There is no need of furnishing EMD separatelyfor each individual item. The earnest money in the case of unsuccessfultenderer shall be released after finalization of tender, whereas in the caseof successful tenderers it will be adjusted towards the security money(required to be deposited) on application, for due performance of the agreedcontract/ performance during the warranty (period No interest shall bepayable by purchaser on the EMD deposited by the tenderer). EMD in respect of local Registered SSI units shall be applicable in letterand spirit. The local SSI units are required to pay the EMD prescribed asper J&K Govt. rules which at present is 5% of the value of contract (oritems against which tender is quoted) or Rs 5000/- whichever is less. Forthe purpose, SSI units shall have to furnish Registration Certificate andFunctional Certificate of SSI Unit, issued by the competent authority withtheir tender offer failing which the benefits of SSI units will not be allowed.The Government/Semi-Govt. or similar other concerns, claiming exemptionfrom the payment of EMD shall have to append duly authenticated orders,certificate etc. from competent authority supporting their claims.

7. Security Deposit.––The approved tenderers will have to supplythe equipment at the approved rate and as per approved sample (if any)and specification till the date of validity of the approved list. They will haveto furnish security deposit @ 5% of the total value of the items contractedfor, in the shape of CDR/FOR from a Nationalized Bank/schedule at thetime of signing of Deed of Agreement to ensure satisfactory performanceof the equipment supplied, for warranty period from the date of acceptanceof product. This security deposit will be released in due course after theexpiry of specified warranty period/agreed contract. The charges on stampsetc. (cost of documents in totality) shall be borne by the supplier whileexecuting the agreement (No interest shall be paid by the purchaser on thesecurity deposit). J&K Govt. Rules for EMD in respect of local SSI Unitsshall be applicable.

8. Despatch Instructions.––Stores are required to be delivered atConsignee’s location (Srinagar/Jammu), at freight, risk and cost of thesupplier.

9. Store required at.––Free delivery at Consignee location.

10. Delivery required.––Within one month from the date ofconfirmed order or as mentioned in the supply order.

If during the aforesaid period, the said stores be discoverednot conforming to the description and quality or not giving satisfactoryperformance or have deteriorated, the decision of the purchaser in thatbehalf shall be final and binding on the contractor and purchaser shall beentitled to call upon the contractor to rectify the goods or such portionthereof as is found to be defective by the purchaser within a reasonableperiod or such specified period as may be allowed by the purchaser in hisdiscretion on/an application made thereof by the contractor and in such anevent, the above mentioned warranty period shall apply to the goods rectifiedfrom the date of rectification thereof. In case of failure of the contractor torectify or replace the goods etc. within specified time, the purchaser shallbe entitled to recover the cost with all expenses from the contractor forsuch defective stores.

13. Two Bid System.––All bidders are required to submit their offersin two covers as under :––

(A) First Cover.––(Technical Bid) is to be uploaded online as scancopies in PDF format should contain the following.––

i. Tender documents duly completed and signed but withoutindicating the rates quoted ;

ii. Scan copy of earnest money ;

iii. Scan copy of the tender fee ;

iv. Technical specifications of the item quoted along withoriginal catalogues (Make and Model) ;

(A) Second Cover.––(Commercial/Price Bid) should contain thefollowing :––

i. Rate quoted by the firm which should be on firm pricebasis as per Bill of Quantities (BoQs) of the e-Tender tobe downloaded from the website and rates should becarefully quoted. For their own convenience, the tenderersmay fillin the details initially offline and then upload thesame so as to ensure accuracy. The rates quoted shallinclude the cost of all the components mentioned inthis SBD ;

The Zero basic cost quoted for any item in BoQ willbe treated as Nil quoted :

* J&K State Entry Tax rate currently is13.5% extra. State Entry Tax shall bereimbursable on production of originaldocuments by the successful bidder.

* The rates of AMC inclusive of service tax(applicable after completion of warrantyperiod) shall also be quoted separately.

ii. Rates quoted shall be final till the validity of contract witha provision of further extension if finally approved byState Level Purchase Committee for J&K PoliceDepartment ;

iii. Firms shall clearly indicate different taxes, duties, chargeswhich they propose to charge as per the format of Bill ofQuantity (BoQ) available with the e-Tender. However,online generation of financial comparative (BOQ Chart)is of indicative nature only and not conclusive. The detailedfinancial comparative figures (BoQ Chart) shall beworked out by the purchasing department and will beuploaded on the website for general information of all thetenderers. Mere online generated information either bydesign or default shall not confer any right of any naturewhatsoever, on any tenderer unless confirmed byCompetent Authority of the Deptt.

