Council’s Administration & Public Buildings and Council

Depots

GENERAL – FORMS AND CONDITIONS OF REQUEST FOR TENDER

1.1 Definitions

1.2 Tender prices a) Prices quoted are to be on a fixed lump sum basis not subject to “rise and fall”.

b) All prices offered are to be fixed for the term of the Contract.

c) Unless otherwise indicated, prices quoted must include all costs associated with the works as specified in Section 8, and all applicable levies, duties, taxes and charges. Any charge not stated in the Tender as being additional will not be allowed as a charge for any transaction under any resultant Contract.

1.3 Lodgement of Tenders

The Respondent must submit:

a) Original Tender form and

b) One copy of the Tender form marked as copy

1.4 Tender Closing Time

d) Tenders that are mailed will be dated and time stamped when received.

e) Emailed tender forms will be accepted provided the following conditions are followed: i. Emails are addressed to [email protected]

ii. The subject line states the RFT number and title eg: Installation of SALTO Locking System on Council’s Administration & Public Buildings and Council

Depots – 2906/2016-17/QTB/26 iii. Emails are received by the closing date and time;

f) North Burnett Regional Council will accept no responsibility in the event that a Tender is not

received by the closing time.

1.5 Informal Tender Any Tender may be rejected if it:

a) does not comply with the requirements of the specification or this request for tender; or

b) contains any provisions not required by this request for tender.

1.6 Acceptance of Tenders

a) North Burnett Regional Council is not bound to accept the lowest or any tender.

b) North Burnett Regional Council reserves the right to accept all or part of the works detailed in this RFT document and the prices provided in the Tender submission must reflect this.

c) This request for Tender together with North Burnett Regional Council’s written acceptance of the Tender shall constitute the Contract between North Burnett Regional Council and the successful Respondent.

d) The Respondent agrees that the RFT will remain open for acceptance for a minimum period of 60 days after the closing time, notwithstanding that there may have been negotiations in respect of any tender in the meantime.

e) A Respondent may withdraw its tender at any time after the expiration of 60 days from the Closing Time, but must not withdraw their tender prior to the expiration of 60 days from the Closing Time.

1.7 Tender Assessment The information provided in the Tender Submission Form will be used to undertake a qualitative and quantitative assessment of the individual projects within the tender submissions to determine which tender offers Council best value for money.

Council will assess against the Evaluation Criteria as outlined below:

a) Failure against any of the criteria may result in the Tender being rejected without further consideration.

b) Council will appoint an Evaluation Panel, as the Council sees fit. The Evaluation Panel may also choose to contact referees or other sources in order to verify information provided by the Contractor.

1.8 Canvassing of Elected Members and Council Officers Canvassing of elected members or Council officers will automatically lead to disqualification.

1.9 Indemnity

The successful Respondent must indemnify and keep indemnified North Burnett Regional Council against:

a) any liability under the Workers’ Compensation and Rehabilitation Act 2003 as amended from time to time; and

b) any other law in force or which during the term of this Contract may come into force, under which any person is entitled to claim or sue for compensation or recover any damages from North Burnett Regional Council.

2 TENDER BRIEF

2.1 Description of Work

The North Burnett Regional Council intends to Install SALTO Locking System on Council infrastructure as specified in Section 8 Specifications.

2.2 Extent of Works Extent of works is set out in section 8 Specifications.

2.3 Acts, Standards and Codes

Construction is to comply with the relevant sections of the QBCC licence requirements for carpentry and electrical work.

Membership of the Master locksmiths Association of Australia is preferable but not mandatory. Advise regarding membership of this organisation in the tender response Section 9

2.4 Structure of Request for Quotation The documents comprising the Request for Tender are, collectively:

a) Request for Tender; and b) Specification; and c) Respondent’s Submission Form which, when completed by the Respondent, comprises

the Submission of the Respondent.

All parts of the Request for Tender must be read and construed together so that all parts are as far as

possible consistent. Where the documents are inconsistent, the documents should be read and

construed in the order of priority from document a) to c) as follows:

a) Request for Tender; and

b) Specification; and c) Respondent’s Submission Form which, when completed by the Respondent, comprises

the Submission of the Respondent.

The request for tender is not an offer. The request for tender is an invitation for persons to submit

an offer to supply the goods and services particularised in the Specification.

2.5 Principal Contractor

The Principal shall appoint the successful Contractor as the “Principal Contractor” for the purposes of the Workplace Health and Safety Act, and current Regulations with all the duties and responsibilities as defined by the Act.

2.6 Briefing/Site Inspection

Respondents are to attend a tender briefing and site inspections commencing on Wednesday 30 April 2017 at 8.30am and concluding at Biggenden on Friday 31 April 2017. Attendance at this meeting to discuss the Request for Tender is mandatory.

