1. PROJECT DESCRIPTION AND SCOPE OF WORK

GENERAL DESCRIPTION

This is a subproject under the Trung Son hydropower project financed by the World Bank. Reasons of Subproject proposals:

Trung Son hydropower plant will be constructed on the Ma River, in the territory of Trung Son commune, Quan Hoa district, Thanh Hoa province. Installed capacity of the hydropower project is 260 MW, annual electricity produced will be 1056 GWh. Trung Son hydropower project will bring benefit in term of power generation and flood control.

Construction of the subproject “Mai Chau 110 kV substation and 35 kV power line supply for construction of Trung Son hydropower project” is aimed to meet the local power demand, supply electricity for construction of Trung Son hydropower project and supply electricity for ressettlement sites.

The subproject is consisted of two components:

- Mai Chau 110 kV substation and connections;

- 35kV power line supply for construction of Trung Son hydropower project (19. 427 km).

The construction of Mai Chau 110 kV substation and 19.427 km of 35 kV power line can cause negative impacts on the environment and local communities during pre-construction phase, construction phase and operation phase.

In order to ensure that potential negative impacts are identified and mitigated during subproject implementation and that the subproject complies with the Environmental Assessment policy (OP/BP 4.01) of the WB, an Environmental Management Plan (EMP) of the subproject has been prepared in compliance with the Environmental Guideline (EG) prepared under Trung Son hydropower project. This EMP is prepared with reference to Environmental Management Framework (EMF) of the Distribution Efficiency Project sponsored by the WB. Application of some items of EMF is suitable in this case due to similarities of the Subproject and other subproject under DEP. This EMP includes: the subproject description, legal and policy frameworks, applicable environmental technical standards and regulations, potential negative impacts, proposed mitigation measures to be implemented prior and during construction and operation, and implementation arrangements. The EMP also includes Environmental Codes of Practice (ECOP) that will be integrated into bidding and contractual documents, monitoring and supervision during the implementation.

EIA of Trung Son hydropower project (including the subproject Mai Chau 110 kV substation and 35 kV power line supply for Trung Son HP) was approved by Ministry of Environment and Natural resource by Decision N0 1257/QD-BTNMT dated 17/6/2008 on approval of EIA for Trung Son hydropower project.

PROJECT DESCRIPTION

1.1. Construction of Mai Chau 110 kV Substation and its 68 m Connection Line1.1.1. Alternatives for subproject location.

General requirements on Subproject’s locations

Selection of location for Mai Chau 110 kV substation is made based on the following technical and financial requirements:

- To comply with Master plan for power development No 6 and comply with Local socio-economic plannings;

- Technical requirement: To ensure to have enough area for the substation and power line connections. The location should be optimized in term of having minimum power loss for power grid;

- Natural condition requirement: Geological pattern is suitable for substation construction, climate is suitable. Topography is preferably to be flat, open to enable access and connections with the power grid.

- Location should be convineinent for construction, transportation of substation’s equipment during operation phase.

- Minimize compensation and ressettlement, avoid impact in cultural and historical valuable sites. Minimize impact on local landscape and views.

- Minimize loads on ground leveling. - Make use of the existing facilities such as road, power source, water source. - Minimize environmental impacts caused by the substation to surrounding

areas.

Substation location alternativesBased on the above-mentioned requirement, technical consultants (PECC4) have investigated and proposed 3 alternatives described bellow:

- Option 1: Mai Chau 110 kV substation will be constructed on rice and dry crop field of Na Quan (Tong and Dau villages), Tong Dau commune, Mai Chau district, Hoa Binh province.

- Option 2: Mai Chau 110 kV substation will be constructed on agricultural alnd of Vang village, Mai Chau township, Mai Chau district, Hoa Binh province.

- Option 3: Mai Chau 110 kV substation will be constructed on the agricultural land next to the existing Mai Chau 35 kV substation in Mai Chau township, Mai Chau district, Hoa Binh province.

Among these three options, the option 3 having connecting 110 kV power line overpassing deeply in center of Mai Chau township. This affect affect development of Mai Chau township so there will be many disadvantages to local development planning. Beside that, the option 3 will not comply with Decision 5638/QDD-BCT dated 22/20/2008 of MOIT on “Decision on amandement of Power Development Planning for Hoa Binh Province in period 2006- 2010 with vision to 2015”. So option 3 is excluded before go to further considerations. Table 1.1. Comparison of alternatives for Mai Chau 110 kV substation location

Consultation with local authorities During site investigations, Consulting company PECC4 has worked and

consulted with relevant authorities in Hoa Binh province. Even the

option 1 having higher investment cost than the option 2 (2.05 billions),

but this location is more suitable for the socio-economic planning of

Hoa Binh province. Local authorities approve the Option 1.

- Tong Dau primary school

The school is about 150 m far from Mai Chau 110 kV substation. The first part of 35 kV supply power line is going along the edge of the school.

