INVITATION FOR BIDS

M.P State Electronics Development Corporation Ltd., Bhopal, invites sealed bids on item rate basis (all inclusive) under three envelop system in prescribed proforma from competent & experienced bidders, for �Interiors & allied works at NMC Building, Arera hills, Bhopal, M.P.�

Earnest Money : Rs. 3,00,000/- (Rupees Three Lacs only )

Period of completion : 50 days + 7 days for mobilization

Eligibility Criteria shall be as follows:

a) Interested bidder(s) must have successfully completed at least one similar work of value not less than Rs. 150.00 Lacs (Rupees One hundred fifty Lacs) for State/Central Govt., PSUs/Corporate or any other reputed institution in the last five years. OR Must have successfully completed two similar works of value not less than Rs. 75.00 Lacs (Rupees Seventy five Lacs) each, for State/Central Govt., PSUs/Corporate or any other reputed institution in the last five years Bidder must submit the proof of experience by providing the attested copies of Work Order/Agreement and work Completion Certificate showing the executed value of the job.

b) Interested bidder(s) should have an Average Annual Turnover (Turnover figures related to the Interior works

only shall be considered) of Rs. 200.00 Lacs (Minimum) for the last three financial years. As a proof of Average Annual Turnover, certified copies of the Income Tax returns, Audited balance sheet (head wise) and profit and loss account is to be submitted.

The tender documents can be obtained from the office of M.P. State Electronics Development Corporation Ltd. At 147, Zone 1, M P Nagar, Bhopal 462011 on the payment of Rs 5000/- (Rupees Five Thousand only) in the form of crossed DD payable to MPSEDC Ltd., Bhopal, however tender document can also be downloaded from our web: www.mpsedc.com, in such case the Tender fee should be enclosed along with the EMD, in the form of crossed DD payable to MPSEDC Ltd., Bhopal,. The tender should be submitted in Original (duly stamped and sealed) in the office of M.P. State Electronics Development Corporation Ltd. At 147, Zone 1, M P Nagar, Bhopal 462011 on or before 11/06/2012 up to 15.00 hours and will be opened on 11/06/12 at 16.00 hours.The tender shall be accompanied with the earnest money deposit of Rs. 3,00,000/- (Rupees Three Lacs only) in the form of crossed demand draft from any Nationalized / scheduled bank in favor of M.P. State Electronics Development Corporation Ltd Bhopal. The MPSEDC shall reserve the right to accept or reject any or all the tenders without assigning any reason whatsoever.

Dear Sir,

Having examined the tender document relating to the Interior & allied works at NMC building, Arera hills, Bhopal,

M.P., comprising of the Tender Notice, General and Special Conditions of Contract, Specifications, Schedule of

Quantities etc., having understood the provisions and requirements relating to the project, having conducted a

thorough study of the job, location of site, availability of power supplies. Transportation and communication

facilities, availability and accessibility of materials, and all other factors governing the project / We hereby submit

our offer for the execution of the proposed work in accordance with the terms and conditions and within the time

period specified in the tender document at the rates (all inclusive) quoted by me / us in the accompanying

Schedule of Quantities.

I / We undertake to do all extra works which may be assigned to us as a part of this contract, at the rates quoted

in the tender document.

If after the tender document is accepted, I / We fail to commence the execution of the works within 7 days of letter of intent, MPSEDC shall have full authority to forfeit the earnest money deposited and shall be free to award the contract to any other contractor as they deem fit. INSTRUCTION TO TENDERER

01. Bidders are required to furnish the details as per the prescribed format given in this tender document

along with attested copies of the all supporting certificates/documents.

The sealed tenders should be addressed to: The Addl Chief General Manager, M.P. State Electronics Development

Corporation Ltd, 147, Zone 1, M P Nagar, Bhopal, 462011.

02. The Tender Document has to be submitted in three sealed separate envelopes keeping all the envelopes

in one big envelope containing as detailed below:

(i) EMD & Tender cost (in case of downloaded tender document) and letter for submission of Tender in First envelop which should be super scribed as 'EMD & TENDER FEE� (ii) TECHNICAL Bid in Second envelop which should be super scribed as 'TECHNICAL BID' (iii) Price bid in Third envelop which should be super scribed as 'PRICE BID'

All the three envelopes should be kept in one big envelop super scribing as �Interior & allied works at NMC building, Arera hills, Bhopal, M.P.�

04. Each page of the tender document is required to be signed by the authorized signatory of the Tenderer.

05. Original tender document duly signed and filled up should be submitted.

06. The tender document shall be duly filled-up in all respects. If any of the data is found to be missing then the

tender will be considered as invalid.

07. The tenders received after due date and time shall not be accepted under any circumstances, whatsoever it

may be. The envelope of �EMD & Tender Fee� shall be opened first. Tenders without EMD & Tender fee will not

be considered. The Technical Bid shall be opened for those tenders only who have submitted EMD & Tender

fee as specified. The Technical bid shall be opened and evaluated by a committee formed by The Managing

Director, M.P. State Electronics Development Corporation Ltd, for this purpose.

08. The Financial Bid shall be opened only for the Bidders who found successful in their technical bid evaluation.

Date and time for opening of the financial bid shall be communicated to all such bidder later on.

09. MPSEDC do not bind himself to accept the lowest or any other tender and reserves the right to accept or

reject any or all the tenders either in full or in part without assigning any reason.

10. Before bidding, the Tenderer is advised to visit the site, its surroundings to assess and satisfy themselves

about the local conditions such as the working and other constraints at site, approach roads to the site,

availability of water & power supply, application of taxes, duties and levies as applicable, accommodations

they may require etc. and any other relevant information required by them to execute complete scope of

work. The Tenderer may obtain all necessary information as to risks, weather conditions, contingencies &

other circumstances (insurgencies etc.) which may influence or affect their tender prices. Tenderer shall be

deemed to have considered site conditions whether he has inspected it or not and to have satisfied himself

in all respect before quoting his rates and no claim or extra charges whatsoever in this regard shall be

entertained/ payable by the MPSEDC at a later date.

11. The Tenderer must attest all erasures and alterations made while filling the tender Document by putting his initials. Over-writing of figures is not permitted.

12. If the Tenderer fails to comply with any of the above stated conditions, the tender shall be considered as invalid.

13. All inclusive prices should be quoted in the original B.O.Q of financial bid given in the tender document. The

rates quoted by the Tenderer shall be firm and fixed for the entire period of completion and till handing

over of the work.

The contractor shall be responsible for the payment, wherever payable, at his own cost of all taxes such as

excise duty, custom duty, sales tax, including the Service tax, purchase tax, consignment tax, work

contract tax, or any other similar tax in the state concerned, turnover tax, toll tax, octroi charges, royalty,

cess, levy and other tax(es) or duty(ies) which may be specified by local/state/central government

from time to time on all materials, articles which may be used for this work. The rates quoted by him

in the tender in bill of quantities shall be inclusive of all such taxes, duties etc. The imposition of any new

and/ or increase in the aforesaid taxes, duties, levies (including fresh imposition of Work Contract Tax,

Turnover Tax, Sales Tax on Work Contract or any other similar Tax) etc. during the currency of the contract

shall be borne by contractor and shall not be paid or reimbursed to the contractor by MPSEDC. .In the event

of non-payment/default in payment of any octroi, royalty, cess, turnover tax, sales tax, including the purchase

tax, consignment tax, work contract tax or any other similar tax in the state concerned, customs, excise or

any other levy/tax including labor dues etc. by contractor/ supplier, MPSEDC reserves the right to with-hold

the dues/ payments of contractor and make payment to local/state/ Central Government authorities or to

laborers as may be applicable. The contractor should submit along with the tender Registration Certificates

with Sales Tax on works contract authority etc. otherwise appropriate recovery shall be made from his bills.

14. Following procedures shall be adapted in case of difference in quoted rates in figures and words and

extensions.

a) Where there is difference between rates in figures and in words, the rates quoted in words shall be

considered as correct.

b) Where the amount of an item is not worked out or it does not correspond to the rate either in figure or in

words, the rates quoted in words shall be considered as correct and necessary consideration made.

c) Where the rates quoted by the Tenderer in figures and in words tally, but the amount is not worked out

correctly, the rates quoted by the Tenderer shall be considered as correct and amount shall be corrected

accordingly.

15. All Taxes as applicable from time to time shall be deducted from each running bill of the contractor.

ELIGIBILITY/ EVALUATION CRITERIA OF TECHNICAL BID:

The Evaluation of Bidder�s technical Proposal shall be as given hereunder:

a) Bidder(s) must have successfully completed at least one similar work of value not less than Rs.150.00 Lacs (Rupees One hundred Fifty Lacs) for State/Central Govt., PSUs/Corporate or any other reputed institution in the last five years.

OR

Must have successfully completed two similar works of value not less than Rs. 75.00 Lacs (Rupees Seventy Five Lacs) each, for State/Central Govt., PSUs/Corporate or any other reputed institution in the last five years Bidder must submit the proof of experience by providing the attested copies of Work Order/Agreement and work Completion Certificate showing the executed value of the job.

b) As per the audited financial results, the Average Annual Turnover of the preceding three financial years (FYs) i.e., 2011-12, 2010-11 & 2009-10 of the bidder should be not less than Rs.200.00 Lacs. In case, Balance Sheet and Profit & Loss account statement (B/S & P/L) for FY 2011-12 is still not audited, then bidder has an option to submit the B/S & P/L account statement for FY 2008-09 also in support of meeting the minimum turn over criteria. Bidders must submit the attested copy of Income tax returns and audited B/S & P/L accounts statement for relevant FYs along with the technical bid. Note: Turnover figures related to the Interior works shall only be considered.

GENERAL CONDITION OF CONTRACT

1.0 GENERAL INFORMATION:

2.0 Handing over & Clearing of site:

2.1 The Contractor should note that area for proposed Interior work may be made available in phases as

per availability and in conjunction with pace of actual progress of work at site. The work may be required

to be carried out in constrained situations. The work is to be carried out in such a way that the traffic,

people movement, if any, is kept operative and nothing extra shall be payable to the contractor due to

this phasing/ sequencing of the work. The contractor is required to arrange the resources to complete

the entire project within total stipulated time. The contractor shall not be entitled for any extra payment,

whatsoever, in this regard. It should be clearly understood that the MPSEDC shall not consider any

revision in contract price or any other compensation whatsoever viz. towards idleness of Contractor�s

labour, equipment etc.

2.2 Space for site office shall be decided at site. The store for material, tools and labor accommodation

shall be arranged by the contractor at his own cost. The site should be well maintained and kept clean

by the Contractor throughout the project execution.

2.3 After the completion of the project, the Contractor shall remove all the Temporary structures (if any)

constructed by him and clear the site as per the Instructions of the MPSEDC. In case, if the Contractor

fails to do so, the Consultant / Owner shall have right to remove the temporary structures and clear the

site. The expenses incurred shall be recovered from the Contractor from the payments due to him.

2.4 The contractor shall make his own arrangement for Water & Electrical power for the execution of work of

their scope and other purposes at his own cost and pay requisite electricity and water charges. The

contractor shall also make standby arrangement for water & electricity to ensure un-interrupted supply.

3.0 Scope of work:

The scope of work envisaged in this tender broadly includes but not limited to the Interiors works only. The scope of work covered in this tender shall be as per the Bill of Quantities, specifications, drawings, instructions, orders issued to the contractor from time to time during the pendency of work. The drawings for this work, which may be referred for tendering, provide general idea only about the work to be performed under the scope of this contract. These may not be the final drawings and may not indicate the full range of the work under the scope of this contract. The work will be executed according to the drawings to be released as "GOOD FOR CONSTRUCTION" from time to time by the Consultant/ MPSEDC and according to any additions/modifications/alterations/ deletions made from time to time, as required by any other drawings that would be issued to the contractor progressively during execution of work. It shall be the responsibility of the contractor to incorporate the changes that may be in this scope of work, envisaged at the time of tendering and as actually required to be executed.

3.1 The quantities of various items as entered in the "BILL OF QUANTITIES" are indicative only and may vary depending upon the actual requirement. The contractor shall be bound to carry out and complete the stipulated work irrespective of the variation in individual items specified in the bill of quantities. The variation of quantities will be governed as per stipulated terms & condition of contract.

3.2 Fixed Interior & Loose furniture works: The above is indicative of the broad scope of work. However, depending upon site conditions and situations, it is possible that certain other works not included above may be required to be executed. Such additions / deletions / alterations shall not be the ground for any claims or extras what so ever it may be.

3.3 Samples & Shop Drawings: After the award of the contract, the contractor shall furnish the shop drawings and samples of materials to be incorporated, for the approval of competent authority.

4.0 COMMITMENT OF CONTRACTOR: 4.1 Interpretation of Contract documents: 4.1.1 All the documents forming part of the contract are to be taken as mutually explanatory, supplementary

and complementary to each other, if there is any error, omission or discrepancy in any of them, it shall be brought to the notice of the Consultant / Owner well in time. The decision of the Consultant /Owner shall be final and binding. The Contractor shall execute the work only after the clarification in writing from Consultant / Owner.

4.1.2 The Contractor shall examine all the contract documents thoroughly including the scope, nature and magnitude of works he has to execute in accordance with the contract documents

4.1.3 The Contractor shall visit the project site to study the site conditions, means of access to the site, in addition to other factors governing the works.

4.1.4 There may be change in the interior layout as per technical requirements and the tenderer shall not be entitled for any claim due to such changes.

4.2 Performance Security/ Retention Money: The Successful Tenderer will furnish within 7 days after the

issue of Letter of Intent (LOI), an amount equal to 10% of the accepted contract value as Performance Security by way of crossed Demand draft or an unconditional Bank Guarantee of any Indian Nationalized Bank/ Scheduled Bank) valid for the period of 90 days after the end of the defect liability period. The performance security shall be released after successful completion of Defect liability period of 12 months, provided the contractor has satisfactorily carried out all the works and attended to all the defects in accordance to all stipulated term & conditions of the contract.

4.3 Time of Completion: The work shall be completed in all respects with in 50 days + 7 days for mobilization. 4.4 Work Schedule:

The successful tenderer shall submit the work schedule in the form of programme charts within five days from the date of commencing of work and shall execute the work strictly as per the schedule submitted by him.

4.5 Compensation for delay (Liquidated damages): Time is essence of contract. If the Contractor fails to complete the work and clear the site on or before the dates fixed for completion, he shall without prejudice to any other right or remedy on account of such breach be liable to pay compensation viz. 0.5 % (half percent) of the total contract value of the work ordered, for every week delay, even though a part remains incomplete. For the purpose of this condition, the contract value shall be, the value of work actually ordered, plus algebraic sum of subsequent work ordered provided always that the total amount of compensation to be paid under this condition shall not exceed 10% (Ten percent) of the total contract value.

4.6. A Force majeure: The events like War, revolution, riots, floods, earthquake and epidemic or any other such reason which is beyond the control of management shall come under the category of force majeure

. If the execution of work is delayed due to any of the above events, then the time period shall be extended as per the affected period.

4.6.B In case work is delayed due to any other reasons which is beyond the Contractor's control, the Contractor shall then upon the happening of any such event causing delay shall immediately but not later than 10 days of happening of such event, give notice thereof in writing to the Owner / Consultant, and shall use his best endeavor to prevent or make good the delay. The accepting officer may in his discretion grant such extension of time as may appear reasonable to him and the same shall be communicated to the Contractor in writing and shall be final and binding. The Contractor shall be bound to complete the work within such extended time.

