500kg,andtrailerswithacarryingcapacityofnotmorethan750kg.
“Underlying Comprehensive Insurance Policy”ThefullyComprehensiveenforceableVehicleInsurancePolicyenteredintobyYouwithany registered domestic Insurance Company (The Underlying Comprehensive Insurer), whichcoversTheVehicleagainst,andobligestheUnderlyingComprehensiveInsurertopay,forallpossibleVehiclerisks(IncludingTheftandHijacking)occurringatleastinthewholeoftheRepublicofSouthAfrica.TheVehicleanditsaccessoriesandextrasmustbecorrectlyInsuredintermsofTransUnionDealersGuideforatleastitsfullMarket Value or new list price at Date of Loss.
“We, Us, Our”Guardrisk Insurance Company Limited (“Guardrisk”). An authorised Financial ServicesProvider,FSPNo.26/10/75.
“You, Your”ThepersonorentitynamedastheInsuredintheScheduleofInsurance.Youmustbe18(Eighteen)yearsofageandbeapermanentresidentofSouthAfricaand/or permanently residing in South Africa or a properly constituted and registered Company or trust.

The Alphera Care and Cosmetic Cover Policy has an option of 3 products namely:

Alphera Care and Cosmetic Cover Plan.
1. The Alphera Exterior Cover Policy covers Your Vehicle for the following benefits:
Windscreen and Glass Repair
Wewillberesponsibleforthecostoftherepairorrestorationforanareanotexceeding 10cm (Ten Centimetres) in diameter and not deeper than 3mm (Three Millimetres).WhereYourVehicle’swindscreenisdamagedbyimpactresultingina chip on the surface of the windscreen, impairing the drivers view only in terms ofdrivervisibilityandroadworthiness,andsuchdamageisrepairable,Wewillberesponsibleforthecostofthemaintenanceorrestoration,uptothemaximumlimit. In the event that the windscreen cracks during the repair process, the replacementcostofthewindscreenwillbeforYourownaccount.Thisbenefitincludesrepairabledamagetoheadlampsandrelatedcomponents. Hail Damage Repair
WewillrepairYourVehicleifdamagedresultingfromhailstonesandorhailstormsandcanbesuccessfullyrepairedbyanApprovedRepairer.
Wheels and Alloy Rims Repair
WewillpayfortherepairstothedamagewhereYourVehiclewheelrimsoralloyrimsaredamagedandrepairable,uptothemaximumlimit,andpurelybasedoncosmetic repairs. The outer edge of a wheel, holding the tyre. It makes up the outer circular design of the wheel on which the inside edge of the tyre is mounted.
Minor Dent Repair
Wewillprovidecovertoanareanotexceeding15cm(FifteenCentimetres)inlength and diameter, not deeper than 3mm (Three Millimetres). Where any part ofthebodypanelandorplastic/vinyl/hardenedrubbertrimparthasbeenripped ortornthedamageshallnotbedefinedasa“MinorDent”andshallnotberepairedor restored under this Policy.
Light Scratch Repair
Wewillprovidecovertoanareanotexceeding15cm(FifteenCentimetres)inlength. For the purpose of this Policy, repair of a Scratch does not include the polish of The Vehicle.
Chips Repair
WewillprovideCoverwhereastonechipstheexteriorofthebodyworkofTheVehicletoanareanotexceeding1.5mm(OneandaHalfMillimetres)indiameter.
Tar Removal
WewillpayfortherepairswhereYourVehiclehasbeendamagedbytar,uptothemaximum limit.
MaximumAmountpayableundertheExteriorCoverPolicyforRepairorRestoration;• Youareabletoselectthedamagetobeclaimed.Anydamagenotselected willbeconsideredpre-existingandcannotbeclaimedinfuture.
• WewillpayforthedamagenotexceedingR7000(SevenThousandRand)inclusiveofVATPerclaimforuptoamaximumofR28000(Twenty-EightThousand Rand) over the term of the policy.
• AnyclaimthatexceedsthemaximumamountofR7000(SevenThousandRand)willnotbeconsideredtobe“minor”andwillnotbecoveredintermsofthisPolicyYoumustclaimfromYourUnderlyingComprehensiveInsurancePolicy.
• Theaccumulativecostofrepairsbetweenallbenefitsshallnotexceed R7000(SevenThousandRand)inclusiveofVAT.Wewilltakealldamageintoconsideration and the total amount for repairs must fall within the maximum R7000(SevenThousandRand)allowedperclaim.
