Each category (Sections 1.1 through 1.9) will be evaluated separately by the Evaluation Committee.

Committee members will score each category independently of the others, and will make awards as

in the best interest of the Lead State and ValuePoint.

Vendors may submit a proposal for any or all of the categories listed in the Scope of Work, but may

not submit for less than one entire category. Vendors must clearly identify in their proposal the

category or categories, the section number(s) and geographic location for which they are proposing.

For all categories below, the vendor:

Must ensure that the facilities are in compliance with all existing Participating Entities rules

and regulations;

RFI will comply

Must be in compliance with current National Fire Protection Association (NFPA) Standards,

Participating Entities Contractor’s Board Licensing and Participating Entities State and

Local Fire regulations at the time supplies or systems are delivered pursuant to an order

under the Master Agreement;

RFI will comply

Must ensure all services are conducted by a State Certified/Licensed Technician;

RFI will comply

Must ensure all services are conducted in accordance with any certification requirements

within Participating Entitles;

RFI will comply

May offer additional services as related to awarded categories;

RFI has installed large videowalls, AV type products, perimeter fence detection, special

touchscreen control systems, turnstiles and just about anything related to facility security

and notification.

Must ensure all equipment is compatible to the best industrial standards and must function as designed after installation;

RFI has always insured that equipment works as presented. If there are any reasons equipment is incompatible or not working as expected, we will correct it at our own expense.

Must designate a single point of contact to be the liaison for state information technology staff to handle the day-to-day operations. References for this designee must be submitted as part of the vendor’s proposal;

Byron Fanger will be the point of contact for information technology to handle day to day operations.

May not apply surcharges for transportation, fuel, energy, insurance or any other reason

throughout the duration of the contract(s); and

Shall ensure permits must be current and remain current.

When providing services, vendor must:

Discuss findings with the Purchasing Entity’s point of contact prior to leaving site; and

Submit a report including the findings no later than 24 hours after inspection.

Inspections performed shall include the cost of the initial inspection, any required

maintenance, and any needed follow-up inspections (at no additional cost for the follow up

inspection).

A. AGREEMENTS

The agreement between vendors and agencies will include, but are not limited to the

following:

If vendors will require agencies to sign a subordinate agreement the subordinate

agreement must be approved by each Purchasing Entity prior to signing.

Awarded vendors shall provide separate quotes within 48 hours of request (unless

otherwise approved by Purchasing Entity) for each new or replacement installation as

required by the Purchasing Entity. Quotes should offer price differences for lease and

purchase options as requested by the Purchasing Entity.

B. BACKGROUND CHECKS

All background checks must be completed after contracts have been awarded, but prior

to any work being done.

All vendors’ employees providing on-site services to this contract must be required to

submit to and pass background checks. Upon request from Purchasing Entities, vendors

must provide copies of background checks or submit to additional security requirements.

It is the vendor’s responsibility to ensure the following:

Vendors must not begin work on the contract until clearance has been issued by the

Purchasing Entity; and

Notification and access to facilities will be pre-authorized by Purchasing Entities.

C. PUBLIC WORKS PROJECTS

Any projects that are federally funded may be subject to the requirements of Davis-Bacon

Act and/or the Davis-Bacon Wage Decision.

Labor prices for affected projects may be negotiated between the using entity and the

contractor, provided the contractor provides adequate documentation for any negotiated

increase.

Documentation may include payroll records, copies of wage decisions, and/or other

information that establishes a clear difference between the contractor’s standard

wage and the prevailing Davis-Bacon wage for any affected employee for that

project.

RFI will comply

Under no circumstances will that price be increased by an amount higher than the

difference between the normal hourly rate and the hourly rate required by the

applicable Davis-Bacon Wage Decision.

RFI will comply

Vendors must include in job quotes the standard business hours and prevailing wage rate for

the job location. Quotes should include shift differential, if any, for working nights and

weekends.

Jobsites must be cleaned every day.

Awarded vendor(s) must complete any punch lists within five (5) days of receipt. Exceptions

to this standard may be addressed on an individual project basis.

Asbestos

Asbestos may be present within State-owned facilities, and may be encountered in

previously inspected buildings.

Upon discovering asbestos or a suspected asbestos-containing material (ACM), all work

shall immediately stop in the affected area and contact the project manager and/or

building owner;

RFI will comply

The project manager and/or building owner shall assume responsibility for taking

material samples for testing; and

The project manager/building owner will convey all pertinent information regarding

asbestos test results to the vendor and, if necessary, conduct any required remediation

prior to resuming work in the affected area.

All remediation work must be performed by a contractor specifically licensed and/or

certified to perform asbestos remediation.

Vendors may be held liable for violations of any applicable federal, state and/or local

environmental laws or regulations, whether committed through action or inaction.

D. GENERAL REQUIREMENTS

Vendors must guarantee workmanship at vendors’ expense for a period of twelve (12)

months from date of installation.

Work shall be performed in accordance with manufactures’ recommendations and with

all current local codes, regulations, and installation guidelines.

The awarded vendor(s) may be required to do some work after normal business hours

(8am-5pm, unless otherwise specified by the Purchasing Entity); however, it is

anticipated that most work will be completed during normal business hours.

Vendor staff is responsible for performing a standard site walk-through and providing

competent personnel to perform the specific scope(s) required. Due to the nature of these

scopes of work and the liability involved, each Purchasing Entity will have the final

determination of competency in all matters regarding personnel provided by the vendor.

Once the awarded vendor(s) has possession of the equipment to be installed, the

responsibility for all equipment, including storage during installation work, shall be at

the awarded vendor’s expense when storage space is unavailable at the jobsite.

E. PENALTY FOR IMPROPER PRICING

It is the vendor’s responsibility to ensure that all prices proposed for all projects are

accurate and consistent with the terms of the contract.

For all projects completed under this contract: if a vendor submits an invoice containing

incorrect pricing in favor of the vendor, that vendor shall submit a new, corrected invoice

with a 25% reduction in cost for each incorrectly priced item.

If vendor continues to provide incorrect invoicing each Purchasing Entity has the option

to cancel their contract in its entirety without penalty.

Vendors are not allowed to aggregate fees into contract after award has been made.

Failure to comply may be grounds for cancellation.

F. STANDARD OF PERFORMANCE AND ACCEPTANCE

The Standard of Performance applies to all product(s) purchased under this Master

Agreement, including any additional, replacement, or substitute product(s), as well as

any product(s) which are modified by or with the written approval of the vendor and

acceptance by the Purchasing Entity.

