E-Auction bidding Terms and Conditions

1. Online e-auction shall be conducted by the service provider M/s Easy Bid Solutions Pvt. Ltd. on

behalf of RIICO, on the pre-specified date and time, while the bidder(s), shall be quoting from

their own offices/places of their choice, internet connectivity and other paraphernalia required for

participation in the e-auction shall have to be ensured by the bidder(s) themselves. Please note

that failure of internet connectivity (due to any reason whatsoever it may be) shall be sole

responsibility of the bidder(s) and neither RIICO nor M/s Easy Bid Solutions Pvt. Ltd. shall be

responsible for such unforeseen circumstances. In order to ward-off such contingent situation,

bidder(s) are requested to make all the necessary arrangements/ alternatives whatever required so

that they are able to circumvent such situation and still be able to participate in the e-auction

successfully. The bidder(s) are requested not to wait till the last moment to quote their bids to

avoid any such mishap.

2. On request, M/s Easy Bid Solutions Pvt. Ltd. shall arrange to train the bidder(s), without any

cost. M/s Easy Bid Solutions Pvt. Ltd. shall acquaint bidder(s) regarding the bidding process,

functions and e-auction rules. All the bidder(s) in their own interest if so required ,should ensure

9. Procedure of E-Auction

i. E-Form Submission

All interested bidder(s) need to deposit the Earnest Money and register/ fill the online form

available on e-auction domain at www.easybidsolutions.com with necessary details by Date

: 10/2/2015, Time : 5 P.M.

ii. For registration , click the button “AUCTION” on the web site www.easybidsolutions.com

and then click “UPCOMING AUCTIONS” this will direct you to the page where details of

RIICO’s e-auction are being displayed. Click on the “PARTICIPATE” button on the row

in which RIICO’s e-auction is displayed. This will take you to “NEW USER

REGISTRATION PAGE” after filling the required details click the button “REGISTER”

this will then take you to the page for “PAYMENT DETAILS”. On this page fill in the

required details of earnest money deposited and upload scanned copy of all the necessary

documents such as ANNEXURE-II (bid amount to be quoted in ANNEXURE-II should

not be less than the reserve price) & ANNEXURE-III ,photograph/image, photo-ID,

scanned signatures ,authorization letter etc. and then click on the “SUBMIT” button.

Subsequent to successful submission of all the required details and deposition of earnest

money the bidder(s) shall receive a login-ID and password through their registered e-mail

from M/s Easy Bid Solutions Pvt. Ltd. for participating in the e-auction.

iii. Online e-auction

RIICO will declare its Opening Price (OP), which shall be visible to all the bidder(s)

during the start of the e-auction. Please note that the start price of an item in online e-

auction is open to all the participating bidder(s).Any bidder(s) can start bidding, in

the online e-auction, from the start price itself. Hence, the first online bid that comes

in the system during the online e-auction can be equal to the e-auction’s start price, or

higher than the e-auction’s start price by one increment or higher than the e-auctions

start price by multiples of increment. The second online bid and onwards will have to

be higher than the H1 rate (Highest Bid) by one increment value, or higher than the

H1 rate by multiples of the increment value.

The “Bid Increase Amount” has been fixed which the bidder(s) can view on their

bidding screen and the bidder(s) will have to increase the bid amount in the multiple

of “Bid Increase Amount”.

Online e-auction shall be for a Period of 2 hour. If a bidder(s) places a bid in the last

5 minutes of closing of the e-auction and if that bid gets accepted, then the e-

auction’s duration shall automatically get extended for another 5 minutes, from the

time that bid comes in. Please note that the auto-extension shall be for unlimited

times and will take place only if a valid bid comes in last 5 minutes of closing. If

valid bid is not received, the auto-extension will not take place even if that bid might

have come in the last 5 minutes, in case, there is no bid in the last 5 minutes of

closing of e-auction, the e-auction shall get closed automatically without any

extension. However, bidder(s) are advised not to wait till the last minute or last few

seconds to enter their bid during the auto-extension period to avoid complications

related with internet connectivity, network problems, system crash down, power

failure, etc.

10. Highest bidder(s) in his/its/their own interest is/are advised to submit the final price, quoted

during the e-auction as per ANNEXURE-IV (through a scanned copy) immediately after the

completion of e-auction, duly signed and stamped without any new condition other than

those already agreed to before start of e-auction through e-mail at [email protected]

&/or [email protected]. &/or [email protected].

11. During e-auction, if no bid is received within the specified time, RIICO at its discretion may

decide to revise opening prices/ scrap the e-auction process / proceed with conventional

mode of auction.

12. The bid once submitted by bidder(s), cannot be cancelled/ withdrawn and the bidder(s) shall

be bound to buy the property at the final bid price after due approval from competent

authority of RIICO and issue of sale letter. The failure on part of bidder(s) to comply with

any of the terms and conditions of the e-auction notice, Sale Letter and Tender

Document will result in forfeiture of the earnest money /10% amount paid by the

defaulting bidder(s).

