Property NewsCanary IslandContract Awarded For New Harbour And Marina In Corralejo

The contract for the extention and improvement to Corralejo harbour has been awarded and is expected to take two years to complete. The project will improve and extend the ferry piers, increase the number of moorings for pleasure craft and provide better boat yard facilities.

As well as the existing marina berths the new marina will provide 650 berths for yachts which will be sheltered behind a huge curved breakwa-ter.

Fuerteventura is one of the busiest in the Canaries

with close to a million passengers a year using

the short ferry link to Lanzarote and the project

will ensure that increasing passenger demand

can be met. The harbour Playa Blanca in Lanzarote

will also be extended and improved to allow

easier access for the ferries whose entrance at the

moment can only be described as tight.

A recent survey has revealed some good news

for the canary islands. The Canary Islands is the

most popular tourist destination in Spain. The

Canarian year round climate cannot be beaten

and for guaranteed weather this is the place to

come. Another interesting fact is that visitors are

also spending more money when holidaying in the

Canary Islands.

The Canarian vice president Jose Manuel Soria said

that the islands are on the ‘right track’ on the road

to financial recover. His statement was based on

two factors, new cars and overnight tourist stay

duration. New vehicles coming on to the road rose

by 11% in the first month of 2010, this compares

very well to the fall of 31% for the same month a

year ago. The figures for overnight stay duration

are also looking good this year compared to last.

Last year they dropped by 8.2% compared to a rise

early in this year of 3.7%.

Visitors on the up

The amount of tourists staying in hotels in

Lanzarote was up by 4% in February of this year.

These figures were released by ASOLAN, the asso-

ciation for Lanzarote hoteliers.

The areas of Lanzarote that performed particu-

larly well are Costa Teguise and Playa Blanca.

Costa Teguise saw occupancy levels rise to 73%,

this figure was higher than any other Canary

Island hotel. Only a fraction behind was Playa

Blanca. Puerto del Carmen also did well with an

occupancy level of 68%.

These levels are becoming close to pre-crisis levels

which peaked at 77% occupancy.

Lanzarote visitors from the East Midlands area

will be happy about new routes planned to start

on May 19th. Jet2.com will be adding thess new

flights from their new base at the East Midlands

airport. The airport will bring easily accessible

flights to the areas of Nottingham, Derbyshire

and Leicestershire. The east of access that the

airport has to offer will also draw custom from

future afield. Jet2’s company slogan is ‘friendly

low fares’ and they hope to offer new flyers a new

kind of experience. Baggage allowance is 22kg,

seats are not too cramped and are allocated and

flight crews are trained to a high level.

The new slogan for Spanish tourism is… wait for

it… ‘I need Spain’. The idea is that this slogan will

help to unify Spain’s position as a leading tourist

destination. Spain wants to become known as a

‘first class’ tourist destination, moving into the

arena of an all year around cultural holiday loca-

tion. The idea and slogan for the new campaign

was uncovered recently by Spanish Secretary of

state for Tourism.

This new image of Spain is intended to be pub-

licized across over 40 countries, the expected

audience is more than 400 million people. Over

the last two years Spain has increased her promo-

tional budget by 20 per cent.

The previous campaign had a slogan of ‘Smile

you’re in Spain’ and was targeted to an audience

of only 100 million. The new campaign is selling

Spain as a lifestyle destination. Spain currently

receives over 50 million tourists per year.

New route from East Midlands to Lanzarote

Iberia recently announced an introduction of an

extra 60 euro charge for each extra item of bag-

gage from flights between the Canary Islands and

mainland Spain. The Canarian government were

up in arms over this and put this point of view to

Iberian bosses. Finally Iberian Airlines responded

by allowing up to a 23 kilo limit the first piece

of baggage and a 10 kilo limit on hand luggage.

Additional pieces of baggage, up to the 32 kilo

limit, will cost 15 euros for residents and 60 euros

for non residents.

The Easter holidays saw and great influx of cruise

ships visiting the Canaries. Local businesses wel-

come this as the ships dock at each island allow-

ing visitors time to explore and grab some local

bargains.