2. The Alphera Interior Cover Policy covers Your Vehicle for the following benefits:
Centre Console Repair
Wewillrepairscratches,scuffsandpeelingoffofrubberonTheVehicle centre console.
Door Handle Repair
Wewillre-spray(Plasticonly)doorgrabhandlesthatarescratchedorscuffed.
Plastic Panel Door Repair
Wewillrepairorre-sprayscratchesorscuffs.
Door Plastic Kick Panel Repair
Wewillrepairorre-spraytheplasticpanelsonthesillbelowthedoors;any metalfinishersonthesillsareexcluded.
Hand Brake Boot Repair
Wewillrepairorreplacethedamagedpanelincludingthegrabhandlesand window winder. The auto window mechanism or switch is excluded.
Centre Armrest Repair
Wewillre-coverthetornorrippedcentrearmrest.
Head Rest Repair
Wewillrepairtornfabric/leatherordamagetotheheadrestmould.Iftheexact fabricisnotavailableasuitablereplacementwillbeused.Guides,framesandrailsare excluded.
Front seat Backboard and Pocket Repair
Wewillrepairtheplasticbackboardonthedriverandpassengerfrontseats,as wellastothepocketsonbothdriverandpassengerseats.
Interior Boot Carpet Repair
Wewillre-coverthecarpetonthebaseoftheboot.Clipsandsidewalls are excluded.
Seat Panel Repair
Wewillreplaceaseatpanelthatistorn.Intheeventoftheexactfabricnot beingavailable,asuitablereplacementwillbeused.Thisincludesthepanel baseandback.
Seat Stitching Repair
Wewillrepairloosestitching,tornseamsandburns,Intheeventoftheexactfabric/leathernotbeingavailable,thenanextraseamwillbeputintheseatandmatched to the passenger seat.
Steering Wheel Re-Spray
Wewillpayforare-sprayofanyleathersteeringwheel.Wewillnotpayfor a replacement.
Rubber Carpet Inserts
Wewillonlyrecovertherubberheelmatonthedriver’sside.Willincludeheelmat on loose lay carpet on driver’s side only.
Gear Lever Re-spray
Wewillre-sprayfadedpaintwork.
Sun Visor Repair
Wewillrecoverthesunvisorbyreplacingtheclips.
MaximumAmountpayableundertheInteriorCoverPolicyforRepairorRestoration;• Youareabletoselectthedamagetobeclaimed.Anydamagenotselectedwillbeconsideredpre-existingandcannotbeclaimedinfuture.
• We will pay for the damage not exceeding R3 000 (Three Thousand Rand) inclusive of VAT per claim for up to a maximum of R12 000 (Twelve Thousand Rand) over the term of the policy.
• Any claim that exceeds the maximum amount of R3 000 (Three Thousand Rand) willnotbeconsideredtobe“minor”andwillnotbecoveredintermsofthisPolicyYoumustclaimfromYourUnderlyingComprehensiveInsurancePolicy.
• Theaccumulativecostofrepairsbetweenallbenefitsshallnotexceed R3 000 (Three Thousand Rand) inclusive of VAT. We will take all damage into consideration and the total amount for repairs must fall within the maximum R3 000 (Three Thousand Rand) allowed per claim.

3. The Alphera Inside Out Cover Policy covers Your Vehicle for the following benefits:

Thetotalamountallowedperpolicy,isanamountofbutnotexceeding R34000(ThirtyFourThousandRand).
• Anyclaimthatexceedsthemaximumamountallowedperclaimasspecifiedabove,willnotbeconsideredtobe“minor”andwillnotbecoveredinterms ofthisPolicyandYoumustclaimfromYourUnderlyingComprehensiveInsurance Policy.
• Theaccumulativecostofrepairsbetweenallbenefitsshallnotexceed R7000(SevenThousandRand)inclusiveofVAT.Forexteriorclaimsand R3 000 (Three Thousand Rand) inclusive of VAT. For Interior claims. We will take all damage into consideration and the total amount for repairs must fall within the maximum amount allowed per claim.
GENERAL CONDITIONSThefollowingconditionsareapplicabletoallsectionsofthisPolicy.