4.7 Cancellation / Determination of contract in full or part: Subject to other provisions contained in this clause the Consultant may, without prejudice to his any other rights or remedy against the contractor in respect of any delay, inferior workmanship, any claims for damages and / or any other provisions of this contract or otherwise, and whether the date of completion has or has not elapsed, by notice in writing absolutely determine the contract in any of the following cases: i) If the contractor having been given by the Consultant a notice in writing to rectify, reconstruct or

replace any defective work or that the work is being performed in an inefficient or otherwise improper or un-workmanlike manner shall omit to comply with the requirement of such notice for a period of seven days thereafter; or

ii) If the contractor has, without reasonable cause, suspended the progress of the work or has failed to proceed with the work with due diligence so that in the opinion of the Consultant (which shall be final and binding) he will be unable to secure completion of the work by the date for completion and continues to do so after a notice in writing of seven days from the Consultant; or

iii) If the contractor fails to complete the work within the stipulated date or items of work with individual date of completion, if any stipulated, on or before such date(s) of completion and does not complete them within the period specified in a notice given in writing in that behalf by the Consultant; or

iv) If the contractor persistently neglects to carry out his obligations under the contract and / or commits default in complying with any of the terms and conditions of the contract and does not

remedy it or take effective steps to remedy it within 7 days after a notice in writing is given to him in that behalf by the Consultant; or

v) If the contractor shall offer or give or agree to give to any person in MPSEDC/Consultant or to any other person on his behalf any gift or consideration of any kind as an inducement or reward for doing or forbearing to do or for having done or forborne to do any action relation to the obtaining or execution of this or any other contract for MPSEDC; or

vi) If the contractor shall enter into a contract with MPSEDC in connection with which commission has been paid or agreed to be paid by him or to his knowledge, unless the particulars of any such commission and the terms of payment thereof have been previously disclosed in writing to the Consultant; or

vii) If the contractor shall obtain a contract with MPSEDC as a result of wrong tendering or other non-bona-fide methods of competitive tendering; or

viii) If the contractor being an individual, or if a firm, any partner thereof shall at any time be adjudged insolvent or have a receiving order or order for administrative of his estate made against him or shall take any proceedings for liquidation or composition (other than a voluntary liquidation for the purpose of amalgamation or reconstruction) under any Insolvency Act for the time being in force or make any conveyance or assignment of his effects or composition or arrangement for the benefit of his creditors or purport so to do, or if any application be made under any Insolvency Act for the time being in force for the sequestration of his estate or if a trust deed be executed by him for benefit of his creditors; or

ix) If the contractor being a company, shall pass a resolution or the Court shall make an order for the winding up of the company, or a receiver or manager, or

x) If the contractor shall suffer an execution being levied on his goods and allow it to be continued for a period of 21 days; or

xi) If the contractor assigns, transfers, sublets (engagement of labour on a piece-work basis or of the labour with materials not to be incorporated in the work, shall not be deemed to be subletting) or otherwise parts with or attempts to assign, transfer sublet or otherwise parts with the entire works or any portion thereof without and prior written approval of the Consultant/MSEDC.

When the contractor has made himself liable for action under any of the cases aforesaid, the Consultant with the prior approval of MPSEDC may without prejudice to any other right or remedy which shall have accrued or shall accrue hereafter to MPSEDC, by a notice in writing to cancel the contract as a whole or only such items of work in default from the Contract. The Consultant shall on such cancellation by the MPSEDC have powers to: a) Take possession of site and any materials, constructional plant, implements, stores, etc.

thereon; and/ or b) Carry out the incomplete work by any means at the risk and cost of the contractor; and/ or c) To determine or rescind the contract as aforesaid (of which termination or rescission notice in

writing to the contractor under the hand of the Consultant shall be conclusive evidence). Upon such determination or rescission the full security deposit recoverable under the contract shall be liable to be forfeited and un-used materials, construction plants, implements, temporary buildings, etc. shall be taken over and shall be absolutely at the disposal of the MPSEDC. If any portion of the Security Deposit has not been paid or received it would be called for and forfeited; and/ or

d) To employ labour paid by MPSEDC and to supply materials to carry out the work or any part of the work debiting the contractor with the cost of the labour and the price of the materials (of the amount of which cost and price certified by the Consultant shall be final and conclusive) against the contractor and crediting him with the value of the work done in all respects in the same manner and at the same rates as if it had been carried out by the contractor under the terms of his contract. The certificate of the Consultant as to the value of the work done shall be final and

conclusive against the contractor provided always that action under the sub-clause shall only be taken after giving notice in writing to the contractor. Provided also that if the expenses incurred by the department are less than the amount payable to the contractor at his agreement rates, the difference shall not be paid to the contractor; and/ or

e) After giving notice to the contractor to measure up the work of the contractor and to take such whole, or the balance or part thereof as shall be un executed or delayed with reference to the General Conditions of Contract clause no.4.5 and/or relevant clause of Special Conditions of Contract, out of his hands and to give it to another contractor to complete in which case any expenses which may be incurred in excess of the sum which would have been paid to the original contractor if the whole work had been executed by him (of the amount of which excess the certificate in writing of the Consultant shall be final and conclusive) shall be borne and paid by the original contractor and may be deducted from any money due to him by MPSEDC under his contract or on any other account whatsoever or from his security deposit or the proceeds of sales of unused materials, construction plants, implements temporary buildings etc. thereof or a sufficient part thereof as the case may be. If the expenses incurred by the MPSEDC are less than the amount payable to the contractor at his agreement rates, the difference shall not be paid to the contractor; and/ or

f) By a notice in writing to withdraw from the contractor any items or items of work as the Consultant may determine in his absolute discretion and get the same executed at the risk and cost of the contractor.

Any excess expenditure incurred or to be incurred by MPSEDC in completing the works or part of the works or the excess loss or damages suffered or may be suffered by MPSEDC as aforesaid after allowing such credit shall without prejudice to any other right or remedy available to MPSEDC in law be recovered from any moneys due to the contractor on any account, and if such moneys are not sufficient the contractor shall be called upon in writing and shall be liable to pay the same within 30 days.

If the contractor shall fail to pay the required sum within the aforesaid period of 30 days, the MPSEDC shall have the right to sell any or all of the contractor�s unused materials, constructional plant, implements, temporary buildings, etc. and apply the proceeds of sale thereof towards the satisfaction of any sums due from the contractor under the contract and if thereafter there be any balance outstanding from the contractor, it shall be recovered in accordance with the provisions of the contract and law.

Any sums in excess of the amounts due to MPSEDC and unsold materials, constructional plant etc. shall be returned to the contractor, provided always that if cost or anticipated cost of completion by MPSEDC of the works or part of the works is less than the amount which the contractor would have been paid had he completed the works or part of the works, such benefit shall not accrue to the contractor. In the event of anyone or more of the above courses being adopted by the Consultant /MPSEDC the contractor shall have no claim to compensation for any loss sustained by him by reasons of his having purchased or procured any materials or entered into any engagements or made any advances on account or with a view to the execution of the work or the performance of the contract. And in case action is taken under any of the provision aforesaid the contractor shall not be entitled to recover or be paid any sum for any work thereof or actually performed under this contract unless and until the Consultant has certified in writing the performance of such work and the value payable in respect thereof and he shall only be entitled to be paid the value so certified.

Provided further that if any of the recoveries to be made, while taking action as per (d) and/or (e) above, are in excess of the security deposit forfeited, these shall be limited to the amount by which the excess cost incurred by MPSEDC exceeds the security deposit so forfeited.

4.8 Contractor liable to pay compensation even action not taken:

In any case in which any of the powers conferred upon the Consultant by relevant clause thereof, shall have become exercisable and the same are not exercised, the non-exercise thereof shall not constitute a waiver of any of the conditions hereof and such powers shall notwithstanding be exercisable in the event of any future case of default by the contractor and the liability of the contractor for compensation shall remain unaffected. In the event of the Consultant putting in force all or any of the powers vested in him under the preceding clause he may, if he so desires after giving a notice in writing to the contractor, take possession of (or at the sole discretion of the Consultant which shall be final and binding on the contractor) use as on hire (the amount of the hire money being also in the final determination of the Consultant) all or any tools, plant, materials and stores, in or upon the works, or the site thereof belonging to the contractor, or procured by the contractor and intended to the used for the execution of the work/or any part thereof, paying or allowing for the same in account at the contract rates, or in the case of these not being applicable, at current market rates to be certified by the Consultant, whose certificate thereof shall be final, and binding on the contractor and/or direct the contractor, clerk of the works, foreman or other authorized agent to remove such tools, plant, materials, or stores from the premises (within a time to be specified in such notice) in the event of the contractor failing to comply with any such requisition, the Consultant may remove them at the contractor's expense or sell them by auction or private sale on account of the contractor and his risk in all respects and the certificate of the Consultants to the expenses of any such removal and the amount of the proceeds and expenses of any such sale shall be final and conclusive against the contractor.

4.9 Approved Equal:

�Approved Equal� shall mean an alternative product / service approved by the MPSEDC as equivalent to that specified in the contract documents.

4.10 Items of work for completion:

The tenderer is bound to carry out any items of work necessary for the completion of the job, even though such items are not included in the BOQ, in the stipulated period of time, unless an extension of time is duly authorized. The MPSEDC will issue instructions for such additional items and their quantities in writing.

4.11 Schedule of quantities:

The quantities given in the schedule of quantities are provisional and are only meant to indicate the intent of the work and to provide bases for tendering. The contractor shall be paid for the actual quantity of work executed by him actually at site as per the instructions. The MPSEDC will have the right to increase or decrease any of the quantities or totally omit any items of work and the contractor shall not claim any extra or damages on these grounds subject to the condition that the overall contract amount is not varied by more than + or - 10% of overall contract amount, however for the purpose of this variation, the escalation in cost of materials, labour etc shall not be taken into account. Any error in description or in quantity or omission of item in the schedule of quantities shall not violate this contract but shall be deemed to be a variation required for completion of the project.

4.12 Termination of contract on death:

If the Contractor is an individual or a proprietary firm and the individual or proprietor dies and if the Contractor is a partnership firm and one of the partners dies, then the Consultant / Owner has the right to terminate the contract unless and until the Consultant / Owner is satisfied

that the surviving partners are capable of executing and completing the remaining contract. In case of termination of contract, the legal representatives of the deceased Contractor are not entitled for any compensation or claim. In addition MPSEDC shall not levy any penalty against the damage caused by incomplete work.

4.13 Contractor's subordinate staff:

The Contractor shall depute qualified engineers for execution of the project. The technical staff employed by the Contractor shall be responsible for the quality and workmanship of the work as per the satisfaction of MPSEDC. The Contractor�s supervisory staff should follow the instructions given by MPSEDC or his authorized representative. If any of the Contractor's staff members is incapable or inexperienced, in the opinion of consultant/owner, then he should be removed immediately and the Contractor should do suitable substitution. The Technical staff to be employed should be degree holder from a government recognized institution with at least 3 years practical experience of work, in addition to Diploma holder and other experienced supervisory staff to be deployed at site. .

4.14 Subletting of contract:

The Contractor shall not appoint any sub-contractors for execution of any part of the works, without the written approval of the MPSEDC.

4.15 Co-operation with other agencies at site:

The Contractor or his authorized representatives must work in close co-operation with the agencies executing other works forming the part of the project and also with the other agencies employed by the Consultant / Owner for the execution of the works / incidental works. Contractor shall permit free access and generally afford reasonable facilities to other agencies or departmental workmen etc. The Contractor�s quoted amount / rates shall be deemed to cater for all the above contingencies and nothing extra shall be admissible on this account.

4.16 Safety of adjoining properties:

The Contractor or his authorized representatives should conduct all the operations necessary for the execution of works in such a manner that no inconvenience / damages are caused to the properties of other persons / agencies.

4.17 Taxes and Duties: 4.17.1 The contractor shall be responsible for the payment, wherever payable, at his own cost of all taxes such

as excise duty, custom duty, sales tax, including the service tax, purchase tax, consignment tax, work contract tax, or any other similar tax in the state concerned, turnover tax, toll tax, octroi charges, royalty, cess, levy and other tax(es) or duty(ies) which may be specified by local/state/central government from time to time on all materials, articles which may be used for this work. The rates quoted by him in the tender in bill of quantities shall be inclusive of all such taxes, duties etc. The imposition of any new and/ or increase in the aforesaid taxes, duties, levies (including fresh imposition of Work Contract Tax, Turnover Tax, Sales Tax on Work Contract or any other similar Tax) etc. during the currency of the contract shall be borne by contractor and shall not be paid or reimbursed to the contractor by MPSEDC. .In the event of non-payment/default in payment of any octroi, royalty, cess, turnover tax, sales tax, including the service tax, purchase tax, consignment tax, work contract tax or any other similar tax in the state concerned, customs, excise or any other levy/tax including labor dues etc. by contractor/ supplier, MPSEDC reserves the right to with-hold the dues/ payments of contractor and make payment to local/state/ Central Government authorities or to laborers as may be applicable. The contractor should submit along with the tender Registration Certificates with Sales Tax on works contract authority etc. other wise appropriate recovery shall be made from his bills.

4.17.2 The rate quoted by the contractor shall be deemed to be inclusive of service tax, Sales Tax, Turnover Tax on works contract or any similar tax as per the Act applicable in the State and it shall not be reimbursed by MPSEDC. Tax deductions at source shall be made as per laws prevalent in the State.

4.17.3 The stamp duty and registration charges, if any, on the contract agreement levied by the Government or

any other statutory body, shall be paid by the contractor. 4.17.4 It will be incumbent upon the Contractor to obtain a registration certificate as a dealer under the Local

Sales Tax Act and the Central Sales Tax Act and necessary evidence to this effect shall be furnished by the Contractor to MPSEDC. Sales Tax on the transactions between the Contractor and his Subcontractor/Vendors etc. shall not be reimbursed by MPSEDC. The Contractor shall be responsible for any taxes that may be levied hereunder on the transaction between Contractor and MPSEDC.

4.17.5 The bidder shall quote his rates inclusive of Service tax, Turnover Tax/ Sales Tax on Works Contract

payable to State/Central Govt. along-with other taxes, duties, levies etc. in conjunction with other terms and conditions. In case, the Service tax, Turnover Tax/ Sales Tax on Works Contract on execution of works is waived off by the State/Central Govt. at later stage for this project, the equivalent amount from the date of waiver of such tax (as per prevailing rate as on the date of waiver of Service tax, Turnover Tax/ Sales Tax on Works Contract) shall be deducted from the amount payable to the contractor from subsequent RA Bills.

4.17.6 Value Added Tax (VAT)

"The consideration agreed for the execution of said contract shall includes the tax, duties, cess, etc. such as excise duty, VAT, which are applicable or may be levied in future under any State Law or the Central Law on execution of said contract, such taxes shall be borne by the contractor and shall not be reimbursed by MPSEDC. Further, if due to any variance in such tax, duties, cess etc. there is any increase in the taxes, the same shall also be borne by the contractor. Where under any of the State or the Central Law, there is requirement of deduction of tax at source, the same shall be deducted from the amount paid or payable to the contractor pursuant to this contract and shall be deposited to the Government authorities by MPSEDC. The MPSEDC shall issue the documents/forms/ certificate as prescribed under the relevant law, in respect of the amount so deducted from the amount paid or payable to the contractor. MPSEDC shall have full rights to withhold the amount payable to the contractor in pursuant to this contract, if contractor does not fulfill his obligation under any State or Central Law relating to execution of said contract, in case the amount has already been paid, MPSEDC has the right to recover such payments from the contractor.

4.17.7 Royalty on Materials:

The contractor shall deposit royalty and obtain necessary permit for disposing off surplus excavated rocks and for supply of bajri, stone, kankar, sand, bricks etc. from the local authorities and quoted rates shall be inclusive of royalty

4.18 Arbitration:

Except as otherwise provided in this contract all question and disputes relating to the meaning of the specifications, designs, drawings and instructions herein before mentioned and as to thing whatsoever, in any way, arising out of or relating to the contract, designs, drawings, specifications, estimates, concerning the works, or the execution or failure to execute the same, whether arising during the progress of the work or after the completion or abandonment thereof shall be referred to the Additional Chief General Manager, MPSEDC who shall give his written instructions and/or decisions within a period of 30 days of such request. This period can be extended by mutual consent of the parties. Upon receipt of written instructions or decisions, the party shall promptly proceed without delay to comply such instructions or instructions. If any party is not satisfied with the decision of the Additional

Chief General Manager, MPSEDC, he can refer such dispute to MD , MPSEDC for arbitration governed as per " The Madhya Pradesh Madhyastha Abhikaran Adhiniyam 1983".

