THE FAIR LABOR STANDARDS ACT OF 1938, AS AMENDED(29 U.S.C. 201, et seq.)

To provide for the establishment of fair labor standards inemployments in and affecting interstate commerce, andfor other purposes.

Be it enacted by the Senate and House of Representativesof the United States of America in Congress assembled,That this Act may be cited as the “Fair Labor StandardsAct of 1938.”

Finding and Declaration of Policy

SEC. 2. (a) The Congress hereby finds that the exis-tence, in industries engaged in commerce or in the pro-duction of goods for commerce, of labor conditions detri-mental to the maintenance of the minimum standard ofliving necessary for health, efficiency, and general well-being of workers (1) causes commerce and the channelsand instrumentalities of commerce to be used to spreadand perpetuate such labor conditions among the workersof the several States; (2) burdens commerce and the freeflow of goods in commerce; (3) constitutes an unfair methodof competition in commerce; (4) leads to labor disputesburdening and obstructing commerce and the free flowof goods in commerce; and (5) interferes with the orderlyand fair marketing of goods in commerce. The Congressfurther finds that the employment of persons in domes-tic service in households affects commerce.

(b) It is hereby declared to be the policy of this Act,through the exercise by Congress of its power to regulatecommerce among the several States and with foreign na-tions, to correct and as rapidly as practicable to eliminatethe conditions above referred to in such industries withoutsubstantially curtailing employment or earning power.1

Definitions

SEC. 3. As used in this Act —(a) “Person” means an individual, partnership, associa-

tion, corporation, business trust, legal representative, orany organized group of persons.

(b) “Commerce” means trade, commerce, transporta-tion, transmission, or communication among the severalStates or between any State and any place outside thereof.2

(c) “State” means any State of the United States or theDistrict of Columbia or any Territory or possession of theUnited States.

(d) “Employer” includes any person acting directly orindirectly in the interest of an employer in relation to an em-ployee and includes a public agency,3 but does notinclude any labor organization (other than when acting as anemployer) or anyone acting in the capacity of officer or agentof such labor organization.

(e) (1) Except as provided in paragraphs (2), (3),and (4), the term “employee” means any individual em-ployed by an employer.

(2) In the case of an individual employed by a pub-lic agency, such term means —

(A) any individual employed by the Govern-ment of the United States —

(i) as a civilian in the military de-partments (as defined in section 102 of title5, United States Code),

(ii) in any executive agency (as de-fined in section 105 of such title),

(iii) in any unit of the judicial branchof the Government which has positions inthe competitive service,

(iv) in a nonappropriated fund instru-mentality under the jurisdiction of the ArmedForces,

(v) in the Library of Congress, or(vi) the Government Printing Office;

(B) any individual employed by the UnitedStates Postal Service or the Postal Rate Commis-sion; and

(C) any individual employed by a State,political subdivision of a State, or an interstate gov-ernmental agency, other than such an individual—

(i) who is not subject to the civil ser-vice laws of the State, political subdivision,or agency which employs him; and

(ii) who —(I) holds a public elective office

of that State, political subdivision, oragency,

(II) is selected by the holder ofsuch an office to be a member of his per-sonal staff,

(III) is appointed by such an of-fice holder to serve on a policymakinglevel,

(IV) is an immediate adviser tosuch an officeholder with respect to theconstitutional or legal powers of his of-fice, or

(V)4 is an employee in the legis-lative branch or legislative body of thatState, political subdivision, or agencyand is not employed by the legislativelibrary of such State, political subdi-vision, or agency.

(3) For purposes of subsection (u), such term doesnot include any individual employed by an employerengaged in agriculture if such individual is the par-ent, spouse, child, or other member of the employer’simmediate family.5

(4)6 (A) The term “employee” does not includeany individual who volunteers to perform ser-vices for a public agency which is a State, apolitical subdivision of a State, or an interstategovernmental agency, if —

(i) the individual receives no compen-sation or is paid expenses, reasonable ben-efits, or a nominal fee to perform theservices for which the individual volun-teered; and

(ii) such services are not the sametype of services which the individual is em-ployed to perform for such public agency.

(B) An employee of a public agency whichis a State, political subdivision of a State, or aninterstate governmental agency may volunteerto perform services for any other State, po-litical subdivision, or interstate governmentalagency, including a State, political subdivisionor agency with which the employing State, po-litical subdivision, or agency has a mutual aidagreement.

(5)7 The term “employee” does not include in-dividuals who volunteer their services solely

for humanitarian purposes to private non-profit food banks and who receive from thefood banks groceries.

(f) “Agriculture” includes farming in all its branches andamong other things includes the cultivation and tillage ofthe soil, dairying, the production, cultivation, growing, andharvesting of any agricultural or horticultural commodi-ties (including commodities defined as agricultural com-modities in section 1141j(g) of U.S.C. Title 12), the raisingof livestock, bees, furbearing animals, or poultry, and anypractices (including any forestry or lumbering operations)performed by a farmer or on a farm as an incident to or inconjunction with such farming operations, including prepa-ration for market, delivery to storage or to market or tocarriers for transportation to market.

(g) “Employ” includes to suffer or permit to work.(h) “Industry” means a trade, business, industry, or

other activity, or branch or group thereof, in which indi-viduals are gainfully employed.

(i) “Goods” means goods (including ships and marineequipment), wares, products, commodities, merchandise,or articles or subjects of commerce of any character, or anypart or ingredient thereof, but does not include goods aftertheir delivery into the actual physical possession of the ul-timate consumer thereof other than a producer, manufac-turer, or processor thereof.

(j) “Produced” means produced, manufactured, mined,handled, or in any other manner worked on in any State;and for the purposes of this Act an employee shall bedeemed to have been engaged in the production of goods ifsuch employee was employed in producing, manufactur-ing, mining, handling, transporting, or in any other man-ner working on such goods, or in any closely related pro-cess or occupation directly essential to the productionthereof, in any State.8

(k) “Sale” or “sell” includes any sale, exchange, contractto sell, consignment for sale, shipment for sale, or otherdisposition.

(l) “Oppressive child labor” means a condition of em-ployment under which (1) any employee under the age ofsixteen years is employed by an employer (other than aparent or a person standing in place of a parent employinghis own child or a child in his custody under the age of six-teen years in an occupation other than manufacturing ormining or an occupation found by the Secretary of Laborto be particularly hazardous for the employment of chil-dren between the ages of sixteen and eighteen years ordetrimental to their health or well-being) in any occupa-tion,9 or (2) any employee between the ages of sixteen and

eighteen years is employed by an employer in any occupa-tion which the Secretary of Labor shall find and by orderdeclare to be particularly hazardous for the employment ofchildren between such ages or detrimental to their healthor well-being; but oppressive child labor shall not be deemedto exist by virtue of the employment in any occupation ofany person with respect to whom the employer shall haveon file an unexpired certificate issued and held pursuant toregulations of the Secretary of Labor certifying that suchperson is above the oppressive child labor age. The Secre-tary of Labor shall provide by regulation or by order thatthe employment of employees between the ages of four-teen and sixteen years in occupations other than manufac-turing and mining shall not be deemed to constitute op-pressive child labor if and to the extent that the Secretaryof Labor determines that such employment is confined toperiods which will not interfere with their schooling and toconditions which will not interfere with their health andwell-being.

(m) “Wage” paid to any employee includes the reason-able cost, as determined by the Secretary of Labor,10 to theemployer of furnishing such employee with board, lodging,or other facilities, if such board, lodging, or other facilitiesare customarily furnished by such employer to his employ-ees: Provided, That the cost of board, lodging or otherfacilities shall not be included as a part of the wage paidto any employee to the extent it is excluded therefromunder the terms of a bona fide collective-bargainingagreement applicable to the particular employee: Pro-vided further, That the Secretary is authorized to deter-mine the fair value of such board, lodging, or other fa-cilities for defined classes of employees and in definedareas, based on average cost to the employer or to groupsof employers similarly situated, or average value togroups of employees, or other appropriate measures offair value. Such evaluations, where applicable and per-tinent, shall be used in lieu of actual measure of cost indetermining the wage paid to any employee. In determin-ing the wage an employer is required to pay a tippedemployee, the amount paid such employee by theemployee’s employer shall be an amount equal to —

(1) the cash wage paid such employee which forpurposes of such determination shall be not less thanthe cash wage required to be paid such an employeeon August 20, 1996; and

(2) an additional amount on account of the tipsreceived by such employee which amount is equal tothe difference between the wage specified in para-graph (1) and the wage in effect under section 6(a)(1).

The additional amount on account of tips may not ex-ceed the value of the tips actually received by an em-ployee. The preceding two sentences shall not apply withrespect to any tipped employee unless such employee hasbeen informed by the employer of the provisions of thissubsection, and all tips received by such employee havebeen retained by the employee, except that this subsectionshall not be construed to prohibit the pooling of tips amongemployees who customarily and regularly receive tips.11

(n) “Resale” shall not include the sale of goods to beused in residential or farm building construction, repair, ormaintenance: Provided, That the sale is recognized as abona fide retail sale in the industry.12

(o) Hours worked. — In determining for the purposesof sections 6 and 7 the hours for which an employee is em-ployed, there shall be excluded any time spent in changingclothes or washing at the beginning or end of each work-day which was excluded from measured working time dur-ing the week involved by the express terms of or by customor practice under a bona fide collective-bargaining agree-ment applicable to the particular employee.13

(p) “American vessel” includes any vessel which isdocumented or numbered under the laws of the UnitedStates.

(q) “Secretary” means the Secretary of Labor.(r) (1) “Enterprise” means the related activitiesperformed (either through unified operation or com-mon control) by any person or persons for a commonbusiness purpose, and includes all such activitieswhether performed in one or more establishmentsor by one or more corporate or other organizationalunits including departments of an establishmentoperated through leasing arrangements, but shall notinclude the related activities performed for such en-terprise by an independent contractor. Within themeaning of this subsection, a retail or service estab-lishment which is under independent ownership shallnot be deemed to be so operated or controlled as to beother than a separate and distinct enterprise by rea-son of any arrangement, which includes, but is notnecessarily limited to, an agreement,

(A) that it will sell, or sell only, certaingoods specified by a particular manufacturer,distributor, or advertiser, or

(B) is engaged in the operation of a hos-pital, an institution primarily engaged in the careof the sick, the aged, or the mentally ill or de-fective who reside on the premises of such in-stitution, a school for mentally or physicallyhandicapped or gifted children, a preschool, el-ementary or secondary school, or an institutionof higher education (regardless of whether ornot such hospital, institution, or school is pub-lic or private or operated for profit or not forprofit); or

(C) is an activity of a public agency.

(2) Any establishment that has as its only regu-lar employees the owner thereof or the parent,spouse, child, or other member of the immediatefamily of such owner shall not be considered to bean enterprise engaged in commerce or in the pro-duction of goods for commerce or a part of such anenterprise. The sales of such an establishment shallnot be included for the purpose of determining theannual gross volume of sales of any enterprise forthe purpose of this subsection.(t) “Tipped employee” means any employee engaged

in an occupation in which he customarily and regularlyreceives more than $30 a month in tips.16

(u) “Man-day” means any day during which an em-ployee performs any agricultural labor for not less thanone hour.

(v) “Elementary school” means a day or residentialschool which provides elementary education, as deter-mined under State law.

(w) “Secondary school” means a day or residentialschool which provides secondary education, as determinedunder State law.

(x) “Public agency” means the Government of theUnited States; the government of a State or political sub-division thereof; any agency of the United States (in-cluding the United States Postal Service and Postal RateCommission), a State, or a political subdivision of aState, or any interstate governmental agency.

(y)17 “Employee in fire protection activities” meansan employee, including a firefighter, paramedic,emergency medical technician, rescue worker, am-bulance personnel, or hazardous materials worker,who —

(1) is trained in fire suppression, has the le-gal authority and responsibility to engage in fire

(B) that it will join with other such estab-lishments in the same industry for the purposeof collective purchasing, or

(C) that it will have the exclusive right tosell the goods or use the brand name of a manu-facturer, distributor, or advertiser within a speci-fied area, or by reason of the fact that it occupiespremises leased to it by a person who also leasespremises to other retail or service establishments.

(2) For purposes of paragraph (1), the activitiesperformed by any person or persons —

(A) in connection with the operation of a hos-pital, an institution primarily engaged in the careof the sick, the aged, the mentally ill or defective whoreside on the premises of such institution, a schoolfor mentally or physically handicapped or giftedchildren, a preschool,14 elementary or secondaryschool, or an institution of higher education (regard-less of whether or not such hospital, institution, orschool is operated for profit or not for profit), or

(B) in connection with the operation of astreet, suburban or interurban electric railway, orlocal trolley or motorbus carrier, if the rates andservices of such railway or carrier are subject toregulation by a state or local agency (regardless ofwhether or not such railway or carrier is public orprivate or operated for profit or not for profit), or

(C) in connection with the activities of apublic agency, shall be deemed to be activities per-formed for a business purpose.

(s) (1) “Enterprise engaged in commerce or in theproduction of goods for commerce” means an en-terprise that —

(A) (i) has employees engaged in com-merce or in the production of goods forcommerce, or that has employees handling,selling, or otherwise working on goods ormaterials that have been moved in or pro-duced for commerce by any person; and

(ii) is an enterprise whose annualgross volume of sales made or businessdone is not less than $500,000 (exclusiveof excise taxes at the retail level that areseparately stated);15

Prior to April 1, 1990, the dollar volume test for enterprise coverage (except in the caseof an enterprise comprised exclusively of one or more retail or service establish-ments; or one engaged in construction or reconstruction; or one engaged in laun-dering, cleaning, or repairing clothing or fabrics; or one described in section 3(s)(1)(B)or (C)) was $250,000. For retail enterprises, the dollar volume test was $362,500.There was no dollar volume test for the other enterprises.

suppression, and is employed by a fire departmentof a municipality, county, fire district, or State; and

(2) is engaged in the prevention, control, andextinguishment of fires or response to emergencysituations where life, property, or the environmentis at risk.

Administration18

SEC. 4. (a) There is created in the Department ofLabor a Wage and Hour Division which shall be under thedirection of an Administrator, to be known as the Admin-istrator of the Wage and Hour Division (in this Act referredto as the “Administrator”). The Administrator shall beappointed by the President, by and with the advice andconsent of the Senate.19

The Sec-retary of Labor may from time to time make such pro-visions as he shall deem appropriate authorizing theperformance by any other officer, or by any agency oremployee, of the Department of Labor of any functionof the Secretary, including any function transferred tothe Secretary by the provisions of this reorganizationplan.”

(b) The Secretary of Labor20 may, subject to the civilservice laws, appoint such employees as he deems neces-sary to carry out his functions and duties under this Actand shall fix their compensation in accordance with Chap-ter 51 and Subchapter III of Chapter 53 of Title 5.21

The Secretary22 may establish and utilize such regional,local, or other agencies, and utilize such voluntary anduncompensated services, as may from time to time beneeded. Attorneys appointed under this section mayappear for and represent the Secretary23 in any litigation,but all such litigation shall be subject to the directionand control of the Attorney General. In the appointment,

selection, classification, and promotion of officers andemployees of the Secretary,24 no political test or qualifica-tion shall be permitted or given consideration, but allsuch appointments and promotions shall be given andmade on the basis of merit and efficiency.

(c) The principal office of the Secretary shall be in theDistrict of Columbia, but he or his duly authorized repre-sentative may exercise any or all of his powers in any place.

(d) 25 The Secretary shall conduct studies on thejustification or lack thereof for each of the special ex-emptions set forth in section 13 of this Act, and theextent to which such exemptions apply to employeesof establishments described in subsection (g) of suchsection and the economic effects of the application ofsuch exemptions to such employees. The Secretaryshall submit a report of his findings and recom-mendations to the Congress with respect to the stud-ies conducted under this paragraph not later thanJanuary 1, 1976.

(e) Whenever the Secretary has reason to believe thatin any industry under this Act the competition of for-eign producers in United States markets or in marketsabroad, or both, has resulted, or is likely to result, inincreased unemployment in the United States, he shallundertake an investigation to gain full information withrespect to the matter. If he determines such increasedunemployment has in fact resulted, or is in fact likelyto result, from such competition, he shall make a fulland complete report of his findings and determinationsto the President and to the Congress: Provided, Thathe may also include in such report information on theincreased employment resulting from additional exportsin any industry under this Act as he may determine tobe pertinent to such report.

(f) The Secretary is authorized to enter into an agree-ment with the Librarian of Congress with respect toindividuals employed in the Library of Congress toprovide for the carrying out of the Secretary’s functionsunder this Act with respect to such individuals. Not-withstanding any other provision of this Act, or any

other law, the Director of the Office of PersonnelManagement26 is authorized to administer the pro-visions of this Act with respect to any individual em-ployed by the United States (other than an individualemployed in the Library of Congress, United StatesPostal Service, Postal Rate Commission, or the TennesseeValley Authority). Nothing in this subsection shall beconstrued to affect the right of an employee to bring anaction for unpaid minimum wages, or unpaid overtimecompensation, and liquidated damages under section16(b) of this Act.