1. Conditions Precedent to Liability
WeshallhavenoliabilityunderthisPolicyandYoushallnotbeentitledtobeindemnifiedunderthisPolicyunless:
1.1 subjecttoCondition14(Fourteen)underGeneralConditions,thePremiumhas beenreceivedbyUsbythePremiumDueDate;
1.2 YoucomplywiththeClaimsProceduressetoutunderCondition9(Nine)under GeneralConditions;
1.3 YoucomplywiththeClaimsProceduresetoutunderCondition4(Four)under General Conditions.
2. Arbitration
ShouldanydisputearisebetweenYouandUsastotheamountofanyclaimunderthisPolicy,liabilityhavingalreadybeenadmittedbyUsfortheclaiminprinciple,Youmayrefersuchdisputetoarbitrationwithin90(Ninety)DaysofthedisputearisinginaccordancewiththeArbitrationAct42of1965(AsAmended).
3. Rejection of Claim and Time Bar
IntheeventofaclaimbeingrejectedorYoudisputethequantumofthebenefitpaidbyUs,YouareentitledtomakerepresentationstoUsinrespectofOurdecisiontorejecttheclaimorastothemannerinwhichthequantumofthebenefitwascalculatedforaPeriod180(OneHundredAndEighty)Daysfromthedateofreceiptoftheletterofrejectionorthedateoftheclaimpayment.

Where You are not satisfied with the response from the Insurer You are entitled to make further representation to:

IntermsofSection15oftheFinancialServicesOmbudSchemesActNo.37of2004thatonthereceiptoftheofficialreferraltotheaforementionedOmbud,anyapplicabletimebarringclauseintermsofthisPolicyortherunningofprescriptionintermsofthePrescriptionActNo68of1969,fromthedateofreferraltothedateofwithdrawalofthereferralordeterminationofthereferralbytheOmbudshallbestayed. If the dispute is not satisfactorily resolved in this manner, legal action may beinstitutedagainsttheInsurerfortheenforcementoftheclaimbywayoftheserviceofsummonsagainsttheInsurer.SummonsmustbeservedontheInsurerwithin6(Six)monthsfromthedateYoureceivetheoutcomeinrespectoftherepresentationsYouhavemadefailingwhichallbenefitsinrespectofsuchclaimshallbeforfeitedandnoliabilitycanariseintermsofsuchclaim.
4. Misrepresentation
If any claim under this Policy is in any way misrepresented or if any fraudulent means areusedbyYouoranyoneactingonYourbehalftoobtainanybenefitunderthisPolicy,orifanyoftheEventsInsuredagainstareoccasionedbyYourintentionalact,orwithYourconnivance,allbenefitsunderandthePremiumspaidintermsofthisPolicyshallbeforfeited,andthePolicywillbevoidableatOuroption.
5. Jurisdiction
ThisPolicyissubjecttoSouthAfricanlawandtothejurisdictionofacompetent South African court.
6. Termination of this Policy
Theenddatewillbetheearliestof: 6.1 thedateattheendofthePeriodofInsurance; 6.2 thedateonwhichTheVehicleissoldbyYou; 6.3 whenWedonotreceiveYourPremium,subjecttoCondition15(Fifteen)
underGeneralConditionsandPremiumunderDefinitions; 6.4 wheneitherYouorWecancelthePolicy,subjecttoCondition8(Eight)
underGeneralConditions; 6.5 thedateuponwhichthemaximumclaimshavebeenreached.
7. Cancellation and Refund of Premiums
ThisPolicymaybecancelledbyYouorUsatanytimeon30(Thirty)Dayswrittennoticetothelastknownaddress.InthecaseofTermPoliciesYourPremiumwillberefundedonascaledeterminedbyOuractuarybasedonOurcalculationfortheunexpiredportionoftheTermPolicy,providedthatnoclaimwassubmitted,inwhicheventnoPremiumshallberefunded.NoPremiumwillberefundedinthecase of monthly Premiums or in the case where the refund due is less than R200 (Two Hundred Rand).
8. Theft or Destruction of The Vehicle
IfTheVehiclecoveredunderthisPolicyisstolen,hijackedordamagedbeyondrepairduringthePeriodofInsurance,thePolicyshallbedeemedtohaveterminatedontheDateofsuchOccurrence.
