Come walk with me into the forest's blessed abode,

To see the wondrous beauty the Dehradun has bestowed;

We'll be lost in the greenery that surrounds us,

And listen to nature composing the melodious songs

As sounds of whispering trees and burbling streams,

Send our minds wandering into a poet's lovely dreams.

We'll walk where sunlight comes in the college arena,

Weaving open paths for our future to go

Where trees shade us from summer heat and harsh rays,

Freeing our minds so we can see calm our ways,

Of creating beautiful nature it nurtures all children,

Let nature grow so as the future of the young one.

Time to think about Appointment to the Higher Judiciary

The appointment of judges to the High Courts and the Supreme Court of India is

becoming a vexed issue and immediate solution needs to be found so that the justice

delivery system is not adversely affected. The Supreme Court of India by its judgement

in Supreme Court Advocates-on-Record Association vs. Union of India has assumed

authority in regard to the appointment of judges and it has held that the

recommendation of the collegium of the Supreme Court is final in the matter. Having

done so, it is the duty of the collegiums both at the High Court level as well as in the

Supreme Court to discharge the said responsibility with due diligence so that the best

amongst the available are appointed as judges to the higher judiciary. That apart, the

position in most of the High Courts in India is alarming as many of them are

functioning at half their strength. In order to maintain the sanctity of the collegium

system, the system needs to reinvent itself and come out in a new avatar. One of the

contentious issues in the present system is the manner in which the collegium selects a

particular name.

The Government has been alleging that there is a complete lack of transparency as well

as a lack of objectivity in the system. To allay the said apprehensions, the system

requires a relook. Suggestions- Each collegium should prescribe certain essential

qualifications for considering a name for elevation. The criteria can be, namely,

prescribing a particular age group in which lawyers are to be considered for elevation, a

minimum income for the particular High Court and it could be different for different

High Courts. Lastly, the number of minimum reported judgements that the candidate

Page 12: The Editorial Board · School, Gwalior. He graduated in B.Tech from IcfaiTech, Dehradun. Dr. Pawan K Aggarwal, Vice Chancellor, Dr. Muddu Vinay, Pro-Vice Chancellor, Brig.Rajiv Sethi

6

should have for elevation. Once these criteria are spelt out for different High Courts,

then a permanent secretariat should be created at each High Court to scan all the

names on the basis of the qualifications referred above amongst lawyers practicing in

the state as well as lawyers practicing in the Supreme Court from that state.

There are some outstanding lawyers practicing in the trial courts as well as practicing

in the tribunal and some of them working in law firms. It should be the endeavor of the

collegium system to find out the best candidates and do an extensive exercise of

searching into all possible names before finalizing its recommendation. The contention

that the judges in the collegium should know a candidate before making any

recommendation for his elevation is retrograde as this may result in the members of

the collegium resorting to favoritism. Once the qualifications are spelt out then every

lawyer fulfilling that qualification should be considered for elevation irrespective of

whether he appears in the courts of the members of the collegium or not. Accordingly,

distinguished members of the bar practicing in the Supreme Court will get an equal

opportunity for being elevated as judges of their parent High Court. Once such a

master list is prepared, the permanent secretariat should seek opinion or comments on

all these names from two eminent senior advocates practicing in the relevant High

Court nominated by the collegiums of the High Court so as to obtain their views with

regard to advisability of elevating such persons from that list as judges of the High

Court. The said master list along with the views of the senior advocates should then be

placed before the collegiums for their consideration who should then review all the

names before making their recommendations for elevation. This procedure will obviate

any possibility of nepotism, favoritism and will bring in complete transparency in the

appointment of judges. It should also be provided in the guidelines for appointment of

judges that if a relation or direct junior of collegium member is being considered for

elevation then he or she should rescue, and the next senior judge of collegium be co-

opted for the meeting of the collegium.

Whatsoever a man soweth, that shall he also reap

Life had been a Sturm und Drang. Treading on the knife’s edge; being succumbed to

affliction is all that I have ever got in my life. One never really contemplates what others

may feel, unless one goes through the same situation, a situation of melancholy,

sorrow, and tragedy.

Back in the days of my childhood, when we were naive, innocent and docile, we were

overwhelmed by felicity and glee. I have a blurred remembrance of a chubby little girl

named Amaira when I was in class eight.

She always used to remain silent and genteel but what devastating was that she was

bullyragged because she had a lisp. Words scarred her, rumors destroyed her and the

bullies killed her. The bullying didn’t stop, it only escalated. For years, she was tortured

and bullied for her appearance, weight and literally every single thing that made her,

her. She felt so terribly jaded and perturbed by the world, that a year later she

committed suicide. Oh! Her world turned dark and so did mine, as her last words still

keep reverberating in my ears.