4.19 Escalation:

The rates quoted by the Contractor in this contract documents shall be final and shall not be subjected to any change due to the increase in labour wages or inflation in the cost of materials or any other price variations due to any reason during the tenure of the contract or during the extended time of completion.

4.20 Insurance:

The Contractor shall at his own expense carry and maintain insurance with reputed insurance companies to the satisfaction of the owner as under:

i) Insurance of works: The Contractor shall take full responsibility for loss, damage and care of the

area and the works until it is, constructed, and handed over to the Owner. The Contractor shall in the interest of the work insure the plant and the work for their full value (contract value) plus 10.00% (ten percent) until the works have been taken over. Such insurance shall cover the equipments and works against loss, damage or destruction by fire, earthquake, theft or any other cause, throughout the duration of the contract period or extended contract period. If the Contractor fails to undertake the insurance, the owner will insure and debit the premium expenditure to the Contractor's account.

ii) Insurance of employees: The Contractor shall accept full and exclusive Liability for the compliance

with all obligations imposed by the Employees State Insurance Act, 1948 and any liability or penalty which may be imposed by the Central, State or Local Authorities due to the reason of violation by the Contractor or sub-contractor of the Employees State Insurance Act, 1948, the shall be recovered from any of the payment due to Contractor. The Contractor shall agree to fulfill the requirements of Employees State Insurance Corporation, the declaration forms and all forms which may be required in respect of the Contractor's, sub-contractor's employees who are employed in the work provided for or those covered by E.S.l.C. from time to time under the agreement. The Owner shall retain such sum as may be necessary from the total contract value until the Contractor shall furnish satisfactory proof that all contributions as required by the Employees State Insurance Act, 1948 have been paid.

iii) Workmen�s Compensation: Insurance shall be effected for all the Contractor's employees

engaged for this contract, if any of the work is sub-let, the Contractor shall require the sub-contractor to provide workmen�s compensation and employers liability insurance for the latter's employees, if such employees are not covered under the Contractor's insurance. The Contractor shall also carry and maintain all other insurance, which may be required under any law or regulations from time to time. He should also carry and maintain any other insurance, which may be required by the Owner.

iv) Transit Insurance: The cost of transit insurance relating to the items to be transported by the

Contractor to the site of work shall be borne by the Contractor and the quoted price shall be inclusive of this cost.

v) Loss or damage and Indemnity Agreement: The Contractor shall be responsible during the

progress of work as well as maintenance period for any liability imposed by law for any damage to work or any part thereof or to any of the materials or other things including those of owner used in performing the work or for injury to any person or persons or for any property damaged in or outside the Site. The Contractor shall indemnify and hold the owner and the engineer Harmless against all liability, claims, loss or injury, including costs, expenses and attorneys, fees incurred in the defense of same, arising from any Allegation whether groundless or not, of damage or injury to

any person or Property resulting from the performance of the work or from any material used in the work or from any condition of the work or works site or from any cause whatsoever during the progress and maintenance of the work.

vi) Third party insurance: Before commencing the execution of the works, the Contractor, but without

limiting his obligations and responsibilities shall insure against his liability for any material or physical damage, loss or injury which may occur to any property, including that of the Owner, or to any person, including any representative of the Owner, by or arising out of the execution of works or in the work being carried out by the owner, by or arising out of the referred to in the provision to clause 4.20( v) here of. Such insurance shall be effected with an insurer, in terms approved by the Owner, and for at least the amount stated in the Appendix of the Tender. The Contractor shall deposit with the Engineer or the Engineer's representative the policies of insurance and the receipts for payment of the current premiums. The term shall include a provision whereby, in the event of any claim in respect of which the owner would be entitled to receive indemnity under the policy being through or made against the Contractor, the insurer will indemnify the Owner against such claims and any costs, charges and expenses in respect there of.

vii) The Contractor is required to deposit copies of all insurance policies with the MPSEDC.

5.0 EXECUTION OF WORK 5.1 General:

All the works shall be executed in accordance with the detailed drawings, IS Specifications and instructions given by the Owner/Consultant or as mentioned in the contract document.

5.2 Drawings: The drawings given in the tender document are indicative only. They are only meant for giving idea of the type and quantum of work to be executed. All working drawings shall be marked "Released for Execution" and duly signed by the Consultant. All the old drawings shall be discarded and marked with �Superseded by drawing no..... �If during the execution of the work any discrepancy occurs in the drawings or between the drawings and specification, then the same should be clarified from the Consultant / Owner prior to the execution of work. The decision given by the Consultant / Owner would be final.

5.3 Material and Samples: 5.3.1 The materials/ products used on the works shall be one of the approved make/brands out of list of

manufacturers/ brands/ makes given in the tender documents. The contractor shall submit samples/ specimens out of approved makes of materials/ products to the Consultant for prior approval. In exceptional circumstances Consultant may allow alternate equivalent makes/ brands of products/ materials after getting approval from MPSEDC. The final choice of brand/ make shall remain with the Consultant, whose decision in this matter shall be final and binding and nothing extra on this account shall be payable to the Contractor. In case single brand/ make is mentioned, other equivalent makes/ brands may be considered by the Consultant after prior approval of MPSEDC. In case of variance in CPWD/ IS/BIS Specifications from approved products/ makes specification, the specification of approved product/ make shall prevail for which nothing shall be paid extra to the Contractor. In case no make or brand of any materials, articles, fittings and accessories etc. is specified, the same shall comply with the relevant Indian Standard Specifications and shall bear the ISI/BIS mark. The Consultant /MPSEDC shall have the discretion to check quality of materials and equipments to be

incorporated in the work, at source of supply or site of work and even after incorporation in the work. They shall also have the discretion to check the workmanship of various items of work to be executed in this work. The contractor shall provide the necessary facilities and assistance for this purpose.

5.3.2 The above provisions shall not absolve the contractor from the quality of final product and in getting the

material and workmanship quality checked and approved from the MPSEDC. 5.3.3 The contractor shall well in advance, produce samples of all materials, articles, fittings, accessories etc.

that he proposes to use and get them approved in writing by Consultant. The materials articles etc. as approved shall be labeled as such and shall be signed by Consultant and the Contractor's representative.

5.3.4 The approved samples shall be kept in the custody of the Consultant till completion of the work.

Thereafter the samples except those destroyed during testing shall be returned to the contractor. No payment will be made to the contractor for the samples or samples destroyed in testing.

5.3.5 The brands of all materials, articles fittings etc approved together with the names of the manufacturers

and firms from which supplies have been arranged shall be recorded in the site order book. 5.4 Test and Inspection of works: 5.4.1 The contractor shall carry out the various mandatory tests from authorized laboratory, as per

specifications and the technical documents that will be furnished to him during the performance of the work.

5.4.2 All the tests on materials, as recommended by CPWD, MOST and relevant Indian Standard Codes or

other standard specifications (including all amendments current at the last date of submission of tender documents) shall be got carried out by the contractor at the field testing laboratory or any other recognized institution/laboratory, at the direction of the MPSEDC.

5.4.3 All testing charges, expenses etc. shall be borne by the contractor. All costs towards samples, materials,

collection, transport, manpower, testing etc. shall be borne by the Contractor and are deemed to be included in the rates quoted by him in the bill of quantities.

5.4.4 Works to be open to Inspection: All works executed or under the course of execution in pursuance of

this contract shall at all times be open to inspection and supervision of the Consultant/MPSEDC. The work during its progress or after its completion may also be inspected, by Chief Technical Examiner of Government of Madhya Pradesh (CTE) and/ or an inspecting authority of State Government and/or by third party checks by MPSEDC. The compliance of observations/ improvements as suggested by the inspecting officers of MPSEDC/CTE/ State authorities shall be obligatory on the part of the Contractor at the cost of contractor

5.5 Inadequate works and materials:

i) If any material brought by the Contractor is found unsuitable or of sub-standard quality after testing, then the Contractor shall remove that faulty materials immediately from the site as per the instructions of the MPSEDC.

ii) If any work executed by the Contractor is found to be of bad workmanship or not as per the drawings, then the same is to be dismantled and re-executed by the Contractor without claiming any extra payment.

5.6 Discrepancies between instructions:

If any discrepancy occurs between the various instructions conveyed to Contractor or his authorized representative or if any misunderstanding arises between the Contractor's staff and owner's staff, the Contractor shall report the matter immediately to MPSEDC, whose decisions shall be final and binding. Moreover, no claims for losses due to discrepancies between instructions, doubts or misunderstandings shall be admissible.

5.7 Change in specifications and extra items:

If there is any variation in specification for any change in make of item then it has got to be approved from the Consultant / Owner in writing prior to installation or execution and the financial effect, plus or minus, or impact shall be incorporated accordingly by the Consultant / Owner. If any of the items to be executed is not included in the schedule of quantities, then the Contractor shall submit the rate analysis of the item specifying the actual cost of prevailing rates of material and labour and allowing 15 % to cover overhead and profit.

5.8 Work not specified in the specification:

If for any work, no specification has been given in the tender document, then the work will be executed as per the IS specifications, and if the work is not covered by IS specifications then it should be executed as per standard engineering practice, subject to the approval of the Consultant / Owner in writing.

5.9 Progress Report: During execution of the contract, the Contractor shall furnish fortnightly progress reports to MPSEDC and in the format as specified by the Consultant / Owner indicating the progress achieved during the fortnight and the total progress up to the fortnight as against scheduled and anticipated completion dates in respect of key phases of the work such as, release of drawings for fabrication, procurement of materials, fabrication, inspection, testing at works, transportation, installation, erection, testing at site, commissioning etc. The Contractor shall also furnish any other information in order to ascertain progress, if called for by the Consultant / Owner.

5.10 Liabilities for defects and rectification:

If it shall appear to the Consultant / Owner in charge that any work has been executed with imperfect or unskilled workmanship or with materials of any inferior description, or of quality inferior to that contracted for, or otherwise not in accordance with the contract, the Contractor shall on demand in writing from the Consultant / Owner or his representative specifying the work, materials or articles complained of notwithstanding that the same may have been inadvertently paid for, forth with rectify, remove and reconstruct that work so specified and provide other proper and suitable materials or articles at his own charges and cost, and in the event of failure to do so within a period to be specified by the Consultant / Owner or his demand aforesaid, the Consultant / Owner may on expiry of notice period rectify or remove, re-execute the work at the risk of Contractor and the cost shall be recovered from the Contractor. The decision of the Consultant / Owner as to any question arising under this clause shall be final and conclusive.

5.11 Suspension of work:

The Contractor shall suspend the progress of work on receipt of the written order from the Consultant / Owner for any of the following reasons: a) On account of any default on the part of the Contractor. b) For execution of the work for reasons other than the default of the contractor. c) For safety of the works.

5.11.1 The Contractor shall during such suspension, properly protect and secure the works and carry out the instructions of the Consultant / Owner.

5.11.2 If the suspension is ordered for the reasons 5.11 (b) and (c) as stated above, the Contractor shall be entitled for extension of time equal to the period of every such suspension but no compensation for damages etc. shall be admissible on account of suspension of work.

5.11.3 If the progress of the work is suspended for the reason stated in 5.11(a) then the Contractor shall not be entitled for the extension of time and also, the Contractor shall have no claim for payment of compensation for re-execution of faulty works.

6.0 Possession prior to completion:

The Consultant / Owner shall have the authority to take possession of any completed or partially completed works. Such possession shall not be deemed to be acceptance of any work completed in accordance with the contract; if such prior possession delays the progress of works then the adjustment in the time of completion shall be done accordingly. The decision of the MPSEDC regarding the extent of delay shall be final and binding.

7.0 Defect liability period: The contractor shall be responsible for the rectification of defects in the works for a period twelve months from the date of taking over of the works by the MPSEDC. Any defects discovered and brought to the notice of the contractor forthwith shall be attended to and rectified by him at his own cost and expense. In case the contractor fails to carry out these rectifications, the same may without prejudice to any other right or remedy available, be got rectified by MPSEDC at the cost and expense of the contractor.

8.0 Care of Works:

From the commencement to the completion of works, the Contractor shall take full responsibility for the care of all works including all temporary works and in case any damage or loss occurs then the Contractor shall at his own cost repair and make good the same so that on completion of the work, the same shall be in good order, in all respect, in accordance with the contract and to the fullest satisfaction of the MPSEDC.

9.0 Work on Sunday, Holidays and during Night:

For carrying out work on Sunday and Holidays or during night, the contractor will approach the Consultant or his representative at least two days in advance and obtain his permission. The Consultant at his discretion can refuse such permission. The contractor shall have no claim on this account whatsoever. If work demand, the contractor shall make arrangements to carry out the work on Sundays, Holidays and in two, three shifts with the written approval of Consultant at no extra cost to MPSEDC

10.0 No Idle Charges towards Labour or P&M etc.:

No idle charges or compensation shall be paid for idling of the contractor's labour, staff or P&M etc. on any ground or due to any reason whatsoever. MPSEDC will not entertain any claim in this respect.

11.0 CERTIFICATE AND PAYMENT

11.1 Schedule of Rates:

i) The payments to be made to the Contractor for various items of works shall be as per the all inclusive rates quoted by the Contractor in the tender document.

ii) The rates quoted by the Contractor in the tender document shall remain firm till the completion of the work.

iii) The schedule of rates shall deem to include the cost of all taxes and testing fees for the articles and no extra payment for the same shall be given to the Contractor.

iv) The schedule of rates shall be deemed to include and cover the risks of all possibilities of delay and no extra payment shall be given to the Contractor for the work executed in the extended time period.

v) The payment shall be made by the MPSEDC after due scrutiny by the consultant.

. 11.2 Measurement of Works: 11.2.1 Unless otherwise mentioned in the bill of quantities and as specified in Technical Specification of the

Tender the measurements of works shall be done as per CPWD specifications and if the same is not given in the CPWD Specifications, the same shall be measured as per latest relevant BIS codes in force.

11.2.2 The Measurements of various items of the work shall be taken jointly by the contractor�s authorized

representative with the Consultant/MPSEDC�s authorized representative for maintaining the record. 11.2.3 In presence of the Contractor authorized representative the Consultant or his subordinate staff shall

record these measurements in the measurement books supplied by the MPSEDC. 11.2.4 In presence of the Contractor authorized representative the Consultant or his subordinate staff if

deemed fit may also record these measurements in the Laptop (Computer) instead of measurement books supplied by the MPSEDC. In such cases the duly bounded Printed hard copies shall also be treated as the Measurement Book.

11.2.5 All measurements so recorded in the measurement book shall be cross checked and verified by the

Consultant. In the office of the Consultant the Contractor�s authorized representative shall also cross examine these measurements from their own record of joint measurement and at the foot of Measurements, shall give their acceptance as follows: Measurements from Item no�. to Item no�.. of this M.B page no �.to page no�.jointly taken with me and all these measurements are acceptable to us. Signature & Seal of the Contractor or his authorized representative

11.2.6 All Measurement Books shall be kept in the safe custody of the MPSEDC/Consultant.

11.3 Billing & Payments:

11.3.1 The running account bills to be submitted by the Contractor should amount to minimum Rs.30.00 Lacs (Thirty Lacs) on the basis of detailed measurements of various items of Works executed and jointly recorded. The contractor shall prepare computerized bill using the programme as approved by the Consultant /MPSEDC as per prescribed format/proforma. The Contractor shall submit 4 Nos. of hard copies and one soft copy of floppy/CD for all bills.

11.3.2 All running payments/interim payments shall be regarded as payments by way of advance against the final payment only and not as payments for work actually done and completed and / or accepted by Consultant /MPSEDC and shall not preclude the recovery for bad, unsound and imperfect or unskilled work to be removed and taken away and reconstructed or re-erected or be considered as an admission of the due performance of the Contract, or any part thereof, in this respect, or the accruing of any claim, nor shall it conclude, determine or affect in any way the powers of the Consultant /MPSEDC under these conditions or any of them as to the final settlement and adjustments of the accounts or otherwise, or in any other way vary/ affect the contract. The final bill shall be submitted by the contractor within three months of the completion of work; otherwise Consultant /MPSEDC�s certificate of the measurement and of the total amount payable for the work accordingly shall be final and binding on contractor. Each Running Bills should be accompanied by two sets of at-least 20 (twenty) photographs as per direction of Consultant /MPSEDC taken from various points depicting status of work as on Report/ Bill date along with Monthly Progress Report for the concerned month in the pro-forma to be given/ approved by Consultant /MPSEDC. Intermittent progress Photographs as and when required shall also be provided by the Contractor at his own cost as per direction of Consultant /MPSEDC. No payment of running account bill shall be released unless it is accompanied by progress photographs and Monthly Progress Report as above.