Special Industry Committees forAmerican Samoa

SEC. 5.27 (a) The Secretary of Labor shall as soon aspracticable appoint a special industry committee to recom-mend the minimum rate or rates of wages to be paid undersection 6 to employees in American Samoa 28 engaged incommerce or in the production of goods for commerce oremployed in any enterprise engaged in commerce or inthe production of goods for commerce, or the Secretarymay appoint separate industry committees to recommendthe minimum rate or rates of wages to be paid under sec-tion 6 to employees therein engaged in commerce or in theproduction of goods for commerce or employed in any en-terprise engaged in commerce or in the production ofgoods for commerce in particular industries. An industrycommittee appointed under this subsection shall be com-posed of residents of American Samoa where the employ-ees with respect to whom such committee was appointedare employed and residents of the United States outside ofAmerican Samoa. In determining the minimum rate orrates of wages to be paid, and in determining classifica-tions, such industry committees29 shall be subject to theprovisions of section 8.

(b) An industry committee shall be appointed by theSecretary without any regard to any other provisions oflaw regarding the appointment and compensation of em-ployees of the United States. It shall include a number ofdisinterested persons representing the public, one of whom

the Secretary shall designate as chairman, a like numberof persons representing employees in the industry, and alike number representing employers in the industry. Inthe appointment of the persons representing each group, theSecretary shall give due regard to the geographicalregions in which the industry is carried on.

(c) Two-thirds of the members of an industry commit-tee shall constitute a quorum, and the decision of the com-mittee shall require a vote of not less than a majority of allits members. Members of an industry committee shall re-ceive as compensation for their services a reasonable perdiem, which the Secretary shall by rules and regulationsprescribe, for each day actually spent in the work of thecommittee, and shall in addition be reimbursed for theirnecessary traveling and other expenses. The Secretaryshall furnish the committee with adequate legal, steno-graphic, clerical, and other assistance, and shall by rulesand regulations prescribe the procedure to be followed bythe committee.

(d) The Secretary shall submit to an industry commit-tee from time to time such data as he may have availableon the matters referred to it, and shall cause to be broughtbefore it in connection with such matters any witnesseswhom he deems material. An industry committee may sum-mon other witnesses or call upon the Secretary to furnishadditional information to aid it in its deliberations.

Minimum Wages

SEC. 6. (a) Every employer shall pay to each of hisemployees who in any workweek is engaged in commerceor in the production of goods for commerce, or is employedin an enterprise engaged in commerce or in the produc-tion of goods for commerce, wages at the following rates:

(1) except as otherwise provided in this section,not less than $4.25 an hour during the period endingon September 30, 1996, not less than $4.75 an hourduring the year beginning on October 1, 1996, andnot less than $5.15 an hour beginning September 1,1997; 30

(2) if such employee is a home worker in PuertoRico or the Virgin Islands, not less than the minimumpiece rate prescribed by regulation or order; or, if no suchminimum piece rate is in effect, any piece rate adoptedby such employer which shall yield, to the proportion orclass of employees prescribed by regulation or order, notless than the applicable minimum hourly wage rate. Suchminimum piece rates or employer piece rates shall becommensurate with, and shall be paid in lieu of, the mini-

mum hourly wage rate applicable under the provisionsof this section. The Secretary of Labor, or his autho-rized representative, shall have power to make such regu-lations or orders as are necessary or appropriate to carryout any of the provisions of this paragraph, including thepower without limiting the generality of the foregoing,to define any operation or occupation which is performedby such home work employees in Puerto Rico or the Vir-gin Islands; to establish minimum piece rates for any op-eration or occupation so defined; to prescribe the methodand procedure for ascertaining and promulgating mini-mum piece rates; to prescribe standards for employerpiece rates, including the proportion or class of employ-ees who shall receive not less than the minimum hourlywage rate; to define the term “home worker”; and to pre-scribe the conditions under which employers, agents,contractors, and subcontractors shall cause goods to beproduced by home workers;31

(3) if such employee is employed in AmericanSamoa, in lieu of the rate or rates provided by thissubsection or subsection (b), not less than the appli-cable rate established by the Secretary of Labor inaccordance with recommendations of a special indus-try committee or committees which he shall appointpursuant to sections 5 and 8. The minimum wagerate thus established shall not exceed the rate prescribedin paragraph (1) of this subsection; 32

(4) if such employee is employed as a seaman onan American vessel, not less than the rate which willprovide to the employee, for the period covered by thewage payment, wages equal to compensation at thehourly rate prescribed by paragraph (1) of this subsec-tion for all hours during such period when he was actu-ally on duty (including periods aboard ship when theemployee was on watch or was, at the direction of a su-perior officer, performing work or standing by, but notincluding off-duty periods which are provided pursu-ant to the employment agreement); or

(5) if such employee is employed in agriculture,not less than the minimum wage rate in effect underparagraph (1) after December 31, 1977.

(b) Every employer shall pay to each of his employees(other than an employee to whom subsection (a) (5) ap-plies) who in any workweek is engaged in commerce orin the production of goods for commerce, or is employedin an enterprise engaged in commerce or in the produc-tion of goods for commerce, and who in such workweek is

brought within the purview of this section by the amend-ments made to this Act by the Fair Labor StandardsAmendments of 1966, title IX of the Education Amend-ments of 1972, or the Fair Labor Standards Amendmentsof 1974, wages at the following rate: Effective afterDecember 31, 1977, not less than the minimum wagerate in effect under subsection (a)(1).

(c) * * * (Repealed)[Note: Section 6(c), relating to minimum wage

requirements in Puerto Rico, was phased out by sec-tion 4(b)(2) of the Fair Labor Standards Amendments of1989 (103 Stat. 940), which raised the minimum wagerate for all covered employers in Puerto Rico up to therate prescribed by section 6(a)(1), effective no later thanApril 1, 1996, and was stricken by the Minimum WageIncrease Act of 1996 (Section 2104(c) of the Small Busi-ness Job Protection Act of 1996).]

(d)33(1) No employer having employees subject to anyprovisions of this section shall discriminate, withinany establishment in which such employees are em-ployed, between employees on the basis of sex bypaying wages to employees in such establishment ata rate less than the rate at which he pays wages toemployees of the opposite sex in such establishmentfor equal work on jobs the performance of whichrequires equal skill, effort, and responsibility, andwhich are performed under similar working condi-tions, except where such payment is made pursuantto (i) a seniority system; (ii) a merit system; (iii) asystem which measures earnings by quantity or qual-ity of production; or (iv) a differential based on anyother factor other than sex: Provided, That an em-ployer who is paying a wage rate differential in viola-tion of this subsection shall not, in order to complywith the provisions of this subsection, reduce the wagerate of any employee.

(2) No labor organization, or its agents, repre-senting employees of an employer having employeessubject to any provisions of this section shall causeor attempt to cause such an employer to discriminateagainst an employee in violation of paragraph (1) ofthis subsection.

(3) For purposes of administration and enforce-ment, any amounts owing to any employee which havebeen withheld in violation of this subsection shall bedeemed to be unpaid minimum wages or unpaid over-time compensation under this Act.

(4) As used in this subsection, the term “labororganization” means any organization of any kind,or any agency or employee representation committeeor plan, in which employees participate and whichexists for the purpose, in whole or in part, of dealingwith employers concerning grievances, labor disputes,wages, rates of pay, hours of employment, or condi-tions of work.

(e) (1) Notwithstanding the provisions of section 13of this Act (except subsections (a)(1) and (f) thereof),every employer providing any contract services (otherthan linen supply services) under a contract with theUnited States or any subcontract thereunder shall payto each of his employees whose rate of pay is not gov-erned by the Service Contract Act of 1965 (41 U.S.C.351–357) or to whom subsection (a)(1) of this section isnot applicable, wages at rates not less than the rates pro-vided for in subsection (b) of this section.

(2) Notwithstanding the provisions of section 13of this Act (except subsections (a)(1) and (f) thereof) andthe provisions of the Service Contract Act of 1965, everyemployer in an establishment providing linen supplyservices to the United States under a contract with theUnited States or any subcontract thereunder shall payto each of his employees in such establishment wages atrates not less than those prescribed in subsection (b),except that if more than 50 per centum of the gross an-nual dollar volume of sales made or business done bysuch establishment is derived from providing such linensupply services under any such contracts or subcon-tracts, such employer shall pay to each of his employeesin such establishment wages at rates not less than thoseprescribed in subsection (a)(1) of this section.

(f) Any employee —(1) who in any workweek is employed in domes-

tic service in a household shall be paid wages at a ratenot less than the wage rate in effect under section 6(b)unless such employee’s compensation for such servicewould not because of section 209(a)(6) of the Social Secu-rity Act constitute wages for the purposes of title II ofsuch Act, or

(2) who in any workweek —(A) is employed in domestic service in one

or more households, and(B) is so employed for more than 8 hours in

the aggregate,shall be paid wages for such employment in such work-week at a rate not less than the wage rate in effectunder section 6(b).

(g)34 (1) In lieu of the rate prescribed by subsection(a)(1), any employer may pay any employee of suchemployer, during the first 90 consecutive calendar daysafter such employee is initially employed by such em-ployer, a wage which is not less than $4.25 an hour.

(2) No employer may take any action to displaceemployees (including partial displacements such as re-duction in hours, wages, or employment benefits) forpurposes of hiring individuals at the wage authorizedin paragraph (1).

(3) Any employer who violates this subsectionshall be considered to have violated section 15(a)(3).

(4) This subsection shall only apply to an em-ployee who has not attained the age of 20 years.

Maximum Hours

SEC. 7.35* (a) (1) Except as otherwise provided in thissection, no employer shall employ any of his employees whoin any workweek is engaged in commerce or in the pro-duction of goods for commerce, or is employed in an enter-prise engaged in commerce or in the production of goodsfor commerce, for a workweek longer than forty hours un-less such employee receives compensation for his employ-ment in excess of the hours above specified at a rate notless than one and one-half times the regular rate at whichhe is employed.

(2) No employer shall employ any of his employ-ees who in any workweek is engaged in commerce or inthe production of goods for commerce, or is employed inan enterprise engaged in commerce or in the produc-tion of goods for commerce, and who in such workweeksis brought within the purview of this subsection by theamendments made to this Act by the Fair Labor Stan-dards Amendments of 1966 —

(A) for a workweek longer than forty-four hoursduring the first year from the effective dateof the Fair Labor Standards Amendments of 1966,

(B) for a workweek longer than forty-two hoursduring the second year from such date, or

(C) for a workweek longer than forty hoursafter the expiration of the second year from suchdate,

unless such employee receives compensation for hisemployment in excess of the hours above specified at arate not less than one and one-half times the regularrate at which he is employed.

(b) No employer shall be deemed to have violated sub-section (a) by employing any employee for a workweek inexcess of that specified in such subsection without payingthe compensation for overtime employment prescribedtherein if such employee is so employed —

*(1) in pursuance of an agreement, made as a resultof collective bargaining by representatives of employeescertified as bona fide by the National Labor RelationsBoard, which provides that no employee shall be em-ployed more than one thousand and forty hours duringany period of twenty-six consecutive weeks, or

*(2) in pursuance of an agreement, made as a resultof collective bargaining by representatives of employeescertified as bona fide by the National Labor RelationsBoard which provides that during a specified period offifty-two consecutive weeks the employee shall be em-ployed not more than two thousand two hundred and fortyhours and shall be guaranteed not less than one thou-sand eight hundred and forty hours (or not less than forty-six weeks at the normal number of hours worked perweek, but not less than thirty hours per week) and notmore than two thousand and eighty hours of employmentfor which he shall receive compensation for all hours guar-anteed or worked at rates not less than those applicableunder the agreement to the work performed and for allhours in excess of the guaranty which are also in excessof the maximum workweek applicable to such em-ployee under subsection (a) or two thousand and eightyin such period at rates not less than one and one-half timesthe regular rate at which he is employed; or

(3)36 by an independently owned and controlled lo-cal enterprise (including an enterprise with more thanone bulk storage establishment) engaged in the whole-sale or bulk distribution of petroleum products if —

(A) the annual gross volume of sales of suchenterprise is less than $1,000,000 exclusive of ex-cise taxes,

(B) more than 75 per centum of such enter-prise’s annual dollar volume of sales is made withinthe State in which such enterprise is located, and

(C) not more than 25 per centum of the an-nual dollar volume of sales of such enterprise is to

customers who are engaged in the bulk distributionof such products for resale,

and such employee receives compensation for employ-ment in excess of forty hours in any workweek at a ratenot less than one and one-half times the minimum wagerate applicable to him under section 6,and if such employee receives compensation for employ-ment in excess of twelve hours in any workday, or foremployment in excess of fifty-six hours in any workweek,as the case may be, at a rate not less than one and one-half times the regular rate at which he is employed.

(c) * * * (Repealed)[Note: Section 7(c) (relating to employers employing

employees in an industry found by the Secretary to beof a seasonal nature) was repealed by Section 19 of theFair Labor Standards Amendments of 1974, effectiveDecember 31, 1976.]

(d) * * * (Repealed)[Note: Section 7(d) (relating to employers who do not

qualify for the exemption in subsection (c) who employemployees in an industry found by the Secretary “(A) tobe characterized by marked annual recurring peaks ofoperation * * *, or (B) to be of a seasonal nature andengaged in the handling, packing, storing, preparing,first processing, or canning of any perishable agricul-tural or horticultural commodities in their raw or natu-ral state * * *”) was repealed by Section 19 of the FairLabor Standards Amendments of 1974, effective Decem-ber 31, 1976.]

**(e) As used in this section the “regular rate” at whichan employee is employed shall be deemed to include all re-muneration for employment paid to, or on behalf of, theemployee, but shall not be deemed to include —

**(1) sums paid as gifts; payments in the nature ofgifts made at Christmas time or on other special occa-sions, as a reward for service, the amounts of which are notmeasured by or dependent on hours worked, produc-tion, or efficiency;

**(2) payments made for occasional periods whenno work is performed due to vacation, holiday, illness,failure of the employer to provide sufficient work, or othersimilar cause; reasonable payments for traveling ex-penses, or other expenses, incurred by an employee inthe furtherance of his employer’s interests and properlyreimbursable by the employer; and other similar pay-ments to an employee which are not made as compen-sation for his hours of employment;

**(3) sums paid in recognition of services performedduring a given period if either, (a) both the fact that pay-ment is to be made and the amount of the payment aredetermined at the sole discretion of the employer at or

near the end of the period and not pursuant to any priorcontract, agreement, or promise causing the employeeto expect such payments regularly; or (b) the paymentsare made pursuant to a bona fide profit-sharing plan ortrust or bona fide thrift or savings plan, meeting the re-quirements of the Secretary of Labor set forth in ap-propriate regulations which he shall issue, having dueregard among other relevant factors, to the extent towhich the amounts paid to the employee are determinedwithout regard to hours of work, production, or efficiency;or (c) the payments are talent fees (as such talent feesare defined and delimited by regulations of the Secre-tary) paid to performers, including announcers, on ra-dio and television programs;

**(4) contributions irrevocably made by an em-ployer to a trustee or third person pursuant to a bonafide plan for providing old-age, retirement, life, accident,or health insurance or similar benefits for employees;

**(5) extra compensation provided by a premiumrate paid for certain hours worked by the employee inany day or workweek because such hours are hoursworked in excess of eight in a day or in excess of themaximum workweek applicable to such employee un-der subsection (a) or in excess of the employee’s normalworking hours or regular working hours, as the casemay be;

*(6) extra compensation provided by a premiumrate paid for work by the employee on Saturdays, Sun-days, holidays, or regular days of rest, or on the sixth orseventh day of the workweek, where such premium rateis not less than one and one-half time the rate establishedin good faith for like work performed in nonovertimehours on other days;37

*(7) extra compensation provided by a premiumrate paid to the employee, in pursuance of an applicableemployment contract or collective-bargaining agreement,for work outside of the hours established in good faith bythe contract or agreement as the basic, normal, or regu-lar workday (not exceeding eight hours) or workweek(not exceeding the maximum workweek applicable tosuch employee under subsection (a) of this section),where such premium rate is not less than one and one-halftimes the rate established in good faith by the contract oragreement for like work performed during such workdayor workweek;38 or

(8)39any value or income derived fromemployer-provided grants or rights provided pur-

suant to a stock option, stock appreciation right,or bona fide employee stock purchase programwhich is not otherwise excludable under any ofparagraphs (1) through (7) if —

(A) grants are made pursuant to a pro-gram, the terms and conditions of which arecommunicated to participating employeeseither at the beginning of the employee’s par-ticipation in the program or at the time of thegrant;

(B) in the case of stock options and stockappreciation rights, the grant or right cannotbe exercisable for a period of at least 6 monthsafter the time of grant (except that grants orrights may become exercisable because of anemployee’s death, disability, retirement, or achange in corporate ownership, or other cir-cumstances permitted by regulation), and theexercise price is at least 85 percent of the fairmarket value of the stock at the time of grant;

(C) exercise of any grant or right is vol-untary; and

(D) any determinations regarding theaward of, and the amount of, employer-provided grants or rights that are based onperformance are —

(i) made based upon meeting pre-viously established performance criteria(which may include hours of work, effi-ciency, or productivity) of any businessunit consisting of at least 10 employeesor of a facility, except that, any deter-minations may be based on length ofservice or minimum schedule of hoursor days of work; or

(ii) made based upon the past per-formance (which may include any criter-ia) of one or more employees in a givenperiod so long as the determination is inthe sole discretion of the employer andnot pursuant to any prior contract.

