Qualifying criteria.

A. Party should have done such works during last th ree (03) years satisfactorily at Wanakbori

TPS or other Thermal Power stations of GSECL, NTPC or other Electricity Board in the later

case. Documentary proof of having executed such ord ers will have to be produced along with

Technical bid. However, submission of such document ary proof by party will not automatically

qualify the party as to its capability to execute s uch orders and the Corporation shall assess

the capability of the party at the time of evaluati on of the Technical bid.

B. It is necessary for contractor to produce the la test solvency certificate from nationalized bank

of 20% value of estimated cost.

C. It is necessary for contractor to possess separa te P.F. Code No. in their name (under

Employee provident fund organization, Regional offi ce, Ahmedabad directive) obtained from

the concerned authorities of their respective juris dictions. Up-dated copy for the same shall

have to be submitted. In the event of non-possessio n of the separate PF code number, No

tender will be considered.

D. Contractor shall have to submit up date workman Group insurance policy covering all the

labour who are going to work at WTPS site.

E. Contractor shall have to submit up date valid la bour license from the Asstt. Labour

Commissioner, Nadiad.

F. Contractor should possesses own service tax numb er. Document for the same shall have to be

submitted.

G. Contractor shall have to submit copy of PAN card .

H. Contractor shall have to submit list of tools & tackles and men power.

I. For fulfillment of all the Labour laws, liabilit ies before starting of the contract work, contracto r

should give the assurance/indemnity bond on non jud icial stamp paper of Rs. 100/- to GSECL,

WTPS or as per the tender amount.

Name of work: On-Line Safety Valve Pressure Setting of 210 MW boi ler Unit # 4, 5 & 6 at Wanakbori TPS .

SCOPE OF WORK: 01 Party shall have to mobilize the site within 24 hours after intimation (verbal/on paper) from GSECL. 02 The scope of work envisages online pressure setting of M/s BHEL make spring loaded safety

valves i.e. 1740 WD & 1750 WB on super heater and boiler drum respectively in boilers Unit No.4,5 &6 of 210 MW by agency.

03 Job will be required mostly during units overhauling or any breakdown of the units. 04 The agency will report to the site along with necessary/specialized tools and tackles, required for on

line pressure setting of safety valves including necessary monitoring equipment like pr.gauge etc. 05 Minimum two personnel having experience in online pressure setting by trevitest will be required.

The personnel should be capable enough to Suggest for sorting out of any problem of safety valves during its setting.

06 The representative of the agency shall report to EIC for taking necessary actions and work would be

executed according to his direction only. 07 Required pressure setting for safety valves and their technical details is to be provided at site before

on line testing and setting purpose. 08 Necessary protocol and other observations and suggestions shall be explicitly handed to the

Engineer-in-charge or his authorized representative by service personnel (Test report & graphically charts)

09 Any maintenance of the safety valve floating kit during execution of the job is to be maintained by

the party. 10 To test the valves online to our satisfaction in the shortest time possible. Max.30 minutes per valve

which will not include the material handling and mobilization. 11 The material /tools & tackles which are not mentioned in order but, required for safe and efficient on

line safety setting is to be arranged by the party without any additional cost. 12 Party shall have to submit test report with the graphical chart for the work carried out. 13 Minimum 04 valves per visit will be offered by GSECL for on line setting.

14 Conveyance is to be arranged by Party. 15 The working hour for pressure setting might be odd hours in day or Night depending upon status of

unit start up. All days including Sunday and Holidays shall be treated as working day.

16 Bill shall be made to the agency after completion of job against submission of invoice indicating actual quantities of safety Valves setting done and on certificate of EIC.

17 The period of contract shall be One Year from the date of issue of work order. Exact date shall be

intimated well in Advance by the EIC. Time limit for completion of work is One day. 18 All the safety valve location is at an EL.56 mtr. in all boilers. 19 All the safety rules & regulation are to be followed strictly by the party during executing the work at

site. 20 GSECL will not be responsible for any accident/injury occurred to the party’s employees their

deputed staff. 21 Necessary agreements are to be executed by the party as per GSECL rules and regulations. 22 If your work is not found satisfactory and not as per the terms of contract.GSECL reserve our right to

cancel the contract at your risk & cost. 23 GSECL reserves the right to forfeit the security deposit in case of any breach of contract. 24 The rates given in schedule-B will be firm till completion of work in all units. Any type of price

escalation will not be allowed against this contract. 25 In case of any delay in the work of safety valve setting due to any reason accountable to party, the

recovery may be imposed against party as deemed fit or as per decision of C.A. SCOPE OF GSECL: 01 GSECL will provide one gang for assisting the testing of valve at the work site.. 02 GSECL will provide lift for ease of transportation, if available 03 Accommodation will be arranged by GSECL in the guest house on chargeable basis depending

upon availability. 04 GSECL will provide free air, water and electricity at the work site for carrying out job. 05 GSECL will provide scaffolding if required. 06 GSECL will provide workshop facility, if available.