11.3.3 All running bills so prepared by the contractor shall be submitted to the Consultant who will duly check and forward the same within 15 days to the M.P.S.E.D.C for payments. MPSEDC shall release the payments within next15days from the date of received of running bills in their office from Consultant, by Account Payee's Cheque from its offices directly at the address notified by the Contractor (Postage charges shall be charged to the contractor's account). In case of Payments is made by Demand Draft at the request of the Contractor, Bank Commission charges shall also be debited to the account of contractor.

12.0 No Compensation for Cancellation/ Reduction of Works:

If at any time after the commencement of the work the Consultant/MPSEDC shall for any reason whatsoever is required to abandon the work or is not required the whole work thereof as specified in the tender to be carried out, the Consultant/MPSEDC shall give notice in writing of the fact to the contractor, who shall have no claim to any payment of compensation whatsoever on account of any profit or advantage which he might have derived from the execution of the work in full, but which he did not derive in consequence of the full amount of the work not having been carried out or fore-closure, neither shall he have any claim for compensation by reason of any alterations having been made in the original specifications, drawings, designs and instructions which shall involve any curtailment of the work as originally contemplated. Provided that the contractor shall be paid the charges on the cartage only of materials actually and bonafide brought to the site of the work by the contractor and rendered surplus as a result of the abandonment or curtailment of the work or any portion thereof and then taken back by the contractor.

13.0 Set-off of Contractor�s Liabilities:

Consultant/MPSEDC shall have the right to deduct or set off the expenses incurred or likely to be incurred by it in rectifying the defects and/or any claim under this agreement against the Contractor from any or against any amount payable to the contractor under this agreement including security deposit and proceeds of performance guarantee.

14.0 Jurisdiction:

The agreement shall be executed at Bhopal on non-judicial stamp paper purchased in Bhopal and the courts in Bhopal alone will have jurisdiction to deal with matters arising there from, to the exclusion of all other courts.

15.0 Final Payment Certificate: Within 45 days after receipt of the Final Statement, and the written discharge, the Consultant after due consultation with MPSEDC�s Representative, shall issue to the MPSEDC (with a copy to the Contractor) a Final Payment Certificate stating, (a) the amount which, in the opinion of the Consultant, is finally due under the Contract; and, (b) after giving credit to the MPSEDC for all amounts previously paid by the MPSEDC and for all sums to which the MPSEDC is entitled under the Contract, the balance, if any, due from the MPSEDC to the Contract or from the Contractor to the MPSEDC as the case may be.

16.0 Taking Over/Virtual Completion Certificate:

When the whole of the works have been completed as per the contract, the Contractor shall be eligible to apply for provisional/Virtual completion certificate in respect of the works. The Consultant in consultation with the MPSEDC shall issue to the Contractor the provisional/Virtual completion certificate after verifying from the completion documents and satisfying himself that the work has been completed in accordance with the construction drawings, specifications and as per the contract conditions. The Contractor, after obtaining the provisional/Virtual completion certificate shall be eligible to present the final bill for the work executed by him under the terms of the contract. The work will not be considered as complete and taken over by the MPSEDC until the entire temporary works, labor hutment etc. are removed and the work site cleared to the satisfaction of the Consultant/MPSEDC If the Contractor fails to comply with the requirements of the above on or before the date for the completion of the works, the Consultant/MPSEDC at the expense of the Contractor, may remove the tools and plants and surplus materials and dispose off the same as he deemed fit. The Contractor shall

bear all such amounts of expenses incurred by the Consultant/MPSEDC. 17.0 Final Certificate:

This shall mean the certificate issued by the MPSEDC after the defect liability period is over.

LABOUR SAFETY PROVISIONS

1.0 Suitable scaffolds should be provided for workmen for all works that cannot safely be done from the ground, or from solid construction except such short period work as can be done safely from ladders. When a ladder is used an extra mazdoor shall be engaged for holding the ladder and if the ladder is used for carrying materials as well, suitable footholds and hand holds shall be provided on the ladder and the ladder shall be given an inclination not steeper than 1/4 to 1 (1/4 horizontal and 1 vertical).

2.0 Scaffolding or staging more than 3.6m (12 feet) above the ground or floor, swung or suspended from an overhead support or erected with stationery support shall have a guard rail properly attached or bolted, braced and otherwise secured at least 90 cm. (3 feet) high above the floor or platform of such scaffolding or staging and extending along the entire length of the outside and ends thereof with only such opening as may be necessary for the delivery of materials. Such scaffolding or staging shall be so fastened as to prevent it from swaying from the building or structure.

3.0 Working platforms, gangways, and stairways should be so constructed that they should not sag unduly or unequally, and if the height of the platform or the gangway or the stairway is more than 3.6m (12 feet) above ground level or floor level, they should be closely boarded, should have adequate width & should be suitable fastened as described in (2.0) above.

4.0 Every opening in the floor of a building or in a working platform shall be provided with suitable means to prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height shall be 90 cm (3 feet).

5.0 Safe means of access shall be provided to all working platforms and other working places. Every ladder shall be securely fixed. No portable single ladder shall be over 9m. (30 feet) in length while the width between side rails in rung ladder shall in no case be less than 29 cm. for ladder upto and including 3m (10 feet) in length. For longer ladders this width should be increased at least 1/4" for each additional 30 cm (1 ft.) of length. Uniform step spacing shall not exceed 30 cm (12"). Adequate precautions shall be

taken to prevent danger from electrical equipment. No materials on any of the sites of the work shall be so stacked or placed as to cause danger or inconvenience to any person or the public. The contractor shall provide all necessary fencing and lights to protect the public from accident, and shall be bound to bear the expenses of defense of every suit, action or other proceeding at law that may be brought by an person for injury sustained owing to neglect of the above precautions and to pay any damages and cost which may be awarded in any such suit, action or proceedings to any such person or which may, with the consent of the Contractor, be paid to compensate any claim by any such person.

6.0 EXCAVATION AND TRENCHING All trenches, 1.2mts.(four feet) or more in depth, shall at all times be supplied with at least one ladder for each 30m. (100 feet) in length or fraction thereof, Ladder shall be extended from bottom of the trench to at least 90 cm (3feet) above the surface of the ground. The side of the trenches, hitch are 1.5m. (5feet) or more in depth shall be stepped back to give suitable slope or securely held by timber bracing, so as to avoid the danger or sides to collapsing. The excavated materials shall not be placed within 1.5m (5 feet) of the edges of the trench or half of the depth of the trench whichever is more. Cutting shall be done from top to bottom. Under no circumstances undermining or undercutting shall be done.

7.0 DEMOLITION: Before any demolition work is commenced and also during the progress of the work: 7.1 All roads and open areas adjacent to the work site shall either be closed or suitably protected. 7.2 No electric cable or apparatus which is likely to be a source of danger or a cable or apparatus used by

the operator shall remain electrically charged. 7.3 All practical steps shall be taken to prevent danger to persons employed from risk or fire or explosion or

flooding. No floor, roof or other part of the building shall be overloaded with debris or materials as to render it unsafe.

8.0 All necessary personal safety equipments as considered adequate by the Engineer-in-charge should

be kept available for the use of persons employed on the site and maintained in a condition suitable for immediate use, and the contractor should take adequate step to ensure proper use of equipment by those concerned- The following safety equipment shall be invariably provided.

8.1 Workers employed on mixing asphaltic materials, cement and lime mortars shall be provided with protective footwear and protective goggles.

8.2 Those engaged in white washing and mixing or stacking of cement bags or any materials which are injurious to the eye shall be provided with protective goggles.

8.3 Those engaged in welding works shall be provided with welders protective eye shields. 8.4 Stone breakers shall be provided with protective goggles and protective clothing and seated at

sufficiently safe interval. 8.5 When workers are employed in sewers and manholes, which are in active use, the Contractors shall

ensure that the manhole covers are opened and ventilated at-least for an hour before the workers are allowed to get into the manholes, and the manholes so opened shall be cordoned off with suitable railing and provided with warning signals or boards to prevent accident the public. In addition, the contractor shall ensure that the following safety measures are adhered to: a) Entry for workers into the line shall not be allowed except under supervision of the JE or any

other higher officer. b) Atleast 5 to 6 manholes upstream and down stream should be kept open for atleast 2 to 3 hours

before any man is allowed to enter into the manholes for working inside. c) Before entry, presence of Toxic gases should be tested by inserting wet lead acetate paper

which changes colour in the presence of such gases and gives indication of their presence. d) Presence of Oxygen should be verified by lowering a detector lamp into the manhole. In case,

no Oxygen is found inside the sewer line, workers should be sent only with Oxygen kit. e) Safety belt with rope should be provided to the workers. While working inside the manholes

such rope should be handled by two men standing outside to enable him to be pulled out during emergency.

f) The area should be barricaded or cordoned of by suitable means to avoid mishaps of any kind. Proper warning signs should be displayed for the safety of the public whenever cleaning works are undertaken during night or day.

g) No smoking or open flames shall be allowed near the blocked manhole being cleaned. h) The malba obtained on account of cleaning of blocked manholes and sewer lines should be

immediately removed to avoid accidents on account of slippery nature of the malba. i) Workers should not be allowed to work inside the manhole continuously. He should be given

rest intermittently. The Engineer In-charge may decide the time up to which a worker may be allowed to work continuously inside the manhole.

j) Gas masks with Oxygen Cylinder should be kept at site for use in emergency. k) Air-blowers should be used for flow of fresh air through the manholes. Whenever called for,

portable air-blowers are recommended for ventilating the manholes. The Motors for these shall be vapour proof and of totally enclosed type. Non sparking gas engines also could be used but they should be placed at-least2 meters away from the opening and on the leeward side protected from wind so that they will not be a source of friction on any inflammable gas that might be present.

l) The workers engaged for cleaning the manholes/ sewers should be properly trained before allowing working in the manhole.

m) The workers shall be provided with Gumboots or non sparking shoes, bump helmets and gloves non sparking tools, safety lights and gas masks and portable air blowers (when necessary). They must be supplied with barrier cream for anointing the limbs before working inside the sewer lines.

n) Workmen descending a manhole shall try each ladder step or rung carefully before putting his full weight on it to guard against insecure fastening due to corrosion of the rung fixed to manhole well.

o) If a man has received a physical injury, he should be brought out of the sewer immediately and adequate medical aid should be provided to him.

p) The extents to which these precautions are to be taken depend on individual situation but the decision of the Engineer �in-charge regarding the steps to be taken in this regard in an individual case will be final.

8.6. The Contractor shall not employ men and women below the age of 18 years on the work of painting

with products containing lead in any form wherever men above the age of 18 are employed on the work of lead painting the following precautions should be taken.

8.6.1 No paint containing lead or lead products shall be used except in the form of paste or readymade paint.

8.6.2 Suitable face masks should be supplied for use by the workers when paint is applied in the form of spray or a surface having lead paint is dry rubbed and scrapped.

8.6..3 Overalls shall be supplied by the Contractor to the workmen and adequate facilities shall be provided to enable the working painters to wash during the cessation of work.

8.6.4.1 a White lead, sulphate or lead work products containing those pigments shall not be used in

painting operation except in the form of paste or of paints ready for use. b. Measures shall be taken whenever required in order to prevent danger arising from the

application of paint in the form of spray. c. Measures shall be taken, whenever practicable to prevent danger arising out of dust caused by

dry rubbing down and scrapping. 8.6.4.2 a Adequate facilities shall be provided to enable working painter to wash during and on cessation

of work. b. Suitable arrangements shall be made to prevent clothing put off during working hours being

spoiled by painting materials.

8.6.4.3 a) Cases of lead poisoning and of suspected lead poisoning shall be notified and shall be subsequently verified by a medical man appointed by the competent authorities of the Consultant.

b) The MPSEDC may require when necessary a medical examination of workers. c) Instructions with regard to the special hygienic precautions to be taken in the painting trade shall

be distributed to working painters.

9.0 When the work is done near any place where there is risk of drowning, all necessary equipments should be provided and kept ready for use and all necessary steps taken for prompt rescue of any person in danger and adequate provisions should be made for prompt first aid treatment of all injuries likely to be obtained during the course of the work.

10.0 Use of hoisting machines and tackle including their attachment encourage and supports shall

conform to the following standard of conditions. 10.1 a) These shall be of good mechanical construction, sound material and adequate strength and free

from patent, defects and shall be kept required in good working order.

b) Every rope used in hoisting or lowering materials or as a means of suspension shall be of durable quality and adequate strength, and free from patent defects.

10.2 Every crane driver or hoisting appliance operator shall be properly qualified and no person under the

age of 21 years should be in-charge of any hoisting machine including any scaffolding, winch or giving signals to operator.

10.3 In case of every hoisting machine and of every chain ring hook, shackle swivel and pulley block used in hoisting or as means of suspension the safe working load shall be ascertained by adequate means. Every hoisting machine and all gear referred to above shall be plainly marked with the safe working load. In case of a hoisting machine having a variable safe working load, each safe working load and the conditions under which it is applicable shall be clearly indicated. No part of any machine or any gear referred to above in this paragraph shall be loaded beyond the safe working load except for the purpose of testing.

10.4 In case of MPSEDC machines, the safe working load shall be notified by the Engineer-in- Charge. As regards Contractor's machines the Contractor shall notify the safe working load of the machine to the Engineer-in-charge whenever he brings any machinery to site of work and get verified by the Engineer-in-Charge.

11.0 Motors gearing, transmission electric wiring and other dangerous parts of hoisting appliances should

be provided with efficient safeguard, hosting appliances should be provided with such means as will reduce to the minimum the risk of accidental descent of the load. Adequate precautions should be taken to reduce the minimum the risk of any part of a suspended load becoming accidentally displaced. When workers are employed on electrical installations, which are already energized, insulating mats, wearing apparel, such as gloves sleeves and boots as may be necessary be provided. The worker should not wear any rings, watches and carry keys or other materials, which are good conductors of electricity.

12.0 All scaffold, ladders, and other safety devices mentioned or described herein shall be maintained in

safe condition and no scaffold ladder or equipment shall be altered or removed while it is in use. Adequate washing facilities should be provided at or near places of work.

13.0 These safety provisions should be brought to the notice of all concerned by display on a notice board at a prominent place of work spot. The person responsible for compliance of the safety codes shall be named therein by the contractor.

14.0 To ensure effective enforcement of the rules and regulations relating to safety precautions the arrangements made by the Contractor shall be open to inspection by the or their representatives.

15.0 Notwithstanding the above Clauses & sub clauses from (1.0) to (14.0) there is nothing in these to

exempt the contractor from the operations of any other Act or Rule in force in the Republic of India.

MODEL RULES FOR THE PROTECTION OF HEALTH AND SANITARY

ARRANGEMENTS FOR WORKERS 1.0 APPLICATION

These rules shall apply to all building and construction works in which 20 (twenty) or more workers are ordinarily employed or are proposed to be employed in any day during the period during which the contractor work is in progress.

2.0 DEFINITION

Workplace means a place where twenty or more workers are ordinarily employed or are proposed to be employed in connection with construction work on any day during the period during which the contractor work is in progress.

3.0 FIRST-AID FACILITIES 3.1 At every work place first aid facilities shall be provided and maintained, so as to be easily accessible

during working hours, First-Aid boxes at the rate of not less than one box per 150 contract labour or part thereof ordinarily employed.

