proposal by completing a proposal form which together with any other statementsmade in writing by the Insured for the purpose of this policy' is deemed to beincorporated hereto.

%t the latest' the insurance shall e/pire on the date specied in the &chedule but if the wor! of construction included in the insurance is not completed within the timespecied hereunder' the Company may e/tend the period of insurance but theInsured shall pay to the Company additional premium at rates to be prescribed bythe Company.

#ENERAL CONDITIONS 2

". The due observance and fulllment of the terms of this olicy in so far as theyrelate to anything to be done or complied with by the Insured and the truth of

the statement and answers in the ;uestionnaire and proposal made by theInsured shall be a condition precedent to any liability of the company.

. The &chedule and the &ection(s) shall be deemed to be incorporated in andform part of this olicy and e/pression Mthis olicy= wherever used in thiscontract shall be read as including the &chedule and the &ection(s). %ny word

or e/pression to which a specic meaning has been attached in any part of this olicy or of the &chedule or of the &ection(s) shall bear such meaningwherever it may appear.

,. The Insured shall at his own e/pense ta!e all reasonable precautions andcomply with all reasonable recommendations of the Company to prevent loss'damage or liability and comply with statutory re;uirements andmanufacturersD recommendations.

2. a) 9epresentatives of the Company shall at any reasonable time have theright to inspect and e/amine the ris! and the Insured shall provide therepresentatives of the Company with all details and information necessary

for the assessment of the ris!.

(b) The Insured shall immediately notify the Company by Telegram and inwritingof any material change in the ris! and cause at his own e/pense

suchadditional precautions to be ta!en as circumstances may re;uire and

thescope of cover and3or premium shall' if necessary' be ad4usted

accordingly.

#o material alteration shall be made or admitted by the Insured where by theris! is increased unless the continuance of the Insurance be conrmed inwriting by the Company.

6. In the event of any occurrence' which might give rise to a claim under thisolicy' the Insured shall J

a) Immediately notify the Company by Telephone or Telegram as well as inwriting giving an indication as to the nature and e/tent of loss ordamageF

b) ta!e all steps within his power to minimise the e/tent of the loss or

damageF

c) preserve the parts a>ected and ma!e them available for inspection by arepresentative or &urveyor deputed by the companyF

d) furnish all such information and documentary evidence as the Company

may re;uireF

e) inform the police authorities in case of loss or damage due to theft or

burglary.

The Company shall not in any case be liable for loss' damage or liability of whichno notice has been received by the Company within "2 days of its occurrence.

pon notication being given to the Company under this condition the Insuredmay carry out the repair or replacement of any minor damage not e/ceeding 9s.'6AA3-. In all other cases a representative of the Company shall have theopportunity of inspecting the loss or damage before any repairs or alterationsare a>ected. If a representative of the Company does not carry out theinspection within a period of time which could be considered as ade;uate underthe circumstances the Insured is entitled to proceed with the repairs orreplacement.

The liability of the Company under this olicy in respect of any item sustaining

damage shall cease if said item is not repaired properly without delay.

7. The Insured shall at the e/pense of the Company do and concur in doing andpermit to be done all such acts and things as may be necessary or re;uired bythe Company in the interest of any rights or remedies' or of obtaining relief orindemnity from parties (other than those Insured under this olicy) to which theCompany shall be or would become entitled or subrogated upon their paying foror ma!ing good any loss or damage under this olicy' whether such acts andthings shall be or become necessary or re;uired before or after the InsuredDsindemnication by the Company.

8. If any dispute or di>erence shall arise as to the ;uantum to be paid under thisolicy (liability being otherwise admitted) such di>erence shall independently of all other ;uestions be referred to the decision of a sole arbitrator' to beappointed in writing by the parties to or' if they cannot agree upon a singlearbitrator within ,A days of any party invo!ing %rbitration' the same shall bereferred to a panel of three %rbitrators comprising of two %rbitrators - one to beappointed by each of the parties to the dispute3di>erence' and the third%rbitrator to be appointed by such two %rbitrators and arbitration shall beconducted under and in accordance with the provisions of the %rbitration andConciliation %ct "??7.

It is clearly agreed and understood that no di>erence or dispute shall bereferable to arbitration as hereinbefore provided' if the Company has disputed ornot accepted liability under or in respect of this olicy.

It is hereby e/pressly stipulated and declared that it shall be a conditionprecedent to any right of action or suit upon this olicy that the award by such%rbitrator3%rbitrators of the amount of the loss or damage shall be rst obtained.

