INTRODUCTION This finding aid concerns Record Group 321, Grubbs Lawsuit Records, Tennessee

Department of Correction, 1960-[1979-1990]-1994. This record group consists mostly of court documents, exhibits, facility reports, and subject files relating to the Department of Correction’s responses to the Grubbs Lawsuit ruling from 1960-1994, however the bulk of the collection is concentrated in the years 1979-1990. These records were transferred to the Tennessee State Library and Archives over a number of years directly from the Department of Correction. In accordance with this collection’s Records Disposition Authority (RDA) number, 2411, the material in Record Group 321 has been microfilmed and the originals have been retained in acid-free containers. Where possible, the original arrangement was maintained, however where no arrangement could be determined, one was imposed. This collection consists of eight series, which have been arranged in order of their relevance to the case. Record Group 321 consists of approximately 20.5 linear feet of records. This collection originally consisted of 29 linear feet. Documents removed were numerous duplicate copies and routine office materials. Aside from the confidential records in Series VIII, there are no restrictions on the access or use of this collection.

CASE HISTORY In the mid to late 1970s a number of inmates housed in Tennessee Department of Corrections state institutions filed lawsuits against the State based on the inhumane conditions of the prisons. Their complaints cited shoddy facilities, poor facility programming, and especially overcrowding. In 1978 the trial court ruled against the Department of Corrections and the cases were appealed to the Tennessee Court of Appeals and Tennessee Supreme Court. The Tennessee Supreme Court abstained from issuing a decision, pending federal resolution. The U.S. District Court combined the cases on appeal into a class action suit on behalf of the inmates and appointed attorneys on their behalf. The resulting case was the Grubbs suit. In 1982 the U.S. District Court ruled in the Grubbs Case that specific prison “conditions and practices amount to cruel and unusual punishment in violation of the Eighth and Fourteenth Amendments to the United States Constitution and Article I, Sections 16 and 32 of the Tennessee Constitution.” There were seven specific conditions and practices that the court determined amounted to cruel and unusual punishment:

1. Double celling of inmates at two prison facilities; 2. Confining an inmate in a cell for more than one week without access to hot water; 3. Confining inmates in portions of two facilities that were “unfit for human

habitation;” 4. Failing to maintain minimum sanitary conditions in food storage, preparation, and

service areas at three institutions; 5. Failing to protect inmates at three institutions from violent attacks; 6. Failing to provide minimally adequate medical care for inmates at nine prisons;

and 7. Confining female inmates in segregation with no opportunity to exercise.

The parties in the litigation were to submit names for a special master, and the Department of Correction was ordered to prepare plans to remedy the constitutional violations found by the court. The department proposed the Correction Plan for the Eighties to correct the problems. When the department experienced difficulty implementing the plan, the judge directed the special master to appoint specialized evaluators to observe the problem areas of the state’s prison system and make recommendations for improvement. The evaluators developed a list of more than 1,500 needed improvements for the department. This list is referred to as the Grubbs Matrix. In 1992, the evaluators reported back to the court explaining that while many of the issues in the matrix had been resolved, some concerns remained, including the lack of a health care quality assurance program. The department remained under court control until 1993, when a judge returned control to the department with the requirement that the department monitor for one year its quality assurance program for health care. In 1994 Tennessee was completely released from the court order. The only permanent order required the closure of Tennessee State Penitentiary.∗

SCOPE & CONTENT NOTE Record Group 321, Grubbs Lawsuit Records, Tennessee Department of

Correction, 1960-1994, consists of records that were created by the Tennessee Department of Correction before, during, and after the Grubbs Lawsuit ruling in 1982. This collection contains the department’s responses and action plans following the court’s ruling against the State, which determined that Tennessee’s Corrections program was unconstitutional and mandated several reforms to be enacted by the department to improve facilities and conditions.

Where possible, the original arrangement was preserved and the original titles of each folder were maintained; however, where no original order existed, an organizational arrangement was imposed.

Record Group 321 consists of eight series, arranged in order of their relevance to the Grubbs Case. The series are Court Documents; Exhibits; Legislation; Facility Audits; Facility Reports and Matrices; Special Master’s Documents; Subject Files; and Confidential Documents. The types of documents found in the series are court proceedings, orders and exhibits; legislation; audits; reports concerning Department of Correction activities and specific facilities; correspondence; and meeting minutes. However, much of the information in this collection is incomplete. This collection also contains a number of photographs of facility conditions taken during inspections by court appointed consultants. Most of the photographs display the deplorable environment of Tennessee’s prisons at the time. The photographs can be found in Series II, Box 8. There are also a number of oversized facility report printouts, which contain detailed reports of particular facilities. These can be found in Series V, Box 16. Series VIII consists of documents that were determined to be statutorily confidential during processing and were removed from the main body of the collection. A removal notice containing the title and new location of each document was put in its place. Confidential materials removed contain information concerning inmate health, education, individual institutional records; specific employee complaints; and facility incident reports. These records have not been microfilmed and are restricted from inspection by the public.

