Requirements for the display of the ecolabel On-pack

• CoC code of company that puts the ecolabel on products

• Subcontractors– If subcontractor has its own CoC certificate,

• the subcontractor’s code goes on pack

– If subcontractor has not its own CoC certificate• The subcontracting’ company’s code goes on pack


Turnover declaration• Compulsory for

– MSC-certified products using ecolabel on pack– MSC-certified products using text to promote certification

• Depending on business activity, declaration on sales or on purchase

• Depending on total sales value, reporting 1, 2 or 4 times a yr• Declaration to be done for each product or each species

• Adapt the declaration: – Use Tonnes, kg or lbs– Use of your internal references

Assessing the use of the ecolabel


General purposes

• Part A sets out the activities that all CABs shall undertake in carrying out certification of organisations (…) supply chains that wish to (…) to use the MSC ecolabel on product

• Part B sets the activities that all CABs shall undertake in carrying out audits of organisations in the supply chain that wish to make a claim that the fish and/or fish [are from MSC-certified source]


New clients

• When assessing a new client– Check if your client has used or is suspected to

have used the MSC ecolabel prior to certification (4.9.3, 4.9.4)

- If so, raise a nonconformity and send copy to MSCI


New client

• Inform new clients of the rules to use the MSC ecolabel 7.1.2)

• Newly published MSC Ecolabel user guidelines


Onsite audits

• During the onsite audit• 17.4.3.8 states.

– Verify that the client complies with the ecolabel licensing agreement for the use of the MSC trademarks on packaging, including when non-certified seafood is used that it is used to a maximum of 5% of the total seafood content of the consumer ready tamper proof product

• Verify if ecolabel is used• Verify if a license has been

signed• Verify the term of the agreement• Verify if products have been

approved• If non-certified fish is used, verify

that the client complies with BD5


Use of Non-certified fish

• BD5.2.3 provides rule of calculation clients must apply to verify if non-ingredient seafood < 5% total seafood content– Method for solid ingredients– Method for liquid ingredients– Method for solid and liquid ingredients

• Company may use information from other suppliers


Enforcement

• MSC Incident Procedure• Notification of breach of license can come

from CBs and other sources– Ecolabel misuse– Non payment of royalties/submission of sales

statement • Possible loss of licence• Breach of trademark by others can lead to

prosecution
