TEXAS COMMISSION ON ENVIRONMENTAL QUALITY

A RESOLUTION Consideration of nominations and appointment of members to the Pollution Prevention Advisory Committee. Docket No. 2011-0877-RES

WHEREAS, the Commission has the authority to appoint members to the Pollution Prevention Advisory Committee (PPAC) pursuant to the Solid Waste Disposal Act, Chapter 361, Subchapter B §361.0215 of the Texas Health and Safety Code; and WHEREAS, the commission published a notice in the January 28, 2011 and February 25, 2011 issues of the Texas Register, soliciting nominations to fill expired positions on the Pollution Prevention Advisory Committee; and WHEREAS, the following terms will maintain a balanced representation on the committee of members representing the regulated community and an environmental or public interest group: Four (4) full members:

• Two (2) representatives from an environmental or public interest group (four year terms to expire on August 31, 2015); and

• Two (2) representatives from the regulated community (four year terms to expire on August 31, 2015).

NOW THEREFORE, BE IT RESOLVED BY THE TEXAS COMMISSION ON

Ms. Hunziker-Klaes has a varied background with more than 24 years of demonstrated environmental compliance, hazardous materials emergency response; Superfund remedial design; pollution prevention inventories and solutions; remedial investigation and feasibility studies (RI/FS), hazardous waste characterization and annual waste summaries; EHS training; health and safety, and project management experience. As a senior technical professional, Ms. Hunziker-Klaes is responsible for peer review of technical reports and documents, successful budget and schedule of projects, and client relations. In addition to technical expertise Ms. Hunziker-Klaes provides important community service functions as part of her personal values and PBS&J’s core values. Some career highlights are provided below. Project Manager, Texas Commission on Environmental Quality (TCEQ) Superfund Program, East Texas. As a consultant for the Texas Commission on Environmental Quality (Formerly TNRCC) Superfund contract, Ms. Hunziker-Klaes was the project manager for the clean-up effort of a former battery recycling facility in East Texas. The preferred remedial action was in-situ treatment with an on-site cap. Ms. Hunziker-Klaes administration of supplemental remedial investigation work, followed by preparation of the contract documents, assisted TCEQ with the contractor selection process, managed the construction oversight on behalf of TCEQ, facilitated and maintained all project documentation, including weekly meeting minutes, daily and weekly logs, sampling data, mapping, and project amendments and successfully lead liaison between the TNRCC and the construction contractor. USEPA Region 2, Love Canal Survey The Love Canal NPL site includes the original canal that was excavated by Mr. William T. Love in the 1890's for a proposed hydroelectric power project but was never implemented. From 1942 to 1952, the landfill was used by Hooker Chemicals and Plastics (now Occidental Chemical Corporation (OCC)) for the disposal of over 21,000 tons of various chemical wastes. In the 1960s and 1970s, numerous toxic chemicals had migrated into the surrounding area directly adjacent to the original landfill disposal site around which were homes and schools at that time. In addition, runoff drained into the Niagara River, approximately three miles upstream of the intake tunnels for the Niagara Falls water treatment plant. As a result of the environmental emergency, approximately 950 families were evacuated from a 10-square-block area surrounding the landfill. In 1988, EPA issued the Love Canal EDA Habitability Study (LCHS), a comprehensive sampling study of the EDA to evaluate the risk posed by the Site. Ms. Hunziker-Klaes worked on this phase of the site providing land survey and documentation support as a contractor to the EPA. The final LCHS, NYSDOH issued a decision on habitability.