The Acceptance Testing period shall be seven (7) calendar days, or any other time period

identified in the solicitation or the Participating Addendum, beginning with the day after

the product is installed certification is received that the product is ready for Acceptance

Testing.

If the product does not meet the Standard of Performance during the initial period of

Acceptance Testing, the Purchasing Entity may, at its discretion, continue Acceptance

Testing on a day-to-day basis until the Standard of Performance is met.

Upon rejection, the vendor will have three (3) calendar days to cure any Standard of

Performance issue(s).

If, after the cure period, the product still has not met the Standard of Performance, the

Purchasing Entity may, at its option:

Declare the vendor to be in breach and terminate the order;

Demand a replacement product from the vendor at no additional cost to Participating

Entity; or

Continue the cure period for an additional time period agreed upon by the

No product shall be accepted and no charges shall be paid until the Standard of

Performance is met.

H. SYSTEM COMPLIANCE WARRANTY

Licensor represents and warrants: (a) that each Product shall be Date Compliant; will operate consistently,

predictably and accurately, without interruption or manual intervention, and in accordance with all

requirements of this Agreement, including without limitation the Applicable Specifications and the

Documentation, during each such time period, and the transitions between them, in relation to dates it

encounters or processes; (b) that all date recognition and processing by each Product will include the Four

Digit Year Format and will correctly recognize and process the date of February 29, and any related data,

during Leap Years; and (c) that all date sorting by each Product that includes a "year category" shall be

done based on the Four Digit Year Format.

RFI will comply

I. TERMS AND CONDITIONS FOR GOODS

The information in this section does not need to be returned with the vendor’s proposal. However, if

vendors have any exceptions and/or assumptions to any of the terms and conditions in this section, they

MUST identify in detail their exceptions and/or assumptions on Attachment E, Technical Proposal

Certification of Compliance. In order for any exceptions and/or assumptions to be considered they

MUST be documented in Attachment E. The State will not accept additional exceptions and/or

assumptions if submitted after the proposal submission deadline.

J. EXPRESS WARRANTIES

For the period specified on the face of the Contract, Contractor warrants and represents each of the

following with respect to any goods provided under the Contract, except as otherwise provided on

incorporated attachments:

Fitness for Particular Purpose

The goods shall be fit and sufficient for the particular purpose set forth in the RFP or other

solicitation documents.

Fitness for Ordinary Use

The goods shall be fit for the purpose for which goods of a like nature are ordinarily intended, it

being understood that the purpose for the goods covered by the Contract are ordinarily intended is

general government administration and operations.

Merchantable, Good Quality, No Defects

The goods shall be merchantable, of good quality, and free from defects, whether patent or latent,

in material and workmanship.

Conformity

The goods shall conform to the standards, specifications and descriptions set forth in the

incorporated attachments. If Contractor has supplied a sample to the State, the goods delivered

shall conform in all respects to the sample and if the sample should remain in the State's possession

it shall be identified by the word "sample" and the signature of Contractor's sales representative.

Uniformity

The goods shall be without variation, and shall be of uniform kind, quality, and quantity within

each unit and among all units.

Packaging and Labels

The goods shall be contained, packaged, and labeled so as to satisfy all legal and commercial

requirements applicable to use by a government agency, including without limitation, OSHA

material safety data sheets and shall conform to all statements made on the label.

Full Warranty

The foregoing warranties are "full" warranties within the meaning of the Magnuson-Moss

Warranty - Federal Trade Commission Improvement Act, 15 U.S.C. § 2301 et seq., and

implementing regulations 16 C.F.R. pts. 700-703, if applicable to this transaction.

Infringement Indemnity

Refer to Attachment A ~ NASPO ValuePoint Master Agreement Terms and Conditions, Section

33.

Usage of Trade; Course of Dealings; Implied Warranties

Contractor shall also be bound by any other implied warranty that, at the time of execution of the

Contract, prevails in the trade of government in the marketing area in and about the State of

Nevada. Contractor shall also be bound by any other implied warranty arising through course of

dealings between Contractor and the State from and after the execution of the Contract. Contractor

shall also be bound by all warranties set forth in Nevada's Uniform Commercial Code (NRS Title

8) in effect on the date of execution of the Contract.

Warranties Cumulative

It is understood that warranties created by the Contract, whether express or implied, as well as all

warranties arising by operation of law that affect the rights of the parties under the Contract, are

cumulative and should be construed in a manner consistent with one another.

Priority of Warranties

If it is held by a court of competent jurisdiction that there is an irreconcilable conflict between or

among any of the warranties set forth in the Contract and any warranties implied by law, the parties

agree that the specifications contained in the Contract shall be deemed technical and mere language

Beneficiaries of Warranties

Benefit of any warranty made in the Contract shall be in favor of the State of Nevada and

Participating Entities, any of their political subdivisions or agencies, and any employee or licensee

thereof who uses the goods, and the benefit of any warranty shall apply to both personal injury and

property damage.

Delivery; Inspection; Acceptance; Risk of Loss

Contractor agrees to deliver the goods as indicated in the Contract, and upon acceptance by the

State, title to the goods shall pass to the State unless otherwise stated in the Contract. The State

shall have the right to inspect the goods on arrival and, within a commercially reasonable time, the

State must give notice to Contractor of any claim or damages on account of condition, quality, or

grade of the goods, and the State must specify the basis of the claim in detail. Acceptance of the

goods is not a waiver of UCC revocation of acceptance rights or of any right of action that the

State may have for breach of warranty or any other cause. Unless otherwise stated in the Contract,

risk of loss from any casualty, regardless of the cause, shall be on Contractor until the goods have

been accepted and title has passed to the State. If given any, the State agrees to follow reasonable

instructions regarding return of the goods.

No Arrival; No Sale

The Contract is subject to provisions of no arrival, no sale terms, but proof of shipment is to be

given by Vendor, each shipment to constitute a separate delivery. A variation of ten days in time

of shipment or delivery from that specified herein does not constitute a ground for rejection. The

State may treat any deterioration of the goods as entitling the State to the rights resulting from a

casualty to the identified goods without regard to whether there has been sufficient deterioration

so that the goods no longer conform to the Contract.