The easter period saw over 10 cruise liners docking

letting off a total of almost 50,000 visitors. The

majority of these visitors we arriving in the ports

of Las Palmas in Gran Canaria and Santa Cruz de

Tenerife. Tenerife proving to be the most popular

destination hosting over 27,000 visitors.

Flights to and from the Canary Islands are set to

increase this summer. A recent report published

that and overall increase of 17% is to be expected

for the summer of 2010. Already tour operators

have made reservations in access of 17 million

seats. In Tenerife an overall increase of 11% has

been recorded across its two airports, almost

seven million seats. Representing a rise of 10%

against the airplane seats of 2009.

The largest rise is in Fuerteventura. A rise of an

amazing 30% from 2009’s figures. Also ahead of

Tenerife’s increase is Lanzarote who saw are rise

on their 2009 figures of 21%. The representing

almost 3.25 million tourists flying into Lanzarote.

15% of these increases will becoming from UK

tourists. The Airlines bringing in the extra tourists

are Ryanair flying from the UK and Air Berlin from

Germany and Austria.

New survey reveals that smokers cost more than

they pay back. Smoking cost the health services in

Spain more than 5.5 billion euros per annum. Plus

there is an estimated cost to businesses of another

7.8 billion euros. Totalling a staggering 13.3 billion

euros a year.

In the business sector of the costs 75% comes from

lack of productivity and 20% from cleaning costs

and days off. The Spanish government is also say-

ing the smoking bans in public places is having no

slowing down effect on the income of bars and

restaurants.

One of the internets largest online flight booking

web sites has just released figures of its latest

survey, and it looks like good news. Skyscanners

cover almost any destination in the world. Spanish

destinations take up the top three most clicked

on places. Malaga is in position one, Alicante in

two and Tenerife in third place. This is great news

for Spanish tourism. Fears that the recession will

severely cut down UK overseas tourism have now

been put to rest. Only 6% of customers polled said

they would not be taking any holidays in 2010.

13% said one trip and a massive 16% said they

would be taking four or five overseas trips in 2010.

The Skyscanner development director, Barry Smith

said that ‘2009 was a testing year for travel; many

operators and some airlines went out of business.

However, the fact that 49% of people in our poll

plan on taking two or three trips aboard this year

is great news for the travel industry. And despite

fears that Spain might drop in popularity, our data

shows that it’s still by far the most popular coun-

try for British holidaymakers.’

Why speak with a Currency Specialist?Over the past 10 years the growth in companies offering a foreign exchange service has been considerable. From a consumer point of view this has provided competition with service and price prov-ing the major influences in a client choos-ing their means of transfer. The ques-tion’s that face prospective clients are:

Why should I use them?

Who should I use?

What benefits will they provide?

Invariably this question is based around a decision on whether to use a bank, or a cur-rency broker. Banks offer traditional service levels, a reactive approach, and costs that are not necessarily apparent. Due to a currency brokers sole focus on foreign exchange, and significantly reduced overheads, the ability to offer dedicated personnel and commercial rates of exchange clearly put a client in a bet-ter position.

Who should I use?

Choosing a currency broker should start with the recently introduced Payment Services Directive, the ‘PSD’. This is pan-European legislation and in the UK it falls under the FSA from a regulatory perspective. Whilst accept-ing that 2011 is the deadline for applications, any currency broker that has already been granted the relevant authorities by the FSA has shown professional intent, has met the stringent requirements, and is investing for the future. It is also worth looking at the visibility and accessibility of the senior manager/man-agers as active participation in the business is important. Looking for a company whose focus remains firmly on client service as opposed to purely price is prudent when transferring funds.

What benefits will they provide?

The most significant benefits are service, cost saving and rates of exchange. Service, what is this? The whole point of having a dedicated contact is that during the time between first contact through to the transfer deadline, this person will maintain contact with a client,

provide market updates, alert a client of posi-tive or negative movements, provide different solutions for buying/selling, and be a clients eye’s and ear’s when the markets are volatile.

How safe/secure are they?

FSA regulation and authorisation is a badge of quality. Obtaining this authorisation is a clear indication that a company operates to the high-est levels of ethics and transparency. In addi-tion to this using segregated client accounts, having a skilled and experienced team with solid credentials offer further assurances of companies probity.