14. On due date of opening of tenders i. e. 20-07-2015 at 1100 hours,only technical bids shall be opened and the technical evaluation process will

be carried out by the authorised committee. The technically qualified bidderswill be informed online together with the date of opening of financial bids.

15. The shortlisted tenderers will have to arrange for the technicalor field/practical demonstration of the equipments, if any, required, at theirown cost at the place and date to be fixed by the authority which will beintimated to them online. The bids of such shortlisted bidders who do notarrange/participate in the demonstration as above will be treated as rejected.

16. The approved supplier shall be deemed to have fully understoodthe conditions, specifications, size, patterns, make etc. of the articles etc. tobe supplied and in case of any doubt may seek clarification.

17. The supplies delivered by the successful tenderers shall besurveyed and verified at our Stores i. e. Police Central Stores, Jammu/Srinagar by the Survey Committee constituted for the purpose.

18. The successful tenderer shall have to enter into an Agreement/Deed on prescribed proforma (immediately after the issue of supply order)with the department for due performance of the contract which shall beinvariably furnished before the supply is made.

19. Delivery/Liquidated Damages.––The successful tenderersshall arrange supplies within one month from the date of Purchase Orderor else as mentioned in the supply order. Failure to supply the goods by duedelivery date shall entail charging liquidated damages to be specified in thesupply order.

20. The successful tenderers shall have to ensure that he has notsupplied the same product at the rates lower than offered to J&K Police.In case found so, the same rates will apply to J&K Police and the excessamount, if any, paid to the firm shall be recovered from it in any manner tobe decided by APHQ, J&K.

21. The approved supplier will be required to furnish an authenticatedcopy of latest Sales Tax/VAT/clearance certificates and PAN and VAT

registration certificate. The PHQ shall be at liberty to put to scrutiny,verification etc. the sales tax clearance so furnished by the successfultenderer.

22. Payment shall be released by the department against eachconsignment delivered in entirety, inspected, accepted and properly broughton stock in the concerned stock registers of the department. In case theequipment is subject to installation by the firm, then the payment shall followafter complete installation.

23. Remittance charges (Bank Commission) on payment made tothe firms will be borne by the suppliers. The charges of stamp etc. shall bepaid by the supplier while executing the agreement.

24. As soon as the acceptance of the tender is communicated to thesuccessful tenderers, the contract shall be binding on him. EMD of thetenderer who backs out or withdraws his tender or fails to abide by it, afteracceptance thereof, is communicated/posted to him shall be forfeited besidesother penal remedies that may be available to the Govt. of J&K under thelaw for the time being in force in the State of J&K :––

(a) If, after the registration/placement of orders/execution of theagreement and formally depositing the security money, thetenderer backs out or fails to supply the goods, the securitydeposit will be forfeited besides any other penal measures, thedepartment may take as per norms in vogue ;

(b) The formal deed incorporating the terms of the contract willbe executed by the successful bidder immediately after receiptof supply order. Failure to execute such bond/deed shall nothowever prevent the contract from being enforced againstthe bidder. Any loss sustained by the Govt. as a result ofre-tendering the contract, shall be recovered from the defaulter,besides other penal measures as the department may thinkproper ;

(c) Goods shall be delivered (as per instructions in supply order) atAPHQ, J&K, Jammu/Srinagar, duly packed in perfect condition.The supplier if he so desires may insure the goods against lossor theft, destruction, damages by the natural calamity loss byexposure to weather or otherwise viz. war rebellion, riot etc.The insurance charges will have to be borne by the supplierand the department shall not pay such charges ;

(d) If, the successful bidder fails to supply goods of the prescribedspecification or fails to deliver the goods within the stipulatedperiod as specifically mentioned in the supply order, thedepartment shall be at liberty to arrange supplies by otherpossible means, at his risk and cost. The department may giveprior notice to the approved supplier in writing to make suppliesgood. In case of failure to supply the consignment on specifiedqualitative and quantitative terms, the department shall belawfully entitled to forfeit the amount of the security moneyand take penal action to make good the loss sustained or excesscost incurred by the State in arranging the supplies and otherremedies that may be available to the department, under thelaw for the time being in force in the State.

