Spring time is sprinkler time, but the Albuquerque Bernalillo County Water Utility Au-

thority reminds customers to water only in the morning and evening starting from April 1

through October 31. This is to minimize water lost to wind and evaporation. Violators can face

fines starting at $40 for a first offense up to $4,000 for ninth offenses and beyond. Fine is

Yes, there is a bi-monthly Tanoan Talk Newsletter, but that does not give immediate informa-

tion-sharing other than when it is printed.

not be available to any other resident. You, however, would be in the loop for your own peace

the tCa Board of Directors meets on the 3rd Thursday of every month. Each meeting is held at the Association office at9820 Murifield Ct. NE at 7:00 p.m. The meetings generally last less than one hour.

All meetings of the Board of Directors are public open meetings. Residents are encouraged to observe the posted meeting dates andtimes. Residents who wish to address the Board are welcome to do so during the homeowner open forum conducted at the end of eachbusiness Board meeting.

Tanoan Ladies’ Coffee and The Chatty Chicks Our regular Tanoan Ladies’ Coffee Hour is held on the second Thursday of each month at 10:00 a.m. in

the Association Office. Mark your calendars for June 13th and July 11th.

Message from ManagementPAUL SKOJECAssociation Manager

Thank you all for the beautiful work you are

doing on your homes, landscaping, and compli-

ance with the rules of the community. During

the past three years we have experienced sig-

nificant freeze damage to a variety of plant ma-

terial and significant drought conditions that

have stressed the beauty of the landscaping.

Please continue to take a good look at your landscape, it is time to

remove and replace all dead plant material that we have antici-

pated would come back to life.

Thank you to every resident that takes pride in revitalizing your

home and landscaping. Everyone’s property values benefit when

the neighborhood is well cared for, and the positive impression

of a beautiful neighborhood is striking when you enter the

Tanoan community.

Garbage and Waste Management Issues:Please be reminded, it is a requirement of the Rules and Regula-

tions of the Tanoan Community Association that all trash/recycle

carts must be screened from view from the street and that means

it needs to be either in your garage, or behind a fence or screen,

which includes your side yards. If you have a side yard gate

where you store your trash/recycle carts, please ensure that there

is sufficient screening on the gate so that no trash/recycle carts

can be seen from the street.

Please make sure your trash/recycle carts are removed promptly

after collection day. Additionally, keep your front and side yards

free of clutter. There is a noted increase of an accumulation of

household treasures in the side yard areas of many homes. It is

time to organize and clean out these areas so that items do not ac-

cumulate and become an eyesore or pest problem.

Do you bag your trash? In an effort to keep the community litter

free, especially when the trash is collected on Tuesdays, all trash

should be placed in a plastic bag and securely tied.

Did You See That Person in the Street?Please slow down on all streets in Tanoan and encourage others

to do the same. Summer is here and school is out. We will have

many more children playing, riding bikes, skateboards and scoot-

ers, and residents walking and jogging in the community. Keep

our children and neighbors safe!

Lawn CareDuring the summer months everyone needs to ensure that they

are regularly mowing, weeding, pruning, and watering their proper-

ties; front, back and side yards.

Preferred Standards for Landscaping1. Lawns will be green, reflecting adequate watering,

fertilization and aeration.

2. Lawns will be mowed and trimmed on an approximate

weekly basis.

3. Lawns will have minimal or no weeds. Lawns will not contain

any patches of weeds.

4. Lawns will have no bare or dead spots continuing for longer

than three weeks. Owners should reseed or resod any bare

or dead spots.

5. Landscaped areas, including rock and flowerbeds, and

vegetable gardens will be kept weed free.

6. Dead or dying plants shall be removed within thirty days and

replaced as necessary.

In Closing…I wish to make each of you aware of the fact, that I have accepted

a new management opportunity with Homeowners Association

Management Company (HOAMCO), here in Albuquerque, New

Mexico. I start on June 3, 2013 and will be the Executive Director

of Client Services | NM Division. I will play an active role in strate-

gic planning, business growth and corporate governance with a

focus on operational excellence in customer and employee en-

gagement, financial performance, property management and com-

pliance with legal and governing documents for all of HOAMCO’s

portfolio management functions of its New Mexico operations.

