Recitals
SFRSandBHMKFRShaveagreedto enterintoarrangementsonthetermssetoutinthisAgreement:
a) Forsecuringundersectionl3ofthe2004Acttherenderingof mutualassistanceindischargingtheirfunctionsundersections7to9ofthe2004Act
b) ForsecuringundersectionISof the2004Actthedischargeofsomeof eachothers'functionsundersectionsBto 9 and11of the 2004Act.
AGREEMENT
I. DefinitionsandInterpretations
Thepartiesagreeasfollows;
1.1 '1he2004Act"meanstheFireandRescueServicesAct2004.
1.2 "TheAgreement"meansthe mainbodyof this agreementandthe schedulesherein(andincludinganyvariationsmadeinaccordancewithClause11).
1.3 '1he Assistor"meansthe partyto the Agreementwhichunderthe provisionsof this Agreementgivesassistanceto.or dischargesafunctionof.theotherpartyto thisAgreement.
1.4 "TheRecipient"meansthepartyto thisAgreementwhichundertheprovisionsof this Agreementreceivesassistancefrom.or hasafunctiondischargedby.theotherpartyto thisAgreement.
1.5 "TheTerm"meansthe periodcommencingon I August2012andterminatingin accordancewith theprovisionsofClause7.

I.B ''TheReinforcements"meanssuchresources(includingpersonnel.vehiclesandotherequipment)as theChiefFireOfficerfor thetimebeingemployedbytheAssistorconsidersto beavailableat that timeto meeta requestfor assistancefromtheRecipient.
1.7 "TheExpenses"meansthe expensesincurredby the Assistorin providing assistance.or dischargingfunctions.duringtheTerm.for:
1.7.1 Thecostof replacementofconsumablestoressuchaspetrol.oilor foamcompound.
1.7.2 Thecostofrepairingor replacinglostor damageditemsofequipment:and
1.7.3 Thecost of additionallabourcostsi.e. overtimeincurredby the Assistorin providingreinforcements.
1.8 "EmergencyCalls"meanstelephoneandothercallsrequestingassistancein respectofanincidentwithinafire andrescueauthority'sfunctionsundersections7to 8 inclusiveofthe2004Act.
1.8 "ChiefFireOfficer"includesanypersonauthorisedto actonhisor herbehalf
1.10 "Year"meanstheperiodoftwelvemonthsendingoneach31March
2. ConstructionofthisAgreement
2.1 Unlessthecontextrequiresotherwise.wordsimportingthesingularshallincludethepluralandviceversa.andthemasculinegendershallincludethefeminineandneuterandviceversa
2.2 Referencesto Recitals.ClausesandSchedulesare. unlessotherwisestated.referencesto. recitalsto.
clausesofandschedulesto thisAgreement.
2.3 Anyreferenceto a 'person'shallastheAgreementmayrequirebeconstruedasa referenceto anyindividual.firm.company.bodycorporate.corporation.trust.governmentdepartment.state.agencyoranyassociationorpartnership(whetherornothavingaseparatelegalentity).
2.4 Theexpressions"SFRS" and"BHMKFRS"shallincludetheir respectivesuccessors.
2.5 Theheadingsanduseof boldtypeinthisAgreementare insertedfor convenienceonlyandshallnotaffecttheconstructionor interpretationofthisAgreement.
2.B Referencesto anyActof Parliamentor statutoryprovisionshallbedeemedto includeanytreaty.statute.statutoryinstrument.directive.bye-law.instrument.orderor regulationderivingauthoritytherefrom oranyotherlikelegislationor documentandanyamendmentmodificationor re-enactmentthereof.
SFRS'sObligations
Reinforcements
3. Pursuantto section13ofthe2004Act.SFRSagreesat BHMKFRSrequestto providetheReinforcementstoBHMKFRSin the eventof an emergencyduringthe Termas soonas is reasonablypracticablein theprevailingcircumstances.
GededResponsibility
4. Pursuantto section16ofthe2004Act.SFRSagreesat BHMKFRSrequestto dischargecertainfunctionsofBHMKFRSunderthe2004ActduringtheTerm.asfollows:
4.1 Torespondassoonasis reasonablypracticableto allEmergencyGallsreceivedbySFRSdirectlyin respectofthosepartsof BHMKFRS'sareaasindicatedinGolumnI ofPartI oftheFirstScheduleusingtheresourcesspecifiedinGolumn2 oftheSchedule.
4.2 Tonotify BHMKFRSbytelephoneof all EmergencyGallsin respect of incidentsin the BHMKFRSarea indicated
in GolumnI of Part I of the First Scheduleas soon as is reasonablypracticable upon receipt of such
EmergencyGallsandof the resourcesdispatchedbySFRSbywayof responseto suchEmergencyGalls.
4.3 Torespondas soonas is reasonablypracticableto all EmergencyGallsreferredto SFRSby BHMKFRSinrespectof thoseparts of BHMKFRSareaindicatedin Golumnlof Partl of the First ScheduleusingtheresourcesspecifiedinthecorrespondingpartofGolumn2 oftheFirstSchedule.
The BHMKFRSobligations
Reinforcements
5. Pursuantto section13ofthe2004Act.BHMKFRSagreesto providetheReinforcementsto SFRSintheeventofanemergencyduringtheTerm.assoonasis reasonablypracticableintheprevailingcircumstances.

