a. Public Hearing for consideration of a COA (P18-130) for exterior repainting inhistorically accurate colors, the faqade of this house. It is located in the FirstRailroad Addition Landmarks District and Residential Low Density (R- L) Zoning.The dwelling is addressed as 108 E. Ilth Ave.

Chairwoman Edson opened the public hearing and explained the procedures of thehearing. She asked the appearance of fairness questions. There were no ob3ections tothe participation of any of the commissioners.

Senior Planner Kesler presented his staff report. He said the proposal is From Robert andPaula Hoctor to repaint the house located at 108 E. I1 'h Ave. It is a contributing edifice inthe historic district, and they are seeking to paint it three different colors, as depicted bythe color chips included in the packet. Although the LDC does not approve colors, staffand the applicant would like the color to be to in keeping with the historic neighborhood.

Mr. Kesler stated that the house is a good example of Colonial Revival, and the applicant'sgoal to repaint the fagade in colors compatible with the character of the historic district willnot detract from the historic character of the structure. He said that as such, staff finds theproposal to be in keeping with two of the building design standards of ECC 15.530.020 -

(a) and (b). Mr. Kesler stated that staff is recommending approval with one condition asoutlined in the staff report.

Chairwoman Edson asked if the applicant had anything to present. Paula Hoctor, 674Game Farm Road, approached the Commission and said they are really excited to bringthis property back to life, as it has been such an eyesore to the community.

There were no members of the public in the audience. Ms. Edson asked if Staff hadanything to add, and Mr. Kesler responded that it is clear from old aerial photography thatthe property has not been kept up well over the years, and this should be a greatimprovement for the historic district.

Chairwoman Edson closed the public hearing and opened the floor to deliberationamongst the commissioners. There was no discussion.

Commissioner Gibson read the Findings of Fact as found in the agenda report. She thenmade a motion to grant the COA for the repainting of the house located at 'I 08 E. 1l thStreet with one condition:

1. The applicant shall strip and repaint the house in a manner using best availableprocedures per the Secretary of Interior's Standards for Rehabilitation,Preservation Brief 10: Exterior Paint Problems on Historic Woodwork to ensure

that there is no damage to the wooden faqade of the building.

Commissioner McCoy seconded. No discussion.

All in favor, motion passed.

6. Ellensburg Downtown Association Update

None, no one from EDA was in attendance.

a. Commerce Dept. Training for Commissioners - Cle Elum City Hall, Council Chambers,119 W. Ist st., Cle Elum, WA 98922: Wed., Nov. 7, 2018, 6:15 - 9:15 pm.

b. Mr. Kesler noted that there will be two cases presented at the next meeting onNovember 11, and one case at the following meeting on December 4. Gibson notedshe would not be available if a second meeting is held in December. There wasdiscussion about the desire to try to consolidate the commission meetings to one permonth. Sackett indicated that Staff would take their request into consideration, butalso noted that it may not always be possible, depending on the timing of whenapplications are submitted. Further discussion was held on future work items for theCommission, including a review of the grant application criteria, as well as the yearlywork plan, and the demolition ordinance. Edson responded that she would definitelylike to come up with a better plan for the narrowing the focus of the grants, and evenlooking into possibilities for additional funding sources.

9. Commission Representative Updates

a. Chairwoman Edson wanted to discuss the recent public relations issue with the Tav.She feels it is a teachable moment. She offered to draft up a guest editorial to thenewspaper that provides information about the Landmarks and Design Commissionand the responsibilities of owning property in a historic district. She wanted to discussit with the other commissioners to determine how they would like to approach it. Afterdiscussion, Edson said she would draft up the editorial then email it to Director Sackettfor distribution and comment from the other commissioners. The Commission also

requested that staff send out a follow -up letter to the property owners, who alreadyreceived the brochure. They would also like to get more information on the City'swebsite. Stanley suggested including before and after photos of historic renovationdone correctly, and also examples of those done incorrectly.

b. Ms. Stanley spoke about a tour she went on in Portland. She said they have aPreservationist Guild, and she attended a lecture where they're trying to converthistoric properties into affordable housing.

Ms. McCoy made a motion to adjourn the meeting. Ms. Stanley seconded. ChairwomanEdson adjourned the meeting at 6:30 pm.

PROJECT TITLE: Public Hearing for Consideration of a Certificate of Appropriateness(COA) for a proposed repainting, in historically accurate colors, of the faqade of theirnew restaurant, The Red Pickle, in the former Black and White Service Station (1 930s).

PROJECT DECRIPTION: The property, addressed as 301 N. Pine Street (See VicinityAerial, Exhibit A) is identified as Parcel ID # 707033 and is zoned Central-Commercial(C- C). As depicted in the submitted elevation (Exhibit B.3), the applicant seeks torepaint the building in historically compatible colors. These colors are identified as LightFrench Gray, dark French Gray, Black magic and Rave Red. This COA application,P18-137 (Exhibit B), was received by the Department and determined to be a completeapplication, per ECC 1 5.280.090(C)(2)(b) on October 29, 2018.