Thank you for every opportunity that has been extended to me

during my time of employment with the Tanoan Community Associ-

ation. My experience has been rewarding and productive, and I

wish only the best for this beautiful community.

A group of ladies respectably referred to as

the “Chatty Chicks” of Tanoan, have a group

of book lovers that seek to nurture neighbor-

hood camaraderie by creating a mini lending

library (free book exchange) located in the

Association office.

There are no rules to the mini lending library.

There is not a Dewey Decimal System. Any-

one could drop a book off and someone

could pick it up five minutes later. Only the

universe knows what has been exchanged.

Books are always free and do not need to be

returned. Books are accepted that you just

want to share with others. The mini lending li-

brary provides neighborhood residents and

visitors with an ever evolving selection of titles,

free for the taking. In exchange, neighbors re-

stock it with their own books, giving new life to

stories that otherwise would rest forgotten on a

living room bookshelf or coffee table.

Stop by the Association office and visit the

mini lending library today!

Free Book Exchange

Hello everybody! I hope you are all en-

joying the summer as I am. This is a

beautiful time of year with everything green

and all the flowers in the community

blooming; it is my favorite time of year

around the community.

Walkers and JoggersThis time of year there are those who really get into the walking

and jogging. It is important that residents enjoying this activity uti-

lize the sidewalks as much as possible and if you have to be in the

streets stay as close to the side of the street as possible please.

Be considerate of the motorist.

Motorist are reminded that this time of year walkers and joggers

are out and about, so please drive carefully. Be sure to stop at all

stop signs and to not operate your vehicle in excess of 25mph.

Pet ControlWe have experienced some incidents this spring when loose dogs

have attacked and injured residents. This is to remind all pet own-

ers that your pets are not to be off your property and loose. Tanoan

Rules are very explicit regarding this, stating, “Animals are not al-

lowed to be free in the community at any time. Except when on its

owner’s lot, an animal must be carried or on a leash and attended

by a responsible person. In particular, an animal must be leashed

and accompanied by its owner while on any Tanoan common

area.” There is no need for any resident to be afraid while out walk-

ing, jogging, or walking their own pet. Please be considerate of all

your neighbors and control your pets.

Dog Clean Up/BarkingWe continue to receive complaints from residents that folks fail to

clean up after their pets. Owners of pets are required by Associa-

tion rules to keep pets on a leash and to always clean up after

them. Failure to comply with these rules can result in a citation

being issued by the Community Patrol.

Additionally, residents are reminded about the Association rules re-

garding the persistent barking of dogs. The association rules pro-

hibit this, and violators of that rule can be issued a citation.

Vehicle SecurityWe have had a few vehicles that have been left unlocked in the

community and sadly, unknown persons have entered them. Folks

please, when you park your vehicles, roll up your windows and

lock all your doors. Do not leave expensive items in the vehicle vis-

ible from outside, i.e. golf clubs, laptops etc. While talking about

security I remind all residents to please close your garage doors.

From Our NeighborsYou’ve heard it before. However, the pleas (and the please) from your neighbors continue to come in. Many of us are dog lovers, butplease protect our lawns. 1. “Curb” your dog in your backyard. Do not let your dog use the front lawn or the common green space —even if it’s near your home. Damaging these areas affects the whole neighborhood. 2. Do not allow your dog to use your neighbor’syard as a bathroom. It’s a common courtesy.

Vacation FormsResidents who are planning vacations are reminded to please

complete a vacation form. This will assist the Community Patrol in

checking your residences during your absence. Further, it will as-

sist the Academy Gate attendant when checking in visitors, know-

ing who is home and who is not. Also in case of emergency it will

assist in the contacting of responsible people.

Stop SignsI received a question recently regarding a stop sign citation as to

the location of Tanoan Lane. Tanoan Lane is the street entering

Tanoan at the Ventura Gate, and there is a stop sign there.

Recreation VehiclesWell, it is that time of year again when recreation vehicles start to

appear in greater numbers in Tanoan and residents start utilizing

them for summer enjoyment. Residents are reminded that recre-

ation vehicles may only be on the property for 48 hours for the pur-

pose of loading and unloading. Residents are reminded the

recreation vehicles are to enter the Community through the Acad-

emy Gate only and are to receive an RV pass before entering. If

the Gate attendant does not offer the pass, please ask for one.