ANNEXURE ‘A’

At any time it is found that work force of the party is inadequate and progress of the work is not be to the satisfaction of GSECL, other agencies/departmental personnel will be put to carry out work. Amount so incurred will be recovered from the party’s bill. In this case the decision of the Engineer in charge of WTPS shall be final and binding on the contractor/party. The time is the essence of the contract and the party shall have to ensure that work is completed within stipulated period, in the contract, keeping personnel round the clock otherwise penalty will be charged at the rate of ½% per day subject to maximum of 10% of the contract value as per the Corporation’s rules. Party shall indemnity GSECL against for any injury and/or damages that may be caused in his man or material. Moreover the party shall be fully responsible for any damaged caused to the Corporation’s properties done by his men/materials, while executing the work. The CORPORATION will be entitled to recover the damages from the party’s bill. Party should take all necessary precautions during execution of the work and all labours of the party should utilize all types of safety applications during work in plant area to prevent the accident as per factory acts/rules. The electrical connection and electricity to the party’s welding generator sets and other equipments such as grinding sets etc. shall be given by the GSECL free of cost at one point only near to working place, as directed by EIC. This is a rate contract for a period of 12 months. The CORPORATION reserves the right to extend this annual contract for further six months period, as d eemed suitable, considering the balance quantities yet to complete, and it will be binding to the party. The rates and other terms and conditions will remain sa me as per original order for the extended period . The tender shall be submitted along with EMD without which no tender will be considered. The conditional tender will not be accepted withdrawal of condition unilaterally after opening of tender will not be permitted. Chief Engr., WTPS reserves right either to accept or reject under all tender without assigning any reasons. The labour laws in existence and which may modify from time to time shall be binding to the party. The party will have to execute an indemnity bond on non judicial stamp paper of appropriate value. The cost of the stamp shall be borne by the party. The CORPORATION reserves the right to split each item in to more than one agency and place the order accordingly. All parties should therefore, carefully evaluate and fill up the rate item wise keeping themselves ready to execute order for any one or more allotted to them by the CORPORATION. The CORPORATION reserves the right to terminate the contract at any time during is tendency by giving seven days notice to the party without entertaining of claim/compensation. The contractor shall have to arrange to remove the day to day scrap materials from site and deposit to GSECL main stores/BMD.II site stores as per the instruction of Engineer in charge. The site must have to be kept cleared before starting/commissioning of equipments/unit otherwise 5% of the contractor order value of the amount or expenditure actually incurred will be recovered from the party’s bill without assigning any reason in the event of non removal of scrap. Rates are quoted to be firm and hence no price and labour escalation will be applicable. All consumables like cotton waste, kerosene/diesel/rustonlene, welding electrodes, Oxy-acetylene gas shall be arranged by the party at his own cost.

The quantity of welding electrodes to be used MS general purpose only confirming to AWS-6013 series. The spares, pertaining to equipment components, packing ropes, MS plates / Angle / Beam / Channel / pipe of required size, gasket etc. will be issued free of cost from GSECL store as per requirement of the work. Over all time period for this contract would be 12 months counted from the date of commencement of the work and can be same rates and terms. Contractor shall have to prepare the material account and shall have to submit the same in triplicate along with the bill. The RA bills may be raised by the party on completion of works per unit quantity wise. The party has to arrange for 24 V transformer/battery torches to be utilized as safety equipment while carrying out work inside of equipments/at higher elevation. The party has to provide required capacity of welding machine.

TERMS AND CONDITIONS: 1. The time is the essence of the contract and the party will have to ensure that the work has to be

completed within stipulated period for the above wo rk keeping manpower round the clock and if required necessary the additional resources are to be mobilized, so that the work can be completed as per schedule time period during A.O.H/C.O.H & short shutdown of boiler.

2. Overall time limit for works contract is 12 mont hs, however, the quoted rates shall remain firm and no

escalation shall be given if the work extended beyo nd 12 months due to any reason or for balance quantity for any balance quantity of order when fro nts are plan to release after overhauling works, th e allotted works have to be completed within time lim it on each occasion of any unit.

3. The time limit for completion of one boiler job is maximum 08 Hrs. during 15 days A.O.H. and 25 day s

C.O.H, therefore contractor shall have to arrange t he gangs to work round the clock so as to complete it within time limit, failing which penalty may be levied at the rate of ½% per day subject to maximum of the 10% of the contract value as per GSECL’s rul es. Party shall have to work in COH, AOH & short S/D as per requirement of work in stipulated time p eriod of short shut down.

4. Mobilization period One day time shall be allowe d from date of telephonic talk/e-mail/telegraphic f ax.

Order or letter for mobilization of contractor’s ma n, tools, tackles etc. commencement date for starti ng the works will be reckoned accordingly from the dat e contractor is permitted to start the works, mobilization for site, material collection period s hall be excluded from working period.

5. The contractors have to keep authorized represen tative always available at site, to receive instruc tion

from GSECL EIC to execute the works. 6. Sub-letting the contract to other agency is not permitted unless and otherwise, the competent

authority approves it. 7. Party has to fill up the rates on total value of the tender with above/less percentage and no condi tion

should be attached with the tender. 8. GSECL reserves right to split up in to more than one agency, if deemed fit to have availability of

resources to complete the work in stipulated period .

