munity Development is authorized toenter into or amend contracts withvarious agencies to provide housing,commercial, industrial and real estatedevelopment activities.Section 2. That the cost of the con-

tracts authorized in this ordinanceshall not exceed $1,381,960 and anyprior years balances from Fund Nos.14 SF 039, 14 SF 040, and 14 SF 041,RQS 8006, RL 2015-0061.

Building and Housing is authorizedto make one or more written require-ment contracts under the Charter andthe Codified Ordinances of Cleveland,Ohio, 1976, for the requirements for aone or two year period for the items oflabor and materials necessary toimplement the Board-up Program, inthe approximate amount as pur-chased during the preceding term, tobe purchased by the Commissioner ofPurchases and Supplies on a unitbasis for the Department of Buildingand Housing. Bids shall be taken in amanner that permits an award to bemade for all items as a single con-tract, or by separate contract for eachor any combination of the items as theBoard of Control determines. Alter-nate bids for a period less than thespecified term may be taken ifdesired by the Commissioner of Pur-chases and Supplies until provision ismade for the requirements for theentire term. The Director of Buildingand Housing is authorized to enterinto one or more contracts with a termof two years instead of one year whenthere is a financial advantage to theCity. For purposes of this ordinance, afinancial advantage shall be deter-mined by the Director of Building andHousing by comparing the bidsreceived for both terms.Section 4. That the costs of the con-

tract or contracts shall be chargedagainst the proper appropriationaccounts and the Director of Financeshall certify the amount of any pur-chase under the contract, each ofwhich purchases shall be made on

order of the Commissioner of Pur-chases and Supplies under a deliveryorder against the contract or con-tracts certified by the Director ofFinance.Section 5. That prior to expending

funds under this ordinance, the Direc-tor of Building and Housing and theDirector of Community Developmentshall enter into a memorandum ofunderstanding for this program.Section 6. That the Director of

Building and Housing is authorizedto accept monies in repayment underthe program and to utilize CDBG pro-gram income and any prior years bal-ances for making additional expendi-tures under this program, and thefunds are appropriated for that pur-pose.Section 7. That the Director of

Building and Housing is authorizedto collect from persons or entitiesfrom whom the City is collectingdemolition costs an amount equal toany amount spent for services relatedto collection of demolition cost, suchas title searches, credit bureaureports, and document filing fees.Any funds collected shall be deposit-ed into Fund No. 14.Section 8. That this ordinance is

The City agrees to be responsi-ble for all utility accommodation,relocation, and reimbursement andagrees that all such accommodations,relocations, and reimbursementsshall comply with the current provi-sions of 23 CFR 645 and the ODOTUtilities Manual.Section 5. Maintenance. Upon com-

pletion of the Improvement, andunless otherwise agreed, the Cityshall: (1) provide adequate mainte-nance for the Improvement under allapplicable state and federal laws,including, but not limited to, 23 USC116; (2) provide ample financial provi-sions, as necessary, for the mainte-nance of the Improvement; (3) main-tain the right-of-way, keeping it freeof obstructions; and (4) hold saidright-of-way inviolate for public high-way purposes.Section 6. That the Director of Capi-

tal Projects is authorized to enter intocontracts with ODOT pre-qualifiedconsultants for the preliminary engi-neering phase of the Improvementand to enter into contracts with theDirector of Transportation necessaryto complete the above described pro-ject. Upon the request of ODOT, theDirector of Capital Projects is alsoauthorized to assign all rights, title,and interests of the City to ODOT aris-ing from any agreement with its con-sultant in order to allow ODOT todirect additional or corrective work,recover damages due to errors oromissions, and to exercise all othercontractual rights and remediesafforded by law or equity.Section 7. That the City agrees that

if Federal Funds are used to pay thecost of any consultant contract, theCity shall comply with 23 CFR 172 inthe selection of its consultant and theadministration of the consultant con-tract. Further, the City agrees toincorporate ODOT’s “Specificationsfor Consulting Services” as a contractdocument in all of its consultant con-tracts. The City agrees to require, as ascope of services clause, that all plansprepared by the consultant must con-form to ODOT’s current design stan-dards and that the consultant shall beresponsible for ongoing consultantinvolvement during the constructionphase of the Improvement. The Cityagrees to include a completion sched-ule acceptable to ODOT and to assistODOT in rating the consultant’s per-formance through ODOT’s ConsultantEvaluation System.

Section 8. That this Councilrequests the State to proceed with theImprovement.Section 9. That the Director of Capi-

tal Projects is authorized to apply forand accept any gifts or grants for thispurpose from any public or privateentity, including but not limited toNOACA; and that the Director isauthorized to file all papers and exe-cute all documents necessary toreceive the funds under the grant; andthat the funds are appropriated forthe purposes described in this ordi-nance.Section 10. That, when appropriate,

Section 1. That the Director ofFinance is authorized to employ bycontract or contracts one or more con-sultants or one or more firms of con-sultants for the purpose of supple-menting the regularly employed staffof the several departments of the Cityof Cleveland in order to provide pro-fessional services necessary to pro-vide administration of Family andMedical Leave Act benefits for Cityemployees, for a period of one year,with a one-year option to renew, exer-cisable by the Director of Finance.The selection of the consultants for

the services shall be made by theBoard of Control on the nomination ofthe Director of Finance from a list ofqualified consultants available foremployment as may be determinedafter a full and complete canvass bythe Director of Finance for the pur-pose of compiling a list. The compen-sation to be paid for the services shallbe fixed by the Board of Control. Thecontract or contracts authorized shallbe prepared by the Director of Law,approved and certified by the Direc-tor of Finance.Section 2. That the cost of contract

or contracts authorized shall be paidfrom any and all funds approved bythe Director of Finance.Section 3. That this ordinance is

Whereas, this ordinance constitutes an emergency measure providing for the usual daily operation of a munic-

ipal department; now, therefore,