:. If a claim is in any respect fraudulent' or if any false declaration is made or usedin support thereof' or if any fraudulent means or devices are used by the Insuredor any one acting on his behalf to obtain any benet under this olicy' or if aclaim is made and re4ected and no action or suit is commenced within threemonths after such re4ection or' in case of arbitration ta!ing place as providedtherein' within three months after the %rbitrator or %rbitrators or mpire have

made their award' all benets under this olicy shall be forfeited.

?. If at the time any claim arises under this olicy there be any other insurancecovering the same loss' damage or liability the Company shall not be liable topay or contribute more than their rateable proportion of any claim for such loss'damage or liability.

"A. This insurance may be terminated at the re;uest of the Insured at any time inwhich case the Insurers will refund appropriate premium amount sub4ect to thefollowing conditions -

i) Claims e/perience under the policy as on date of cancellation should be less

than 7A E of rewor!ed premium.

ii) MThe une/pired period is not less than , months or 6 E of the policy periodwhichever is less=.

iii) Testing period should not have commenced.

This insurance may also at any time be terminated at the option of the Companyby "6 days notice to that e>ect being given to the Insured in which case theCompanies shall be liable to repay on demand a rateable proportion of thepremium for the une/pired term from the date of cancellation.

SECTION I % MATERIAL DAMA#E %

The Company hereby agrees with the Insured (sub4ect to the e/clusions andconditions contained herein or endorsed hereon) that if' at any time during theperiod of insurance stated in the said &chedule' or during any further period of e/tension thereof the property (e/cept pac!ing materials of any !ind) or any partthereof described in the said &chedule be lost' damaged or destroyed by any cause'other than those specically e/cluded hereunder' in a manner necessitatingreplacement or repair the Company will pay or ma!e good all such loss or damageupto an amount not e/ceeding in respect of each of the items specied in the&chedule the sum set opposite thereto and not e/ceeding in the whole the total suminsured hereby.

The Company will also reimburse the Insured for the cost of clearance and removal

of debris following upon any event giving rise to an admissible claim under this

olicy but not e/ceeding in all the sum (if any) set opposite thereto in the &chedule.

EXCLUSIONS TO SECTION % I

The Company' shall not' however' be liable for J

a) the rst amount of the loss arising out of each and every occurrence shown as/cess in the &cheduleF

b) loss discovered only at the time of ta!ing an inventoryF

c) normal wear and tear' gradual deterioration due to atmospheric conditions orlac! of use or obsolescence or otherwise' rust' scratching of painted or polishedsurfaces or brea!age of glassF

d) loss or damage due to faulty designF

e) the cost of replacement' repair or rectication of defective material and3orwor!manship' but this e/clusion shall be limited to the items immediatelya>ected and shall not be deemed to e/clude loss of or damage to correctly

e/ecuted items resulting from an accident due to such defective material and3or wor!manshipF

f) the cost necessary for rectication or correction of any error during constructionunless resulting in physical loss or damageF

g) loss of or damage to les' drawings' accounts' bills' currency' stamps'deeds' evidence of debt' notes' securities' che;ues' pac!ing materials such ascases' bo/es' cratesF

h) any damage or penalties on account of the InsuredDs non-fulllment of theterms of delivery or completion under his Contract of construction or of anyobligations assumed there under or lac! of performance including conse;uentialloss of any !ind or description or for any aesthetic defects or operationaldecienciesF

i) loss of or damage to vehicles licensed for general road use or water bornevessels or Bachinery3;uipment mounted or operated or /ed on Noatingvessels3craft3barges or aircraft.

PROVISIONS APPLYIN# TO SECTION % I

Me1o % SUM INSURED 2

It is a re;uirement of this Insurance that the sum of insurance stated in theschedule shall not be less than the completely erected value of the propertyinclusive of freights' custom duty' erection cost and the insured underta!es to

increase or decrease the amount of insurance in the event of any materialNuctuation in the level of wages or prices. rovided always that such increase ordecrease shall ta!e e>ect only after the same has been recorded on the policy bythe Company.

If in the event of the occurrence of a loss' or damage it is found that the &um

insured representing the completely erected value of the property and3or of particular item involved is less than the amount re;uired to be insured' then theamount recoverable by the insured under this policy shall be reduced in suchproportion as the &um Insured bears to amount re;uired to be insured.

Me1o " % PREMIUM ADUSTMENT 2

The &um Insured under the olicy representing the complete value of the contractwor!s shall be ad4ustable at completion of the construction on the basis of actualvalues to be declared by the insured in respect of freight and handling charges'customs dues and construction cost and di>erence in premium shall be met with bypayment at the rate agreed to or by the insured as the case may be. %ny increase

or decrease in the rime cost of materials shall not be the sub4ect matter of premium ad4ustment.

