WASHINGTON THIS WEEK In conjunction with the U.S. Executive Branch, the FCC announced its DAB strategy for the World Administrative Radio Conference '92 (WARC -92), which supports the allocation for satellite and complementary terrestrial DAB at 2.3 GHz, with a
proposed band of 2310 -2360 MHz. Chairman Alfred Sikes said the FCC is continuing to research in -band DAB, as well as establishing ground rules for DAB service that would allow existing broadcasters to upgrade their services. The Commission and the Executive Brancn agreed that the U.S. will seek to add terrestrial DAB allocation issues to the agenda of post - WARC -92.
According to Radio & Records, Congressmen Ed Markey (D -MA) and John Dingell (D -MI)
are leading an effort that would severely inhibit LMAs and time brokerage agreements. Markey and Dingell have proposed a new bill that would impose restrictions on such agreements, including: 1) stations would be prohibited from leasing more than 25% of air time, including no more than 10% of air time controlled by a single outside programmer; 2) stations could not enter into agreements with parties not qualified to be FCC licensees; 3) all agreements must be registered with the FCC; 4) waivers to the 25% rule may be granted from the FCC if stations can prove that the exemption is essential to station operation. The provisions would apply only to radio and television stations, and does not include network programming or syndication.
In a responding statement, the NAB voiced concern about the effect of the proposed legislation on time brokerage agreements and the need for a clear definition of
what can or cannot be allowed under such agreements. The NAB said, '. . .this
bill appears to do more to kill them than define them. We hope that its sponsors will recognize the value of such agreements in helping many stations stay competitive and preserve local service to their communities."
The FCC waived its one -to -a- market rule and granted the application of Susquehanna Radio Corp. to transfer the licenses of WTKN, Pinellas Park, FL, and WHVE,
Sarasota, FL from Susquehanna to Paxson Broadcasting of Tampa, LP. Paxson's general partner Lowell Paxson has attributable interest in the licensee of
television station WBSH in Tampa, which has a Grade A contour that includes both Pinellas Park and Sarasota. Ordinarily,a common ownership of television and radio stations would violate the one -to -a- market rule. However, Paxson was granted the waiver because he proved that the Tampa -St. Petersburg market met the FCC's Top 25/30 voices test, which generally permits the licensing of radio -television combinations. Tampa -St. Petersburg is the 13th largest ADI television market, and was shown by Paxson to have 41 separately owned or operated broadcast stations in
existence after all assignments are made.
In other action, the FCC granted Villcom Broadcasting's application for the
renewal of license for WZZU, Burlington, NC, subject to reporting conditions, and issued a Notice of Apparent Liability to Villcom for a forfeiture of $5,000 for
EEO violations. The FCC found Villcom's EEO efforts to be deficient.
The FCC's FM Branch is requesting comments for an informal review of the FM licensing process. According to the Commission, approximately 60 percent of FM license applications have discrepancies, many of which occur repeatedly. Among the most frequent discrepancies are: transmitter power output is miscalculated; towers are constructed to the wrong height; antenna and transmission line types are listed incorrectly; and the construction permit is allowed to expire before the license is filed. Another frequent problem is the lack of compliance with
special operating conditions. The FCC said that discrepancies cause delays in
application processing and divert engineering staff time from processing applications for new and existing facilities. Those wishing to file comments and

Houston Christian Broadcasters, Inc. has applied to the FCC to change the license
of KHCB 1400KHz Galveston, TX to noncommercial educational.
CANADA THIS WEEK A "very preliminary" report about DAB testing in Canada's L -band has been issued from a joint study by the CBC, the Canadian Association of Broadcasters, the
Department of Communications and its Communication Research Centre. The research is part of Canada's proposal to WARC -92 for a mixed terrestrial /satellite digital radio frequency in the L -band. Initial results showed that "lower receiver noise
figure, lower man -made noise and the use of time and frequency diversity in new
digital broadcasting systems would seem to compensate for the increased propagation losses and the smaller antenna aperture." Tests of the system were