25. The supplier shall not sublet the contract or any part thereof toany other agency without the concurrence of APHQ, J&K.

26. The decision of the accepting authority shall be final as to thequality of stores and shall be binding on the supplier. In case the articlessupplied are not according to the approved specifications they shall berejected. The replacement of the rejected stores shall be allowed at thesole discretion of the department. The loss caused due to rejection of thesupplies shall be entirely borne by the supplier. The rejected equipmentshall be lifted by the supplier within one week from the date of rejection.The department shall in no case be responsible for any loss or damage thatmay occur to the rejected stores while these are in the premises of theconsignee.

27. The quantities indicated in the Tender Notification are tentativeand this Headquarters reserves absolute rights to change the same withoutany prior notification up to the validity of rate contract of this NIT.

28. The authorities reserve absolute discretion to reject or acceptany tender or a part thereof without assigning any reason and without anylegal obligations. Any clause incorporated in the bid (not conforming to theNIT in any manner) shall make such an offer liable for rejection. Therefore,all the terms and conditions of the Tender Notice including technicalspecification shall be carefully studied for the sake of complete andcomprehensive tender. Failure to comply with any of the tender conditionsor instructions or the offer with insufficient particulars/documents, which islikely to render fair comparison of tender as a whole impossible shall leadto rejection even if otherwise, it is a competitive offer/tender.

29. The department reserves the right to add or suitably modify theterms and conditions (without prior notification) as per exigencies that mayarise for one or the other reason.

30. All legal proceedings arising out of any dispute between the partiesshall have to be settled in the Courts situated in Jammu and Srinagar andnot elsewhere.

1. Short title and commencement.––i. These rules may be calledthe Jammu and Kashmir Biological Diversity Rules, 2015.

2. Definitions.––In these rules, unless the context otherwiserequires,––

(a) “Act” means the Biological Diversity Act, 2002 (CentralAct 18 of 2003) ;

(b) “Authority” means the National BiodiversityAuthority constituted under sub-section (1) of section 8 ofthe Act ;

(c) “Board” means the J&K State Biodiversity Board establishedunder section 22 of the Act ;

(d) “Biodiversity ManagementCommittee” means a Committeeconstituted by the local bodies under sub-section (1) section41 of the Act ;

(e) “Form” means the Forms appended to these rules ;

(f) “Government” means the Government of Jammu andKashmir ;

(g) “Member” means a member of the J&K State BiodiversityBoard and includes the Chairperson thereof ;

(h) “Section” means section of the Act ;

(i) “Member-Secretary” means the Member-Secretary of theJ&K State Biodiversity Board ;

(j) “Year” means the financial year commencing on the First dayof April ; and

(k) Words and expressions used but not defined in these rulesshall have the same meaning respectively as assigned to themin the Act.

3. Terms and conditions of Service of the Chairperson andMembers.–– i. The Chairperson of the Board shall hold office for a termof three years and shall be eligible for re-appointment ; Provided that noChairperson shall hold office beyond the age of 65 years.

ii. The Chairperson may resign from his office by giving at least onemonth’s notice in writing to the State Government.

iii. The Chairperson of the Board shall be entitled to such salary andallowances, as may be determined by the State Government from time totime.

iv. Every non-official member of the Board shall hold office for aterm not exceeding three years from the date of his/her nomination

v. The non-official member of the Board shall be entitled to sittingallowance, travelling allowance, daily allowance and such other allowance(s)as may be prescribed by the Government.

vi. A non-official member of the Board may resign from hismembership at any time by giving notice in writing under his hand to theGovernment and the seat of that member shall become vacant.

vii. Any casual vacancy in the Board shall be filled up by freshappointment and the person so appointed shall hold office only for theremainder of the term of the member in whose place he was appointed.

4. Removal of member of the Board.––No member of the Boardshall be removed from the office on the grounds specified in section 11 ofthe Act without due and proper enquiry by an officer not below the rank ofPrincipal Secretary appointed by the Government for the purpose andwithout giving a reasonable opportunity to the member of being heard.

5. Appointment of Ex-officio Members.––Five Ex-officio membersshall be appointed from the following departments/organizations of the StateGovernment as long as they hold their respective office :––

i. Administrative Secretary, Forest Department ;

v. Director, State Forest Research Institute (Member-Secretary).

