1. These Rules may be cited as the Parole Rules. 1978.

2. In these Rules, unless the context otherwise requires- "appropriate parish parole committee" means the parish parole

committee which, in the opinion of the Board, is likely to have the closest connection with the applicant if he is released on parole;

"appropriate parole officer" means the parole officer who, in the opinion of the Commissioner of Corrections, is likely to have the closest connection with the parolee during the parole period;

"parole application form" means the form prescribed as Form A Schedule.

"parole unit" means the section of the M i a t r y which is responsilble for the administration of p m b ;

"the Superintendent" means the Superintendent of the prison in which an applicant for parole ia serving his sentence or frvrm which a parolee is released on parole.

Application for parole 3.-41) The Superintendent shall. at the end of each month or within

such longer period as the Board may determine, furnish to the parole unit a list of all prisoners under his supervision who will become eligible for parole under section 6 of the Act within the succeeding period of nine months after the date on which such list is compiled.

(2) Where after the submission of a list under paragraph ( 1 ) any prisoner named therein is transferred to another prison the Superinten- dent of the prison from which the prisoner is transferred shall give written notice to the parole unit of such transfer.

4 .11 ) The parole unit shall, not later than six months before the date on which a prisoner shall become eligible for parole, give written

Farm B. notice of that date to the prisoner in the form prescribed as Form B in the Schedule.

(2) The parole unit shall furnish the Superintendent with copies of the parole application form.

(3) Where a notice is given under paragraph ( 1 ) . the parole umit shall-

(a) send a copy of each such notice to the Superintendent and the Board;

(b) request the Superintendent to furnish each prisoner in receipt of such notice with copies of the parole application form.

5 . - ( 1 ) Every prisoner eligible for parole who wishes to apply for the grant of parole shall make his application on the parole application form.

(2) Every such application-

(a) shall be submitted to bhe Superintendent; and (b) may be accompanied by such written representations as the

applicant may wish to make in support of his application.

(3) Written representations pursuant to paragraph (2) may be attached to the application forms or may be submitted within a reason- able time after the application fonn is submitted.

6 . - ( 1 ) Upon the receipt of an application submitted in accordance with rule 5, the Superintendent shall forthwith-

(a) prepare a case history of the applicant in the form prescribed as Form C in the Schedule;

(b) request a prison officer to prepare the report required by section 7 (3) (b) of the Act, in the form prescribed as Form D in the Schedule;

(c) obtain the report required by section 7 (3) (c) of the Act.

(2) The Superintendent shall, as soon as is practicable after the parole application form is submitted to h h , forward to the parole unit for submission to the Board. such form together with the reports men- tioned in paragraph (1).

7.-(1) The parole unit shall examine all parole application forms and all documents relating thereto with a view to ensuring that such forms and documents are in order for submission to the Board, and shall submit them to the Board.

(2) Where such documents are not in order as aforesaid the parole unit shall take such steps as are necessary to ellsure that the documents are in order.

Grant or refusal of parole

%.-(I) Subject to pragraph (2). the Board shall, upon the receipt af the documents aforesaid, fix a ddte and plnce for thc hearing of the application and shall notify the appropriate parish parole committee in the time and manner prescribed in section 7 (4) (c) of the Act.

(2) The Board may, before making a decision under paragraph (1). require, pursuant to section 7 (4) (a) of the Act, the appropriate parish parole committee to carry out such investigations as the Board may direct.

(3) The Board shall endeavour to ensure that the date fixed under paragraph (1) is the earliest practicable date after the date on which the applicant becomes eligible for parole.

9.-(1) Where the Board decides to grant parole to an applicant, the parole unit shall, within ten days of the date of such decision-

(a) give written notice of the decision to the Superintendent and the applicant;

(b) advise the applicant in writing that arrangements will be made for his release on parole on tLe date specified in the parole order relating to that applicant;

(c) forward to the Superintendent copies of the parole order made in respect of the applicant:

(d) cause to be prepared and forwarded to the parole officer an identification card in relation to the applicant.

(2) A parole order shall be in quadruplicatt: and-

(a) shall be in the form prescribed as Form E in the Schedule; FO, E.

(b) may contain, in addition to the conditions stated in the pre- scribed form, such special conditions as the Board may consider necessary for the rehabilitation of the parolee.

(3) Any of the conditions of a parole order may, if the circum- stances so warrant, be varied or revoked by the Board and for this purpose the Board may take into account any advice given by the appropriate parole officer.

