The condition of a propertys sidewalk is a major item to consider in the sale of a home. Although an uneven or cracked sidewalk may not have been deal killer over the years, the sidewalk condition may now result in a required and costly repair. City inspectors began inspections of sidewalks early this year, and the City Manager has asked the City Commission to consider an administrative policy that directed city staff to enforce the citys longstanding ordinance. However, commissioners have deferred the request, and will discuss the issue of sidewalk maintenance as part of the citys upcoming budget process. Stay tuned! Although the Citys decision may resulting in a sharing of the costs,it is likely that some costs will be required of the property owner. $IDEWALK REPAIR$

City of Lawrence Manager Tom Markus is pushing to enforce a longstanding sidewalk repair policy, requiring property owners to pay for repairs to sidewalks that border their properties. Listing Visibility Type—For ALL Saved Searches, ensure that the new field called “Listing Visibility Type” has a value of MLS Listings, to see listings that are visible to all MLS users.

Zillow Data Feed — Select Include to send your listing to Zillow:

As a result of Zillow’s announcement to block agents from manually entering a listing after May 1, the LMLS now has a Zillow Data Feed for agents to use to send their listings to Zillow.

Simply, if the listing is to be displayed at Zillow &Trulia, the agent will select “Include” at the time of listing input, or in listing maintenance. Selecting Exclude will prevent the listing from being included in the Zillow Data Feed.

Q. What is the difference between a

Cancelled and a Withdrawn listing?

A. Thanks for asking! There is a REALLY BIG difference!

A Cancelled listing status indicates that the listing agreement between the Seller and the Seller’s Agent has been terminated. This listing is no longer subject to a listing agreement, and agents may choose to market their services to this property owner. A Withdrawn listing status indicates that the listing has been removed from dissem-ination in the MLS system, however, the listing is still subject to a current and valid listing agreement. Agents who choose to market their services to this property owner may be accused of interfering with an existing agency agreement, which is a violation of license law. Days on Market & Days on MLS are suspended while a listing is in a Withdrawn status, and will resume once the status is returned to Active.

Contract – Broker Responsibility for Agent Actions

Question: What is the responsibility of a broker when one of his/her agents has taken money from consumers that was to have been used to pay for repairs on a property? This action has resulted in a lien on the property by the un-paid contractor.

Answer: Although salespersons are viewed as independent contractors, the broker is responsible for supervision and has liability for wrongs done by the salesperson. Firing the agent and reporting this to the Real Estate Commis-sion while standing in and assuming responsibility for the wrongs of the agent is probably the appropriate course of conduct.
