'1. The mandate of the Agency shall be to-(a) co-operative with the Regional Anti-Doping

(RADO), World Anti-Doping Agency (WADA) and anyanti-doping organizations in carrying out anti-doping activin Kenya;

(D) execute the enforcement of the Kenya Anti-Doping RulesRegulations as shall be approved by WADA from time to

(d) oversee the prosecution of anti-doping related offencesthe Sports Tribunal or any other judicial bodyjurisdiction in such matters;

(e) promote values, information and preventive work aimedfighting doping;

(fl contribute to research related to the object of its activities;

(g) contribute in the fight against doping outside organized sport;

(ft) liaise with other govemmental agencies in eradicating theand abuse of performance enhancing substancessports persons; and

() promote the integrity of a drug-free sport.

In exercising this mandate the agency shall-(a) form such committees as shall be necessary for the e

The County Public Service Board under sections 59(1) (d), 59(l)(f), 59(3) and 59(5) of the County Govemment Act, 2012 is required toannually prcpare and issue reports to the County Assembly on theextent to which values and principles referred to in articles l0 and 232

arc complied with in the County Public Service and on execution ofthe mandate of the Board. The requirement is in line with the newconstitutional dispensation that emphasizes devolution and, the need toinstitutionalize an accountability framework in the discharge of theBoards' mandate. This report is the second of its kind since the CountyPublic Service Board of Turkana was established in August 2014. ltcovers the period from 2d January to 3l"t Dec 2014. The reportoutlines details of recruitrnents and appoinfinents done; steps taken,recommendations and decisions made by the Board; decisions takenon particular persons and/or public bodies that have violated the valuesand principles and the actions taken thereof and; programrne that theBoard has undertaken in the mediurn term towards the promotion ofvalues and principles. During the year under review the Board faced a number of hamperingchallenges in the discharge of its constitutional mandate. Thechallenges included-

Preamble

This report is prepared in accordance with the Constitution andsection 59 (l) (d) and (fl and subsection (5) of section 59 of CountyGovernment Act (No. 17 of 2012) which states that the County PublicService Board shall:

59 (l) (d) prepare regular reports for submission to the countyassembly on the execution of the functions of the Board.

59 (l) (, evaluate and report to the County Assembly on the extentto which the values and principles referred to in Articles lO and 232are complied with in the county public service.

It is a requirement under section 59 (5) (a) of the CountyGovernments Act (2012) that each County Public Service Board mustdeliver a report to the respective County Assembly in the month ofDecember each year. The scope of the report which is itemized in thesection 59 (5) (b-fl (Annex I) is primarily on the extent to which thecounty is implementing the promotion and protection of the principlesand values elicited in Articles l0

report meets all the requirements in section 59 sub section (5) of thecounty Government Act.

Preface

This report covers the period between July and December, 2013, a

time of transition in the history of the County and the Nation ingeneral. lndeed, the promulgation of the new constitution ushered in anew era in the governance of the Republic of Kenya. One key changeinroduced by this dawn was devolution. Following the passage of theconstitution, several [,aws have been passed by the national assembly,as envisaged by the same constitution, to actualize and implement itincluding rolling out devolution. Some of the Laws operationalizingdevolution include the County Government Act 2012, the Transition toCoun! Govemment Act and the Transition Act.

On the 4ttr of March 2013, devolution became a reality to Kenyawhen Kenyans, through the ballot, voted for their first leaders underthe devolved system of govemment. Since then, the Countygovernments were established and flrst Govemors sworn in.Subsequently, other organs and institutions that will deliver functionsto this govemment were then swom in. One such institution is theCounry Public Service Board. Elgeyo Marakwet County PublicService Board came into existence on 25th June 2013, when itsmembers were swom in. This report covers the period from then to3 I st December 20 I 3.

As one of the organs responsible for the fansition into a newgovenrment, the EMC-CPSB has taken this role with speed anddiligence. As detailed in this report, the board has been instrumental inselection of chief-offrcers, filling positions in the County organizationstructure, delivering an HR planning strategy to the county, developinga board charter, establishing and adopting terms of reference for digitalsystem for recruitrnent, selection and performance management. Theboard has also established structures and frameworks that will enablethe county have an efficient and vibrant public service that is capableof service to its citizens.

As we embarked on establishing our county structures, it has notbeen without challenges. As at the close of 2013, the EMC CPSB didnot have a budget, offices nor a secretariat.

The County Public Service Board has worked with the CountyExecutive and the County Assembly through the CASB on severalfrontiers. We report thar the task has been both challenging andexciting. We have shepherded and lived up to the values as enriched inthe constitution, and we are continuously committed to ensuring thatwe have put in place structures to safeguard the constitution and allother Laws of the land.

Elgeyo Marakwet County Public Service Board was establishedunder Chapter 13 Article 235 of the Constitution of Kenya 2010 andsection 57 of the County Government Act of 2012. It consists of thechairman, Vice-chairman and four oher memben appointed by tlreGovernor with the appmval of the County Assembly. The Board isrequired under Article 59 (l) (d) to prcparc rcgular reports forSubmission to the County Assembly on the execution of the functionsof the Board. This inroduces ar accountability framework on thedischarge of the Boad's mandate.

Upon its inauguration, the Board started discharging its mandate.Since then, the bulk of the Board's activities have entailed setting upmodalities to enable it discharge its mandate. To this end, the Boardformulated its Charter, came up with its Vision, Mission, slogan andCore Values, and designed the Structur€ of the Secretariat which isexpectod to bc filled i1 tlrc goming year. To build the caprcity ofBoard members, to establish srategic partnership and to cultivate anenvironment of mutual cooperation, the Board affended variousinduction trainings and ma& visis. Noable among this being the visitmade to PSC headquarters Nairobi, and the visit reccived .fiom theSRC Chairman and Commissionen.

Dwing the period, some of the Board's key achievements include:advisorics to the executivc on IIR planning, fraurcwort on jobevaluation, CIDP, and performance matragerrEnt; recruitnent of keypositions and ECD rcachers; staffheadcount, amongst others.

In the discharge of its mandate lhe Board frced a number ofchallenges which included lack of office space; lack of a secretariat;and managing expcctations of all stakeholders. The Board is aware ofthe high expectations on service delivery and prudcnt management ofcounty public service.

I take this o,pportunity to tha* all the stakeholders for having fullysupportcd the boad to deliver its mandate. We look forward to greaterpartnenhips in the coming year.