(4) The identification card referred to in paragraph (1) (d) shall

Form F. be in the form prescribed as Form F in the Schedule and shall be delivered to the parolee by the Superintendent at the time when the parolee is released on parole.

(5) A parolee shall carry his identification card on his person at all times and shall produce it for inspection if required to do so by any member of the security forces or the parole officer. as the case may be.

(6) For the purposes of paragraph (5) "security forces" means-

(a) the Jamaica Constabulary Force;

(b) the Jamaica Defence Force to the extent that such Force has been assigned to act in aid of the police;

(c) the Island Special Constabulary Force; and

(d) the Rural Police.

10. On receipt of copies of a parole order the Superintendent shall-

(a) require the parolee to sign such copies;

(b) give a copy of such order to the parolee, return a copy to the parole unit and place a copy on the parolee's penal record.

11. The parole unit shall, upon receipt of the copy of the parole order referred to in rule 10 ( b j

(a) notify the appropriate parole officer accordingly and furnish such officer with a copy of the parole order and a case history of the parolee;

(b) notify the Criminal Records Office of the Jamaica Constabul- ary Force and the Chief OBcer of Police in the parish in which the parolee is permitted to reside pursuant to the relevant

condition in his parole order, stating the date of release and the date on which the parole order shall expire.

12.--(I) Where the Board decides to refuse to grant parole to an applicant. the Board shall forthwith notify the parole unit of such decision,

(2) The parole unit shall within ten days after the date of such decision give written notice to the applicant and the Superintendent and shall advise the applicant as to the date on which he may reapply for parole.

(3) A prisoner whose application for parole has been refused or a parolee whose parole has been suspended or revoked may, in the time specified in section 15 (1) or (2) of the Act, as the case may require, re-apply for parole in the manner prescribed in rule 5 and any such application shall be processed in the manner prescribed in rules 6. 7 and 8.

Operation of Parole

13.41) The duties of the parole officer of any parish shall be-

(a) .to act as liaison between the parole unit and the parish parole committee on matters relating to the rehabilitation programme for parolees;

(b) to assist in the promotion of effective methods for the fullest development of the parole system in the parish;

(c) to co-ordinate the activities of ,the parole unit with the police. charitable organizations, social services and health services in the parish;

(d) supervise, advise and assist the parolees placed under his supervision;

(e) inquire. in accordance with any direction of the appropriate parish parole committee, into h e circumstances or home surroundings of any prisoner who has applied for parole with a view to assisting the Parole Board in determining the most suitable method of dealing with the application;

(f) to perform such other duties as ,the Parole Board or the parish parole committee may direct. -

(2) The parole officer shall make quarterly reports to the parole unit on the progress of the parolees residing in the parish to which such parole officer is assigned.

14.-31) A parole officer shall, subject to any directions given by the Board (whether in the parole order or otherwise) or the appropriate parish parole committee, visit the residence of a parolee placed under his supervision and make inquiries as to his behaviour, mode of life and employment.

(2) The parole officer shall keep in close touch with such parolee and shall secure, as far as possible, the co-operation and assistance of social and religious workers or agencies.

15. A parole officer shall-

(a) satisfy himself that every parolee placed under his supervision understands the conditions of the parole order relating to him; and the parole officer shall endeavour to ensure the observance of those conditions by the parolee;

(b) make himself conversant with the provisions of the Parole Act and with these Rules and such other rules as may be made under that Act.

16. A parole officer shall report-

(a) as to the conduct and mode of life and generally as to the progress of every parolee placed under his supervision, to the appropriate parish parole committee;

(b) to the parole unit on the failure of any parolee placed under his supervision to observe any of the conditions of his parole order.

17. Case reports and returns of a parole officer shall be made to the parole unit at such intervals and in such manner as the parole unit may direct and shall not be published.

18.-41) Every parole officer shall keep a record of each case placed under his supervision, in the form and manner prescribed by these Rules.

(2) The particulars forming the record of each case shall be Form G. entered by the parole officer on the form prescribed as Form G in the

Schedule.

(3) The entries in each case shall be made from time to time without delay by the parole officer.

19. A parole officer shall not wear any badge or uniform distinctive of his office.

20. When a parolee is permitted by the Board to reside in a parish other than the one stated in the parole order consequent upon a variation of a condition of the parole order, the record relating to such parolee shall be forwarded to the parole officer assigned to that parish and subsequent reports relating to that parolee shall be made to the parish parole committee in the new parish.