3.2 The First-Aid box shall be distinctly marked with a red cross on white ground and shall contain the

following equipments:- 3.2.1 a) For work places in which number of contract labour employed does not exceed 50,

Each First-Aid box shall contain the following equipments:

i) 6 small sterilized dressings. ii) 3 medium size sterilized dressings. iii) large size sterilized dressings. iv) 3 large sterilized burn dressings. v) 1 (30 ml) bottle containing a two percent alcoholic solution of iodine. vi) 1 (30 ml) bottle containing Sal volatile having the dose and mode of administration

indicated on the label. vii) 1 snake-bite lancet. viii) 1 (30 gms) bottle of potassium permanganate crystals. ix) 1 pair of scissors. x) 1 copy of the First-Aid leaf-let issued by the Director General, Factory Advise Service &

Labour Institutes, Government of India. xi) 1 bottle containing 100 tablets (each of 5 grams) of aspirin. xii) Ointment for burns. xiii) A bottle of suitable surgical antiseptic solution.

3.2.2 For work places in which the number of contract labour exceed 50. Each First-Aid box shall contain the following equipments:

i) 12 small sterilized dressings. ii) 6 medium size sterilized dressings. iii) 6 large size sterilized dressings. iv) 6 large size sterilized burn dressings. v) 6(15 gms) packet sterilized cotton wool. vi) 1 (60 ml.) bottle containing a two percent iodine alcoholic solution.

vii) 1 (60 ml.) bottle containing Sal volatile having the dose and mode of administration indicated on the label.

viii) 1 roll of adhesive plaster. ix) 1 snake - bite lancet. x) 1 (30 gms.) bottle of potassium permanganate crystals. xi) 1 pair of scissors.

xii) 1 copy of the First-Aid leaf-let issued by the Director General, Factory Advice Service and Labour Institutes, Government of India.

xiv) A bottle containing 100 tablets (each of 5 grams) of aspirin. xv) Ointment for burns. xvi) A bottle of suitable surgical antiseptic solution.

3.3 Adequate arrangements shall be made for immediate recumbent of the equipment when necessary.

3.4 Nothing except the prescribed contents shall be kept in the First Aid box. 3.5 The First Aid box shall be kept in charge of a responsible person who shall always be readily

available during the working hours of the work place. 3.6 A person in charge of the First-Aid box shall be a person trained in First-Aid treatment, in work

places where the number of labour employed is 150 or more. 3.7 In work places where the number of labour employed is 500 or more and hospital facilities are

not available within easy distance of the works, first-Aid Posts shall be established and run by a trained Compounded. The Compounded shall be on duty and shall be available at all hours when the workers are at work.

3.8 Where work places are situated in places, which are not towns of cities, a suitable motor transport shall be kept readily available to carry injured person or persons suddenly taken ill to the nearest hospital.

4.0 DRINKING WATER 4.1 In every work place, there shall be provided and maintained at suitable places, easily accessible

to labour, a sufficient supply of cold water fit for drinking. 4.2 Where drinking water is obtained from an intermittent public water supply, each work place shall

be provided with storage where such drinking water shall be stored. 4.3 Every water supply of storage shall be at a distance of not less than 50 feet from any latrines

drain or other source of pollution, Where water has to be drawn from an existing well which is within such proximity of latrine, drain or any other source of pollution, the well shall be properly chlorinated before water is drawn from it for drinking. All such wells shall be entirely closed in and be provided with a trap-door which shall be dust and water-proof.

4.4 A reliable pump shall befitted to each covered well, trap-door shall be kept locked and opened only for cleaning or inspection which shall be done at least once a month.

5.0 WASHING FACILITIES

5.1 In every workplace adequate and suitable facilities for washing shall be provided and maintained for the use of labour employed herein.

5.2 Separate and adequate screening facilities shall be provided for the use of male and female workers.

5.3 Such facilities shall be conveniently accessible and shall be kept clean and hygienic Condition. 6.0 LATRINES AND URINALS 6.1 Latrines shall be provided in every work place on the following scale, namely:

a) Where females are employed there shall be at least one latrine for every 25 females. b) Where males are employed, there shall be at least one latrine for every 25 males. Provided that where the number of males or females exceeds 100, it shall be sufficient if

there is one latrine for 25 males or females, as the case may be, upto the first 100, and one for every 50 thereafter.

6.2 Every latrine shall be under cover and so partitioned off as to secure privacy, and shall have a

proper door and fastenings. 6.3 Construction of Latrines: The inside walls shall be constructed of masonry or some suitable heat

resisting non-absorbent materials and shall be cement washed inside and outside at least once a year. Latrine shall not be a standard lower than bore-hole system.

6.4 (a) Where workers of both sexes are employed, there shall be displayed outside each block of latrine and urinal, a notice in the language understood by the majority of the workers "For Men only" or "For Women only" as the case may be.

(b) The notice shall also bear the figure of men or of women, as the case may be.

6.5 There shall be at least one urinal for male workers upto 50and one for female workers up to 50 employed at a time. Provided that where the number of male or female workmen, as the case may be, exceeds 500, it shall be sufficient if there is one urinal for every 50 males or females upto the first 500 and one for every 100 or part thereof, thereafter.

6.6 a) The latrines and urinals shall be adequately lighted and shall be maintained in a clean and sanitary condition at all times.

b) Latrines and urinals other than those connected with a flush sewerage system shall

comply with the requirements of the Public Health Authorities. 6.7 Water shall be provided by means of a tap or otherwise so as to be conveniently accessible in or

near the latrines and urinals. 6.8 DISPOSAL OF EXCRETA

Unless otherwise arranged for by the local sanitary authority arrangements for proper disposal of excreta by incineration at the work place shall be made by means of a suitable incinerator. Alternatively excreta may be disposed off by putting a layer of night soil at the bottom of a pucca tank prepared for the purpose and covering it with a 15 cm layer of waste or for refuse and then covering it with a layer of earth for fortnight (when it will turn into manure).

6.9 The Contractor shall, at his own expense, carry out all instruction issued to him by the Engineer- in-Charge to effect proper disposal of night soil and other conservancy work in respect of the Contractor's workmen or employees on the site. The Contractor shall be responsible for payment of any charges which may be levied by Municipal or Cantonment Authority for execution of such work on his behalf.

7.0 PROVISION OF SHELTER DURING REST

At every place there shall be provided, free of cost four suitable sheds, two for males and the other two for rest separately for the use of man and women labour. The height of each shelter

shall not be less than 3 meters from the floor level to the lowest part of the roof. These shall be kept clean and the space provided shall be on the basis of 0.6 sqm. Per head Provided that the Engineer-in-Charges may permit, subject to his satisfaction, a portion of the building under construction or other alternative accommodation to be used for the purpose.

8.0 CRECHES 8.1 A every work place, at which 20 or more women workers are ordinarily employed, there shall be

provided two rooms of reasonable dimensions for the use of their children under the age of six years. One room shall be used as a play room for the children and the other as their bedrooms.

The rooms shall be constructed on standard not lower than the following: i) Thatched roof ii) Mud floor and walls. iii) Planks spread over the mud floor and covered with matting

8.2 The rooms shall be provided with suitable and sufficient openings for light and ventilation. There shall be adequate provision of sweepers to keep the places clean.

8.3 The Contractor shall supply adequate number of toys and games in the playroom and sufficient number of cots and beddings in the bed-room.

8.4 The Contractor shall provide one Ayaa to look after the children in the crèche when the number of women workers does not exceed 50 and two when the number of women workers exceeds 50.

8.5 The use of the rooms/earmarked as ealize shall be restricted to children, their attendant and mother of the children.

9.0 CANTEENS 9.1 In every work place where the work regarding the employment of contract labour is likely to

continue for six months and wherein contract labour numbering one hundred or more are ordinarily employed, an adequate canteen shall be provided by the Contractor for the use of such labour.

9.2 The canteen shall be maintained by the Contractor in an efficient manner. 9.3 The canteen shall consist of at least a dining hall, kitchen, store room, pantry and washing

places separately for workers and utensils. 9.4 The canteen shall be sufficiently lighted at all times when any person has access to it. 9.5 The floor shall be made of smooth and impervious material and inside walls shall be lime

washed or colour washed at least once in each year. Provided that the inside walls of the kitchen shall be lime-washed every four months. 9.6 The premises of the canteen shall be maintained in a clean and sanitary condition. 9.7 Waste Water shall be carried away in suitable covered drains and shall not be allowed to

accumulate so as to cause a nuisance. 9.8 Suitable arrangements shall be made for the collection and disposal of garbage. 9.9 The dinning hall shall accommodate at a time 30 persons of the labour working at time. 9.10 The floor area of the dinning hall, excluding the area occupied by the service counter and any

furniture except tables and chair shall not be less than one square meter per dinner to be accommodated.

9.11 a) A portion of the dinning hall, and service counter shall be partitioned off and reserved for women workers in proportion to their number.

b) Washing places for women shall be separate and screened to secure privacy.

9.12 Sufficient tables, stool, chairs or benches shall be available for the number of dinners to be accommodated.

9.13.1 a) There shall be provided and maintained sufficient utensils, crockery, furniture and any other Equipment necessary for the efficient running of the canteen.

b) The furniture, utensils and other equipment shall be maintained in a clean and hygienic condition.

9.13.2 a) Suitable clean clothes for the employees serving in the canteen shall be provided and

maintained. b) A service counter, if provided, shall have top of smooth and impervious material.

c) Suitable facilities including an adequate supply of hot water shall be provided for the cleaning of utensils and equipment.

9.14 The food stuffs and other items to be served in the canteen shall be in conformity with the

normal habits of the labour. 9.15 The charge for food stuffs, beverages and any other items served in the canteen shall be based

on 'No profit No loss' and shall be conspicuously displayed in the canteen. 9.16 In arriving at price of food stuffs, and other articles served in the canteen, the following items

shall not be taken into consideration as expenditure, namely: a) The rent of land building. b) The depreciation and maintenance charges for the building and equipment provided for the canteen. c) The cost of purchase, repair and replacement of equipment including furniture,

crockery, cutlery and utensils: d) The water charges and other charges incurred for lighting and ventilation:

e) The interest and amounts spent on the provision and maintenance and equipment provided for in the canteen.

9.17 The accounts pertaining to the canteen shall be audited once every 12 months by registered accountants and auditors.

10.0 ANTI MALARIAL PRECAUTIONS

The Contractor shall at his own expense, conform to all anti-malarial instructions given to him by the Engineer-in-Charge including the filling up of any borrows pits which may have been dug by him.

11.0 AMENDMENTS MPSEDC may from time to time, add to or amend these rules and issue such directions as it may consider necessary for the purpose of removing any difficulty which may arise in the administration hereof.

CONTRACTOR�S LABOUR REGULATIONS

1.0 SHORT TITLE These regulations may be called the Contractor �Labour Regulations�. 2.0 DEFINITIONS 2.1 �Workman� means any person employed by the MPSEDC, or its Contractor directly or indirectly

through a sub-contractor, with or without the knowledge, of the MPSEDC, to do any skilled, semi-skilled, un-skilled, manual, supervisory, technical or clerical work for hire or reward, whether, the terms of employment are expressed or implied but does not include any person- a) Who is employed mainly in a managerial or administrative capacity; or b) Who being employed in a supervisory capacity draws wages exceeding Rupees Two thousand

Five hundred per person or exercises either by the nature of the duties attached to the office or by reason of powers vested to him, functions mainly of managerial nature.

c) Who is an out worker, that is to say, a person to whom any articles or materials are given out by or on behalf of the principal employer to be made up cleaned, washed, altered, ornamental finished, repaired, adopted or otherwise processed for sale for the purpose of the trade or business of the principal employer and the process is to be carried out either in the home of the out worker or in some other premises, not being premises under the control and management of the principal employer.

2.2 �Fair Wages� means wages whether for time or piecework fixed and notified under the provisions of the minimum Wages Act from time to time.

2.3 �Contractor� shall include every person who undertake to produce a given result other than a mere supply of goods or articles of manufacture through labour or who supplies labour for any work and includes a sub-contractor.

2.4 �Wages� shall have the same meaning as defined in the Payment of Wages Act. 2.4.1 Normally working hours of an adult employee should not exceed 9 hours a day. The working day shall

be so arranged that inclusive of interval for rest, if any, it shall not spread over more than 12 hours on any day.

2.4.2 When an adult worker is made to work for more than 9 hours on any day or for more than 48 hours in any week he shall be paid overtime for the extra hours put in by him at double the ordinary rate of wages.

2.4.3.1 Every worker shall be given a weekly holiday on a Sunday, in accordance with the provisions of the Minimum Wages (Central) Rules 1960 as amended from time to time, irrespective of whether such worker is governed by the Minimum Wages Act or not.

2.4.3.2 Whether the Minimum Wages prescribed by the Government under the Minimum Wages Act are not inclusive of the wages for the weekly day of rest, the worker shall be entitled to rest day wages at the rate applicable to the next preceding day, provided he has worked under the same contractor for a continuous period of not less than days.

2.4.3.3 Here a contractor is permitted by the Engineer-in-Charge to allow a worker to work on a normal weekly holiday, he shall grant a substitute holiday to him for the whole day on one of the five days immediately before or after the normal weekly holidays and pay wages to such worker for the work performed on the normal weekly holiday at overtime rate.

3.0 DISPLAY OF NOTICE REGARDING-WAGES, ETC.

The contractor shall before he commences his work on contract, display and correctly maintain and continue to display and correctly maintain in a clean and legible condition in conspicuous places on the work, notices in English and in the local Indian languages spoken by the majority of the workers, giving the minimum rates of wages fixed under the Minimum Wages Act, the actual wages being paid, the hours of work for which such wages are earned, wage period, dates of payment of wages and other relevant information as per Appendix �A�.

4.0 PAYMENT OF WAGES 4.1 The contractor shall fix wage periods in respect of which wages shall be payable. 4.2 No wage period shall exceed one month. 4.3 The wages of every person employed as labour in an establishment or by a contractor where less than

one thousand, such persons are employed shall be paid before the expiry of the seventh day and in other cases before the expiry of tenth day after the last day of the wage period in respect of which the wages are payable.

4.4 Where the employment of any worker is terminated by or on behalf of the contractor the wages earned by him shall be paid before the expiry of the second working day from the date on which his employment is terminated.

4.5 All payments of wages shall be made on a working day at the work premises and during the working time and on a date notified in advance and in case the work is completed before the expiry of the wage period, final payment shall be made within 48 hours of the last working day.

4.6 Wages due to every worker shall be paid to him direct or to other person authorized by him in this behalf.

4.7 All wages shall be paid in current coin or currency or in both. 4.8 Wages shall be paid without any deductions of any kind except those specified by the Central

Government by general or special order in this behalf or permissible under the payment of Wages Act 1956.

4.9 A notice showing the wage period and the place and time of disbursement of wages shall be displayed at the place of work and a copy sent by the contractor to the Engineer-in-Charge under acknowledgment.

4.10 It shall be the duty of the contractor to ensure the disbursement of wages in the presence of the Engineer or any other authorized representatives of the Engineer-in-Charge who will be required to be present at the place and time of disbursement of wages by the contractor to workmen.

4.11 The contractor shall obtain from the Engineer or any other authorized representative of the Engineer-in-Charge as the case may be, a certificate under his signature at the end of the entries in the �Register of Wages� or the �Wage-cum-Muster Roll� as the case may be in the following form: �Certified that the amount shown in column No�.........has been paid to the workmen concerned in my presence on�............. at�.........�.

5.0 FINES AND DEDUCTIONS, WHICH MAY BE MADE FROM WAGES

5.1 The wages of a worker shall be paid to him without any deduction of any kind except the following� a) Fines

b) Deductions for absence from duty i.e. from the place or the places where by the terms of his employment he is required to work. The amount of deduction shall be in proportion to the period for which he was absent.

c) Deduction for damage to or loss of goods expressly entrusted to the employed persons for custody, or from loss of money or any other deduction which he is required to account where such damage or loss is directly attributable to his neglect or default.

d) Deduction for recovery of advances or for adjustment of over payment of wages, advances granted shall be entered in a register.

e) Any other deduction, which the Central Government may from time to time allow.

5.2 No fines should be imposed on any worker save in respect of such acts and omissions on his part as have been approved by the Chief Labour Commissioner.

NOTE: An approved list of Acts and Omissions for which fines can be imposed is enclosed at Appendix-I.

5.3 No fine shall be imposed on a worker and no deduction for damage or loss shall be made from his wages until the worker has been given an opportunity of showing cause against such fines or deductions.