9. The GSECL reserves the right to terminate the co ntract at any time without giving notice or any reasons thereof.

10. The scope of works shall include carting of mat erials from GSECL main stores and or BMD II stores as

the case may be and as directed by GSECL EIC for wh ich no extra payment shall be made. 11. All balance left out and scrap materials shall be credited to GSECL stores as directed by GSECL EI C,

for which no extra payment shall be made. 12. The contractor shall be required to produce Cha llan/invoice copy for all consumable items, tools

tackles etc. dully entered and signed by Security o fficer at concern maintenance section. 13. All necessary safety appliances such as safety shoes, helmets, welder’s apron, hand gloves, goggle s,

safety belts etc. shall be made available to the st aff as and when required, by the contractor. All sa fety measures have shown elsewhere in this contract as w ell as factory rules shall have to be observed strictly by the contractor.

14. Working schedule is to be arranged in co-ordina tion with other working agencies to avoid any accid ent

as well as for safety to personnel on job and resou rces is to be engaged for round the clock. 15. Payment shall be made as per actual works done only and availability of funds with GSECL. 16. Party has to execute the work as per instructio n of GSECL EIC and technical specifications of the

contract.

17. Rates are to be quoted firm and hence no price escalation and labour escalation will be applicable . 18. Contractors have to fulfill all the statutory r equirements as per existing/modify labour laws in

consultation with IRO/LWO with all legal aspects. 19. The electrical connection and electricity to th e party’s welding generator sets and other equipmen ts

shall be given by GSECL free of cost at one point o nly near working place as directed by GSECL, EIC. 20. The contractor shall have to arrange, to remove the day-to-day scrap materials from site and depos it to

GSECL main stores or BMD.II stores as per instructi on of GSECL EIC. The site must have to be kept cleared before starting/commissioning of equipments , otherwise 5% of the contract value of the amount or expenditure actually incurred from the pa rty’s bill without giving any reasons on the event of non removal of scrap materials.

21. In case of any dispute, the decision of the Chi ef Engineer, WTPS shall be final and binding to the

contractor. 22. The party shall have to pay security deposit 5% contract value immediately in case, order is award ed

to you. The party shall also have to enter in to a greement on stamp paper as per GSECL’s rules. 23. The payment to the workers shall be disbursed i n the presence of Management representatives during

the working hours in the factory premises and the c ontractor shall get the entries certified in the register of wages by the representative of the GSEC L. The contractor shall pay minimum wages per day in time as per wages act.

24. Consumable items like oxygen and acetylene gas cylinder, MS welding rods, welding accessories like

cutting torch, pipe, gas regulator, welding generat or/transformer with cable, main switch ELCB etc. and all safety appliances shall be arranged by the contractor. However any special welding electrodes like S.S. welding electrodes, cut rods will given b y GSECL free of cost.

25. Performance guarantee shall be liable and respo nsible for rectifying defective workmanship or any

effect attributable to faulty workmanship or proced ures followed or adjustments done on the times works covered in the contract period for 15 days fr om the date of recommissioning of the unit or taking full load or units Guarantee shall be coveri ng all aspects noticed during period and shall be attended free of cost immediately, on when shutdown available any failure to do so, then shall be get done by GSECL at risk and cost of the contractor.

26. Party shall have to submit list of personnel th ey proposed to engage for above contract at the tim e of

30. Service tax at the rate prevailing during perio d of execution and if applicable, will be paid on

production of certified copy of Registration number and certified copy of paid challan for payment of service tax from time to time.

GENERAL CONDITION AT CONTRACT.

1. WAGES TO BE PAID & TIME OF PAYMENT ETC. BY THE CONTRACTOR:

A) The contractors shall pay minimum rates fixed under the minimum wages act. The wages of every contract labor employed by him under this con tract shall be paid by him before the expiry of 7 th day of the last day of the month in respect of whi ch the wages are payable (i.e. wages of a month have to the paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representat ive during the working hours in factory premises and the contractor shall get the entries c ertified in the register of wages by the representatives of the company. Any default will re sult in cancellation of contract forthwith or also the contract shall be punishable to the extent of Rs. 100/- fine per each day.

B) The contractor shall be give his telephone number a nd address to the Board so that in case of labor trouble etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contrac tor shall keep himself present through out the work hours.

2. LABORS LAW :

A) Person below the age of 18 years shall not be emplo yed for the work.

B) No female worker shall be employed in the night shi ft between 07-00 PM to 06-00 AM.

C) Contractor shall maintain a valid labor license und er the contractor labor (Regulation and Abolition) Act for the employing necessary manpower to be required by him in the absence of such license the contractor shall be liable to term inated without assign any reasons thereof.

D) The contractor shall at his own expense comply with all labor laws and keep the Board indemnified in respect thereof. Some of the major l iabilities under various labor and industrial laws which the contractor shall comply with are as under :

1. Payment of contributing of way of Employer’s contri bution towards provident fund, family pension scheme, deposit linked insurance scheme, ad ministrative charges etc. at the rates made applicable from time to time by Government of Gujarat/ Government of India or other Statutory Authorities.