**(f) No employer shall be deemed to have violated sub-section (a) by employing any employee for a workweek inexcess of the maximum workweek applicable to suchemployee under subsection (a) if such employee is em-ployed pursuant to a bona fide individual contract, or pur-suant to an agreement made as a result of collective bar-gaining by representatives of employees, if the duties ofsuch employee necessitate irregular hours of work, and thecontract or agreement (1) specifies a regular rate of pay ofnot less than the minimum hourly rate provided in subsec-tion (a) or (b) of section 6 (whichever may be applicable)and compensation at not less than one and one-half times

such rate for all hours worked in excess of such maximumworkweek, and (2) provides a weekly guaranty of pay fornot more than sixty hours based on the rates so specified.

**(g) No employer shall be deemed to have violated sub-section (a) by employing any employee for a workweek inexcess of the maximum workweek applicable to suchemployee under such subsection if, pursuant to an agree-ment or understanding arrived at between the employerand the employee before performance of the work, theamount paid to the employee for the number of hoursworked by him in such workweek in excess of the maxi-mum workweek applicable to such employee under suchsubsection —

(1) in the case of an employee employed at piecerates, is computed at piece rates not less than one andone-half times the bona fide piece rates applicable to thesame work when performed during nonovertime hours;or

(2) in the case of an employee performing two ormore kinds of work for which different hourly or piecerates have been established, is computed at rates not lessthan one and one-half times such bona fide rates appli-cable to the same work when performed during nonover-time hours; or

(3) is computed at a rate not less than one and one-half times the rate established by such agreement orunderstanding as the basic rate to be used in computingovertime compensation thereunder: Provided, That therate so established shall be authorized by regulation bythe Secretary of Labor as being substantially equiva-lent to the average hourly earnings of the employee, ex-clusive of overtime premiums, in the particular work overa representative period of time;

and if (i) the employee’s average hourly earnings for theworkweek exclusive of payments described in paragraphs(1) through (7) of subsection (e) are not less than the mini-mum hourly rate required by applicable law, and (ii) extraovertime compensation is properly computed and paid onother forms of additional pay required to be included incomputing the regular rate. * (h) (1)40Except as provided in paragraph (2),

sums excluded from the regular rate pursuant tosubsection (e) shall not be creditable toward wagesrequired under section 6 or overtime compensa-tion required under this section.

(2) Extra compensation paid as described in para-graphs (5), (6), and (7) of subsection (e) shall be credit-able toward overtime compensation payable pursuantto this section.41

(i) No employer shall be deemed to have violated sub-section (a) by employing any employee of a retail or ser-vice establishment for a workweek in excess of the ap-plicable workweek specified therein, if (1) the regularrate of pay of such employee is in excess of one and one-half times the minimum hourly rate applicable to himunder section 6, and (2) more than half his compensa-tion for a representative period (not less than onemonth) represents commissions on goods or services.In determining the proportion of compensation represent-ing commission, all earnings resulting from the applica-tion of a bona fide commission rate shall be deemed com-missions on goods or services without regard to whetherthe computed commissions exceed the draw or guarantee.

(j) No employer engaged in the operation of a hospitalor an establishment which is an institution primarilyengaged in the care of the sick, the aged, or the mentallyill or defective who reside on the premises shall be deemedto have violated subsection (a) if, pursuant to an agree-ment or understanding arrived at between the employerand employee before performance of the work, a work pe-riod of fourteen consecutive days is accepted in lieu of theworkweek of seven consecutive days for purposes of over-time computation and if, for his employment in excess ofeight hours in any workday and in excess of eighty hoursin such fourteen-day period, the employee receives com-pensation at a rate not less than one and one-half timesthe regular rate at which he is employed.

(k)42 No public agency shall be deemed to have violatedsubsection (a) with respect to the employment of anyemployee in fire protection activities or any employeein law enforcement activities (including security per-sonnel in correctional institutions) if —

(1) in a work period of 28 consecutive days theemployee receives for tours of duty which in the ag-gregate exceed the lesser of (A) 216 hours, or (B) theaverage number of hours (as determined by the Secre-tary pursuant to Section 6(c)(3) of the Fair Labor Stan-dards Amendments of 1974)43 in tours of duty of em-ployees engaged in such activities in work periods of28 consecutive days in calendar year 1975; or

(n) In the case of an employee of an employer engagedin the business of operating a street, suburban or in-terurban electric railway, or local trolley or motorbuscarrier (regardless of whether or not such railway or car-rier is public or private or operated for profit or not forprofit), in determining the hours of employment of suchan employee to which the rate prescribed by subsection(a) applies there shall be excluded the hours such em-ployee was employed in charter activities by such em-ployer if (1) the employee’s employment in such activi-ties was pursuant to an agreement or understandingwith his employer arrived at before engaging in suchemployment, and (2) if employment in such activities isnot part of such employee’s regular employment.

(o)44 (1) Employees of a public agency which is aState, a political subdivision of a State, or an inter-state governmental agency may receive, in accor-dance with this subsection and in lieu of overtimecompensation, compensatory time off at a rate notless than one and one-half hours for each hour ofemployment for which overtime compensation isrequired by this section.

(2) A public agency may provide compensa-tory time under paragraph (1) only —

(A) pursuant to —(i) applicable provisions of a collec-

tive bargaining agreement, memorandumof understanding, or any other agreementbetween the public agency and represen-tatives of such employees; or

(ii) in the case of employees notcovered by subclause (i), an agreement orunderstanding arrived at between the em-ployer and employee before the perfor-mance of the work; and(B) if the employee has not accrued com-

pensatory time in excess of the limit applicableto the employee prescribed by paragraph (3).

In the case of employees described inclause (A)(ii) hired prior to April 15, 1986, theregular practice in effect on April 15, 1986, withrespect to compensatory time off for such em-ployees in lieu of the receipt of overtime com-pensation, shall constitute an agreement orunderstanding under such clause (A)(ii). Ex-cept as provided in the previous sentence, theprovision of compensatory time off to such em-ployees for hours worked after April 14, 1986,shall be in accordance with this subsection.

(2) in the case of such an employee to whom awork period of at least 7 but less than 28 days applies,in his work period the employee receives for tours ofduty which in the aggregate exceed a number of hourswhich bears the same ratio to the number of consecu-tive days in his work period as 216 hours (or if lower,the number of hours referred to in clause (B) of para-graph (1)) bears to 28 days,

compensation at a rate not less than one and one-halftimes the regular rate at which he is employed.

(l) No employer shall employ any employee in domes-tic service in one or more households for a workweeklonger than forty hours unless such employee receivescompensation for such employment in accordance withsubsection (a).

(m) For a period or periods of not more than fourteenworkweeks in the aggregate in any calendar year, anyemployer may employ any employee for a workweek inexcess of that specified in subsection (a) without pay-ing the compensation for overtime employment pre-scribed in such subsection, if such employee —

(1) is employed by such employer —(A) to provide services (including stripping

and grading) necessary and incidental to the saleat auction of green leaf tobacco of type 11, 12, 13,14, 21, 22, 23, 24, 31, 35, 36, or 37 (as such types aredefined by the Secretary of Agriculture), or in auc-tion sale, buying, handling, stemming, redrying,packing, and storing of such tobacco.

(B) in auction sale, buying, handling, sort-ing, grading, packing, or storing green leaf tobaccoof type 32 (as such type is defined by the Secre-tary of Agriculture), or

(C) in auction sale, buying, handling, strip-ping, sorting, grading, sizing, packing, or stem-ming prior to packing, of perishable cigar leaf to-bacco of type 41, 42, 43, 44, 45, 46, 51, 52, 53, 54, 55,61, or 62 (as such types are defined by the Secre-tary of Agriculture); and(2) receives for —

(A) such employment by such employerwhich is in excess of ten hours in any workday,and

(B) such employment by such employerwhich is in excess of forty-eight hours in anyworkweek,

compensation at a rate not less than one and one-halftimes the regular rate at which he is employed.

An employer who receives an exemption under this sub-section shall not be eligible for any other exemptionunder this section.

(A) such employee is paid at a per-pagerate which is not less than —

(i) the maximum rate established byState law or local ordinance for the jurisdic-tion of such public agency,

(ii) the maximum rate otherwise es-tablished by a judicial or administrative of-ficer and in effect on July 1, 1995, or

(iii) the rate freely negotiated betweenthe employee and the party requesting thetranscript, other than the judge who pre-sided over the proceedings being transcribed,and

(B) the hours spent performing such dutiesare outside of the hours such employee performsother work (including hours for which the agencyrequires the employee’s attendance) pursuant tothe employment relationship with such publicagency.

For purposes of this section, the amount paid suchemployee in accordance with subparagraph (A) for theperformance of court reporting transcript preparationduties, shall not be considered in the calculation of theregular rate at which such employee is employed.

(7)46 For purposes of this subsection —

(A) the term “overtime compensation”means the compensation required by subsec-tion (a), and

(B) the terms “compensatory time” and“compensatory time off” mean hours duringwhich an employee is not working, which arenot counted as hours worked during the appli-cable workweek or other work period for pur-poses of overtime compensation, and for whichthe employee is compensated at the employee’sregular rate.

(p)47(1) If an individual who is employed by a State,political subdivision of a State, or an interstate gov-ernmental agency in fire protection or law enforce-ment activities (including activities of security per-sonnel in correctional institutions) and who, solelyat such individual’s option, agrees to be employedon a special detail by a separate or independent em-ployer in fire protection, law enforcement, or relatedactivities, the hours such individual was employed

Sec. 7(o)(3)

(3) (A) If the work of an employee for whichcompensatory time may be provided includedwork in a public safety activity, an emergencyresponse activity, or a seasonal activity, the em-ployee engaged in such work may accrue notmore than 480 hours of compensatory time forhours worked after April 15, 1986. If such workwas any other work, the employee engaged insuch work may accrue not more than 240 hoursof compensatory time for hours worked afterApril 15, 1986. Any such employee who, afterApril 15, 1986, has accrued 480 or 240 hours,as the case may be, of compensatory time offshall, for additional overtime hours of work, bepaid overtime compensation.

(B) If compensation is paid to an employeefor accrued compensatory time off, such com-pensation shall be paid at the regular rateearned by the employee at the time the em-ployee receives such payment.(4) An employee who has accrued compen-

satory time off authorized to be provided under para-graph (1) shall, upon termination of employment,be paid for the unused compensatory time at a rateof compensation not less than —

(A) the average regular rate received bysuch employee during the last 3 years of theemployee’s employment, or

(B) the final regular rate received by suchemployee,

whichever is higher.

(5) An employee of a public agency which is aState, political subdivision of a State, or an inter-state governmental agency —

(A) who has accrued compensatory timeoff authorized to be provided under paragraph(1), and

(B) who has requested the use of suchcompensatory time,

shall be permitted by the employee’s employer touse such time within a reasonable period after mak-ing the request if the use of the compensatory timedoes not unduly disrupt the operations of the publicagency.

(6)45 The hours an employee of a public agencyperforms court reporting transcript preparation dutiesshall not be considered as hours worked for the pur-poses of subsection (a) if —

(1) provided to employees who lack a highschool diploma or educational attainment at theeighth grade level;

(2) designed to provide reading and otherbasic skills at an eighth grade level or below; and

(3) does not include job specific training.

Wage Orders in American Samoa

SEC. 849 (a) The policy of this Act with respect to in-dustries or enterprises in American Samoa engaged incommerce or in the production of goods for commerce is toreach as rapidly as is economically feasible without sub-stantially curtailing employment the objective of the mini-mum wage rate which would apply in each such in-dustry under paragraph (1) or (5) of section 6(a) but forsection 6(c).

The Secretary of Labor shall from time to time con-vene an industry committee or committees, appointed pur-suant to section 5, and any such industry committee shallfrom time to time recommend the minimum rate or ratesof wages to be paid under section 6 by employers in Ameri-can Samoa engaged in commerce or in the production ofgoods for commerce or in any enterprise engaged in com-merce or in the production of goods for commerce inany such industry or classification therein, and who butfor section 6 (a)(3) would be subject to the minimumwage requirements of section 6 (a)(1). Minimum ratesof wages established in accordance with this section whichare not equal to the otherwise applicable minimum wagerate in effect under paragraph (1) or (5) of section 6(a)shall be reviewed by such a committee once during eachbiennial period, beginning with the biennial period com-mencing July 1, 1958, except that the Secretary,50 in hisdiscretion, may order an additional review during any suchbiennial period.51

(b) Upon the convening of any such industry commit-tee, the Secretary shall refer to it the question of the mini-mum wage rate or rates to be fixed for such industry. Theindustry committee shall investigate conditions in the in-dustry and the committee, or any authorized subcommit-tee thereof, shall after due notice hear such witnesses and

by such separate and independent employer shallbe excluded by the public agency employing suchindividual in the calculation of the hours for whichthe employee is entitled to overtime compensationunder this section if the public agency —

(A) requires that its employees engagedin fire protection, law enforcement, or securityactivities be hired by a separate and indepen-dent employer to perform the special detail,

(B) facilitates the employment of suchemployees by a separate and independentemployer, or

(C) otherwise affects the condition of em-ployment of such employees by a separate andindependent employer.

(2) If an employee of a public agency whichis a State, political subdivision of a State, or aninterstate governmental agency undertakes, on anoccasional or sporadic basis and solely at the em-ployee’s option, part-time employment for the pub-lic agency which is in a different capacity from anycapacity in which the employee is regularly em-ployed with the public agency, the hours suchemployee was employed in performing the differentemployment shall be excluded by the public agencyin the calculation of the hours for which the em-ployee is entitled to overtime compensation underthis section.

(3) If an individual who is employed in any ca-pacity by a public agency which is a State, politicalsubdivision of a State, or an interstate governmen-tal agency, agrees, with the approval of the publicagency and solely at the option of such individual,to substitute during scheduled work hours for an-other individual who is employed by such agencyin the same capacity, the hours such employeeworked as a substitute shall be excluded by the pub-lic agency in the calculation of the hours for whichthe employee is entitled to overtime compensationunder this section.

(q) 48 Any employer may employ any employee for aperiod or periods of not more than 10 hours in theaggregate in any workweek in excess of the maximumworkweek specified in subsection (a) without payingthe compensation for overtime employment pre-scribed in such subsection, if during such period orperiods the employee is receiving remedial educationthat is —

receive such evidence as may be necessary or appropriateto enable the committee to perform its duties and func-tions under this Act.52 The committee shall recommend tothe Secretary the highest minimum wage rates for theindustry which it determines, having due regard to eco-nomic and competitive conditions, will not substantiallycurtail employment in the industry, and will not give anyindustry in American Samoa a competitive advantage overany industry in the United States outside of American Sa-moa; except that the committee shall recommend to theSecretary the minimum wage rate prescribed in section6(a) or 6(b), which would be applicable but for section6(a)(3), unless there is evidence in the record which es-tablishes that the industry, or a predominant portionthereof, is unable to pay that wage due to such economicand competitive conditions.53

(c) The industry committee shall recommend such rea-sonable classifications within any industry as it determinesto be necessary for the purpose of fixing for each classifica-tion within such industry the highest minimum wage rate(not in excess of that in effect under paragraph (1) or (5)of section 6(a) (as the case may be)) which (1) will notsubstantially curtail employment in such classification and(2) will not give a competitive advantage to any group inthe industry, and shall recommend for each classificationin the industry the highest minimum wage rate which thecommittee determines will not substantially curtail employ-ment in such classification. In determining whether suchclassification should be made in any industry, in makingsuch classifications, and in determining the minimum wagerates for such classifications, no classifications shall bemade, and no minimum wage rate shall be fixed, solely on aregional basis, but the industry committee54 shall consideramong other relevant factors the following:

(1) competitive conditions as affected by transpor-tation, living, and production costs;

(2) the wages established for work of like or com-parable character by collective labor agreements negoti-ated between employers and employees by representativesof their own choosing; and

(3) the wages paid for work of like or comparablecharacter by employers who voluntarily maintain mini-mum wage standards in the industry.

No classification shall be made under this section on thebasis of age or sex.

(d) The industry committee shall file with the Secretarya report containing its findings of fact and recommenda-

tions with respect to the matters referred to it. Upon thefiling of such report, the Secretary shall publish such rec-ommendations in the Federal Register and shall provideby order that the recommendations contained in such re-port shall take effect upon the expiration of 15 days afterthe date of such publication.55

(e) Orders issued under this section shall define the in-dustries and classifications therein to which they are to ap-ply, and shall contain such terms and conditions as the Sec-retary finds necessary to carry out the purposes of suchorders, to prevent the circumvention or evasion thereof,and to safeguard the minimum wage rates establishedtherein.56

(f) Due notice of any hearing provided for in this sec-tion shall be given by publication in the Federal Registerand by such other means as the Secretary deems reason-ably calculated to give general notice to interested persons.