The fi nal reward of all your marketing efforts to get your house sold will be a viewing. This tends to be a defi ning moment and one that brings a lot of us some due tension. That said, an appointment to view your property is often looked at very differently by potential buyers.

Unfortunately you are going to come up against mixed messages. Some will treat your eagerly awaited viewing as one among maybe 8 to 10 that day & merely traipse through your home looking uninterested & leave after 5 minutes. Whilst another potential buyer may stay for hours and talk over your house in great detail and may even talk instantly to you about pric-ing and how quickly you can move out. In a few days this may have come to nothing other than giving you a false sense of security

So, is there anything you can do when you have a viewing – apart from having your property looking its very best? In fact, there is:

Be relaxed and confi dent : Never appear desper-ate to sell and if one of you is naturally nervous then make sure that your partner or even a friend shows your property – if your potential

buyer is viewing without an agent.

Orientate fi rst : If you are showing a viewer around your home for the fi rst time then orien-tate him around your property at his own pace. Normally, this will be quite quick and it is not unusual to show an average sized villa within 15 minutes – particularly if the potential buyer is showing no particular interest. Certainly, do not go into comprehensive detail about specifi c areas (unless you are asked direct questions) and avoid long winded narratives and inconse-quential stories.

Allow your viewer time alone : Having shown your property, see if your viewer wants to look over your property again on his own (having made sure your valuables are safe!). Most buyers prefer, once they have experienced an overview, to be alone or with their partner to discuss together what they have seen and then double-check it. If your viewer wants this – then remain discreetly in the background but close enough to be able to respond to any queries.

Create a sense of obligation : Offer your viewer a drink and, if he accepts, make sure that he

takes it sitting at the best part of your property (for example, the terrace overlooking your pool or on your balcony where there are lovely views of your local golf course etc.)

Never over-sell : Trying to batter a buyer into purchasing never works and can be extremely counter-productive in making a potential buyer reluctant to return for a second viewing – and another tirade of your oppressive and unwel-come pressure.

Have a credible reason for selling : One that does not raise any doubts in a buyer’s mind (I ‘don’t get much use out of the pool’, ‘would like an en-suite’, ‘need a bigger garage’, ‘want more room for guests’, ’steps are getting too much now’ etc. Avoid negativity but equally do not ’spin’ too much. Nowhere is perfect and no buyer expects it to be.

Never delay a buyer : If your buyer wants to leave then land in no way obstruct him. However, try to lead him gracefully out a differ-ent way than he came in – if it will show off an unseen and benefi cial part of the property.

to other readers that may be on the point of doing

the same

How long have you been visiting the Canary Islands, which island?

We are not visiting we are residents & live in

Lanzarote. So far, we have been to Fuerteventura ,

Tenerife & La Palma

Which area is your favourite and why ?

Lanzarote is our favourite Island as we just fell

in love with it on our fi rst visit back in 1990. Our

favorite area would now be Playa Blanca because of

the amenities that are all at hand. You do not have

to live on top of the centre yet it is always just fi ve

minutes away.

How long have you been thinking about buying ?

We have been thinking of buying for several years.

What fi nally made you buy ?

The recession was the main factor as the interest on

our savings dropped dramatically so we needed an

investment property.

How did you afford the purchase, did you need a mortgage? If so how did all of this work and come about ?

We had savings to cover the purchase, so we did not

need a mortgage

Why did you choose Sonia Vargas at Optima Estate as your preferred agent & how did they assist you through the procedure ?

We met Sonia many years ago and we then, (luck-

ily as it turns out) had a reason to contact her on a

business matter. We have found Sonia to be one of

the most honest and most helpful people that we

have ever met. She just cannot do enough for you,

and besides the purchasing side of things she will

help you with other matters and we have learnt that

Sonia is not just here to earn out of the community

but she also puts back by way of this help. How did

they assist us through the procedure? well, it would

be far easier to say that there would have been no

procedure without Sonia? She was not only there

from start to fi nish of the purchase, she is there

for you afterwards as well. Although you may have

completed your sale and that is the case closed as

far as agents go but, Sonia is always just a phone call

away and ready to help you out with any problems

which you may need help with. (she will hate me

for this).