Price; Taxes; Payment

The price quoted is for the specified delivery, and, unless otherwise specified in the Contract, is

F.O.B. to the delivery address specified above. Unless otherwise specified in the Contract, the

price does not include applicable federal or State sales, use, excise, processing or any similar taxes,

or duty charges, which shall be paid by the State, or in lieu thereof, the State shall provide Vendor

with a tax exemption certificate acceptable to the applicable taxing authority. Unless otherwise

specified in the Contract, payment shall be made for Orders by State agencies by warrant drawn

on the State of Nevada (in accordance with Nevada law) and mailed to Vendor at the address

specified above (or to assignee if assignment is acknowledged by the State) within the time

specified above.

we will order the parts on the next available business day. RFI does have an 800

number with an on call technician 24/7. We will return a call to the customer by

phone within the 4-hour period. If during normal business hours we will respond

accordingly to any emergency type service.

that is currently in operation and must become an integral part thereof. Vendors must

ensure complete connectivity and integration to each existing system in those

instances where an addition or upgrade is warranted.

1.2.11 Designate a single point of contact who can address the programing needs of alarm

systems in use throughout the Purchasing Entity’s facilitates with a certified tech.

1.2.12 Vendors must possess the ability to provide for individual access codes.

monitoring services are purchased. These also allow for customers to access

equipment from hand held devices for arming and disarming.

Attached under section VI is our monitoring agreement for approval from the state

of Nevada.

1.3 CATEGORY 3 – SURVEILLANCE SERVICES AND EQUIPMENT

This category includes, but, is not limited to the following services:

1.3.1 All aspects of cloud-based and video surveillance systems, services and equipment.

1.3.2 Installation of new systems.

1.3.3 Replacement or upgrade of systems.

1.3.4 Removal of existing systems.

work in conjunction with video cards.

We have installed a single camera to installations of more than 100 cameras. We

have certified technicians with multiple manufacturers to which enable us to

provide the best most reasonable system that fits the needs of the site. In some cases

there are compliance issues that are addressed at the time of proposals.

1.4 CATEGORY 4 - PORTABLE FIRE EXTINGUISHERS

The Portable Fire Extinguisher category includes, but is not limited to the following services:

1.4.1 Providing or replacing portable fire extinguishers;

1.4.1.1 Supply extinguisher.

1.4.1.2 Installation of extinguisher.

1.4.1.3 Removal of any old extinguisher.

1.4.2 Maintaining existing portable fire extinguisher;

1.4.3 Annual tests and inspections;

1.4.4 Periodic internal examination and maintenance as required by state law;

1.4.5 Hydrostatic testing of portable fire extinguishers as required by NFPA 10;

1.4.6 Vendors will provide users with a receipt for all services performed; and

1.4.7 Fire inspection tags will be attached to all inspected fire extinguishers.

1.4.8 Vendors must adhere to the following process for the safety of the staff and/or public

when extinguishers are being replaced.

serviced at the next location with the newly serviced extinguisher, provided

it is of the same size and type, and it may be mounted properly.

including, but not limited to, all smoke detectors, heat detectors, carbon monoxide detectors,

flame detectors, water flow switches, pull stations, remote annunciators, horns, strobes, fuses,

lamps, LED’s, control panels, control equipment, batteries, and wiring or cabling. This category

includes, but is not limited to the following services:

RFI has certified technicians and all of our field technicians are required to hold and maintain “F”

cards to enable them to work on fire system signaling devices. We currently have Nicet II certifications

which allow us to not only design systems but also to stamp them as required by code. We have invested

a lot of training dollars into our staff to reach this point. Since each jurisdiction may have specific

requirements outside of code requirements, we encourage you to reach out to us for discussions about

your equipment and how to develop a regular maintenance program.

1.8 CATEGORY 8: HIGH SECURITY CONTROL SYSTEMS

The High Security Control Systems category includes, but is not limited to the following services:

Replacement or upgrade of systems.

Testing, training,

The DCS category custom-integrates HMI /SCADA operator interfaces with

programmable logic controllers (PLCs), and various communication subsystems to

create a single integrated security system. Custom tailor, program, and configure to

remotely move and secure confined individuals in a specific detention, correctional,

courts holding, mental health, or similar secure facility; generally, from a 24-hour central

control room supported by distributed satellite stations. Representative subsystems may

include, but is not limited to:

Operator interfaces employing PC-based human-machine-interface (HMI) and

supervisory control and data acquisition components (SCADA) software. Configure

as client/server or peer systems. Representative pointing devices include mouse,

touchscreen, or both.

Master-to-master staff intercommunications, typically on a full-duplex, dialup basis.

Door monitoring and control systems. Field device interfaces (relays, fuses, and

terminals) to detention locking systems and door control programming.

Utility monitoring and control systems. Data interfaces or field device interfaces to

lighting control panels and relays, power control relays and breakers, flushing control

systems, water control valves, telephone cutoff relays, fan control relays, generator

monitoring interfaces, transfer switch monitors and transfer relays, and similar utility

monitoring and control systems.

Perimeter alarm systems. Data interfaces or field device interfaces to perimeter

security and intrusion detection systems.

The Fire Extinguishing System category includes inspections of new extinguishing

1.9.2 Fire Sprinkler Systems

RFI may utilize sub-contractors for this work

Awarded vendors will be required to perform the following annual services:

1.9.2.1 Inspect installed equipment, including alarm devices, sprinkler heads, pipes,

insulation, line pressure, unusual wear/corrosion, hose connections, hose

racks, fire department connections, and other equipment in accordance with

all rules and regulations within the Participating Entities;

1.9.2.2 Provide condition analysis report for all equipment inspected, highlighting

any potential repairs needed, including any known rules and/or regulation

RFI has certified technicians on staff for this work

Awarded vendors will be required to perform the following semiannual/annual

inspection services: **

1.9.3.1 Inspect installed equipment, including complete testing of all fire alarm

initiating devices, supervisory devices, and notification appliances;

1.9.3.2 Inspect fuses, lamps, LED’s, control equipment including all wiring,

connections and insulation; and

1.9.2.3 Provide the Participating Entities with a test report within 24 hours of

completion, unless otherwise agreed upon in writing by both parties.

** Some facilities may not accommodate one complete inspection per year of all fire

alarm systems at one time. In this case, vendors will be required to service a portion

of the alarm system each quarter until all systems have been inspected throughout the

course the year.

1.9.4 Alarm Monitoring

Provide a 24 hour, 7 day per week UL listed station for monitoring alarm systems,

including providing backup communication using a radio or cellular service.

RFI will fully comply. The RFI monitoring agreement is attached for approval.

Because there are different requirements, we ask for Nevada state approval of our

monitoring agreement. Agreement is submitted under section VI.