Attendance of Witnesses

SEC. 9. For the purpose of any hearing or investigationprovided for in this Act, the provisions of section 9 and 10(relating to the attendance of witnesses and the productionof books, papers and documents) of the Federal Trade Com-mission Act of September 16, 1914 as amended (U.S.C., 1934edition, title 15, sec. 49 and 50), are hereby made appli-cable to the jurisdiction, powers, and duties of the Secre-tary of Labor and the industry committees.

Court Review

SEC. 10.57 (a) Any person aggrieved by an order of theSecretary issued under section 8 may obtain a review ofsuch order in the United States Court of Appeals for anycircuit wherein such person resides or has his principal placeof business, or in the United States Court of Appeals forthe District of Columbia, by filing in such court, within 60days after the entry of such order a written petition pray-ing that the order of the Secretary be modified or set asidein whole or in part. A copy of such petition shall forthwithbe transmitted by the clerk of the court to the Secretary,and thereupon the Secretary shall file in the court the recordof the industry committee upon which the order complainedof was entered, as provided in section 2112 of title 28, UnitedStates Code. Upon the filing of such petition such courtshall have exclusive jurisdiction to affirm, modify (includingprovision for the payment of an appropriate mini-

mum wage rate), or set aside such order in whole or inpart, so far as it is applicable to the petitioner.58 The reviewby the court shall be limited to questions of law, and find-ings of fact by such industry committee when supportedby substantial evidence shall be conclusive. No objectionto the order of the Secretary shall be considered by thecourt unless such objection shall have been urged beforesuch industry committee or unless there were reasonablegrounds for failure so to do. If application is made to thecourt for leave to adduce additional evidence, and it is shownto the satisfaction of the court that such additional evidencemay materially affect the result of the proceeding and thatthere were reasonable grounds for failure to adduce suchevidence in the proceedings before such industry commit-tee, the court may order such additional evidence to betaken before an industry committee and to be adduced uponthe hearing in such manner and upon such terms and con-ditions as to the court may seem proper. Such industrycommittee may modify the initial findings by reason of theadditional evidence so taken, and shall file with the courtsuch modified or new findings which if supported by sub-stantial evidence shall be conclusive, and shall also file itsrecommendation, if any, for the modification or setting asideof the original order. The judgment and decree of the courtshall be final, subject to review by the Supreme Court ofthe United States upon certiorari or certification as pro-vided in section 1254 of title 28 of the United States Code.

(b) the commencement of proceedings under subsection(a) shall not, unless specifically ordered by the court, oper-ate as a stay of the Secretary’s order. The court shall notgrant any stay of the order unless the person complainingof such order shall file in court an undertaking with a suretyor sureties satisfactory to the court for the payment to theemployees affected by the order, in the event such order isaffirmed, of the amount by which the compensation suchemployees are entitled to receive under the order exceedsthe compensation they actually receive while such stay isin effect.

Investigations, Inspections, Records, andHomework Regulations

SEC. 11. (a) The Secretary of Labor or his designatedrepresentatives may investigate and gather data regardingthe wages, hours, and other conditions and practices of em-ployment in any industry subject to this Act, and may enterand inspect such places and such records (and make suchtranscriptions thereof), question such employees, and inves-tigate such facts, conditions, practices, or mattersas he may deem necessary or appropriate to determinewhether any person has violated any provision of this Act,

or which may aid in the enforcement of the provisions ofthis Act. Except as provided in section 12 and in subsec-tion (b) of this section, the Secretary shall utilize the bu-reaus and divisions of the Department of Labor for all theinvestigations and inspections necessary under this section.Except as provided in section 12, the Secretary shall bringall actions under section 17 to restrain violations of this Act.

(b) With the consent and cooperation of State agenciescharged with the administration of State labor laws, theSecretary of Labor may, for the purpose of carrying outhis functions and duties under this Act, utilize the servicesof State and local agencies and their employees and, not-withstanding any other provision of law, may reimbursesuch State and local agencies and their employees for ser-vices rendered for such purposes.

(c) Every employer subject to any provision of this Actor of any order issued under this Act shall make, keep, andpreserve such records of the persons employed by him andof the wages, hours, and other conditions and practices ofemployment maintained by him, and shall preserve suchrecords for such periods of time, and shall make such re-ports therefrom to the Secretary as he shall prescribe byregulation or order as necessary or appropriate for the en-forcement of the provisions of this Act or the regulationsor orders thereunder. The employer of an employeewho performs substitute work described in section7(p)(3) may not be required under this subsection tokeep a record of the hours of the substitute work.59

(d) The Secretary is authorized to make such regula-tions and orders regulating, restricting, or prohibiting in-dustrial homework as are necessary or appropriate toprevent the circumvention or evasion of and to safeguardthe minimum wage rate prescribed in this Act, and allexisting regulations or orders of the Administrator relat-ing to industrial homework are hereby continued in fullforce and effect.60

Child Labor Provisions

SEC. 12. (a) No producer, manufacturer, or dealer shallship or deliver for shipment in commerce any goods pro-duced in an establishment situated in the United States inor about which within thirty days prior to the removal ofsuch goods therefrom any oppressive child labor has beenemployed: Provided, That any such shipment or deliveryfor shipment of such goods by a purchaser who acquiredthem in good faith in reliance on written assurance fromthe producer, manufacturer, or dealer that the goods wereproduced in compliance with the requirements of this sec-

tion, and who acquired such goods for value without noticeof any such violation, shall not be deemed prohibited bythis subsection: And provided further, That a prosecu-tion and conviction of a defendant for the shipment ordelivery for shipment of any goods under the conditionsherein prohibited shall be a bar to any further prosecutionagainst the same defendant for shipments or deliveries forshipment of any such goods before the beginning of saidprosecution.61

(b) The Secretary of Labor, or any of his authorizedrepresentatives, shall make all investigations and inspec-tions under section 11(a) with respect to the employmentof minors, and, subject to the direction and control of theAttorney General, shall bring all actions under section 17to enjoin any act or practice which is unlawful by reasonof the existence of oppressive child labor, and shall admin-ister all other provisions of this Act relating to oppressivechild labor.

(c) No employer shall employ any oppressive child la-bor in commerce or in the production of goods for com-merce or in any enterprise engaged in commerce or inthe production of goods for commerce.62

(d) In order to carry out the objectives of this sec-tion, the Secretary may by regulation require employ-ers to obtain from any employee proof of age.

Exemptions

SEC. 13.63 (a) The provisions of sections 6 (except sec-tion 6(d) in the case of paragraph (1) of this subsection)64

and 7 shall not apply with respect to —(1) any employee employed in a bona fide execu-

tive, administrative, or professional capacity (includ-ing any employee employed in the capacity of academicadministrative personnel or teacher in elementary orsecondary schools), or in the capacity of outside sales-man (as such terms are defined and delimited fromtime to time by regulations of the Secretary, subjectto the provisions of Subchapter II of Chapter 5 ofTitle 5,65 except that an employee of a retail or serviceestablishment shall not be excluded from the defini-tion of employee employed in a bona fide executiveor administrative capacity because of the number ofhours in his workweek which he devotes to activities

not directly or closely related to the performanceof executive or administrative activities, if less than40 per centum of his hours worked in the workweekare devoted to such activities); or

(2) * * * (Repealed)[Note: Section 13(a)(2) (relating to employees em-ployed by certain retail or service establishments)was repealed, effective April 1, 1990, by section 3(c)(1)of the Fair Labor Standards Amendments of 1989.]

(3) any employee employed by an establishmentwhich is an amusement or recreational establishment,organized camp, or religious or non-profit educationalconference center,66 if (A) it does not operate for morethan seven months in any calendar year, or (B) duringthe preceding calendar year, its average receipts for anysix months of such year were not more than 33 1/3 percentum of its average receipts for the other six monthsof such year, except that the exemption from sections 6and 7 provided by this paragraph does not apply withrespect to any employee of a private entity engaged inproviding services or facilities (other than, in the caseof the exemption from section 6, a private entity engagedin providing services and facilities directly related to ski-ing) in a national park or a national forest or on land inthe National Wildlife Refuge System, under a contractwith the Secretary of the Interior or the Secretary ofAgriculture;67 or

(4) * * * (Repealed)[Note: Section 13(a)(4) (relating to employees em-ployed by certain retail establishments) was re-pealed, effective April 1, 1990, by section 3(c)(1) ofthe Fair Labor Standards Amendments of 1989.]

(5) any employee employed in the catching, tak-ing, propagating, harvesting, cultivating, or farmingof any kind of fish, shellfish, crustacea, sponges,seaweeds, or other aquatic forms of animal and veg-etable life, or in the first processing, canning or pack-ing such marine products at sea as an incident to,or in conjunction with, such fishing operations, includ-ing the going to and returning from work and load-ing and unloading when performed by any such em-ployee; or

(6) any employee employed in agriculture (A) ifsuch employee is employed by an employer who did not,during any calendar quarter during the preceding cal-endar year, use more than five hundred man-days ofagricultural labor, (B) if such employee is the parent,

(12) any employee employed as a seaman on avessel other than an American vessel; or

ging crews) was repealed by section 23 of the Fair La-bor Standards Amendments of 1974. The 1974 amend-ments created an exemption for such employees fromthe overtime provisions only in Section 13(b)(28).]

(15) any employee employed on a casual basis indomestic service employment to provide babysittingservices or any employee employed in domestic ser-vice employment to provide companionship servicesfor individuals who (because of age or infirmity) areunable to care for themselves (as such terms are de-fined and delimited by regulations of the Secretary);or

(16)70 a criminal investigator who is paid availa-bility pay under section 5545a of Title 5, United StatesCode; or

(17)71 any employee who is a computer systemsanalyst, computer programmer, software engineer, orother similarly skilled worker, whose primary duty is —

(A) the application of systems analysis tech-niques and procedures, including consulting withusers, to determine hardware, software, or systemfunctional specifications;

(B) the design, development, documenta-tion, analysis, creation, testing, or modification ofcomputer systems or programs, including proto-types, based on and related to user or systemdesign specifications;

(C) the design, documentation, testing, cre-ation, or modification of computer programs re-lated to machine operating systems; or

(D) a combination of duties described insub-paragraphs (A), (B), and (C) the performanceof which requires the same level of skills, and

spouse, child, or other member of his employer’s imme-diate family, (C) if such employee (i) is employed as ahand harvest laborer and is paid on a piece rate basis inan operation which has been, and is customarily andgenerally recognized as having been, paid on a piece ratebasis in the region of employment, (ii) commutes dailyfrom his permanent residence to the farm on which heis so employed, and (iii) has been employed in agricul-ture less than thirteen weeks during the preceding cal-endar year, (D) if such employee (other than an employeedescribed in clause (C) of this subsection) (i) is sixteenyears of age or under and is employed as a hand har-vest laborer, is paid on a piece rate basis in an operationwhich has been, and is customarily and generally rec-ognized as having been, paid on a piece rate basis in theregion of employment, (ii) is employed on the same farmas his parent or person standing in the place of his par-ent, and (iii) is paid at the same piece rate as employeesover age sixteen are paid on the same farm, or (E) ifsuch employee is principally engaged in the range pro-duction of livestock;68 or

(7) any employee to the extent that such em-ployee is exempted by regulations, order, or certificateof the Secretary issued under section 14; or

(8)69 any employee employed in connection withthe publication of any weekly, semi-weekly, or dailynewspaper with a circulation of less than four thou-sand the major part of which circulation is withinthe county where published or counties contiguousthereto; or

(9) * * * (Repealed)[Note: Section 13(a)(9) (relating to motion pic-

(10) any switchboard operator employed by an in-dependently owned public telephone company whichhas not more than seven hundred and fifty stations;or

who, in the case of an employee who is compensatedon an hourly basis, is compensated at a rate of notless than $27.63 an hour.

(b) The provisions of section 7 shall not apply withrespect to —

(1) any employee with respect to whom the Sec-retary of Transportation72 has power to establishqualifications and maximum hours of service pursuantto the provisions of section 31502 of Title 4973; or

(2) any employee of an employer engaged in theoperation of a rail carrier subject to part A of Sub-title IV of Title 49;74 or

(3) any employee of a carrier by air subject tothe provisions of title II of the Railway Labor Act; or

(4) * * * (Repealed)[Note: Section 13(b)(4) (relating to employees in

the canning, processing, marketing, freezing, curing,storing, packing for shipment, or distributing of anykind of fish, shellfish, or other aquatic forms of ani-mal or vegetable life, or any byproduct thereof) wasrepealed, effective May 1, 1976, by section 11 of the FairLabor Standards Amendments of 1974.]

(5) any individual employed as an outside buyerof poultry, eggs, cream, or milk, in their raw or natu-ral state; or

which has a total population in excess of one hundredthousand, or (B) in a city or town of twenty-five thou-sand population or less, which is part of such an areabut is at least 40 airline miles from the principal cityin such area; or

(10) (A) any salesman, partsman, or mechanicprimarily engaged in selling or servicing automo-biles, trucks, or farm implements, if he is employedby a nonmanufacturing establishment primarilyengaged in the business of selling such vehicles orimplements to ultimate purchasers; or

(B) any salesman primarily engaged in sell-ing trailers, boats, or aircraft, if he is employedby a nonmanufacturing establishment primarilyengaged in the business of selling trailers, boats,or aircraft to ultimate purchasers;77 or

(11) any employee employed as a driver or driver’shelper making local deliveries, who is compensatedfor such employment on the basis of trip rates, or otherdelivery payment plan, if the Secretary shall find thatsuch plan has the general purpose and effect of re-ducing hours worked by such employees to, or below,the maximum workweek applicable to them under sec-tion 7(a); or

(12) any employee employed in agriculture or inconnection with the operation or maintenance of ditches,canals, reservoirs, or waterways, not owned or operatedfor profit, or operated on a sharecrop basis, and which

are used exclusively for supply and storing of waterat least 90 percent of which was ultimately de-livered for agricultural purposes during the preced-ing calendar year;78 or

(13) any employee with respect to his employmentin agriculture by a farmer, notwithstanding other em-ployment of such employee in connection with livestockauction operations in which such farmer is engaged asan adjunct to the raising of livestock, either on his ownaccount or in conjunction with other farmers, if suchemployee (A) is primarily employed during his work-week in agriculture by such farmer, and (B) is paid forhis employment in connection with such livestock auc-tion operations at a wage rate not less than that pre-scribed by section 6(a)(1);79 or

(14) any employee employed within the area of pro-duction (as defined by the Secretary) by an establish-ment commonly recognized as a country elevator, in-cluding such an establishment which sells products andservices used in the operation of a farm, if no more thanfive employees are employed in the establishment in suchoperations;80 or

(15) any employee engaged in the processing ofmaple sap into sugar (other than refined sugar) orsyrup;81 or

(16) any employee engaged (A) in the transporta-tion and preparation for transportation of fruits andvegetables, whether or not performed by the farmer, fromthe farm to a place of first processing or first marketingwithin the same State, or (B) in transportation, whetheror not performed by the farmer, between the farm and anypoint within the same State of persons employed or to beemployed in the harvesting of fruits or vegetables;82 or

(17) any driver employed by an employer engaged inthe business of operating taxicabs;83 or

(29)92 any employee of an amusement or recre-ational establishment located in a national park or na-tional forest or on land in the National Wildlife RefugeSystem if such employee (A) is an employee of a pri-vate entity engaged in providing services or facilities ina national park or national forest, or on land in the Na-tional Wildlife Refuge System, under a contract with theSecretary of the Interior or the Secretary of Agriculture,and (B) receives compensation for employment in ex-cess of fifty-six hours in any workweek at a rate not lessthan one and one-half times the regular rate at whichhe is employed; or

(30)93 a criminal investigator who is paid availabil-ity pay under section 5545a of Title 5, United StatesCode.

(c) (1) Except as provided in paragraphs (2) or(4), the provisions of section 12 relating to child laborshall not apply to any employee employed in agricul-ture outside of school hours for the school district wheresuch employee is living while he is so employed, if suchemployee —

(A) is less than twelve years of age and (i)is employed by his parent, or by a person stand-ing in the place of his parent, on a farm owned oroperated by such parent or person, or (ii) is em-ployed, with the consent of his parent or personstanding in the place of his parent, on a farm, noneof the employees of which are (because of section13(a)(6)(A)) required to be paid at the wage rateprescribed by section 6(a)(5),

(B) is twelve years or thirteen years of ageand (i) such employment is with the consent ofhis parent or person standing in the place of his

parent, or (ii) his parent or such person is em-ployed on the same farm as such employee, or

(C) is fourteen years of age or older.

(2) The provisions of section 12 relating to childlabor shall apply to an employee below the age of sixteenemployed in agriculture in an occupation that the Sec-retary of Labor finds and declares to be particularly haz-ardous for the employment of children below the age ofsixteen, except where such employee is employed by hisparent or by a person standing in the place of his parenton a farm owned or operated by such parent or person.

(3) The provisions of section 12 relating to childlabor shall not apply to any child employed as an actoror performer in motion pictures or theatrical produc-tions, or in radio or television productions.

