TENDER CONDITIONS

1. Tenders for each and every machinery should be sent separately in TWO SEPARATE SEALED COVERS using sealing wax or adhesive tape.

(a) Techno Commercial bid cover

Techno Commercial bid cover should be sent in wax sealed cover or using adhesive tape duly superscribed as "Techno commercial bid" for the supply of …………………………………………………. (Name of the machine should be mentioned clearly) to be opened on ----------------

(ii) Tenderer applying for more than one machine sh ould furnish a separate commercial bid for each and every machine. Tenderer furnishing a combined commercial bid cover for more than one mac hine will be summarily rejected.

(b) Price bid cover

Price bid cover should be sent in wax sealed cover or using adhesive tape duly superscribed as "Price bid" for the supply of ……………………………………………. (Name of the machine should be mentioned clearly).

(ii) Tenderer applying for more than one machine sh ould furnish a separate Price bid for each and every machine. Tend erer furnishing a combined Price bid cover for more than one machine will be summarily rejected.

Note: Both the Techno commercial bid and Price bid covers should separately be sealed and shall be kept in an outer envelope superscribed as "Techno commercial bid and Price bid for the supply of …………………………………" (Name of the machine should be mentioned).

2. The Techno commercial bid for each item should consist of the following

documents for technical evaluation. (Duly adhering to all the tender conditions).

(a) Tender form (every page) duly signed with official rubber stamp affixed

(b) Copy of the Audited statement of the company for the last three years (2012-13, 2013-14 and 2014-15)

(c) EMD payment details — Original Challan/Demand Draft should be enclosed with the Techno commercial Bid.

(d) The Manufacturers should produce manufacturing license and Proof of production capacity (latest)

(e) List of service centers in Tamil Nadu specifically in Chennai.

(f) List of clients with address and details of machines supplied to them apart from the performance Certif icate from the clients on the machines supplied to them.

(g) The tenderer should submit a comparative statement between the specification of the machine model quoted and with the tender specification as per Annexure-A.

(h) Sales Tax / VAT Clearance Certif icate for the year 2014-15

(i) Authorised dealers should submit the Latest Dealership certif icate issued by the principal company/ manufacturer. He should also produce the authorisation letter issued by the principal company/ manufacturer authorising him to participate in the tender as per Annexure-D.

(j) Declaration to the effect that the tenderer has not been black listed so far by any Government Department / Institution / Organisation.

(k) Income Tax statement for the year 2014-15.

(l) Tenderer should quote only for commercially success ful model and not for out dated model or for model which has been introduced newly and not sold so for.

3.(a) The Sealed price bid cover should consist of the ra te quoted for the machineries both in figures and in words. Rate should include of basic price of machine, accessories, packing, transportat ion, payment of duties, taxes leviable, insurance, freight, loading and unl oading, erection of the machine and any other incidental charges with givin g detailed break up of price separately.

Compulsorily rate should also be quoted for optional items specified in Annexure-A.

(b) Tenderer should quote for only one model and tenders quoting rate for more than one model will be rejected.

(c) The rates quoted shall be valid for not less than one year.

(d) Tenderers are specifically requested to quote rates without their own conditions, delivery terms, etc.

(e) The motors or any other electrical spares should be with ISI standards / International Standards.

(f) The Stabilizer of the required capacity (ISI standard/International Standards) should be provided for, along with the machine, wherever necessary.

(g) Standard and Special Accessories: A list of standard and special accessories and equipments that will be supplied free of cost along with the machine should be furnished. Equipments and accessories which are available at extra cost and which will be supplied as optional should also be specified separately furnishing the rates in respect of each item.

4. Tenders should be furnished in the prescribed format only, which can be bought from the Assistant Director, (Publications), Directorate of Stationery and Printing, 110, Anna Salai, Chennai-2, on payment of Rs.525/- (Rs.500+VAT5%). If the tender forms are required to be sent by Post, it can be received by sending a Demand Draft for Rs.575/- obtained from any of the Nationalized Bank drawn in favour of the Assistant Director (Publications), Directorate of Stationery and Printing, Chennai-2 on or after the date of publication of the notif ication. Tender document can also be downloaded from website www.tenders.tn.gov.in at free of cost.