6. Pursuantto section16ofthe2004Act.BHMKFRSagreesat SFRSrequestto dischargecertainfunctionsoftheSFRSunderthe2004ActduringtheTerm.asfollows:
6.1 Torespondas soonas is reasonablypracticableto all EmergencyGallsreceivedby BHMKFRSdirectlyinrespectof thosepartsof SFRSareaas indicatedin GolumnI of Part2 of the First ScheduleusingtheresourcesspecifiedinGolumn2oftheSchedule.
6.2 Tonotifythe SFRSbytelephoneof all EmergencyGallsin respectof incidentsin the SFRSareaindicatedinGolumnI ofPart2 oftheFirstScheduleassoonasisreasonablypracticableuponreceiptofsuchEmergencyGallsandoftheresourcesdispatchedbyBHMKFRSbywayofresponseto suchEmergencyGalls.

6.3 Torespondassoonas is reasonablypracticableto all EmergencyCallsreferredto BSMKFRSby SFRSinrespectof thoseparts of SFRSareaindicatedin ColumnI of Part 2 of the First Scheduleusingtheresources specifiedin the correspondingpart of Column2 of the First Schedule.
General
Termination
7. ThisAgreementmaybeterminatedat anytimebyeitherpartygivingto theothernotlessthansix-calendarmonths'priorwrittennoticeto expireatanytimeor immediatelybymutualagreement.
Notices
8. Forthepurposesof Clause7suchnoticeshallbedeemedto bevalidlyservedbyonepartyif sentbyrecordeddeliverypostaddressedtotheotherpartyattheaddressgivenattheheadofthisAgreement.
S. TheAssistorshallindemnifythe Recipientagainstallcosts.liabilitiesanddamageswhatsoeverin respectofdeathor personalinjuryor lossor damageto anypropertycausedsolelyanddirectlybythenegligenceoftheAssistoror its employeeswhileactingundertheprovisionsofthisAgreement.
Expenses
10. TheRecipientshallwithin21daysof receiptof a written demandfrom the Assistorpaythe Assistor'sExpenses.
Variation
11. ThisAgreementmaybevariedat anytimebymutualagreementbetweenthe parties.suchvariationto berecordedbywrittenmemorandum.signedanddatedbybothpartiesandattachedto thisAgreement.
Record keepinQ
12. Eachpartyshallkeepaccurateandcompletewrittenrecordsofall EmergencyCallsor incidentsto whichithasrespondedundertheprovisionsofthisAgreementandsubmitcopiesofsuchrecordsto theotherpartyonrequest.
Completionof the IncidentRecordinQSystem(lRS)forms
13. Wherethereis jointattendanceat anincidentit shallbetheresponsibilityof the Recipientto completetheIRSform.Wherethere is no attendancefrom the Recipientthe OfficerIn Chargeof the first appliance
attendingfromtheAssistorshallberesponsiblefor completingthe IRSform andsubmittingit to the ClGdatabase.
IndustrialAction
14. Theobligationsof a partyunderthisAgreementshallbesuspendedin the eventof industrialaction.whichpreventsthat partyfromfulfillingits obligationsunderthisAgreementfor the durationof suchindustrialaction.
15. Intheeventof industrialactionbothpartieswill agreeto enterintoanewreinforcementschemewitheachotheror otherpartiesfor securingmutualassistanceduringthe periodof industrialactionas deemedappropriateatthetime.
General
lB. Inthe caseof incidentsattendedbyoperationalpersonnelfrombothSFRSand BBMKFRSthe mostsenioroperationalofficerof the RecipientFRSpresentat thescene.("theSeniorUfficer")shallhavesolechargeof fire andrescueserviceoperations.unlessotherwiseagreedonacase-by-casebasis.AllpersonnelshallcomplywithallreasonableinstructionsandrequestsbytheSeniorUfficerasto deploymentandoperationalactionwiththeprovisofor safesystemsof workpurposesthatcrewsshallnotbesplitupsuchthatindividualfirefightersfrombothpartiesareworkingtogetheraspartofthesamecrew.
17. EachpartyshallprovideearlyconsultationonanyIntegratedRiskManagementPlan(lRMP)that mayaffecttheresourcesandgeographicalareasspecifiedintheFirstSchedule.
18. Eachpartyshallsharehazardinformationandprovideprovisionsto makethis informationreadilyavailableen-routeto anincidentto supportsafesystemsofwork.
IS. Eachpartyagreesto sharerelevantinformationto helpimproveandsupportperformancestandards.
Waiver
2U. NodelaybyanyPartyinenforcinganyof thetermsor conditionsof thisAgreementwill affector restrictrightsandpowersarisingundertheAgreement.Nowaiverof anyterm or conditionof this Agreementwillbeeffectiveunlessmadeinwriting.
RepresentatiDn
21. Norepresentationor statement(exceptwritten representationsor writtenstatementsof fact) relatingspecificallyto the Agreementmadebyanyrepresentativeof eitherpartyprior to the dateof completionshallbebinding.

Validityof AgreementProvisions
22. If anyof theseterms andconditionsshallbe foundby anycourtor administrativebodyof competentjurisdictionto beinvalidor unenforceabletheinvalidityor unenforceabilityof suchterm or conditionshallnot affectthe otherterms andconditionshereofandall suchtermsandconditionsnot affectedby suchinvalidityor unenforceabilityshallremaininfull forceandeffect.
22.1 ThePartiesherebyagreeto attemptto substitutefor anyinvalidor unenforceabletermor conditionavalidenforceableterm or conditionwhichachievesto the greatestextentpossiblethe economic.legalandcommercialobjectivesunderlyingtheinvalidor unenforceabletermor condition.
Third Party Rights
23. ThepartiesherebyagreethattheContract(Rightsof ThirdParties)ActISSS doesnotapplyto thisagreement.

24. All referencesto statutesin thesetermsandconditionsshallbedeemedto applyequallyto anyre-enactmentormodificationthereof.
Jurisdiction
25. Theseterms andconditionsandanydocumentsformingpart of this Agreementshallbegovernedby andconstruedin accordancewithEnglishlawto the exclusivejurisdictionof whosecourtsthe Partiesherebysubmit.
