Community Watch/Incident Report: December 2014

Here’s another item addressing the revised state regulations applicable to Lake Montclair. We recently updated Montclair’s Emergency Action Plan (EAP) as required. Among other things, this plan shows the actions and responsibilities for protecting the residents, structures, etc. downstream from Lake Montclair’s dam in the event of any dam failure.

A meeting with state and county officials is being arranged. A copy of the revised and state approved EAP will be provided to the county zoning officials at that time. The revised state dam regulations require the county share in the responsibility for any damage to items approved for placement in the flow area shown in Montclair’s current inundation plan after receipt of Montclair’s revised EAP.

Again let me emphasize your dam is properly maintained and frequently inspected. These inspections include the inside of the 135-foot outflow pipe and the gate located at the end of the pipe at the bottom of the lake 54 feet below the lake surface. The concrete structure you see at the dam with its gate opening mechanism is tested and inspected from top to bottom 60 feet down. This area is the most critical component of the dam. And the earthen part of the dam also gets close attention.

Tom, Heather, Buck and I attended another state sponsored dam workshop in preparing to address any alterations to Montclair’s alternative spillway determined necessary after the state review of it’s probable maximum precipitation (PMP) requirements.

Delegate Scott Lingamfelter issued a response with an update on the PMP requirements, which can be found on page 6. Scott, thank you for all the meetings and time that you’ve spent with us in addressing this important situation in Montclair. Thank you for your continued support of the community of Montclair in the many messages you have taken forward on our behalf. Your advice is always valued.

Prince William County Police arrested two individuals for the mailbox vandalism. Make sure that Officer Kim Chinn is aware of the other vandal activities including the auto windows shot with BB guns and the theft from autos. Your reports are necessary as the officers investigate the rash of petty crimes in our community. Others could be involved. As justice is addressed and a price is paid hopefully those involved in these crimes will be receptive to the counseling and dedicated efforts by those professionals trained to help redirect wayward teens. Bill and Marie are preparing safety programs presenting things we can do to discourage these crimes and protect our families and property.

This community has come together remarkably providing assistance and love to a family confronted with the loss of their home and contents resulting from a devastating fire. Thanks to those that lead our desires to help, and a special thanks to Connie.

Don’t believe the groundhog - spring and all of Montclair’s beauty will be bursting out shortly. In the meantime, I am turning up the heat.

Help Wanted: Summer PositionsWe are currently accepting applications for seasonal employment of recreation guards, supervisors and managers. Recreation guard applicants must be 16 years of age or older and able to work varied hours. A valid driver’s license and transporation is preferred, but not required. Recreation supervisors and managers must be college students or equivalent and must have worked at least one season in a position of similar responsibility. A valid driver’s license and transportation for use to and from assignments during the work day are required for these positions. For more information, contact our office at (703) 670-6187. No Assessments for March & AprilResidents electing to pay their assessments monthly will enjoy a two month break from assessments in March and April. The MPOA fiscal year runs May through April, with monthly assessments divided into 10 payments rather than 12. There is no assessment due for March or April. Payment coupons will be distributed to owners at the end of March pending budget approval at the Annual Meeting. If you do not receive a coupon book, please contact our office at (703) 670-6187.

Annual Meeting: Saturday, March 14Voting packets for the Annual Meeting were mailed to all owners mid-February. All eligible owners are encouraged to vote on the FY2016 Budget and Precinct Representative positions. Vote online, by mail, or by fax by Thursday, March 12. If you miss the deadline, don’t worry: owners are welcome to vote in-person at the Annual Meeting on Saturday, March 14 at Southlake Recreation Center. Registration for the Annual Meeting begins at 9 a.m., and the meeting will be called to order at 10 a.m. See page 9 for more information.

Amendments to Community Guidelines Article 5, Section 5.1.4 Role of the Covenants DirectorThe “Covenants Director” is a the staff member Assistant Manager of Administration, who supervises the Covenants Manager, Covenants Administrator and Covenants Inspectors, and who responds to complaints of covenants violations and receives applications for exterior alterations and home businesses. Their duties include: (1) review applications for...The following are “Quick Track” requests that may be approved by the Covenants Director, and will generally not require review by the Covenants Committee:a. Storm doors;a. Decorative Objects: Not over 18” in length, 18” in height, and 12” in width;b. Doors, Entry/Storm: Full view, clear glass storm doors that match the front door color or trim color of the house and doors, entry/storm meeting the

Requirements and Restrictions as stated with sub-association approval;c. Electronic & Propane Insect Traps: Meeting the Requirements and Restrictions;d. be painted with Behr solid color stains Padre Brown, Wood Chip, Russet, Valise, Chocolate and Sable. Paints from other suppliers that are an exact match to these colors are acceptable.

a. Fences are to be constructed of wood and are to be left to either weather naturally or stained in a semi-transparent stain in a natural wood color. No redwood stains, paint, or solid stains will be acceptable. Paint or solid stains of natural wood color which aesthetically blend with the home and neighborhood will be considered on an individual basis.

k. For Northside Townhomes: Fence style is 6’, alternating board-on-board with a straight top. No redwood stains, paint, or solid stains will be acceptable.l. For Water’s Edge Townhomes:

1. Landscaping alternatives to the use of fences are encouraged. All fences must be 6’, alternating board-on-board with a straight top. Gates must match the style and height of the fence. Fences must be left to weather naturally or weather protected with a clear sealer.

