Litigation starsNoted not only for his general commercialwork but also for his grasp on white-collarcriminal and securities matters, New Yorkpartner Gandolfo DiBlasi enjoys a “superb”reputation at the firm for his strength infinancial services litigation. He successfully

represented client Goldman Sachs in asecurities litigation matter and is currentlyhandling another matter in Missouri. RobertGiuffra Jr is also praised for his generalcommercial work based out of New York. Whilemaintaining an active litigation practice,David Tulchin specializes in antitrust,contract, patent, trademark and securitiesmatters, with a client base including American

Express, Goldman Sachs, Merrill Lynch andMicrosoft. Noted for his work in generallitigation, but also for a specific strength inantitrust, John Warden maintains a strongclient list that includes British Airways,Goldman Sachs and Amax. Steven Holley’spractice focuses on antitrust, but alsoencompasses intellectual property andsecurities litigation.

ExperienceAlthough the firm boasts smaller numbers thanother New York firms, no one disputes thelitigation experience the Sullivan & Cromwellteam has brought to the table. “Sullivan &Cromwell takes on very complex cases, biggertypes of litigation,” one insider says. Besides hiswork for UnitedHealth, Giuffra also representsUBS in a securities class action in the NorthernDistrict of Alabama, in a derivative action in

Alabama state court and in governmentinvestigations arising out of UBS’ role asformer lead investment banker forHealthSouth. DiBlasi is praised for his workwith Goldman Sachs. He successfully reverseda class certification in a dot-com securitieslitigation matter for his client in the US Courtof Appeals for the Second Circuit.

In a matter for Microsoft, the firm recentlyrepresented its client in an antitrust dispute inIowa. Plaintiffs alleged that Microsoftunlawfully monopolized the markets throughanticompetitive conduct in violation of theIowa Competition Act, prompting them torecover damages in excess of $450 million.The case was brought as a class action onbehalf of all Iowa residents who were indirectpurchasers of operating systems and businessproductivity applications and ended in afavorable settlement.

The firm represents BP in the settlement ofDepartment of Justice and CommodityFutures Trading Commission investigationsof alleged commodities manipulation. Adeferred prosecution agreement with the DOJwas entered, as was a consent order with theCFTC. In its representation of The Bank ofNova Scotia in an action brought by 122former shareholders of Grupo FinancieroInverlat, the firm is battling allegations ofbreach of fiduciary duty, fraud, negligentmisrepresentation and a slew of other chargesagainst its client. Damages are currently inexcess of $100 million.

In continued representation of Barclays inthe Enron securities class action, the firm isinvolved in one of the largest and mostcomplex securities class actions in history.The district court ruled that the plaintiffs’claims against Barclays were deficient and theUS Court of Appeals for the Fifth Circuitreversed the class certification order.Recently, the US Supreme Court denied theplaintiffs’ petition for review of the FifthCircuit’s decision.

Other clients of note include Dyson, PhilipsElectronics and Solvay. The firm representsthe latter in response to the EuropeanCommission’s crackdown on alleged price-fixing cartel of producers of hydrogenperoxide and sodium perborate in Europe.Most lawsuits were consolidated as directpurchaser and indirect purchaser classactions, under the Sherman Act and variousstate laws, in US District Court for theEastern District of Pennsylvania.

Steven Holley is a member of S&C’s litigation group and a co-coordinatorof the firm’s antitrust group. His practice focuses on antitrust but alsoincludes copyright, patent and securities litigation, as well as complexcommercial disputes. Mr Holley has considerable experience advisingclients on competition issues, including reviews of prospective mergersand acquisitions and other investigations conducted by the Federal TradeCommission, the Antitrust Division of the US Department of Justice, theDirectorate-General for Competition of the European Commission andState Attorneys General. In recent years, Mr Holley has represented Goldman Sachs in purportedclass actions challenging consortium bids in private equity transactions andalleged price fixing by underwriters in initial public offerings, JC Flowers &Co in litigation surrounding the failed bid for Sallie Mae, UnitedHealthGroup in its acquisitions of Sierra Health and John Deere Health, Diageo inits acquisition of a 50% interest in Ketel One vodka and Rio Tinto inconnection with the unsolicited offer made by BHP Billiton.