(4)94 (A) An employer or group of employers mayapply to the Secretary for a waiver of the applicationof section 12 to the employment for not more thaneight weeks in any calendar year of individuals whoare less than twelve years of age, but not less thanten years of age, as hand harvest laborers in anagricultural operation which has been, and is cus-tomarily and generally recognized as being, paidon a piece rate basis in the region in which suchindividuals would be employed. The Secretary maynot grant such a waiver unless he finds, based onobjective data submitted by the applicant, that —

(i) the crop to be harvested is one witha particularly short harvesting season and theapplication of section 12 would cause severeeconomic disruption in the industry of the em-ployer or group of employers applying for thewaiver;

(ii) the employment of the individuals towhom the waiver would apply would not be del-eterious to their health or well-being;

(iii) the level and type of pesticides andother chemicals used would not have an ad-verse effect on the health or well-being of theindividuals to whom the waiver would apply;

(iv) individuals age twelve and above arenot available for such employment; and

(v) the industry of such employer orgroup of employers has traditionally and sub-stantially employed individuals under twelveyears of age without displacing substantial jobopportunities for individuals over sixteen yearsof age.

(B) Any waiver granted by the Secretary un-der subparagraph (A) shall require that —

(i) the individuals employed under suchwaiver be employed outside of school hoursfor the school district where they are living whileso employed;

(ii) such individuals while so employedcommute daily from their permanent residenceto the farm on which they are so employed;and

(iii) such individuals be employed undersuch waiver (I) for not more than eight weeksbetween June 1 and October 15 of any calen-dar year, and (II) in accordance with such otherterms and conditions as the Secretary shallprescribe for such individuals’ protection.

(5)95 (A) In the administration and enforcementof the child labor provisions of this Act, employeeswho are 16 and 17 years of age shall be permitted toload materials into, but not operate or unload materi-als from, scrap paper balers and paper box compactors—

(i) that are safe for 16- and 17-year-oldemployees loading the scrap paper balers orpaper box compactors; and

(ii) that cannot be operated while be-ing loaded.(B) For purposes of subparagraph (A), scrap

paper balers and paper box compactors shall beconsidered safe for 16- or 17-year-old employeesto load only if —

(i) (I) the scrap paper balers andpaper box compactors meet the Ameri-can National Standard Institute’s Stan-dard ANSI Z245.5–1990 for scrap paperbalers and Standard ANSI Z245.2–1992for paper box compactors; or

(II) the scrap paper balers andpaper box compactors meet an appli-cable standard that is adopted by theAmerican National Standards Instituteafter the date of enactment of this para-graph and that is certified by the Secre-tary to be at least as protective of thesafety of minors as the standard describedin subclause (I);(ii) the scrap paper balers and paper

box compactors include an on-off switch in-corporating a key-lock or other system andthe control of the system is maintained in the

custody of employees who are 18 years ofage or older;

(iii) the on-off switch of the scrap pa-per balers and paper box compactors ismaintained in an off position when the scrappaper balers and paper box compactors arenot in operation; and

(iv) the employer of 16- and 17-year-oldemployees provides notice, and posts a no-tice, on the scrap paper balers and paper boxcompactors stating that —

(I) the scrap paper balers andpaper box compactors meet the appli-cable standard described in clause (i);

(II) 16- and 17-year-old employ-ees may only load the scrap paper balersand paper box compactors; and

(III) any employee under the ageof 18 may not operate or unload thescrap paper balers and paper box com-pactors.

The Secretary shall publish in the Federal Register astandard that is adopted by the American NationalStandards Institute for scrap paper balers or paper boxcompactors and certified by the Secretary to be pro-tective of the safety of minors under clause (i)(II).

(D) the automobile or truck is equippedwith a seat belt for the driver and any pas-sengers and the employee’s employer has in-structed the employee that the seat belts mustbe used when driving the automobile or truck;

(E) the automobile or truck does not ex-ceed 6,000 pounds of gross vehicle weight;

(F) such driving does not involve —(i) the towing of vehicles;(ii) route deliveries or route sales;(iii) the transportation for hire of

property, goods, or passengers;(iv) urgent, time-sensitive deliveries;(v) more than two trips away from

the primary place of employment in anysingle day for the purpose of deliver-ing goods of the employee’s employerto a customer (other than urgent, time-sensitive deliveries);

(vi) more than two trips away fromthe primary place of employment in anysingle day for the purpose of transportingpassengers (other than employees of theemployer);

(vii) transporting more than threepassengers (including employees of theemployer); or

(viii) driving beyond a 30 mile radiusfrom the employee’s place of employment;and

(G) such driving is only occasional andincidental to the employee’s employment.

For purposes of subparagraph (G), the term“occasional and incidental” is no more than one-third of an employee’s worktime in any workdayand no more than 20 percent of an employee’sworktime in any workweek.

(7) 97(A) (i) Subject to subparagraph (B), inthe administration and enforcement ofthe child labor provisions of this Act, itshall not be considered oppressive childlabor for a new entrant into the workforceto be employed inside or outside placesof business where machinery is used toprocess wood products.

Sec. 13(c)(7)(A)(ii)

(ii) In this paragraph, the term "newentrant into the workforce" means anindividual who —

(I) is under the age of 18 andat least the age of 14, and

(II) by statute or judicial orderis exempt from compulsory schoolattendance beyond the eighth grade.

(B) The employment of a new entrantinto the workforce under subparagraph (A)shall be permitted —

(i) if the entrant is supervised by anadult relative of the entrant or is super-vised by an adult member of the samereligious sect or division as the entrant;

(ii) if the entrant does not operateor assist in the operation of power-drivenwoodworking machines;

(iii) if the entrant is protected fromwood particles or other flying debris withinthe workplace by a barrier appropriateto the potential hazard of such wood par-ticles or flying debris or by maintaininga sufficient distance from machinery inoperation; and

(iv) if the entrant is required to usepersonal protective equipment to preventexposure to excessive levels of noise andsawdust.

(d) The provisions of sections 6, 7, and 12 shall not ap-ply with respect to any employee engaged in the deliveryof newspapers to the consumer or to any homeworker en-gaged in the making of wreaths composed principallyof natural holly, pine, cedar, or other evergreens (in-cluding the harvesting of the evergreens or other forestproducts used in making such wreaths).

(e) The provisions of section 7 shall not apply with re-spect to employees for whom the Secretary of Labor is au-thorized to establish minimum wage rates as provided insection 6(a)(3), except with respect to employees for whomsuch rates are in effect; and with respect to such employ-ees the Secretary may make rules and regulations provid-ing reasonable limitations and allowing reasonable varia-tions, tolerances, and exemptions to and from any or all ofthe provisions of section 7 if he shall find, after a publichearing on the matter, and taking into account the factorsset forth in section 6(a)(3), that economic conditions war-rant such action.98

(f) The provisions of sections 6, 7, 11, and 12, shall notapply with respect to any employee whose services duringthe workweek are performed in a workplace within a for-eign country or within territory under the jurisdiction ofthe United States other than the following: a State of theUnited States; the District of Columbia; Puerto Rico; theVirgin Islands; Outer Continental Shelf lands defined inthe Outer Continental Shelf Lands Act (ch. 345, 67 Stat.462); American Samoa; Guam; Wake Island; Eniwetok Atoll,Kwajalein Atoll; and Johnston Island.99, 100

(g) The exemption from section 6 provided by para-graph (6) of subsection (a) of this section shall notapply with respect to any employee employed by anestablishment (1) which controls, is controlled by, or isunder common control with, another establishment theactivities of which are not related for a common busi-ness purpose to, but materially support the activitiesof the establishment employing such employee; and (2)whose annual gross volume of sales made or businessdone, when combined with the annual gross volume ofsales made or business done by each establishmentwhich controls, is controlled by, or is under common con-trol with, the establishment employing such employee,exceeds $10,000,000 (exclusive of excise taxes at the re-tail level which are separately stated.)

(h) The provisions of section 7 shall not apply for aperiod or periods of not more than fourteen workweeksin the aggregate in any calendar year to any employeewho —

(1) is employed by such employer —(A) exclusively to provide services neces-

sary and incidental to the ginning of cotton in anestablishment primarily engaged in the ginningof cotton;

(B) exclusively to provide services neces-sary and incidental to the receiving, handling,and storing of raw cotton and the compressing ofraw cotton when performed at a cotton warehouseor compress-warehouse facility, other than oneoperated in conjunction with a cotton mill, pri-marily engaged in storing and compressing;

(C) exclusively to provide services neces-sary and incidental to the receiving, handling,storing, and processing of cottonseed in an estab-

lishment primarily engaged in the receiving, han-dling, storing, and processing of cottonseed; or

(D) exclusively to provide services neces-sary and incidental to the processing of sugar caneor sugar beets in an establishment primarily en-gaged in the processing of sugar cane or sugarbeets; and

(2) receives for —(A) such employment by such employer

which is in excess of ten hours in any workday,and

(B) such employment by such employerwhich is in excess of forty-eight hours in anyworkweek;

compensation at a rate not less than one and one-halftimes the regular rate at which he is employed.

Any employer who receives an exemption under thissubsection shall not be eligible for any other exemp-tion under this section or section 7.

(i)101 The provisions of section 7 shall not apply for aperiod or periods of not more than fourteen workweeks inthe aggregate in any period of fifty-two consecutive weeksto any employee who —

(1) is engaged in the ginning of cotton for marketin any place of employment located in a county wherecotton is grown in commercial quantities; and

(2) receives for any such employment during suchworkweeks —

(A) in excess of ten hours in any workday,and

(B) in excess of forty-eight hours in anyworkweek,

compensation at a rate not less than one and one-halftimes the regular rate at which he is employed. No weekincluded in any fifty-two week period for purposes ofthe preceding sentence may be included for such pur-poses in any other fifty-two week period.

( j )102 The provisions of section 7 shall not apply for aperiod or periods of not more than fourteen workweeks inthe aggregate in any period of fifty-two consecutive weeksto any employee who —

(1) is engaged in the processing of sugar beets,sugar beet molasses, or sugar cane into sugar (otherthan refined sugar) or syrup; and

(2) receives for any such employment during suchworkweeks —

(A) in excess of ten hours in any workday,and

(B) in excess of forty-eight hours in anyworkweek,

compensation at a rate not less than one and one-halftimes the regular rate at which he is employed. No weekincluded in any fifty-two week period for purposes of thepreceding sentence may be included for such purposesin any other fifty-two week period.

Learners, Apprentices, Students, andHandicapped Workers

SEC. 14.103 (a) The Secretary, to the extent necessary inorder to prevent curtailment of opportunities for employ-ment, shall by regulations or by orders provide for theemployment of learners, of apprentices, and of messen-gers employed primarily in delivering letters and mes-sages, under special certificates issued pursuant to regu-lations of the Secretary, at such wages lower than theminimum wage applicable under section 6 and subject tosuch limitations as to time, number, proportion, and lengthof service as the Secretary shall prescribe.

(b) (1) (A) The Secretary, to the extent necessary inorder to prevent curtailment of opportunities foremployment, shall by special certificate issuedunder a regulation or order provide, in accordancewith subparagraph (B), for the employment, ata wage rate not less than 85 per centum of theotherwise applicable wage rate in effect under sec-tion 6 or not less than $1.60 an hour, whichever ishigher, of full-time students (regardless of age butin compliance with applicable child labor laws) inretail or service establishments.

(B) Except as provided in paragraph (4)(B),during any month in which full-time students areto be employed in any retail or service establish-ment under certificates issued under this subsec-tion the proportion of student hours of employ-ment to the total hours of employment of allemployees in such establishment may not exceed—

(i) in the case of a retail or service es-tablishment whose employees (other thanemployees engaged in commerce or in the pro-duction of goods for commerce) were covered bythis Act before the effective date of the FairLabor Standards Amendments of 1974 —

Sec. 14(b)(1)(B)(i)(I)

(I) the proportion of studenthours of employment to the total hoursof employment of all employees in suchestablishment for the correspondingmonth of the immediately precedingtwelve-month period,

(II) the maximum proportion forany corresponding month of studenthours of employment to the total hoursof employment of all employees in suchestablishment applicable to the issu-ance of certificates under this section atany time before the effective date of theFair Labor Standards Amendments of1974 for the employment of students bysuch employer, or

(III) a proportion equal to one-tenth of the total hours of employmentof all employees in such establishment,

whichever is greater;

(ii) in the case of retail or service es-tablishment whose employees (other thanemployees engaged in commerce or in the pro-duction of goods for commerce) are coveredfor the first time on or after the effective dateof the Fair Labor Standards Amendments of1974 —

(I) the proportion of hours of em-ployment of students in such establish-ment to the total hours of employment ofall employees in such establishment forthe corresponding month of the twelve-month period immediately prior to theeffective date of such Amendments,

(II) the proportion of studenthours of employment to the total hoursof employment of all employees in suchestablishment for the correspondingmonth of the immediately precedingtwelve-month period, or

(III) a proportion equal to one-tenth of the total hours of employmentof all employees in such establishment,

whichever is greater; or

(iii) in the case of a retail or service es-tablishment for which records of studenthours worked are not available, the propor-tion of student hours of employment to thetotal hours of employment of all employeesbased on the practice during the immediately

preceding twelve-month period in (I) simi-lar establishments of the same employer inthe same general metropolitan area in whichsuch establishment is located, (II) similarestablishments of the same or nearby com-munities if such establishment is not in a me-tropolitan area, or (III) other establishmentsof the same general character operating inthe community or the nearest comparablecommunity.

For purpose of clauses (i), (ii), and (iii) of thissubparagraph, the term “student hours of employ-ment” means hours during which students areemployed in a retail or service establishment un-der certificates issued under this subsection.

(2) The Secretary, to the extent necessary inorder to prevent curtailment of opportunities for em-ployment, shall by special certificate issued under aregulation or order provide for the employment, at awage rate not less than 85 per centum of the wage ratein effect under section 6(a)(5) or not less than $1.30 anhour, whichever is the higher, of full-time students(regardless of age but in compliance with applicablechild labor laws) in any occupation in agriculture.

(3) The Secretary, to the extent necessary inorder to prevent curtailment of opportunities for em-ployment, shall by special certificate issued under aregulation or order provide for the employment by aninstitution of higher education, at a wage rate not lessthan 85 per centum of the otherwise applicable wagerate in effect under section 6 or not less than $1.60 anhour, whichever is the higher, of full-time students (re-gardless of age but in compliance with applicable childlabor laws) who are enrolled in such institution. TheSecretary shall by regulation prescribe standards andrequirements to insure that this paragraph will notcreate a substantial probability of reducing the full-time employment opportunities of persons other thanthose to whom the minimum wage rate authorized bythis paragraph is applicable.

(4) (A) A special certificate issued under para-graph (1), (2), or (3) shall provide that the stu-dent or students for whom it is issued shall,except during vacation periods, be employed on apart-time basis and not in excess of twenty hoursin any workweek.

cause the number of students employed by suchemployer under special certificates issued underthis subsection to exceed six, the Secretary maynot issue such a special certificate for the employ-ment of a student by such employer unless theSecretary finds employment of such student willnot create a substantial probability of reducingthe full-time employment opportunities of personsother than those employed under special certifi-cates issued under this subsection. If the issu-ance of a special certificate under paragraph (1)or (2) for an employer will not cause the numberof students employed by such employer under spe-cial certificates issued under this subsection toexceed six —

(i) the Secretary may issue a specialcertificate under paragraph (1) or (2) for theemployment of a student by such employer ifsuch employer certifies to the Secretary thatthe employment of such student will not re-duce the full-time employment opportunitiesof persons other than those employed underspecial certificates issued under this subsec-tion, and

(ii) in the case of an employer whichis a retail or service establishment, sub-paragraph (B) of paragraph (1) shall notapply with respect to the issuance of specialcertificates for such employer under suchparagraph.

The requirement of this subparagraph shall notapply in the case of the issuance of special cer-tificates under paragraph (3) for the employmentof full-time students by institutions of higher edu-cation; except that if the Secretary determinesthat an institution of higher education is employ-ing students under certificates issued under para-graph (3) but in violation of the requirements ofthat paragraph or of regulations issued there-under, the requirements of this subparagraph shallapply with respect to the issuance of special cer-tificates under paragraph (3) for the employmentof students by such institution.

(C) No special certificate may be issued un-der this subsection unless the employer for whomthe certificate is to be issued provides evidencesatisfactory to the Secretary of the student sta-tus of the employees to be employed under suchspecial certificate.

(D)105 To minimize paperwork for, and to en-courage, small businesses to employ students un-der special certificates issued under paragraphs (1)and (2), the Secretary shall, by regulation or order,prescribe a simplified application form to be usedby employers in applying for such a certificate forthe employment of not more than six full-time stu-dents. Such an application shall require only —

(i) a listing of the name, address, andbusiness of the applicant employer,

(ii) a listing of the date the applicantbegan business, and

(iii) the certification that the employmentof such full-time students will not reduce thefull-time employment opportunities of personsother than persons employed under specialcertificates.

(c)106 (1) The Secretary, to the extent necessary to pre-vent curtailment of opportunities for employment, shallby regulation or order provide for the employment,under special certificates, of individuals (including in-dividuals employed in agriculture) whose earning or pro-ductive capacity is impaired by age, physical or mentaldeficiency, or injury, at wages which are —

(A) lower than the minimum wage applicableunder section 6,

(B) commensurate with those paid to non-handicapped workers, employed in the vicinity inwhich the individuals under the certificates areemployed, for essentially the same type, quality, andquantity of work, and

(C) related to the individual’s productivity.

