Regular City Council Meeting of September 9, 2019
The City Council of the City of Princeton, Texas, met in regular session in the
Council Chamber of City Hall on September 09, 2019 at 6:30 p.m.
The following Councilmembers were present: Councilmember David Kleiber, Mayor
Pro-Tempore Rich Hooper, Councilmember Nikki Krum, and Councilmember Steve
Deffibaugh. Mayor John – Mark Caldwell was present. The following Councilmembers
were absent: Councilmember Richard Sheehan. The following Staff Members were
present: City Manager Derek Borg, Assistant City Manager Lesia Gronemeier, City
Secretary Tabatha Monk, Finance Director Carron Prigmore, Director of Development
Services Shawn Fort, Police Chief Mark Moyle, Police Captain James Waters, Police
Sergeant Jeremy Watts, Fire Chief Tom Harvey, Director of Public Works Tommy
Mapp, Parks and Recreation Director Chase Bryant, Marketing Director Deb Cooke and
Communications Specialist Nakia Patton.
Mayor Caldwell called the City Council Meeting to order at 6:30 PM.
Mayor Caldwell called roll, present were Councilmembers David Kleiber, Rich
Hooper, Nikki Krum and Steve Deffibaugh.
Pastor Wes Brown, led the audience in the invocation.
Councilmember Kleiber then led the audience in the Pledge of Allegiance.
Mayor Caldwell then announced Citizen Appearance. No one spoke under
citizens appearance.
Mayor Caldwell then announced the Consent Agenda: All consent agenda items
listed are considered to be routine by the City Council and will be enacted
by one motion. There will be no separate discussion of these items unless a

Councilmember so request, in which event the item will be removed from the Consent
Agenda and considered in its normal sequence on the agenda. Items on the Consent
Agenda were: Discussion and possible action regarding the minutes of the August 26,
2019, Regular City Council meeting. Discussion and possible action regarding
Ordinance, 2019-09-09, amending the Drought Contingency Plan for the City of
Princeton Councilmember Deffibaugh made a motion to approve the Consent
Agenda. Councilmember Kleiber seconded the motion to approve. The motion
carried unanimously.
Mayor Caldwell then announced the first item under the Regular Agenda:
(2019-185) “Discussion and possible action regarding Ordinance, 2019-09-09-01, to
Ratify Tax Rate for Fiscal Year 2019-2020.” Councilmember Deffibaugh made a
Motion to approve the consent agenda. Councilmember Krum seconded the
motion. The motion carried unanimously.
Mayor Caldwell then announced the second item under the Regular Agenda:
(2019-186) “Discussion and possible action regarding Ordinance, 2019-09-09-02,
adopting the budget for Fiscal Year 2019-2020.” Councilmember Deffibaugh made
a motion to approve. Mayor Pro-Tempore Hooper seconded the motion. The
motion carried unanimously.
Mayor Caldwell then announced the third item under the Regular Agenda:
(2019-187) “Discussion and possible action regarding Ordinance, 2019-09-09-03,
adopting the City of Princeton ad valorem tax rate for Fiscal Year 2019-2020.”
Councilmember Krum made a motion to approve. Councilmember Kleiber seconded
the motion. The motion carried unanimously.

Mayor Caldwell then announced the fourth item under the Regular Agenda:
(2019-188) “Discussion and possible action regarding Ordinance, 2019-09-09-04, for a
voluntary annexation of property, Lots 1-12, Block A Quail Ridge Estates. a 19.989 acre
tract of land situated in the Hardin Wright Survey, Abstract Number 957, in Collin
County, Texas as recorded under instrument No. 20060504000599410 of the Deed
Records of Collin County, Texas.” Councilmember Krum made a motion to approve.
Mayor Pro-Tempore Hooper seconded the motion. The motion carried
unanimously.
Mayor Caldwell then announced the fifth item under the Regular Agenda:
(2019-189) “Discussion and possible action regarding Resolution, 2019-09-09-R,
establishing the allocation of funds for the reconstruction of the City Portion of County
Road 1219.” Mayor Pro-Tempore Hooper made a motion to approve. Councilmember
Deffibaugh seconded the motion. The motion carried unanimously.
Mayor Caldwell then announced the sixth item under the Regular Agenda:
(2019-190) “Discussion and possible action regarding Resolution, 2019-09-09-R-01,
Brookside Phase 1 SAP update.” Councilmember Krum made a motion to approve.
Councilmember Deffibaugh seconded the motion. The motion carried
unanimously.
Mayor Caldwell then announced the seventh item under the Regular Agenda:
(2019-191) “Discussion and possible action regarding Resolution, 2019-09-09-R-02,
Arcadia Farms Phases 8 and 9 SAP Update.” Councilmember Deffibaugh made a
motion to approve. Councilmember Kleiber seconded the motion. The motion
carried unanimously.