conducted in various environments in Ottawa and Montreal. Further findings will be made available in four reports to be released over the next three months.
ELSEWHERE Third quarter radio advertising revenues were down by 3% from last year's figures, according to the Radio Advertising Bureau. The third quarter showing was an
improvement over the first quarter 1991, which had a 5.2% decrease from the first
quarter 1990. Local revenue for the third quarter was down 3.2% with national down 2.1%, compared with the third quarter last year. The RAB's September figures show a 3.9% decrease from 1990 revenues, with a local and national revenues down by 3.2% and 5.8 %, respectively. September's only regional gains in revenue were
in the Southwest and Midwest, with a local increase of 4.1% in the Southwest, and local and national increases of 0.4% and 2.3%, respectively, in the Midwest.
Birch Scarborough has reached a settlement in its lawsuit against Edens Broadcasting of Phoenix, owners of KKLQ AM /FM, San Diego, CA, and WRBQ AM /FM,
Tampa, FL. Birch had charged that Edens committed copyright infringement, breach of contract, and mail and wire fraud in its use of Birch's ratings reports. The
amount pf the settlement was not disclosed, but "both parties expressed satisfaction about the terms of the settlement" according to Birch.
The 'rational Black Network has entered into an agreement with Sheridan Broadcasting. NBN, which dropped its news function earlier this year, has a talk
format and will be added to Sheridan's line -up of black -oriented networks, which
includes news, sports and entertainment programming.
According to the Washington Times, UPI has withdrawn the layoff notices it issued to its radio network employees in October. The scheduled layoff was to take place November 5, upon the sale of the network. The layoff was canceled because UPI is
still reviewing offers to buy the network. The UPI's Al Rossiter said, "We just
want some time to see what's best." Rossiter also said that individual layoffs of radio employees might occur in the future.
Tracy Thomas, publisher of the Finderbinder Media Guide, and owner of a Kansas City ad agency, blasted the advertising schedule of KBEQ, Kansas City, and
station -advertiser relations, in general, in a recent Finderbinder editorial. According to Thomas, KBEQ is "cramming more commercials together than any other
station in town" because it runs blocks of 5 spots in a row surrounded by station promos in its :45 to top of the hour time slot after playing 45 minutes of
"uninterrupted" music programming. Thomas referred to KBEQ's lengthy advertising stop set as a "Slave Quarter Hour" and a "commercial ghetto," and is enlisting advertisers to call the station and insist that they only pay for the audience
delivered in that quarter hour. She said, "Why base buys on overall ratings --
they include the 45 minutes each hour that's commercial -free. . . Maybe we should tag our spots, 'And now back to the station that plays one song in a row!'"
Thomas also criticized the oft -used station liner, "x in a row with no commercial interruptions," saying that advertisers "deserve on -air respect, not scorn. After
all, we pay all the station's expenses." In addition, Thomas said it is
unacceptable for stations to change formats without informing advertisers, as in
KBEQ's recent switch from Chit to a.,.rnative rock programming at night without
notice or promotion. She said, "They expect advertisers to bankroll this
experiment . . .unknowingly."

educational background, occupation breakouts, and purchasing power. For more

Bonneville Broadcasting System is offering a special Christmas edition of its
Chartbreakers Music Service on compact disc. The discs include such holiday hits
as Gene Autry's "Rudolph the Red Nosed Reindeer," Springsteen's, "Santa Claus is
Comin' To Town," and "Jingle Bells," by those legendary crooners, The Singing Dogs. For more traditional programming Bonneville has a 14 disc set with a

WASHINGTON THIS WEEK
David Stiles was ordered by the FCC to dismantle the radio tower he owns in
Manchester, TN, because it constitutes a hazard to air navigation according to the
Federal Aviation Administration. Stiles did not suitably maintain the tower's
lights and told tne Commission ne would be unable to do so in tne future. The
tower was formerly licensed to WKQD in Tullahoma, which is now WHVK, and has not
been used since April, 1990, when WKQD authorized operation from a different tower
site. Under the Communications Act, in the event a tower ceases to be licensed by
the FCC for the transmission of radio energy, the owner of the tower is required
to maintain the prescribed painting and /or illumination of the tower until it is
dismantled. If there is a possibility that a tower could be hä :ardous to air
navigation, the FCC may require the tower's owner to dismantle and remove the
tower.
The FCC referred to the Managing Director the appeal of HBA Broadcasting, Inc.
seeking reinstatement of its dismissed application for a new station at 107.7 MHz
in Martinez, GA. The application was dismissed because of HBA's failure to timely
tender its hearing fee in the case involving five mutually exclusive applications
for a new station in Martinez.
The NAB has scheduled a Law and Regulation Conference for April 14 -15 as a part of
its NAB '92 convention in Las Vegas. FCC officials, communication lawyers, and
"other legal pros" will discuss such issues as joint sales agreements, time
brokerage, proposed relaxed ownership limits, political broadcast rules,
employment laws, and contests and promotions. In addition, NAB lawyers will be
available at a convention booth called "The Lawyer Is In: The Meter is off," to
provide legal advice, particularly in the area of political broadcasting. For