CONFIDENTIALITY RESTRICTIONS The material located in boxes 23 and 24 in this collection has been removed as it

is protected from public inspection by the confidentiality provisions of Tennessee Code Annotated, Title 10 Chapter 7, Part 5, Sections 503 and 504 [TCA §10-7-503; §10-7-504]. Members of the public may appeal denial of inspection and may obtain access only as provided by law, according to the provisions of §10-7-505 of the Tennessee Code Annotated.

The confidentiality of material restricted for reasons of statute may expire with time. The scheduled expiration date for statutory confidentiality is 70 years after the date of inception.

SERIES DESCRIPTION

Series I: Court Documents Box 1-2 This series contains the orders, motions, submissions, memorandums, opinions and complaints of the Grubbs Lawsuit from 1982-1992. Following the court’s ruling in 1982, the lawsuit continued to generate new orders, decrees, and findings based on the Department of Correction’s compliance with the 1982 ruling. The orders found in Series I translated directly into the reforms enacted by the Department to improve the correction system in Tennessee. This series has been arranged chronologically.

Series II: Exhibits Box 3-8

Series II contains numerous numbered exhibits used in the Grubbs Lawsuit and are arranged corresponding to their exhibit number. The exhibits contain such information as health inspections, staffing qualifications, facility investigations, numerous program evaluation findings, classification reports, and budgetary matters. Also included are documents from the Trigg v. Blanton and Trigg v. Alexander lawsuits that prefaced the Grubbs litigation. The exhibits of Series II display the condition of the Department of Correction in detail. They date from 1960-1985. The information in this series is incomplete, as there are a number of exhibits that were never transferred from the department and are therefore missing from the collection.

Series III: Legislation Box 9

Series III contains the Legislative responses to the Grubbs ruling. The Tennessee State Legislature met in an emergency session in the summer and fall of 1985 to pass legislation that directly responded to the Grubbs decision. Documents included are the Special Session Planning Document, the Comprehensive Correction Plan, and several bills designed to bring Tennessee’s correctional system up to code. These records date from 1985 to 1987 and have been arranged chronologically.

Series IV: Facility Audits Box 10-13

Series IV contains facility audits conducted from 1985-1991. These audits contain findings and suggested improvements of specific facilities and sections of the Tennessee Department of Correction. The audits are generally broken down into different subsections for each facility: Classification; Education; Jobs; Management; Security & Institutional Environment; and Work Programs, however many of the audits in Series IV are incomplete and do not contain an audit for each category. The audits have been arranged chronologically, then alphabetically by facility name within each year.

Series V: Facility Reports & Matrices Box 14-16

This series contains several different institutional reports submitted by court appointed consultants. As part of the court’s ruling, the Tennessee Department of Correction was required to bring in consultants to inspect facilities and submit improvement recommendations. These reports follow through with the Facility Audits in Series IV, by detailing the findings and suggesting appropriate improvements. The Grubbs Lawsuit Matrices are a list of required improvements for every facility in Tennessee. Documents in this series date from 1984-1992 and have been arranged alphabetically by type of

report, and then chronologically within each different report type. Grubbs Matrix Reports are arranged at the end of the series.

Series VI: Special Master’s Documents Box 17

Series VI contains the documents issued to the Federal Special Master from the Department of Correction and reports issued by the Special Master to the court. The Special Master was appointed by the court in 1983 to oversee the Department of Correction and ensure that reforms ordered by the court were implemented. Tennessee Department of Correction Reports to the Special Master contain the improvements initiated by the department and steps taken toward compliance with the court order. Reports from the Special Master to the Court contain the findings of the Special Master and his suggested areas of improvement and areas believed to be in noncompliance. These documents date from 1983-1992 and are arranged chronologically.

Series VII: Subject Files Box 18-22

This series contains general subject files of the department. Included here are: correspondence with the Attorney General of Tennessee; the department’s proposed responses to the Grubbs litigation; documents of Plaintiff attorney Gordon Bonnyman; consultant recommendations (unrelated to the specific facility recommendations and reports of Series V); population management documents; status conference meeting reports; program reports; and measures of violence reports. The Subject Files date from 1981-1994 and are arranged chronologically.

Series VIII: Confidential Documents Box 23-24

Series VIII contains confidential documents removed from the main body of the collection. A removal notice has been placed in the original location of removed documents that contains their location in the confidential records boxes. This series contains inmate medical, psychological, and institutional reports. This series also contains allegations by individual employees against the Department of Correction, and personal information of Tennessee Department of Correction staff. This series has been arranged in the order these documents were originally found in the collection. Access to this series is restricted.