Mai Chau 110 kV subsation is proposed to be built in the land used for 1-harvest rice field and dry crop cultivation on Tong Dau commune, Mai Chau dictrict of Hoa Binh province.

- North of the proposed subsation is bordered with field for rice and dry crop cultivation;

- South of the substation is field and about 100 m far from Tong Dau primary school.

- East of the substation is borderd with national road N0 15. - West of the substation is field and is about 100 m far from 110 kV Hoa Binh-

Moc Chau power line and 35 kV Mai Chau- Hoa Binh power line. Total acquired land for the substation is 8,336.0 m2. Of which:

- Land for the substation and access road is: 7,336.0 m2.- Land for resting house of operating team is: 1,000.0 m2.

An access road to the substation

An access road to the substation is 135.0 m in length connecting substation to the

national road 15. This road is made by reinforced concrete, 4 m wide. Slope of the road is

2% in both sides. The pavement is 1.5 m and ROW of the road is 6 m (calculated from

the outest point of the pavement).

The road is constructed by widening of the existing inter commune road in Tong Dau

commune. At the present time, this inter commune road is also passing Tong Dau

primary school. From the widening point to Tong Dau primary school is about 150 m.

During construction, widening of the road might cause short term environmental impacts

on the traffic in the inter commune road. In long term, subproject’s vehicles will use only

the extended road for transportation so no impact on local traffic will occur.

Water supply system

Water used for living and construction will be purchased from the water supply utility of Mai Chau district. Water supply pipe is available at 100 m far from the substation. Water for construction will be supplied to construction sites by tank truck and plastic water pipes. During operation phase, water will be supplied through zinc-coated steel pipe (34 mm in diameter). Water will be stored in 10m3 reinforced cisterns and will be pumped up to tank fixed in roof of operating house and resting house.

Water drainage system

- Domestic water will be collected to underground cistern and will self soaked to the soil.

- Drainage system for the substation’s surface water run off: rain water will be drained out through designed slope. Collecting holes are designed along road inside the substation. Holes are connected by PVC 150. By this PVC pines, rain water is collected and discharged to the existing water canal outside the substation.

Basin for oil collection in emergency will be constructed under each transformer. Basin will be constructed by reinforced concrete. This basin is under grounded and has a volume about 22 m3. This volume is enough to collect oil in the designed transformers

(including the transformer reserved to install in later phase – from 110 kV - 25MVA to 110 kV - 40 MVA). Walls (0.5 m high) around foundation of transformers are constructed to avoid oil spill. In case, accident of oil spill is occurred, spilled oil will be collected through steel pipe Ф200, 5mm thick.

Fire prevention and protection system

There are 2 water tanks (3 m3 /each tank) and 6 sand containers (1m and 1m in height). Water tanks and sand containers are allocated along road and near inflammable subjects such as transformers, operating house. Beside these, there are fire extinguishers (powder type, CO2 type) and manual tools for fire control are equipped.

110 kV connection line

Start point: in between tower N0 187 - 188 (the point is 40.3 m far from tower No 187) of the existing 110kV Hoa Binh - Moc Chau power line.

End point: Gate tower of the proposed Mai Chau 110 kV substation;

Length: 68m.

Topography in the area (that the connection line will overpassing) is quite flat. Land use pattern in the ROW is rice and dry crop field. The connection line will overpass land of Tong Dau commune, Mai Chau district, Hoa Binh province.

Route of the connection line is agreed by People committee of Hoa Binh province by document 285/UBND-CT dated 09/3/2009.

Route of the 35 kV power line was approved by People committee of Hoa Binh province and Quan Hoa district agreed. The power line will mainly go along national road No 15, along the road used for construction of Trung Son HPP, along inter commune road. The power line will mainly overpass rice field. The 35 kV power line is composed of two main sections as described bellows:

- Section 1: From the starting point to G26 (15,396 m in length).

The power line is started from Mai Chau 110 kV/30 kV substation in Tong Dau commune (Mai Chau district, Hoa Binh province). The power line will overpass Mai Chau- Hoa Binh 35 kV power line and Hoa Binh- Moc Chau 110 kV power line. In this section, the power line will go along national road No 15 (in the right hand side). Distance from the power line to the national road is ranging from 250 m to 500 m. Turnings (change direction of the route) are required to avoid residential areas. Topography of the area is quite plain. Main land use patterns are fruit tree gardens, rice and dry crop fields, hills with bamboo Luong planted forest. The power line will overpass land of Tong Dau commune, Mai Chau Township, Chieng Chau, Mai Ha, Van Mai of Mai Chau district, Hoa Binh province.

- Section 2: From G26 to tower No 59 of 35 kV power line supply for Ban Uon 110 kV substation (under RE 2 WB loan). This section is 4,031 m long.

