September 17, 2020 COVID-19 has created a fluid and rapidly evolving situation across the state of Texas. Below are the latest developments:
Case Statistics as of 9/16/2020: • 674,772 total cases (69,457estimated active cases) • 3,409 new cases 9/16/2020 • 590,837 estimated recovered • 14,478 fatalities (135 new) • 3,249 hospitalized • 5,299,620 molecular tests (9/15/2020) • 6.98% Specimen Collection Positivity Rate (9/15/2020)
o DSHS added the Specimen Collection Date positivity rate effective 9/14/2020. This more accurate positivity rate is possible due to recent data system upgrades.
DSHS COVID Dashboard Governor Abbott made the following statements in a 12:00 pm press conference today: Governor Greg Abbott held a press conference to provide an update on the state's ongoing efforts to combat COVID-19. During the press conference, the Governor issued Executive Orders expanding occupancy levels for restaurants, retail stores, office buildings, manufacturing facilities, gyms and exercise facilities and classes, museums, and libraries, and re-authorizing elective surgeries for a majority of the state of Texas. The Governor also announced new guidance related to visitations at nursing homes and long-term care facilities across the state. Restaurants, Retail, Etc. Capacity Expanded to 75% • Executive Order – GA 30 allows restaurants, retail stores, office buildings, manufacturing
facilities, gyms and exercise facilities and classes, museums, and libraries to operate at 75% capacity.
• Bars must remain closed
o Governor Abbott stated that it is still too risky to reopen bars at this time. o TABC has adjusted some of their rules to make it easier for bars to qualify as a restaurant,
and therefore be able to be open. More information on those rules can be found here.
• The following counties are excluded from the reopening’s in this order due to high hospitalization rates (see Hospital Capacity Metric below):
o Trauma Service Area S – Calhoun; DeWitt; Goliad; Jackson; Lavaca; Victoria o Trauma Service Area T – Jim Hogg; Webb; Zapata o Trauma Service Area V – Cameron; Hidalgo; Starr; Willacy
Elective Surgery/Hospital Capacity • Executive Order – GA 31 – hospitals that have less than 15% of COVID patients have no
restrictions on elective surgeries.

Hospital Capacity Metric for Reopening’s • The Governor said that looking at hospital capacity is the most accurate set of data we have in
evaluating COVID-19, and will be used as a baseline for additional reopening’s in the state. When hospitalizations are high, the state needs to react and put in place restrictions. When hospitalizations are down, then the state can loosen reopening restrictions.
• Texas is broken down into 22 Trauma Service Areas (see map on page 3). Counties that reside in Trauma Service Areas (TSAs) with high COVID-19 hospitalizations are excluded from these reopening’s.
• Any TSA that has had seven consecutive days in which the number of COVID‑19 hospitalized patients as a percentage of all hospitalized patients exceeds 15% is excluded from the reopening’s provided under GA‑30 and GA‑31. Once they have seven consecutive days below the 15% threshold, they are eligible for the reopening’s.
• The following counties are part of TSAs where, for the last seven days, 15% or more of the hospitalizations have been COVID‑19:
o Trauma Service Area S – Calhoun; DeWitt; Goliad; Jackson; Lavaca; Victoria o Trauma Service Area T – Jim Hogg; Webb; Zapata o Trauma Service Area V – Cameron; Hidalgo; Starr; Willacy

New Guidance for Visitation at Nursing Homes and Long-Term Care Facilities • Governor Abbott directed the Texas Health and Human Services Commission to expand
visitation options for eligible nursing, assisted living, and intermediate care facilities, home and community-based service providers, and inpatient hospice, effective Thursday, Sept. 24.
• This will allow a designated essential caregiver to provide supportive, hands-on care to facility residents who do not have COVID-19.
• Residents will be allowed to designate up to two essential family caregivers o Designated caregivers will be provided necessary training to allow them to safely go
inside a facility for a scheduled visit, including in the resident’s room. o Designated caregivers will not be required to maintain physical distancing o Only one caregiver can visit a resident at a time o Proper PPE must be worn at all times o Caregiver must test negative for COVID-19 within the previous 14 days before the initial
visit
• General visitors, who are not a designated essential caregiver, will be allowed scheduled indoor visitation with the use of plexiglass safety barriers. Physical contact between residents and general visitors is not permitted.

• Outdoor Gatherings o Any gathering over 100 people must be approved by local government
Phase III June 19, 2020
• Amusement Parks/Carnivals o Counties with < 1,000 confirmed positive cases of COVID-19 may open at 50%
capacity.
June 12, 2020
• Restaurants o Can expand to 75% capacity
• Counties o Counties with >10 cases can expand all openings to 75%
June 3, 2020
• Businesses o Can expand to 50% capacity
• Bars/Wineries/Breweries o Can expand to 50% capacity (patrons must be seated)
• Amusement Parks/Carnivals o Counties with >1,000 cases may open at 50% capacity

Phase II May 31, 2020
• Adult Recreational Sports o Practices only, games can’t resume until June 15th o No spectators allowed during practice (spectators can attend games after June 15th, with
proper social distancing • Youth Camps
• Youth Sports o Youth Sports Operators o Practices cannot have spectators, however, one parent/guardian is allowed o Games can be held with or without spectators, with 6-feet social distancing