2. Payment of deposit in respect of each contract labo r at rate of Rs. 30/- with the office of Commissioner of Labor as per contract labor (Regula tion and Abolition) Act.

3. License as prescribed under the contract labor (Reg ulation and Abolition) Act and rules framed there under depending upon the number of workman em ployed by the contractor License is compulsory it ten or more labors engaged due date.

4. Identity cards as prescribed under the factories ac t. With photo affixed there to the same for identification.

5. Payment of retrenchment compensation, notice pay an d other liabilities as per Industrial Disputes Act. Any payment to the contractor’s emplo yees arising out of any claim or disputes under the industrial Disputes Act. 1947 or any othe r labor laws.

6. Payment of compensation in case of accidental injur y.

7. Provision of crèche if female labor employed is mor e than 30 numbers.

8. Maternity leave as per the provision of the Materni ty Benefit Act.

3. PROVIDENT FUND AND FAMILY PENSION SCHEME.

The contractor shall submit along with his bill (mo nth wise) a statement regarding deductions against employees provident fund and family pension scheme in respect of each concerned employees. Provident fund and family pension scheme is applicable at the rate of 8.33% (or at the rate made applicable by the Government from time to time) of Wages. The contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional Provident Fund comm issioner, Ahmedabad.

4. DEPOSIT LINKED INSURANCE SCHEME :

The contractor shall have to deposit ½% of the wage s in respect of employees who is a member of the provident fund as the contribution to the Depos it linked insurance scheme with Regional Provident Fund Commissioner, Ahmedabad.

5. ADMINISTRATIVE CHARGES :

Administrative charges for maintaining Provident fu nd account shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedaba d at the rates applicable.

6. PAID LEAVE FACILITY :

Paid leave facility at the rate of one day for ever y 29 days worked by the contractor labor shall be provided by the contractor to his workers. He shall maintain leave records/leave cards for individual laborers which shall be duly verified and approved certified by the authorized officer of the Board.

7. WORKMEN’S COMPENSATION FUND AND EMPLOYERS LIABILITY INSURANCE

The contractor shall cover all his employees under workmen’s compensation fund and under the liability Insurance.

8. The contractor shall employ adequate number of e xperienced staff at site for daily supervision and for maintenance of various registers and records re quired under the law and contract no payment for supervision shall be admissible.

9. CONTRACTOR TO INDEMINITY THE BOARD

The contractor shall indemnity and keep indemnified the Board and every member, officer and employees of the G.S.E.C.L. also Engineer in charge and his staff against action proceeding claims, demands, costs and expenses whatsoever arising, out of or in connection with the maters referred in above clauses and elsewhere and against all acti ons claims, demands, cost and expenses which may be made against the G.S.E.C.L. by any workmen / employees of the contractor or any sub contractor and/ or contractor from any liability an y wise any workman employees of the contractor or sub contractor under any laws rules or regulatio n having the force of low including but not limited to claims against the owner workmen compens ation Act 1923. The employees Provident Fund 1952, and or/ the Cont ract labor (Abolition and Regulation) Act. 1970 the G.S.E.C.L. shall not be liable for in respect o f or in consequence of any accident or injury to workman of other person in the employment of the co ntractor or his sub contractor and the contractor shall identify workman in the G.S.E.C.L. against all such damage and compensation and against all claims, demands, proceeding costs charg e and expenses what so ever in respect thereof or in relation there to.

10. WORKMAN’S COMPENSATION & EMPLOYER’S LIABILITY INSURANCE : Insurance shall be affected for all the contracto r’s employees engaged in the performance of this

contractor. If any of the work is subjected, the co ntractor shall require the sub contractor to provid e workman’s compensation and Employers Liability Insu rance for the letter’s employees are covered under this scheme.

11. The Company reserves the right to terminate this ra te contract at any time during contract period

without giving notice of termination of any reasons thereof.

12. The Company will be entitled to deduct directly fro m the bills, to be paid to the contractor any sum o f sums payable by the contractor and which sum/sums t he GSECL is required to pay as a principal employer on account of Contractor default in respec t of all liabilities referred to in above clauses.

13. Nothing in the contract document stated shall anywi se constitutes any workman/ employees of the contractor or any sub contractor as or to be workma n employees of the owner or place obligationary liability in respect of any such workman/ employee upon the GSECL.

14. Office Correspondence will be carried out in Englis h and if at any time to facilitate the contractor, Gujarati Translation may be furnished if deemed fit the English version will be the contract one the same only will held good for legal matter.

15. Contractor will be responsible and liable to pay di fference in wages if any and or observe the revised service conditions that may be awarded by the honor able Industrial Tribunal effective from the dated directed in the award.

