Qualifying Criteria & Process:
Tenders are invited from OEM or authorized dealers/suppliers/contractors of
BOSCH/Brahler/Sennheiser/Bose or similarly reputed brand of PA system with the
eligibility as below:-
The tenderer is to submit a specific authorization from OEM authorizing the tendered toquote for this tender along with a copy of regular dealership certificate
The tenders/bidders shall fulfill the below mentioned qualifying criteria & they shall
submit the copies of relevant documents to support their eligibility in the Envelope-1 of
the tender. The copies of these documents shall be signed and stamped by the bidder
and duly attested by a Notary Public.
1. The Average annual financial turnover for last 3 years shall be at least 30% of
the estimated cost put to tender, copies of balance sheets of last three financial
years, duly certified by a Chartered Accountant shall be submitted in support of
the requisite financial Turnover.
2. The bidder shall have successfully completed works during the last five years as
mentioned below:
a. Three Work Orders each costing not less than 40% of the estimated cost put
to tender.
OR
b. Two Work Orders each costing not less than 50% of the estimated cost put totender.
OR
c. One Work Order costing not less than 80% of the estimated cost.
The value of completed works shall be brought to the current price level by
enhancing the actual value of work done @ 7% (simple rate) per annum
calculated from the date of completion of the respective work to the last date of
receipt of application for this tender. In case the bidder has executed the Work
Order(s) under a private sector, the value of the work shall be reflected in the
TDS of the corresponding year(s) and shall submit requisite Proof/TDS certificatefor the same. Similar work means Fire Fighting services.
3. Copy of Sales Tax/VAT/Registration Certificate.
The Tenders shall be addressed to the ADMINISTRATIVE OFFICER and submitted in the
Patent Office Boudhik Sampada Bhawan, Plot No. 32, Sec. 14, Dwarka, New Delhi
along with the requisite EMD. The EMD shall be submitted in the form of a DD drawn in
favour of Controller of Patents from any Nationalized of approved Scheduled Banks of
India and shall be payable at New Delhi. Tenders received without the requisite EMD
shall be summarily rejected.

CGPDTM or any person authorized by him reserves the right to accept/reject any or all
the tenders in part or full or divided the work among two or more parties without
assigning any reason whatsoever and in such case bidders/intending bidders, shall not
have any claim on Office of Controller General of Patents, Designs and Trade Marks,

SPECIAL CONDITIONS OF CONTRACT
The following special conditions shall be read in conjunction with contract.
1. The tenders are to be submitted in two separate sealed Envelopes/covers
marked as under:
ENVELOPE-1
The Envelope-1 shall contain the followings:
Earnest Money Deposit (EMD) as per NIT.
Specific Authorization from OEM authorizing him to quote for this tender along
with proof of being a regular dealership.
Technical data sheets of all the equipment quoted. Conference equipment, mike,
amplifier and speaker should be of the same brand.
Acceptance letter for un-conditional acceptance of the Tender conditions as per
the Performa given in the Instructions to Tenderers.
D.D. of Rs. 1,000/- favouring Controller of Patents is to be submitted as tender
fee, if the tender documents are downloaded from website.
Affidavit on Stamp Paper of Rs. 10/- as per Appendix ‘B’ “Details of Balance work in hand with _______________ as on date of
submission of tenders,.
Credentials/documents in support of meeting the Pre-qualifying criteria as
prescribed in the NIT.
This envelope shall be marked as :
Envelope-1 “EMD”, Acceptance letter, Volume-II: (NIT, SCC, Technical
Specifications, List of Approved Makes and Tender drawings and
Corrigendum/Addendum, if any)
ENVLOPE-2This Envelope shall contain the following:

Price Bid duly filled in, signed and stamped on each page by the
tenderer/ authorized representative of the tenderer. No cutting or
overwriting shall be allowed. In such cases the bid shall be treated as
CANCELLED AND TENDERE SHALL BE TREATED AS DISQUALIFIED. All
proforma forming part of tender documents shall be filled in, signed and
stamped by the tenderer.
Any other information as required to be submitted along with the tender. This envelope shall be marked as:

Inviting Tender”)