6. Head Office of the Board.––– The Board shall be located in theOffice of the Director, State Forest Research Institute, Srinagar/Jammu.

7. Functions and powers of Member-Secretary of the Board.––i. The Member-Secretary shall be responsible for day to day administrationof the Board.

ii. All orders or instructions to be issued by the Board shall be underthe signature of the Member-Secretary.

iii. The Member-Secretary shall be incharge of all the confidentialpapers of the Board and shall be responsible for their safe custody. Heshall produce such papers whenever directed by the Board.

iv. The Member-Secretary shall have the powers to signMemorandum of Understanding with various local, national and internationalorganizations after due approval of the Board. The Member-Secretary shallexercise such other powers and perform such other functions, as may bedelegated to him from time to time by the Board.

8. Meetings of the Board.––i. The Board shall meet at least twicein a year, at the Head Office of the Board or at such other place as may bedecided by the Chairperson.

ii. The Chairperson shall upon a written request from not less thanfive members of the Board or upon a direction of the Government call fora special meeting of the Board.

iii. The members shall be given at least fifteen days notice for holdingan ordinary meeting and three days notice for holding a special meeting,specifying the purpose, the time and venue at which such meetingis to be held.

iv. Every meeting shall be presided over by the Chairperson and inhis absence by the senior most ex-officio member.

v. The decision of the Board at a meeting shall, if necessary, betaken by a simple majority of the members present through voting and theChairperson or in his absence the member presiding the board shall have asecond or casting vote.

vi. Each member shall have one vote.

vii. The quorum at every meeting of the Board shall be Five.

viii. No member shall be entitled to bring forward for considerationof a meeting any matter of which he has not given ten days notice in writingunless the Chairperson in his discretion permits him to do so.

ix. Notice of the meeting may be given to the member by deliveringthe same by messenger or sending it by registered post to his last knownplace of residence or business or in such other manner as theMember-Secretary of the Board may, in the circumstances of the casethink fit.

x. Every member who is in any way, whether directly, indirectly orpersonally concerned or interested in a matter to be discussed in the meetingshall disclose the nature of his concern or interest and after such disclosure,the member concerned or interested shall not attend that meeting.

xi. The Board may dispose off urgent matters by circulation of papers,if so desired by the Chairperson. All resolutions and decisions thus made beconsidered at the next meeting of the Board for ratification.

xii. The Board may evolve such procedure for the transaction of itsbusiness, as it may deem fit.

9. Appointment of Expert Committee by the Board and theirEntitlements.–– i. The Board may constitute any number of committees,sub-committees, for such purposes as it deems fit for the efficient dischargeof the duties and its functions consisting of full time/part time members.

ii. The members of Expert Committee constituted undersub-section (1) shall be entitled to such other allowance(s) or fee(s), asmay be fixed by the State Government for attending the meeting(s) of theCommittee or Board.

iii. The Board may invite any person whose assistance or advice isconsidered useful to be obtained in performing any of its functions, and toparticipate in the deliberations of any of its meetings. Such person associatedwith the Board shall be entitled to get allowances, as prescribed by theGovernment.

10. General Functions of the State Biodiversity Board.––TheBoard shall perform the following functions :––

(i) Lay down procedure and guidelines to govern the activitiesunder section 23 of the Act ;

(ii) Advise the Government on any matter concerning conservationof biological diversity, sustainable use of its components andfair and equitable sharing of benefits arising out of the use ofbiological resources and knowledge ;

(iii) Provide technical assistance and guidance to the departmentsof the State Government and Biodiversity ManagementCommittees for coordination of the activities ;

(iv) Regulate by granting of approval(s) or otherwise requests forcommercial utilization or biosurvey and bioutilization of anybiological resource by Indians ;

(v) Facilitate updating and implementation of State bio-diversityStrategy and Action Plan ;

(vi) Commission studies and sponsor investigations and research ;

(vii) Engage consultants for specific periods, not exceeding threeyears, for providing technical assistance to the Board in theeffective discharge of its functions, provided that if it isnecessary and expedient to engage any consultant beyond threeyears the Board shall seek prior approval of Government forsuch engagement ;

(viii) Collect, compile and publish technical and statistical data,manuals, codes and guides relating to conservation of biologicaldiversity, sustainable use of its components and fair andequitable sharing of benefits arising out of the use of biologicalresource and knowledge ;