How long were you looking for the right property ?

We had been looking for about six years.

How did you know the one you chose was the one for you ?

We had done extensive research on the internet

about the area and what it had to offer. We decided

on the location and then got in touch with Sonia.

Sonia or one of her teem showed us properties

within our budget and what met our criteria. I must

admit that we looked at quite a lot of properties and

then we decided that we would give the properties a

point system so that we could whittle the list down

and then, with the help of Sonia & staff we had

whittled the list down to a fi nal four properties. We

looked at these over and over until we got our list

down to two. The decision actually became quite

easy after that as, although there are always plusses

and minuses we got this (this is the one) feeling

when we walked into this particular property, all

the confusion had gone and I put it down to the help

and advice we received from Sonia and her staff and

I feel that our whittle down system had helped us so

much and it paid off in the long term.

Where you worried about buying over-seas and how did you overcome the hur-dles of buying within a different system ?

There are many hurdles and it is worrying buying overseas as there are far too many people out there laying in wait to sell you anything. The frightening stories travel far and wide. The media often prints dramatic stories but these are a minority and you do not always get to hear about the success stories. You can overcome all of the worry and the fears by asking the people who have been through it suc-cessfully and who assisted them. You cannot use the pin in the telephone book system to find an agent, you cannot use the one who puts in the biggest advert in the paper, you must use the agent who has a good reputation and a good success list. Most agents have people who are prepared to not only recommend, but more than often chat with you if need be. That’s how we did it and how we were reassured that it does not have to be a mine field if you are using the right people.

How did you cope with the different lan-guage ?

The language barrier is a major problem but, once again, when using the right people who’s staff are multilingual the problem disappears.

How did you manage to get all the paper work and finances in order ?

Once agin, We were so lucky that we had the guid-ance of Optima and Sonia who between them arranged virtually everything for us.

How long did it take from first seeing the property you wanted to completing the purchase ?

After deciding on which property we were having it was swift, just a matter of weeks to complete.

How much did the extra costs like taxes, notary and solicitors fees come to ?

This is based on property purchase price of about

200,000 euros so the extras as fore mentioned came

to 14,000 euros.

How do you plan to use the property, as holiday home, residence, investment etc?

We plan to use the property as a Holiday home /

investment.

How did you manage to get amenities connected, was it difficult ?

Sonia and the solicitor arranged everything for us.

Have you spent much time in the property yet? If yes then how was it ?

Yes, we have and we love it to pieces!!!!

Now that you own a property in the Canaries what does it feel like ?

It feels like we are now part of the community and

it feels like home.

Was the experience of buying a prop-erty more difficult than what you thought beforehand ?

Not at all, all of the scary thoughts turned out to be

well and truly unfounded.

Now you have a property what are you plans for the future? how often do you

plan to use it? will others use it ?

The family will use it as often as they can and we will most certainly be using it ourselves frequently.

What advice would you give to anyone else thinking about buying a property overseas ?

Forget your fears and follow our advice, You will no doubt come to the conclusion that we are Pro Optima but, we are not saying go to Optima because we did, we are saying that you need and agent like Optima who is not just there to sell to get commis-sion. We know it is there business to do this, but it is the beginning and the during and the after sales service which is the most important factor other-wise, you are like a lost sheep in the middle of a forest not knowing which way to turn.

This is what I would like to say to all of those would be buyers whom are afraid to take the first step, fol-low our advice. Everything went well for us but, this was not luck, this was careful planning and doing our homework and, of course, being lucky enough to have the right agent behind us all of the way.

Before signing anything there are some important pieces of paper you and your lawyer should have a look at ..

The Escritura Publica and Nota Simple

The Escritura Publica is the registered title deed of the property. It is entered in the ‘Registro de la Propiedad’, the Property Registry, and is the only guarantee of title in Spain. It contains a description of the property, the details of the owner and any mortgages or legal claims that exist against the property. This document is important because it tells you if the seller is the owner of the property being sold. A nota simple contains further details of any mortgages or charges against the property and is also avail-able from the Registry.