Mayor Caldwell then announced the eighth item under the Regular Agenda:
(2019-192) “Discussion and possible action regarding Resolution, 2019-09-09-R-03,
Arcadia Farms Phases 1 and 2 SAP update.” Councilmember Krum made a motion to
approve. Councilmember Deffibaugh seconded the motion. The motion carried
unanimously.
Mayor Caldwell then announced the ninth item under the Regular Agenda:
(2019-193) “Discussion and possible action regarding Resolution, 2019-09-09-R-04,
Crossroads SAP update.” Mayor Pro-Tempore Hooper made a motion to approve.
Councilmember Krum seconded the motion. The motion carried unanimously.
Mayor Caldwell then announced the tenth item under the Regular Agenda:
(2019-194) “Discussion and possible action regarding filling Seat 3 on the Economic
Development Board.” Councilmember Krum made a motion to approve Dylan
Griffiths to fill the EDC Seat 3 position. Councilmember Deffibaugh seconded the
motion. The motion carried unanimously.
Mayor Caldwell then announced the eleventh item under the Regular Agenda:
(2019-195) “Discussion and possible action regarding an update from Code
Enforcement as requested by Councilmember Krum.” No action was needed.
Mayor Caldwell then announced the twelfth item under the Regular Agenda:
(2019-196) “Possible action to approve request for items to be placed on a future
agenda and NOT for discussion of these requests.” No items were requested. Mayor Caldwell then announced the Report Agenda: City Manager:

City Council reports about items of community interest regarding which no action will
be taken: 911 Ceremony at 7:30 a.m. at the Princeton Fire Station; Emmitt Smith
foundation bike ride on Saturday, September 14th @8:00 a.m.; Councilmember Krum
reminded everyone of the upcoming Chamber of Commerce Luncheon and the
VFW fundraiser.
Councilmember Krum made a motion to adjourn. Councilmember Deffibaugh
seconded the motion. The motion carried unanimously.
Mayor Caldwell adjourned the meeting at 6:58 p.m.

RESOLUTION NO. 2019-09-23-R
A RESOLUTION OF THE CITY OF PRINCETON, TEXAS CALLING A PUBLIC HEARING TO CONSIDER AN ORDINANCE LEVYING ASSESSMENTS ON PROPERTY LOCATED WITHIN PHASE 1 OF THE WINCHESTER PUBLIC IMPROVEMENT DISTRICT; DIRECTING THE PUBLICATION AND MAILING OF NOTICE OF SUCH PUBLIC HEARING
WHEREAS, the Public Improvement District Assessment Act, Texas Local Government Code, Chapter 372, as amended (the "Act") authorizes the governing body (the "City Council") of the City ofPrinceton, Texas (the "City"), to create a public improvement district within the City; and
WHEREAS, the City Council has approved a resolution (the "Authorization Resolution"), authorizing, establishing and creating the Winchester Public Improvement District (the "District"); and
WHEREAS, the Act requires that a public hearing (the "Assessment Hearing") be held to consider proposed assessments and requires the City Council to hear and pass on any objections to the proposed assessments at, or on the adjournment of, the Assessment Hearing; and
WHEREAS, the Act requires that notice of the Assessment Hearing be published in a newspaper of general circulation in the City before the 10th day before the date of the Assessment Hearing;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRINCETON, TEXAS AS FOLLOWS:
SECTION 1. The recitals set forth above in this Resolution are true and correct and are hereby adopted as findings of the City Council and are incorporated into the body of this Resolution as if fully set forth herein.
SECTION 2. The City Council hereby calls a public hearing (the Assessment Hearing as defined above) to be held on October 14, 2019 at 6:30 p.m. in the regular meeting place of the City Council in the Council Chamber in the City Hall located at 123 W. Princeton Drive, Princeton, Texas, 75407, at which the City Council shall, among other actions, hear and pass on any objections to the proposed assessmentson Phase 1 of the District (“Phase 1”) ; and, upon the adjournment of the Assessment Hearing, the CityCouncil may consider an ordinance levying the assessments as special assessments on certain property within Phase 1 (which ordinance shall specify the method of payment of the assessments).
SECTION 3. The City Council hereby authorizes and directs the City Secretary to publish notice of the Assessment Hearing, in substantially the form attached hereto as Exhibit A and incorporated herein for all purposes, in a newspaper of general circulation in the City, as required by Section 372.016(b) of the Act.
SECTION 4. The City Council hereby authorizes and directs the City Secretary to mail notice of the Assessment Hearing to owners of property liable for the assessment, as required by Section 372.016(c) of the Act.
SECTION 5. This Resolution shall become effective from and after its date of passage in accordance with law.