13. The bidder(s) will be able to view the following on their screen along with the necessary

fields in the e-auction

a. Leading bid in the e-auction (H1 – Highest Bid/Rate)

b. Bid placed by bidder(s)

c. Opening Price & Minimum Increment Value.

d. The bid rank of bidder(s) in the e-auction.

14. The decision of RIICO regarding declaration of successful bidder(s) shall be final and

binding on all the bidder(s). RIICO reserves the right to accept any offer or to reject all or

any of them without assigning any reason thereof. No legal right shall be generated in favour

of the highest bidder merely on account of the highest bid.

15. The highest bidder in the auction will have to deposit with RIICO 10% of the bid amount

including earnest money earlier deposited within seven (7) working days of the bid failing

which the bid shall not be considered , earnest money deposited shall be forfeited and the

second/ subsequent higher bidder in the auction shall be given the same chance.

16. RIICO shall be at liberty to cancel the e-auction process at any time, before declaring the

successful bidder(s), without assigning any reason.

17. RIICO / M/s Easy Bid Solutions Pvt. Ltd. shall not have any liability towards bidder(s) for

any interruption or delay in access to the website irrespective of the cause.

18. The bidder(s) are required to submit acceptance of the terms & conditions before

participating in the e-auction by uploading a scanned copy of ANNEXURE-III at the time of

registration.

19. Duration of E-Auction: The e-auction of property is scheduled to be conducted on the day &

time as specified in the e-auction notice published in the newspapers and soft copy enclosed

as ANNEXURE-I below. There will be unlimited extension of 5 minutes duration each, if

any valid bid is received in last 5 minutes of the close of e-auction. The bidder(s) are

cautioned not to wait till the last minute or last few seconds to enter their bid to avoid

complications related to internet connectivity, network problems, system crash down, power

failure, etc.

20. Successful bidder(s): At the end of the e-auction, RIICO will evaluate all the bids submitted

and will decide upon the successful bidder(s) after taking due approvals from the competent

authorities. This process may take some time, RIICO’s decision will be final & binding on all

the bidder(s).

Terms & Conditions of E-Auction for Sale of Property:

i) The e-auction is being held on “AS IS WHERE IS AND WHAT EVER THERE IS”

basis.

ii) The sale/e-auction is being conducted under provisions of SFC Act, 1951.

iii) Plot No. A-320(A) measuring 5481 sqm. located at MIA, Alwar is being offered for sale/

e-auction. This shall constitute one lot only.

iv) Land being sold by RIICO shall be free from encumbrances of dues /liability of State

Government Departments /Agencies. However, Land dues of RIICO will be borne / paid

by the buyer separately.

v) The intending bidder(s) should make their own independent enquiries regarding the other

encumbrances, title or property/(s) put on e-auction and claims/rights/dues affecting the

property, prior to submitting their bid. The e-auction advertisement does not constitute

and will not be deemed to constitute any commitment or any representation of RIICO.

vi) It shall be the responsibility of the bidder(s) to inspect and satisfy themselves about the

factual position of the assets and its measurements before submitting the bid.

vii) The particulars specified in the e-auction notice published in the newspapers and annexed

herein below as ANNEXURE-I, have been stated to the best of the information of

RIICO. However, RIICO shall not be responsible / liable for any error, misstatement or

omission.

viii) The inspection of property put on e- auction will be permitted to interested bidder(s) at

site on the day and time mentioned in the public notice annexed as ANNEXURE-I.

ix) The interested bidder(s) who require assistance in creating login ID and password,

uploading data, submitting bid, training on e-bidding process etc., may contact M/s Easy

x) The intending purchaser/ bidder(s) is required to deposit earnest money by way of

NEFT/RTGS in the following Account – RIICO Ltd. Account No 678605001015 (IFSC

Code ICIC0006786) maintained at ICICI Bank Tilak Marg, Jaipur or through DD/

Payorder payable at Jaipur (Rajasthan) favouring RIICO Ltd. on or before the last date

mentioned in the e-auction advertisement released in the newspaper which is annexed

herewith as ANNEXURE-I. The bidder(s)subsequent to deposition of earnest money are

required to register themselves at www.easybidsolutions.com and upload required

documents (Please note that last date for deposition of earnest money and registration for

online E- Auction is 10/2/2015, upto 5 P.M.). The bidder(s) are required to e-mail at

[email protected] &/or [email protected] the UTR/Transaction number of the

RTGS/NEFT done towards earnest money to RIICO or the Details of DD/ Payorder

favouring RIICO Ltd. payable at Jaipur (Rajasthan) submitted towards earnest money.

