Warranty Terms and Conditions

* Warranty is valid from the date of purchase/ activation.

1. The product is not purchased from an Authorized Kult sales dealer.2. The product purchased is not used according to instructions given in the INSTRUCTION MANUAL, as determined by the authorized service center/company personnel.3. Modification or alterations of any nature made in the setting, assembly or installation of the product by the purchaser or unauthorized personnel as determined the company personnel.4. Conditions of the premises where the product was kept by the customer not confirm to the recommended operating condition of the product.5. The product has been subject to abnormal use, abnormal conditions, improper storage, exposure to moisture or dampness, exposure to liquid and sweat, exposure to excessive temperature or

other unsuitable environmental conditions, unauthorized modifications, unauthorized repair including but not limited to the use of unauthorized spare parts in repairs. Colour fade due to neglect,abusive, accident, improper installation, spill of foods or liquids, maladjustment to customer controls or other acts which are beyond the reasonable control of Kult, including deficiencies inconsumables parts such as fuses and breakage or damage of antenna, unless caused directly by defects in materials or workmanship.

6. The product lMEI/ original serial number is removed, defaced, made illegible, obliterate or altered form the product.7. Defects due to causes beyond control like lighting abnormal voltage, acts of God or while in transit to service center or to the purchaser's residence.8. Defect caused by household pets, rats, cockroaches or any other animals or insects.9. Under no circumstances the company is liable for loss directly or indirectly for any of the following:a. Third party claims against customer for losses or damages. b. Loss or damages of records, information or data.c. The company shall not be liable for any data, records or program lost due to repair. d. Economic consequential damages including lost profitse. Customer is advised to take back up contents before handing over the unit for repair. The company shall not provide any backup service.10. Warranty does not cover uses of any third party software, settings, content, data or links, whether included/downloaded in product.11. Warranty does not cover normal wear and tear and cosmetic damage such as, but not limited to corrosion, scratches, dents, rust and stains. Non- functional parts such as, but not limited to,

plastics and finishes, Expendable or lost items, such as, but not limited to cables, ear buds , head phones or camera.12. Warranty does not cover defects or alleged defects caused by any of the threat; the product was used with, or connected to product, accessories, software and / or service not manufactured,

supplied or authorized by Kult or was used other than for its intended use. Defects caused by viruses from any third party's unauthorized access to service, other accounts, computer system or networks. This unauthorized access can take place through hacking, password- mining or through variety of means.

13. Warranty does not cover defects caused by the fact that the battery has been short -circuited or by the fact that the seals of the battery enclosure or the cells are broken or show evidence oftampering or by the fact that the battery has been used in equipment other than those for which it has been specified.

14. Damage, fault or failure due to or arising out of, transit or delivery, packing, unpacking, assembly, installation, routine maintenance, dismantle, relocation or removal.

This warranty is not applicable in any of the following conditions:

The buyer must produce the invoice/original proof of purchase when servicing the product. The event that the document is not produced, service charges along with the payment of any part being replaced are applicable and the buyer will be charged accordingly.

6. Transportation, delivery and handling charges incurred in the transport of the product to and from Kult or its authorized service centre shall be borne by the consumer.7. Any implied warranty of merchantability or fitness of particular purpose or use shall be limited to the duration of the foregoing written warranty. Otherwise, the foregoing warranty is the

consumer's sole and exclusive remedy and is in lieu of all other warranties, expressed or implied. Kult shall not be liable for any incidental or consequential damages or loss of anticipatedbenefits or profits, loss of impairment of privacy of conversations, work stoppage or loss or impairment of data arising out of the use or inability to use the product.

8. In case of any misuse or damage to the product is detected by the authorized service centre personnel, the warranty conditions shall not be applicable and in that case repairs will be donesubject to availability of parts on chargeable basis.

9. The company's obligation under this warranty shall be limited to repair or providing replacement of part(s) only. The maximum claim(s), if entertained by the company, will be subject to themaximum retail price of the product purchased or purchase price, whichever is lower.

10. In the event of any unforeseen circumstance, and spares not being available, the company's prevailing depreciation rules will be binding on the purchaser to accept as a commercial solution inlieu of repairs.

11. Only carry in repairs is applicable for all the models.12. We shall reserve the right to vary, modify or change the terms and conditions herein due to change(s) in availability of services, products and/or spare parts or for the purposes of complying

with applicable policies, rules, regulations and law, with or without notice.13. None of our employees, distributors, dealers, retailers, agents has the authority to vary, modify or amend any of the terms and conditions of this warranty. 14. Our decisions regarding all matters concerning this warranty shall be final and binding.15. All disputes are subject to the jurisdiction of the Courts of the New Delhi only.

Accessory/Part Not Covered

1. This warranty is good only to the person named as the owner of the Product in the invoice and is not assignable and/or transferable in any case.2. During the limited warranty period, in case any product or a unit, part(s) thereof requires repair, Kult or its authorized service network may at its option and discretion, repair, replace or

exchange it with an equivalent product, unit, part(s) and return the product to the consumer in working condition The replaced part or product that is exchanged during service will beretained by us as our property. No charge will be levied to the consumer for either part(s) or labour in repairing or replacing the product. The external housing and cosmetic parts shallbe free of defects at the time of purchase of the product and, thereafter, shall not be covered under these limited warranty terms. 3. Repaired, replaced or exchanged part or product will continue to be under warranty for the remaining Product warranty period but for a period of not less than thirty (30) days.4. Service will be provided at Kult authorised Customer Service Center only. For units installed beyond the municipal limits of the jurisdiction of the company's authorised service centre, it

is the responsibility of purchaser to contact the nearest authorized service centre at purchaser's cost and risk.5. If a problem develops during the limited warranty period, the consumer should take the following step(s) to avail the warranty service:

a) The consumer may either contact at local Kult office or search at customercare@kultlife.com, or www.kult.life for knowing the

location of the nearest authorized service centre. b) The consumer shall himself arrange for the product to be delivered at the authorized

service centre for necessary rectifications only.