5. The tenders can be sent by registered post, speed post, in person or by courier. Tender who could not send his/their Tender by post can put their tenders in the tender box, which will be provided for this purpose, at the office of the Director of the Stationery and Printing, Chennai-2. This box will be sealed at the prescribed closing time in the presence of Management By Objectives (Adviser), Directorate of Stationery and Printing, Chennai-2.

The size and dimension of the slit of the tender box is 30cm. in length and 4 cm. in width. Tenderer may take note of this and prepare cover to fit the slit, Big cover, if any, may be sent through registered post with acknowledgement due or through courier service. This department will not be responsible for the delay, if any, in transit in the receipt of tenders from the tenderer.

6. The Techno commercial bid covers will be opened on the dates specified in the presence of the tenderers or their authorised representatives who desire to attend with a letter of authority. Price bid of the tenderers found qualif ied to execute the tender will be opened on the dates to be intimated to them later, in the presence of the qualif ied tenderers or their authorised representatives who desire to attend with a letter of authority.

7. Each tenderer should give an undertaking along with his tender to the effect that he has made his tender abiding by all the tender conditions prescribed in the tender notice and that the rates tendered are for the items as specified in the tender schedule and that no plea will be put forward later that the rates quoted are for a different variety or quality. All specifications other than that mentioned in the tender schedule are liable for rejection.

8. (a) Tenders in the prescribed form should be duly signed by the tenderer. The tender forms issued in the name of the Intending tenderers/firms or downloaded from the designated website only should be used. If the form issued to other tenderer is used, such tenders will not be accepted. Use of any other tender form other than the one supplied by this department or downloaded from the any other web site is prohibited and if received will be summarily rejected.

(b) Every page of the tender documents should be duly s igned and rubber stamp affixed by the tenderer and enclosed a long with the tender ( i.e. with the Techno Commercial Bid) in token of having accepted all the tender conditions. In case of omission of signatures and affixing of official rubber stamp on each and every page of the tender document, the tenderer is at liberty to sign and affix his official rubber stamp in his Tender Document (before the Tender Scrutiny Committee) in the presence of the tenderers present at the time of opening of Tender, otherwise the Tender will be summarily rejected.

9. (a) Tenders must be accompanied by Tender deposit of 1% (One per cent) on the total value of the Tender based on net price of the machinery. Tenders which are not accompanied with one per cent EMD or accompanied with a deposit of less than 1% will be summarily rejected. The EMD must be remitted into the State Bank of India, Thousand lights Branch, Chennai-600 006, or any nearest Government Treasury in Tamil Nadu under the head,

“8443 -00 Civil Deposits- Deposits not bearing inte rest -

and the related original chalan should be attached to the tender or by a demand draft drawn from any nationalized banks in favour of the Director of Stationery and Printing, Chennai-2. Cash, cheque, etc., will not be accepted on any account towards EMD.

(b) No request for transfer or adjustment of any previous deposit towards EMD will be entertained.

(c) SSI Units registered in the relevant trade with Director of Industries and Commerce (Tamil Nadu) and NSIC are exempted from payment of EMD. Small Scale Industries units are requested to produce recently issued ‘Existence Certif icate’ and ‘Capacity Certif icate’ issued in the year 2014-15 for the particular item by the Director of Industries and Commerce or by the General Manager of the District Industries Centre of the respective areas in addition to the permanent enlistment certif icate to qualify for exemption from payment of EMD.

Tenderer applying for more than one machine should furnish separate EMD for each and every machine. Otherwise tenders with a combined EMD furnished by the tenderer for more tha n one machinery will be summarily rejected.

10. Tenders received after the specified time and d ue date will be summarily rejected.

11. At any time after the issue of tender documents and before the opening of the tender, the tender inviting authority may make any change, modifications or amendments to the tender documents and shall send intimation of such change to all those who have obtained the original tender documents from the office of the Director, Stationery and Printing, Chennai-2.

12. Any overwrit ing or correction in the tender should bear the initial of the tenderer. If any item in the tender is left blank, a line in ink should be drawn across it.

13. Tenders which do not satisfy any of the conditions mentioned above are liable to be rejected.

14. The Director, Stationery and Printing, Chennai reserves the right to accept the tender either in full or in part and eit her to increase or decrease the quantities to be purchased indicated in the ten der.

15. Any other conditions, which the Director, Stationery and Printing, Chennai-2

may deem fit and proper, will be imposed at the time of placing supply orders.