16. Rate quoted are firm and hence no price escalation or labor escalation will be applicable towards execution of work.

17. In case of delay in execution of work the penalty a s Cl. No. 3 of Tender and contract for work will be applicable.

18. Party shall have to provide at their own the requir ed personal protective equipments of standard make (ISI approved) to their staff during work exec ution and it will be your responsibility to see tha t the same are by your staff while at work.

GENERAL CONDITIONS OF CONTRACT

SECTION:

1. The contractor shall at their own expense make all necessary provision for housing water supply and sanitary arrangement for their employee as well as for works and shall pay direct to the authorities concerned all rates and taxes.

2. The contractor shall make their own arrangements fo r the necessary approach road, for transport of their materials and be responsible for the Compe nsation on account of damage to crop on Corporations’ property.

3. All the royalty charges octroi other duties will be paid by the contractor and no extra could be claimed on this account.

4. The organization will supply articles at the place and rates mentioned in schedule ‘A’ of Tender form.

In case of the materials issued either through or w ith the recommendation of this organization it will be absolutely necessary for the contractor to maintain a correct and honest record of the daily consumption of the said materials/with inside parti cular reference to the work during the day. The Engineer-in-charge of this department or his au thorized agent shall have the right to inspect and check the stores containing these materials and the account for these materials shall be presented for inspection whenever asked for by them . Every facility shall be afforded by the contractors for all these inspections Engineer-in-c harge will supply the materials in any quantity as deemed fit.

5. Godown of sheds hired or constructed for storage of controlled materials and more/ particularly of cement shall be such as would prevent the materials from getting damages in any way.

6. It will be absolutely incumbent o the contractors t o have on the site of work only such of the materials as have been dully passed by the Engineer -in-charge Materials that have been rejected must on no account be allowed to remain on the side and in spite of written order to do so any such rejected material is on the site beyond a period of 48 hours, notice the Engineer-in-charge shall have the right to remove it at the risk and cost of the contractor and even destroy it.

7. It must be distinctly understood that the condition s of the contract and of claims in respect of extra work will not be allowed, unless the works to which they relate is clearly without the spirit and meaning of the specifications or unless such work a re ordered in writing by the Engineer-in-charge and claimed for in specified manner.

8. On completion of the work, the site shall be cleare d by the contractors within the stipulated period, and ground brought to original state and they shall not be entitled for any extra claim on this account.

9. General specification of the latest edition of the P.W.D. Hand Book volume I & II shall also apply.

10. When cement is obtained through or with the recomme ndation or issued by the Corporation it should be understood that the contractors will have to be very careful regarding the handling of the cement bag so as to preserve their serviceability a nd quality.

11. DAMAGE CAUSES TO WORKS: The work whether fully constructed or not, and al l materials, machinery plant tools, temporary building and other things connected there shall be at the risk and in the sole charge of the contractor until the work s have been delivered, completed to the Engineer- in-charge and certificate from him to that effect o btained until such delivery the contractor shall at

their own cost take all the precautions reasonably necessary to keep all the aforesaid works materials machinery, plant, tools, temporary buildi ng and other things connected with the work, free from any loss or damage and in the event to th e same or any part there of being lost or damage shall from with within possible speed, reinstate an d make good such loss or damage at contractor’s own cost.

12. Supply of controlled articles will be invariably re commended after the actual requirements have

been carefully scrutinized. In the event of any suc h materials remaining in surplus in charge of the contract, on account of some modifications either i n the design or changes in construction or any other reason will be returned to the department.

13. There will be generally no objection on the compone nt parts of the works being given over to

responsible sub contractors but it must be borne in mind that this department would under no circumstances recognize these sub contractors and r esponsibility of executing the work in accordance with the condition of the contract will entirely rest on the main contractors. The main contractors will therefore always have the very res ponsible member preferably a technical hand, present on the works with power to sign all work or der issued on the site of work and to take requisite actions in the interest of very efficient execution of works.

14. With a view to ensure rapid progress on the works p urchaser may store at work sites certain

quantities of the materials such as cement etc. and it will be incumbent on the tender to purchase these materials, at the rates mentioned in schedule ‘A’ of tender form for supply of necessary articles, all necessary help will be tendered but i n must be clearly understood that the purchases does not accepted and responsibility for the delay that may be cause in their supply on account of circumstances beyond the purchaser’s control.

15. The Engineer-in-charge will fix the hours of work a nd no work shall be executed beyond that period

during night time or in absence of the Engineer-in- charge or his authorized agent. The box measures shall be filled only in the presence of th e Engineer-in-charge or his authorized agent.

16. Contractor will be asked to present the sample of m aterials and the approved sampled will be

preserved at the site of work and no change in the approved sample will be allowed without the written permission of the Engineer-in-charge.

17. If any work is not executed according to the specif ications and the directions of the Engineer-in-

charge the same will be rejected or reduced rate wi ll be allowed as deemed fit by the Engineer-in-charge.

18. Contract will have to communicate the name of his a uthorized agent who shall be presentation the

works and shall be authorized to sign the materials requisitions receive instruction given verbally, or on the order book on behalf of the contractor.