Terminal ion of parole

21.-(1) Where the Board intends, pursuant to section 9 of the Act, to suspend parole in respect of any parolee the Board shall, within a reasonable timc, give written notice of such intention to-

(a) the Commissioner of Corrections; (b) the parolee; (c) the Superintendent; (4 the appropriate parole officer; and

(e) the Criminal Records Office of the Jamaica Constabulary Force and the Chief Officer of Police in the parish in which the parolee resides.

(2) Where the Board decides, pursuant to section 10 of the Act. to revoke the parole granted to a parolee, the Board shall forthwith give written notice of that decision stating the reasons therefor to-

(a) the parolee; (b) the Superintendent; (c) the appropriate parole officer; and (d) the Criminal Records Office of the Jamaica Constabulary

Force and the Chief Officer of Police in the parish in which the parolee resides.

(3) The Superintendent shall-

(a) give written notice to the Board of the date on which such parolee returns to prison consequent upon the suspension or revocation, as the case may be, of his parole;

(b) notify the parole unit of the date on which the sentence of such parolee shall expire.

(4) Where the board decides to revoke the parole granted to a parolee the Board mar. if it thinks fit, permit the parolee to make written representations to the Board against such revocation; and the Board shall notify the parolee accordingly.

2 2 . 4 ) If there is a forfeiture of parole the parole unit shall forth- with notify-

(a) the Tarolee;

(b) the Superintendent;

(c) the appropriate parole officer; and (d) the Criminal Records Office of the Jamaica Constabulary

Force and the Chief Officer of Police in the parish in which the parolee resides.

(2) The Superintendent shall give written notice to the Board of the date on which a parolee returns to prison consequent upon the forfeiture of his parole.

23.-(1) The warrant required pursuant to section 1 1 ( 1 ) of the Act Form H. shall be in the form prescribed as Form H in the Schedule.

(2) The warrant required pursuant to section 12(1) of the Act Fonn I. Shall be in the form prescribed as Form I in the Schedule.

24. Upon the completion of the parole period-

(a) the parole officer shall notify the Board that a parolee has completed his parole;

(b) the parole unit shall issue a certificate to that parolee in the Form 1. form prescribed as Form J in the Schedule; and

(c) the parole mit shall send copies of such certificate to the Superintendent, the appropriate parole officer and the Criminal Records Office of the Jamaica Constabulary Force and the Chief Officer of Police in the parish in which the parolee resides.

General 25.-(1) For the better supervision of parolees, a register of all

persons released on parole shall be kept under the management of the ..

Assistant Commissioner of Police in charge of Crime and the Chief Officer of Police in each parish.

(2) Where a parolee is charged with an offence during the parole period it shall be the duty of the Chief Officer of Police in the parish in which the parolee is being tried for such offence to inform the court of the fact that such parolee is on parole.

26. The Board shall, at the end of each year or within such further time as may in special circumstances be allowed by the Minister. furnish to the Minister the reports required by section 4 0 of the Act.

27.-(1) For the purposes of section 6(5) of the Act, the parole unit shall within a period of six months before the expiration of the relevant period of ten years advise the Board in writing of such cases as are to be reviewed by the Board pursuant to that section.

(2) The Superintendent shall furnish to the parole unit, in relation to each case referred to in paragraph (I), the following reports-

(u) a case history of the prisoner; (b) a report by a prison officer on the conduct of the prisoner

during his term of imprisonment;

(c) a report containing an opinion of a psychiatrist or psychologist as to whether the prisoner has derived maximum benefit from imprisonment and whether he is, at the date of the report, fit to be released on parole.

(3) The Board shall notify the parole unit of the date fixed by the Board for the review of such cases, and the parole unit shall, not later than fourteen days after the receipt of such notification, give written notice to the prisoners to whom this rule applies.

28.-41) For the purposes of paragraph (a) of section 7(6) of the Act, the Assistant Commissioner of Police in charge of Crime shall furnish the Board with a report of the nature and circumstances of the offence in relation to which an applicant for parole was convicted and sentenced.

(2) For the purposes of paragraph (b) of section 7(6) of the Act, the Registrar of the Supreme Court or the Clerk of Courts, as the case may be, shall furnish the Board with a transcript of remarks, if any. made by the Judge at the time of the sentencing of a person tried and convicted before the Judge.

29. Records relating to parole shall be preserved for not less than ten years after the expiration of the parole period to which they relate.

30.--(I) A summons issued by the Board pursuant to section 4 (b) of Form K. the Act shall be in the form prescribed as Form K in the Schedule.

(2) Where parole is suspended or revoked, notice of such sus- pension or revocation, as the case may be, shall be in the form pre-