(ix) Organize through mass media a comprehensive awarenessprogramme amongst all stakeholders regarding conservationof biological diversity, sustainable use of its components andfair and equitable sharing of benefits arising out of the use ofbiological resource and knowledge ;

(x) Plan and organize training programmes for personnel engagedor likely to be engaged for programmes in the conservation ofbiological biodiversity and sustainable use of its components ;

(xi) Take steps to build up database and to create information anddocumentation system for biological resources and associatedtraditional knowledge through biodiversity registers andelectronic data base, to ensure effective management,promotions and sustainable uses ;

(xii) Give directions to Local Bodies/Biodiversity ManagementCommittees in writing and through appropriate oral means,for the effective implementation of the Act ; and to facilitatetheir meaningful participation in all measures relating toconservation, sustainable use and equitable benefit sharing ;

(xiii) To devise methods for ensuring protection of right includingintellectual property rights over biological resources andassociated knowledge, maintaining confidentiality of suchinformation as appropriate, the protection of the informationrecorded in People’s Biodiversity registers ;

(xiv) Sanction grant-in-aid and grants to the BiodiversityManagement Committees for specific purposes ;

(xv) Undertake physical inspection of any area within its jurisdictionin connection with the implementation of the Act ;

(xvi) Ensure that biodiversity and biodiversity dependent livelihoodsare integrated into all sectors of planning and management,and at all levels of planning from local to State, to enable suchsector and administrative levels to contribute effectively forconservation and sustainable use ;

(xvii) Prepare annual budget of the Board ;

(xviii) The Board shall have full powers for granting administrativeand technical sanctions to all the estimates. It may, however,delegate such administrative and technical powers to theChairperson/Member-Secretary of the Board any otheremployee of the Board, as may be deemed necessary ;

(xix) Recommend creation of posts to the Government for theeffective discharge of functions by the Board and to createsuch posts :

Provided that no such posts, whether temporary or permanent,of any nature shall be created without the prior approval ofthe Government ;

(xx) Shall have power to acquire, hold and dispose property,both movable and immovable and enter into contract for thesame ;

(xxi) Perform such other functions, as may be necessary to carryout the provisions of the Act or as may be prescribed by theState Government from time to time.

11. Powers and Duties of the Chairperson.––i. The Chairpersonshall ensure that the affairs of the Board are run efficiently and inaccordance with the provisions of the Act and rules madethereunder.

ii. The Chairperson shall have the powers of general superintendenceover the officers and staff of the Board and may also issue necessarydirections for the conduct and management of the affairs of theBoard.

iii. The Chairperson shall preside over all meetings of the Board andshall ensure that all decisions of the Board are implemented in proper manner.

iv. The Chairperson shall exercise such other powers and performsuch other functions as may be delegated to him from time to time by theBoard.

12. Employees of the Board and their conditions of service.––i. The Board may appoint such officers and other employees as it considersnecessary for the efficient discharge of its functions.

ii. The appointment in general shall be on contractual basis or ondeputation, unless otherwise decided by the State Government.

iii. The Board shall approve the method of recruitment to the posts inthe Board.

13. Procedure for access/collection of biological resourcesfor certain purposes.––i. Any citizen of India or body corporate, associationor organization registered in India shall make prior intimation of biosurveyand bioutilization for commercial purposes in Form I appended to theserules to the Board. Every application shall be accompanied by a fee as maybe fixed and notified by the Board in the form of Demand Draft.

ii. The Board after due appraisal of the application and afterconsultation with the Biodiversity Management Committee concerned andafter collecting such other additional information, as it may deem necessary,shall take decision on the application as far as possible within a period oftwo months of the receipt of the application.

iii. On being satisfied with the merit of the application, the Boardmay allow the application in the form of a written agreement signed by theMember-Secretary or an officer duly authorized by the Board on the onepart and the applicant on the other subject to such terms and conditions asit may deem necessary.

iv. The form of agreement shall be prescribed by the Board andshall contain such conditions as the Board may consider necessary to protectthe biological diversity of the State.

v. The conditions for access to/collectlon may specifically providemeasures for conservation and protection of biological resources to whichaccess/collection is being granted.

vi. The Board shall have full right to reject any application for goodand sufficient reasons, but before rejecting any application it shall give theapplicant reasonable opportunity of being heard.

vii. Any information given in the form referred to in the sub-rule (1)for prior intimation shall be kept confidential and shall not be disclosedeither intentionally or unintentionally to any person not concerned thereto.