19. The materials issued to the contractor as per sched ule ‘A’ of the tender shall not be removed from

the work and all surplus material at the end of the works which is considered serviceable shall be returned to the organization even the unserviceable material shall be removed only with the prior permission to the E.E. in writing.

20. The contractor will have to sign the conditions of the contract and execute the agreement, send the

list of previous works executed solvency certificat es and pay up the security deposits, failing to that the tender will be rejected and earnest money deposit will be forfeited. The value of the stamp paper and stamp duty charges shall be borne by the contactor.

21. The contractor must arrange for all transport of ma terials weighting of material issued at

department stores and all such cost include in the rates of schedule ‘B’ with the loss or above percentage quoted by the contractor for finished wo rk.

22. The competent authorities can delete to any items i n the schedule ‘B’ of the tender order if they fill that the items is not essential to be executed.

23. A schedule of quantities is included in the tender document it shall definitely understood that the Corporation does not accept any responsibility for the correctness or complication of this schedules and this schedule is liable to alteration s by commissions, deduction or additions at the description of the Chief Engineer of as set forth i n conditions of contract specific percentage less or above shall be quoted by the contractor below th e total amount of schedule ‘B’. The tender documents shall be written legibly and free from gr ouser, over written on conversion of figures correction where unavoidable shall be made by cross ing out initialing dating and rewriting both in figures and in words in case of my discrepancy in f igures the price quoted in words shall prevail.

24. This notice to tenders shall form a part of the con tract.

25. The entire work is to be completed within the stipu lated time limit from the date of work order. The contractor will not be eligible for any extra for t he idle period of work or waiting period that may b e required to suit other considerations and no claim for compensation on account of such will be considered. However in case or delay due to circums tances beyond the control contractor either in date of commencement or due to waiting during const ruction extension time may be considered for completion of work.

26. In case contractor is unable to account for full qu antity of materials issued to him from the department stores, recovery will be effected from h im at cost rates or market rates prevailing at the time of issue whichever is higher, plus 15% to cove r Corporation’s departmental supervision charges for all material unaccounted for.

27. Scrap from reinforcement (bars below 1.25 M lengths ) not be accepted back and the contractor will be authorized to remove it from the site after comp letion of works and rendering of accounts with written permission of Engineer in charge not below the rank of Executive Engineer. The corporation will not be responsible for any del ay in supply of controlled materials such as M.S. Reinforcement Bars cement etc. however it will hand over to see that there in no delay of materials. Due consideration will be given in granting extensi on of time for completion of the work if found necessary on account of delay supply of materials. No claim for compensation or for damages for extension in time shall be entertained in this acco unt. All materials inquired by the contractor shall be d rawn from the stores by requisition given in writing by the contractor at least one week before the requirement of work. The recoveries will be affected in running payment for all material issued up to the date of measurements for the particular bill or the quantities used in the works measured at the description of the Executive Engineer in charge of work.

28. The contractor shall keep one full time qualified C ivil engineer at site who shall be fully authorized to receive and comply with such instructions as giv en by the Executive Engineer. The names of such Engineer with his qualification and experience shall be intimated by the contractor. The E.E. shall have the right to demand the removal of any t echnical person. Skilled or unskilled work men who in his opinion are considered to cause bad work manship in the execution of work or to cause indiscipline.

29. Bill shall be submitted by the contractor monthly o n or before the date fixed by the E.E., for all works executed in the previous months.

30. SUPPLY OF WATER AND ELECTRICITY: If possible water for construction purpose only m ay be supplied by the Corporation at one point as decided by the Engineer & recovery for water charges shall be effected at two percent of cost of time as executed in which the water supplied by the Corporation is used as certified by the Engineer in charge Electric supply is required the contractor shall be given Free of cost by GSECL. ( Applicable to CIVIL WORKS only).

31. Should this tender be accepted I/We have agreed to abide by and full fill all the terms and provision of ‘Tender and Contract of works’ as applicable and in default there to forfeit and pay to the Corporation the some of money due.

32. The work will have to be carried out in co ordinati on with other Agencies on the same site on account of this in case the contractor has to stop or delay his works for same time he will not claim anything extra only Corporation may consider to giv e suitable extension in time limit if necessary on such account.

33. Any disputes arising out of the contract if not set tled mutually, than the same shall be settle by Gujarat Public Work Arbitration Tribunal act-1992.

Note: - Following clauses are not applicable to this contract i.e. 2,3,4,6,9,10,12,14,16,27 and 29.

CIRCULAR - I

The following are the major obligations to be fulfi lled by the Contractors as per the Contract Labor ( R&A) Act 1970 and rule mentioned there under:

1. License to be obtained before starting the Work whe re number of contract laborers in ten or more.

2. Payment to contract laborers has to be made in pres ence of IRO/LWO. Wages rates for contract laborers are applicable as per the terms and condit ions of the license. The contractor shall have to pay wages to workers as notified by Government o f Gujarat., from time to time

3. Every contractor shall have to maintain the muster roll and wages register in respect of his contract labor.

4. Every contractor is required to issue employment ca rd, wages slip and attendance card to their laborers.

5. The contractor has to maintain the register No. 13 containing details of contract labors employed by him.

6. Earned leave register/ card as per the Factories Ac t. And Rules. 7. Other registers required under Contract Labor Rules and the Factories Act. And Rules. 8. Every contractor shall have to obtain insurance pol icy in respect of the contract labors engaged

by him to cover them under workmen’s Compensation A ct. 9. To send half yearly return to licensing officer as per Rule 82 (1) as per schedule time. 10. Before starting the work as per the contract awarde d to him, he should make arrangement to

enter into the agreement in the prescribed format o n the stamp paper as applicable. Before fulfilling the above requirement the contractor is instructed not to start the work. The responsibility will be on his head in case he fails .