(2) The Secretary shall not issue a certificate un-der paragraph (1) unless the employer provides writtenassurances to the Secretary that —

(A) in the case of individuals paid on an hourlyrate basis, wages paid in accordance with para-graph (1) will be reviewed by the employer at peri-odic intervals at least once every six months, and

(B) wages paid in accordance with paragraph(1) will be adjusted by the employer at periodic in-tervals, at least once each year, to reflect changesin the prevailing wage paid to experienced non-handicapped individuals employed in the localityfor essentially the same type of work.

(3) Notwithstanding paragraph (1), no employershall be permitted to reduce the hourly wage rate pre-scribed by certificate under this subsection in effect onJune 1, 1986, of any handicapped individual for a pe-riod of two years from such date without prior authori-zation of the Secretary.

(4) Nothing in this subsection shall be construedto prohibit an employer from maintaining or establishingwork activities centers to provide therapeutic activitiesfor handicapped clients.

(5) (A) Notwithstanding any other provision ofthis subsection, any employee receiving a specialminimum wage at a rate specified pursuant to thissubsection or the parent or guardian of such anemployee may petition the Secretary to obtain areview of such special minimum wage rate. An em-ployee or the employee’s parent or guardian mayfile such a petition for and in behalf of the employeeor in behalf of the employee and other employeessimilarly situated. No employee may be a party toany such action unless the employee or the em-ployee’s parent or guardian gives consent in writ-ing to become such a party and such consent isfiled with the Secretary.

(B) Upon receipt of a petition filed in accor-dance with subparagraph (A), the Secretary withinten days shall assign the petition to an administra-tive law judge appointed pursuant to section 3105of title 5, United States Code. The administrativelaw judge shall conduct a hearing on the record inaccordance with section 554 of title 5, United StatesCode, with respect to such petition within thirty daysafter assignment.

(C) In any such proceeding, the employershall have the burden of demonstrating that thespecial minimum wage rate is justified as neces-sary in order to prevent curtailment of opportuni-ties for employment.

(D) In determining whether any special mini-mum wage rate is justified pursuant to subpara-graph (C), the administrative law judge shall con-sider —

(i) the productivity of the employee oremployees identified in the petition and theconditions under which such productivity wasmeasured; and

(ii) the productivity of other employeesperforming work of essentially the same type

and quality for other employers in the samevicinity.

(E) The administrative law judge shall issuea decision within thirty days after the hearing pro-vided for in subparagraph (B). Such action shallbe deemed to be a final agency action unless withinthirty days the Secretary grants a request to re-view the decision of the administrative law judge.Either the petitioner or the employer may requestreview by the Secretary within fifteen days of thedate of issuance of the decision by the administra-tive law judge.

(F) The Secretary, within thirty days after re-ceiving a request for review, shall review the recordand either adopt the decision of the administrativelaw judge or issue exceptions. The decision of theadministrative law judge, together with any excep-tions, shall be deemed to be a final agency action.

(G) A final agency action shall be subject tojudicial review pursuant to chapter 7 of title 5, UnitedStates Code. An action seeking such review shallbe brought within thirty days of a final agency ac-tion described in subparagraph (F).

(d) The Secretary may by regulation or order providethat sections 6 and 7 shall not apply with respect to theemployment by any elementary or secondary school ofits students if such employment constitutes, as deter-mined under regulations prescribed by the Secretary,an integral part of the regular education program pro-vided by such school and such employment is in accor-dance with applicable child labor laws.

Prohibited Acts

SEC. 15. (a) After the expiration of one hundred andtwenty days from June 25, 1938, it shall be unlawfulfor any person —

(1) to transport, offer for transportation, ship, de-liver, or sell in commerce, or to ship, deliver, or sell withknowledge that shipment or delivery or sale thereof incommerce is intended, any goods in the production ofwhich any employee was employed in violation of section6 or section 7, or in violation of any regulation or order ofthe Secretary of Labor issued under section 14; exceptthat no provision of this Act shall impose any liability uponany common carrier for the transportation in commercein the regular course of its business of any goods not pro-duced by such common carrier, and no provision of thisAct shall excuse any common carrier from its obligationto accept any goods for transportation; and except that

Sec. 15(a)(1)

any such transportation, offer, shipment, delivery, or saleof such goods by a purchaser who acquired them in goodfaith in reliance on written assurance from the producerthat the goods were produced in compliance with the re-quirements of the Act, and who acquired such goods forvalue without notice of any such violation, shall not bedeemed unlawful;107

(2) to violate any of the provisions of section 6 orsection 7, or any of the provisions of any regulation ororder of the Secretary issued under section 14;

(3) to discharge or in any other manner discrimi-nate against any employee because such employee hasfiled any compliant or instituted or caused to be insti-tuted any proceeding under or related to this Act, orhas testified or is about to testify in any such proceed-ing, or has served or is about to serve on an industrycommittee;108

(4) to violate any of the provisions of section 12;(5) to violate any of the provisions of section 11(c)

or any regulation or order made or continued in effectunder the provisions of section 11(d), or to make any state-ment, report, or record filed or kept pursuant to the pro-visions of such section or of any regulation or order there-under, knowing such statement, report, or record to befalse in a material respect.109

(b) For the purposes of subsection (a)(1) proof that anyemployee was employed in any place of employment wheregoods shipped or sold in commerce were produced, withinninety days prior to the removal of the goods from suchplace of employment, shall be prima facie evidence that suchemployee was engaged in the production of such goods.

Penalties110

SEC. 16. (a) Any person who willfully violates any of theprovisions of section 15 shall upon conviction thereof be sub-ject to a fine of not more than $10,000, or to imprisonmentfor not more than six months, or both. No person shall beimprisoned under this subsection except for an offense com-mitted after the conviction of such person for a prior of-fense under this subsection.

(b) Any employer who violates the provisions of section 6or section 7 of this Act shall be liable to the employee oremployees affected in the amount of their unpaid minimumwages, or their unpaid overtime compensation, as the casemay be, and in an additional equal amount as liquidated

damages. Any employer who violates the provisions ofsection 15(a)(3) of this Act shall be liable for such legal orequitable relief as may be appropriate to effectuate thepurposes of section 15(a)(3), including without limitationemployment, reinstatement, promotion, and the paymentof wages lost and an additional equal amount as liqui-dated damages. An action to recover the liability pre-scribed in either of the preceding sentences may be main-tained against any employer (including a public agency)in any Federal or State court of competent jurisdiction byany one or more employees for and in behalf of himself orthemselves and other employees similarly situated. No em-ployee shall be a party plaintiff to any such action unlesshe gives his consent in writing to become such a party andsuch consent is filed in the court in which such action isbrought.111 The court in such action shall, in addition toany judgment awarded to the plaintiff or plaintiffs, allow areasonable attorney's fee to be paid by the defendant, andcosts of the action. The right provided by this subsectionto bring an action by or on behalf of any employee, andthe right of any employee to become a party plaintiff toany such action, shall terminate upon the filing of acomplaint by the Secretary of Labor in an action undersection 17 in which (1) restraint is sought of any fur-ther delay in the payment of unpaid minimum wages,or the amount of unpaid overtime compensation as thecase may be, owing to such employee under section 6 orsection 7 of this Act by an employer liable therefor un-der the provisions of this subsection or (2) legal or equi-table relief is sought as a result of alleged violations ofsection 15(a)(3).112

(c) The Secretary is authorized to supervise the pay-ment of the unpaid minimum wages or the unpaid over-time compensation owing to any employee or employeesunder section 6 or 7 of this Act, and the agreement of anyemployee to accept such payment shall upon payment infull constitute a waiver by such employee of any right hemay have under subsection (b) of this section to such un-paid minimum wages or unpaid overtime compensation andan additional equal amount as liquidated damages. TheSecretary may bring an action in any court of competentjurisdiction to recover the amount of the unpaid minimumwages or overtime compensation and an equal amountas liquidated damages.113 The right provided by subsec-tion (b) to bring an action by or on behalf of any em-ployee to recover the liability specified in the first sentence

of such subsection and of any employee to become a partyplaintiff to any such action shall terminate upon thefiling of a complaint by the Secretary in an action un-der this subsection in which a recovery is sought of un-paid minimum wages or unpaid overtime compensationunder sections 6 and 7 or liquidated or other damagesprovided by this subsection owing to such employee byan employer liable under the provisions of subsection (b),unless such action is dismissed without prejudice onmotion of the Secretary. Any sums thus recovered bythe Secretary on behalf of an employee pursuant to thissubsection shall be held in a special deposit account andshall be paid, on order of the Secretary, directly to the em-ployee or employees affected. Any such sums not paid toan employee because of inability to do so within a period ofthree years shall be covered into the Treasury of the UnitedStates as miscellaneous receipts. In determining when anaction is commenced by the Secretary under this subsec-tion for the purposes of the statutes114 of limitations pro-vided in section 6(a) of the Portal-to-Portal Act of 1947, itshall be considered to be commenced in the case of anyindividual claimant on the date when the complaint is filedif he is specifically named as a party plaintiff in the com-plaint, or if his name did not so appear, on the subsequentdate on which his name is added as a party plaintiff insuch action.115

(d) In any action or proceeding commenced prior to, on,or after August 8, 1956, no employer shall be subject toany liability or punishment under this Act or the Portal-to-Portal Act of 1947 on account of his failure to complywith any provision or provisions of such Acts (1) with respectto work heretofore or hereafter performed in a workplace towhich the exemption in section 13(f) is applicable, (2) withrespect to work performed in Guam, the Canal Zone orWake Island before the effective date of this amendment ofsubsection (d), or (3) with respect to work performed in apossession named in section 6(a)(3) at any time prior tothe establishment by the Secretary, as provided therein,of a minimum wage rate applicable to such work.116

(e) Any person who violates the provisions of section12 or section 13(c)(5),117 relating to child labor, or anyregulation issued under section 12 or section 13(c)(5),118

shall be subject to a civil penalty of not to exceed $10,000for each employee who was the subject of such a viola-tion. Any person who repeatedly or willfully violatessection 6 or 7 shall be subject to a civil penalty of not toexceed $1,000 for each such violation.119 In determiningthe amount of any penalty under this subsection, theappropriateness of such penalty to the size of the busi-ness of the person charged and the gravity of the viola-tion shall be considered. The amount of any penaltyunder this subsection, when finally determined, maybe —

(1) deducted from any sums owing by the UnitedStates to the person charged;

(2) recovered in a civil action brought by theSecretary in any court of competent jurisdiction, inwhich litigation the Secretary shall be represented bythe Solicitor of Labor; or

(3) ordered by the court, in an action broughtfor a violation of section 15(a)(4) or a repeated orwillful violation of section 15(a)(2),120 to be paid tothe Secretary.

Any administrative determination by the Secretary ofthe amount of any penalty under this subsection shallbe final, unless within fifteen days after receipt ofnotice thereof by certified mail the person charged withthe violation takes exception to the determination thatthe violations for which the penalty is imposed occurred,in which event final determination of the penalty shallbe made in an administrative proceeding after oppor-tunity for hearing in accordance with section 554 of title 5,United States Code, and regulations to be promulgatedby the Secretary. Except for civil penalties collected forviolations of section 12, sums collected as penalties pur-suant to this section shall be applied toward reimburse-ment of the costs of determining the violations andassessing and collecting such penalties, in accordancewith the provisions of section 9a. Civil penalties collectedfor violations of section 12 shall be deposited in the generalfund of the Treasury.121

Injunction Proceedings

SEC. 17. The district courts, together with the UnitedStates District Court for the District of the Canal Zone,the District Court of the Virgin Islands, and the Dis-trict Court of Guam shall have jurisdiction, for causeshown, to restrain violations of section 15, includingin the case of violations of section 15(a)(2) the restraintof any withholding of payment of minimum wages orovertime compensation found by the court to be due toemployees under this Act (except sums which em-ployees are barred from recovering, at the time of thecommencement of the action to restrain the violations,by virtue of the provisions of section 6 of the Portal-to-Portal Act of 1947).122

Relation to Other Laws

SEC. 18. (a) No provision of this Act or of any orderthereunder shall excuse noncompliance with any Federalor State law or municipal ordinance establishing a miniumwage higher than the minium wage established under thisAct or a maximum workweek lower than the maximumworkweek established under this Act, and no provision ofthis Act relating to the employment of child labor shalljustify noncompliance with any Federal or State law or mu-nicipal ordinance establishing a higher standard than thestandard established under this Act. No provision of thisAct shall justify any employer in reducing a wage paid byhim which is in excess of the applicable minimum wage un-

der this Act, or justify any employer in increasing hours ofemployment maintained by him which are shorter than themaximum hours applicable under this Act.

(b) Notwithstanding any other provision of this Act(other than section 13(f)) or any other law —

(1) any Federal employee in the Canal Zone en-gaged in employment of the kind described in section5102(c)(7) of title 5, United States Code, or 123

(2) any employee employed in a nonappropriatedfund instrumentality under the jurisdiction of the ArmedForces,124

shall have his basic compensation fixed or adjusted at awage rate which is not less than the appropriate wage rateprovided for in section 6(a)(1) of this Act (except that thewage rate provided for in section 6(b) shall apply to anyemployee who performed services during the workweek ina work place within the Canal Zone), and shall have hisovertime compensation set at an hourly rate not less thanthe overtime rate provided for in section 7(a)(1) of this Act.

Separability of Provisions

SEC. 19. If any provision of this Act or the application ofsuch provision to any persons or circumstances is held in-valid, the remainder of the Act and the application of suchprovision to other persons or circumstances shall not beaffected thereby.

LIABILITY OF EMPLOYERS

No employer shall be liable under the Fair LaborStandards Act of 1938 for any failure to include in anemployee’s regular rate (as defined for purposes ofsuch Act) any income or value derived from employer-provided grants or rights obtained pursuant to anystock option, stock appreciation right, or employeestock purchase program if —

(1) the grants or rights were obtained beforethe effective date described in subsection (c);

(2) the grants or rights were obtained withinthe 12-month period beginning on the effectivedate de-scribed in subsection (c), so long as suchprogram was in existence on the date of enactmentof this Act and will require shareholder approvalto modify such program to comply with section7(3)(8) of the Fair Labor Standards Act of 1938 (asadded by the amendments made by subsection (a));or

(3) such program is provided under a collec-tive bargaining agreement on the effective datedescribed in subsection (c).

SEC. 2. REGULATIONS CONCERNINGCERTAIN EMPLOYEES

Not later than 90 days after the date of enactment of thisAct, the Secretary of Labor shall promulgate regulationsthat permit computer systems analysts, computer program-mers, software engineers, and other similarly skilled pro-fessional workers as defined in such regulations to qualifyas exempt executive, administrative, or professional em-ployees under section 13(a)(1) of the Fair Labor StandardsAct of 1938 (29 U.S.C. 213(a)(1)). Such regulations shallprovide that if such employees are paid on an hourly basisthey shall be exempt only if their hourly rate of pay is atleast 6 1/2 times greater than the applicable minimum wagerate under section 6 of such Act (29 U.S.C. 206).

PRESERVATION OF COVERAGE

SEC. 3. * * *

(b) PRESERVATION OF COVERAGE. —

(1) IN GENERAL. — Any enterprise that onMarch 31, 1990, was subject to section 6(a)(1) of theFair Labor Standards Act of 1938 (29 U.S.C. 206(a)(1))and that because of the amendment made by sub-section (a) is not subject to such section shall —

(A) pay its employees not less than theminimum wage in effect under such section onMarch 31, 1990;

(B) pay its employees in accordance withsection 7 of such Act (29 U.S.C. 207); and

(C) remain subject to section 12 of suchAct (29 U.S.C. 212).

(2) VIOLATIONS. — A violation of paragraph(1) shall be considered a violation of section 6, 7, or12 of the Fair Labor Standards Act of 1938, as thecase may be.

(e) EFFECTIVE DATE. — The amendments made bythis section shall become effective on April 1, 1990.

TRAINING WAGE

SEC. 6. TRAINING WAGE.

(a) IN GENERAL. —

(1) AUTHORITY. — Any employer may, in lieuof the minimum wage prescribed by section 6 of theFair Labor Standards Act of 1938 (29 U.S.C. 206),pay an eligible employee the wage prescribed byparagraph (2) —

(A) while such employee is employed forthe period authorized by subsection (g)(1)(B)(i),or

(B) while such employee is engaged inon-the-job training for the period authorized bysubsection (g)(1)(B)(ii).

(2) WAGE RATE. — The wage referred to inparagraph (1) shall be a wage —

(A) of not less than $3.35 an hour duringthe year beginning April 1, 1990; and

(B) beginning April 1, 1991, of not less than$3.35 an hour or 85 percent of the wage pre-scribed by section 6 of such Act, whichever isgreater.

(b) WAGE PERIOD. — An employer may pay an eli-gible employee the wage authorized by subsection (a)for a period that —

(1) begins on or after April 1, 1990;(2) does not exceed the maximum period dur-

ing which an employee may be paid such wage asdetermined under subsection (g)(1)(B); and

(3) ends before April 1, 1993.