14. Revocation of agreement.–– i. The Board may either suo-motoor on the basis of any complaint, revoke the written agreement in thecircumstances specified below :––

a. On the ground of reasonable belief that the person accessinghas violated any of the provisions of the Act ;

b. That the person has violated any of the terms of theagreement ; and

c. On account of overriding public interest with reference to theprotection of the environment and conservation of biologicaldiversity and protection of the rights, livelihoods and knowledgeof local communities.

ii. The revocation order shall be made only after making suchenquires as required after giving the person so affected reasonableopportunity of being heard.

iii. The Board shall send a copy of such withdrawal or revocationorder to the Biodiversity Management Committees and the local bodyconcerned for prohibiting the person concerned from utilizing the biologicalresources and also to assess the damage, if any, caused and take steps torecover the damage.

15. Restriction or prohibition on activities related to access tobiological resources.–– i. The Board, if it deems necessary and appropriateshall take the steps to restrict or prohibit the access to biological resourcesfor the following reasons that the access :––

a. Is for any endangered taxa, or taxa that are likely to becomethreatened due to such access ;

b. Is for any endemic and rare species ;

c. Is likely to result in adverse effect on the livelihoods, cultureor indigenous knowledge of the local people ;

d. May result in adverse environmental impact which may bedifficult to control and mitigate ;

e. May cause genetic erosion or affecting the ecosystemfunction ;

f. For resources may be for purposes contrary to National/Stateinterest and other related International agreements entered into by the Country.

ii. Any order of restriction shall be made only after making suchinquiries as required after consulting the concerned BiodiversityManagement Committees and giving the person so affected an opportunityof being heard.

16. Application and operation of State Biodiversity Fund.––i. The State Biodiversity Fund shall be deposited in a bank as approved bythe Board in the name of J&K Biodiversity Fund.

ii. The State Biodiversity Fund shall be operated by theMember-Secretary of the Board or by such officer of the Board as may beauthorized by the Board in this behalf.

iii. The “State Biodiversity Fund” shall have separate heads ofaccounts receipts from––

(a) Central Government ;

(b) National Biodiversity Authority ;

(c) State Government ;

(d) Fee, royalty and other receipts.

iv. The Board shall frame guidelines to ensure that decisions regardingthe management and use of the fund are transparent and accountable tothe public.

17. Annual Report and Annual Statement of Accounts.–– i. TheBoard shall prepare its annual report for each financial year giving detailedaccount of its activities, achievements and annual statement of accountsand submit the same to the State Government.

ii. The Board shall lay down the procedure for upkeep of theaccounts. The accounts of the Board shall be audited by a CharteredAccountant on panel of Comptroller and Auditor General (CAG) appointedfor the purpose by the Board. The Accountant General may as well auditthe accounts.

iii. The Board shall submit the annual report of the Preceding FinancialYear together with the audited statement of accounts to the Governmentby the 31st of the Month of October.

18. Establishment and Management of Biodiversity Heritagesites.–– i. The Board shall, in consultation with the local bodies and otherkey stakeholders, take necessary steps to facilitate setting up of areas ofsignificant biodiversity values as Heritage Sites. Following recommendationfrom the Board, the State Government shall issue notification to this effect.

ii. The Board shall frame guidelines on the selection, managementand other aspects of Heritage Sites ensuring that these provide decisionmaking role for relevant Biodiversity Management Committees.

19. Constitution and functions of Biodiversity ManagementCommittees.–– i. Every local body shall constitute a BiodiversityManagement Committee within its area of jurisdiction.

ii. The Biodiversity Management Committees as constituted undersub-rule (l) shall have six persons nominated by the local body, of whichthere shall be atleast two women members and one from Scheduled Caste/Scheduled Tribe. These six local knowledgeable persons being so nominatedshould be drawn from amongst the––

• herbalists ;

• agriculturalists ;

• non-Timber Forest Produce collectors/traders

• fisher folk ;

• representatives of user associations/community workers

• academicians

• any person/representative of organization, on whom the localbody trusts that he/she can significantly contribute to themandate of the Biodiversity Management Committee.