Addition of Resolution #2015-01 Schedule of Costs and Fees Relating to a Member’s Request for Copies of Association Books and RecordsWHEREAS, effective July 1, 2012, Va. Code Ann. § 55-510(D) as amended (1950) states:D. Prior to providing copies of any books and records to a member in good standing under this section, the association may impose and collect a charge, reflecting the reasonable costs of materials and labor, not to exceed the actual costs thereof. Charges may be imposed only in accordance with a cost schedule adopted by the board of directors in accordance with this subsection. The cost schedule shall (i) specify the charges for materials and labor, (ii) apply equally to all members in good standing, and (iii) be provided to such requesting member at the time the request is made.

NOW, THEREFORE, in accordance with the requirements of the Virginia Property Owners Association Act, Va. Code Ann. §§ 55-508, et seq., the Board of Directors adopts the following Schedule of Costs and Fees, attached hereto and incorporated herein by reference as Exhibit A, relating to a member’s request for copies of Association books and records in accordance with Va. Code Ann. § 55-510, as amended (1950).

If you are an owner of a lot in Montclair and are in good standing (all assessments, fees and charges paid by February 10, 2015), and do not receive a packet in the mail by Friday, February 20, 2015, please contact the MPOA office to make arrangements for a replacement from Election Trust.

This year the lot owners will be asked to vote for four Precinct Representatives to serve on the Board of Directors and the FY2016 Budget. Owners of Record may vote via the internet, mail, fax or in person at the Annual Meeting on March 14, 2015.

Paper ballots should be mailed in by Friday, March 6, 2015. Ballots submitted by fax or internet must be submitted by 5 p.m. EST, Thursday, March 12, 2015.

Your vote is important. To achieve quorum at the Annual Meeting, our governing documents require that 25% of the eligible voters cast a vote on the budget. The MPOA will auction off all unclaimed or abandoned boats found on Lake Montclair or located on the West Beach boat racks that do not have current registration stickers. Bids will be accepted beginning Monday, April 6.

Boats available for bidding will be located in the West Beach parking lot and clearly marked with a numbered sticker. Only bids from owners in good standing will be accepted. Limit one bid per household.

To place a bid on a boat, please complete the 2015 Spring Boat Auction form located online at www.montclairva.com or at the MPOA office. Forms may be faxed to the office at (703) 670-9620 or left in the drop box located outside of the MPOA office main entrance. Forms may additionally be emailed to Erika DelAguila at [email protected]. The

deadline to place a bid is Monday, April 20 by 5 p.m. The winning bidders will be notified by Monday, April 27.

If you store your boat on the West Beach boat racks, please ensure that it is properly registered with the MPOA office. Boats that are registered and current will have an October 2015 sticker as well as an orange Montclair sticker with a 4-digit number. If your boat is not registered, please fill out the Boat Registration form and return it, along with a photo of your boat, to the MPOA office as soon as possible to obtain stickers. Any boats stored at West Beach that are not properly registered by Monday, March 17 will be marked for auction.

The Covenants Department will be performing Annual Inspections beginning in late March. The purpose of annual inspections is to help improve on the enforcement of the MPOA Declarations and Guidelines. Regular inspections are also key to maintaining property values and to keep Montclair a pleasant and beautiful neighborhood for all residents to enjoy.

The process entails a detailed inspection of the entire property for every home and lot. With nearly 4,000 homes in Montclair, this process can last through the fall.

What is the process for Annual Inspections?When inspections begin, Covenants Inspectors will walk every street in Montclair inspecting each individual home and lot. Any items found to be in violation of the community’s covenants will be noted and the owner will be sent a Notice of Non-Compliance. This letter will provide the owner the nature of the violation and two weeks to correct the violation. If the violation has not been corrected within two weeks, the Covenants Inspector will return to reinspect and a second

Notice of Non-Compliance will be issued. At that time, the owner will have two weeks to correct the violation. If the violation still has not been corrected, the inspector will issue a third Notice of Non-Compliance, known as a Hearing Opportunity. Owners will have the opportunity to request, in writing, a hearing before the Board of Directors to discuss their violation. If a homeowner chooses to waive the Hearing Opportunity with the Board, fines may be assessed if the violation remains uncorrected. Extensions for correction of violations are considered on a case-by-case basis. If you have any questions about your letter, please call our office at (703) 670-6187.