9. Claims Procedures
OnthehappeningofanEventwhichmayresultinaclaimunderthisPolicy,YoushallatYourownexpense,inthecaseof:
TheInterior,Exteriorand/orInsideOutoptions: 9.1 NotifyUswithin60(Sixty)DaysofthehappeningofanyEventresulting
inaclaimbeingmadeagainstthisPolicybymeansofaclaimform; 9.2 ProvideUswithsuchproofandinformationasWemayrequiretoprocess
theclaim; 9.3 UponlodgingYour1st(First)claim,YouaretoProvideUswithaclear
photograph of the full Vehicle, front, left side, right side, and/or rear, taken at the Approved Repair Centre at claim stage.
9.4 Photosofthedamagedareawillberequiredforclaim2(Two),3(Three) and4(Four).
9.5 WhereYoumakeuseofaAlpheraApprovedRepairerYouonlyneedtosubmitonequoteforapproval,inthecaseofYoumakinguseofanRMI(RetailMotorIndustryOrganisation)RepairCentreYouarerequiredtosubmittwoquotesforapproval.Quotesfrommobilerepairerswillbeaccepted only if they are RMI approved.
9.6 Intheeventofaclaimbeingrejected,theInsuredisentitledtoreliefthroughacourtaction,theOmbudforShortTermInsuranceandthecomplaints process as detailed.
10. Contract
The application for this Policy, the Schedule of Insurance, this Policy and any endorsementsoramendmentstogethercomprisesYourPolicywithUs.This Policyismadeupofnumerousbenefits,eachbenefitmustbeindividually appliedforandtheappropriatePremiummustbepaidfortheappropriate benefitorbenefitsselected.
11. Reasonable Precautions

12. Territorial Limits
CoverislimitedtoEventsoccurringintheterritoriallimitsasspecifiedin YourUnderlyingComprehensiveInsurancePolicy.
13. Repatriation Costs
IfTheVehicleisdamagedoutsidetheRepublicofSouthAfrica,thecost ofrepatriationwillbebornebyYou.
14. Period of Grace for Premium Payment
YoushallbeentitledtoaPeriodof15(Fifteen)DaysfromthePremiumDueDateinwhichtopayYourPremium.InthecaseofmonthlyPolicies,thisPeriodofGraceonly applies from the second month of the currency of the Policy.
15. Roadworthy Condition
YoushallmaintainTheVehicleinaroadworthyconditionincompliancewiththeNationalRoadTrafficAct93of1996(AsAmendedOrSubstituted)andtheRegulationspromulgatedthereunder.WewillnotacceptliabilityforanylossordamageiftheconditionofTheVehiclecontributedtoorcausedtheEvent.
16. Amendments or Endorsements
WemayamendorendorsethisPolicyatanytimebygivingYou30(Thirty)DaysnoticeinwritingatYourlastknownaddress.
17. Vehicle Substitution
WhereTheVehicleissubstituted,YoumustadvisePinnAfricaimmediatelyofsuchachange, and within 30 (Thirty) Days supply PinnAfrica with the new Vehicle details. TheGeneralConditionsasindicatedatinceptionofthePolicywillbeapplicable.
18. Hold Cover
Wewillprovidecoverforthefirst30(Thirty)Daysfromtheinceptiondateof the Policy.
19. Repair or Restoration
YoumustobtainauthorisationfromPinnAfricapriortothecommencementof repairs or restoration.
20. Repair Co-Operation
Youshall,onreportingdamage,atOurrequestorthatofOurdulyAppointedRepresentative, ensure that The Vehicle is taken to an Approved Repair Centre. Allselecteddamagewillbetakenintoaccountwhencalculatingthecostforrepairsorrestorationandthetotalcostmaynotexceedthemaximumlimitperclaim.Youmayselecttohaverepairsorrestorationdoneoncertainareasofdamage,butanydamagewhichisnotselectedwillthenbenotedandexcludedfromanyfutureclaims.
21. Damage
We,orOurdulyAppointedRepresentative,shallbethesolepartytoauthoriseorrejectclaims.YoushallallowUs,orOurdulyAppointedRepresentative,accesstoinspectTheVehiclethatisthesubjectoftherepair.

GENERAL EXCLUSIONS
ThefollowingexceptionsareapplicabletoallsectionsofthisPolicyexceptas theymaybevariedbyspecificexceptionsunderaparticularsection.
