1. Background to Service Plan

Sefton Council Transformation agenda in 2011 informed the re-structure of services against a context of reduced government funding. This resulted in

rationalising council directorates into 2; People and Places. The Transformation agenda underpinned the council’s commitment to’ Early Intervention &

Prevention’ for children, young people and families within the borough. Early Intervention & Prevention (EIP) is a portfolio of services within the People

Directory, comprising 0-11yrs services (Children & Family Centres), 11+ (Youth Service & Aiming High) & Targeted Support & Interventions (Youth

Offending Service, Targeted Youth Support, Substance Misuse & Sexual Health/SMASH, Family Intervention Project (FIP) & Strengthening Families Service

(service preventing children & young people from local authority care).

Given the change agenda, developing a common vision and shared objectives between teams amalgamating as the new Targeted Support & Intervention

Service were a priority. Developing a performance management framework allied to the vision was a key imperative for a whole service approach to

developing outcomes and targets. Managers and staff met in May to collaborate in relation to developing a vision and measurable objectives based on

local and national corporate performance outcome drivers:

National: Reducing Youth re-offending; Reducing First Time Entrants into the Criminal Justice System; Reducing The Use of Custody; Effective Public

Protection; Effective Safeguarding and Contributing to the Government’s youth drugs and knife crime prevention priorities

Policy Context – National & Local:

i. Youth Offending Service – Key Changes for Youth Justice, the Legal Aid, Sentencing and Punishment of Offenders Act 2012, received Royal

Assent on May 1, with implementation in November.

The Act reforms the justice system and the administration of legal aid, creating a new youth remand and sentencing structure and allowing

courts greater flexibility when deciding on appropriate disposals.

Youth Sentences:

• Increasing sentencing discretion by enabling courts to conditionally discharge a young person pleading guilty to their first offence

instead of giving a referral order

• Removing current restrictions on repeated use of referral orders following a guilty plea

• Altering detention and training order recall

• Remands, where a more flexible and simplified approach is being introduced for remanding young people under 18 years of age. Key

implications for YOT Partnerships; young people remanded become ‘looked after children’; incremental transfer of remand costs to

local authorities from April 2013

• Out of Court Disposals, where reprimands and final warnings will be replaced by youth cautions and youth conditional cautions

• Rehabilitation of Offenders, amending the times when different convictions become spent and, in most cases, when rehabilitation

periods will be reduced

• Introduction of local Police Crime Commissioners (PCC), Sefton’s youth justice grant was reduced by £31k this year in order to support

the implementation of the Police Crime Commissioner in Merseyside, elections November. Awaiting YJB consultation July 2012 re

reduced grant for 2013/14

• National Standards, freedoms and flexibilities – increasing opportunities for professional discretion in line with the Green Paper on

Justice. Delivery within the new environment of increased accountability and local determination.

Troubled Families

• Targeted Support & Interventions supporting the delivery of services targeting Sefton households that meet the following criteria

Are involved in crime and anti-social behaviour, have children not in school, have an adult on out of work benefits and who meet the locally

defined criteria ; children and young people at risk of becoming ‘looked after’ or parents identified as substance misusers, particularly alcohol.

Key considerations and associated actions:

• Re-design relevant Targeted Support teams into one coherent service…to support the delivery of the Troubled Families agenda

• Implement ‘Gateway Panel’ – multi-agency gatekeeping and resource panel to ensure a consistent approach and provide the necessary

performance management oversight

• Workforce Development – training needs analysis linked to current and future skill set requirements. See plan annexe

Children & Young People on the Cusp of Care & Custody

Targeted support reviewing with colleagues across EIP (11+), Children’s Social Care LAC & Family Support, Positive Futures identifying

mechanisms to better target young people at risk of care and to reduce the incidence of placement breakdown and subsequent high cost

agency placements.