11. Contractor should posses separate P.F. code on thei r firm, name otherwise their offer may not be considered.

All the contractors are informed to adhere to the r ules and regulations applicable to them, particular ly in respect of the laborers engaged by them, the contra ctor not fulfilling the obligations will not be all owed or continue with work/ not be held qualified to carry out the work at TA-Thasra Dist. - Kheda Power Station.

General Safety Rules / norms To Be Observed By The Contractors. - Safety measures regarding fatal accident in the project

All the contractors working at Thermal Power Statio n for Project Erection testing, commissioning shall strictly observe the following Safety Rules. Concerned Contractors are responsible for informing & observance of these rul es by their supervisors/employees/ labours as well as the supervisors/ employees/ labo urs of agencies/ sub-Contractors engaged, if any, by them for the work contract awarded to th em. Prior to commencement of the work, Contractor shall submit a written assurance on thei r letterhead to the concerned Sectional Head / Engineer-in-charge that they have thoroughly gone through these Rules, have educated their employees / employees of their sub contractor and will strictly observe the said Rules while execution of work under work contract awarded to them. They shall indemnify the Corporation for any loss or damage / accident / inj ury to the Corporation’s property / employee or employee of their own in default due to non - ob serving these rules.

1. Persons to be employed for carrying out the work shall possess required qualification, are

fully trained and conversant for the works to be do ne. All persons should have gate pass. Register consisting the full details i.e. address, phone number nearest relative,.. of all persons to be maintained. During the work execution, one tr ained & competent supervisor shall always remain present at site.

2. The contractor shall take all the required safet y measures prior to commencement of work on

dangerous substances, machineries or area at which cautionary notice is displayed and obtain `Line Clear` or `Work Permit` through the concerned Department / Section.

3. Prior to carrying out welding, gas cutting, furn ace heating or any other hot work job, remove

all the inflammable material lying at or nearby wor ksite or cover it properly by suitable protective covering. Also, special care shall be ta ken before carrying out such job & see that all possible contributing factors to set fire shall be removed / vanished prior to commencement of the work. Advance intimation shall be given to concerned section / Fire Section to commence the work in fire prone areas. T hey should also keep ready all the First Aid & Fire Extinguishers / equipments & fire exting uishing media / material like sand / water buckets or other appropriate equipment at such plac e.

4. While carrying out work in confined space or ins ide vessel, obtain necessary `Confined Space / Vessel Entry Permit` from concerned department pr ior to commencement of the work. For lighting in such areas, only 24-volt (ISI certified & with proper guard) hand lamp shall be used. For taking care of the persons working inside the c onfined space / vessel, a supervisor / person capable to keep continuous watch on person(s ) working inside, assist them incase of emergency or arrange to get immediate outside help, shall remain present at entry point. (Use full body safety belt without failed.) While working inside sewage, trench or at-depth, a person to warn outsiders / entrants / passers etc shall remain available near entry point or the entry point shall be cordoned by a barricade tape with a cautionary notice. After comp letion of the works, all the lids / covers / grills / grits opened, shall be re-fixed / re-place d in the original position as it were prior to commencement of the work and leave the work place i n safe condition in all respect, so as to prevent accident to fellow workers.

5. Do not work on or block (by stacking material, s pare parts, tools-tackles, equipments etc), any passages / walkways / gangways / aisles / staircase s / ladders / lifts or any other approaches / roads leading to plans or its auxiliaries, on which there is traffic movement or possible traffic movement in case of emergency. Such passages are me ant for safe escape in the event of emergency. If it is utmost necessary to carry out w ork in such area with blocking of passage, prior permission of Competent Authority or the Engi neer-In-Charge shall be obtained. To demarcate / declare the area as UNSAFE, cordon it u sing barricading tape & display suitable caution notice or keep a person to restrict / diver t the traffic on this route through other safe passage.