16. The successful tenderer has to take an insuranc e policy against fire, burglary, marine cum erection policy for the machin e covering the period from transportation, erection at the site continuou sly until handing over the machine in good working condition. During this peri od the tenderer is liable to assist to claim the insurance compensation again st any risk of loss, damage, howsoever caused to the machine. Policy sho uld stand in the name of Director of Stationery and Printing, 110, Anna S alai, Chennai-600 002 and installation site is at Government Central Press, C hennai-600 079 or any other branch presses as mentioned in the supply order.

Eligibility Criteria for CCTV Camera and Fire Alarm

The Bidders should have the following Eligibility for participating in the Tender. The Bidders should enclose documentary evidence for fulfilling the Eligibility in the Technical Bid.

The whole camera unit should be of the same brand. It should not be a assembled set.

Tenderers should be quote only for the approved brands mentioned in the tender. Otherwise tender will be summarily rejected.

Tenderers participating for cctv & fire alarm should file separate tenders for each Presses as mentioned in the tender. Otherwise it will be summarily rejected.

Eligibility Conditions Documentary proof to be submitted

1. Bidder should be in the business of implementing Security Systems for any Government Organizations/ Public Sector Undertakings in India for the past 3 years as on 31.03.2015

Photocopy of Work Orders or signed Agreements in the Bidder's name issued by the customer on or before 31.03.2012 should be submitted.

2. Bidder should have an Average Turnover of at least INR 75 Lakhs in the last three Audited Financial years as on 31/03/2014

Photo copies of the Audited Balance Sheet and Profit and Loss Account Statement of the Bidder for last three Audited financial years (2012-13, 2013-14, 2014-15) duly certified by the Auditors of the company should be submitted.

3. Bidder should have executed and maintained at least on single project order value worth not less than Rs.15 Lakhs in Security Systems Implementation at any Government Organizations / Public Sector Undertakings in India in the past 3 years as on 31.03.2015.

Photocopy of the Work Order or signed Agreements in the Bidder's name issued by the customer should be submitted.

Photocopy of the Completion Performance Certificate obtained from the customers on or before should be submitted.

4. Bidder should have possess a valid ISO 9000:2008 / ISO 9001:2008 Certification from the manufacturer

Photo copy of the relevant ISO Certificates should be submitted.

5. Bidder should have tied-up with the Original Equipment Manufacturer (OEM) for the supply and support service of the proposed Security Gadgets.

Letter of authorization from the OEM for the supply and support services of the proposed Security Gadgets should be submitted.

6. The bidder should not have been black listed from participating in any of the Tenders as per Tamil Nadu transparency in Tenders Act by Government of Tamilnadu as on date of submission of Bid.

A self-certificate letter Signed by the Authorised Signatory of the bidder as per prescribed format given as per our conditions.

Tenders will be evaluated adopting the following criteria.

2. The machineries and accessories for which the rates quoted, should match the specifications prescribed in the tender schedule.

3. Printed Literature: The tenderer should specify the machine model and number to be offered, machine catalogue, Literature, Pamphlets. He should also mention the machine features in details in com parison with the technical specification mentioned in the tender. If not specified / compared properly tender will be rejected.

4. Tenderer must be a manufacturer / Authorised dealer or distributor of the machineries and accessories. The original certif icate for the same should be furnished. If the tenderer is a authorized dealer or distributor, the date of appointments as Authorised dealer or distributor should be before that of the date of publication of this tender.

5. The company should be in the field of manufacture / supply and installation of machineries and accessories for the past 15 years.

6. The details of service facilities available in C hennai should be furnished and necessary proof for the same, together with the ir address and phone numbers, should be furnished.

7. The company should furnish a performance certif icate to the Directorate of Stationery and Printing, Chennai-2, issued by 3 to 4 important customers who are using the machineries supplied / maintained by the Tenderer.

8. The manufacturer or the dealer should specifically mention the number of machines of specification given in the tender and any other model sold in the last 3 years.

9. The manufacturers should enclose the certif icate from the Central excise department in support of their manufacturing capacity.

10. a) The manufacturer should mention his/her year s of experience in manufacturing the machine for which the tender is s ubmitted.

b) The dealers should enclose the latest dealers hip certificate obtained from the principal company/ manufacturer stating th e number of years of dealing of the respective machinery for wh ich the tender is submitted.