Neither RIICO nor M/s Easy Bid Solutions Pvt. Ltd shall be liable for any network

problem and the interested bidder(s) are to ensure that they are technically well

equipped for participating in the e-auction.

xi) At the time of registration of bidder(s) on the web-site as mentioned in Para (x) above, the

intending purchaser/ bidder(s) is required to get the scanned copies of following

documents uploaded on the website before the last date & time for submission of earnest

money (as mentioned in the public e-auction notice published in the newspapers and

copy of which is attached below as ANNEXURE-I )

1. Copy of the NEFT/RTGS challan / details of DD/ payorder;

2. Copy of PAN card;

3. Proof of identification (KYC) viz. self attested copy of Voter ID Card/ Driving

License/ Passport etc.

4. Copy of proof of address, without which the bid is liable to be rejected.

5. The bidder(s) other than individuals (i.e company, firm etc.) shall also upload proper

mandate/authorization letter for e-bidding/participation in e-auction.

xii) The e-auction will take place through web portal "www.easybidsolutions.com" on the

date & time specified in the e-auction notice published in the newspaper and as per

ANNEXURE-I attached herewith.

xiii) The interested bidder(s) who have deposited their earnest money by 10/2/2015, upto 5

P.M. shall be eligible for participating in the e-auction. The e-auction of above

properties would be conducted exactly on the scheduled date & time as mentioned

against the property by way of inter-se bidding amongst the bidder(s). The bidder(s)

shall improve their offer in multiple of rupees, as mentioned against the assets in the

advertisement published in newspapers. In case bid is placed in the last 5 minutes of the

closing time of the e-auction, the closing time will automatically get extended for 5

minutes (subject to unlimited extensions of 5 minutes each). The bidder(s) who submits

the highest bid (not below the reserve price) on closure of online e-auction shall be

declared as the highest bidder(s).

xiv) The minimum offer amount cannot be less than the reserve price mentioned in the public

e-auction notice published in the newspapers and copy of which is attached below as

ANNEXURE-I.

xv) The bid (s) shall be accompanied by an Earnest Money Deposit (EMD) equal to Rs 5.00

lakh by RTGS/NEFT/DD/Payorder. No bid/proposal shall be considered/accepted

without the requisite Earnest Money and the bids submitted without EMD amount shall

be summarily rejected. The property shall not be sold below the reserve price.

xvi) Any conditional bid(s) shall be treated as invalid. Please note that after submission of the

bid(s), no correspondence regarding any change in the bid shall be entertained.

xvii) If the dues of RIICO together with all costs, charges and expenses incurred by it or part

thereof as may be acceptable to RIICO are tendered by or on behalf of the borrower

whose property is on e-auction or by the property holder/s or guarantor/s at any time on

or before the date fixed for sale, the sale of assets/e-auction may be cancelled.

xviii) Only those bidder(s) holding valid user ID & Password and confirmed payment of EMD

through NEFT/RTGS/DD/Payorder shall be eligible to participate in online e-auction.

xix) The interested bidder(s), who have deposited their earnest money and registered

themselves at www.easybidsolutions.com by 10/2/2015, upto 5 P.M. shall be eligible to

participate in the e-auction at scheduled date and time given against the assets to be sold

as specified in the public notice annexed as ANNEXURE-I. The e-auction is by way of

inter-se bidding amongst the bidder(s) and the bidder(s) shall improve their offer in

multiple of rupees as mentioned against assets in the advertisement published in

newspapers. The inter-se bidding amongst the bidder(s) shall commence online exactly

on the date & time specified in the public notice annexed as ANNEXURE-I.

xx) The EMD of unsuccessful bidder(s) will be refunded to their respective bank A/c No.

shared in e-auction portal (www.easybidsolutions.com) online and/or the DD/Payorder

submitted towards EMD shall be returned. The bidder(s) will not be entitled to claim

any interest, costs, expenses and any other charges (if any) on the EMD. Refund of EMD

of unsuccessful bidders shall be done within 10 working days from the date of E-auction.

xxii) RIICO is not bound to accept the highest offer/bid and RIICO has absolute right to

accept or reject any or all offer(s) or adjourn/postpone/cancel the e-auction without

assigning any reason thereof. This sale/e-auction is subject to approval by the

competent authority of RIICO. Highest bid received in the auction shall be put up

before the competent authority for approval of the sale by RIICO. Subsequent to

approval of the sale by the competent authority letter of offer for sale shall be issued.

xxiii) The highest bidder in the auction will have to deposit with RIICO 10% of the bid

amount including earnest money earlier deposited within seven (7) working days of

the bid failing which the bid shall not be considered , earnest money deposited shall

be forfeited and the second/ subsequent higher bidder in the auction shall be given

the same chance.

xxiv) The successful bidder(s) shall be required to submit their offers on cash down

payment basis only i.e.the bidder(s) shall deposit entire agreed sale consideration