From G26, the power line will turn left and go along inter commune road to reach to construction site of Trung Son HPP. Distance of the power line to this inter commune road is ranging from 100 m – 300 m. Topography of this section is quite complex with high hills and deep creeks. Main land use pattern is bamboo Luong forest mixed with dense shrubs. From G37, the power line will connect with 35 kV power line of RE 2 project in Quan Hoa district of Thanh Hoa province. The power line will overpass land of Van Mai commune of Mai Chau district (Hoa Binh province) and Phu Thanh, Trung Son communes of Quan Hoa district (Thanh Hoa province).

1.3. Supplement of Materials and Equipment for the Subproject

Sand, rocks, gravels, cements etc.... are supplied by local suppliers.

Other materials will be provided from warehouse of PMU at Moc Chau and Co Luong communes.

1.4. Transportation of Construction Materials and Equipment

Long-way transportation

Cars will be used for transportation of materials, equipment from ware house of PMU to subproject’s construction sites as well as for transportation within construction sites. Concrete centrifugal towers will be purchased from Hoa Binh province will be separated according to type of towers and provided to each site as required. Loading and unloading materials and equipment will be done manually or by cranes. Local suppliers will directly transport materials to gathering points along the power line.

Transportation within the construction sites

National road, provincial road, inter-district and inter commune roads will be used for transportation of materials and equipment among the construction sites. An average transportation is 15 km.

Short-way transportation

From gathering points, materials and equipment are transported manually or half-manually to construction sites. An average distance for short way transportation is 300 m.

1.5. Number of Workers and Workers Camps

Mai Chau 110 kV substation and connection line: Warehouse, camp are proposed bo be located in reserve area for the second transformer in the substation area. These structures will be build by assembling steel structures to easily dismount in later phase. Foundations of these warehouse and camp will be build by bricks. Colums, beams will be made by wood or steel. Roof will be made by corrugated iron sheets (or cement sheets). Walls will be made by plywoods. Ground will be montared by cement to ensure cleaness, hygenity.

Camp will consist of living area, office area... Number of workers for construction of the substation and 68 m connection line is as bellows:

▫ Direct worker : 60 people

▫ In-direct worker : 07 people

▫ Site managers : 05 people

35 kV power line: There will be two construction team. Each team will consist of 40 people. These workers will hire houses of local people for their camps.

1.6. Subproject Schedule

Some of main milestones of Mai Chau 110 kV substation is:

- Preparation of technical design and approval : 01/2011 - 11/2011

- Preparation of Request for Proposal for Bidding : 9/2012 - 10/2012

- Ground breaking : 12/2012

- Completion and commissioning : 3rd quarter 2013

2. POLICY AND REGULATION FRAMEWOR

2.1. Regulations of Vietnamese Government

The following laws and regulations in Vietnam are applied for the subproject:

Environment Protection Law 52/2005/QH11 passed by the National Assembly dated on 29/11/2005 regulating responsibilities of individuals and organizations regarding environmental protection.

Law on Cultural Heritage No. 28/2001/QH10.

Decree no. 29/2011/NÐ-CP dated 18 April 2011 regarding regulations on strategic environmental assessment, environmental impacts assessment and environmental protection commitments.

Circular no. 26/2011/TT-BTNMT dated 18 July 2011 detailing some articles of Decree no. 29/2011/ND-CP dated 18 April 2011 regarding regulations on strategic environmental assessment, environmental impacts assessment and environmental protection commitments.

2.2. The World Bank Safeguard policies

The environmental screening according to criteria described in the EG for subproject has been carried out and the result shows that the WB policies on Environmental Assessment (OP 4.01) and Involuntary Resettlement (OP 4.12) are triggered for this subproject. The subproject has also to comply with the Bank’s requirement on Public Consultation and Information Disclosure Policy. The implementation of policy on Involuntary Resettlement (OP 4.12) is addressed in a separate safeguard document.

Conclusion:

Since implementation of the subproject would mainly cause land acquisition, increased dust generation, air pollution, and domestic waste production during the construction phase. However, these impacts are not significant, temporary, and localized, and can be mitigated available mitigation measures. During the operational phase the main impacts would be visual, due to the alteration of the previously existing landscape, and potentially on the avifauna, who is at risk of collision and electrocution. However, as the TL follows exiting infrastructure and the height of pylons and wires is moderate; these impacts are anticipated to be low. Therefore, the subproject is assessed as B environmental category according to the World Bank’s operational policy OP4.01 on environmental assessment, requiring an ESIA and an EMP as analytical and mitigation instruments.

Construction phase

6 Impact in Tong Dau primary school

Medium Short - Tong Dau primary school is about 150 m far from the proposed substation. Therefore, the school might be affected by noise, dust, vibration during construction time. However, these impacts will last only in a short period of time (about 3 months, when ground leveling and civil work are occurred). These impacts can be mitigated by application of mitigation measures as specified in Chapter 4.

- An access road to the substation is created by widening an inter commune road of Tong Dau commune. This inter commune road is also passing Tong Dau primary school. So transportation of pupils and teachers might be affected during construction time. This impact will mostly occur during ground leveling, road construction, civil work for substation construction. When the access road is completed, subproject’s vehicles will use only the new road. So impact on local traffic will not be considerably affected.

