Item Description:- NS-3 Assembling, linking and laying of BG PRC fan shaped points and crossing (Turn outs)52kg/60kg, trap, Diamond crossing and Scissor crossover with New/ SS rails on PRC sleepers as per approvedIRS drawings in other than running track conditions as per direction of Engineer and in accordance with theprovisions contained in the special tender conditions, ensuring correct spacing, including cutting and straighteningof lead rails, drilling of holes for fish plated joints, fixing distance blocks & stretcher bars, fixing of check rails etc.with all standard fitting and fastenings. The item includes the marking of sleeper spacing on rail gauge face withapproved quality paint/colour/stencil as directed by Engineer in charge including squaring of sleepers in points &crossing assembly, gauge, alignment, longitudinal and cross level etc. complete, including greasing/oiling of fishplates, fish bolts and nuts, leg of ERCs, inner surface of MCI inserts, Gauge face of lead Rails, Stock Rails,Tounge Rails, CMS Crossing. (K.oil, black oil, Grease etc. is to be arranged by contractor at his own cost),providing spherical washers and provision of correct expansion gaps according to standard temperature prevailingat the time of linking including free lead upto 500 meter for all PRC sleepers, switches, crossing, lead rail, leading ofall P. way fittings from site store of the contractor at respective station or lying in the Section, with all lead, lift,ascent, descent or any other obstruction, handling, re-handling, crossing of line etc. in station yard on new/existingformation as required including dressing and rolling of previously laid track ballast of required cushion, katchapacking & required grading with ballast to bring track to fairly good geometry and final tolerance as per specialtender conditions and specifications in non-running track. The item includes fixing of hand lever for movement ofswitches and movement from signal point of view and setting properly where it is required, Machinery work forcutting of stud bolts/stretcher bar bolt up to required depth for proper opening and housing of points and crossing.Bolts will be supplied free of cost from the store of SSE/C/P. Way at site etc. including all labour and materials as acomplete job. Necessary S & T Fitness of Switches have to be made with the S & T Department and providenecessary assistance to S & T Department. Leading of P. Way Materials beyond 500 M shall be paid separatelyunder relevant NS item. Note: - (i)The work of assembling, linking and laying shall be done during before non-interlocking or pre-non-interlocking period. (ii)The Item includes fixing of Hand Lever for movement of Switch andmovement from Signal point of view and setting properly where it is required. The rate against NS item shall deem to be inclusive of above elements. Item Description:- NS-6- Handling, lifting, loading, leading, unloading and spreading of 65mm gauge machinecrushed hard stone ballast from the existing stacks lying along the cess/within railway boundary/ other land andputting the same on new bank manually, donkey labor or by tractor/truck or any other means in straight /curved /point and crossing etc. Rate will include all lead, lift, ascent, descent, handling, rehandling, crossing of runningtrack (safely), nallahas, streams or any other obstruction coming while working including all other charges i.e.taxes, royalties, octroi etc. making approach road wherever required for leading of ballast on new bank withcontractor's own tools labor etc. complete as directed by the Engineer in charge including a lead of 200mtr oneither side. The ballast shall be spread initially in a layer of 150 to 300mm thickness (as directed by Site Engineer)for linking of track and further ballast shall be spread after linking of track to make proper ballast profile as perballast profile shown in IRPWM (with all correction slip up to date) for single line BG LWR track on PRC sleeperswith contractor's own tools & labor as a complete job. Note: - (i)During lifting operation of ballast complete stack,clean ballast will be cleared. (ii)(ii) The payment shall be made for the actual quantity of ballast measured in thestacks. (iii)If ballast stacks lying on opposite side of new formation, lead will be measured along track & nothingextra lead will be paid.

Item Description:- NS-7- Two rounds of Manual Through packing inclusive of boxing, packing, dressing andproviding required ballast cushion 250/300/350mm as applicable and as per stipulated profile for LWR / SWR / Fishplated track / curves, point and crossing, traps as per IRPWM or as directed by the Engineer-in Charge including1st& 2nd packing at required intervals including squaring of sleepers, ensuring correct spacing, gauging, slewingfor adjusting alignment, packing, repacking of joint sleepers, longitudinal and cross level etc. complete to bring thetrack to required tolerance so as to make the track fit for a speed of 45 KMPH including all lead, lift, handling and rehandling etc. of track points and crossing under working traffic conditions or on newly laid track/ turn out/ trappoints as a complete job.Note: - Payment schedule will be as follows: (i)40% payment will be made on completionof 1st through packing. (ii)40% payment will be made on the completion of 2nd through packing after making thetrack tolerances within the range defined in special conditions/ specifications, boxing, dressing and stipulatedballast profiling and making track fit for the speed of 45 KMPH. (iii)10% payment will be released after completion ofBoxing, balancing as per approved ballast Profile. Balance 10% payment shall be released after one month of theopening of the track to rail traffic including rectification of all defects by the contractor as intimated by the Engineerat site.

Tender documents in suchcases are to be signed by such persons as may be legally competent to signthem on behalf of the firm, company association or society as the case maybe Co-operative societies must likewise submit a attested copy of theircertificate of registration alongwith the documents as above mentioned. Therailway will not be bound by any power of attorney granted by the tenderer/sor by changes in the composition of the firm made subsequent to theexecution of the contract. 3.2JVs/ Consortiums/ MOUs shall be considered in accordance with TenderNotice / approved tender conditions.

3.3

If the tenderer expires after the submission of his tender or after theacceptance of his tender, the Railway shall deem such tender/contract ascancelled, if a partner of firm expires after the submission of their tender, theRailway shall deem such tender as cancelled unless the firm retain itscharacter.

3.4

If the contractor's firm is dissolved on account of death, retirement of anypartners or for any reason what-so-ever before fully completing the wholework or any part of it, undertaken by the principal agreement the survivingpartners shall remain jointly/severally and personally liable to complete thewhole work to the satisfaction of the Railway due to such dissolution. Theamount of such compensation shall be decided by Chief Engineer/Const.,Northern Railway, Kashmere Gate, Delhi and his decision in the matter shallbe final and binding on the contractor.

3.5

The cancellation of any documents such as power of attorney, partnershipdeed etc., shall forth be communicated to the Railway in writing, failing whichthe Railway shall have no responsibility or liability for any action taken on thestrength of the said documents.

The value of contract and the quantities given in schedule of items, rates andquantities are approximate and are given only as a guide. These are subject tovariations/additions and omission. The quantum of work to be actually carriedout shall not form the basis of any dispute regarding the rates to be paid andshall not give rise to claim for compensation on account of any increase ordecrease either in the quantity of in the contract value

4.1

The Performance Guarantee shall be initially valid up to the stipulated date ofcompletion plus 60 (Sixty) days beyond that. In case, the time of completion ofwork gets extended, the contractor shall get the validity of PerformanceGuarantee extended to cover such extended time for completion of work plus60 (Sixty) days. In case during the course of execution, value of the contractincreases by more than 25% of the original contract value, an additionalPerformance Guarantee amounting to 5% (five percent) for the excess valueover the original contract value shall be deposited by the contractor. On theother hand, if the value of contract decreases by more than 25% of the originalcontract value, Performance Guarantee amounting to 5% (five percent) of thedecrease in the contract value shall be returned to the contractor. The PGamount in excess of required PG for decrease contract value, available withRailways, shall be returned to contractor as per their request dulysafeguarding the interest of Railways.