Weshallnotbeliablefor:1. IfTheVehicleisdamagedasaresultof;vandalism,abuseor
maliciousdamage;2. Liabilitytoanypassengerorthirdpartywhatsoever,includingthirdparty
vehicles,forloss,damageorpersonalinjury;3. Anylossordamagecaused,sustainedorincurredwhilstTheVehicleisbeing
drivenbyYouorbyanotherpersonwithYourconsent,unlessdulyandfullylicensedtodriveTheVehicleintermsofanyapplicablelegislation,orwhilsttheconcentrationofalcoholhowsoevermeasured,inYourorsuchperson’sbloodorrespiratorysystemexceedsthestatutorylimitinforceatsuchtime,orwhilstYouorsuchpersonisundertheinfluenceofalcoholoradrughavinganarcoticeffect;
4. Anyclaimwhichisnotsubmittedwithin60(Sixty)calendarDaysfromDate ofOccurrence;
5. Anyclaimarisingoutofanycontractualliability;6. Damagecausedbyaroadtrafficaccidentorfire;7. AnybenefitcoveredasstandardunderaUnderlyingComprehensive
InsurancePolicy;8. Consequentiallossofanynaturewhatsoever,depreciation,wearandtear,
mechanicalorelectricalbreakdown,failuresbreakage;9. Lossordamagerelatedtoorcausedbycivilcommotion,labourdisturbances,
riot,strike,lock-outorpublicdisorder,war,invasion,actsofforeignenemy,hostilitiesorwarlikeoperations,oranyriskwhichiscoveredbythePolicyissuedbySASRIALimited(FormerlyTheSouthAfricanSpecialRisksInsuranceAssociation).IfWeallegethatthelossordamageiscoveredbytheSASRIALimitedPolicytheburdenofprovingthecontraryshallrestonYou;
10. Lossordamagecauseddirectlyorindirectlybyorthroughorinconsequenceoforcontributedtobynuclearweaponsmaterialorbyionisingradiationsorcontaminationbyradioactivityorbyanynuclearfuelorwaste;
11. AnyclaimintermsofthisPolicy,unlessYouhavecompliedwithallthe Policytermsandconditions;
12. AnydamageexceedingthemaximumrepairlimitasperthisPolicy;13. Anydamageresultinginthereplacementofanybodypanelorpartthereof;14. Anydepreciationinvaluearisingfromrepairsorrestoration;15. AnylossorclaimarisingwherethereisMisrepresentation,non-disclosure
ormisdescriptionofanyfactorcircumstance,whetherinconnectionwith: 15.1 ThisPolicy;or 15.2 YourclaimintermsofthisPolicy.16. AnyclaimwhereYouresideoutsidetheRepublicofSouthAfrica,in
whichcasethisPolicyshallbedeemedtobevoidfrominceptionand thePremiumrefunded;
17. LossordamageifTheVehicleisusedatanytimeduringthePeriodofInsurance asataxiortotransportpassengersforrewardorishiredoutforreward;
18. Loss,damage,consequentiallossoranylegalliabilityarisingfromthefailureormalfunctionofanycomputer,dataprocessingequipmentormediamicrochip, integrated circuit or similar device or any computer software (“The ComputerEquipment”);
19. Wherethelossordamageorliabilityisattributabletomorethanoneproximate cause, this exception will not apply if any other such cause is an Insuredevent;
20. IntheEventofthemechanicalbreakdownofanymachinery,equipmentorvehicle.WewillnotpayforthereplacementorrepairormodificationofanypartofthecomputerequipmentcausingtheEventbutWewillpayforanyresultantloss,damageorliabilitycoveredunderthisPolicy;
21. DamagetoTheVehiclewhichexistedpriortotheEvent(Pre-ExistingDamage),orloss,includingrusting,damageorliabilityarisingfromanyotherEventunrelatedtoaparticularclaim,unlesssuchEventissubjectofavalidclaim registered separately and in accordance with the terms and conditions of thisPolicy;
22. IfTheVehicleisbeingusedforracing,rallies,speedandothercontestsorwhilstTheVehicleisbeingusedforanypurposeinconnectionwiththemotortrade other than for the purpose of overhaul, upkeep or repair of The Vehicle.