(after adjusting the 10% of bid amount already deposited) within 30 days from the

date of issue of sale letter. In case bidder(s) fails to deposit the entire down

payment within the stipulated period of 30 days, the amount earlier deposited by

the bidder(s) shall be forfeited.

xxv) The successful bidder(s) shall be required to deposit10% of the bid amount within seven

(7) working days of the bid and the entire agreed sale consideration (after adjusting the

10% of bid amount already deposited) within 30 days from the date of confirmation of

sale by RIICO through sale letter or such extended period, as may be permitted by

RIICO at their sole discretion through NEFT/RTGS to the following account - RIICO

Ltd. Account No 678605001015 (IFSC Code ICIC0006786) maintained at ICICI Bank

Tilak Marg, Jaipur or through DD/ Payorder, favouring RIICO Ltd. payable at Jaipur

(Rajasthan). In case of default in payment of the bid amount within the prescribed

period, the amount earlier deposited by the bidder(s) shall be forfeited and the assets

will be reauctioned.

xxvi) The successful bidder after depositing the due payments, shall within 30 days from the

date of executing the Agreement to Sale /Conveyance Deed / Sale Deed and other legal

documents, take over the possession of the fixed assets. In case of failure to do so the

successful bidder/purchaser shall be liable for security and other related expenses.

xxvii) The purchasers will not be required to pay outstanding dues of other Department(s) of

State Government including Electricity i.e. electricity distribution companies,

Commercial Tax, State Excise, PHED, Transport, Land & Building Tax, Industries etc.

separately.

xxviii) The bidders/purchasers will be responsible for payment of all the IPI dues of the

Corporation related to land, including dues for unauthorized construction etc.,

whatsoever, separately, prior to execution of conveyance/sale deed/agreement to sale.

xxix) The bidders/purchasers will also be responsible for payment of dues of Central

Government Departments/Agencies, such as Central Excise & Customs etc., whatsoever,

separately. However, the bidders in their own interest are advised to confirm the same

from the concerned depts.

xxx) Words and expressions used herein above shall have the same meaning respectively

assigned to them in the SFC Act, 1951 and the Rules framed there under.

xxxi) Disputes, if any, shall be within the jurisdiction of Jaipur Courts only.

xxxii) The legal documents shall be executed after confirmation of sale by RIICO and on the

receipt of entire sale consideration.

xxxiii) Any expenses on account of registration of Sale Deed/Agreement to Sale shall be borne

by the bidder/purchaser.

Other Terms & Conditions for Sale of Property(s)

The bidder(s) shall not involve himself or any of his representatives in price

manipulation of any kind directly or indirectly by communicating with other

bidder(s).The bidder(s) shall not divulge either his bids or any other exclusive details of

RIICO to any other party.

The decision of RIICO regarding declaration of successful bidder(s) shall be final and

binding on all the bidder(s).

M/s Easy Bid Solutions Pvt. Ltd / RIICO shall not have any liability to bidder(s) for any

interruption or delay in access to the site irrespective of the cause.

M/s Easy Bid Solutions Pvt. Ltd /RIICO is not responsible for any damages, including

damages that result from, but are not limited to negligence. M/s Easy Bid Solutions Pvt.

Ltd./RIICO will not be held responsible for consequential damages, including but not

limited to systems problems, inability to use the system, loss of electronic information

etc.

1. I/We, the bidder(s) do hereby state that, I/We have read the entire terms and conditions of the e-

/information furnished by me/us is found to be incorrect and /or untrue, the offer/bid submitted by

me/us is liable to be cancelled and in such case, the EMD paid by me/us is liable to be forfeited by

the RIICO and that RIICO will be at liberty to annul the offer made to me/us at any point of time.

4. I/We understand that in the event of me/us being declared as successful bidder(s) by RIICO in its sole

discretion, I/We are unconditionally bound to comply with the Terms and Conditions of e-

auction/sale. I/We also agree that if my/our bid for purchase of the asset/s is accepted by RIICO

and thereafter if I/We fail to comply with or act upon the terms and conditions of the sale letter or

am/are not able to complete the transaction within the time limit specified for any reason whatsoever

and/or fail to fulfill any /all of the terms and conditions, the EMD and any other monies paid by

me/us along with the bid amount thereafter, is/are liable to be forfeited by RIICO.

5. I/We also agree that in the eventuality of forfeiture of the amount by RIICO, the defaulting bidder

(s) shall neither have claim on the property nor on any part of the sum for which it may be

subsequently sold/auctioned.

6. I/We also understand that the EMD of all the bidder(s) shall be retained by RIICO and returned only

after the successful completion of the sale/e-auction of the Assets. I/We state that I/We have fully

understood the terms and conditions of e-auction and agree to be bound by the same.

7. The decision taken by RIICO in all respects shall be binding on me/us.