Key considerations and associated actions|:

Following a series of management and staff vision and planning days, managers and staff agreed the following vision and key service objectives for Targeted Support

Sefton YOT Performance Review against National Measures

To provide recommendations that identifies strategies for future improvement and to highlight practice priorities in response to current trend analysis. To highlight the development of performance information is in progress; particularly in accessing up-to-date information from the revised Child View system. Training from CACI is required to facilitate this. The most up-to-date information available has been used and a variety of information sources used where possible. National Performance Indicator - Reducing the Use of Custody: In 2010 the way of calculating performance in relation to custody changes to rate per 1,000 of 10-17 population. However, the previous way of calculating custody has been used here to provide continuity of data to illustrate trends. Also there are current issues gaining up-to-date information from the YJB as YOS have been requested to resubmit data. Hence, custody is: Defined as Percentage of custodial sentences issued to young people out of all sentences issues to young people in court:

For the year 2011/12 (1st April to 31st March) the percentage of number of young people receiving custodial sentences in Sefton was 12%. comparing years:

2010/11 the rate was 7.5 and 2009/10 rate is 4.3 In making comparisons across our Merseyside neighbours all Merseyside YOS have experienced an upward trend of custody in 2011/12. Knowsley, Liverpool and have a similar rate toSefton. St Helens and the Wirral have traditionally had low custody numbers and there rate is 4% and 5% respectively.

Trends

• These figures clearly illustrate an upward trend in relation to custody and Sefton’s Performance is therefore declining

• This decline is represented across Merseyside YOS

• Although not show in the data represented here, there are increasing numbers of young people who are remanded and/ or receive a custodial sentence who are from the North of Sefton. These are predominately males and 16/ 17 year olds.

• The cost of remands/ custody has increased and it is anticipated that 2014/15 that full costs of custody will transfer over to the Local Authority

Practice Priorities

• To monitor and track remands and custody cohorts in relation to bed nights and associated cost by establishment using the YJB tracking tool

• To undertake post custody reviews to assess early identification of practice issues in order to inform strategic and operational decision making in relation to remands & custody – taking a proactive approach

• Develop mechanisms to monitor breach and ensure consistent and good practice is adhered to

• Review and effectively target resources across EIP Targeted services to young people at risk of remand/ custody i.e. strengthening bail support packages

• Further develop relationships with the Court. The development of a Youth Court Panel that meets quarterly to explore issues & develop more in-depth understanding across services

• Develop appropriate links and joint working with social care in relation to ‘looked after’ status for all remands, which will necessitate a designated social worker (LASPO Act).

• Review and develop alternative accommodation to remands

• Develop the Connexions office as a base to work with and engage with Southport Young People who are increasing numbers within remand and custody cohorts.

It should be noted that the above data is based upon PNC data. This bases offending upon the offenders address and therefore includes out of borough cases. Given Sefton is a net importer of children from other authorities who are looked after, Sefton has an import of vulnerable young people, whom are unknown and potentially at risk of offending. Analysis of first time entrants using data from Youth Justice Systems is based upon the previous measure of First Time Entrants (number of First Time Entrants to the Youth Justice System aged 10-17). This illustrates greater reductions. For example, 2011/12 compared to 2009/10 showed Sefton had a 29% reduction. St Helens and the Wirral achieved a 69% and 45% reduction respectively. There are differences between PNC data and Youth Justice Data from local YOS databases. One important issue to illuminate is that currently PNC is counting Triage as a first time entrant. Therefore there are larger reductions not currently being counted by using PNC data alone. Trends

• As the table above indicates the rate of first time entrants has reduced in October 11 to September 11 by 20/7% when compared to the previous year. Greater reductions have been achieved by our Merseyside colleagues. However, it should be noted that Sefton began Triage as a strategy to reduce first time entrants in January 2011 Approximately 12 months behind our Merseyside colleagues

• The PNC data does not accurately reflect reductions given that Triage is counted as a first time entrant – this is being explored with the police

• Although not shown in the above figures, local analysis of data indicates that Triage is being used effectively for Cannabis use and that the vast majority of those who receive a triage intervention do not re-offend.

