A SYSTEMS APPROACH

MAQASIDAL-SHARIAH

ASPHILOSOPHYof islamic law

Islamic law is about achieving the juridicalpurposes (maq¥|id al-shari¢ah) of justice, mercy, wisdom, and common good. However, many ‘Islamic rulings’ (fat¥w¥)issued today effectively replace justice withinjustice, mercy with cruelty, wisdom withnonsense, and common good with mischief. This book argues that such rulings do notbelong to the Islamic law, even if they wereclaimed to be so according to some interpre-tation. In this pathbreaking study, JasserAuda presents a systems approach to the philosophy and juridical theory of Islamiclaw based on its purposes (maq¥|id).

Maq¥|id al-shari¢ah, or the higher goals andobjectives of Islamic law, is an important andyet somewhat neglected theme of the Shari¢ah.Generally the Shari¢ah is predicated on thebenefits of the individual and that of thecommunity, and its laws are designed so as toprotect these benefits and facilitate improve-ment and perfection of the conditions ofhuman life on earth. This easy to read guidegives a birds eye view of the subject, simplifying its main principles to help readersunderstand the subject of maq¥|id al-shari¢ahand how it explains the ‘wisdoms behindrulings.’

Current applications (or rather, misapplica-tions) of Islamic law are reductionist ratherthan holistic, literal rather than moral, one-dimensional rather than multidimensional, binary rather than multi-valued, deconstruc-tionist rather than reconstructionist, and causalrather than teleological. There is lack ofconsideration and functionality of the over-allpurposes and underlying principles of theIslamic law as a whole. Further, exaggeratedclaims of ‘rational certainty’ (or else, ‘irrationa-lity’) and ‘consensus of the infallible’ (or else,‘historicity of the scripts’) add to lack ofspirituality, intolerance, violent ideologies, suppressed freedoms, and authoritarianism.

The maq¥|id al-shari¢ah have been eitherdirectly stated in the Qur’an and the Sunnahor inferred from these by a number of schol-ars. All of these address the raison d’etre ofthe Shari¢ah which, as recognized by almostall the jurists, is to serve the interests of allhuman beings and to save them from harm.In this paper Dr. Chapra explores the Islamicvision of development in relation to themaq¥|id al-shari¢ah arguing that Islam hasemphasized all the ingredients of humanwell-being, including the human self, faith, intellect, posterity as well as wealth, for society to flourish.

The Sunnah provides the stable moral frame-work enabling Muslims by formal rules andan inward sense to know right from wrong. This book addresses the danger of simplisti-cally viewed, misused and widely misinter-preted hadith. Hadith need to be approachedwith wisdom and understanding. The authorexamines what makes a hadith sound orweak, and how certain hadith are being sensationalised without understanding theirevolution and development.

VEIL

A powerful critique of the popular westernnotion that the veil is a symbol of Muslimwomen’s oppression. Until now the bulk ofthe literature about the veil has been writtenby outsiders who do not themselves veil. This literature often assumes a condescend-ing tone about veiled women, assuming thatthey are making uninformed choices aboutveiling that makes them subservient to apatriarchal culture and religion. RethinkingMuslim Women and the Veil offers an alterna-tive viewpoint, based on the thoughts andexperiences of Muslim women themselves.

This paper examines the issue of maritaldiscord with a deep sensitivity to theperspective of women. Criticising an approachto the Qur’an that is misogynistic rather thanemancipatory the paper moves the debateforward by introducing an alternative inter-pretation of the Qur’anic text. Theexplanation is fresh, firmly on the side ofwomen’s human rights and recaptures the fullIslamic spirit of human dignity.