Will someone be on my property?Covenants Inspectors, Bridget Geiger and Jon Bradford, as well as Covenants Manager, Kristie Upperman, will be on homeowners’ property conducting Annual Inspections. Inspectors will perform most inspections from public areas, but have the right to go onto property to evaluate potential violations. Before entering rear yards, inspectors will first notify the resident. All Covenants Staff members are assigned specific MPOA shirts

and will be wearing identification badges. If you have any questions regarding inspections or notices, they are available to assist you.

Preparing Your HomeArticle 5 of the Community Guidelines is available for download at MontclairVA.com and contains information on what items are and are not permitted and what can be considered a violation. Some of the most common violations can be addressed prior to Annual Inspections to prevent receiving a violation notice:

• Check for mold, dirt, or other discoloration on siding and gutters;

• Inspect all window, door, and other miscellaneous wood trim for mold, discoloration, or rot;

• Make sure trash and recycling containers are stored out of public view, except on trash days;

• Prune any overgrown landscaping and, in the warmer months, cut grass regularly;

• Keep all items on the entire property stored in a neat and orderly fashion;

• Ensure that house numbers are affixed to both the mailbox and the house.

Annual Inspections to Begin


MPOA Guidelines prohibit dogs on beaches in Montclair primarily because pet waste contributes to degradation of water quality and introduces risks to human health.

There are many incidents of dog owners either leaving dog feces on the beach; covering it up with sand (even worse because a child could dig it up unknowingly); or throwing it into the lake. There have been instances of unleashed dogs running well ahead of their owners on the beach or in common areas abutting the lake where owners cannot see what their dogs are doing.

Probably the greatest health concerns associated with feces are pathogens. Many of these pathogens can infect humans if ingested. Organisms such as Cryptosporidium, Giardia lamblia, and Salmonella can induce symptoms ranging from skin sores to chest pain. E. coli, which causes diarrhea and abdominal gas, has been the source of disease outbreaks in several states.

Dog feces often contain roundworms and other parasitic nematodes. Infection by just a few roundworms usually causes no problems, but more severe infections may cause fevers, bronchitis, asthma, or vision problems.

The health of residents, especially small children digging in the sand, far outweighs the inconvenience of not walking ones dog on the beach. Keeping the water and sand clean for all to enjoy is everyone’s responsibility.

At the Volunteer Appreciation Reception in February, Richard “Buck” Arvin was presented with the 2014 Distinguished Montclairion Award. Buck has contributed much time and talent to the maintenance and improvement of Lake Montclair.

A member of the Lake Management Committee (LMC) for over 9 years, Buck assumed the role of Chairman in 2010. Buck has played an instrumental part in numerous projects concerning the lake, including contracting for the 2014 Inundation Study and Emergency Spillway Analysis, revising the Emergency Action Plan, coordinating with Management for dredging operations, presenting articles for inclusion in The Montclairion, and administrative duties as Chairman of the LMC.

Buck is currently working with Management to coordinate Emergency Action Plan tabletop exercises, and continues to contribute to meetings concerning the dam’s emergency spillway requirements. Buck’s hard work and dedication is an exceptional asset to the community. Thank you, Buck!

SchoolsHenderson ElementaryFebruary was a busy and very special month for our school. The biggest news is that Henderson Elementary School has been designated as a School of Excellence for the 2013-2014 school year! This is the 12th year Henderson has earned the coveted title. School of Excellence is the highest recognition awarded to schools by the PWCS School Board. It signifies high levels of performance on state accreditation, Annual Measurable Objectives, and in moving toward the goals of the Division’s Strategic Plan. Henderson was also featured in the “Best Practices Showcase” at the February School Board Meeting. Principal Suzanne Bevans, Gifted Resource Teacher Colleen Kendrick, Reading Specialist Gina Cory and ESOL teacher Lisa Jacobsmeyer shared Henderson’s amazing journey in becoming PWCS’s first and only Focus School for Children’s Engineering. February 13th-15th was the Valley Forge Encampment. The scouts hiked and reenacted the turning point of the Revolutionary War. They did all this in the freezing cold weather (but probably not as cold as it was back then, because we have more modern conveniences for camping in cold weather). The following day, February 16th, was Presidents’ Day. Remembering amazing leaders, after reenacting a turning point in history, made for a great end to the weekend.