- Mai Chau 110 kV substation is about 50 m far from a small stream. This stream is going along national road No15. This is the only one surface water source near the substation.

- The 35 kV power line will 2 times overpass Xia stream and one time overpass other small stream in Chieng Chau commune. Width of these steams at the over passing point is from 4-7 m. Beside these, the power line will not overpass other surface water such as river, stream, and reservoir.

- Construction of foundations near the streams might cause risk on water contamination due to debris, construction materials washed out to the water bodies.

- The Subproject area is quite flat; therefore, the risks of erosion, soil and construction materials runoff are not high.

- Excavation is planned to do in dry season. Excess soil will be reused to fill in the poles’ foundations. Thus there will be no soil, rock left after the Subproject implementation.

- Thus the impact on surface water pollution in the Subproject area is medium and can be mitigated.

- About 100 m far from the substation is Tong Dau primary school. Few houses are about 200 m far from the substation location. These are the nearest areas with human living in the substation location. The nearest residential area of the substation is center of Chieng Chau commune (2 km far from the substation).

- The 35 kV power line will mainly overpass rice fields, bamboo Luong forest. Sections of the power line going near residential area is G3-G4 (Mai Chau township), G21-G22 (Van Mai commune). These residential areas are about 70 m far from the power line. Main part of the power line are far from residential areas so construction activities of the subproject will not impact to normal life of local people.

- Construction materials will be supplied by local supplier within medium distance to construction sites.

- Equipment, cables, materials transported from Ha Noi and from Mai Chau district to the sites through national road 15 and provincial roads system. After that these materials will be transported manually or half-manually to construction sites.

- Due to the above reasons, the noise and vibration impact caused by the Subproject is considered as medium, happening in a short period of time and can be mitigated.

- Regarding soil erosion, the impact is assessed as small according to small scale of the sub-station site, short construction time. Furthermore, these impacts can be reduced to even smaller when implementing mitigation measures.

10 Air pollution Medium Short -Dust generated from soil excavation, ground leveling especially during dry seasons. The subjects to be affected by dust are people living, working near roads used for transportation of the constriction materials such as national, provincial, district, inter commune roads.

- The Subproject site is away from residential and urban areas therefore air pollution (dust) would not affect much on people living in the Subproject area; The most affected area by air pollution will be substation location, center of Chieng Chau commune, center of Van Mai commune. These areas will be sprayed by water during dry and strong wind times.

- There are 3 residential areas about 70 m far from the Subproject sites. Construction activities at these sites are just construction of foundations. Size of the foundations is 2 m x 2.3 m x 2 m (depth) so impact can be

11 Ecological impact Small Short - Proposed substation is located in very intensively used by human activities.

- The main land use pattern in the substation area and ROWs are rice fields and dry crops. There are 2.504 km from 19.427 km of the power line overpassing bamboo Luong forest. This forest is planted and periodically exploited for commercial purpose.

- Except rice field, Luong forest, there are few other trees, fruit trees, eucalyptus are impacted. These trees mainly have economic but not ecological value.

- There is also no special impact caused by Subproject on fauna since the Subproject sites are mainly rice fields, planted Luong forests, gardens, land along roads. These are very common patterns in the area. Beside these, there is no special habitat observed.

12 Traffic disturbance including water-way transportation

Small Short - Transportation of materials and equipment will disturb the normal traffic in the areas during short period of time.

- Currently local authorities and people supervise the management of rural road quite well. Large load transportations are not allowed to run through roads whose quality is not good enough. This is also an issue that the contractors have to comply and thoroughly calculate transporting options to avoid rural road degradation.

- Manually or half-manually transportation material to construction sites might also cause damages to the rice fields, path at edges of the rice fields.

- The road section that most potentially be damaged by subproject activities is the inter commune road that will be widened for an access road of the Mai Chau substation. Other roads used by subproject’s vehicles are potentially less affected.

15 Environmental impacts caused by construction workers

Medium Short - The subproject implementation is expected to be completed in 9 months, from that construction period will last for 5-6 months. High construction time is last from 5 to 6 months. The remaining time is mainly reserved for the installation of equipments;

- It is expected to be 72 workers involving with construction of the substation. These worker will create their camps in substation's area, where is reserved for the second phase (installation of another transformer). Number of workers involving with construction of the power line is about 80; they will be divided into two groups and will stay in houses rent from local people. Workers will be chosen from the skilled ones in the region so in this camp number of worker will be also about 30-40 workers/each site.

- In the camp for substation, other ancillary’s constructions such as bathrooms, toilets will be built for workers to use.

- Camp sites will dispose domestic solid wastes that can cause environmental pollution. However these wastes are mainly package materials, leftover food... with small amount.