TYPE OF REVIEW:

Review of proposed changes to landmarks register properties is required per ECC15.280.090(A), as follows:

A. Review Required1) No person shall alter, repair, enlarge, newly construct, relocate, or

demolish any registered landmark, or any property located within alandmark district, nor install any exterior sign or mural pursuant tosubsectron (A)(2) of this section, without review by the landmarks anddesign commission and issuance of a COA. In the case of murals, the artscommission shall first review and provide its recommendations to thelandmarks and design commission of any proposal for a mural to belocated on a registered landmark or within a landmark district. Factors tobe considered by the arts commission include media to be used, method

of application, stability, building/site, mural location and practicability ofprolect.

2) This review shall apply to all exterior features of the property visible from apublic right- of -way. This review applies whether or not a permit from thecity of Ellensburg is required.

3) Review oT alterations to Ellensburg landmarks register properties underthis chapter is in lieu of design review required for prolects and sign reviewper ECC 15.210.050(B).

Additionally, the Commission shall also review the Building Design criteria as found inECC Chapter 15.530. More specifically, the building design criteria which is applicableto historic buildings and districts in found in ECC 15.530.020, as follows:

ECC 15.530.020 Building Design: Historic Buildings and Districts

A. Purpose.downtown

To preserve and reinforce the historic character of Ellensburg'sand older residential areas.

B. Historic Buildings and Districts Standards and Guidelines.

1) All development projects identified on the Ellensburg landmarks register aresublect to review by the Ellensburg landmarks and design commission perChapter 15.280 ECC and conformance with the following design standardsfor rehabilitating existing buildings.

a. Retain and preserve the overall historic character of the building;b. Ensure that proposed alterations are compatible with the building's own

architectural character, and do not create a false historical appearance;c. Retain and preserve early alterations which have architectural significance

in their own right;d. Treat distinctive original features, finishes, and examples of skilled

craftsmanship with sensitivity;e. Repair rather than replace deteriorated architectural features whenever

possible;f. Use the gentlest means possible when surface cleaning exterior masonry;g. Protect and preserve significant archaeological sites affected by the

project, or provide mitigation for their disturbance; andh. Design new additions to existing buildings and new infill construction to be

compatible with the massing, scale, materials, and architectural featuresof adlacent historic structures.

These standards are supplemented and further defined or explained by thatdocument entitled "Design Standards for the City of Ellensburg," as currentlyenacted.

2) Property owners of historic district buildings are also encouraged to use theSecretary of the Interior's Standards for the Treatment of Historic Properties

(web: https://www.nps.qov/tps/how- to- preserve/briefs.htm) (hard copy alsoavailable at City Hall) as a guide to preserve, rehabilitate, restore, reconstruct,or add to historic properties. These standards provide detailedrecommendations on restoration, maintenance, repair, replacement, design,alterations, building materials, roofs, interiors, etc. [Ord. 4656 § 1 (Exh. 02),2013.]

ST AFF COMMENTS:

The building where the Red Pickle Restaurant is relocating is a vernacular one- storyenframed window wall style building (Richard Longstreth, The Buildings of Main Street,p. 68), formerly known as the Black and White Service Station (circa 1930). A slightlytaller section with windows on the north side of the building is where the bays for theautos were located. At one time, there were gasoline pumps in the current parking lot,but these were gone by the l960s. Later, a dry cleaners operated in the building andmost recently, it was a D&M Coffee location. D&M moved to a larger space in theGeddes Building in 2017. The Red Pickle is proposing to open in 2019. The buildingremains relatively intact and is a contributing edifice in the Downtown EllensburgNational Register and local Landmarks Districts.

Per the narrative (Exhibit B.2), the applicants seek to have the whole fagade of thebuilding painted. The illustration of the elevation shows that the walls would be a "LightFrench Gray", the trim and one of the doors would be a "Classic French Gray", thefascia would be painted "Black Magic", while the main entry door would be "Rave Red"(Exhibit B.3).

By repainting, the applicants seek to maintain, protect and enhance this historicresource. In review of the criteria found in ECC 15.530.020(B)(1), staff finds thatpainting the structure in the colors proposed will not detract from the overall historiccharacter of the building, nor create a false historical appearance. Therefore, thisproject meets the following two criteria of said section:

a) Retains and preserve(s) the overall historic character of the building, andb) Ensure(s) that proposed alterations are compatible with the building's own

architectural character and do not create a false historical appearance

RECOMMENDATION:

Staff has reviewed the criteria in the Code and recommends that the Certificate of

Appropriateness (COA) be granted by the Commission for repainting the faqade of TheRed Pickle, 301 N. Pine st., In historically accurate colors, as proposed, with onecondition:

1. The applicant shall do the work using best available procedures per theSecretary of Interior's Standards for Rehabilitation, Preservation Brief 11:Rehabilitating Historic Storefronts, to ensure that the historic elements of theedifice are preserved and there is no damage to the faqade of the building.