Company background history

4.1 Company Background/History

Company background/history and why vendor is qualified to provide the services described in

this RFP. Limit response to no more than five (5) pages.

RFI Enterprises Inc. dba RFI Communications and Security Systems has been incorporated since

1983 in California. RFI currently has offices in San Jose CA., Sacramento CA., Cerritos CA.,

Seattle WA., and Reno NV.

Reno Nevada is currently the office that will provide services for the State of Nevada. RFI has

been licensed to do business in the State of Nevada since 1984. The RFI Reno office was

established in 1995. Currently our Reno office is fully staffed. Nationally RFI has approximately

265 employees.

RFI has been working on the card access systems, CCTV systems, and alarm systems for the

State of Nevada since 2006 with the award of RFP/contract 1541. We successively were awarded

the RFP/contract 1837 in 2008 and RFP/contract 1938 in 2010, and RFP/contract 3047, which is

still in force at this time.

RFI was founded in 1979 by Larry Reece to address his desire to provide professionally

engineered, fully integrated, and cost effective Communications and Security management

systems to his clients. Our specialty is the integration of large, complex security systems. RFI

has grown to become the West’s premier supplier of integrated access control, ID badge, closed

–circuit television, burglar alarms and fire and life safety systems.

We stress the word integrated because RFI is able to provide our clients with solutions that are

not available “out of the box”. We integrate the best parts of several different systems so as to

give our clients a solution that best fits our customer needs.

RFI can provide Design Engineering, Drafting, Project Management, Field Supervision,

Technical and installation labor. Technical labor for systems that include components such as

PC Advisor – September 25, 2012 -- Good Technology contracted RFI to install new HID Global

ThinLine II proximity readers in its Sunnyvale office. These new readers are compatible with the

low-frequency proximity-based ID badges Good currently uses, as well as the HID Near Field

Communications (NFC) credentials stored on the smartphones given to pilot participants for

physical access to buildings and offices. Good has started a few months ago working with HID

Global as part of what HID is calling the "world's first NFC-enabled smartphone pilots in the

4.2 NASPO ValuePoint Master Agreement Statement of Compliance

NASPO ValuePoint Master Agreement(s) resulting from this RFP will constitute the final

agreement except for negotiated terms and conditions specific to a Participating Entity’s

Participating Addendum.

The Master Agreement will include, but not be limited to, the NASPO ValuePoint Standard Terms

and Conditions in Attachment A and Lead State specific terms and conditions required to execute

a master agreement, the scope of work (Attachment B) and selected portions of the Offeror’s

Proposal.

This section highlights particular terms and conditions of NASPO ValuePoint Master Agreement

Terms and Conditions, although Offerors will be bound to all the terms and conditions when

executing a Master Agreement as shown in Attachment A. Offerors must include a statement in

their Proposal that they have read and understand all of the terms and conditions as shown in the

Master Agreement (Attachment A).

4.2.a Insurance

To be eligible for award, the Offeror agrees to acquire insurance from an insurance carrier or

carriers licensed to conduct business in each Participating Entity’s state at the prescribed levels set

forth in Section 21 of the NASPO ValuePoint Master Agreement Terms and Conditions. Describe

your insurance or plans to obtain insurance satisfying the requirements in Section 21.

RFI will comply.

4.2.b NASPO ValuePoint Administrative Fee and Reporting Requirements

To be eligible for award, the Offeror agrees to pay a NASPO ValuePoint administrative fee as

specified in Section 6 of the NASPO ValuePoint Master Agreement Terms and Conditions.

Moreover, specific summary and detailed usage reporting requirements are prescribed by Section 7

of NASPO ValuePoint Master Agreement Terms and Conditions.

Offerors shall identify the person responsible for providing the mandatory usage reports. This

information must be kept current during the contract period. Contractor will be required to provide

reporting contact within 15 days of Master Agreement execution.

RFI will comply.

4.2.c NASPO ValuePoint eMarket Center

To be eligible for award, the Offeror agrees, by submission of a Proposal, to cooperate with

NASPO ValuePoint and SciQuest (doing business as JAGGAER) (and any authorized agent or

successor entity to JAGGAER) to integrate its presence in the NASPO ValuePoint eMarket Center

development of ordering instructions. Proposer shall respond how they can support the eMarket

Center in the Proposal through either a hosted catalog or punchout solution.

RFI will comply. 4.3 Participating State Terms and Conditions

As a courtesy to Offerors, some Participating State specific Terms and Conditions are provided in

Attachments to this solicitation. These are for informational purposes only and will be negotiated

with other Participating States after award of the Master Agreement. Each State reserves the right

to negotiate additional terms and conditions in its Participating Addendums. Offerors shall submit

a statement that they understand they may be required to negotiate these additional terms and

conditions when executing a Participating Addendum. RFI understands we may be required to

2. SALE & INSTALLATION: We agree to sell and install the alarm system (“System”) described in the Schedule of Protection below and on the Attachment to Alarm System

Sales and Monitoring Agreement (“Attachment”) at the address shown above. We will provide monitoring service and any other service(s) selected above. IF AN INTRUSION ALARM: • Motion detectors, glass break detectors, and photo electric beams are for spot protection only. You are to provide a clear path for protection. • Holdup button (wireless) - You are aware transmitter push button may cease operating without notice and function is affected by battery charge or distance from control unit. You agree that we are neither responsible nor liable and hold us harmless from any consequences associated with this device. • Wireless devices - You are aware that it is your responsibility to maintain and replace transmitter batteries when necessary. We will provide this service for a fee if you so desire.

IF A FIRE SYSTEM: • Smoke/heat detectors - For area detection only. • You understand and agree that any additional devices required by the Fire Department before final acceptance of system will be at your expense at our prevailing rates. • RFI will submit for plan check and file for city permits. You agree to pay all city, permit, plan check, or drawing charges as required. • You are to provide two phone lines and dedicated 120 VAC to the fire alarm control unit and associated power supplies. You are to install breaker locks as required. • You understand and agree that the automatic fire alarm devices and appliances that will be installed or are located on this property are pursuant to the approved shop drawings that were previously submitted by us to the Authority Having Jurisdiction for this property.

