The following are revoked— (a) the following provisions of the Criminal Legal Aid (Remuneration etc.) (Amendment) Regulations 2015(d)— (i) regulations 1(2)(b) (commencement) and 2(2) (transitional provision), and (ii) subject to regulation 3, Part 3 (amendments coming into force on 1st April 2016) and Schedules 4 to 13; (b) the Criminal Legal Aid (Remuneration etc.) (Amendment) (No.2) Regulations 2015(e). Exceptions to revocation 3. The Criminal Legal Aid (Remuneration) (Amendment)

Regulations 2016

The Lord Chancellor makes these Regulations(a) in exercise of the powers conferred by sections

2(3), 13(4) and (5), 15(1), (6), (7) and (9), 21(2) and 41(1) to (3) of the Legal Aid, Sentencing and

Punishment of Offenders Act 2012(b).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Criminal Legal Aid (Remuneration)

(Amendment) Regulations 2016 and come into force on 31st March 2016.

(2) In these Regulations, “the Criminal Remuneration Regulations” means the Criminal Legal

Aid (Remuneration) Regulations 2013(c).

Revocation of amending instruments

2. The following are revoked—

(a) the following provisions of the Criminal Legal Aid (Remuneration etc.) (Amendment)

Regulations 2015(d)—

(i) regulations 1(2)(b) (commencement) and 2(2) (transitional provision), and

(ii) subject to regulation 3, Part 3 (amendments coming into force on 1st April 2016) and

Schedules 4 to 13;

(b) the Criminal Legal Aid (Remuneration etc.) (Amendment) (No.2) Regulations 2015(e).

Exceptions to revocation

3. Regulation 2(a)(ii) does not apply to the following provisions of regulation 6 of the Criminal

Legal Aid (Remuneration etc.) (Amendment) Regulations 2015 (amendments to the Criminal

Remuneration Regulations)(f)—

(a) Section 42(1) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (c. 10) provides that in Part 1 of that Act

“Regulations” means Regulations made by the Lord Chancellor and “prescribed” means prescribed by regulations (except in Schedule 6).

(b) 2012 c. 10. (c) S.I. 2013/435. (d) S.I. 2015/1369, amended by S.I. 2015/1678 and 2015/2049 (revoked by regulation 2(b) of these Regulations). (e) S.I. 2015/2049. (f) Amended by S.I. 2015/1678 and 2015/2049 (revoked by regulation 2(b) of these Regulations).

(a) paragraph (4)(b)(iii), (c) and (d) (amendments to regulation 17A: interim payment of

litigators’ fees);

(b) paragraphs (5) (amendment to regulation 21: hardship payments) and (6) (amendment to

regulation 28: redetermination of fees by appropriate officer);

(c) paragraph (7)(b)(i) and (ii) (amendments to paragraph 1(1) of Schedule 2: litigators’

graduated fee scheme – interpretation);

(d) paragraph (8)(f)(i) and (ii) (amendments to paragraph 5 of Schedule 4: rates payable for

the claims specified in regulation 8 – representation in the magistrates’ court).

Amendments to the Criminal Remuneration Regulations

4.—(1) The Criminal Remuneration Regulations are amended as follows.

(2) Schedule 2 (litigators’ graduated fee scheme) is amended as set out in Schedule 1 to these

Regulations.

(3) Schedule 3 (proceedings in the Court of Appeal) is amended as set out in Schedule 2 to these

Regulations.

(4) Schedule 4 (rates payable for the claims specified in Regulation 8) is amended as set out in

Schedule 3 to these Regulations.

Application and transitional provision

5. These Regulations do not apply to services made available pursuant to a determination made

before 1st April 2016 under section 13 (advice and assistance for individuals in custody), section

15 (advice and assistance for criminal proceedings) or section 16 (representation for criminal

proceedings) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument amends the Criminal Legal Aid (Remuneration) Regulations 2013 (S.I. 2013/435)

(“the Criminal Remuneration Regulations”), which provide for the remuneration of advice,

assistance and representation made available under sections 13, 15 and 16 of the Legal Aid,

Sentencing and Punishment of Offenders Act 2012 (c. 10) (“the Act”).

The Criminal Remuneration Regulations were amended by the Criminal Legal Aid (Remuneration

etc.) (Amendment) Regulations 2015 (S.I. 2015/1369) (“the Amending Regulations”), which were

amended by the Criminal Legal Aid (Remuneration etc.) (Amendment) (No.2) Regulations 2015

(S.I. 2015/2049). The Amending Regulations amend the fees payable under the Criminal

Remuneration Regulations in two respects: reducing fees under existing fee schemes (Part 2 of the

Amending Regulations) and introducing new fixed fee schemes (Part 3 of the Amending

Regulations), along with amendments consequential on the introduction of new contracts for the

provision of services made available under sections 13, 15 and 16 of the Act. Part 3 also makes a

number of minor clarificatory amendments to the Criminal Remuneration Regulations. Part 2 of

the Amending Regulations came into force on 1 July 2015; Part 3 was originally due to come into

force on 11 January 2016 but, by virtue of S.I. 2015/2049, comes into force on 1 April 2016.

Subject to the exceptions in regulation 3, regulation 2 of this instrument revokes regulations

1(2)(b) and 2(2) and Part 3 of, and Schedules 4 to 13 to, the Amending Regulations and S.I.

2015/2049. The effect of these revocations is that the fixed fee schemes provided for by Part 3 of

the Amending Regulations will not come into force. Regulation 3 ensures that the minor

clarifications to the Criminal Remuneration Regulations in regulation 6 of the Amending

Regulations (amendments to the Criminal Remuneration Regulations) are not revoked.

Regulation 4 of, and Schedules 1 to 3 to, this instrument amend the existing fee schemes by

increasing the fees for advice, assistance and representation made available under sections 13, 15

and 16 of the Act.

The instrument does not apply to work done pursuant to a determination under section 13, 15 or

16 of the Act made before 1st April 2016.