5.4 The total amount of fine which may be imposed in any one wage period on a worker shall not exceed an

amount equal to three paise in a Rupees of the total wages, payable to him in respect of that wage period.

5.5 No fine imposed on any worker shall be recovered from him in installment, or after the expiry of sixty days from the date on which it was imposed.

5.6 Every fine shall be deemed to have been imposed on the day of the act or omission in respect of which it was imposed.

6.0 LABOUR RECORDS 6.1 The contractor shall maintain a �Register of persons employed� on work on contract in form XIII of the

CL(R&A) Central Rules 1971 (Appendix-B). 6.2 The contractor shall maintain a �Muster Roll� register in respect of all workmen employed by him on the

work under contract in from XVI of the CL(R&A) Rules 1971 (Appendix-C). 6.3 The contractor shall maintain a �Wage Register� in respect of all workmen employed by him on the

work in form (Appendix-D). 6.4 Register of accidents � The contractor shall maintain a register of accidents in such form as may be

convenient at the work place but the same shall include the following particulars: a) Full particulars of the labourers who met with accident. b) Rate of wages c) Sex d) Age e) Nature of accident and cause of accident. f) Time and date of accident. g) Date and time when he/she admitted in Hospital h) Date of discharge from the Hospital i) Period of treatment and result of treatment j) Percentage of loss of earning capacity and disability as assessed by Medical Officer. k) Claim required to be paid under Workmen�s Compensation Act. l) Date of payment of compensation. m) Amount paid with details of the person to whom the same was paid. n) Authority by whom the compensation was assessed. o) Remarks.

6.5 Register of Fines � The contractor shall maintain a � Register of Fines� in the form (Appendix-H). The contractor shall display in a good condition and in a conspicuous place of work the approved list of Acts and Omission for which fines can be imposed (Appendix-I).

6.6 Register of Deductions-The contractor shall maintain a �Register of Deductions� for damage or loss in form (Appendix-J).

6.7 Register of Advances-The con tractor shall maintain a �Register of Advances� in form (Appendix-K). 6.8 Register of Overtime-The contractor shall maintain a �Register of Overtime� in form (Appendix-L).

7.0 ATTENDANCE CARD-CUM WAGE SLIP: 7.1 The contractor shall issue an attendance card-cum-wage slip to each workman employed by him in the

specimen form at (Appendix-E). 7.2 The card shall be valid for each wage period.

7.3 The contractor shall mark the attendance of each workman on the card twice each day, once at the commencement of the day and again after the rest interval, before he actually starts work.

7.4 The card shall remain in possession of the worker during the wage period under reference. 7.5 The contractor shall complete the wage slip portion on the reverse of the card at least a day prior to the

disbursement of wages in respect of the wage period under reference. 7.6 The contractor shall obtain the signature or thump impression of the worker on the wage slip at the

time of disbursement of wages and retain the card with himself.

8.0 EMPLOYMENT CARD The contractor shall issue an Employment Card in form to each worker within three days of the employment of the worker (Appendix-F).

9.0 SERVICE CERTIFICATE On termination of employment for any reason whatsoever the contractor shall issue to the workman whose services have been terminated, a service certificate in from Appendix-G.

10.0 PRESERVATION OF LABOUR RECORDS

All records required to be maintained under Regulations Nos. 6 and 7 shall be preserved in original for a period of three years from the date of last entries made in them and shall be made available for inspection by the Engineer-in-Charge, Labour Officer.

11.0 POWER OF LABOUR OFFICERS TO MAKE INVESTIGATIONS INQUIRY

The Labour Officer or any other person authorized by MPSEDC, on its behalf shall have power to make inquires with a view to ascertaining and enforcing due and proper observance of the Fair Wage Clauses and the Provisions of Regulations. He shall investigate into any complaint regarding the default made by the contractor or sub-contractor in regard to such provision.

12.0 INSPECTION OF BOOK AND SLIPS

The contractor shall allow inspection of all the prescribed labour records to any of his workers or to his agent at a convenient time and place after due notice is received or to the Labour officer or any other person, authorized by the Central Government on his behalf.

13.0 SUBMISSION OF RETURNS

The contractor shall submit periodical returns as may be specified from time to time.

14.0 AMENDMENTS The MPSEDC, may from to time, add or amend the regulations and on any question as to the application, interpretation or effect of these regulations the decision of the Chief Engineer concerned shall be final.

6.0 LABOUR LAWS AND SAFETY REGULATIONS

6.1 Labor Laws

i) Labor below the age of 18 years should not be employed on the work.

ii) The Contractor shall not pay less than what is specified in the law to Laborers engaged by him on the

work.

iii) The Contractor shall, at his own expenses, comply with all labor laws

In addition, the owner shall not be responsible for any recovery/penalty imposed by the respective

authorities for violating the labor laws.

iv) If the Contractor is covered under the Contract Labor (Regulation and Abolition) Act, he shall obtain a

license from the licensing authority (i.e. the office of Labor Commissioner), by payment of the necessary

prescribed fee and deposit, if any, before starting the work.

v) The Contractor shall furnish to the owner the details of the workers employed on the works.

vi) The Contractor shall comply with the provisions of the existing rules and regulations relating to labor

laws.

vii) The owner shall on a report having been made by an inspecting officer as defined in Contract Labor

(Regulation and Abolition) Act, 1980, have the power to deduct from the amount due to the Contractor

any sum required or estimated to be required for making good the losses suffered by a worker or

workers by reason of non-fulfillment of the conditions of the contract or the benefit of the workers, or if

deductions made from his or their wages which are not justified by the terms of contract or non-

observance of the said regulations.

7.0 SAFETY CODE

7.1 Safety and Protection

The Contractor shall adhere to safe engineering practice and guard against hazardous and unsafe

working conditions. While carrying out the work, the Contractor should provide for:

i) Safety of personnel engaged in the electrification and erection

ii) Protection and safety of works and materials during their progress.

iii) Clean and hygienic conditions of working and living for his workers, as required by MPSEDC.

7.2 First Aid

The Contractor shall provide regular first aid facilities for his employees and those of his sub-contractors.

7.3 Contractor's Barricades / safety and danger boards

The Contractor shall erect and maintain barricades, safety, and danger boards required about his

operations to guard or protect

i) Excavations

ii) Charged electrical panels and system areas

iii) Areas adjudged hazardous by the Contractor or Consultant�s representatives.

7.4 Preservation of peace

The Contractor shall take precautions to prevent any riotous or unlawful behavior by his workers, for the

preservation of peace and protection of inhabitants and the security of property in the neighborhood of

the work.

TECHNICAL SPECIFICATIONS PREAMBLE TO SPECIFICATIONS The conditions of contract and the drawing shall be read in conjunctions with the Specifications and matters referred to, shown or described in one are not necessarily repeated in the other. These specifications are comprehensive and may exceed the requirements of this project. Any ambiguity between the General specifications, the Bill of quantities and contract drawings, shall be referred to the consultant for clarification not later than 10 days before the date Fixed for delivery of Tenders. Any ambiguity may be referred to the consultant after signing of the contract and consultant shall give a ruling, which shall prevail- No claim for additional cost due to above, however, will be entertained. Notwithstanding the subdivision of the specification into various headings, every part of it is to be deemed supplementary to every other part and is to be read with it, so far as it may be practicable so to do, or when the context so admits. In this contract, reference is made to the Indian Standards and these references shall be deemed to include the latest editions or issue of standards, specifications or Bylaw including all revisions up to the date of invitations of tenders. The contractor shall ensure that all materials and workmanship in so far as they apply to this contract shall comply in every specification or any other equivalent or specification approved by the consultant. The contractor shall keep at site copies of all relevant standards and codes of practice referred in these specifications throughout the period of contract. These shall be the latest editions and shall include all revisions / addendum thereof. Approved manufacturers: Names of approved manufacturers shall be constructed as establishing a standard of quality and not as limiting competition. The contractor shall include in his prices for supplying the item or materials from the approved manufacturers listed or equal and approval. All items or materials shall be delivered to the site in the manufacturers original unopened containers with the manufacturers brand and name clearly marked on. All items or materials shall be assembled, mixed, fixed, applied or otherwise incorporated in the works in accordance with the printed instructions of the manufacturer of the item or materials.

1 GENERAL 1.1 Scope This specification applies to the interior decoration works to be executed by the contractor. It is to be read in conjunction with and subject to the general conditions of contract and in conjunction with the drawings, the schedule of rates and such other documents as may from time to time be agreed upon as comprising part of this contract. Where these specifications are not clear, consultation with the architects is to be obtained by the contractor. . 1.2 Setting out the work The contractor shall set out the works and during the progress of the work shall amend at is own cost any errors arising from inaccurate setting out. During the execution of the work contractor must cross check his work with the drawings. The contractor shall be responsible for all the errors in this connection and shall have to rectify all detects and / or errors at his own cost, failing which the architect/owner reserves the right to get the same rectified at the risk and cost of the contractor.

1.3 Cleaning up and handing over Upon completion of the work all the areas should be cleaned. All floors, doors, windows, Surface, etc. shall be cleaned down in a manner which will render the work acceptable to the architect and owner. All rubbish due to any reason, shall be removed daily from the site and an area of up to ten meters on the outer boundaries of the premises will be cleaned by the contractor as a part of the contract. Upon completion of the project, the contractor shall turn over to the owner for the following: - a) Written guarantee and certificates. b) Maintenance manuals, if any.

1.4 Samples The contractor shall submit to the Architect samples of all materials for approval and no work shall commence before such samples are duly approved. Samples of precast concrete panels, masonry units, building insulation, finished hardware, floor tiles, stones, wood, finishing & carpentry items as laminates, veneers, etc. ply, block boards, upholstery cloth, and every other work requiring samples in the opinion of the architects shall be supplied to the architects, and these samples will be retained as standards of materials and workmanship. The cost of samples shall be borne by the contractor. Throughout this specification, types of material may be specified by manufacturer's name in order to establish standard of quality, price and performance and not for the purpose of limiting competition. Unless specifically stated otherwise, the Bidders may asses the price of approved equivalent except that the burden is upon the contractor to prove such equality in writing. The contractor for the material approvals, within one weeks of the Architect�s order to commence shall submit a detailed program. The detailed program shall include but not limited to: Date/s of submitting the various materials samples. Date/s by which the Architect's approval is required. Date/s of placing orders on the Manufacturers / Suppliers. Date/s of arrival of the approved material/s on to the site. Date/s of the completion of the 'Mock-ups', whenever required, and the Date/s by which the Architects' inspection of such 'Mock-ups' should be completed and the Date/s by which the Architect should fully approve the said Mock-ups. 1.5 Tests All materials and methods of tests shall conform to the latest rules, regulation and / or specifications of the following authorities where specified (BIS), British Standards Code cf Practice (BS) in case no equivalent BIS is available. The Architects will have the option to have any of the materials tested and if the test results show that the materials do not conform to the number of representative tests will be deemed to be included in the rates tendered. 1.6 Rates The all inclusive item rates quoted in schedule of quantities are deemed to be included to execute the works in strict accordance with the relevant specifications read in conjunction with the appropriate standard specifications. 1.7 Mode of Measurement The item quoted in schedule of quantities are deemed to be included to execute the works in strict accordance with the relevant IS specifications read in conjunction with the appropriate standard specifications.

1.8 Safety Code (1) All necessary personal safety equipment as considered adequate by the architect should be - l available for the use of the person employed on the site and maintained in condition suitable for immediate use, and the contractor should take adequate steps to ensure proper) of equipment by those concerned. a) Those engaged in white washing and mixing or stacking of cement bags or any Materials which is injurious to the eyes shall be provided with welders protective Goggles. b) The contractor shall not employ men below the age of 18 years and women on the work of painting with products containing lead in any form. Whenever men above the age of 18 are employed on the work of lead painting, the following precautions should be taken: i) No paint containing lead or lead products shall be used except in the form of Paste or ready made paint. ii) Suitable face masks should be supplied for use by the worker when paint is applied in the form of spray on a surface or when paint is dry-rubbed and scrapped. iii) The contractors to the workmen shall supply overalls and adequate Facilities shall be provided to enable the working painter to wash during the Cessation of work. (2) All scaffolds ladders and other safety devices mentioned or described herein shall be maintained in safe condition and no scaffold, ladder or equipment shall be altered or removed while it is in use. Adequate washing facilities should be provided at or near places of work. (3) The safety provisions should be brought to the notice of all concerned on a notice board at a prominent place at work spot. The person responsible for compliance of the safety code shall be named therein by the contractor. (4) To ensure effective enforcement of the rules and regulations relating to safety precautions. (The arrangements made by the contractor shall be open to inspection by the labor officer, Consultant / Owner or their representatives. (5) Not withstanding the above clause there is nothing in these to exempt the contractor from the operations of any other act or rule in force in the republic of India. 2.0 MASONRY WORKS 2.1 Brick works i) The bricks shall conform to the IS . ii) The building bricks are to be the best quality table molded kiln burnt, patent bricks, hard sound, square with sharp arises, even and uniform in shape and color free from cracks, stones, flaws and other defects. Samples of bricks are to be submitted to the Architect for approval before full quantity is ordered. All supply of brick to conform to the sample approved. iv) Every brick shall be thoroughly soaked in water before use Broken bricks shall not be used except as closers. The courses shall be truly horizontal and the work strictly plumb, joints shall be broken vertically and they shall not exceed 1/2" in thickness. All joints in brick work are to be well Filled with mortar. All brick work shall be kept constantly moist on all the faces for at least 8 days. v) The brick work shall not be raised more that 12 single courses per day and shall be built in English bond, except brick on edge and half brick walls shall be built in stretcher bond. Except for brick on edge work, the bricks shall be placed with "frog" facing upwards. vi) All joints in brick work shall be raked out 1/2" deep as the work proceeds, and before the mortar sets.

vii) The brick work is to be carried out with all necessary set backs, projections, cuttings and too things in conformity with the drawings. viii) The brick work shall be cured properly. ix) All uneven, irregular and bad brick work poor in workmanship shall be demolished if deemed necessary by the Architect and rebuilt by the contractor at the contractors expenses. If necessary the contractor will have to provide wooden plug, etc. for his own work and for which there will be no special payment on that account. The work will have to be executed at any height and lift will not form the criterion for any extra amount. 2.2 Rates to include.

a) All scaffolding, ladders, platforms and staging required in the execution of work to any heights or depth. b) Hacking and roughening of concrete or other surfaces in contact with masonry for bondage. c) Works at all heights, depths and locations unless otherwise specified. d) All applicable rates & taxes. 3.0 CARPENTERY AND JOINERY 3.1 Timber All timber shall be of the kind and of first class quality as described and indicated on drawings and schedules. It shall be uniform in texture, free from large, loose head or cluster knots, veneer, injurious open shakes, bore holes, rot, decay discoloration, soft or spongy spots, hollow pockets, put and all other defects and blemishes. The sizes shown or described are to be taken as not sizes when finished.

3.2 Seasoning All timber shall be fully seasoned, if necessary, in kilns, chemically impregnated if required and the contractor shall produce satisfactory proof of the same. The moisture content in the Timber, shall not exceed 12% for internal work and 16% for external work. The timber shall remain stable, free from expansion or contractions or any other movements, when fixed in position. The timber shall be tree from drying detects and shrinkage. 3.3 Rough carpentry Material All framing and other concealed wood members shall be of sound wood or approved specials and shall be seasoned. All surfaces in contact with masonry or concrete, and in general, all surfaces hidden from view, shall be treated with two coats of approved wood preservative paint. Workmanship All carpenters work shall be done by skilled workmen, with the longest nails that may be used without splitting the wood. In general top nailing and cross nailing shall be used. Wherever it is necessary, or an adequate joint can not be formed by nailing, the members shall be lapped or jointed by Gl straps or extra wood blocks. All jointing and nailing shall be done with neatness, especially in exposed position. Joints and nailing shall be approved by the architect and done according to his directions when required. Gross bracing, solid blocking and bracing shall be provided according to best practice.