Environmental Compliance Support, U.S. Environmental Protection Agency (EPA) Region 6, Dallas, Texas. Ms. Hunziker-Klaes provided technical and field support to the Oil Protection Program. As a contract environmental compliance specialist, Ms. Hunziker-Klaes prepared and presented outreach seminars to oil and gas industry stakeholders regarding SPCC plan implementation and the Oil Pollution Act of 1990 (OPA 90) regulations. As a contract field inspector for the EPA Region 6, she conducted Facility Response Plan (FRP) and SPCC inspections, reviewed and produced the associated inspection reports, and enforcement documentation. Environmental Compliance Audits, Oil and Gas Industry, Nationwide. For oil and gas industry clients, Ms. Hunziker-Klaes conducted RCRA and SPCC plan compliance audits in the northeastern United States. This included facility equipment inspections as well as file review. She traveled along the pipeline between compressor stations to complete the audits in a timely manner. Regional Environmental Representative, Telecommunications Company, Texas. As an in-house environmental representative, Ms. Hunziker-Klaes provided environmental support to engineering, construction, operations, and sales personnel located in the west, north, and south pacific United States. Duties included regulatory agency stakeholder presence and voice; environmental compliance facility audits; hazardous materials contingency planning; tank registrations and annual fees; air emissions permitting and annual reporting; annual waste summaries; annual Tier 2 reporting; spill/release reporting and clean up; SPCC plan development, implementation, and training; and new construction permitting. Ms. Hunziker-Klaes was also responsible for emergency response technical assistance for the fiber optic emergency response personnel. The September 11, 2001 terrorist attacks required the entire EH&S team to man the incident command center on a rotational basis for eight consecutive days to ensure that the emergency response team at Ground Zero in Manhattan, NY had constant technical support while working on the communications systems. Ms. Hunziker-Klaes led the quality assurance team for over 350 Phase I ESA reports and 150 Phase II ESAs for two TTA right-of-way projects. Each parcel to be acquired by TXDOT required a Phase I ESA that was prepared by the three environmental consultants. Ms. Hunziker-Klaes reviewed the Phase I and Phase II ESAs for compliance with ASTM E1527-05 and ASTM E1903-97. Concurrence with the environmental consultant’s Environmental Professional (E.P.) was documented through very tight document control processes. Meeting and exceeding the deadlines for reviews was crucial to meet the construction schedules. To meet these deadlines, building and maintaining excellent relationship with the developer’s environmental consultants was vital for the success of the project. New York State Department of Transportation (NYSDOT) As and engineering consultant to NYSDOT, Ms. Hunziker-Klaes designed alternative routes for a major highway arterial and developed the associated cost estimates for the route selection process including conducting quantity take off and scheduling for the highway design and task leader for preparing a draft EIS, including the project schedule, cost estimate, and progress reports to the client. New York State Department of Transportation (NYSDOT) As a consultant to NYSDOT, Ms. Hunziker-Klaes developed a new methodology for the hazardous waste critical features analysis as part of the Environmental Impact Statement (EIS) for the State Highway 219 project. Ms. Hunziker-Klaes surveyed the alternative routes, mapped the observed potential problem locations, and assisted with the scoring of alternatives to provide the recommended route. Ms. Hunziker-Klaes designed presentations and written comprehension exams for compliance with 40 CFR Part 112.7(f). Stormwater Pollution Prevention Plan (SWPPP) and Spill Prevention, Control and Countermeasures Plan (SPCC plan) Training, Industrial Clients, North Texas. Ms. Hunziker-Klaes designed and conducted SPCC plan and SWPPP training for personnel located at various facilities in north Texas. The plan was later used as a guide while the facility and equipment were used for exhibits and discussions. Practical examples of failures and uses of best management practices (BMP) were created and conducted. Stormwater Pollution Prevention Plan (SWPPP), Oil and Gas Clients, North Texas. For a natural gas pipeline distribution client, Ms. Hunziker-Klaes is project manager and stormwater inspection coordinator for compliance with the National Pollutant Discharge Elimination System (NPDES) and the U.S. Army Corps of Engineers (USACE) nationwide permit for new gas pipeline installation and repair projects located throughout Texas. The projects involve coordinating and managing inspection personnel for more than 30 permitted sites on a weekly basis; review and distribution of SWPPPs; executing subcontract agreements for various services; and maintaining the record documentation on behalf of the permit holder including SWPPP amendments, distribution of amendments, and document archiving. Ms. Hunziker-Klaes provided peer review for a Phase I ESA for the South Weidner Road Drainage Improvement project. ASTM Practice E1527-05 and all appropriate inquiry (AAI) procedure were used to provide a comprehensive assessment of the subject property that included both public and private land. Phase I and II Environmental Site Assessments (ESAs), DFW Area For a confidential natural gas industry client, Ms. Hunziker-Klaes conducted Phase I ESA’s in preparation for property acquisitions for potential natural gas well pad sites. In addition to the routine contact and interviews as required under ASTM E1527-05 and All Appropriate Inquiry (AAI) procedure, these projects included frequent property owner interaction to facilitate good client-landowner relationships. Many of the Phase I ESAs included ecological studies due to their locations and proximity of natural resources; the projects were often on a quick turn-around to meet the client’s schedule. At PBS&J I initiated the recycling program in 2008 and continue to facilitate that effort by distribution of information, providing collection bins and signs, and stressing recycling awareness. It has been a successful effort with participation increasing monthly. On a larger scale, I have served as a board member to the North Texas Corporate Recycling Association (NTCRA http://www.ntcra.org/ ) and continue to volunteer by participating in the Industry & Legislative Affairs Committee. As an EHS professional, I am well versed in pollution prevention inventories and solutions and have assisted clients with P2 and P2 inventories, source reduction and waste minimization plans and reporting. My experience extends back to the Love Canal NPL site in Niagara Falls, New York from which much of our environmental legislation was born. Keep Laredo Beautiful holds regular clean ups, environmental fairs, attends outreach opportunities at schools and hosts several Earth Day, Arbor Day and Recycles Day events. Presentations to the schools and community groups are also provided. As a program going into its fifth year Keep Laredo Beautiful has had three state winners of Keep Texas Beautiful Awards. We have also garnered a Silver Star Award our first year and a Gold Star Award (highest achievement) from the State every year since and we have been in the President’s Circle through the Keep America Beautiful program since our inception. It is the National Affiliates highest achievement award.

They awarded the contract to Laredo Crime Stoppers in an effort to join an established agency that was already fighting a variety of criminal activity. The Center adds the Child Abuse component and focuses on awareness, prevention and early intervention. We do this through service provider meetings, focus groups, public relations, community speakers, community involvement activities, distribution of literature and counseling. I am also responsible for the monthly and quarterly reports that are sent to the state. I also edit and publish the quarterly newsletter called the Family Resource Review for the center. I have developed and designed organizational forms that are now part of the program and have been asked by state to assist in the creation of a concise method of reporting for Centers throughout Texas.