If the Commission should choose to follow the recommendation of Staff and approvethe COA, Staff would advise the Commission that the following Findings of Fact areapplicable to this project:

1. Per ECC Sections 15.280.090 and 15.530.020, the LDC has jurisdiction to reviewthis project.

2. The project has been found to be indesign standards of ECC 15.530.020,

keeping with two of the required buildingspecifically that it:

a) Retains and preserve(s) the overall historic character of the building, andb) Ensure(s) that proposed alterations are compatible with the building's own

architectural character and do not create a false historical appearance.

3. The Applicants are the owners of the Red Pickle and agents for Faust andRudolph, LLC, owner of the building, addressed as 301 N. Pine St. It is located inboth the Downtown Ellensburg National Register and local Landmarks Districts towhich it is a contributing building.

4. It is in the interest of the City of Ellensburg to have historic buildings maintained.This proposal, if approved with one condition, would not negatively alter thecharacter- defining features of the historic building, but rather, enhance andpreserve them.

In addition, if no public comment is received during the public hearing portion of themeeting, the following Finding of Fact would also be applicable:

5. No public comment was received.

Afier the close of the public hearing, if it is determined additional findings of fact arepertinent, they should consist of concise statements of the underlying facts in support ofthe decision made by the Landmarks & Design Commission. Findings of Fact should bemade by the Commission, regardless of whether the prolect is approved or denied.

When making the final motion, the Commission may also include any conditions ofapproval that are appropriate to this application.

PROJECT TITLE: Public Hearing for Consideration of a Certificate of Appropriateness (COA)for attaching a new 7' by 3' lighted green sign to the north faqade of the Kelley Realty Building(1988).

PROJECT DECRIPTION: The property is zoned Central- Commercial (C- C), and is located onthe corner of 6'h Avenue and Main St. It is addressed as 508 N. Main st., Parcel ID # 76933(see Vicinity Aerial, Exhibit A). The edifice is located in the Downtown Ellensburg NationalRegister and local Landmarks Districts, but it is a noncontributing building constructed in 1988.Per the narrative, the applicant seeks approval of a seven foot (7') wide by three foot (3') highsign that reads, "Bob Kelley Realty, Inc." and "www.kelleyrealty.com" (Exhibit B.2). This COAapplication, P18-139, was received by the Department and determined to be complete, per ECC1 5.280.090(C)(2)(b) on October 29, 2018 (Exhibit B).

TYPE OF REVIEW:

Review of proposed changes to landmarks register properties is required per ECC15.280.090(A), as follows:

A. Review Required1 ) No person shall alter, repair, enlarge, newly construct, relocate, or demolish any

registered landmark, or any property located within a landmark district, nor installany exterior sign or mural pursuant to subsection (A)(2) of this section, withoutreview by the landmarks and design commission and issuance of a COA. In thecase of murals, the arts commission shall first review and provide itsrecommendations to the landmarks and design commission of any proposal for amural to be located on a registered landmark or within a landmark district.Factors to be considered by the arts commission include media to be used,method of application, stability, building/site, mural location and practicability ofproject.

2) This review shall apply to all exterior features of the property visible from a publicright- of-way. This review applies whether or not a permit from the city ofEllensburg is required.

3) Review of alterations to Ellensburg landmarks register properties under thischapter is in lieu of design review required for projects and sign review per ECC15.21 0.050(B).

Additionally, the Commission shall also reviewChapter 15.530. More specifically, the buildingbuildings and districts in found

the Building Design criteria as found in ECCdesign criteria which is applicable to historicin ECC 15.530.020, as follows:

ECC 15.530.020 Building Design: Historic Buildings and Districts

A. Purpose. To preserve and reinforce the historic character of Ellensburg's downtownand older residential areas.

B. Historic Buildings and Districts Standards and Guidelines.

1 ) All development projects identified on the Ellensburg landmarks register are subjectto review by the Ellensburg landmarks and design commission per Chapter 15.280ECC and conformance with the following design standards for rehabilitating existingbuildings.

a. Retain and preserve the overall historic character of the building;b. Ensure that proposed alterations are compatible with the building's own

architectural character, and do not create a false historical appearance;c. Retain and preserve early alterations which have architectural significance in

their own right;d. Treat distinctive original features, finishes, and examples of skilled

craftsmanship with sensitivity;e. Repair rather than replace deteriorated architectural features whenever

possible;f. Use the gentlest means possible when surface cleaning exterior masonry;g. Protect and preserve significant archaeological sites affected by the pro3ect,

or provide mitigation for their disturbance, andh. Design new additions to existing buildings and new infill construction to be

compatible with the massing, scale, materials, and architectural features ofadjacent historic structures.