3.4 Joinery Materials Finished wood work and joinery including doors, shall be with straight grained Indian Teak of approved quality, unless noted otherwise. Wood shall be free from knots, and other blemishes and imperfections. All Finished wood for joinery shall be seasoned as prescribed before. All joinery work shall be securely mortised and tenoned and glued with best quality synthetic waterproof glue equivalent of FEVICOL or VEMICOL. All sections and dimensions shall be as shown on drawings. For all joinery work, nails shall not be permitted, and only wood screws of appropriate sizes shall be used. Wherever practicable, means of fastening the various parts together shall be concealed. Installation Doors, and cabinet work shall be installed in positions only after the plaster in the section for which it is intended, is sufficiently dry. All interior and exterior doors, cabinetwork and other Fixed wooden equipment shall be fixed plumb and true. Wherever possible, the joints shall be beveled. All exterior angles shall be mitred. Adjoining interior wood members shall match and harmonize. All wood work in contact with masonry shall be painted with approved bitumen paint or solignum before placing in positions. All concealed wood members shall be used. Wherever practicable, means of fastening the various parts together shall be concealed. 3.5 MEASUREMENTS The Contractor shall be fully responsible for accuracy of all measurements and shall verify all dimensions given on the drawings, and shall make such site measurements as are necessary to complete the work properly. 3.6 Doors and Windows Doors and windows and ventilator frames shall be made of First quality seasoned timber specified under the head of timber for doors and window frames, and as shown on the drawing or as directed by the Architect/Client. These shall be properly framed mortised together, and set solidly in the masonry with MS holdfasts. Holdfasts will be 30 x 4 cms and 5 mm flat fixed to the jamb and embedded in masonry with PCC 1:2:4. Windows I mtr. 1-iigh will have minimum of 6 number holdfasts. Each holdfast will be fixed to the frame with 3 Nos. of 5 cm. long galvanized iron screws. In case the frames are to be fixed to RCC members suitable raw plugs shall be used as directed by the Architect. 3.7 Flush Doors All flush door shall be solid core as specified. It shall conform to the relevant specifications to IS and shall be obtained from ISI approved manufacturers. The finished thickness of the shutter shall be as mentioned in the items. Face veneers shall be of the pattern and colour approved by the Architect and an approved sample shall be deposited with the Architects for reference. The solid core shall be wood laminate prepared from battens of well-seasoned and treated good quality wood having straight grains. Battens shall be of uniform size of about 2.5 cm. width properly glued and machine hot pressed together with grains of each piece reversed from that of adjoining one. The adhesive used for bending shall be phenol formaldehyde synthetic resin conforming to BWP type specified in IS. Vision panels, if .my shall he factory Finished and no deduction shall be made for such openings. Also nothing extra shall be paid for glass in such openings. 3.8 Plywood Plywood shall be best quality closed grained suitable for veneering, painting or bonded with plastic laminate. It shall be resin bonded and of waterproof and boil proof (WBP) brand. Exposed edges shall be finished with an edge strip of solid teakwood.

3.10 Glass and Glazing The contractor shall furnish all labor, material and equipment required to complete the installation of all glass and related items. A glass shall be of the type, quality, and substance specified in the schedule of quantities. The contractor shall out glass sizes by field measurements or dimensions of the approved shop drawings. The responsibility for correct glass sizes shall rest with the contractor. No cracked, chipped or disfigured glass shall accepted, and the contractor shall replace all breakage's or faulty installation without cost to the Employer. The glass shall be set in wood or metal glazing straps and metal sash with elastic glazing and compound. The glass shall be beaded First and so installed as to achieve a completely watertight result. The opaque glass, where called for, shall be set with the smooth surface outside. At the completion of the work all glass shall be thoroughly cleaned of paint and other marks removed. Any cracked, scratched, chipped or otherwise defective glass shall be removed and replaced without extra cost to the Employer. 3.11 Hardware The contractor shall procure all the hardware as specified in the schedule. The rate shall include for making chases to receive the hardware, and also the cost of approved screws, nails, clamps etc. The Fixing shall be done in the best workmanship like manner and in accordance with that employed for Fixing hardware. Any damage to the joinery or the hardware shall be made good at not extra cost to the employer. 3.12 Partitions/ False Ceiling GI Rolled Sections / Timber framing tor partitions and ceiling shall be fixed by approved MS clamps. Blots or other equal and approved slotted angle suspenders and shall be treated with wood preservative using solignum or other equal and approved. Steel work within false ceiling shall be painted with two coats of priming Red lead paint. MS clamps, suspenders shall be welded to the MS hold down plates where provided in the structural soffit, or fixed in to the RCC work by cutting holes in approved manner and grouted with stiff mix of (1: 1'/2:3) cement concrete. 4.0 METAL WORKS 4.1 Metal Casements Frames of casements shall be of hot rolled sections. Both fixed and open able frames shall be constructed of sections which have been cut to length, mitred and electrically flush but welded at corners. Subdividing bar units shall be tennoned and riveted in to the frames. All frames shall have the corners welded to u true right angle and welds shall neatly ground down smooth-Couplings, mullions, transom, and weather bar shall be provided, as directed by the Architects. Outer frames shall be provided with fixing screws and lugs shall be used for fixing the frame to the masonry. Mastic cements shall be used for making the joints watertight. Hinges shall be of the strong projecting type. If directed, friction type hinges shall be used in which case windows shall not be fitted with peg stays. Projecting type hinged shutter shall be fitted with bronze, or brass peg stays, 30 cms long with peg and brackets welded/riveted to the frame. All windows shall be provided with handles of brass or bronze, fixed with a square head bolt, which can be tightened if required after the glazing has been fitted. Top hung ventilators shall be fixed with plain hinges, riveted or welded to the fixed frame. A brass or brown peg stays 30 cms. long as in windows, shall be provided. Centre hung ventilators shall be hung on two pairs of brass or lead-tin-bronze cup pivots. riveted to the inner and outer frames of the ventilators, to permit the ventilators to swing through an angle of approximately 85°. The opening position of the ventilator shall be so balanced of keep it open at any desired angle under normal weather conditions. A bronze spring shall be fitted in the centre of the top bar of the ventilator for the operation of the ventilator. This spring catch which shall be closed in to a mild steel iron catch plate, riveted or welded to outside of the outer ventilator bar. A brass chord pulley wheel in mild steel or malleable iron brackets shall be provided along with the chord pulley wheel in mild steel or malleable iron brackets shall be provided along with the chord eye. The windows and ventilators shall be painted with approved paint.

* All the steel surface shall be thoroughly cleaned free of rust, scale or dirt and mill scale by picking or

phosphating and before erecting painted with the coat of approved primer and after erection painted with two Finishing coats of synthetic enamel paint of approved shade and quality. Glazing of special thickness shall be provided on the outside of frames and unless otherwise specified, metal heading of approved shade and section shall be used for Fixing glasses. Special metal sash putty of approved make shall be used as directed. 4.2 Aluminum Doors, Windows, Curtain Wall etc. Shop Drawings Contractor shall submit to the Architects for their approval, shop drawings within 15 days of confirming the opening sizes. The drawings must indicate construction details, material. Fixing clamps etc. The contractor shall however make his own measurement to ascertain the actual opening on site and they will be responsible for the correctness of the sizes of the windows, louvers etc. Protection against Wind and Weather Contractor shall ensure that the member of the doors/windows/walling, shall withstand 150 Kg/Sqm. wind pressure, without deformation. The operable windows must not warp in the extreme climatic conditions. All calculations for the sizing of the members must be lodged with the Architects. The contractor is however, responsible to replace any damaged member at their cost, if the same is found to be inadequate for extreme weather. The contractor must guarantee that the windows are completely waterproof. The contractor shall submit one sample of each item for inspection and scrutiny and get the same approved by the Architect, prior to fabricating the remaining items.

All extruded aluminum sections shall be obtained from approved and established Manufacturers or approved equivalent and shall be of aluminum alloy conforming to IS:733. The sections shall generally conform to IS: 1948. These shall be fabricated as per the approved shop drawings. All doors, windows and walling will be supplied complete with screws, beads, weather stripping and matching Finish hardware. All frames shall have corner Fixed to true right angles. For side hung shutters, hinges shall normally be of projecting type made of aluminum alloy and riveted/welded to frames and shall have stainless steel pins. Handles, peg stays, etc. shall be of approved aluminum quality or its alloy conforming to is specifications. The colour of anodizing shall be natural unless otherwise stated and its sample shall be submitted for the Architects approval before work Commences. The section shall be anodized to a minimum of 20 microns. The supplier must submit necessary evidence to the satisfaction of the Architect that the thickness of the anodization is not less than 20 microns. In case of doubt the Architect reserves the right to send sample pieces to independent testing laboratories, at the cost of the supplier. If the testing laboratory report states that the thickness or quality the anodization is deficient, the Employer may ask the contractor to treat the order as cancelled and the supplier in such a case shall indemnify the Employer of any loss incurred by the Supplier. A frame should be made to Fit the actual opening with a 5 mm clearance all round. Discrepancies in overall width or height exceeding 5 mm will not be allowed and the frames will be rejected in such cases. Small discrepancies shall have the gaps suitably filled with tropical grade mastic. All ironmongers to be fixed to the frames shall be approved by the Architect prior to fixing. Glazing sections shall be lined with PVC gaskets to make the window completely waterproof. The contractor shall provide all scaffolding ladders etc. for fixing the windows and glazing and no extra will be payable on this account. Fixing of glazing shall be done with Aluminum snap on heading.

Where aluminum comes into contact with masonry brick work, plaster or dissimilar metals. It shall be coated with insulating lacquers, paint or tape to ensure that electro chemical corrosion is avoided. Fittings shall retain the casements rigidly in both the open and closed position. All fittings shall be got approved from the Engineer. The fittings and aluminum work shall be fixed after all plastering is complete and shall be wrapped and protected until after the completion of the building. After the installation work is complete, the Aluminum work shall be washed with mild solution of non-alkali soap and water and left in complete finished condition. Aluminum Railing The aluminum railings shall be carried out on site as shown on the drawings, from approved anodized aluminum extrusions. When required, parts shall be specially made to shapes required, and matched with the standard extrusions. The whole work shall be plumb and rigid. All mechanical joints shall be finished neat with Araldite. 4.3 Brass Railing Brass balustrades shall be solid or hollow cold drawn hard and strips with bright gold color. All the parts shall be cold bent to exact shape and pattern shown in the drawing. The work shall be carried out by a specialized Agency, approved by the Architect. All ornamental casting shall be tree from defects and shall match with the rest of the work. AH brass shall be highly polished before handing over and given protective coats of lacquer according to the manufacturer instruction. All balustrades shall be set in lead and shall be plumb and rigid. 4.4 Glazing The glass shall be of the type and quality as specified and directed by Consultant and as per the relevant IS code. Cracked, chipped or disfigured glasses shall have to be replaced. 4.5 Glazing clip Four glazing clips. shall be provided per glass pane for a size larger than 30 cm x 60 cm and (clips for sizes exceeding 80 cm x 200 cms. 4.6 Putty Special metal sash putty of approved make conforming to IS-420-1953 shall be used foi fixing glass panels. Putty shall be applied first between glass panel and glazing bars and then on glass panels which shall stop 2-3 mm from the sight line of back rebate to enable painting to be done. The oozed putty shall be cleaned. Quantity of putty shall not be less that 185 gms/metre of glass perimeter. Putty shall be painted within 2-3 weeks after glazing is fixed.

5.0 Edge Support Rigid Grid System (False flooring)

The system shall comprise of the followings:

(A) LAMINATED ACCESS FLOOR PANEL: Access Floor panel of size 600x600 mm shall be all steel welded construction, with an enclosed bottom pan of 56 hemispherical and 8 oval cones with 25 reverse cones and top plain sheet which are fuse welded at 152 locations to form a panel of an overall depth of 37 mm. The panel after cleaning, degreasing, phosphating by 11 tank process is coated with 40-60 micron epoxy coat and is heated to achieve maximum adhesion to the panel surface and corrosion resistance. The inner empty core of the panel is injected with a light weight fire retardant, non combustible cementitious compound at high pressure to fill in all the crevices of the panel and ensures support of not less than 90% of the top surface area of the panel. The panel is then laminated with 2.00 mm thick fire retardant floor grade Antistatic Laminate / ESD Laminate on a semi -automated lamination line to ensure maximum bonding to the steel surface. The edges of the laminated are

protected with black Conductive PVC edge trim 5mm wide on all sides. This edge trim is mechanically locked and sealed in place to avoid detachment.

(B) SUB STRUCTURE -PEDESTAL ASSEMBLY: Sub structure installed to support the panel shall be suitable to achieve a minimum finished floor height of 65mm to a maximum of 300 mm from the existing floor level. Pedestal design shall confirm speedy assembly and removal for relocation and maintenance. The assembly shall provide easy adjustment of leveling and accurately align panels for a maximum ± 25 mm in the vertical direction. Pedestals shall support an axial load without permanent deflection and an ultimate load as laid out in System Performance requirement. The Pedestal head assembly shall consist of a 75 x 75 mm x 3.5 mm embossed head mechanically riveted to a 100mm long 19 mm Dia rolled formed stud and 2 check nuts for level adjustment and arresting vertical movement. The pedestal head shall consist of an anti-vibrational PVC cap, for Panel and stringer location. The Pedestal Base assembly shall consist of 22.20 mm OD pipe of thickness 1.6mm mechanically locked on a press for perpendicularity and then welded to a base plate of 100 x 100 x 2mm thick with stiffening folds. The sub structure assembly shall be suitably anchored to the floor with suitable adhesive or fastener as recommended by the manufacturer. All steel components shall be zinc electro plated.

(C) STRINGERS:

The stringer is hot dipped galvanized steel cold rolled construction specially designed with ribs embossed on 3

sides for strength, lateral stability, and rolling loads and to support the panels on all four sides for alignment. The

stringer to have a counter sunk holes at both ends to accommodate bolting of M6 machine screws to the pedestal

head assembly. The stringers shall be 21 x 32 x .8mm x 570 mm length.

Performance of the system, as described below, shall be confirming to Master specs 10270 / 096900 (USA) 1 : Structural Performance : (a) Concentrated Loads : 450 Kgs ( 1000 lbf ) with a top-surface deflection under load and a permanent set not to exceed , respectively, 2.54 & 0.25 mm ( 0.10 & 0.010 inch ) according to CISCA A/F, Section I �� Concentrated Loads�� (b) Ultimate Concentrated Load: 1125 kgs (2500 lbf ) without failing according to CISCA A/F, Section II �� Ultimate Loading�� (c) Rolling Loads : 225 kgs ( 500 lbf )of the following magnitude, with a combination of local and overall deformation not to exceed 1.02 mm (0.040 inch) according to CISCA A/F, Section III �� Rolling Loads�� CISCA AF Rolling Load : 10000 Passes. with a maximum permissible deflection of not more than 1.52 mm as per definition of �Uniform load� of CISCA tested over an area of 300x300 mm square for 100kgs load Note: The uniform load rating of an access floor panel as specified here in should not be confused with the �uniform live load� as specified in seismic zone application. 3 : Other Non structural Parameters : (a) Fire Rating : The Panels shall confirm to Class O & Class 1 Fire Ratings tested as per BS 476 Part 6 (Fire Propagation) & 7 (Surface spread of flame) as also ASTM E84 1998 (Flammability) and ASTM E136 (Combustibility)

6.0 PLASTERING AND PAINTING 6.1 General 6.1.1 All plasterwork shall be of the best workmanship and in strict accordance with the dimensions of the drawings. All plastering shall be finished to true levels including plumbs, without imperfections, and square with adjoining work. It shall form proper foundations for finishing materials such as paint etc. Masonry and concrete surface to which plaster is to be applied shall be clean, free from efflorescence, sufficiently rough and keyed to ensure proper bond. 6.1.2 All chiseling, installation of conduits, boxes, etc. shall be completed before any plastering is commenced on a surface. Chiseling or cutting of plaster will not be permitted. Broken comers shall be cut back less than 150 mm both sides and patched with plaster of Paris as directed. All corners shall be rounded to a radius. Contractor shall get samples of each type of plaster work approved by the Architect. 6.1.3 The materials used for plastering shall be proportioned by volume by means of gauge boxes. Alternatively it may be required to proportion the materials by weight. 6.2 Plaster work 6.2.1 The joints in the brickwork, concrete blocks, shall be raked to a depth of 15 mm masonry is green. Concrete surfaces to receive plaster shall be suitably roughened. All walls shall be washed with water and kept damp for 10 hours before plastering. 6.2.2 The plaster unless specified otherwise shall be average of 15 mm thick on walls and minimum 6mm thick for the ceiling. The finished texture shall be as approved by the Architect. The mix for plaster unless otherwise specified, shall be one part cement and four parts sand, to walls and one part cement, 3 parts sand to ceiling. 6.2.3 The interior plaster shall be applied in one coat only. The surface shall be troweled smooth to an approved surface shall be trowelled smooth to an approved surface. All Plaster work shall be kept continuously wet for seven days. . 6.2.8 The rates include works at the heights, depths and corners and provision of all grooves, between various surfaces. 6.2.9 Any cracks which appear in the surface and all positions which sound hollow or are found to be soft or otherwise defective shall be cut and redone as directed by the Engineer to match with the surrounding surfaces. 6.3 Colour Washing The mineral colours not affected by lime. shall be added to white wash. indigo shall however, not be added. No colour wash shall be done until a sample of the colour wash of the required tint or shade has been got approved from the Architect. The colour shall be of even tint or shade over the whole area. A priming coat of white wash with lime or with whiting shall be applied. Two or more coats, shall then be applied on the entire surface till it represents a smooth and uniform Finish. Other specification described in above shall be applied in this case also.