The IBI receipt

Before purchasing a resale (not new) Spanish property check out the ‘lmpuesto sobre Bienes lnmuebles’, or lBI, which is the municipal prop-erty tax. Ideally, you’ll be able to see the IBI receipts for the last five years because that is the limit of liablity for unpaid back taxes and is attached to the property, not the owner. A new property bought from a developer will not have an IBI receipt (because it has never been ‘owned’) so it will be your responsibility to reg-ister the property for this tax.

The Referencia Catastral

Every property sale must quote the ‘Referencia Catastral’ of the property in question. The Catastro is another system of property registra-tion in Spain, concentrating on the location, physical description and boundaries of the property. While the Property Registry focuses almost exclusively on ownership and title, the Catastro is concerned with property valuation.

These two systems do not communicate with each other, and it is common to find that the catastral description of a property differs greatly from the one in the Property Registry. It is a good idea to request the actual certificate from the Catastro with a full description of the prop-erty. The certificate is in two parts, one being a description of the property and the other being either a plan or an aerial photograph.

Community fees, statutes and minutes of the AGM

This only applies if you are buying a property in an urbanisation or where there are some ‘com-munal’ resources, shared amongst a number of properties. These are the fees charged by the ‘Comunidad de Propietarios’, the Community of Property Owners, a legal body that controls all the elements held in common; the lift, gardens and pool for example. Each owner is assigned a quota, or percentage of the expenses which, by law, must be paid.

Utility bills

These assure you that the bills are paid and also provide an idea of what the running costs of the property will be.

NIE number

The NIE is the Numero de Identification de Extranjeros ie Foreigners Identification Number which is the equivalent of the DNI ( Documento nacional de Identidad) for the Spanish nation-als. This is an absolute necessity when buying a property in Spain. Your lawyer or accountant can get this for you

Misc

If you are buying a property in an urbanisa-tion, make sure that it is legal and registered by asking to see the approved ‘plan parcial’ at the town hall. If the property is on the beach, make sure the development is also approved by the Jefatura de Costas. For a new property, make sure that it has been declared for IBI and that the developer has made the ‘declaracion de obra nueva’. Also ensure that the escritura men-tions the house you are purchasing as well as the plot of land on which it stands. As an addi-tional safeguard, it is wise to examine the town planning maps for the area around the property, called the Plan General de Ordenacion Urbana

Spanish tax reclaim in a nutshell

From 1997 until the end of 2006, the Spanish Tax Office charged non-residents of Spain a higher rate of capital gains tax when they sold their properties than local residents had to pay. Foreign non-residents were charged 35% Capital Gains Tax, compared to just 15% paid by resi-dents of Spain.

This was clearly a case of discrimination, so the Spanish Government was taken to the European Court. And they lost.

That means that every foreign non-resident taxed on the sale of their property from 1997 to the end of 2006 qualifies for a tax rebate. An estimated 90,000 foreigners from other European countries qualify to reclaim their overcharged tax from the Spanish authorities, plus interest. Some e944 million waits to be claimed.

It is estimated that the average amount of overpaid capital tax to be reclaimed by Britons is 8,300 Pounds in overpaid capital gains tax. Added to this amount is interest of around 6 percent from when the tax was paid, which means that the average total reclaim almost 11,000 Pounds.

Although the European Court ruled that all these people qualify to reclaim their Spanish tax, it left the mechanism of reclaiming to the Spanish system. With almost a billion Euros waiting to be claimed, the Spanish taxman was not going to make it that easy for foreigners to reclaim this huge amount.

The Spanish system means that each and every case needs to be taken to court individually: it’s not just a case of filling in a few forms at the local tax office. By enforcing a judicial route to reclaim the tax, the Spanish government knew that this would prevent most people from suc-cessfully getting their money back.

Many people would be put off by having to take the Spanish tax man to court and would not even try. In addition, the Spanish authorities knew that having to go to court means having to hire a lawyer, and most people would not be prepared to risk their money on lawyers’ fees. The area of law involved is highly specialist. There are very few tax lawyers with sufficient knowledge of European and Spanish tax legis-lation who would even be able to take on such a case. With these tactics the Spanish taxman planned natural obstructions to put people off claiming.