The Associated Press' Board of Directors approved a 3 percent general assessment increase in the cost of its service, effective January 19, 1992. The increase,
said to be the AP's lowest in four years, will affect all AP subscribers, including over 6,000 radio and television members.
Cox Enterprises in Atlanta is launching a new satellite talk network for Georgia starting in January, according to Inside Radio. The network, which has not yet
been named, will emanate from Cox's WSB(AM) and will air long -form programming featuring veteran talker Ludlow Porch, who leaves WSB for the network's 9 a.m. to
noon slot. The network will also carry sports features, but will not have news
programming. Cox's Bob Neil said there is a great deal of interest in the venture
based on favorable response from several station managers.
Rush Limbauan will be a keynote speaker at a Saturday luncheon during the RAB
Managing Sales Conference, January 30 - February 2 at the Opryland Hotel in
Nashville. The appearance will be Limbaugh's first at a Radio all -sales event,
according to RAB board member Herb McCord. To register for the conference, call

The FCC upheld the Administrative Law Judge's ruling dismissing the application of
Irene Escalante for a new FM station at 95.7 MHz in Orcutt, CA, because Escalante
failed to timely demonstrate that she was financially qualified to construct and
operate the proposed station. Escalante requested that the ALJ to intervene in
the proceeding, and was subsequently denied. The Review Board affirmed both
rulings by the ALJ, and the Commission concurred, noting that Escalante did not
file the required financial documentation with a good cause showing. In addition,
Escalante argued that the dismissal should be reconsidered because she is a
resident of the community to be served by the new station. The Commission found
no merit in Escalante's contention.
The Review Board's decision reinstating the application of Seaside Wireless, Ltd.,
LP, for a new station at 103.9 MHz in Seaside, CA, was upheld by the FCC. The
Administrative Law Judge had dismissed Seaside's application for failing to comply
with his prior order requiring the appearance at a hearing of a former Seaside
principal. The R.':'ew Board disagreed with the ALJ, finding that he dio.n't have
adequate grounds to dismiss, and reinstated Seaside's application. A competing
applicant, H.H. S L. Communications, argued that the ALJ had ample grounds to
dismiss the apploation, and appealed the Board's decision. The Commission
dismissed the avp.i.:.ation for review, finding it procedurally defective.
In other actions, the FCC: upheld the dismissal of the application of N. Walter
Goi.ns for a new FM station at 105.7 MHz in Eden Prairie, MN, which was found to be
financially unqualified by the ALJ, the Review Board, and the Commission; upheld
its grant of the application of Midwest Radio, Inc. for a new FM station at 107.5
MHz in Des Moines, dismissing arguments from competing applicants that the FCC
erred in fully crediting Midwest's integration proposal and that it erred in not
granting integration erhancemen'... credit for the sexual orientation of the
principal of a competing applicant. John Hollar has been named FCC Commissioner Duggan's Legal Advisor for Mass Media
issues. Hollar is a Washington attorney, who formerly worked as a journalist and
a marketing executive at United Press International.
The FCC issued its requirements for applicants for the fee -exempt operator permits
to be used only at noncommercial educational stations. Applicants for the permits
must submit signed certification stating that: "The Restricted Radiotelephone
Operator Permit being applied for will be used only at a noncommercial educational
station," along with a completed FCC Form 753. For more information, call the

NAB '92 will be expanded by one day to include the Broadcast Engineering
Conference and other radio sessions. The new official convention dates are
Sunday, April 12 - Thursday, April 16. The exhibits will run from Monday -