The briefing will commence at the Mount Perry Boardroom at 8.30am and inspection will follow in Mt Perry, Monto, Eidsvold Mundubbera, Gayndah and Biggenden. It is expected that attendees will have to organise accommodation in Mundubbera on Wednesday night, Council will not be responsible for any costs associated with this inspection.

The briefing and site inspections will provide Respondents with the opportunity to clarify any uncertainties with the Contact Person or their representative prior to the closing time

2.7 Authorities, Certificates etc.

Certified copies of the contractor’s current QBSA licence, relevant insurance policy and the intended operators Workplace Health and Safety Queensland licenses must accompany the quotation documents.

Council will arrange relevant building/plumbing approvals and these fees are to be excluded from the final price. QLeave will also be paid by the Principal (if applicable).

2.8 Plumbing and Drainage

Not applicable

2.9 Contract Duration

The period for completion of the works is as detailed in Section 8 Specifications.

3 GENERAL CONDITIONS

3.1 Awards, Taxes, Duties

Observe all awards, taxes and pay all claims in relation to the employment of labour and materials.

3.2 Coordination and Control Instruction Authority The Contractor shall accept no instructions relative to this contract other than those issued by the North Burnett Regional Council and/or persons nominated by it.

3.3 Inspections a) Give the Principal due notice to make inspections at the relevant stages of construction. b) The Principal or persons nominated by it, reserve the right to access the site for the purpose of

inspection whenever it is deemed necessary.

3.4 Materials, Plant and Workmanship

a) Quality of Materials and Workmanship Materials are to be new and the best of their respective kind. Carry out all workmanship with the best trade practice.

b) Proprietary Lines Use strictly in accordance with the manufacturer’s printed directions.

c) Warranties, Guarantees Provide warranties as required.

d) Workmanship Carry out all work in a good and tradesman like manner in accordance with relevant Australian Standards and to the satisfaction of the Principal.

3.5 Safety and Protection including Security of Site Works

Be responsible for the security of the building site for the duration of the contract. Proper provisions shall be maintained at all times against unauthorised entry of the works, and for safeguarding the works during working and non-working hours.

3.6 Cleaning and Removal of Debris

Remove all rubbish from the site on completion of the works and progressively during installations.

3.7 Hoardings and Barricades Provide all hoardings, screens, platforms, barricades, guard rails, covers, lights etc. as necessary to protect persons lawfully on the site and the public.

3.8 Indemnities, Insurance and Protection

a) Take all necessary insurance and confirm with Principal. b) Protect all work effectively and properly to the Principal’s satisfaction against damage by

accident or weather. c) Take precautions against damage to property of the Owner, adjoining owners, the Local

Authority and others and make good all damage to the satisfaction of all concerned.

3.9 Manufacturer’s Directions

a) Manufactured articles, materials and equipment are to be applied, installed, connected, erected, used, cleaned and conditioned in strict conformity with manufacturer’s most recent directions unless otherwise specified.

b) Retain manufacturer’s directions on such articles for the Principal’s reference.

3.10 Dimensions If applicable figured and specified dimensions shall take precedence over scaled dimensions and large scale details shall over-ride small scale drawings.

3.11 Discrepancies

Any discrepancies between Drawings or between Drawings and Schedules shall be referred to the Principal for decision before commencing the work in question.

It shall be assumed that the more expensive alternative has been allowed for in the contract price.

3.12 Site Meetings The Principal’s representative will meet with the Contractor during the course of the work under the Contract.

3.13 List of Subcontractors and Suppliers

Prior to commencing work on site, and if changes occur from the original tender submission during the contract, the Contractor shall amend and submit table 9.3 for approval by the Principal.

3.14 Hours of Work

Further to Clause 32 of the General Conditions of Contract, the normal hours of work will be as follows: Monday – Friday 7.00am – 5.00 pm

3.15 Existing Services

If applicable:

a) Prior to commencement of construction, the Contractor shall establish the line and level of all underground services in the area affected by the works.

b) The position of underground services owned by responsible Authorities may or may not be indicated on the Drawings. Connections or extended services to consumers’ properties will generally not be shown.

c) The Contractor shall request details of the location of services from each Authority

responsible for underground services. Sufficient site investigations are to be used to avoid damage to services regardless of any indication of their location, or not (e.g. trial

pits, service detectors, etc.).

d) All services, possibly affected by the work under the Contract shall be physically uncovered prior to commencing work in that section. The located services shall be surveyed and the results submitted the Principal, highlighting any clashes with the proposed works.

e) The Contractor shall immediately inform the Principal and the owner of any damage or

interference to any service or property.

3.16 Site Access / Construction Access

Generally access to the site shall be from Contractor to make good at own expense any damage caused to the property.

3.17 Adjoining Owners

The Contractor shall fully respect the rights of adjoining owners and shall exercise caution to prevent trespass, nuisance or damage, directly or indirectly to their property.