6. Prior to use of power / electrically operated ha nd tools / equipments / machines / gadgets like welding machine, hand grinder, hand drill etc, ensu re for its safe operation & use it only if it is found safe to use. Do not use defective, unsafe or improperly maintained equipments. The electrical power supply required to run such eq uipments shall not be taken directly at their own but shall be obtained through concerned E lectrical Maintenance Departments or their authorized persons or under their observation s / guidance only. The Electrical Section

shall provide temporary electrical connection up to contractor’s Mains Board on which it is compulsory to install mains switch, ELCB & fuses of adequate capacity. All such equipments shall invariably be earthed adequately to prevent e lectrical shock, sparking, short circuit etc. Power cord to be used shall be of adequate capacity , without any joint & shall consist of earth wire also. Hence, it is necessary to use adequate c apacity 3-wire power cord for single & 5-wire power cord for three phase power connections. The plugs, receptacles, pins, holders etc shall be of adequate capacity & safe to use. All electrical & mechanical equipments / tools-tack les viz. welding machine, cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks et c required to be used during work execution shall be of standard make & bear ISI cert ification mark on it. The consumables like welding electrodes, grinding wheels / discs etc whi ch has specific prescribed life span shall not be used in any case if its expiry date is over.

7. It is compulsory to use standard make Personal P rotective Equipments (P.P.Es.) as per the job requirement. Do not work without use of required P. P.Es. Contractor is responsible to provide standard make (ISI approved) Personal Protective Eq uipments / Safety Gadgets suitable to give sufficient protection against hazards involved in their work / job to their staff, as per the job requirement and insist / enforce their staff to put on the same while at works. The ongoing work is liable to be stopped at any tim e if any staff is found working without P.P.Es. Following is the list of various P.P.Es. to be used for various works / worksites.

For protection of leg/feet against falling objects, sharp edged objects, heat, hot metals/objects, electricity etc..

8. Before using lifting machines / tackles (like C. P.Bs., Hook chooks, winch, forklift, mobile crane, EOT crane etc) & its attachments (like D-sha ckles, slings, U-clamps, Eye bolts or any fixtures), it shall be checked and used only if fou nd safe to use. Also, ensure that these are tested, examined & certified in form no 9/10 by Com petent Authority Person as per the Factory act-1948 and its validity not expired. Further, it shall be fixed properly and firmly prior to lifting

the weight. 9. Scaffoldings to be used for working at height sh all be of adequate size & capacity. Obtain the

work permit when working at height. While climbing on such scaffolding or working on any structure at height, use of full body safety belt & Helmet is compulsory. It is also necessary to fasten chinstraps of the helmet.

10.Contractor or their employee shall not interfere in day-today routine plant activities / works except the work assigned to them, shall not loiter in the areas other than their work jurisdiction, as well as shall not temper / operate / touch the machineries/equipments/auxiliaries with which they are not concerned. Also, the contractor shall strictly instruct their staff for not to sit or take rest at/near/below running plants, auxiliaries, systems or any place which is risky, h azardous & prone to accident.

11.The cylinders containing poisonous / toxic or in flammable / explosive gas like Oxygen, Acetylene, LPG, Hydrogen, Ammonia, Chlorine, CO2 et c shall be handled safely taking due care. To handle / shift such cylinders a special tr olley /cage meant for it must be used but in no case it should be rolled.

12.On completion of the work, cotton waste, spilled oil / grease, pieces of welding rod & other waste material shall be removed from work site and the area shall be left safe, neat & clean.

13. In case of any injury / accident while working, it shall immediately be reported to Safety Department through concerned Sectional Head / Engin eer. The prescribed Form No.21 may be obtained from concern section or Safety Officer. For any incident occurred but have no injury to any persons should also informed to safety officer as Near Miss Incident.

14. In all risky job, before start the work contrac tor should obtained General Safety Work Permit through concerned section from safety dept in well advance.

15. For performance evaluation of contractor safety factors of work accident, fire incident & near miss accident will be consider. Steps can be taken to review the job assignment up to cancellation for negligence.

16. In case of noticing smoke or fire during their work execution, they shall make immediate efforts to extinguish / control it and simultaneous ly inform the Fire Brigade on phone. Shift the casualty to nearby hospital after rendering fir st aid in case of accident.

17. Over & above these, contractor shall follow all the safety requirements / rules & regulations / norms and legal provisions laid down in various sta tutes. Particularly the provisions of The Factories Act-1948 & The Gujarat State Factories Ru les-1963 (Amended up to date) shall be followed strictly. The contractor shall also obey t he rules / regulations / instructions of the local Competent Authority for safety requirements.

18. Work permit system for (a) Hot job work (b) Wor king at height to be introduced. 19. One Safety Officer / Safety Supervisor to be de ployed to look after safety measures at the

site. 20. All accidents / incident to be reported immedia tely to C.E. (G) and safety officer. 21. Safety talk to all sub contractors workers to b e delivered by site engineer of contractor

regarding safety measures and awaring hazards assoc iated with work. 22. Safety Posters to be displayed at site of work to create awareness regarding safety to

contractor workers. 23. At site before starting the work precautionary sign Board to be displayed i.e., "Dangerous"

work is going on Do-not enter and area to be cordon ed off with special tap. Contractor assured that from 1.12.2008 the site safety standar d will improve.

24. All safety obstruction and norms to be followed and for communication to be improved amongst the workers and staff and also with safety officers.

25. Flash back arrestor to be fixed in each welding / cutting gas cylinders sets. The above rules shall be scrupulously followed and where required, they may contact the Safety Officer in case of any ambiguity or need s further guidance in this regard.