North East Satellite Entertainment (NESE), a new nighttime network arrying a
full -se. vi :e format of music, personalities, news and weather, was last week at 20 _ t_iates in ti.e northeast. The Rochester, NY tAsed network is
targeting a i.) -state area from Maine to Michigan and Delaware. It is fully advertiser supported with no affiliate fees. Among NESE's programs are "Nighttime Live with John Garabo," featuring AC music, news and live interviews, from 6:00 to 10:00 p.m.; "Nunzio in the Night," with an emphasis on comedy in addition to music and news, from 10:00 p.m. to 2:00 a.m.; "In the Heart of the Night," with music and talk, from 2:00 to 5:00 a.m.; and "American Home Magazine," featuring agricultural news along with music and information. The new name for the recently combined Sheridan Broadcasting and National Black Network is American Urban Radio Networks.
UPI has unveiled its facsimile news service "UPI -FaxNEWS" aimed at small market broadcasters. The service will allow subscribers to select specific news and information at a lower cost than at traditional news wire services. UPI's Mike Aulabaugh said the service "is specifically designed to accommodate light news users such as music -intensive FM stations. UPI -FaxNEWS is aimed primarily at the AM and PM drive cycles." The service is available seven days a week and offers national, and international news, sports, weather and business information from 6:00 a.m. to 8:00 p.m., with state news and weather at AM and PM drive times. At
present FaxNEWS is carrying news from eleven states, with more states to be added in early 1992. FaxNEWS is available in ten different packages, including such versions as UPI FaxNEWS AM or PM, AM and PM, All -Day, Weekend, State (also broken down into separate AM and PM versions), Financial, and Weather, with prices beginning at $150 a month. KENO GM Tony Bonnici said, "What we're doing a:?ai.r.st traditional logic. Radio stations just don . advertise with each otneL. . . Just because KEYV listLeners tune inter a football game on KENO doesn't mean they're suddenly going to become a fan of oldies. All we want is for
them to listen to a football game for two hours. When the game's done, they're most likely going to switch back to KEYV."

WASHINGTON THIS WEEK Last week, the FCC issued a proposal under which corrective amendments to defective applications for commercial FM stations would be more readily accepted. The Commission has tentatively decided that the "hard look" processing procedures instituted in 1985 may no longer be necessary. Under the hard look process, defective applications are usually dismissed automatically, with limited opportunity for amendment. The FCC based its proposal on the "improved quality and decreased quantity of commercial FM applications." Such a relaxing of the procedure would apply only to applications received after such rules are adopted. The proposal would not apply to defects resulting from denial of waiver requests. M Street: While relaxing the rules may help the application process, the Commission's contention that FM applications have improved in quality seems to contradict its earlier review of license applications (MSJ 11/4/91) finding that "sixty percent of applications contain discrepancies."
In another proposal, the FCC is seeking comment on whether it should establish cut -off dates which would eliminate conflicts between the filing cf rulemaking petitions and applications for new or modified FM facilities. Under the proposal, the deadline for filing petitions to deny against new or modified facilities would also serve as the cut -off date for rulemaking petitions. Other proposed rule changes include: a cut -off date for minor modification applications 30 days after acceptance of an application or grant, whichever occurs earlier; providing cut -off protection for dismissed applications until the dismissal is no longer subject to FCC review, making any procedural changes effective 30 days after publication in the Federal Register, and applying such changes to any petition for rulemaking filed after that effective date. The Commission is hoping the proposed rule changes will alleviate added expense to applicants and expedite new or improved service to the public.
The FCC dismissed Margaret Pescatello's petition seeking review of the Review Board's order reinstating the competing application of Sound Broadcasting Co. for a new FM station at 98.7 MHz in East Lyme, CT. The Administrative Law Judge dismissed Sound's original application because an exhibit based on an amendment to its application lacked a sponsoring witness, and granted Pescatello's application for the new station. Sound subsequently appealed its dismissal, and sought a "real- party -in- interest" issue against Pescatello, claiming that Pescatello's husband controlled her application. The Review Board reinstated Sound's application, finding that the ALJ's dismissal for failure to a sponsoring witness for a hearing exhibit was unduly harsh. The Board also accepted Sound's amendment, but will consider Sound's financial qualifications and the real- party- in- interest issues raised in Pescatello's application in further hearings.
The FCC reversed a Review Board decision which revoked the licenses of Silver Star Communications- Albany, Inc. for WMJM and WFAV -FM, in Cordele, GA. As a result of the reversal, the FCC reinstated a $20,000 forfeiture against Silver Star. The Cordele stations and two others in Georgia were sold to Silver Star by James and Ronald Rivers, and Sara Howell, pursuant to the FCC's minority distress sale policy. After a later investigation by the Mass Media Bureau, the FCC alleged that Silver Star had abused the distress sale policy when it secretly agreed to resell the stations to the Rivers, and had transferred control to the Rivers family without FCC authorization. The Administrative Law Judge levied the $20,000 forfeiture against Silver Star because of the unauthorized transfer, but dismissed the charges that Silver Star violated the distress sale policy. The Review Board concurred with the ALJ's decision regarding the unauthorized transfer, but ruled that Silver Star's license should be revoked. The Commission upheld the ALJ's original decision, because no misrepresentation was found, and decided that revocation of Silver Star's license would be inappropriate.
In another reversal of a Review Board decision, the FCC granted John Edward Ostlund's application for a new FM station at 99.3 MHz in Fresno, CA, and denied the competing applications of Fresno FM, LP, Valley Radio, Ltd., and Laura R.
Norman. The Review Board had granted the application of Norman, giving it 100 percent full -time integration credit and deeming it qualitatively superior to the competing applicants. The Board held that Norman's qualifications would be superior to Ostlund's, even if Ostlund were given 100 percent integration credit. The Commission disagreed with the Board and added that Ostlund was entitled to a
preference over Norman because of a longer local residency and broadcast experience. Norman's female preference credit was considered insufficient in comparison to Ostlund's local residency. Therefore, the Commission ruled that Ostlund's integration proposal was qualitatively superior to that of Norman, and gave Ostlund 100 percent full -time integration credit.