Me1o & % REINSTATEMENT OF SUM INSURED 2

In the event of loss or damage the Insurance shall notwithstanding be maintained inforce during the period of insurance for the &um Insured the Insured underta!ing topay a pro-rata additional premium on the full amount of each claim for the loss ordamage from the date of such loss to the e/piry of the period of Insurance.

Me1o ' % BASIS OF LOSS SETTLEMENT 2

In the event of any loss or damage the basis of any settlement under this olicy shall be -

a) in the case of damage which can be repaired the cost of repairs necessary torestore the property to their condition immediately before the occurrence of the damage less salvage' or

b) in the case of a total loss - the actual value of the property immediatelybefore the occurrence of the loss less salvageF

however' only to the e/tent the cost claimed has to be borne by the Insuredand to the e/tent they are included in the &um Insured and provided alwaysthat the provisions and conditions have been complied with.

%ll damages' which can be repaired' shall be repaired' but if the cost of repairingany damage e;uals or e/ceeds the value of the property immediately before theoccurrence of the damage' the settlement shall be made on the basis providedfor in (b) above.

The cost of any provisional repairs will be borne by the Company if such repairsconstitute part of the nal repairs and do not increase the total repair e/penses.

The cost of any alterations' additions and3or improvements shall not berecoverable under this olicy.

Me1o 6 % EXTENSION OF COVER 2

%ny e/tra charges incurred for overtime' wor! on holidays' e/press freight(e/cluding air freight) are not covered by this insurance unless agreed upon at anadditional premium to be prescribed by the Company.

Me1o 8 % CONSTRUCTION PLANT AND MACHINERY 2

Loss of or damage to Construction lant and Bachinery e/cludes loss or damagedirectly caused by its own e/plosion or its own mechanical or electrical brea!downor derangement.

Me1o : % SURROUNDIN# PROPERTY 2

Loss of or damage to property located on or ad4acent to the site and belonging to orheld in care custody or control of the rincipal (s) or the Contractor(s) shall only becovered if occurring directly due to the construction of the items insured under&ection I and happening during the period of cover' and provided that a separate&um therefore has been entered in the &chedule under &ection I' for rincipal=ssurrounding specied property. This cover does not apply to construction3erectionmachinery' plants and e;uipment.

Me1o ! THIRD PARTY LIABILITY %

Third party liability (TL) cover cannot be granted during e/tended maintenance.

SECTION II % THIRD PARTY LIABILITY %

The company will indemnify the insured against -

a) legal liability for accidental loss or damage caused to property of other personsincluding property held in trust by or under custody of the Insured for which heis responsible e/cluding any such property used in connection with constructionthereon.

b) legal liability (liability under contract e/cepted) for fatal or non-fatal in4ury toany persons other than the InsuredDs own employees or wor!men or employeesof the owner of the wor!s or premises or other rms connected with any other

construction wor! thereon' or members of the InsuredDs family or of any of theaforesaidF directly conse;uent upon or solely due to the construction of anyproperty described in the &chedule.

rovided that the total liability of the Company during the period of Insuranceunder this cause shall not e/ceed the limits of Indemnity set opposite thereto inthe &chedule.

In respect of a claim for compensation to which the indemnity provided hereinapplies' the Company will' in addition' indemnify the Insured against -

a) all costs and e/penses of litigation recovered by any claimant from the Insured'

b) all costs and e/penses incurred with the written consent of the Company.

The e/clusion contained in paragraphs (d)' (f) $ (g) in &ection I of this olicy shallapply also to this &ection.

EXCLUSIONS TO SECTION II %

The Company will not indemnify the Insured in respect of -

a) bodily in4ury to or illness of employees or wor!men of the Contractor(s) or therincipal(s) or any other rm connected with the pro4ect which or part of which is insured under &ection I' or members of their familiesF

b) Loss of or damage to property belonging to or held in care custody or controlof the Contractor(s)' the rincipal(s) or any other rm connected with thepro4ect which or part of which is insured under &ection - I' or an employee orwor!man of one of the aforesaidF

c) any accident caused by vehicles licensed for general road use or by

waterborne vessels or aircraftF

d) any agreement by the Insured to pay any sum by way of indemnity orotherwise unless such liability would have attached also in the absence of such agreement.

CONDITIONS APPLYIN# TO SECTION II %

". #o admission' o>er' promise' payment or indemnity shall be made or given by oron behalf of the Insured without the written consent of the Company who shallbe entitled' if they so desire' to ta!e over and conduct in the name of the Insuredthe defence or settlement of any claim or to prosecute for their own benet inthe name of the Insured any claim for indemnity or damage or otherwise andshall have full discretion in the conduct of any proceeding or in the settlement of any claim and the Insured shall give all such information and assistance as theCompany may re;uire.