11. In the case of offers for imported machinery, the price must be indicated clearly in terms of related foreign curre ncy also. The break-up details of cost of items prescribed in tender condi tion 3(a) may also be furnished.

12. The tenderer should supply the commercially successful latest model with advanced features available at the time of supply relevant to specification.

13. Spare Parts: The tenderer should be able to supply the spare parts that are needed to the machines as and when required at least for next 10 years.

14. Services: The facilities available for the “after sales service”, and that of annual maintenance contract for at least 10 years, may be briefly stated.

15. Demonstration: A list of Institutions/Depts./Organ izations to whom the machines sold by the tenderer and now in use should be furnished along with tender. The tenderers shall arrange for the de monstration of their machines, only for the model for which they have qu oted at their own cost as per the instructions of this department bef ore the date of opening of tender if necessary.

16. After placing the supply order the selected tenderer should arrange for the inspection of the trial run of the machine by the technical committee of this department and despatch of the machine should be made after getting approval of the Director of Stationery and Printing. In this regard the tenderer should make necessary arrangement including traveling, boarding and lodging at his cost.

17. Training: The Selected tenderers should arrange for training of employees

at the installation site as follows:

18. Delivery of the machine: Machines should be delivered by the selected

firms at the Government Central Press, Chennai-79 or any other Branch specified by the Director of Stationery and Printing and the machine should be handed over in good condition before the date specified in the supply order.

19. Guarantee & Warranty: The number of years for guarantee and warranty of the machines are given below. The period of guarantee for all the machines should commence from the date of installation and handing over of machine in good working condition to the department. During Guarantee period, the fault should be repaired with spare parts free of cost. The warranty period for machine commence from the date of expiry of the Guarantee period. During warranty period repairs and general maintenance shall be attended free of cost and only cost of spares, if any will be paid by the department.

20. (a) The Director of Stationery and Printing reserves himself the right of rejecting any tender without assigning any reasons thereof.

(b) The Director of Stationery and Printing shall not bind himself to accept the lowest or any other tender and reserve the right to himself to reject all or any tender without assigning any reason thereof. The Director of Stationery and Printing also reserves the right to himself to accept one or more tenders for supply of one item

(c) When the performance of the firms on a previous tender was not satisfactory, the Director of Stationery and Printing has the powers to reject the tender.

(d) Based on field verification of the Tenderer / machine and based on the study of the past performance of the Tenderer / machine the Director has powers to reject the tender.

21.(a) On acceptance of the tender, the successful tenderer shall execute an agreement in the prescribed form in a stamp paper to the value as per law within 15 days from the date of receipt of the intimation from the Director of Stationery and Printing, Chennai-2 for the faithful performance of the contract, for the entire period of Guarantee &Warranty. This form can be had from the Directorate of Stationery and Printing, Chennai-2.

(b) The tenderer within 10 days after the receipt of supply order will also be required to remit a SECURITY DEPOSIT of 5 % of the value of the tender accepted and Security Deposit should be drawn in favour of the Director of Stationery and Printing, Chennai - 2. This amount shall be remitted only in the shape of Demand Draft or Banker's cheque or irrevocable Bank guarantee from any Nationalized bank valid for the entire period of Guarantee and Warranty plus 3 months is also acceptable.

(c) In the event of failure to remit the SECURITY DEPOSIT or to execute the agreement within stipulated time, the EMD already furnished shall be forfeited. In addition the tenderer will be treated as having committed breach of contract.

22. In case of unsuccessful tenderer, their EMD will be returned to them after settlement of tenders, for successful tenderers EMD will be returned after 3 months from the date of successful installation of the machines.

23. The Security Deposits will be released only after the completion of entire supply of the machine by the Contractor or after completion of guarantee and warranty period whichever is later. In case of failure to complete the supply and fulf ill all other tender conditions EMD& Security Deposits will be forfeited to the Government without prejudice to other rights and remedies of the Purchaser.

24. The EMD is liable to be forfeited to Government if the tenderer withdraws the tender after acceptance by this Department.

25. Once the tenderer has offered his / her / their rate or rates for an article or for a number of articles or for the whole items, in no case, after the opening of the tender, any of the tenderers will be permitted to withdraw the tendered rates, unless and until the acceptance of rates offered by one of the tenderers is ordered. If any tenderer desires to withdraw after opening of the tender and before acceptance, the EMD is liable for forfeiture.