- Experiences from other similar projects show that this impact was not happened. However subproject owner will work with farmers during construction phase and operation phase to check the problem. In case flooding would occur, Project owner will design proper drainage system to keep water regime as closed as the existing conditions.

4. MITIGATION MEASURESTable 4.1. Mitigation measures

The subproject is very similar to the subprojects of Distribuion Efficiency Project (DEP), which is also supported by loan from the WB. The environmental code of practices (ECOPs) was developed for DEP. During preparation of this EMP, consultant has reffered to these ECOPs and recommended to apply for the subproject.

1 Impacts to vegetation cover and ecological resources

The Contractor shall prepare a Clearance, Revegetation and Restoration Management Plan for prior approval by the Construction Engineer, following relevant regulations. The Clearance Plan shall be approved by Construction Supervision Consultant and followed strictly by contractor. Areas to be cleared should be minimized as much as possible.

Site clearance in a forested area is subject to permission from Department of Agriculture and Rural Development.

The Contractor shall remove topsoil from all areas where topsoil will be impacted on by rehabilitation activities, including temporary activities such as storage and stockpiling, etc; the stripped topsoil shall be stockpiled in areas agreed with the Construction Supervision Consultant for later use in re-vegetation and shall be adequately protected.

The application of chemicals for vegetation clearing is not permitted. When needed, erect temporary protective fencing to efficiently protect the preserved trees

before commencement of any works within the site. No area of potential importance as an ecological resource should be disturbed unless there is

prior authorization from CSC, who should consult with PMUs, and the relevant local authorities. This could include areas of breeding or feeding of birds or animals, fish spawning areas, or any area that is protected as a green space.

2. Impacts of dust The Contractor is responsible for compliance with relevant Vietnamese legislation with respect to ambient air quality.

The Contractor shall implement dust suppression measures (e.g. water sprays vehicles, covering of material stockpiles, etc.) as required. Spray water in construction sites for the substation and its access road during dry and windy weather. Construction vehicles shall comply with speed limits and haul distances shall be minimized.

Material loads shall be suitably covered and secured during transportation to prevent the scattering of soil, sand, materials or dust.

The Contractor shall be responsible for any clean-up resulting from the failure by his employees or suppliers to property secure transported materials.

Exposed soil and material stockpiles shall be protected against wind erosion and the location of stockpiles shall take into consideration the prevailing wind directions and locations of sensitive receptors.

Dust masks should be used where dust levels are excessive.

3 Air pollution All vehicles must comply with Vietnamese regulations controlling allowable emission limits of exhaust gases.

Vehicles in Vietnam must undergo a regular emissions check and get certified named: “Certificate of conformity from inspection of quality, technical safety and environmental protection” following Decision No. 35/2005/QD-BGTVT.

There should be no burning of waste or construction materials or cleared vegetation on site. Cement processing plants should be far from residential areas.

4 Noise and vibration The contractor is responsible for compliance with the relevant Vietnamese legislation with respect to noise and vibration.

All vehicles must have appropriate “Certificate of conformity from inspection of quality, technical safety and environmental protection” following Decision No. 35/2005/QD-BGTVT; to avoid exceeding noise emission from poorly maintained machines.

include silencers, mufflers, acoustically dampened panels or placement of noisy machines in acoustically protected areas.

5 Water pollution The Contractor must be responsible for compliance with the relevant Vietnamese legislation relevant to wastewater discharges into watercourses.

Portable or constructed hygienic toilets must be provided on site for construction workers. Wastewater from toilets as well as kitchens, showers, sinks, etc. shall be discharged into a conservancy tank for removal from the site or discharged into municipal sewerage systems; there should be no direct discharges to any water body.

Wastewater over standards set by relevant Vietnam technical standards/regulations must be collected in a conservancy tank and removed from site by licensed waste collectors.

Using techniques as berms, silt barriers, settlement ponds, drainage channels, minimization of the time soil is left open and unprotected, immediate landscaping an seeding after completion of works, during construction to limit the exposure of disturbed sediments to moving water.

Before construction, all necessary wastewater disposal permits/licenses and/or wastewater disposal contract have been obtained.

At completion of construction works, wastewater collection tanks and septic tanks shall be safely disposed or effectively sealed off.

6 Solid waste Before construction, a solid waste control procedure (storage, provision of bins, site clean-up schedule, bin clean-out schedule, etc.) must be prepared by Contractors and it must be carefully followed during construction activities.

Before construction, all necessary waste disposal permits or licenses must be obtained or hire local environmental services (such as environmental service team of Mai Chau district. which is under management of Mai Chau environmental management division of Mai Chau district) for collection of house hould waste from camp sites and construction waste (if there is any).

to the disposal of all refuse. At all places of work, the Contractor shall provide litter bins, containers and refuse collection facilities.

Solid waste may be temporarily stored on site in a designated area approved by the Construction Supervision Consultant and relevant local authorities prior to collection and disposal through a licensed waste collector, such as environmental service team of Mai Chau district which is under management of Mai Chau environmental management division of Mai Chau district.