IF A VIDEO SURVEILLANCE SYSTEM: • With all video surveillance systems, there are certain rights to privacy enjoyed by employees and the public. As a condition to this installation, it is your responsibility to ensure compliance with all applicable privacy laws. • When using a video recording device, you are solely responsible for providing and maintaining film, storage and/or video tape for CCTV systems. You also agree to provide sufficient lighting in the viewing area. IF A VIDEO SECURE™ SYSTEM: You understand that the system is wireless and portable. To avoid notification errors, it is your responsibility to notify us when you move the system to a new physical address. It is your responsibility to activate and deactivate your system to prevent excessive video transmissions. You understand that this system uses a GSM data network. If your control panel exceeds 15 video transmissions per month, you may incur additional service fees.

IF SOFTWARE IS PROVIDED: • Computer shall be supplied by you to us according to manufacturer’s specifications and shall be free from defect. • You understand that although protected by appropriate safeguards, installing remote access dial-in software carries some risk of access to, and control of the security system by unauthorized persons. It is your responsibility to keep the password, installed software, and network connections under their control at all times. • If networking software is installed; it is your responsibility to provide and maintain a network that can support any installed software by us.

YOU ACKNOWLEDGE THAT: (A) YOU SHOULD OBTAIN INSURANCE FOR THE PROTECTION OF YOURSELF AND OTHERS WHO MAY USE THE SYSTEM AND SERVICES, (B) YOU HAVE READ AND UNDERSTOOD ALL OF THIS AGREEMENT, PARTICULARLY PARAGRAPHS 18 AND 19 WHICH SET FORTH OUR MAXIMUM LIABILITY IN THE EVENT OF ANY LOSS, INJURY OR DAMAGE TO YOU OR ANYONE ELSE; AND (C) YOU HAVE DISCUSSED PARAGRAPH 18 WITH OUR AGENT AND UNDERSTAND THAT YOU MAY OBTAIN A HIGHER LIMITATION OF OUR LIMITED LIABILITY BY PAYING AN ADDITIONAL SERVICES FEE TO US. THIS AGREEMENT SHALL NOT BE BINDING UPON RFI UNTIL EITHER APPROVED BY AUTHORIZED PERSONNEL, OR RFI BEGINS SERVICE/INSTALLATION WITHIN 90 DAYS OF DATE OF AGREEMENT. 5. MONITORING SERVICE: The monitoring of the system will be at the RFI Security, Inc.’s UL Listed monitoring facility or other facility chosen by RFI Security, Inc. To reduce false alarms, we use enhanced call verification (also known as 2-call verification or ECV). When a burglar alarm signal from the alarm system is received, the Center will first try to telephone your premises, and if there is no answer then will try to telephone the first available person on your emergency call list, to verify whether or not an emergency condition requiring police response exists. If there is no answer to both of these calls or the person contacted indicates that an emergency exists, the Center will attempt to notify the police department. The Center will also attempt to contact someone on your Responsible Party List to advise them that the police have been notified. When a fire alarm, hold-up alarm or duress alarm signal is received, the Center will attempt to notify the police or fire department or other emergency personnel and the first available person on your Responsible Party List. When a non-emergency signal is received, the Center will attempt to contact the premises or the first available person on your Responsible Party List but will not notify emergency authorities. The Center may choose not to notify any agency if it has reason to believe that the signal received does not require such notification. Both Parties are obligated to comply with all notification and response requirements imposed by governmental agencies having jurisdiction over the system. We may discontinue or change any particular response service due to governmental or insurance requirements by giving you written notice. If your Police or Fire Department now or in the future requires physical or visual verification of an emergency condition before responding to a request for assistance, you agree to subscribe to such service if provided by us at a commercially reasonable rate, or otherwise comply with such requirements, and we may charge an additional fee for such service. The city or county in which your premise is located may require that you obtain a permit for the use and monitoring of the system. Local authorities may not respond to alarm notifications until all permits or licenses for use of the system have been obtained. You consent to the tape recording of all telephonic communications between you, your premises and the Center. You agree that personnel at the Center and other employees may only be conversant in the English language and may not be able to communicate in other languages.

6. LIMITED WARRANTY – WHAT IS COVERED: For one (1) year after we complete the installation, we will repair or replace any defective part of the system without charge to you. We can use new or used parts of the same quality. WHAT IS NOT COVERED: Repair of the system is our only duty. This warranty does not include batteries or labor associated with the replacement of batteries and other disposable items. We make no other express warranty including any warranty of merchantability of the system or its fitness for any special purchase. We do not warrant that the system or services cannot be defeated or compromised or that it will always operate. This warranty does not cover repairs that are needed because of an accident, Acts of God, your failure to properly use the system, power failures or surges, or if someone other than us attempts to repair or change the system, or any other reason except a defect in the equipment or our installation. To obtain warranty service, see paragraph (4) of this Agreement. WE ARE NOT LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. YOU AGREE THAT THIS IS OUR ONLY WARRANTY AND WE HAVE GIVEN YOU NO OTHER WARRANTY FOR THE SYSTEM.

DISCLAIMER OF LIABILITY; WE DO NOT REPRESENT OR WARRANT THAT THE SYSTEM OR SERVICES WILL PREVENT ANY LOSS OR INJURY DUE TO BURGLARY, HOLD UP, FIRE, OR OTHERWISE, OR THAT THE SYSTEM OR SERVICES WILL IN ALL CASES PROVIDE THE PROTECTION FOR WHICH THEY ARE INTENDED. YOU ACKNOWLEDGE AND AGREE THAT: (A) WE HAVE MADE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, NOR HAS SUBSCRIBER RELIED ON ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED; (B) YOU ASSUME ALL RISK OR LOSS OR DAMAGE TO YOUR PREMISES OR TO THE CONTENTS THEREOF; AND ASSUME ALL RISK OF INJURY (INCLUDING PERSONAL INJURY OR DEATH) TO PERSONS USING OR ON THE PREMISES. WE MAKE NO REPRESENTATION OR WARRANTY AS TO THE PROMPTNESS OF THE CENTER’S RESPONSE, AND WE HAVE NO CONTROL OVER THE RESPONSE TIME OR CAPABILITY OF ANY AGENCY OR PERSON WHO MAY BE NOTIFIED AS A RESULT OF THE SYSTEM OR SERVICES BEING USED.