All the persons should be residents of the said local body andshould be in the voters list. The tenure of the members shallbe three years or till a new committee is constituted. Anymember may resign at any time by giving in writing to theChairperson of the Biodiversity Management Committee.

iii. Every Biodiversity Management Committee shall have atleastsix special invitees from amongst Forest, Agriculture, Horticulture, AnimalHusbandry, Health, Fisheries and Education Department to be nominatedby the concerned local body.

iv. The Chairpersons of the Block Development Council (BDC)/Urban Local Body concerned shall be Ex-officio Chairman of theBiodiversity Management Committee and will have tenure as long as hecontinues as Chairperson of the Block Development Council (BDC)/UrbanLocal Body.

v. Every meeting of the Biodiversity Management Committee shallbe presided over by the Chairperson and in his absence, by a member, to benominated by the members present from among themselves.

vi. In matters related to wild biological diversity and/or biodiversityfound in forest land, it shall be mandatory for the Biodiversity ManagementCommittee to seek assistance of the concerned Joint Forest ManagementCommittee (JFMC), Village Forest Management Committee (VFMC)and/or Eco-Development Committee (EDC). This will be applicable to areasother than recorded forests and protected areas notified under WildlifeProtection Act, 1978.

vii. The local Members of the Legislative Assembly/LegislativeCouncil and Member of Parliament would be special invitees to the meetingsof the Biodiversity Management Committees at different levels.

viii. A technical support group comprising of experts in the field ofbiodiversity drawn from Government Agencies, Non-GovernmentOrganizations, academic and research field, community and individuals shallbe established by State Biodiversity Board. The expert group shall lendsupport to Biodiversity Management Committees.

ix. The Biodiversity Management Committees shall prepare thepeople’s Biodiversity Registers in consultation with local population. TheRegister shall contain comprehensive information on availability andknowledge of local biological resources, their medicinal or any other use orany other traditional knowledge associated with them.

x. The Board shall provide guidance and technical support to theBiodiversity Management Committees for preparing People’s BiodiversityRegisters, and shall ensure that all information recorded in such Registersreceives legal protection against misuse and appropriation by outside agenciesand individuals.

xi. The Biodiversity Management Committee and local bodies willbe responsible for ensuring the protection of the knowledge recorded in thepeople’s Biodiversity Registers, especially to regulate its access to outsideagencies and individuals through Prior Informed Consent (PIC).

xii. The People’s Biodiversity Registers shall be maintained andvalidated by the Biodiversity Management Committees.

xiii. The other function of the Biodiversity Management Committeeis to advise on any matter referred to it by the State Biodiversity Board orAuthority for granting approval, to maintain data about the local Vaids,Hakims and practitioners using the biological resources.

xiv. The Biodiversity Management Committee shall also maintain aRegister giving information about the details of the access to biologicalresources and traditional knowledge granted, details of the collection feeimposed and details of the benefits derived and the mode of their sharing.

xv. The Biodiversity Management Committee may decide the termson which it would permit access to biodiversity resources and associatedknowledge to different parties for various purposes within their jurisdictionand levy charges by way of collection fees from any person for accessingor collecting any biological resources for commercial purpose from thearea falling within its jurisdiction. The major share of levy charged for thematerial eollected/cultivated from private land should be given to the owner/cultivator of the land/knowledge holder(s) and the balance should be

The levy charged for the material collected/cultivated fromGovernment land should be totally deposited in Local Biodiversity Fund ofBiodiversity Management Committee.

xvi. The Biodiversity Management Committee shall take initiative togenerate awareness regarding the biological resources available in the locality,their economic and ecological importance and the need to conserve them.

xvii. The Biodiversity Management Committee shall report anyincidence of misuse of biological resource to the concerned Range Officer(Territorial) or to the Member-Secretary of the Board or any other officerauthorized under the Biological Diversity Act, 2002.

vviii. No suit, prosecution or other legal proceedings shall lie againstthe members of Biodiversity Management Committee or the forest officerfor anything which is in good faith done or intended to be done under theAct or the rules or regulations made thereunder.