EXHIBIT A
CITY OF PRINCETON, TEXASNOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN THAT a public hearing will be conducted by the City Council of Princeton, Texas at 6:30 p.m. on October 14, 2019 at Princeton City Hall, 123 West Princeton Drive, Princeton, TX 75407. The public hearing will be held to consider proposed assessments to be levied against certain assessable property within Phase 1 of the Winchester Public Improvement District("District") pursuant to the provisions of Chapter 372 of the Texas Local Government Code, as amended (the "Act").
The general nature of the proposed improvements authorized by the Act to be undertaken and financed for the benefit of certain property within the District (the "Authorized Improvements") include: (i) landscaping; (ii) erection of fountains, distinctive lighting, and signs; (iii) acquiring, constructing, improving, widening, narrowing, closing, or rerouting of sidewalks or of streets, any other roadways, or their rights-of-way; (iv) construction or improvement of pedestrian malls; (v) acquisition and installation of pieces of art; (vi) acquisition, construction, or improvement of off-street parking facilities; (vii) acquisition, construction, or improvement of water, wastewater, or drainage facilities or improvements; (viii) the establishment or improvement of parks; (ix) projects similar to those listed in (i)-(viii); (x) acquisition, by purchase or otherwise, of real property in connection with an authorized improvement; (xi) special supplemental services for improvement and promotion of the District, including services relating to advertising, promotion, health and sanitation, water and wastewater, public safety, security, business recruitment, development, recreation, and cultural enhancement; (xii) payment of expenses incurred in the establishment, administration, and operation of the District; and (xiii) payment of costs associated with developing and financing the public improvements listed above, including costs of establishing, administering and operating the District and paying costs of issuance, reserve funds or credit enhancement of bonds or other obligations issued to finance the improvements. These Authorized Improvements shall promote the interests of the City and confer a special benefit upon the Property. The total costs of the Authorized Improvements will be approximately $24,722,356.
The District includes approximately 178 acres of land generally located west of Sheamar Lane and South of Myrick Lane and within the city limits, and Phase 1 includes 45.43 acres as described in the metes and bounds description attached hereto. All written or oral objections on the proposed assessments within the District will be considered at the public hearing.
A copy of the proposed assessment rolls relating to the Authorized Improvements to be undertaken at this time, which includes the assessments to be levied against certain assessable parcels in Phase 1 of the District, is available for public inspection at the office of the City Secretary, Princeton City Hall, 123 West Princeton Drive; Princeton, TX 75407.