2. Variations, alternations, modifications etc. for more than 10% of the total
awarded cost shall require prior approval of CGPDTM OR HIS AUTHORISED
PERSON.
3. The contractor shall be responsible to obtain all the necessary approvals from
the respective statutory authorities before during and after completion of work
as and when required. CGPDTM shall only assist the contractor for liaisoining to
obtain the approval from the concerned authorities.
4. From the commencement to the completion of the works, contractor shall take
full responsibility for the care of works thereof and of all temporary works and in
case any damage, loss or injury happens to the works or any part there of or toany temporary works due to lack of precaution or negligence on the part of
contractor, it shall be made good at its own cost.
5. The Controller General of Patents, Designs and Trademarks and its officials shall
not be responsible for any loss and damage. However, without limiting its
obligations and responsibilities as above, contractor shall insure directly in the
joint names of CGPDTM and Contractor against
(i) All loss or damage from whatever cause during the period of execution of
work.
(ii) All loss and damage arising from a cause occurring prior to the
commencement of the period of maintenance and
(iii) For any loss or damage occasioned by contractor in the course of any
operation carried out for the purpose of complying with its obligations of
maintenance as follows:
a) The work and the temporary works to the full values of such works
executed from time to time.
b) The materials, constructional plant and other things brought on to the
site by CGPDTM /Contractor to the full value of such materials,
constructional plant and other things.
c) Sufficient insurance cover for the workers and personnel at site
provided that such insurance shall be effected with any Nationalized

Insurance company and contractor shall, whenever required produce to
the CGPDTM IPO/Client policy on the policies of insurance and the
receipts for payments of the current premia thereof.
6. Tenders have to submit the full tender document duly signed and stamped on each
page as agreement of all term and conditions.
7. If any device/item is missing to complete the system configuration need to beadded to make the system functional.

9. Payment: The General Financial Regulations of the Government of India preclude
any advance payments and payments by letter of credit. Such provisions in a proposal
will be prejudicial to its evaluation by the CGPDTM. The normal terms of payments are
45 days after satisfactory completion of work. The payments will be made after
evaluation by a technical committee and acceptance thereof by the CGPDTM.
10. Performance Bank Guarantee
The applicant who has been awarded the contract (successful bidder) shall furnish a
performance bank guarantee to the tune of 10% of the value of the contract or
minimum EMD of Rs 100,000/- in the form of account payee demand draft or bank
guarantee which should be valid for a period of one hundred and eighty days beyond
the completion of all contractual obligations of the applicant including warranty.
Performance security/EMD shall be forfeited and credited to the Government account in
the event of breach of contractual obligation by the applicant.
11. Jurisdiction
The disputes, if any, arising between the successful applicant and CGPDTM shall be
resolved amicably, failing which shall be referred to an Arbitrator, mutually acceptable
to both parties, appointed by the CGPDTM as per the Arbitration and Conciliation Act,
1996. Alternatively, this shall be subject to the exclusive jurisdiction of courts at
Mumbai.
12. Tender fee: In addition to the documents as listed in the Notice Inviting Tenders
(NIT), the bidders downloading the Tender documents from the Website are required
to deposit the requisite tender fee of Rs. 1,000/- (Non-refundable) by way of a D.D. in
favour of Controller of patent drawn from any nationalized or approved scheduled
bank and payable at New Delhi and the same shall be enclosed in Envelope-I along
with other documents.

Undertaking by the Tenderer
(a) I/We agree to abide by and fulfill all terms and conditions referred to above and
as contained in tender documents elsewhere and in default thereof, to forfeit and
pay to CGPDTM, or its successors or its authorized nominees such sums ofmoney as are stipulated in the notice inviting tenders and tender documents.
(b) I/We hereby pay the earnest money of amount as mentioned in the
“Memorandum to this Form of Tender” in favour of Controller of patents, payable
at place as mentioned in the “NIT/ITT”
(c) If I/We fail to commence the work within 10 days of the date of issue of Letter of
Intent and/or I/we fail to sign the agreement as per contract and/or I/we fail to
submit performance guarantee as pr contract, I/we agree that CGPDTM, IPO
shall, without prejudice to any other right or remedy, be at liberty to cancel the
Letter of Intent and to forfeit the said earnest money as specified above.
(d) I/we are also enclosing herewith the Acceptance letter on the prescribed
proforma as referred to in condition of NIT as Annnexure- “____”