And it worked. Many claims were denied due to following an incorrect legal procedure. Many more did not even try.

It was from this injustice that Spanish Tax reclaim was born. Leading the legal team is Alfonso Padilla Peña, who held one of the most senior positions in the Spanish Tax office until he went into private practice, becoming one of the foremost specialist Tax lawyers in Spain. The firm work on a no win, no fee basis, which means that claimants need pay nothing up front and their fee is deducted from their eventual settlement. There is no risk involved.

How much can I reclaim?

The amount you can reclaim firstly depends on the difference between the price you purchased your property for and the price you sold it for.

There are two distinct types of claims:

• Those who paid the full 35% Capital Gains Tax or 5% retention and are making their claim within four years of selling their property. In effect this means only those who sold their property in 2006 and paid Capital Gains Tax. If you fall into this group then you should make your claim as soon as possible. If you delay, then this will increase the time taken to pursue your reclaim.

• Those who paid the full 35% Capital Gains Tax or 5% retention and sold their property between January 1997 and 2006. This is a longer legal procedure because it falls outside of the four year window set by the Spanish Taxman for the backdating of tax reclaims.

Most typically, those who went on to buy another property will have paid the full capital gains tax for non-residents which was 35% of the price difference between purchase and sale.

The European Court has ruled that foreign-ers should only have been liable for the same Capital Gains Tax rate as Spanish residents. The amount that should have been paid was 15% of the difference between the purchase and sale price.

Example of a Spanish Tax Reclaim Calculation

If you purchased your property for e200,000 and sold it for e250,000, the difference between purchase and sale price would be e50,000. The amount you should have paid, according to European law is e7,500. If you just paid the 5% retention of the sale price, then you will have paid e12,500 and you can reclaim e5,000. If you paid Capital Gains Tax when you sold your Spanish property, you will have paid 35% of e50,000 which is e17,500 and you can reclaim e10,000.

When Cárdenas Real Estate was estab-

lished 30 years ago, its founder Anto-

nio G. de Cárdenas, was a well-known

person in Arguineguín-Mogán. His flaw-

less previous professional career, his

and Rolande’s (his wife and an official

translator) knowledge of foreign lan-

guages - both had lived and worked for

some years abroad - earned him an ex-

cellent reputation especially amongst

the non-resident Real Estate owners in

the southwest of the island. With many

of them, the business relationship even

grew into a friendship. They not only

turned to him to buy and sell proper-

ties, but recommended him as well to

their friends and acquaintances.

Both founders remember how often new cli-

ents reported having been told by a friend:

“if you buy something in Gran Canaria, go

to Cárdenas only, to nobody else”. At a time

when many foreigners, who had bought

their property years ago through different

agents, were still waiting for their inscrip-

tion in the Land Register, the name Cárdenas

meant the guarantee that far from limiting

its task to the mediation between seller and

buyer, it would take care as well of paying

the taxes and of all the paperwork until the

property was registered, and give their cli-

ents a comprehensive after sale service, in-

cluding the annual taxes, assistance with the

drawing of Wills, and legal and tax advice

in inheritance matters, amongst many other

useful services.

Thus Cárdenas started its career hardly

needing any other advertising than the cli-

ents’ word of mouth recommendations.

New methods were introduced when the

founders’ daughter Carolina joined the com-

pany (1996) after completing her European

Business Studies in Germany and Madrid

with a dissertation on the Internet in the Real

Estate sector, at a time when Internet was

hardly known in the Canaries. Cárdenas was

doubtless one of the first Real Estate Agents

with its own website. It was much applaud-

ed from the beginning and greatly improved

when Ramón Sánchez Bruhn joined the

company (2001) as Marketing and IT Direc-

tor. Nowadays the website gets every year

more than 180.000 visitors. Cardenas natu-

rally takes part in the social community on

the Net (Facebook, Twitter, etc.)

In 1997 Cárdenas acquired their superbly

located head office in Arguineguín and its

Mogán and Puerto Rico branches were

opened 2000. The staff was increased up

to the present 14 members of a team that is

second to none as for professionalism, lin-

guistic competency and loyalty.