Waste storage containers shall be covered, tip-proof, weatherproof and scavenger proof. No burning, on-site burying or dumping of solid waste shall occur. Recyclable materials such as wooden plates for trench works, steel, scaffolding material, site

holding, packaging material, etc shall be collected and separated on-site from other waste sources for reuse, for use as fill, or for sale.

If not removed off site, solid waste or construction debris shall be disposed of only at sites identified and approved by the Construction Supervision Consultant and included in the site specific measures. Under no circumstances shall the contractor dispose of any material in environmentally sensitive areas, such as in areas of natural habitat or in or close to watercourses.

7 Chemicals or hazardous wastes

Chemical waste of any kind shall be disposed of at an approved appropriate landfill site and in accordance with local legislative requirements. The Contractor shall obtain needed disposal certificates.

The removal of asbestos-containing materials or other toxic substances shall be performed and disposed of by specially trained and certified workers.

Used oil and grease shall be removed from site and sold to an approved used oil recycling company.

Used oil, lubricants, cleaning materials, etc. from the maintenance of vehicles and machinery shall be collected in holding tanks and removed from site by a specialized oil recycling company for disposal at an approved hazardous waste site.

Used oil or oil-contaminated materials that could potentially contain PCBs shall follow procedures provided in the EMF to avoid any leakage or affecting workers. The local

DONRE must be contacted for further guidance. Unused or rejected tar or bituminous products shall be returned to the supplier’s production

plant. Relevant agencies shall be promptly informed of any accidental spill or incident. Store chemicals appropriately and with appropriate labeling. Appropriate communication and training programs should be put in place to prepare workers

to recognize and respond to workplace chemical hazards. Prepare and initiate a remedial action following any spill or incident. In this case, the

contractor shall provide a report explaining the reasons for the spill or incident, remedial action taken, consequences/damage from the spill, and proposed corrective actions.

8 Traffic management Before construction, carry out consultations with local government and community and with traffic police.

Significant increases in number of vehicle trips must be covered in a construction plan previously approved. Routing, especially of heavy vehicles, needs to take into account sensitive sites such as schools, hospitals, and markets.

Installation of lighting at night must be done if this is necessary to ensure safe traffic circulation.

Place signs around the construction areas to facilitate traffic movement, provide directions to various components of the works, and provide safety advice and warning.

Employing safe traffic control measures, including road/rivers/canal signs and flag persons to warn of dangerous conditions.

Avoid material transportation for construction during rush hour. Passageways for pedestrians and vehicles within and outside construction areas should be

segregated and provide for easy, safe, and appropriate access. Signpost shall be installed appropriately in both water-ways and roads where necessary.

9 Interruption to utilitiy services

Planned and unplanned interruptions to water, gas, power, internet services: the Contractor must undertake prior consultation and contingency planning with local authorities about the consequences of a particular service failure or disconnection.

Coordinate with relevant utility providers to establish appropriate construction schedules. Provide information to affected households on working schedules as well as planned

disruptions (at least 5 days in advance). Interruptions of water supply to agricultural areas must also be avoided. The contractor should ensure alternative water supply to affected residents in the event of

disruptions lasting more than one day. Any damages to existing utility systems of cable shall be reported to authorities and repaired.

10 Restoration of affected areas

Cleared areas such as borrow pits which are no longer in use, disposal areas, site facilities, workers’ camps, stockpiles areas, working platforms and any areas temporarily occupied during construction of the project works shall be restored using landscaping, adequate drainage and revegetation.

Start revegetation at the earliest opportunity. Appropriate local native species of vegetation shall be selected for the planting and restoration of the natural landforms.

Spoil heaps and excavated slopes shall be re-profiled to stable batters, and grassed to prevent erosion.

All affected areas shall be landscaped and any necessary remedial works shall be undertaken without delay, including green-spacing, roads, bridges and other existing works.

Trees shall be planted at exposed land and on slopes to prevent or reduce land collapse and keep stability of slopes.

Soil contaminated with chemicals or hazardous substances shall be removed and transported and buried in waste disposal areas.

Restore all damaged road and bridges caused by project activities.

Safety Prepare and implement action plan to cope with risk and emergency. Preparation of emergency aid service at construction site. Training workers on occupational safety regulations. If blasting is to be used, additional mitigation measures and safety precautions must be

outlined in the EMP. Ensure that ear pieces are provided to and used by workers who must use noisy machines

such as piling, explosion, mixing, etc., for noise control and workers protection. During demolition of existing infrastructure, workers and the general public must be

protected from falling debris by measures such as chutes, traffic control, and use of restricted access zones.

Install fences, barriers, dangerous warning/prohibition site around the construction area which showing potential danger to public people (such as unfinished power pole foundation, high risk electrical shock areas, etc.).

The contractor shall provide safety measures as installation of fences, barriers warning signs, lighting system against traffic accidents as well as other risk to people and sensitive areas.