7. INSTALLATION OF THE SYSTEM: You will permit us (RFI Communications & Security Systems) to install the system during our normal business hours and you will give us uninterrupted access to your premises. You have approved the locations of where the control panel, keypad, audible devices and all protective devices will be installed. We will try to conceal the System’s wiring, but construction problems or obstacles may require that some of the wire be exposed. You have the duty to inform us, prior to starting our work, where we should not (because of concealed obstructions, or hazards such as pipes, wires or asbestos) enter or drill holes. Unless you notify us, we will determine where to drill holes and place equipment. Any alterations to your windows, glass doors and such items (i.e. drilling) may result in voiding your window manufacturer’s warranty. We will take reasonable precautions to avoid concealed obstructions, but we have no means of determining with certainty if they exist. Any costs to repair pipes, wires or other obstructions, and any resulting damage to walls, ceilings, floors, or furnishing shall be your sole expense and responsibility. If asbestos or any other health hazardous material is encountered during installation, we will cease work until you have, at your sole expense, obtained clearance from a licensed asbestos removal contractor that continuation of work will not pose any danger to our personnel. In no case shall we be liable for discovery or exposure of hidden asbestos or other hazardous material. If the system includes an exterior audible bell, horn or siren, it is designed to shut off after sounding for not more than thirty (30) minutes. You will provide 110 volt non-switched electrical outlets for the system’s transformers. We are not responsible if the installation is delayed because of bad weather, labor disputes, unavailability of electrical power or telephone service, Acts of God or other reasons beyond our control. After we complete the installation, you and our representative will inspect it. If something is missing or not properly installed you will tell us within ten (10) days, otherwise the system will have been accepted.

8. CHANGES TO THE SYSTEM: If you or any governmental agency or insurance interest wants us to change the System described on Page one or the Continuation Page, or change it after it is installed, you agree to pay our standard parts and labor charges for such changes. YOU AGREE THAT YOU HAVE CHOSEN THIS SYSTEM AND YOU UNDERSTAND THAT ADDITIONAL OR DIFFERENT PROTECTION IS AVAILABLE FOR A HIGHER PRICE.

9. TITLE OF THE SYSTEM: We may elect not to monitor, activate the system, or provide other services until the sales price is paid in full. We retain title to the System until the total sales price is paid in full. If you fail to make any payment for the purchase of the System or services when due, we may discontinue installation, monitoring and other services. You will also permit us to disconnect and remove the System or any part of it from your home. Removal or disconnection of the System shall not be deemed a waiver of our rights to collect damages. We may terminate this Agreement and pursue any and all legal rights and remedies afforded to us by law to recover all damages to which we are entitled, including the value of the work performed and lost profits. We may also impose a late charge on all payments more than ten (10) days past due in the maximum amount permitted by State Law.

10. INCREASE IN MONITORING RATE: So that we may properly adjust our rates to meet changing monitoring and service costs, and notwithstanding any other terms or conditions set forth herein, after the expiration of one (1) year from the date of completion of installation, we may at any time and from time to time, but not more than once in any twelve (12) month period, increase the monthly service charge by a percentage not to exceed ten percent (10%) per increase, upon giving you notice in writing.

11. CANCELLATION AND TERMINATION:

11.1 You agree that if this agreement is terminated by you for any reason, or if we terminate this agreement for (a) non-payment, or (b) any failure or refusal by you to properly test and/or maintain the system, or (c) your abuse of the system, our services or personnel, or (d) any other default by you, before the end of the term of this agreement, then you agree to pay all amounts due for services performed and an amount equal to our loss of profits for the remaining balance of the current term. If you breach any provision of this agreement upon written notice to your address, we may immediately interrupt and/or terminate service without liability. At our discretion, we may restore such interrupted or terminated service, following correction of violation and/or any payment issues.

11.2 We assume no liability for interruption of monitoring service due to strikes, riots, floods, storms, earthquakes, fires, power failures, your acts, interruption or unavailability of telephone service, acts of God, war, or for any other cause beyond our control, and we will not be required to supply alternate monitoring services/methods during such interruption. This agreement may be suspended or cancelled, at our option, if your premises and/or equipment or the Center are destroyed by fire, other catastrophe, or so substantially damaged that it is impractical to continue service, or in the event we are unable to render service as a result of any action by any governmental authority and/or insurance requirements.

11.3 False/Excessive Unwanted Signals: In the event a fine, penalty, or fee is assessed against us by any governmental or municipal agency as a result of any alarm signal originating from your premises, and no alarm condition exists, you agree to reimburse us for same. In addition, you shall pay us a fee for each false signal. In the event your system transmits an unusually high volume of false/unwanted signals, you authorize us to enter your premises for the sole purpose of removing the reporting feature programmed in the system. We reserve the right to charge additional fees associated with excessive unwanted signals.

12. YOUR DUTIES: You shall carefully and properly test the system periodically, but not less than monthly, during the term of this agreement. Some systems may require daily or weekly testing. If the system includes fire protection, you agree to perform or permit us to perform all necessary inspections, tests and service, and if performed by us, you agree to pay for all such inspections, tests and service at our then prevailing rates. If any defect in operation of the system develops, or in the event of a power failure or other interruption at your premises, you shall notify us immediately. You shall notify us in writing of any changes, revisions or modifications to the Responsible Party List or written instructions provided to us for signal handling. At your expense you shall obtain all necessary permits and licenses that may be required by any governmental agency for the use and operation of the system. When any device is used, including but not limited to space detection which is affected by the turbulence of air, occupied air space change or other disturbing conditions, you shall turn off and remove all things, animate or inanimate, including but not limited to all forced air heaters, air conditioners, animals and other sources of air turbulence or movement which may interfere with the effectiveness of the system during the closed period. You agree that we may disclose any information on the Responsible Party List to any agency having jurisdiction over the use and operation of the system. IF THE SYSTEM INCLUDES ANY WIRELESS DEVICES, YOU WILL REPLACE THE BATTERIES AS NEEDED. FAILURE TO DO SO MAY RESULT IN FAILURE OF THE SYSTEM.

13. TRANSFER OF OWNERSHIP: You cannot sell, assign or transfer this agreement without our written consent, and any and all permitted assignments shall include a requirement that any assignee will agree to abide by the terms and conditions herein. In the event a change in ownership is pending, you shall inform us in writing fourteen (14) days prior to such change becoming effective. All changes shall be provided via Certified Mail.