Residents’ cooperation in this matter will be greatly appreciated.

Homeowners Association Act

IDENTITY THEFT . . . WHAT DOES IT MEAN?Identity theft is one of the fastest growing crimes in our country

today. It is also one of the most difficult to detect until it is too lateand the damage is done. The time and energy to correct damagedcredit and to reestablish your personal identity is reason enough totake steps to prevent frustrating crime. Identity theft occurs whensomeone uses your personal identifying information, like yourname, Social Security number, or credit card number, without yourpermission, to commit fraud and other crimes,

For identity thieves, your personal information is as good as gold.How do the steal your identity? It can start with dumpster divers

rummaging through trash; diverting your billing statements by com-pleting a change of address form; and old-fashion stealing of wal-lets and purses,

Once the information is obtained, thieves may use your informationto open new credit card accounts or create counterfeit checks usingyour name or account number.

Remember to protect your information by shredding papers withpersonal information that is no longer needed including charge re-ceipts, bank statements, etc. Once a thief takes it, it can be yearsuntil you get back.

Section 4: Recording or Filing of Homeowner association no-

tice and Declaration

Any association formed/established AFTER July 1, 2013 mustrecord notice with the county clerk within 30 days. EXISTING as-sociations need to record with the county clerk within the next year,before June 30, 2014. Including in the filing is the disclosure of themanagement company charged with preparation of disclosure doc-uments and subdivision place and declarations. By failing torecord a notice the association’s authority to charge an assess-ment, fine or enforce a lien for nonpayment shall be suspendeduntil notice is recorded.

Section 5: Record Disclosure to Members

Requires disclosure to all members and be available for lot ownerswithin 10 business days of the request. Not fee shall be chargedfor making the records available for review but a reasonable feemay be charged for copies. A list of the 11 items for discloser canbe found in this section.

Section 6: Duties of a Homeowner association

Allows association to exercise powers as conferred in the docu-ments, including lien a lot for assessments or fines. By recordingthe declaration this constitutes notice for the lien. Upon 10 busi-ness days of receipt of written request by lot owner, a statement ofunpaid assessments shall be furnished and considered binding.

Section 7: Duties of Board Members and Officers / Budget

Board members shall perform their duties with fiduciary to the lotowners. A budget shall be adopted annually and within 30 calen-dar days after adoption a summary shall be provided to all owners.

Section 8: Declarant Controlled

Regardless of what is noted in the declaration, the declarant shallterminate control no later the earlier of:

60 days after 75% of the lots are owned by someone other thanthe declarant.

2 years after they have ceased to offer lots for sale.

2 years after development right to add new lots was exercised.

The day the declarant gives written notice voluntarily terminatingtheir rights.

*Section 9: Proxy and absentee voting

Proxy and absentee ballot shall be allowed.

*Section 10: Financial audit

A community of 100+ lots has do a financial audit, review or compi-lation of the association annually within 180 days of the associa-tion fiscal year, unless specified in the community documents to bean audit by a CPA. For those under 100 lots, upon majority votethe board shall provide a financial audit, review or compilation ofrecords.

Section 11: Contract Disclosure Statement

Seller shall provide a disclosure certificate from the association nolater than 7 days before closing, buyer can cancel the contractwithin 7 days after receiving the certificate.

Section 12: Sale of Lots

Within 10 business days after receipt of written request fromowner, association shall furnish a disclosure certificate. Associa-tion may impose reasonable charges for preparation of the certifi-cate.

Section 13: Purchasers Cancellation of Contract

If a buyer cancels, they may do so by hand delivering notice to seller,without penalty and payment shall be refunded within 15 days.

*Section 14: attorney Fees and Costs

A court may award attorney fees and costs to any prevailing partyin a civil action provided in the declaration or bylaws.

Section 15: applicability

*Sections 9, 10 and 14 do not apply to existing associations cre-ated before July 1, 2013, provided any amendment to communitydocuments comply with this act.

Sections 4 and 8 do not invalidate existing provisions.

Does not apply to condominiums which are governed by the Con-dominium Act.

The New Mexico Legislative session officially ended on March 16 and any legislation not signed or vetoed by the governorby April 5th was pocket vetoed. In regards to Homeowners Associations, SB 497 also known as the Homeowner Associa-tion Act was approved and will go into effect on July 1, 2013.