WHEREAS D.R. HORTON - TEXAS, LTD. is the owner of a tract of land situated in the Hardin Wright Survey, Abstract No. 957, City of Princeton, Collin County, Texas, and being part of a called 178.954 acre tract of land described in a deed to D.R. HORTON - TEXAS, LTD. recorded as Instrument Number 20170530000689080 in the Official Public Records of Collin County, Texas, and being more particularly described by metes and bounds as follows:
COMMENCING at a 5/8" iron rod found for corner in asphalt at the intersection of Myrick Lane (County Road 400) and Sheamar Lane (County Road 447) and being the Southeast corner of Princeton Business Park, an addition to the City of Princeton, Collin County, Texas, according to the Conveyance Plat thereof recorded in Volume 2017, Page 737 in the Plat Records of Collin County, Texas, same being the Northeast corner of said 178.954 acre tract;

REQUEST Applicant requests Commission recommend approval of final plat submittal to the City Council. Request is for subdivision of 110 single family residential lots, 2 open space lots & 1 amenity center lot. II. PROCESS (b) Standards for approval. No final plat shall be approved by the director, the commission or the council unless the following standards have been met:
(1) The plat substantially conforms to the preliminary plat. (2) Required public improvements have been constructed and accepted or a development agreement has been accepted by the city council providing for the subsequent completion of improvements. (3) The plat conforms to applicable zoning and other regulations. (4) Provision has been made for adequate public facilities under the terms of this chapter. (5) The plat meets all other requirements of this chapter.
The commission shall recommend, and the city council shall approve a plat if:
(1) It conforms to the general plan of the city and its current and future streets, alleys, parks, playgrounds, and public utility facilities; (2) It conforms to the general plan for the extension of the city and its roads, streets, and public highways within the city and its ETJ, taking into account access to and extension of sewer and water mains and the instrumentalities of public utilities; (3) A bond required under V.T.C.A., Local Government Code § 212.0106, as amended, if applicable, is filed with the city; and (4) It conforms to these regulations.
(c) Approval procedure. After administrative review of the final plat, and a determination made that all technical requirements of these regulations are satisfied, the director shall file the final plat, and place the final plat for consideration and action on the agenda of a public meeting of the commission. Minor plats may be approved by the director or referred to the commission in accordance with section 35-4(b). In the event of disapproval, reasons for disapproval shall be stated. Major plats can only be approved by the city council, after review by the director and consideration and action (or inaction) by the commission. One copy of the final subdivision plat shall be returned to the applicant with the date of approval or disapproval noted on the final plat, and, if the final plat is disapproved, the reasons for disapproval accompanying the final plat. The final plat shall be approved if it satisfies the requisites set forth in subsection (b) above.
The Commission has the following options:

REQUEST Applicant requests Commission recommend approval of preliminary plat submittal to the City Council request is for development of 1 Commercial lot to be operated as a Day Care Facility. II. PROCESS
• Approval procedure. After administrative review of the preliminary plat and a determination that all prerequisites to filing have been satisfied, the director shall place the preliminary plat for consideration and action on the agenda of a public meeting by the commission. Minor plats may be approved by the director or referred to the commission in accordance with subsection 35-4(b). Major plats can only be approved by the city council, after review by the director and consideration and action by the commission. In the event of disapproval, reasons for disapproval shall be stated. The approval of the preliminary plat by the city council shall be effective for a period of 180 days after the approval date, unless reviewed by the commission and city council in the light of new or significant information, which would necessitate the revision of the preliminary plat, such revision being subject to the same procedures as the original preliminary plat.
If a final plat for the subdivision, or a portion thereof, has not been submitted, or if a change in requirements has not occurred which would affect the preliminary plat, at the end of the 180 days after approval by the city council, the preliminary plat shall be null and void, with no further action by city staff, the commission, or city council, unless the subdivider has, in writing, requested and received an extension of time recommended by the commission and approved by the city council.
The Commission has the following options:

UTILITY SERVICE PROVIDERS.
3. THE LOCATION OF UNDERGROUND UTILITIES INDICATED ON THE PLANS IS TAKEN FROM AS-BUILTS, UTILITY PLANS OR SURVEY. IT IS THE CONTRACTOR'S RESPONSIBILITY TO MAKE ARRANGEMENTS WITH THE OWNERS OF SUCH

DRAINAGE DITCHES, DRIVEWAYS, PRIVATE YARDS AND ROADWAYS.
8. ANY CHANGES NEEDED AFTER CONSTRUCTION PLANS HAVE BEEN RELEASED, SHALL BE APPROVED BY THE CITY ENGINEER. THESE CHANGES MUST BE RECEIVED IN WRITING.