14. DEFAULT: If you fail to pay any amount due, file petition in bankruptcy, receivership or insolvency; if you make any assignment for the benefit of creditors, or fail to perform any other provisions hereof; we shall have the right and may exercise any or all of the following remedies: (a) recover all the past due amounts from you and continue to monitor the system, in which case we shall be entitled to recover the monthly amount due under the contract for said services; or (b) discontinue service upon five (5) days written notice and recover all sums we may be entitled to under the law. In addition, a late payment fee of 1.5% (or the maximum interest rate permitted by law whichever is less) per month may be applied to your account if periodic invoices are not paid by the due date. The late payment fee is for costs associated with the late payment and shall not be deemed an interest payment. You agree to pay a fee of $25.00 for any check EFT or ACH transaction returned unpaid by a financial institution for any reason. A minimum-handling fee of $5.00 may be assessed to cover costs for rebilling and mailing statements. We may request payment by money order, cashier’s check, or similar form of secure payment at our discretion at any time. If we retain the services of a collection agency or an attorney to assist in remedying your breach of this agreement including but not limited to nonpayment of charges herein, you shall be liable for and agree to pay all expenses associated to collections, including attorney fees.

15. ASSIGNEES AND SUBCONTRACTORS: We shall have the right to assign this agreement to any other person, firm or corporation without notice to you and shall have the further right to subcontract any services, which we may perform. Upon our assignment of this agreement, our obligations shall terminate. You acknowledge that this agreement, and particularly those paragraphs relating to our limited liability and third party indemnification, inure to the benefit of and are applicable to any assignees, and/or subcontractors and the work they perform, and that they bind you with respect to said assignees, and/or subcontractors with the same force and effect as they bind you to us.

16. TRANSMISSION FACILITIES: The system includes a communicator that send signals to the Center over your regular telephone service, Internet service, dedicated cellular service or long range radio. For a regular telephone service connection, you will pay for all telephone charges including any installation fee for a special jack to connect the alarm system to your telephone service, and we recommend the use of an RJ31X or equivalent telephone jack to give the system priority over the other telephones in your premises; however, when the system is activated, you will be unable to use your telephone to make other calls (such as calls to 911 emergency operator), and therefore, you may wish to have the system connected to a second telephone line. If your telephone is out of order, placed on vacation status or otherwise not working, signals cannot be transmitted to the Center and we will not know of the telephone service problem. You further acknowledge that the telephone utility may stop providing standard landline telephone service, which may require that you subscribe to an alternative transmission facility, which may result in an increased services fee. You acknowledge that the use of cellular, Internet or radio systems may be controlled by local state agencies and the Federal Communications Commission and changes in rules, regulations and policies may necessitate our discontinuing such transmission facilities at our option, in which event we will substitute another service. Internet, cellular or radio transmissions may be impaired by atmospheric conditions, including electrical storms, power failures or other conditions and events beyond our control, and we make no representations or warranties as to how fast a signal will be received at the Center, because signal transmission speed may be adversely affected by Internet traffic or other causes beyond our control. For Internet service you are required to maintain a high-speed always-on Internet connection. You may be required to execute an additional agreement for Internet, cellular or radio transmission service. You acknowledge and agree that all software, firmware, computer codes and transmission facilities are our sole and exclusive property and are not part of the system. You further acknowledge that signals are transmitted over communications facilities provided by independent carriers or providers, which are wholly beyond our control and is maintained and serviced, solely by the applicable carrier or provider. You agree to reimburse us for any costs we may incur to reprogram the communicator because of area code changes or other dialing pattern changes. If telephone service is used, the use of DSL or other broadband telephone service may prevent the system from transmitting alarm signals to the monitoring facility and/or interfere with the telephone line-seizure feature of the system. Such services should be installed on a telephone number that is not used for alarm signal transmission. You agree to notify us if you have installed or intend to install DSL or other broadband service. IMMEDIATELY AFTER THE INSTALLATION OF DSL OR OTHER BROADBAND SERVICE YOU MUST TEST THE SYSTEM’S SIGNAL TRANSMISSION WITH THE CENTER.

17. REPAIR SERVICE. Except as limited below, we shall provide repair service for the System including all parts and labor. All repairs shall be performed during normal business hours, which are 9:00 am to 5:00 pm, Monday through Friday, except holidays we observe, and will be performed as soon as reasonably possible after receipt of notice from you. Emergency service is available at other times at our prevailing service rates. You agree to pay for all parts and labor necessary to repair the System as a result of damage to the System caused by accident, your misuse or modification of the System, acts of God, or attempted repair service performed by anyone other than Company or our designee. Charges for repairs will be based on our existing labor and material rates and will be portal to portal with a minimum one (1) hour visit charge and will be due and payable upon completion of the work. If you fail to pay for such charges upon completion of the work, we may terminate this Agreement. For fire alarm or sprinkler supervisory systems we will provide inspection and testing service as set forth on the equipment description. Inspections and tests will be performed only during our normal business hours described above. We have no obligation to repair equipment to which the System is attached (e.g., a sprinkler system or access control system.)

18. RFI IS NOT AN INSURER; LIMITATION OF LIABILITY: You understand that: (a) we are not an insurer of your premise, property or the personal safety of persons on your premise; (b) you are solely responsible for providing any life, health or disability insurance for yourself and persons who use the System, and insurance on your premise and its contents; (c) the amount you pay to us is based only on the value of the service we provide and not on the value of your premise or its contents; (d) alarm systems and monitoring service may not always operate properly for various reasons; (e) it is difficult to determine in advance the value of the property that might be lost, stolen or destroyed if the System or our service fails to operate properly; (f) it is difficult to determine in advance how fast the police or fire department or others would respond to an alarm signal; (g) it is difficult to determine in advance what portion, if any, of any property loss, personal injury or death would be proximately caused by our failure to perform, our negligence, or a failure of the System or service; and (h) we are not an insurer of the safety and privacy of your information stored on our computer systems, and our computer systems are subject to risks related to cyberattacks and cybercrime, as a result of which information and video footage about you and your premises may be intercepted and used by third parties in a way that would compromise, your safety and privacy, the safety of your premises, and the privacy and safety of third parties on your premises. THEREFORE YOU AGREE that even if a court decides that our breach of this Agreement, or a failure of the System, or our negligence, or a failure of the installation or design of the System, or a failure of monitoring or repair service caused or allowed any harm or damage (whether property damage, personal injury or death) to you or anyone in your premise, you agree that our liability shall be limited to the lesser of $500.00 or six times the monthly Services Fee, as liquidated damages and not as a penalty, and this shall be your only remedy regardless of what legal theory (including without limitation, negligence, breach of contract, breach of warranty or product liability) is used to determine that we were liable for the injury or loss. YOU MAY OBTAIN A HIGHER LIMITATION OF LIABILITY. If you wish, you may obtain from us a higher limitation of liability in lieu of the liquidated damages for an additional periodic charge. If you elect this option, we will attach a rider to this Agreement, which will set forth the amount of the higher limitation of liability and the amount of the additional charge. Agreeing to the limitation of liability does not mean that we are an insurer.