(c) WAGE CONDITIONS. — No eligible employeemay be paid the wage authorized by subsection (a) byan employer if —

(1) any other individual has been laid off bysuch employer from the position to be filled by sucheligible employee or from any substantially equiva-lent position; or

(2) such employer has terminated the employ-ment of any regular employee or otherwise reducedthe number of employees with the intention of fill-ing the vacancy so created by hiring an employeeto be paid such wage.

(d) LIMITATIONS. —

(1) EMPLOYEE HOURS. — During any monthin which employees are to be employed in an estab-lishment under this section, the proportion of em-ployee hours of employment to the total hours ofemployment of all employees in such establishmentmay not exceed a proportion equal to one-fourth ofthe total hours of employment of all employees insuch establishment.

(2) DISPLACEMENT. —(A) PROHIBITION. — No employer may

take any action to displace employees (includ-ing partial displacements such as reduction inhours, wages, or employment benefits) for pur-poses of hiring individuals at the wage autho-rized in subsection (a).

(B) DISQUALIFICATION. — If the Secretarydetermines that an employer has taken an ac-tion in violation of subparagraph (A), the Secre-tary shall issue an order disqualifying suchemployer from employing any individual at suchwage.

(e) NOTICE. — Each employer shall provide to anyeligible employee who is to be paid the wage autho-rized by subsection (a) a written notice before theemployee begins employment stating the require-ments of this section and the remedies provided bysubsection (f) for violations of this section. The Sec-retary shall provide to employers the text of the no-tice to be provided under this subsection.

(f) ENFORCEMENT. — Any employer who violatesthis section shall be considered to have violatedsection 15(a)(3) of the Fair Labor Standards Act of 1938(29 U.S.C. 215(a)(3)). Sections 16 and 17 of such Act(29 U.S.C. 216 and 217) shall apply with respect to theviolation.

(g) DEFINITIONS. — For purposes of this section:(1) ELIGIBLE EMPLOYEE. —

(A) IN GENERAL. — The term “eligible em-ployee” means with respect to an employer anindividual who —

(i) is not a migrant agricultural work-er or a seasonal agricultural worker (asdefined in paragraphs (8) and (10) of sec-tion 3 of the Migrant and Seasonal Agri-cultural Worker Protection Act (29 U.S.C.1802 (8) and (10)) without regard to sub-paragraph (B) of such paragraphs and is

not a nonimmigrant described in section101(a)(15)(H)(ii)(a) of the immigration andNationality Act (8 U.S.C. 1101(a)(15)(H)(ii)(a));

(ii) has not attained the age of 20years; and

(iii) is eligible to be paid the wage au-thorized by subsection (a) as determinedunder subparagraph (B).

(B) DURATION. —(i) An employee shall initially be eli-

gible to be paid the wage authorized bysubsection (a) until the employee has beenemployed a cumulative total of 90 days atsuch wage.

(ii) An employee who has been em-ployed by an employer at the wage autho-rized by subsection (a) for the period au-thorized by clause (i) may be employed byany other employer for an additional 90days if the employer meets the require-ments of subsection (h).

(iii) The total period, as authorized byclauses (i) and (ii), that an employee maybe paid the wage authorized by subsection(a) may not exceed 180 days.

(iv) For purposes of this subpara-graph, the term “employer” means with re-spect to an employee an employer who isrequired to withhold payroll taxes for suchemployee.

(C) PROOF. —(i) IN GENERAL. — An individual

is responsible for providing the requi-site proof of previous period or periodsof employment with other employers. Anemployer's good faith reliance on the proofpresented to the employer by an indi-vidual shall constitute a complete defenseto a charge that the employer has violatedsubsection (b)(2) with respect to suchindividual.

(ii) REGULATIONS. — The Secretaryof Labor shall issue regulations defining therequisite proof required of an individual.Such regulations shall establish minimalrequirements for requisite proof and mayprescribe that an accurate list of the individ-ual’s employers and a statement of the

dates and duration of employment witheach employer constitute requisite proof.

(2) ON-THE-JOB TRAINING. — The term “on-the-job training” means training that is offered toan individual while employed in productive work thatprovides training, technical and other related skills,and personal skills that are essential to the full andadequate performance of such employment.

(h) EMPLOYER REQUIREMENTS. — An employerwho wants to employ employees at the wage autho-rized by subsection (a) for the period authorized bysubsection (g)(1)(B)(ii) shall —

(1) notify the Secretary annually of the posi-tions at which such employees are to be employedat such wage,

(2) provide on-the-job training to such employ-ees which meets general criteria of the Secretaryissued by regulation after consultation with theCommittee on Labor and Human Resources of theSenate and the Committee on Education and Laborof the House of Representatives and other interestedpersons,

(3) keep on file a copy of the training programwhich the employer will provide such employees,

(4) provide a copy of the training program tothe employees,

(5) post in a conspicuous place in places ofemployment a notice of the types of jobs for whichthe employer is providing on-the-job training, and

(6) send to the Secretary on an annual basis acopy of such notice.

The Secretary shall make available to the public uponrequest notices provided to the Secretary by employ-ers in accordance with paragraph (6).

(i) REPORT. — The Secretary of Labor shall re-port to Congress not later than March 1, 1993, on theeffectiveness of the wage authorized by subsection (a).The report shall include —

(1) an analysis of the impact of such wageon employment opportunities for inexperiencedworkers;

(2) any reduction in employment opportunitiesfor experienced workers resulting from the employ-ment of employees under such wage;

(3) the nature and duration of the training pro-vided under such wage; and

(4) the degree to which employees used theauthority to pay such wage.

APPLICATIONS OF FLSA TOCONGRESSIONAL AND ARCHITECT

OF THE CAPITOL EMPLOYEES

SEC. 8. APPLICATION OF RIGHTS AND PROTEC-TIONS OF FAIR LABOR STANDARDS ACT OF 1938TO CONGRESSIONAL AND ARCHITECT OF THECAPITOL EMPLOYEES.

(a) HOUSE EMPLOYEES. —

(1) IN GENERAL. — Not later than 180 daysafter the date the minimum wage rate prescribed bysection 6(a)(1) of the Fair Labor Standards Act of 1938(29 U.S.C. 206(a)(1)) is increased pursuant to theamendment made by section 2, the rights and pro-tections under the Fair Labor Standards Act of 1938(29 U.S.C. 201 et seq.) shall apply with respect to anyemployee in an employment position in the Houseof Representatives and to any employing authorityof the House of Representatives.

(2) ADMINISTRATION. — In the administrationof this subsection, the remedies and proceduresunder the Fair Employment Practices Resolutionshall be applied. As used in this paragraph,the term "Fair Employment Practices Resolution"means House Resolution 558, One Hundredth Con-gress, agreed to October 4, 1988, as continued ineffect by House Resolution 15, One Hundred FirstCongress, agreed to January 3, 1989.

(b) ARCHITECT OF THE CAPITOL EMPLOYEES. —Not later than 180 days after the date the minimumwage rate prescribed by section 6(a)(1) of the FairLabor Standards Act of 1938 (29 U.S.C. 206(a)(1)) isincreased pursuant to the amendment made by sec-tion 2, the rights and protections under the FairLabor Standards Act of 1938 (29 U.S.C. 201 et seq.) shallapply with respect to individuals employed underthe Office of the Architect of the Capitol.

AN ACT

To amend the Fair Labor Standards Act of 1938 to providerules for overtime compensatory time off for certain publicagency employees, to clarify the application of that Act tovolunteers, and for other purposes.

Be it enacted by the Senate and House of Representativesof the United States in Congress assembled, That this Actmay be cited as the “Fair Labor Standards Amendmentsof 1985.”

[Sections 2(a), 3, 4(a) and 5 of the Fair Labor Stan-dards Amendments of 1985 amend the Fair LaborStandards Act of 1938, and are incorporated in theirproper place in the Act.]

COMPENSATORY TIME

SEC. 2. * * *

(b) EXISTING COLLECTIVE BARGAINING AGREE-MENTS — A collective bargaining agreement which isin effect on April 15, 1986, and which permits com-pensatory time off in lieu of overtime compensationshall remain in effect until its expiration date unlessotherwise modified, except that compensatory timeshall be provided after April 14, 1986, in accordancewith section 7(o) of the Fair Labor Standards Act of1938 (as added by subsection (a)).

(c) LIABILITY AND DEFERRED PAYMENT — (1) NoState, political subdivision of a State, or interstate gov-ernmental agency shall be liable under section 16 ofthe Fair Labor Standards Act of 1938 for a violationof section 6 (in the case of a territory or possession ofthe United States), 7, or 11(c) (as it relates to section 7)of such Act occurring before April 15, 1986, withrespect to any employee of the State, political subdi-vision, or agency who would not have been coveredby such Act under the Secretary of Labor's specialenforcement policy on January 1, 1985, and publishedin sections 775.2 and 775.4 of title 29 of the Code ofFederal Regulations.

(2) A State, political subdivision of a State,or interstate governmental agency may defer untilAugust 1, 1986, the payment of monetary over-time compensation under section 7 of the Fair La-bor Standards Act of 1938 for hours worked afterApril 14, 1986.

VOLUNTEERS

(b) REGULATIONS. — Not later than March 15, 1986,the Secretary of Labor shall issue regulations to carryout paragraph (4) of section 3(e) (as amended by sub-section (a) of this section).

(c) CURRENT PRACTICE. — If, before April 15, 1986,the practice of a public agency was to treat certainindividuals as volunteers, such individuals shall untilApril 15, 1986, be considered, for purposes of the FairLabor Standards Act of 1938, as volunteers and notas employees. No public agency which is a State, apolitical subdivision of a State, or an interstate gov-ernmental agency shall be liable for a violation of sec-tion 6 occurring before April 15, 1986, with respect toservices deemed by that agency to have been per-formed for it by an individual on a voluntary basis.

EFFECTIVE DATE

SEC. 6. The amendments made by this Act shalltake effect April 15, 1986. The Secretary of Labor shallbefore such date promulgate such regulations as maybe required to implement such amendments.

EFFECT OF AMENDMENTS

SEC. 7. The amendments made by this Act shall notaffect whether a public agency which is a State, po-litical subdivision of a State, or an interstate govern-mental agency is liable under section 16 of the FairLabor Standards Act of 1938 for a violation of section5, 7, or 11 of such Act occurring before April 15, 1986,with respect to any employee of such public agencywho would have been covered by such Act under theSecretary of Labor’s special enforcement policy onJanuary 1, 1985, and published in section 775.3 of title29 of the Code of Federal Regulations.

DISCRIMINATION

SEC. 8. A public agency which is a State, politicalsubdivision of a State, or an interstate governmentalagency and which discriminates or has discriminatedagainst an employee with respect to the employee’swages or other terms or conditions of employmentbecause on or after February 19, 1985, the employeeasserted coverage under section 7 of the Fair LaborStandards Act of 1938 shall be held to have violatedsection 15(a)(3) of such Act. The protection againstdiscrimination afforded by the preceding sentenceshall be available after August 1, 1986, only for an em-ployee who takes an action described in section15(a)(3) of such Act.

(F) the effect (if any) of the full-time stu-dent certification program on employment andunemployment;

(G) the employment and unemployment ef-fects (if any) of the minimum wage;

(H) the exemptions from the minimum wageand overtime requirements of that Act;

(I) the relationship (if any) between the Fed-eral minimum wage rates and public assistanceprograms, including the extent to which employeesat such rates are also eligible to receive food stampsand other public assistance;

(J) the overall level of noncompliance with thatAct; and

(K) the demographic profile of minimum wageworkers.(2) The Commission shall conduct a study con-

cerning the extent to which the exemptions from theminimum wage and overtime requirements of the FairLabor Standards Act of 1938 may apply to employeesof conglomerates, and shall make a report, within oneyear after the date of the appointment of the membersof the Commission, of the results of such study. For thepurposes of this paragraph a “conglomerate” means anestablishment (A) which controls, is controlled by, or isunder common control with, another establishment theactivities of which are not related for a common businesspurpose to the activities of the establishment employingsuch employees and (B) whose annual gross volume ofsales made or business done, when combined with theannual gross volume of sales made or business doneby each establishment which controls, is controlled by,or is under common control with, the establishmentemploying such employee, exceeds $100,000,000(exclusive of excise taxes at the retail level which areseparately stated). The report shall include an analysisof the effects of eliminating the exemptions from theminimum wage and overtime requirements of such Actthat may currently apply to the employees of suchconglomerates.

(3) The Commission shall make a report of theresults of the study conducted pursuant to paragraph(1) thirty-six months after the date of the appointmentof the members of the Commission. The report shallinclude such recommendations for legislation as theCommission determines are appropriate. The Com-mission may make interim or additional reports which itdetermines are appropriate. Each report shall be madeto the President and to the Congress. The Commissionshall cease to exist thirty days after the submission ofthe report required by this paragraph.

ADDITIONAL PROVISIONS OF FAIR LABOR STANDARDS AMENDMENTS OF 1977(91 Stat. 1245)

AN ACT

To amend the Fair Labor Standards Act of 1938 to increasethe minimum wage rate under that Act, and for otherpurposes.

Be it enacted by the Senate and House of Representativesof the United States of America in Congress assembled,That this Act may be cited as the “Fair Labor StandardsAmendments of 1977.”

[Sections 2(a) through 2(d) and sections 3 through 14,inclusive, of the Fair Labor Standards Amendments of 1977amend the Fair Labor Standards Act of 1938, and areincorporated in their proper place in the Act.]

Increase in Minimum Wage

SEC. 2. * * *(e) (1) There is established the Minimum WageStudy Commission (hereinafter in this subsection re-ferred to as the “Commission”) which shall conduct astudy of the Fair Labor Standards Act of 1938 and thesocial, political, and economic ramifications of theminimum wage, overtime, and other requirements of thatAct. Such study shall include but not be limited to —

(A) the beneficial effects of the minimumwage, including its effect in ameliorating povertyamong working citizens;

(B) the inflationary impact (if any) of increasesin the minimum wage prescribed by that Act;

(C) the effect (if any) such increases have onwages paid employees at a rate in excess of therate prescribed by that Act;

(D) the economic consequence (if any) ofauthorizing an automatic increase in the rate pre-scribed in that Act on the basis of an increase in awage, price, or other index;

(E) the employment and unemploymenteffects (if any) of providing a different minimumwage for youth, and the employment and un-employment effects (if any) on handicapped andaged individuals of an increase in such rate and ofproviding a different minimum wage rate for suchindividuals;

(4) (A) The Commission shall consist of eightmembers as follows:

(i) Two members appointed by theSecretary of Labor.

(ii) Two members appointed by theSecretary of Commerce.

(iii) Two members appointed by theSecretary of Agriculture.

(iv) Two members appointed by theSecretary of Health, Education, and Welfare.

The appointments authorized under this paragraph shallbe made within 180 days after the date of enactment ofthis subsection.

(B) The Chairperson shall be selected by themembers of the Commission. Any vacancy in theCommission shall not affect its powers and shallbe filled in the same manner in which the originalappointment was made.

(C) (i) Except as provided in clause (ii),members of the Commission who are officersor employees of the Federal Government shallserve without compensation. Other members,while engaged in the activities of the Com-mission, shall be paid at a rate equal to theper diem equivalent of the annual rate payablefor grade GS-18 of the General Schedule un-der section 5332 of title 5, United States Code.

(ii) While away from their homes orregular places of business in the performanceof services for the Commission, members ofthe Commission shall be allowed travel ex-penses, including per diem in lieu of sub-sistence, in the same manner as persons em-ployed intermittently in the Government serviceare allowed expenses under section 5703 oftitle 5 of the United States Code.

(5) (A) The Commission may prescribe suchrules as may be necessary to carry out its dutiesunder this subsection.

(B) The Commission may hold such hear-ings, sit and act at such times and places, take suchtestimony, and receive such evidence as it deemsadvisable.

(C) Upon request of the Commission, thehead of any Federal department or agency is au-thorized to detail, on a reimbursable basis, any ofthe personnel of such department or agency to theCommission to assist it in carrying out its dutiesunder this subsection.

(D) The Department of Labor shall furnishsuch professional, technical, and research assis-tance as required by the Commission.

(E) The Administrator of General Servicesshall provide to the Commission on a reimbursablebasis such administrative support services as theCommission may request to carry out its dutiesunder this subsection.

(F) The Commission may secure directlyfrom any department or agency of the United Statessuch information as the Commission may requireto carry out its duties under this subsection. Uponrequest of the Commission, the head of any suchdepartment or agency shall furnish such informa-tion to the Commission.

(G) The Commission may use the UnitedStates mails in the same manner and upon thesame conditions as other departments and agen-cies of the United States.(6) (A) The Chairperson may appoint an execu-cutive director of the Commission who shall per-form such duties as the Chairperson may prescribe.

(B) With approval of the Chairperson, theexecutive director may appoint and fix the pay ofsuch clerical personnel as are necessary for theCommission to carry out its duties.

(C) The executive director and staff shall beappointed without regard to the provisions of title 5,United States Code, governing appointments inthe competitive service, and shall be paid withoutregard to the provisions of chapter 51 and sub-chapter III of chapter 53 of such title relating toclassification and General Schedule pay rates butat rates not in excess of the annual rate payable forgrade GS-18 of the General Schedule under sec-tion 5332 of such title.