If previous assessments indicate there could be unexploded ordnance (UXO), clearance must be done by a relevant army unit.

12 Communication with local communities about Subproject environmental issues

Maintain open communications with the local government and concerned communities; the contractor shall coordinate with local authorities (leaders of local wards or communes, leader of villages) for agreed schedules of construction activities at areas nearby sensitive places or at sensitive times (e.g., religious festival days).

Copies in Vietnamese of relevant parts of these ECOPS should contain in contractor documents and of other relevant environmental safeguard documents shall be made available to local communities and to workers at the site.

Reduced playground space, loss of playing fields and car parking: The loss of amenities during the construction process is often an unavoidable source of inconvenience to users in sensitive areas. However, early consultation with those affected, provides the opportunity to investigate and implement alternatives. In all cases damages shall be compensated.

Disseminate project information to affected parties (for example local authority, enterprises and affected households, etc) through community meetings before construction commencement.

Provide a community relations contact from whom interested parties can receive information on site activities, project status and project implementation results.

Provide all information, especially technical findings, in a language that is understandable to the general public and in a form of useful to interested citizens and elected officials through the preparation of fact sheets and news release, when major findings become available during project phase.

Monitor community concerns and information requirements as the project progresses; Respond to telephone inquiries and written correspondence in a timely and accurate manner. Inform local residents about construction and work schedules, interruption of services,

traffic detour routes and provisional bus routes, blasting and demolition, as appropriate. Provide technical documents and drawings to PC’s community, especially a sketch of the

construction area and the EMP of the construction site. Notification boards shall be erected at all construction sites providing information about the

project, as well as contact information about the site managers, environmental staff, health and safety staff, telephone numbers and other contact information so that any affected people can have the channel to voice their concerns and suggestions.

13 Workforce, camp and site management

Workers‘camps will be located at least 100 m away from schools and health care centres and not be located on steep slopes. The workforce shall be provided with safe, suitable and comfortable accommodations and safe portable water. They have to be maintained in clean and sanitary conditions.

Site offices, worker camps, mixing stations, and workshops shall be located NOT within 100m from any water courses, 500 meters of existing residential area.

Engineers and workers shall register their temporary residence with the local authority. Contractor should sign committeemen with local authorities on keeping of security and

17 Oil, hazardous chemical contamination

Oil containing PCB is not allowed to use for the subproject; Oil refilling (if required) of transformers shall be done in the Workshop. Ussually, after

certain time of operation (5 year in average) the oil inside the transformer might be degraded in term of lower dielectric quality, high content of moisture so the oil must be retrofilled to phase out moisture and other contaminats. After retrofilling, the oil will be reused.

After use, the transformer will be handled to agency that is lisenced to transport and treat used oil as regulated by Cicular 12/2011/TT-BTNMT dated 14/4/2011 on management of hazardous waste.

Design and construct basin under transformers for spill oil collection and central larger basin for oil collection for whole substation as they were described in the approved Subproject technical design report.

Use oil collectors during maintenance services for unexpected oil spills into environment. Carry out regular check and maintenance the transformers so as any leakage and/or failure

risks can be detected timely; Replace or repair transformer as soon as possible after leakage from transformers detected.

Isolate the leakage and fix the problem to ensure that the leakage does not cause pollution in water sources nearby;

6. COMMUNITY CONSULTATION AND INFORMATION DISCLOSURE

During subproject preparation stage (2011-2012), the following activities were carried out:

Activity 1: Investigate and discussion with local authorities about the substation location and power line routing.

Activity 2: Site investigation, preparation of Environmental Management Plan for the Subproject

Activity 3: Organizing public consultation. The subproject will overpass 6 communes and town of Mai Chau district (hoa Binh province) and Phu Thanh commune of Quan Hoa district (Thanh Hoa province). Public consultation in 6 communes of Mai Chau district:Subproject Management Unit and Consultants organized 6 consultation meetings at 6 subproject’s communes. Details of the meetings are described in Table 6.1. Project owner and consultant held public consultation for Environmental management plan of 110 kV Xuan Mai substation and 35 kV power line Subproject. The representatives of Subproject Owner and Consulting Company presented to the public on the following main issues:

Subproject description: route of power line, the substation location, the necessity of construction of the above-mentioned Subprojects;

The potential environmental impacts might be caused by the Subproject; Measures to mitigate the impact.

The comments received in Phu Thanh commune are similar to comments received through public consultation meetings in Mai Chau districts. The Project owner and Consultant received comments and integrated them during updating of the EMP report.

8. ARRANGEMENT FOR EMP IMPLEMENTATION

8.1. Responsibilities for Implementing the Environmental Management PlanNon-compliance by the contractor could result in suspension of works, financial penalties, or other penalties, as must be clearly spelled out in the EMP and in the contract.