These standards are supplemented and further defined or explained by that documententitled "Design Standards for the City of Ellensburg," as currently enacted.

2) Property owners of historic district buildings are also encouraged to use theSecretary of the Interior's Standards for the Treatment of Historic Properties (web:https://www.nps.qov/tps/how- to- preserve/briefs.htm) (hard copy also available at CityHall) as a guide to preserve, rehabilitate, restore, reconstruct, or add to historicproperties. These standards provide detailed recommendations on restoration,maintenance, repair, replacement, design, alterations, building materials, roofs,interiors, etc. [Ord. 4656 § I (Exh. 02), 2013.1

ST AFF COMMENTS:

The site where this edifice was built in 1988 was always vacant in prior years. However,immediately south of it, where the parking lot for this business currently sits, once stood theSmith Bldg. Built after the Great 1889 Fire, the Smith Bldg. Iater served as an annex for theKittitas County Courthouse. A jail was attached to be rear of this building by the 1 920s, also theera when the now UPS Building was constructed on the same parcel, facing 6'h Avenue. TheSmith Building and the 3ail annex were demolished sometime in the 1950s, when the originalKittitas County Courthouse Building met a similar fate.

Per the submittal (Exhibit B), the proposed sign would be seven feet (7') wide, three feet (3')high and six inches (18") deep. The sign, at twenty-one (21) sq. ft., does not exceed the sizelimitation of 300 sq. ft. for signage in the Central Commercial Zoning District (C- C). Thenarrative notes that it would be a "new alumtnum fabricated cabtnet with routed faces patnteddark green; a new white plastic with 1s' surface yellow and Apple Green vinyl overlay. Thecabinet [would bel tnternally lit by white LEDs."

While the sign is a new metal, plastic and vinyl one, it is not being placed on an historic buildingin the Downtown Landmarks District. Rather, it will be on a newer, noncontributing edifice. Thebusiness owner is seeking a new sign, because his monument sign on the southwest corner ofthe property will be removed due to the forthcoming loss of visibility that will occur afterconstruction of the new Windrow on the adjacent property to the south.

In review of the criteria found in ECC 1 5.530.020(B)(1 ), staff finds that the proposed signage ona noncontributing building will not detract from the overall historic character of theneighborhood, nor will it create a false historical appearance on the building itself. As such,staff Tinds that this project meets the following two criteria of said section (cited above):

a) Retains and preserve(s) the overall historic character oT the historic district, andb) Ensure(s) that the proposed alterations are compatible with the building's own

architectural character and do not create a false hrstorical appearance.

When lighted signs have been approved previously by this Commission to be placed onbuildings in the Downtown Landmarks District, restrictions have been placed on the hours thatthe signs may be illuminated. Staff recommends the exact same condition be placed on theapproval of this sign for Bob Kelley Realty.

RECOMMENDATION: Staff has reviewed the criteria in the Code and recommends that theCertificate of Appropriateness (COA) be approved by the LDC for attaching a new 7' by 3'lighted green sign to the north Fagade oT the Kelley Realty Building (1988), with one condition.

1. The sign shall be illuminated from dusk to 10:00 pm only.

If the Commission should choose to follow the recommendation of Staff and approve theCertificate of Appropriateness (COA), Staff would advise the Commission that the followingFindings of Fact are applicable to this project:

1. Per ECC Sections 15.280.090 and 15.530.020, the LDC has jurisdiction to review thisproject.

2. The project has been found to be in keeping with two of the required building designstandards of ECC I 5.530.020(B)(1 ), specifically that it:

a) Retains and preserve(s) the overall historic character of the historic district, andb) Ensure(s) that proposed alterations are compatible with the building's own

architectural character and do not create a false historical appearance.

3. The Applicant is the agent for the owner of this building and can pursue this action. Thebusiness is addressed as 508 N. Main st., located in the Downtown Ellensburg NationaJRegister and local Landmarks Districts.

4. It is in the interest of the City of Ellensburg to protect the historic integrity and characterof historic districts. The proposed new lighted sign should not negatively impact thedistrict, particularly with the condition limiting the hours that it can be illuminated.

In addition, if no public comment is received during the public hearing portion of the meeting, thefollowing Finding of Fact would also be applicable:

After the close of the public hearing, if it is determined that additional findings of fact arepertinent, they should consist of concise statements of the underlying facts in support of thedecision made by the Landmarks & Design Commission. Findings of Fact should be made bythe Commission, regardless of whether the pro3ect is approved or denied.

When making the final motion, the Commission may also include any conditions of approval thatare appropriate to this application.