• Currently there are young people coming into the Youth Offending System, who have had previous reprimand/ final warnings and not yet had the opportunity of Triage. They are already classed as a first time entrant. Hence, the full effects of Triage will take time to take effect and outcomes will need continued analysis overtime.

Practice Priorities

• To further develop Triage as an effective strategy to reduce first time entrants for low level offences.

• Cascade restorative justice training to practitioners who can support Restorative Justice Interventions within Local authority/ private children homes and schools where appropriate. This will avoid unnecessarily criminalising behaviour through involving victims and offenders through a mediation process and will have the following outcomes:

a. Reduction in offending by young people resident in homes b. Reduction in First Time Entrants c. Reduction in call outs of police to children home staff d. Improve life chances & better opportunities for young people in Childrens homes e. To improve approaches to challenging behaviour f. Prevent placement breakdown & the high cost of agency placements

• To further embed Triage as an effective prevention strategy and expand interventions to cover Hate crime and faire evasion • Develop joint discussions with the police and Youth Offending Service in relation to revised guidance following changes to pre-court

disposals (Legal Aid, Sentencing and Punishment of Offenders Act 2012)

The YJB report nationally that the overall rate of re-offending has remained broadly stable with a 0.4 percentage point reduction in relation to proven re-offending. This is defined as any offence committed in a one year follow-up period and receiving a court conviction, caution, reprimand or warning in the one year follow up. The average number of re-offences per offender (freq rate) fell 17% between 2000 and 2009/10 (Youth Justice Board/ Ministry of Justice Statistics Bulletin, 2011:40). Particular reductions were amongst those with no previous offences and those receiving pre-court disposals. Those coming into the youth justice system are seen as more challenging. Trends

• Comparisons indicate some small changes in relation to re-offending rates

• It should be noted that measuring true re-offending is difficult and relates to a proportion of crime that is detected

• The rate of re-offending is related to the characteristics of offenders i.e. 15 to 17 year olds have a higher re-offending rate, offenders with a larger number of previous offences have a higher rate of offending and domestic burglary has a higher rate.

• It is difficult to make comparison across YOS given that re-offending rates vary for the above reasons in relation to ‘types’ of offenders, police activity results in different detection rates and difference of age profiles across geographical locations

• Effectively intervening early on to prevent young people from re-offending • It should be noted that effective prevention of first time entrants through Triage and strategy to reduce custody may have the impact of

changing the nature of the cohort we work with in relation to community orders i.e. we will be working with young people who have higher recidivism/ re-offending rates - the task for this group becomes more difficult

• Reviewing and evaluating programmes for delivery, across prevention and criminal justice orders in relation to ‘What Works’

• The re-focusing of resources to provide access to a targeted range of services across Early Intervention and Prevention. Supporting better outcomes for Young People, including reducing re-offending and exit strategies to provide continuity of support and promote sustainability

• To reducing duplication (Assessment), promoting seamless delivery and flexibility, enhancing information sharing across Early Intervention and Targeted Services

Risks to Future Delivery Local Authority

• £43 million reduction in funding over 2013/14-2014/15 across the council

• Targeted Support & Intervention – 10% saving in local authority contribution to YOT 2012/13, This has largely been met by efficiencies realised by greater integration with parenting services (dis-establishing Parenting Co-ordinator post; deletion of sessional worker role; Education Welfare Service funding previous YOT supply teachers)

• 2012 review of council services based on budget gap, emphasis on commissioning rather than delivering direct services. YOT Partnerships

• Police withdraw cash contribution to YOT 2012/13, £10,997. Statutory partners (Health, Probation) have sustained funding and staff secondment levels based on previous year. Liverpool & Sefton Community Health have increased staffing levels, additional general health nurse (30hr fte post)