19. THIRD PARTY INDEMNIFICATION AND SUBROGATION: If anyone other than you, asks us to pay for any harm or damages (including property damage, personal injury or death) connected with or resulting from (a) our breach of this agreement, (b) a failure of the installation, design of the system, the system or services, (c) our negligence, (d) any other improper or careless activity of ours in providing the system or services, or (e) a claim for indemnification or contribution, you will pay us (a) any amount which a court orders us to pay or which we reasonably agree to pay, and (b) the amount of our reasonable attorney’s fees and any other losses or costs that we may pay in connection with the harm or damages. Your obligation to pay us for such harm or damages shall not apply if the harm or damages happen while one of our employees or subcontractors is in or about your premises, and that employee or subcontractor solely causes such harm or damages. Unless prohibited by your property insurance policy, you agree to release us from any claims of any parties suing through your authority or in your name, such as your insurance company, and you agree to defend us against any such claim. You will notify your insurance company of this release.

20. TAXES, FEES AND LICENSES: You shall obtain at your sole expense all necessary permits and licenses that may be required by any agency for the use and operation of the system. In addition, you further understand and agree that all charges listed in this Agreement are based upon existing federal, state and local taxes and utility charges, including telephone company line charges, cable or internet provider charges, if any. We shall have the right, at any time, to increase the fees to reflect any additional fees and/or charges which may be imposed on us in the future by any utility, governmental agency relating to the service(s) provided hereunder and you agree to pay the same.

21. ENTIRE INTEGRATED AGREEMENT; ELECTRONIC DOCUMENTS: It is understood and agreed by and between the parties hereto that this writing is a final expression of their agreement and as a complete and exclusive statement of the terms thereof. This agreement supersedes all prior representations, understandings or agreements of the parties, verbal or written. This agreement can only be modified by a written addendum signed by both parties. No waiver of any term or condition of this agreement shall be construed to be a waiver of any succeeding term or condition. In the event any of the terms or provisions of this agreement shall be declared to be invalid or inoperative, all of the remaining terms and provisions shall remain in full force and effect. It is understood and agreed by and between the parties hereto, that if there is any conflict between this agreement and your purchase order or any other document, this agreement will govern, whether such purchase order or other document is prior or subsequent to this agreement. You agree that we may save and store all contracts and other documents executed by you in an electronic media and all such contracts and other documents shall be deemed to be, and may be used by us as originals and shall be given the same force and effect as the paper-form originals.

22. LIMITATIONS ON ACTIONS; VENUE; REFERENCE: The parties hereby agree that no suit or action that relates in any way to this agreement whether based upon contract, negligence or otherwise, shall be brought against the other more than one (1) year after the accrual of the cause of action. Any such action shall be brought in Santa Clara County, California. Both parties agree that no law suit or any other legal proceeding connected with this agreement shall be brought or filed more than one (1) year after the incident giving rise to the claim occurred. In addition, both parties waive any right to a jury trial in any matter related to this agreement.

23. PRIVACY AND LEGAL COMPLIANCE: You understand and agree that in conjunction with employee training, quality control and the provision of services, we may monitor and/or electronically record video and audio related to monitored activity at your location, as well as conversations with you, your employees and agents, emergency services providers, and law enforcement personnel. Further, you understand that privacy cannot be guaranteed on telephone, cable and computer systems, and we shall not be liable to you for any claims, loss, damages or costs which may result from a lack of privacy experienced. You consent to our (i) using information about you and your location (collectively, "information") to administer services, offer new products or services, enforce the terms of this agreement, prevent fraud and respond to regulatory and legal requirements, (ii) provide information, including information contained in your emergency information to law enforcement or fire service personnel for the purpose of providing services hereunder or in response to a subpoena or other such legal process, and (iii) using and sharing aggregate information and statistics that do not include information that identifies you personally. You agree that we may contact you by telephone, facsimile, email or other Internet facilities, with respect to the system and services provided under this agreement, and new offerings of systems or services we may make available.

23.1 If you subscribe to RFI’s video surveillance service, [including its two-way audio functionality], you understand and agree that you will not use the System to record or monitor sounds or images or to view images in locations where there might otherwise be a reasonable expectation of privacy, and that you will not view, capture, store, or provide access to a sound or to an image in a manner that violates the personal privacy of another individual or any applicable state or federal law or regulation. You are responsible for any pictures and videos you have stored on your server or transmitted to third parties from the System provided with your video solution. You expressly agree that you are subject to and will comply with all applicable laws and regulations related to your use of the services and the System, including privacy laws. If you are a joint account holder with another individual, each account holder is jointly and severally liable with all other account holders for any violations of this Agreement. You are solely responsible, and we shall have no liability whatsoever, for any and all pictures, sounds, audio, video, or other data that you, or anyone you should reasonably expect to use the System at the premises, upload, download, monitor, record, store, post, email, transmit, disclose, or otherwise make available by using the System or the services. You agree to indemnify and hold harmless RFI, its employees and agents and their respective successors and assigns against any loss, liability, claim, damage and expense arising out from your use of the System and services or the pictures, sounds, audio, video, or other data made available to you.

24. RFI’S LICENSES: ALARM COMPANY OPERATORS ARE LICENSED AND REGULATED BY THE BUREAU OF SECURITY AND INVESTIGATIVE SERVICES, DEPARTMENT OF CONSUMER AFFAIRS, SACRAMENTO, CALIFORNIA 95814. CONTRACTORS ARE REQUIRED BY LAW TO BE LICENSED AND REGULATED BY THE CONTRACTORS’ STATE LICENSE BOARD WHICH HAS JURISDICTION TO INVESTIGATE COMPLAINTS AGAINST CONTRACTORS IF A COMPLAINT REGARDING A PATENT ACT OR OMISSION IS FILED WITHIN FOUR YEARS OF THE DATE OF THE ALLEGED VIOLATION. A COMPLAINT REGARDING A PATENT ACT OR OMISSION PERTAINING TO STRUCTURAL DEFECTS MUST BE FILED WITHIN 10 YEARS OF THE DATE OF THE ALLEGED VIOLATION. ANY QUESTIONS CONCERNING A CONTRACTOR MAY BE REFERRED TO THE REGISTRAR, CONTRACTORS’ STATE LICENSE BOARD, P. O. BOX 26000, SACRAMENTO, CALIFORNIA 95826.