A Hearing Designation Order raised questions about whether Lawson had an undisclosed party to its application; whether Lawson's organizational structure was a sham; and whether Lawson was qua " ',.d _.. be a licensee. Lawscr. alleged that competing applicants had abused the discovery process by raising such questions. The AL,;
dismissed Lawson for failure to prosecute, because Lawson failed to reasonably participate in preheariag discovery. The Review Board agreed with the ALJ's decision, and said that the competing applicants were entitled to examine Lawson's corporate documents and its non- voting shareholders. Further, the Board held that Lawson's pretrial defaults were egregious, prejudicial to its competitors, wholly unjustified, and caused delays in the FCC's processes.
WBBY -FM in Westerville, OH, has been ordered by the FCC to surrender its license because the station lied about its management in order to receive integration credit. According to Radio Business Report, the FCC found that the alleged manager of the station was actually managing a Marietta, OH, car dealership. The FCC made its decision after a comparative renewal hearing, in which the applicant challenging WBBY's license was also found to be unqualified. As a result, the channel, 103.9 MHz will be returned to the table of allocations.
According to two surveys nor ducted this yea: by the FCC, radio tower painting anj lighting requirements have reached compliance levels of 93% and 97 %, which is an increase from a previous compliance rate of around 70 %. The Commission attributes the improvement to its aggressive education and enforcement program, instituted two years ago. ELSEWHERE WRKK and WWPA Williamsport, PA have announced a LMA with WHUM, Avis, PA. WRKK and WWPA will take care of the programming and sales for WHUM. No changes in programming have been announced.
The Radio Creative Fund, an industry partnership comprising RAB members, the Radio Network Association, Interep, and radio group owners, has established the "Mercury Awards," to "recognize and promote creative excellence in radio advertising." Among the awards is a $100,000 first prize given to the team that produces the best radio advertising of the year. Entries can be submitted beginning December 1, with a deadline of January 27. The awards will be presented May 11, 1992 in

The Katz Radio Group has announced the layoff of 23 employees in its New York and regional offices. Of the 23, ten are from Katz's sales staff. Katz said reasons for the layoff were the achievement of revenue goals and "technological advances enabling services to be .delivered with fewer personnel."
The RAB's 1992 Managing Sales Conference in Nashville will feature Dr. Gene Stanaland, "the Will Rogers of economics" as a keynote speaker, February 1.
Stanaland, president of the management consulting firm, GSE, Inc., will address the question on everybody's mind, "The Economy . . . How did we get here ?" with humor interspersed.
Another feature of the MSC will be the administration of the Certified Radio Marketing Consultant exam on Thursday, January 30, from 1:30 - 4:30 pm at the Opryland Hotel. The ABC Radio Networks will air a call -in program, "World War Two: Who Ultimately Won ?" with host Sam Donaldson, on Monday, December 2, from 2:05 to 3:00 p.m. (ET)
as part of its American Agenda Radio series. The program will be broadcast five days from the 50th anniversary of Pearl Harbor Day, and will address not only the years since the war but "what course it put America and the world on for the decades still to come," according to ABC News VP Bob Benson.