20. Local Biodiversity Fund.––i.Every Biodiversity ManagementCommittee shall have its local biodiversity fund.

ii. The Board shall provide to the Biodiversity ManagementCommittee any loan or grant received from the State Government, CentralGovernment or from the Authority for the purpose of the Act. TheBiodiversity Management Committee can also access such funds fromother sources as it identifies, or as specified by the Board.

iii. The Local Biodiversity Fund shall be operated by the BiodiversityManagement Committees. The Board shall lay down the operationalguidelines for operation of the fund.

iv. The fund shall be used for the conservation and promotion ofbiodiversity in the areas falling within the jurisdiction of the concernedBiodiversity Management Committee and for the benefit of the localcommunity in so far such use is consistent with conservation of biodiversity.

v. The account of the Local Biodiversity Fund shall be prepared insuch forms as prescribed by the Board and during such time, as may beprescribed by the Board.

21. Annual Report and Annual Statement of Accounts ofBiodiversity Management Committee.––i. The Biodiversity ManagementCommittee shall prepare the annual report for each year giving detailedaccounts of its activities. The annual report shall invariably contain––

(a) The name of the Committee ;

(b) The period of which the report relates ;

(c) The incumbency of office for the period ;

(d) Detailed statement of programmes of action for the year ;

(e) Detailed report on the activities performed during the year ;

(f) A brief account of financial position of the Committee.

ii. The accounts of the Local Biodiversity Fund shall be audited asprescribed by the Board.

iii. The Biodiversity Management Committee shall submit the auditedstatement of accounts to the Board and a copy to the local body concernedby the 31st of the Month of October following.

22. Removal of doubts.––Where a doubt arises as to the interpretationof any of the provisions of these rules, the matter shall be referred to theGovernment, whose decision thereon shall be final.

23. Appeal for settlement of disputes.–– i. Aggrieved by any order,decision or policy of the Board, a Biodiversity Management Committee orlocal body, may prefer an appeal in Form II appended to the rules toGovernment of Jammu and Kashmir in the Forest Department. For disputesbetween Biodiversity Management Committees regarding their respectivejurisdiction or any other matter, an appeal may be filed before the Chairpersonin the Form IIA appended to these rules.

ii. The memorandum of appeal shall state the facts of the case, thegrounds relied upon by the appellant for preferring the appeal and the reliefsought for, and shall be accompanied by an authenticated copy of the order,direction or policy decisions, as the case may be, by which the appellant isaggrieved. The Memorandum of Appeal shall be duly signed by theauthorized representative of the appellant.

iii. The Memorandum of Appeal shall be submitted in quadruplicateaccompanied with the authenticated copy of the order, directions or policydecisions as the case may be, by which the appellant is aggrieved, either inperson or through a registered post with acknowledgement due, within 30days from the date of the order, direction or policy decision :

Provided that if the appellate authority is satisfied that there wasgood and sufficient reason for the delay in preferring the appeal, the appellateauthority, for reasons to be recorded in writing allow the appeal to bepreferred after the expiry of the aforesaid period of 30 days but before theexpiry of 45 days from the date of the order, direction or policy decision asthe case may be.

iv. The notice for hearing of the appeal shall be given in Form III bya registered post with an acknowledgement due.

v. Every Memorandum of Appeal shall be accompanied by a fee tobe prescribed by the Board.

24. Complaint and manner of giving notice under section 61.––i. A complaint under section 61 for cognizance of any offence under theAct shall be made before the appropriate Court of Law by officers of theState Biodiversity Board or by Forest officers not below the rank of RangeOfficers in their respective jurisdiction or any other officer notified by theGovernment under the Biological Diversity Act, 2002.

ii. The manner of giving notice under clause (b) of section 61 shallbe as follows :––

a. If violation of any provision of the Biological Diversity Act,2002 is detected or observed by any person or groups of persons

b. The person giving the notice shall send it to the Chairman ofthe National Biodiversity Authority/State BiodiversityBoard as the case may be by registered post acknowledgementdue :

Provided that the period of thirty days mentioned in clause (b)of section 61 of the Act shall be reckoned from the date ofreceipt of the notice by the Chairman, National BiodiversityAuthority/State Biodiversity Board.

25. Framing of Guidelines by State Biodiversity Board.––Withoutprejudice to any of the provisions of Biological Diversity Act, 2002 andBiological Diversity Rules, 2004 of Government of India and J&KBiodiversity Rules, 2014 framed by the Government of J&K, the J&KBiodiversity Board may frame guideline(s) as it may deem fit and necessaryfor carrying out the purpose of the Act within the State with the priorapproval of the Government.