I also supervised the four recreational centers and their staffs (approximately 45 employees) as well as maintaining the structures. This included coordinating with the parks maintenance supervisors for necessary repairs and construction to recreational equipment. On a seasonal basis I supervised summer staffing (approximately 135 employees) at an additional eight sites throughout Laredo in conjunction with both school districts, managed the five city swimming pools and their staffs (approximately 50 employees including contract laborers) as well as coordinated their maintenance through the parks division. It was a partnership that started with one fourth grade classroom and is now in every school and grade level throughout Laredo. It was with her teacher's assistance, my belief that integrated learning is successful, and the children's desire for service learning that has made the program what it is today.

Waste Management Recycle America Richard Abramowitz is currently Director of Public Affairs for WM Recycle America. He has communications, community relations, and government affairs responsibilities. Prior to his current assignment he was on special assignment as a Site Coordinator to the WM IT Department where he was involved in the rollout of the largest software upgrade in the recycling industry. Prior to that he was responsible for recycling plant operations in the States of Texas, Oklahoma, Arkansas, and Mississippi. He also represented the Company on the Buy Recycled Business Alliance Board, the US Conference of Mayors Recycling at Work Program, America Recycles Day, Inc., and the State of Texas Alliance for Recycling. Prior to that position for Waste Management, he had responsibility for all operations and material marketing for two multi-material recovery facilities in the North Texas Area for Waste Management. Prior to that position, he served as the Southwest Group Recycling Director for Waste Management. He had responsibility for recycling activities including facility development for the Company in Texas, Oklahoma, Arkansas, Louisiana, and Mexico. Facilities in Dallas and Little Rock were put into operation during his time as Director. Prior to joining Waste Management, he served as Director of Environmental Affairs for the National Soft Drink Association (NSDA) now the American Beverage Association (ABA) in Washington, DC for nearly six years. He was responsible for coordinating their environmental activities as they related to state and local governments. Before joining NSDA, Rich was Technical Director for Recycling for HDR Engineering, Inc., a multi-disciplined national engineering firm based in Omaha, NE with offices nationwide. He worked in the Austin and Alexandria, VA offices where he helped design and implement curbside recycling programs in Florida, Tennessee, Connecticut, and Chicago. Prior to HDR, Rich served as Waste Reduction Program Manager for the City of Austin managing a curbside recycling program, a Christmas Tree recycling program, and other waste reduction efforts. He was also Senior Planner with the Essex County, New Jersey, Division of Solid Waste Management and managed the Rutgers University Recycling Program in New Brunswick, New Jersey. He holds a Masters of Science degree in Community and Regional Planning from the University of Texas at Austin, a Bachelors Degree from Rutgers University, and is past Vice President of the National Recycling Coalition. He is past President of the Recycling Coalition of Texas and served on the Board of Directors of the State of Texas Alliance for Recycling for more than 10 years. He has helped build five houses with the Dallas Area Habitat for Humanity and his synagogue in the past four years and is past chair of the build committee. He and his family (wife, son, and daughter) recently relocated to Houston after living in Dallas for 14 years.

Please accept this letter as my request to service on the PPAC. I have a tremendous passion and extensive experience consulting with Texas communities to help them address important solid waste management issues. I possess a unique understanding of the interests and challenges communities face on a daily basis in seeking to increase diversion rates. Serving on the PPAC will provide an opportunity to communicate key issues that are facing cities and counties across the State of Texas.

Since the mid-1990’s I have focused my career on working with local and regional governments and Federal agencies in Texas to help them solve challenging solid waste management issues. My perspective combines an understanding of financial and technical issues. Many of these efforts have focused on waste minimization and recycling. A few key examples include the following:

Currently working with the City of Denton to implement a pilot food waste diversion program that is focused on serving commercial customers.

Presently working with Fort Bliss (El Paso, Texas) to increase recycling and to minimize hazardous waste. Guided the City of El Paso to implement single-stream recycling, which received the Texas Public Works Association

Project of the Year Award in 2008. Provided recycling consulting services to multiple Councils of Governments (e.g. Houston-Galveston Area Council,

Capital Area COG and North Central Texas COG) on issues such as market development, construction and demolition, organics, commercial and residential recycling.

Worked with the City of San Antonio to develop their 10-year strategic plan, which focuses on achieving substantial increases in the City’s recycling rate.

Assisted many small and/or rural communities (e.g. Lufkin, Huntsville, Mansfield) develop innovative and cost effective approaches to increase recycling.

I am a Senior Director with R. W. Beck, and manage the firm’s Texas Solid Waste Practice. Prior to joining R. W. Beck in 2000, I was employed by the TNRCC from 1995 – 2000 in the agency’s solid waste planning division, where I focused on statewide planning issues as well as coordinating the Texas-Mexico Illegal Dumping Abatement Program. As a former TNRCC employee, I understand many of the challenges facing the TCEQ.