“Tears have been flooding down my face; breathing is a task that now seems

impossible. I draw my legs closer and closer into my chest as I try to transform the

pressure into reassuring comfort. I begin

to slowly rock myself and by now my

tears have colored my pillow black.”

I feel elegiac and remorse fills my heart

when I recall this incident. Realization

dawned upon me, that it is no cliché that

words cause more pain than actions. The

first lesson her death taught everyone

around was that never ever hurt a person

by making fun of his/her weaknesses. We should also not forget the law of Nature that

what goes around comes around therefore we will be rewarded or punished according

to the good or bad deeds that we do.

8

Considering, the rough-sledding in my life, I also learnt that there are no mistakes but

only lessons that we need to master. We should always avoid toxic people as they defy

logic and we should use our weaknesses to complement our strengths. Above all, a

person should focus on the talents and qualities that he/she has and steadily grow into

a better human being in this enigmatic andprofound world.

‘A perplexed minor finally getting into college’

Everyone is much awaited to end their

school life and get enrolled into college life.

But as soon we reach we get into a situation

what’s next? What the hell we want to do

with our lives. We could go into medicine,

law, journalism, etc and most colleges offer

it. Your major has the potential to bring you

happiness or make you suffer during the

rest of your college career, as well as your

professional pursuits thereafter (no pressure). If you declare a neuroscience major and

realize that you completely hate all things that have to do with the brain, it might be

difficult to jump ship depending on how much time you have left in school. Choosing a

major may not be an easy feat, but once you learn a little bit about yourself, declaring

what you love will come easy (getting through the coursework will be the real problem).

If I talk about students I saw and experience during the First year it feels like the world

is at your fingertips. New faces all around, the enthusiasm of getting recognised,

beautiful places to wander with new friends seems like paradise. But that clock winds

down too quickly by the announcement of the first-semester exam and debarred list

though it creates a sign of heart attack among students, later it makes you realise a real

figure where the passion lie i.e. is definitely your academic area. It’s well said we need

to go for hard and easy rules to live life. Though college life is not easy yet it surely

gives a lifetime experience which gives a flashback to share our experience with others.

8th ICFAI Intra Moot Court Competition, 2020

Day: 1

On the fine drizzling afternoon of 28th January 2020 the gathering at the moot court

hall erupted. The ICFAI 9th Intra Moot Court Competition, 2020 was about to be started

in order to enhance the mooting, arguing and researching skills of the law students.

The event commenced by the lightening of the lamps by the Academic Coordinator Ms.

Monica Kharola, Moot Court Coordinator Mr. Suneel Kumar (Faculty of Law), Faculty

members Mr. Vishal Bera (Faculty of Law) and Mr. Avnish Bhatt (Faculty of Law). Post

lightning of the lamp Ms. Monica Kharola was called upon to deliver her fine few words

on the relevance of the competition which was followed by the speech of the Moot

Court Coordinator Mr. Sunil Kumar. After that, the competition was officially declared to

start.

All the participants were full of enthusiasm and were eagerly waiting for the rounds to

start. As determined by the fixtures, the core- committee member Mr. Suyash asked the

researchers of each team to approach one by one for the draw of lots of sessions. All

the participating teams were classified in two rounds slot. Preliminary Round 1 and

Preliminary Round 2 namely. Post this session, all the participants were directed to

approach their respective courtrooms. In the meanwhile, all the court masters were

asked to escort the judges to their respective courtrooms. In this chaotic atmosphere,

the rounds began at 3:15 p.m.

As per the proposition cited, the tussle of words was revolving around one general

contention on whether the consensual sex amounts to rape or not. On one hand, the

Page 69: The Editorial Board · School, Gwalior. He graduated in B.Tech from IcfaiTech, Dehradun. Dr. Pawan K Aggarwal, Vice Chancellor, Dr. Muddu Vinay, Pro-Vice Chancellor, Brig.Rajiv Sethi

63

judges were trying to elucidate the jurisdiction on which the appellant/respondents have

approached the Hon'ble Supreme Court where the appellate side contended that the

rape was maliciously committed with a fake promise to marry and since the Hon'ble HC

opposed the same logic ,the petitioners were bound to appeal to the Supreme Court to

get their grievances redressed. Contrary to this, the respondents argued that the

consent was not given under any misconception and concealment of facts. Since it was

sexual intercourse between two adults, the point of rape doesn't arise.

The arguments were majorly concerned with Article 136 of The Constitution of India,

Section 90, 376, and 417 of Indian Penal Code, 1860.

Whereas some of the court rooms, presiding judges were continuously grilling the

participants whereas in the other court rooms the same was a bit liberal.