#otwithstanding the conditions' provisions and other endorsements of the olicy'it is understood and agreed that the following special conditions shall apply -

The Insurers shall not be liable under the olicy to indemnify loss or damage toe/isting underground cables or pipes of any !ind (electric cables' telephonecables' water and gas pipes' sewers and other pipelines' etc.) unless prior to thecommencement of wor!s -

- the Insured had re;uested and obtained from the public authorities or the

owners of such an underground system the e/act position of all cables or pipes. - the Insured had traced their e/istence and indicated location.

The indemnity shall in any case be restricted to the repair costs of such cables orpipes. %ny conse;uential damage shall be e/cluded from the policy cover.

#otwithstanding the conditions' provisions and other endorsements of the olicyit is understood and agreed that -

a) The contract wor!s time schedule together with plans' documents andspecications supplied and any other statements made by the Insured withrespect of wor!s programme is deemed to be incorporated herein.

b) The Insurers shall not indemnify the Insured in respect of loss or damagecaused by' or arising out of' or aggravated by deviations from the contractwor!s time schedule e/ceeding four wee!s' unless the Insurers had agreed inwriting to such a deviation before a loss occurred.

This memo applies only to the dam wor!s during period of river diversion.

! TEMPORARY ACCESS ROADS %

Irrespective of the periods of Insurance specied in the olicy' the Insurer willindemnify the Insured only for unforeseen accidental loss or damage totemporary access roads insured under the olicy if such loss or damage occursprior to such roads being completed or ta!en into use for their purpose by thecontractors' whichever ta!es place rst.

! SPECIAL CONDITIONS CONCERNIN# THE CONSTRUCTION OF DAMAND @ATER RESERVOIR %

It is agreed and understood that otherwise sub4ect to the terms' e/clusions'provisions and conditions contained in olicy or endorsed thereon the Insurerswill not indemnify the Insured in respect of -

• grouting of soft roc! areas and3or other additional safety measure even if their necessity arises only during construction'

• e/penses incurred for dewatering even if the ;uantities of water originallye/pected are e/ceeded substantially'

• loss or damage due to brea!down of the dewatering system if suchbrea!down could have been avoided by suGcient stand-byfacilities'

• e/penses incurred for additional sealing or water proong and additionalfacilities for the discharge of run o> and or underground water'

• e/penses incurred for the repairs of eroded slopes or other graded areas' if the Insured has failed to ta!e the measures re;uired or to ta!e themin time'

• loss or damage due to subsidence if caused by insuGcient compacting'crac!s and lea!age not caused by Insured peril.

! SPECIAL CONDITIONS CONCERNIN# SAFETY MEASURES @ITHRESPECT TO PRECIPITATION, FLOOD AND INUNDATION %

It is agreed and understood that otherwise sub4ect to the terms' e/clusions'provisions and conditions contained in the policy or endorsed thereon' theInsurers shall indemnify the Insured for loss' damage or liability caused directly

or indirectly by precipitation only if ade;uate precautions have been ta!en indesigning and e/ecuting the pro4ect involved.In this conte/t' ade;uate precautions shall mean that allowance is made forprecipitation' Nood and inundation up to a return period of "A years for thelocation insured and the entire policy period on the basis of statistics preparedby the Beteorological agencies.

Loss' damage or liability resulting from the Insured=s not immediately removingobstruction (e.g. sand' trees) from watercourses' whether carrying water or not'in order to maintain free water Now shall not be idemniable.

MIn consideration of the payment of an additional premium of 9s. HHHHHHH. It ishereby declared and agreed that the Company shall provide for escalation in&um Insured under items of &ection I of the schedule attached to the policyuptoHHHHHHHHHHE of the 1riginal &ite value' the basis of claim settlement shall bethe original &ite value of e>ected e;uipment plus increase in cost of

replacement' if any' provided that the increase in the value of such e;uipmentdoes not e/ceed HHHHHHHE of the original site value.

It is also hereby declared and agreed that in the event of a claim the insuredwould be considered as fully insured upto the &um Insured inclusive of HHHHHHHHH E increase as per selected escalation and under-insurance would apply only inthe event of the cost of replacement of the e>ected e;uipment e/ceeding theoriginal value of selected HHHHHHHHHHHE towards escalation.

It is however understood and agreed that the premium collected against priceescalation herein above shall not be sub4ect to refund the premium ad4ustmentclause in the memo of the policy.

It is further understood and agreed that in case of additional premium

chargeable during nal ad4ustment' additional escalation premium will becharged to the insured but in case of any premium refundable during nalad4ustment no refund shall be allowed against the escalation premium alreadycharged to the insured=.
