Introduction The Goods & Services Tax (GST) comes into effect on 1 April 2015. Having the right GST knowledge is a step towards ensuring correct implementation, risk management and compliance improvement. This in turn will potentially help avoid time and resources needed to rectify GST errors, penalties for filing incorrect GST returns and unnecessary audits by Customs. The EY GST School provides an excellent opportunity to gain fundamental GST knowledge as well as updates and in-depth analysis on the practical issues and challenges businesses new to GST may face. Bernard Yap Partner and Indirect Tax Leader As the Indirect Tax Leader of EY Malaysia, Bernard has been actively involved in conducting GST awareness training for clients and speaking on GST at external / public sessions. He was involved in the submission of GST memorandums and discussions with the Tax Review Panel and Bank Negara Malaysia on GST for the financial services (both conventional and Islamic banks), insurance and takaful sectors. Bernard has 20 years’ experience in tax compliance and consultancy that includes conducting tax due diligence, tax documentation reviews and audits, tax planning schemes for large local and multi-national corporations, and applications for licences, incentives and tax exemptions. Bernard is also a partner of EY’s Global Financial Services (GFS) within the tax practice of EY Malaysia. As a member of the GFS team, Bernard has been involved in numerous transactions involving the insurance and financial market industries.

Aaron Bromley Partner, Indirect Tax Aaron has over 16 years of indirect tax experience, primarily in GST, across the Asia-Pacific region. Prior to joining EY Malaysia, Aaron was actively involved in the implementation of GST in Australia in 2000. Thereafter, he spent a brief period in China (Beijing) advising on Value Added Tax (VAT) technical matters and VAT reform. Aaron has been part of large multi-phase implementation projects and has advised a wide range of local and multi-national clients in various industries regarding GST implementation and GST technical matters, as well as facilitated discussions with the relevant tax authorities.

Yeoh Cheng Guan Partner, Indirect Tax Cheng Guan is a partner in the Indirect Tax and GST practice of EY Malaysia. He has over 17 years of tax experience, five of which were spent in corporate income tax compliance and advisory. Cheng Guan has been involved in providing advisory and compliance services on indirect tax matters covering service tax, sales tax, excise duty, customs importation /exportation, free zones, licensed manufacturing warehouses and duty exemption facilities. Cheng Guan is the Automotive Knowledge Leader for EY Malaysia. He serves a wide range of local and multinational clients in the automotive, consumer products and port industries, among others.

Koh Siok Kiat Executive Director, Indirect Tax Siok Kiat has more than 25 years’ experience in indirect tax, including having served the Royal Customs of Malaysia for more than 10 years. As a senior Customs Officer, he served in various divisions of the Royal Customs Department, including controlling a range of sales tax/service tax licensees, bonded and licensed premises, and conducting a number of investigations into breaches of the law and regulations. He is extensively involved in advising on indirect tax-efficient structuring and operations, cross-border planning and advisory, Customs valuation and Free Trade preferential tariffs planning for a wide variety of industries. Siok Kiat has been involved in the preparation, submission and discussion of the GST Memorandum to the Government for various industries including property development and construction, tourism, plantation, manufacturing and forest and timber. He has wide experience advising various organisations in Malaysia, including some of the leading GLCs and listed companies in the country, on preparations for the implementation of GST. A regular speaker at public seminars on GST and indirect tax issues, Siok Kiat is often invited to represent professional bodies and trade associations in dialogues and discussions with TRP to review and comment on GST legislation and guidelines.

Liza Drew Executive Director, Indirect Tax Liza has 18 years of experience in Indirect Tax. She is currently based in Kuala Lumpur overseeing the implementation of GST for a number of large banking and capital markets clients. Prior to joining EY Malaysia, Liza was the EMEA Head of Indirect Tax for Nomura International Plc which is Nomura’s European broker/dealer in London. She had also worked with Bear Stearns as the head of Indirect Tax and later with JP Morgan where she was responsible for integrating the legacy Bear Stearns business into JP Morgan following its acquisition of that entity. Liza’s additional positions of responsibility included regularly meeting with Her Majesty’s Revenue & Customs (HMRC) to highlight issues facing the financial services industry; lobbying for changes (at both UK and EU level); and assisting HMRC in drafting internal guidance pertaining to the financial services industry and providing training on VAT technical issues so that HMRC staff can better understand the industry and product offerings.

Dave Ananth Director, Tax Dave heads the Technical Unit of the Tax practice in EY Malaysia. He possesses a broad range of experience in the legal, investigation and commercial sectors in both Malaysia and New Zealand. Prior to joining EY Malaysia, Dave was a Senior Prosecutor at the Inland Revenue Department (IRD), Auckland, New Zealand where he prosecuted cases on GST fraud and tax evasion. He was extensively involved in the preparation of evidential sufficiency for cases under the Crimes Act and Tax Administration Act; preparation of charges/ information; advising internal clients on Revenue law and court appearances in the local District Courts and the High Court; sentencing submissions and arguing cases primarily within the Criminal/ Civil Jurisdictions in Court; as well as advising investigators regarding investigations and evidence/intelligence gathering. Dave was also an Adjudicator with the IRD, forming technical opinions on GST and taxation. In 2013, Dave became a Barrister Sole specializing in taxation based in Auckland, New Zealand.

Mike Vaughan Director, Indirect Tax Mike has been involved in Indirect Taxation for over 40 years. He started as an officer in the UK Customs & Excise Department, which was then the controlling body governing the administration and collection of the UK VAT. Later, Mike joined the accountancy profession, advising clients on all aspects of UK VAT. In 1993, he came to Asia, and as partner of a large accounting firm, was instrumental in assisting clients to assimilate the GST introduced in Singapore in 1994. Mike conducted many seminars for clients on the implementation of GST in Singapore. Following the GST implementation, Mike assisted clients by conducting GST health checks, representing them in meetings with the Tax authorities, preparing manuals to assist accounting staff and conducting seminars on niche topics affecting GST. Mike has lectured extensively on GST, and is the original co-author of the CCH Singapore GST Guide as well as the author of a CCH book regarding the implementation of GST in Hong Kong. He was also the Singapore correspondent of the International VAT Monitor.

Lindsey Cruickshanks Senior Manager, Indirect Tax Lindsey has over 12 years of Indirect tax advisory experience in the Netherlands and has worked on multi-disciplinary cross-border projects throughout Europe. During her career in the Netherlands, Lindsey led negotiations with the tax authorities on various topics to minimize client VAT risks. Lindsey has designed and delivered VAT data and diagnostic scans for various multinationals to support their tax controls. She is experienced in performing VAT / ERP reviews in various systems (SAP, Oracle, JD Edwards, etc.). She has advised clients in a broad range of industries including chemical and life sciences, high tech, IT services, packaging, paper, transport, oil and gas, consumer and automotive products. Lindsey relocated to Malaysia in 2014 to assist with the implementation of GST in Malaysia.

Elliot Severs Senior Manager, Indirect Tax Elliot has over 10 years of indirect tax experience, primarily in VAT and GST. Prior to joining EY Malaysia, Elliot was a GST Senior Compliance Officer with the Jersey Tax Authority, State of Jersey overseeing GST matters, which was introduced in May 2008. Prior to joining the Jersey Tax Authority, Elliot worked with Her Majesty’s Revenue & Customs (HMRC) and his last position there was VAT Assurance Higher Officer. During his time in HMRC, Elliot was involved in Assurance visits to customers with complex indirect tax issues and/or serious non-compliance, and preparing cases of serious non-compliance for submission to the Civil or Criminal sections. Elliot also provided technical advice and ensured that clients adhered to the correct and relevant laws.