Once the arguments and rebuttal rounds were over, the judges on the basis of the

performance of the teams marked them accordingly. This called upon the end of day 1

rounds

Day 2 (29th January 2020)

The second day of the event began with a lot of enthusiasm among the participants who

were qualified as the quarter-finalists. Out of 30 teams, only eight teams were able to

qualify the Quarter Final round. As determined by the fixtures the core committee

member asked the researchers of the qualified teams to approach the moot court hall for

the draw of lots session. Once the session got over, the teams were provided

with their respected courtrooms. In the mean while, all the court masters were

Page 70: The Editorial Board · School, Gwalior. He graduated in B.Tech from IcfaiTech, Dehradun. Dr. Pawan K Aggarwal, Vice Chancellor, Dr. Muddu Vinay, Pro-Vice Chancellor, Brig.Rajiv Sethi

asked to escort the judges to the courtrooms. Since the proposition for the quarter-finals

was the same as the first round, the arguments and contentions were revolving around

the same facts and issues. With the neck to neck competition in the quarter-finals, four

best teams emerged to qualify for the Semi-finals that was to take place on the same

day.

The qualified teams for the semi-finals were asked to gather for the draw of lots of

session. As soon as the session got over, in order to avoid further delay, the teams

directly proceeded towards their respective courtrooms and soon the arguments

commenced.

During the rounds, the respected Judges were enlightening the participants with

certain extra knowledge and were thus bringing more clarity in thoughts.

Day 3: Final

awaiting for the Finale of the 8th ICFAI Intra- Moot Court Competition -2019 to begin.

Quarters

The Quarters of a big event, the 1st Trial Advocacy Competition of the ICFAI University,

Dehradun was solemnized on 20/02/2020.

The event started with the enlightening words of In-charge ILS Dr. (Prof) Yugal Kishore

Sir, Prof. Mr. Suneel Kumar , and Prof. Miss Prachi . They shared the importance of

learning and accumulating the knowledge and experience gained from every

competition, thus giving a professional and practical approach towards life.

The fixtures were then announced and the rooms along with their respective Judges,

time-keepers and Judges scouts were decided. The competition commenced with full

enthusiasm among all participants.

The following was the fixture:-

1. TC:- 15 and TC:- 22

2. TC:- 24 and TC:- 08

Page 81: The Editorial Board · School, Gwalior. He graduated in B.Tech from IcfaiTech, Dehradun. Dr. Pawan K Aggarwal, Vice Chancellor, Dr. Muddu Vinay, Pro-Vice Chancellor, Brig.Rajiv Sethi

75

3. TC:- 28 and TC:-19

4. TC:-07 and TC:- 03

And, the Teachers assigned as Judges in the four rooms were Mr. SusantaShadangi Sir,

Miss Ekta Ma'am, Miss Prachi Mam, and Mr. Vagheesh Sir. All the teams tried bearing

fruits of all the hard work they had put in the research, rehearsals and so many other

things they have gone through in their preparation period. However, some teams

managed to impress the Judges with their intellectual and witty answers but some

teams couldn't give their best in managing stress involved in the challenging questions

thrown to them by the Judges as well as during the Cross-Examination sessions.

Some teams failed to produce the copy of FIR (one of the conclusive evidence),

handwriting expert's report to prove it or not the suicide note was written by the

deceased, medical expert's report to clarify the doubts involved in the fracture of C2-C3

and hyoid bone which are more common in cases of strangulation rather than hanging

and many more evidential documents as very precisely pointed by the learned Judges.

The Judges also tested the concepts of the participating teams by asking certain in-

depth questions on the criminal procedural laws (CrPC), Indian Evidence Act, Indian

Penal Code and certain factual questions for the concrete establishment of the case

from either side. They asked the basis of the advocate asking "leading questions" to the

witnesses, the importance of the statements given by the witnesses to the police,

technicalities involved in the concept of "burden of proof", admissibility of the suicide

note and several others, thus making the concepts crystal clear for future purposes.

They also posed questions on the facts given like why did the parents even fulfill the

demand of dowry for 6 long years as both giving and taking dowry is illegal in the eyes

of law or why did her parents not take any action against the cruelty she faced for 6

long years and are filing FIR only after their daughter is dead which certainly are some

important and thought-provoking questions to the present society as well. Thus, as very

accurately stated by the respectable teachers it was a great opportunity to learn a huge

chunk of important things in a short period of time. At the end the teams qualifying for

the semi-finals were announced which consisted of TC:- 15, TC:- 27, TC:- 24 and TC:-03

The semi-final rounds started with great enthusiasm amongst the teams. The teams

tried to impress the judges with their preparations and reversals that they went through

during the preparation period.

Some teams managed to impress the Judges with their intellectual and witty answers

but some teams couldn't give their best in managing stress involved in the challenging

questions thrown to them by the Judges as well as during the Cross-Examination

sessions.