(D) The executive director, with the concur-rence of the Chairperson, may obtain temporary andintermittent services of experts and consultants inaccordance with the provisions of section 3109 oftitle 5, United States Code.

Effective Date

SEC. 15. (a) Except as provided in sections 3, 14, andsubsection (b) of this section, the amendments made bythis Act shall take effect January 1, 1978.

(b) The amendments made by sections 8, 9, 11, 12,and 13 shall take effect on the date of the enactment ofthis Act.

(c) On and after the date of the enactment of this Act,the Secretary of Labor shall take such administrative ac-tion as may be necessary for the implementation of theamendments made by this Act.

To amend the Fair Labor Standards Act of 1938 to increasethe minimum wage rate under that Act, and for otherpurposes.

Be it enacted by the Senate and House of Representativesof the United States of America in Congress assembled,That this Act may be cited as the “Fair Labor StandardsAmendments of 1974.”

[Sections 2 through 6(d)(1) and sections 7 through 27,inclusive, of the Fair Labor Standards Amendmentsof 1974 amend the Fair Labor Standards Act of 1938,and are incorporated in their proper place in the Act.Section 6(d)(2)(A) and (B) amends the Portal-to-PortalAct of 1947 and is set forth below.]

Federal and State Employees

SEC. 6. * * *(2) (A) Section 6 of the Portal-to-Portal Pay Actof 1947 is amended by striking out the period atthe end of paragraph (c) and by inserting in lieuthereof a semicolon and by adding after suchparagraph the following:

“(d) with respect to any cause of action brought undersection 16(b) of the Fair Labor Standards Act of 1938against a State or a political subdivision of a State in adistrict court of the United States on or before April 18,1973, the running of the statutory periods of limitationshall be deemed suspended during the period beginningwith the commencement of any such action and endingone hundred and eighty days after the effective date ofthe Fair Labor Standards Amendments of 1974, exceptthat such suspensions shall not be applicable if in suchaction judgement has been entered for the defendant onthe grounds other than State immunity from Federaljurisdiction.”

(B) Section 11 of such Act is amended bystriking out “(b)” after “section 16.”

Effective Date

SEC. 29. (a) Except as otherwise specifically provided,the amendments made by this Act shall take effect onMay 1, 1974.

(b) Notwithstanding subsection (a), on and after thedate of the enactment of this Act the Secretary of Laboris authorized to prescribe necessary rules, regulations,and orders with regard to the amendments made by thisAct.

further instructed to report to the Congress by July 1, 1967,the findings of such survey with appropriate recom-mendations.

CANAL ZONE EMPLOYEES ANDPANAMA CANAL STUDY

SEC. 604.The Secretary of Labor, in cooperation withthe Secretary of Defense and the Secretary of State, shall(1) undertake a study with respect to (A) wage ratespayable to Federal employees in the Canal Zone engagedin employment of the kind described in paragraph (7) ofsection 202 of the Classification Act of 1949 (5 U.S.C.1082(7)) and (B) the requirements of an effective andeconomical operation of the Panama Canal, and (2) reportto the Congress not later than July 1, 1968, the results ofhis study together with such recommendations as he maydeem appropriate.

STUDY OF WAGES PAID HANDICAPPEDCLIENTS IN SHELTERED WORKSHOPS

SEC. 605.The Secretary of Labor is hereby instructedto commence immediately a complete study of wagepayments to handicapped clients of sheltered workshopsand of the feasibility of raising existing wage standardsin such workshops. The Secretary is further instructed toreport to the Congress by July 1, 1967, the findings of suchstudy with appropriate recommendations.

PREVENTION OF DISCRIMINATIONBECAUSE OF AGE

SEC. 606. The Secretary of Labor is hereby directed tosubmit to the Congress not later than January 1, 1967, hisspecific legislative recommendations for implementing theconclusions and recommendations contained in his reporton age discrimination in employment made pursuant tosection 715 of Public Law 88–352. Such legislative rec-ommendations shall include, without limitation, pro-visions specifying appropriate enforcement procedures,a particular administering agency, and the standards,coverage, and exemptions, if any, to be included in theproposed enactment.

MISCELLANEOUS AND EFFECTIVE DATE

SEC. 16. (a) The amendments made by this Act shalltake effect upon the expiration of ninety days from the dateof its enactment; except that the amendment made bysection 4 shall take effect on the date of its enactment.

(b) Except as provided in section 3(o) and in the lastsentence of section 16(c) of the Fair Labor Standards Actof 1938, as amended, no amendment made by this Act shallbe construed as amending, modifying, or repealing anyprovision of the Portal-to-Portal Act of 1947.

(c) Any order, regulation, or interpretation of the Ad-ministrator of the Wage and Hour Division or of theSecretary of Labor, and any agreement entered into bythe Administrator or the Secretary, in effect under theprovisions of the Fair Labor Standards Act of 1938, asamended, on the effective date of this Act, shall remain in

effect as an order, regulation, interpretation, or agreementof the Administrator or the Secretary, as the case may be,pursuant to this Act, except to the extent that any suchorder, regulation, interpretation, or agreement may beinconsistent with the provisions of this Act, or may from timeto time be amended, modified, or rescinded by theAdministrator or the Secretary, as the case may be, inaccordance with the provisions of this Act.1

(d) No amendment made by this Act shall affect anypenalty or liability with respect to any act or omissionoccurring prior to the effective date of this Act; but, afterthe expiration of two years from such effective date, noaction shall be instituted under section 16(b) of the FairLabor Standards Act of 1938, as amended, with respect toany liability accruing thereunder for any act or omissionoccurring prior to the effective date of this Act.

(e) No employer shall be subject to any liability orpunishment under the Fair Labor Standards Act of 1938,as amended (in any action or proceeding commenced priorto or on or after the effective date of this Act), on account ofthe failure of said employer to pay an employee com-pensation for any period of overtime work performed priorto July 20, 1949, if the compensation paid prior to July 20,1949 for such work was at least equal to the compensationwhich would have been payable for such work had section7(d) (6) and (7) and section 7(g) of the Fair Labor Stan-dards Act of 1938, as amended, been in effect at the timeof such payment.

(f) Public Law 177, Eighty-first Congress, approvedJuly 20, 1949, is hereby repealed as of the effective date ofthis Act.2

PART I

FINDINGS AND POLICY

SECTION 1. (a) The Congress hereby finds that theFair Labor Standards Act of 1938, as amended, hasbeen interpreted judicially in disregard of long-establishedcustoms, practices, and contracts between employers andemployees, thereby creating wholly unexpected liabilities,immense in amount and retroactive in operation, uponemployers with the results that, if said Act as so interpretedor claims arising under such interpretations were permittedto stand, (1) the payment of such liabilities would bringabout financial ruin of many employers and seriously impairthe capital resources of many others, thereby resulting inthe reduction of industrial operations, halting of expansionand development, curtailing employment, and the earningpower of employees; (2) the credit of many employers wouldbe seriously impaired; (3) there would be created both anextended and continuous uncertainty on the part of industry,both employer and employee, as to the financial conditionof productive establishments and a gross inequality ofcompetitive conditions between employers and betweenindustries; (4) employees would receive windfall payments,including liquidated damages, of sums for activities per-formed by them without any expectation of reward beyondthat included in their agreed rates of pay; (5) there wouldoccur the promotion of increasing demands for payment toemployees for engaging in activities no compensation forwhich had been contemplated by either the employer or

employee at the time they were engaged in; (6) voluntarycollective bargaining would be interfered with and industrialdisputes between employees and employers and betweenemployees and employees would be created; (7) the courtsof the country would be burdened with excessive and need-less litigation and champertous practices would be en-couraged; (8) the Public Treasury would be deprived of largesums of revenues and public finances would be seriouslyderanged by claims against the Public Treasury for refundsof taxes already paid; (9) the cost to the Government ofgoods and services heretofore and hereafter purchased byits various departments and agencies would be unreason-ably increased and the Public Treasury would be seriouslyaffected by consequent increased cost of war contracts; and(10) serious and adverse effects upon the revenues of Fed-eral, State, and local governments would occur.

The Congress further finds that all of the forego-ing constitutes a substantial burden on commerce anda substantial obstruction to the free flow of goods incommerce.

The Congress, therefore, further finds and declares thatit is in the national public interest and for the generalwelfare, essential to national defense, and necessary to aid,protect, and foster commerce, that this Act be enacted.

The Congress further finds that the varying and extendedperiods of time for which, under the laws of the severalStates, potential retroactive liability may be imposed uponemployers, have given and will give rise to great difficultiesin the sound and orderly conduct of business and industry.

The Congress further finds and declares that all of theresults which have arisen or may arise under the Fair LaborStandards Act of 1938, as amended, as aforesaid, may(except as to liability for liquidated damages) arise withrespect to the Walsh–Healey and Bacon–Davis Acts andthat it is therefore, in the national public interest and forthe general welfare, essential to national defense, andnecessary to aid, protect, and foster commerce, that thisAct shall apply to the Walsh–Healey Act and the Bacon–Davis Act.

(b) It is hereby declared to be the policy of the Congressin order to meet the existing emergency and to correctexisting evils (1) to relieve and protect interstate commercefrom practices which burden and obstruct it; (2) to protectthe right of collective bargaining; and (3) to define and limitthe jurisdiction of the courts.

FUTURE CLAIMS

SEC. 4. RELIEF FROM CERTAIN FUTURE CLAIMSUNDER THE FAIR LABOR STANDARDS ACT OF 1938, ASAMENDED, THE WALSH–HEALEY ACT, AND THEBACON–DAVIS ACT. —

(a) Except as provided in subsection (b), no employershall be subject to any liability or punishment under theFair Labor Standards Act of 1938, as amended, the Walsh–Healey Act, or the Bacon–Davis Act, on account of thefailure of such employer to pay an employee minimumwages, or to pay an employee overtime compensation, foror on account of any of the following activities of suchemployee engaged in on or after the date of the enactmentof this Act —

(1) walking, riding, or traveling to and from theactual place of performance of the principal activity oractivities which such employee is employed to perform,and

(2) activities which are preliminary to or post-liminary to said principal activity or activities,

which occur either prior to the time on any particularworkday at which such employee commences, or subsequentto the time on any particular workday at which he ceases,such principal activity or activities.

For purposes of this subsection, the use of an employer’svehicle for travel by an employee and activities performedby an employee which are incidental to the use of suchvehicle for commuting shall not be considered part ofthe employee’s principal activities if the use of suchvehicle for travel is within the normal commuting areafor the employer’s business or establishment and the useof the employer’s vehicle is subject to an agreement onthe part of the employer and the employee or represen-tative of such employee.1

(b) Not withstanding the provisions of subsection (a)which relieve an employer from liability and punishmentwith respect to an activity, the employer shall not be sorelieved if such activity is compensable by either —

(1) an express provision of a written or nonwrittencontract in effect, at the time of such activity, betweensuch employee, his agent, or collective-bargaining repre-sentative and his employer; or

(2) a custom or practice in effect, at the time of suchactivity, at the establishment or other place where suchemployee is employed, covering such activity, not in-consistent with a written or nonwritten contract, in effectat the time of such activity, between such employee, hisagent, or collective-bargaining representative and hisemployer.(c) For the purposes of subsection (b), an activity shall

be considered as compensable under such contract provision

or such custom or practice only when it is engaged in duringthe portion of the day with respect to which it is so madecompensable.

(d) In the application of the minimum wage and overtimecompensation provisions of the Fair Labor Standards Actof 1938, as amended, of the Walsh–Healey Act, or of theBacon–Davis Act, in determining the time for which anemployer employs an employee with respect to walking,riding, traveling or other preliminary or postliminaryactivities described in subsection (a) of this section, thereshall be counted all that time, but only that time, duringwhich the employee engages in any such activity which iscompensable within the meaning of subsections (b) and (c)of this section.

PART IV

MISCELLANEOUS

SEC. 6. STATUTE OF LIMITATIONS. — Any action com-menced on or after the date of the enactment of this Act toenforce any cause of action for unpaid minimum wages,unpaid overtime compensation, or liquidated damages,under the Fair Labor Standards Act of 1938, as amended,the Walsh–Healey Act, or the Bacon–Davis Act —

(a) if the cause of action accrues on or after the date ofthe enactment of this Act — may be commenced withintwo years after the cause of action accrued, and every suchaction shall be forever barred unless commenced withintwo years after the cause of action accrued, except that acause of action arising out of a willful violation may becommenced within three years after the cause of actionaccrued;2

SEC. 7. DETERMINATION OF COMMENCEMENT OFFUTURE ACTIONS. — In determining when an action iscommenced for the purposes of section 6, an action com-menced on or after the date of the enactment of this Actunder the Fair Labor Standards Act of 1938, as amended,the Walsh–Healey Act, or the Bacon–Davis Act, shall beconsidered to be commenced on the date when the complaintis filed; except that in the case of a collective or class actioninstituted under the Fair Labor Standards Act of 1938, asamended, or the Bacon–Davis Act, it shall be considered tobe commenced in the case of any individual claimant —

(a) on the date when the complaint is filed, if he isspecifically named as a party plaintiff in the complaint andhis written consent to become a party plaintiff is filed onsuch date in the court in which the action is brought; or

(b) if such written consent was not so filed or if his namedid not so appear — on the subsequent date on which suchwritten consent is filed in the court in which the action wascommenced.

SEC. 10. RELIANCE IN FUTURE ON ADMINISTRATIVERULINGS, ETC. —

(a) In any action or proceeding based on any act oromission on or after the date of the enactment of this Act,no employer shall be subject to any liability or punishmentfor or on account of the failure of the employer to pay mini-mum wages or overtime compensation under the Fair LaborStandards Act of 1938, as amended, the Walsh–Healey Act,or the Bacon–Davis Act, if he pleads and proves that theact or omission complained of was in good faith in conformitywith and in reliance on any written administrative regu-lation, order, ruling, approval, or interpretation, of theagency of the United States specified in subsection (b) ofthis section, or any administrative practice or enforcementpolicy of such agency with respect to the class of em-ployers to which he belonged. Such a defense, if established,shall be a bar to the action or proceeding, notwithstand-ing that after such act or omission, such administrativeregulation, order, ruling, approval, interpretation, practice,or enforcement policy is modified or rescinded or is de-termined by judicial authority to be invalid or of no legaleffect.

(b) The agency referred to in subsection (a) shall be —(1) in the case of the Fair Labor Standards Act of

1938, as amended — the Administrator of the Wage andHour Division of the Department of Labor;

SEC. 11. LIQUIDATED DAMAGES. — In any actioncommenced prior to or on or after the date of the enactmentof this Act to recover unpaid minimum wages, unpaidovertime compensation, or liquidated damages, under theFair Labor Standards Act of 1938, as amended, if theemployer shows to the satisfaction of the court that the actor omission giving rise to such action was in good faith andthat he had reasonable grounds for believing that his act oromission was not a violation of the Fair Labor StandardsAct of 1938, as amended, the court may, in its sound dis-cretion, award no liquidated damages or award any amountthereof not to exceed the amount specified in section 16 4 ofsuch Act.

SEC. 13. DEFINITIONS. —(a) When the terms “employer,” “employee,” and

“wage” are used in this Act in relation to the Fair LaborStandards Act of 1938, as amended, they shall have the samemeaning as when used in such Act of 1938.

(e) As used in section 6 of the term “State” means anyState of the United States or the District of Columbia orany Territory or possession of the United States.

SEC. 14. SEPARABILITY. — If any provision of this Actor the application of such provision to any person or cir-cumstance is held invalid, the remainder of this Act andthe application of such provision to other persons or circum-stances shall not be affected thereby.

SEC. 15. SHORT TITLE. — This Act may be cited as the“Portal-to-Portal Act of 1947.”

DECLARATION OF PURPOSE

SEC. 2. (a) The Congress hereby finds that theexistence in industries engaged in commerce or in theproduction of goods for commerce of wage differentialsbased on sex —

(1) depresses wages and living standards for em-ployees necessary for their health and efficiency;

(2) prevents the maximum utilization of the avail-able labor resources;

(3) tends to cause labor disputes, thereby burden-ing, affecting, and obstructing commerce;

(4) burdens commerce and the free flow of goodsin commerce; and

(5) constitutes an unfair method of competition.

(b) It is hereby declared to be the policy of this Act,through exercise by Congress of its power to regulatecommerce among the several States and with foreignnations, to correct the conditions above referred to in suchindustries.

[Section 3 of the Equal Pay Act of 1963 amends section 6of the Fair Labor Standards Act by adding a new sub-section (d). The amendment is incorporated in the revisedtext of the Act.]

EFFECTIVE DATE

SEC. 4. The amendments made by this Act shall takeeffect upon the expiration of one year from the date of itsenactment: Provided, That in the case of employeescovered by a bona fide collective bargaining agreement ineffect at least thirty days prior to the date of enactment ofthis Act, entered into by a labor organization (as defined insection 6(d)(4) of the Fair Labor Standards Act of 1938, asamended), the amendments made by this Act shall takeeffect upon the termination of such collective bargainingagreement or upon the expiration of two years from thedate of enactment of this Act, whichever shall first occur.