6.4 Distempering Oil bonded distemper (OBD) of required colour and IS approved brand and manufacture shall be used. The shade shall be got approved from the Architect before application of the distemper. The distemper colour as required shall be stirred slowly in clean water using 6 decilitres (0.6 litre) of water per Kg . of distemper or as specified by the makers. Warm water shall preferably be used. It shall be allowed to stand for atleast 30 minutes (or if practicable over night) before use. The mixture shall be well stirred before and during use to maintain an even consistency. Distemper shall not be mixed in larger quantity than is actually for one days work. Preparation of surface Before new work is distempered, the surface shall be thoroughly brushed free from mortar dropping and other foreign matter and sand papered smooth. Pitting in plaster shall be made good with plaster of Pairs mixed with the colour to be used. The surface shall then be rubbed down again with a fine grade sand paper and made smooth. A coat of distemper shall be applied over the patches. The patched surface shall be allowed to dry thoroughly before the regular coat of distemper is applied. A priming coat of whiting shall be applied over the prepared surface. No white washing coat shall be used as a priming coat for distemper. Application The treatment shall consist of a priming coat of whiting followed by the application of two or more coats of distemper till the surface shows an even colours. 6.5 Oil emulsion (Oil bound) distempering Material: Oil emulsion (oil bound) distemper (IS: 428-1929) of approved brand and manufacture shall be used. The primer used shall be cement primer or distemper primer. This shall be of same manufacture as distemper. The distemper shall be diluted with water or any other prescribed thinner in a manner recommended by the manufacturer. Only sufficient quantity of distemper required for days work shall be prepared. The distemper and primer shall be brought by the contractor in sealed tines in sufficient quantities, at a time io suffice tor a fortnights work. The empty tins shall not be removed from the site of work. till this item of work has been completed and passed by the Architect. Preparation of surface Before new work is distempered, the surface shall be thoroughly brushed free from mortar droppings and other foreign matter and sand papered smooth. But if distempering is done after the wall surface is dried completely, distemper primer shall be applied. Oil bound distemper is not recommended to be applied within six months of the completion of wall plaster.

After the primer coat has dried for atleast 48 hours, the surface shall be lightly sand papered to make it smooth for receiving the distemper, taking care not to rule out the priming coat. All loose particles shall be dusted off after rubbing. One coat of distemper properly diluted with thinner (Water or other liquid as stipulated by the manufacture) shall be applied with brushes in horizontal strokes followed immediately by vertical ones which together constitute one coat. The subsequent coats shall be applied in the same way. For distemper 15cm double bristled brushes shall be used. After each days work, brushes shall be thoroughly washed in hot water with soap solution and hung down to dry. The specifications in respect of scaffolding protective measures and route shall be as described. 6.6 Painting i) Painting priming coat of wood surface Primer for woodwork shall be as specified in the description of the item. Surface to be primed shall be dry and thoroughly cleaned. All unevenness shall be rubbed down smooth with sand paper and shall be well dusted, knots, if any, shall be covered with preparation of red lead made by grinding red lead in water and mixing with strong glue sized and used hot. Appropriate wood filler material with same shade as paint shall be used where so specified. The surface treated for knotting shall be dry before primer is applied. After the primer is applied the holes and identification on the surface shall be stopped with glazier's putty or wood putty, stopping shall not be done before the priming coat. ii ) Painting priming coat on Iron & Steel surfaces. All rust and scales shall be removed by scrapping or by brushing with steel wire brushes. Hard skin of oxide formed on the surface of wrought iron during ranking which becomes loose by rushing shall be removed. All dust and dirt shall be thoroughly wiped away from the surface. iii) Painting priming coat on plastered surface The surface shall ordinarily not be painted shall be applied to get correct finish until it has dried completely/Before primer is applied, holes and undulations shall be filled up with plaster of Paris and rubbed smooth. The primer shall be applied with brushes, worked well into the surface and spread even and smooth. Painting shall be done by crossing and laying off. The crossing and laying off consists of covering the area over with paint, brushing the surface hard for the First time over and then brushing alternately in opposite direction, two or three times and then finally brushing lightly in a direction at right angles to the same. In this process, no brush marks shall be left the laying off is finished. The full process of crossing and laying off will constitute one coat.

Rate Rate shall include cost of all labour, material and all applicable rates & taxes involved the operations described above including scaffolding etc. Painting with enamel paint (conforming to IS : 2933 - 1975) and with synthetic enamel paint (conforming to IS : 1932 - 1964).

The surface to be painted shall have received the approval of the Architect after inspection, before painting is commended.

Application

The number of coats including the under coat shall be stipulated in the item.

a) Under Coat One coat of specified paint of shade suited to the shade of the top coat shall be applied and allowed to dry overnight. It shall be rubbed next day with the finest grade of wet abrasive to ensure a smooth and even surface, free from brush marks and all loose particles dusted off. b) Top Coat Top coats of specified paint of desired shade shall be applied. Each coat shall be allowed to dry for not less than 24 hours and lightly rubbed down smooth with Finest wet abrasion paper to get an even glossy surface. If, however, the surface is not satisfactory additional coats as required. 6.7 Spectrum textured wall finish Spectrum textured finish shall be of colour and Finish specified in the BOQ, or as approved by the Consultant. Finish shall be applied on plain smooth plaster / wood surface. The surface should be completely dry.

The Specialist Agency shall earn the work out only.

The note shall include cost of all material and labour involved in all operations including preparations of surface, scaffolding etc. 6.8 The rates of painting shall include.

Works at any height and use of all scaffolding, trestles, ladders cradles, etc. necessary for execution of work and for inspection,

Works on cornices etc. shall be girthed in measurement.

Work in narrow widths, bands etc. and cutting in edges to line.

Spreading and removing coverings to doors, windows, floors. Fittings, etc. to protect them from splashes.

Washing floors, cleaning glass, joinery, electric Fittings, wiring etc. of drops and splashes and leaving premises clean and tidy.

All kind of surfaces over which it is directed to be executed. No extra claim shall be entertained due to small or scattered work difficult positions.

All applicable rates & taxes.

SPECIFICAT IONS 7.I GENERAL 1. All conditions and descriptions etc. contained in the schedule of quantities are to be read with specification. 2. Figured dimensions on drawings shall supersede measurements by scale and drawings to larger scale shall take precedence over those to a smaller scale. All dimensions should be checked on site.

3. Dimensions where stated do not allow for waste, laps, joints etc.. but the contractor shall provide sufficient labor and materials to cover such waste, laps. joints etc. 4. Before taking up the job the contractor shall discuss the whole layout with details with the Architect and shall visit site to acquaint himself of the conditions prevailing thereon. 5. The contractor shall place at the disposal of the Architect, the services and advice of himself and his firm and his staff. suppliers or other skilled persons employed by him for the conduct of works comprised in the contract. 6. All rubbish as it accumulates from time to time during the progress of the work on site and at completion, shall be cleaned and carted away and all material condemned by the Architect shall be removed from the sight at the own cost. 7. The contractor shall make his own arrangements to provide labor, material, maintenance, fixing, carrying cleaning, making, good etc. 8. The contractor shall be required to leave every portion of the work, clean, clear, perfect and efficient at the conclusion of the contract, at his own expense. 9. The windows, glass panes, walls and glazed tiles should be protected during fixing and shifting of any furniture against breakage and the contractor shall make good any damage before the end of maintenance period. 10. All materials not conforming to the .architect's /owner specifications shall be rejected by theArchitect/Owner The contractor at his own cost shall remove such rejected material and replace it with specified material. 11. The Architect Owner shall have full powers and authority to issue instructions as to the order ofProceeding with or carrying out the work as they deem necessary for the guidance of contractor and the contractor shall be bound to carry out and execute accordingly. 12. Where ever the plywood is to be used, it shall be B.W.P grade quality and shall be veneered when to be polished. Unless otherwise stated and all taxes if any. 13. The rates quoted for all woodwork shall be with spirit polish, smooth, with wax finish of an approved shade and color unless otherwise stated. The Contractor shall supply samples of all the tones and types of French polish or Melamine polish as required by the Architect. A counter piece or accepted and approved plash shall be retained by the Architect until the end of virtual completion. 14. All the tones of final polish also shall be approved by the architect. 15. After every piece of work is fixed the Architect's approval shall be required. 16. All veneered plies shall be or selected variety with minimum 4 mm thick. With thin, close grains of light colour and straight and shall be approved by the Architects. No veneers with broad black lines, knots and vivid design shall be approved and no paper veneers shall be allowed to be used. 17. Decorative laminates (D/L) shall be of Formica/Royal Touch, make approved by the Architects with veneers in natural suede or matt finish and colors glossy or matt or suede as per instructions. 18. The tendered must note that the designs, sketches shown at the time of this tender are tentative and shall be subject of variations in design while preparing final details as required by the Architects. 19. All tendered shall be required to furnish a photocopy of the valid sales tax registration Certificate with the tender any tender not fulfilling these conditions shall be disqualified.

20. The glass used in glazed partitions shall be of the specified thickness float glass without Distortion and waves and both the surfaces of the glass shall be parallel and shall be as per list. 21. The contractors shall accord all reasonable co-operation, facilities and allow storage of the materials at site to the nominated sub-contractor as shall be appointed by the Architects in consultation with owner from time to time to carry out the works not covered under this contract, including provisional items etc. and allow them to carry out their work expeditiously 7.2 MATERIALS AND WORKMANSHIP: - 1. All materials, which are to be used in the works, shall be of their best respective kinds and to the approval of the Architect. The Architect or his representative will accept that the materials are really the best of their kinds, when it is approved beyond doubt that no better materials of the particular kind in question are available in the market. 2. The Architect in consultation with Owner shall have the power to cause the contractor to purchase and use such materials from any particular source. As may in his opinion be necessary for the purpose of proper execution of the work. Provided such source is an authorized dealer/stockiest of the said materials. 3. All steelwork to be spot and line welded and shall be painted two coats or enamel paint. 4. The contractor shall allow for a pair or ball and socket latch and a drawer lock and set of two keys and for every drawer and to be fixed as per Architect's instructions, in consultation with Owner. 5. All shutters to be lunged with hinges as specified by Architect and to be fitted with materials and screws. 6. The contractor shall provide samples of all materials or mock-ups of finishes and various items of furniture such as the frames, under-carriages, chair body, stands for tables cupboards, sofas etc. for Architects approval wherever required before taking up the bulk order in hand. Such samples, mock-ups shall be submitted for approval well before taking up the particular item of wooden hand and shall give the Owner and the Architect appreciable time for their comments. 7.3 CARPENTRY AND JOINERY WORK 1. Timber used for the joinery shall be of the approved quality seasoned Wood . and shall be well seasoned out square, free from excess sap, from sapwood dead knots of other defects and shall have fine light veins with uniform straight flow of lines. 2. All Plywood to be used on the work shall be of approved manufacturer. 3. Teak veneering on plywood shall be of special teak quality with thin close veins of light colour and shall run straight No veneer with board black lines, knots and wavy veins shall be approved. 4. All edges and comers of the plywood wherever exposed shall be lipped with Rubber Wood Covering beads mitered and glued as may directed by the Architect. 5. The workmanship shall be of the best quality. Boards and scantlings shall be accurately sawn and shall be of uniform width and thickness through. Work shall be accurately set out in accordance with the drawings and shall be framed together and securely fixed in workmanlike manner and with properly made joints. 6. All joinery shall be properly tanned, shouldered, dovetailed, wedged, planed, braided, etc, to the satisfaction of the Architect and shall be properly glued with l)best quality approved patented glue. 7. Oval or round or 1 shall be used for fixing or race work and hands shall be properly punched in. 8. For fixing to concrete and brick walls etc., rawl plugs or teakwood gutting shall be used and shall be tightly hammered inside. Unless otherwise specified, screws for such work shall be brass. All fixing holes shall be pelted concealed from view.

9. Wherever specified, woodwork shall be painted with two coats of flat oil paints on one coat ofprimer of approved quality and colour, woodwork to be pained shall be rubbed down dray with sandpaper before priming coat is applied. All coats shall be laid evenly and shall show no brush mark or drops of paints. Each coat should be allowed to dry thoroughly before next coat is applied. 10. All right angle joints shall be mitered, screws and glued with approved quality estimate and to be approved by the Architect. 11. All wood to be used in partitioning. Doors, frames, built-up boxing, cupboards etc. shall be of best quality Rubber Wood and shall be free from loose and big knots etc. 12. All wood to be used in partitioning. All metal work such as brass aluminum and wrought iron etc. shall be of the best quality and shall be of cross sections as may be specified by the Architect. 2. All joints junctions shall welded and shall be well ground, neatly finished in a workmanlike manner, wherever necessary wood filling in the hollow section shall be done for securing with the wood work. 3. No flanges, securing plates at junctions angle cleats, etc. shall be visible. All screws shall be counter sunk shall not be seen on the face unless otherwise instructed by the Architect. 4. .All metal legs shall be provided with nylon shoes. 5. All metal work shall be covered by anodizing Chrome plating or oxidizing process or spray painted or brush painted as may be directed and specified by the Architect. 6. All drawers, cupboards and lockers shall be provided with approved make brass locks and pair or chromium plated keys fitted on inside of the shutters. 7. Brass and aluminum fixtures such as hinges, knobs, stoppers handles hinging rods etc.. shall be approved designs, make and finished. 8. AU hinges for cabinets etc., shall be piano type or lmex' or brass butt/railway type oxidized/Zink/Chrome plated or any other make approved by the Architect. 9 All locks, bolts, hall catches, hinges, knobs, handles, pivots and other hardware fittings shall be (oxidized brass best quality approved by the Architect. 9. All cupboards, drawers etc. shall be provided with locking arrangement as per instructions, which approved quality locks, unless otherwise stated. I I. Metal work for the swivel chairs shall be of cast aluminum as per .architects design and shall spray painted in metallic. The castors for the swivel chairs shall be of best quality hand rubber, ball or cylindrical or any other type as approved by the Architects. 13. Aluminum M.S. Sheet stands/legs/under carnages etc. made of extruded solid sections or tub< shall be silver anodized and steel, work shall be hard chromium plated/painted unless other specified. 14. All Chairs/sofas etc., wherever possible shall be provided with helical/box springy of best quality in consultation with the Architects unless otherwise stated

7.5 UPHOLSTERY: 1. All upholstery work, unless otherwise stated shall be in foam rubber of the thickness specified by the Architect and shall be of 'High density P.U .Foam . 2. All workmanship shall be the best quality; P.U. Foam shall be neatly mounted on the plywood backing adequately ventilated. 3. All P.U. foam shall be laid in a perfect level and shall be glued properly at the jointed, all Comers eddies of the