Contractors are responsible for implementation of EMP. The responsibilities for monitoring EMP implementation are typically shared between the contractor, the PMU, and the Construction Supervision Consultant (CSC). The Contractor’s Work Plan should incorporate the guidelines provided in the EMP created for the subproject. The designated Technical Officer(s) and Safeguards Officer(s) of the PMU are responsible for supervising the adherence to the agreed EMP by the selected contractor(s). The World Bank may periodically supervise implementation activities of the subproject.

At a minimum, the contractor should prepare a monthly report on adherence to EMP which should be submitted to the CSC and to the PMU. Subproject-specific or contract-specific reporting requirements are described in the EMP. CSC is responsible for monitoring overall environmental performance of the project and submit to PMUs quarterly monitoring reports.

To ensure effective implementation of the EMP, the following actions will be carried out during the implementation of the subproject:

8.1.1  During Detailed Design and Preparation of Bidding Contract Documents

During the detailed design and bidding invitation preparation, the project management unit will be responsible for incorporate the EMP (mitigation measures, responsibilities of the contractor) into the attached annexes in the bidding invitation and contract signed with the contractor. Engineers taking charge of the detailed design will also refer to findings in the EIA and EMP to ensure environmental issues will be looked at in the final design.

During the bidding invitation preparation and the contract, it is necessary to ensure the contractor is fully informed of its responsibilities in implementing environmental mitigation measures and its commitment to compliance.

8.1.2  During Construction Phase

PMU will assign the Construction Supervising Consultant (CSC) and/or field engineer to be responsible for supervision of safeguard performance of contractor on a daily basis. A generic Terms of Reference (TOR) is provided in Annex 2. CSC and/or field engineers will carry out, but not limited to, the following tasks:

-  Before the commencement of the construction, confirm that all compensation for land and facilities are provided and relocation and/or land acquisition/donation has been completed.

-  Closely supervise the implementation of safeguard measures throughout the construction period. 

-   Confirm the compliance with the EMP and inspect for any damages caused by the contractor.

- If necessary, prepare a minutes to ask the contractor to compensate or rehabilitate as provisions of the contract. Contractor safeguard performance will be included in the subproject progress report.

APPENDIX 2:

TOR for Construction Supervision Consultant

(CSC)General

The Construction Supervision Consultant (CSC)) is to provide professional technical services (“the Services”) to help ensure effective implementation of the ECOP and subproject EMPs.

Scope of Services:

The general services to be provided by the CSC are to inspect, monitor the construction activities to ensure that mitigation measures adopted in the ECOPs/EMP are properly implemented, and that the negative environmental impacts of the project are minimized.

On behalf of the PMU, the CSC will conduct the following tasks:

- Conduct regular site inspections;

- Review the status of implementation of environmental protection measures against the EMP and contract documents;

- Review the effectiveness of environmental mitigation measures and project environmental performance;

- As needed, review the environmental acceptability of the construction methodology (both temporary and permanent works), relevant design plans and submissions. Where necessary, the CSC shall seek and recommend the least environmental impact alternative in consultation with the designer, the Contractor(s), and PMU;

- Verify the investigation results of any non-compliance of the environmental quality performance and the effectiveness of corrective measures; and

- Provide regular feedback audit results to the contractor’s Chief Engineer according to the ECOP and site-specific mitigation measures;

- Instruct the Contractor(s) to take remedial actions within a specified timeframe, and carry out additional monitoring, if required, according to the contractual requirements and procedures in the event of non-compliances or complaints;

- Instruct the Contractor(s) to take actions to reduce impacts and follow the required EMP procedures in case of non-compliance / discrepancies identified;

- Instruct the Contractor(s) to stop activities which generate adverse impacts, and/or when the Contractor(s) fails to implement the EMP requirements / remedial actions.

- For contracts that Site Environmental Management Plan (SEMP) are required, the CSC shall provide the final review and recommend clearance of all Site Environmental plans which may affect the environment. These include, but are not limited to: dredging areas, borrow pits and disposal sites, worker’s camp plans. The CSC will review and approve the SEMP presented by the Contractors. Where these plans are found not to comply with the EMP, EIA or RAP, the CSC shall work with the PMU and Contractor to establish suitable measures or remediation.

- Addressing Complaints: Complaints will be received by the Contractor’s Site Office from local residents with regard to environmental infractions such as noise, dust, traffic safety, etc. The Contractor’s Chief Engineer or his deputy, and the CSC shall be responsible for processing, addressing or reaching solutions for complaints brought to them. The CSC shall be provided with a copy of these complaints and shall confirm that they are properly addressed by the Contractors in the same manner as incidents identified during site inspections.

- Certification for Monthly Payments: The CSC shall confirm the monthly payments for environmentally related activities implemented by the Contractor.

- Reporting: the CSC shall prepare the following written reports:

o Bi-weekly report of non-compliance issues

o Summary monthly report covering key issues and findings from reviewing and supervision activities

o At the end of the project the CSC shall prepare a final report summarizing the key findings from their work, the number of infringements, resolutions, etc. as well as advice and guidance for how such assignments should be conducted in the future.