On February 21st, the scouts completed an activity that lead up to their favorite thing, MULCH!!! To be exact, mulch flyer delivery. The scouts delivered the mulch flyers to the Montclair community announcing the next opportunity for supporting the biannual fundraiser with Troop 189. Mulch delivery is scheduled for March 21st, so don’t forget to send in your order.

Troop 35 ended the month with respectful service to the country by collecting flags. They helped collect old American Flags at the landfill’s Flag Drop project. The flags were collected so that they may be retired in

the proper way. That activity rounded out the month for Troop 35, a month of fun, fulfilling and educational activities.

National Active and Retired Federal Employees Chapter 1270The January meeting ushered in our new set of officers: Linda Force, President; Tammy Flanagan, Vice President; Darwin Ransom, Treasurer; and Cheryl Sullivan, Secretary. Our speaker at the January meeting was Mary Kay Jones of Weight Watchers with tips for healthy eating and activities for losing weight and improving health in the new year.

Semper K9 Assistance DogsSemper K9 Assistance Dogs, a local nonprofit in Prince William County, is currently looking for candidates in need of a service dog. Semper K9 provides Assisted-Living K9s for wounded, critically-ill and injured members of the U.S. Armed Forces and their families.

They are also looking for ideal canine candidates to become service dogs in training. “We are in the process of obtaining our 501c3 status from the IRS,” says Christopher Baity, Semper K9’s Executive Director. “During this waiting period we will begin training and preparing our program for success.” Semper K9 Assistance Dogs will focus on finding ‘rescue dogs’ from various organizations throughout the United States to give these unclaimed K9s a new leash on life and allow them to help a service member. They are looking for dogs that will meet certain requirements to enter their training program. A list of these requirements can be found on their website, www.SemperK9.org.

“It takes at minimum 6-9 months to train a young adult dog to become a service dog. This gives us time to locate and match a service member with their future service dog, who’s training is tailored to meet the new handler’s specific needs.” stated Baity who is a veteran Marine Corps dog handler and kennel master. With 6 overseas deployments during his eight year career, Baity recognizes the overwhelming need for help of veterans suffering from Traumatic Brain Injury (TBI) and Post Traumatic Stress (PTSD).

Semper K9 Assistance Dogs currently has a GoFundMe account as well as an Amazon.com wish list to assist them with training and supplies. They help qualifying post 9/11 Marines, Sailors, Soldiers, Airmen, Coast Guardsmen, and reservists with amputations, spinal cord injuries, Traumatic Brain Injury (TBI), severe Post Traumatic Stress (PTS), burns, blindness, other physical injuries, or those suffering from life-threatening illnesses. Interested applicants can submit a needs assessment form under “Apply For A Service Dog” on their website.

Supervisor Caddigan’s MessageDear Montclair Neighbors,

Dam SafetyThere are serious concerns about Dam Safety regulations as they pertain to Lake Montclair. Marc Aveni, Chief of our Environmental Services Division has responded to these concerns and the regulation’s impact on our dam. The Virginia Dam Safety Act was last revised by the Virginia Soil and Water Conservation Board in 2012. That revision increased dam safety certification regulations state-wide with no provision for “grandfathering” older dams. Prince William County, during the public comment period for these regulations, expressed concerns similar to those by the MPOA and Montclair residents. The regulations were subsequently passed by the General Assembly. The MPOA has been in discussion with Delegate Lingamfelter seeking his assistance. It has been suggested by Mr. Aveni that grant opportunities available through the Department of Conservation and Recreation be explored to provide assistance in upgrading the dam to current standards. This subject is extremely important to all of us and I will continue to monitor it along with our homeowners association.

Secondary Road MaintenanceThe Board of County Supervisors held a joint meeting with our delegation in December. During that meeting I shared with the delegates the need for maintenance of our secondary roads. Delegate Lingamfelter and Senator Barker subsequently submitted bills (HB1407 and SB1274) that would increase available funding for secondary road maintenance. The County’s Legislative Director, Tracy Gordon, in a memo dated January 28th has conveyed to the Board of Supervisors “good news” concerning one of the county’s top priorities for the 2015 session of the General Assembly. The Supervisors visited our delegation in Richmond on February 5th. Results of this visit are available on my web page, on Facebook and through one of my E-Grams.

Eagle ScoutsOn December 9th James ( Jimmy) Young and Benjamin Arrighi received the highest level of scouting achievement and were awarded the rank of Eagle Scout. Both boys are residents of Montclair and I was proud to attend their Court of Honor Ceremony and present them with a commendation from the Board of Supervisors expressing our admiration for their years of service to scouting and the community. These two young men have bright futures and are our future leaders.

AssessmentsAssessments are $510 when paid in full, or $53 when paid monthly. Monthly assessments are due on the first of the month, May through February. Any assessment not received within ten days of the due date will incur a $45 late fee.