23. Anegligent,wilfulorcriminalactbytheYou;24. LackofmaintenancetoTheVehicle,particularlyrelatingtothebrakesor
suspension system. 25. AnymodificationofTheVehicleorifTheVehicleisbeingusedfor,pace-
making, or any other competitive Event, or it is used as a military vehicle, courier/delivery vehicle or for the haulage/transportation of goods, any emergency or response vehicle, or for any use not covered under the UnderlyingComprehensiveInsurancePolicy;
26. LossordamagesifTheVehicleisolderthan10(Ten)years;27. SpecificallyexcludingcommercialVehicles,taxis/Vehiclesusedtotransport
fare paying passengers, tow trucks, and motor homes. 28. Anydamagethatisnotdefinedunder“Benefits”;29. Anydamagetobeadingormoulding,damageinvolvingaccessories,door
mouldings,plastic/vinyl/hardenedrubbertrimparts,windowmoulding,lamps ofanysortoranywindowpanel;
30. Anydamagecausedbyortostickersordecals;31. NobenefitsarepayableunderthissectioniftheapplicablePremiumforthis
sectionhasnotbeenpaidtoUsbythePremiumDueDate.

GENERAL DISCLOSURES.
AllcomplaintsareforwardedtotheComplianceOfficerwhowillforwardthemattertotheresponsibledepartmentforinvestigation.Oncethematterisresolved,theoutcomeiscommunicatedtothecomplainant.Ifthecomplainantissatisfiedwiththeresponse,thematterisconcluded.Shouldthecomplainantbedissatisfiedwiththeresponse,theOmbudforShort-TermInsurancemaybecontacted.
COMPLAINT RESOLUTION PROCESS.
InsuranceproductsdevelopedbyPinnAfricaaresold,onlicence,undertheIndependentIntermediariesbrandforwhichtheintermediaryisappropriately compensated.
CONFLICT OF INTEREST POLICY.It is generally accepted practice within our industry that “entertainment” and “gifts and incentives” collectively referred to as an immaterial financialinterestintheConflictofInterestregulations,areoftenprovidedbytheproductproviderandtheiragentstovariousintermediary,independentintermediariesandbrokers(allofwhommustberegisteredasFinancialServicesProvider)andviceversaandalsopotentiallyfromand to various other Financial Service Providers in the supply chain.
TheRandvalueofsuchinterestsarelimited,bylegislation,percalendaryear,toR1000(OneThousandRand)inrespectofanyoneindividualbetheytheprovideroforbeneficiaryofsuchimmaterialfinancialinterest.SuchlimitationsaredealtwithandmanagedbyourConflictofInterestManagementPolicy.AfullcopyofouroverallConflictofInterestManagementPolicycanbeobtainedfromwww.pinnafrica.co.zaorourofficesuponwrittenrequesttothePinnAfricaComplianceOfficer.
TREATMENT OF VAT.Youare,intermsofaSARSrulingissuedintermsofsection20(7)oftheVATAct,abletoclaiminputtaxonlyifYouareinpossessionofapolicydocument and proof of payment.
TREATING THE CUSTOMER FAIRLY.Wehavecreatedasuperiorsolution–encompassingproducts,processingandservice–tailoredtoeachofourcustomers’requirements.Wewilldeliverasuperiorcustomerexperience,simplifyingandimprovingbothourclientsandtheircustomers’lives.Wewillachievethisthroughamotivatedteamofskilledpeople,absolutefairnessinourtreatmentofourclientsandpartnersandcomplyingwiththe6TreatYourCustomerFairlyOutcomes,theseare;
• YouareconfidentthatYourfairtreatmentiskeytoourculture• ProductsandservicesaredesignedtomeetYourneeds,asOurtargetedclient• We will communicate clearly, appropriately and on time• WeprovideadvicewhichissuitabletoYourneedsandcircumstances• Ourproductsandservicesmeetyourstandardsandareofanacceptablelevel• Therearenobarrierstoaccessforourservicesortolodgeanycomplaints
VARIATIONS.NovariationtothisPolicyshallbebindingontheInsurerunlessmadeinwritingandsignedbyaDirectororPublicOfficeroftheInsurerandconfirmedthereafterbypaymentoftheInsuredofthepremiumwhethervariedornot.
Thispolicyisissuedonthebasisthatthestatementsandinformationmadeandsetforthintheapplicationandalldeclarationsmadeinrespectthereof are true and correct and constitute a full disclosure of all facts and circumstances likely to materially affect the assessment of the risk at the time of the issue of this Policy.
TheCompanyreservestherighttoamend,addorchangetheTermsandConditionsofthispolicybygivingonemonth’swrittennoticeofitsintentiontodoso.AnyvariationsandorchangeswillbebindingonboththeInsurerandtheInsuredandcanbeappliedatanytimetotheexistingTermsandConditionsafterwrittencommunicationofthesechangeshasbeensenttotheInsured’slastknownaddressasitappearsinour records at that time.