3.18 Make Good

The Contractor shall make good all roads, paths, drains, services, lawns etc. broken, damaged or disturbed during the Contract and reinstate to a condition equal to that existing at the commencement of the Contract. The building and grounds are to left in a clean and tidy state to the reasonable satisfaction of the Principal.

3.19 Regulations, Notices and Fees

Comply with the requirements of all Authorities having jurisdiction over these works and give and receive all notices and pay all customary fees and obtain all permits required. The Contractor is responsible for ensuring that the responsibilities and obligations pursuant to the Workplace Health and Safety Act 2011 are fulfilled.

3.20 Site Extent

Extent of site availability is to be determined with the Principal prior to construction. Access onto and around site, material storage, construction times, and parking by the Contractor is to be agreed on-site with the Principal. Access to areas outside the agreed works site is prohibited without written approval from the Principal’s Representative.

3.21 Contractor’s Guarantee

The Contractor shall guarantee all materials and works in accordance with Queensland Building and Construction Commission General Conditions of Contract for the scope of works

6 INFORMATION PRIVACY Any personal information you may provide will only be used to process your tender application and will not be disclosed to any third party without your prior consent unless authorised to do so by law. Information regarding the successful tender may be disclosed after the award of purchase/supply.

7 WORKPLACE HEALTH AND SAFETY REQUIREMENTS

7.1 Principal Contractor

The Principal shall appoint the successful Contractor as the “Principal Contractor” for the purposes of

the Workplace Health and Safety Act, and current Regulations with all the duties and responsibilities

as defined by the Act.

7.2 General Requirement

The Contractor must be aware and comply with all Workplace Health and Safety policies, procedures

and measures, adopted by the Principal and/or the occupiers of any premises at or within which the

Contractor will perform work under the Contract.

In the event of any inconsistency, the Contractor shall comply with such procedures or measure as to

produce the highest level of Workplace Health and Safety.

All inconsistencies and subsequent amendments to the work practices must be notified to the

Principal immediately, for approval, after the Contractor becomes aware of the inconsistency.

7.3 Health and Safety Plan

Prior to commencing the work the Contractor shall submit to the Principal a Health and Safety Plan

for review and approval. The Health and Safety Plan must be specific to the Contract. It will ensure

that the works conform to the relevant requirements.

The Health and Safety Plan shall consider the specific WH&S hazards and issues relevant to the

Works. The plan shall document the systems and methods to be implemented for the Contract.

Failure to provide the required Plan prior to commencement of the works will result in cancellation

of the Contract.

7.4 Incident Notification

The Contractor must promptly notify the Principal of ANY incident, injury, property or environmental

damage which occurs during the Contract. All lost time incidents shall be immediately notified to the

Principal. The Contractor must within 3 days of any such incident provide a report giving complete

details of the incident, including results of investigations into its cause, and any recommendations or

strategies for prevention of a recurrence of the incident, in the future.

7.5 Non Conformance

Non conformance shall be deemed to have occurred if:

The work is not conducted in accordance with the Contractor’s Health and Safety Plan, health and safety management procedures, and relevant legislation.

Any work under the Contract is conducted in such a way as to endanger the health and safety of the Contractors employees or the Principal’s or its Contractors’ and sub -contractors’ employees, agents, plant, equipment or materials, and the public.

All non conformances shall be recorded by the Contractor and provided, without delay, to the

Principal.

A failure by the Contractor to comply with the provisions shall constitute a substantial breach, of the

Contract, for the purpose of Clause 44 of the General Conditions of Contract.

7.6 Environmental Management Plan (EMP)

Not applicable for this tender

7.7 Quality General Requirements

All non-conformances to work procedures, construction outcomes and materials quality and

subsequent remedial action to the Contract works shall be issued to the Principal. The review and

approval by Principal must be completed, where practicable, prior to any remedial work being

carried out.

8 SPECIFICATION

8.1 OVERVIEW

The North Burnett Regional Council has a 3 year Capital Program for Regional Lock Standardisation

on its entire Council infrastructure. Year one of this project has been completed. This tender is for

the installation of the Salto Lock system for the final two years of the project. Locations and extent

of works is specified in Clause 8.2.

8.2 EXTENT OF WORKS

The locations of the locks are shown in the spread sheets below.

The locations of the hotspots/updaters are to be proposed by the tenderer. Final locations will be

verified with the successful tenderer.

The tender should also indicate price of fobs and cards. The card price should be for both printed and

non-printed cards. Supply of these will be treated as a variation to the tendered price.

The tender should indicate the warranty period offered on both the locking equipment supplied and

the installation.

Council will be seeking a service contract which will be negotiated after the warranty period has

expired. The tender should indicate indicative cost of such a contract. Note this will be assessed

independently of the supply and installation contract at a future date.