26. Payment: (a) For the above machines 80% of payment will be made upon receipt of machine at site, with completion of erection, successful trial of the machine and handing over in good working condition and also imparting training to the employees. Balance 20 % will be made after ascertaining the further continuous good working condition of the machine.

(b) Any upward revision in claim of Central Excise Duty/CST/VAT after issue of supply orders by Director should be supported by proper evidence. Any reduction of Central Excise Duty/CST/VAT after issue of supply orders of The Director should also be given effect to.

(c ) Any upward revision in net price except Central Excise duty/CST/VAT after issue of supply orders by The Director will not be borne by this Department and the extra amount incurred if any will be borne only by the successful tenderer.

(d) Customs duty documents, the Bill of entry, Bill of Lading,etc., should be furnished.

27. Penalty for delay in delivery: In case of delay, neglect or refusal on the part of the contractor to supply and deliver the machines ordered for, he is liable to pay liquidated damages and penalty as follows:-

(i) For all the above machines the selected tenderer has to deliver the machine on or before the date specified in the supply order otherwise penalty will be levied @ 0.5% on the total cost of machine per month or part thereof for 30 days and thereafter the supply order will be cancelled.

(ii) In event of failure to supply the machine the selected tenderer is liable to pay the difference in cost between the prices paid for such machine when purchased from other sources and the prices accepted by this office and intimated to the contractor.

(ii i) In cases when the selected tenderer fails to replace the machine that have been rejected, the contractor is liable to pay for the quantity or articles/stores so failed to be supplied and purchased from other sources, the difference of cost between the prices paid for such machine and prices quoted by him in tender and accepted by this office.

(iv) Without prejudice to other rights and remedies of the Government if a contract for the supply is placed on the higher tender in preference to the lowest acceptable offer, in consideration of the offer of earlier delivery the selected tenderer will also be liable to pay to the Government difference between the contract rate and that of the lowest acceptable tender in case of failure to supply in terms of such contract within the due date of delivery.

(v) In case of the selected tenderer fails or refuses to observe, perform, fulf il l and keep up any one or all the conditions stipulated in the agreement to be executed after the acceptance of tender, the EMD and the SECURITY DEPOSIT furnished will be forfeited to Government.

28. Priority assistance for movement of goods licenses or permits required for executing any supply cannot be arranged by this department. They should be attended to by the tenderers themselves. Booking restrictions cannot be a plea for the failure to supply the articles within the stipulated time.

29. Conditions for advance payment or for immediate payment against receipt of LR/RR or any similar condition will not be accepted.

30. Upon the complete fulf illment of contract by selected tenderer to the entire satisfaction of the Director of Stationery and Printing, No. 110, Anna Salai, Chennai-2 and after completion of agreement period, the SECURITY DEPOSIT will be returned to him less the amount, if there is any due by the selected tenderer to this office. On no account, the EMD and the Security Deposit will be returned to the selected tenderer when the contract is in force.

31. In the event of any dispute or difference arising during the subsistence of the contract touching any clause matter, or thing herein contained or the operation of construction, hereto or the rights, duties, or liabilities of either party under or in connection therein then and in every such case except where herein otherwise stated the decision of the Secretary to Government of the Tamil Development and Information Department,Secretariat,Chennai - 9 upon such dispute or difference shall be final and conclusive as against any binding upon each of the parties hereto.

32. Force Majeure Conditions:

If at times during the continuance of the agreement/contract, it becomes impossible by reason of war or war like operation, epidemical sickness, pestilence, earthquake, fire, storm or floods, the supplier shall during continuance of such contingencies, not to be bound to execute the contract as per the agreement. The work shall be resumed immediately after the contingency/cies have ceased or otherwise determined and the successful tenderer's obligation shall continue to be in force for correspondingly extended period after the resumption of execution. The successful tenderer must inform the Director, Stationery and Printing, by registered post or by any other means about such act at once.

In the event of delay lasting over one month, if arising out of cause of Force Majeure, the Director, Stationery Printing reserves the right to cancel the contract without any compensation. Only events of Force Majeure, which affects the order progressing at the time of its occurrence, shall be taken into cognizance. The Director, Stationery and Printing, shall not be liable to pay extra cost due to delayed supplies made under Force Majeure.

33. Jurisdiction of Court: Chennai as per Indian Law.
