1) General Information This agreement is between Tamsen Connects (Tamsen Taylor, “I”, “me”), the purchaser of the gift card (Purchaser) and the person receiving or using the gift card (Recipient). Tamsen Connects offers gift cards for sale in several denominations ($10, $20, $50). These gift cards are intended to be valid for use at any of the Tamsen Connects Network Businesses (also called Service Providers in this document). Gift cards are available on the Tamsen Connects website (www.TamsenConnects.ca). Gift cards are plastic cards with the Tamsen Connects logo and a denomination. Unless otherwise arranged with Service Providers (see Section 4, Redeeming Gift Cards) the entire value of the card must be used at one point of purchase by the Recipient (one Service Provider and one purchase occasion). The cards must be surrendered to the Service Provider at the point of payment. I reserve the right to change or update the gift card terms of use without notice.
2) Disclaimer I cannot claim responsibility for the performance of the service providers in the Tamsen Connects Online Directory. I have included companies here in good faith, but I have not necessarily used every service. It is also possible that my opinions and preferences differ from yours and as such we would view the same service differently. Each individual service provider is responsible for their own performance. If you are unhappy with the performance of a Service Provider, please contact them for remediation.
3) Purchasing Gift Cards Gift cards are available in three denominations: $10, $20, and $50. Gift cards are available in Canadian Funds only. At the time of purchase, the Purchaser must select a delivery option (i.e., will the card be delivered to the Purchaser or the Recipient). Delivery to Ontario locations is
included in the base shipping and handling fee. Other delivery options are available at additional cost. It is assumed that gift card purchases are also being made within Ontario. It is certainly possible to order gift cards from other locations, but that may involve different fees (e.g., additional postage, changes in tax rate). If the gift card is to be sent directly to a Recipient, options for including a decorative note card with a personalized greeting are available at additional cost.
4) Redeeming Gift Cards Gift cards are not returnable or redeemable for cash. Gift cards are valid only at Service Providers that belong to the Tamsen Connects Network at the time the gift card is redeemed. Service Providers in the Tamsen Connects Network can be found in the Tamsen Connects Online Directory: http://www.tamsenconnects.ca/directory/ When a Recipient wishes to redeem a gift card, the Recipient must give the Service Provider from whom the Recipient is planning to redeem the gift card at least 48 hours notice (not counting weekends or holidays; i.e., two business days) that the Recipient will be using a gift card. Please inform the Service Provider of the denomination of the card, and the identifying number on the card. If less than two business days notice is given before a Recipient attempt to redeem a gift card, the Service Provider may refuse to accept the gift card as payment. The gift card can be used by someone other than the Recipient. If a Purchaser or Recipient has lost a gift card or had a gift card stolen, they may report the card as lost or stolen (see Section 5). Unless other arrangements have been made with the Service Provider, the entire value of the card must be used at one point of purchase (one Service Provider and one purchase occasion). The cards cannot be partially used. As noted in Section 4a) below, it is up to the discretion of the Service Provider if they will make accommodation if a Recipient wishes to redeem gift cards in greater value of the service the Service Provider is performing. If a service costs more than the value of the gift card, the difference must be made up by the Recipient in a manner acceptable to the Service Provider (i.e., a Service Provider might not accept credit cards).
When a card is used it must be surrendered to the Service Provider at the point of purchase.
4a) If a gift card is more than the cost of the service
Exchange cards for cards of a lower denomination: If a Recipient has $20 or $50 gift cards and they wish to exchange them for gift cards of lower denomination, the Recipient may contact me at [email protected] and we can make arrangements for an exchange. If the exchange has to be done by mail then additional charges to cover postage and handling will apply.
Use at a future visit: If there is a situation in which a Recipient has gift cards of greater value than an intended purchase, the Recipient may be able to arrange ahead of time to add the extra value on to a future purchase point with the same Service Provider. For example, if a service costs $60, and a Recipient has two $50 gift cards, it might be possible for the Service Provider to accept the $100 in gift cards and use $40 toward the next service visit. The Recipient is responsible for ensuring that they get a receipt or some indication that they have overpaid, which can be presented to the Service Provider as a reminder that a portion of the next service visit has been prepaid. Such an arrangement is up to the Service Provider, and they are within their rights to decline to make such an arrangement. The Service Provider may place a time limit on the use of the extra funds at the time of negotiation (e.g., 30 days). Such a time limit on the use of the extra funds should be NO LESS THAN 30 days. If no time limit is imposed by the Service Provider, a DEFAULT TIME LIMIT of 90 days applies. If the Service Provider wishes, they may exceed the default time limit of 90 days.
“Make change”: Another option if a Recipient wishes to use gift cards of a greater value than an intended purchase, the Recipient may be able to arrange ahead of time so that the Service Provider can “make change” with gift cards of a lower value. For example, if a service costs $60, and a Recipient has two $50 gift cards, the Service Provider could give the Recipient four $10 gift cards at the point of purchase. NOTE: if a Recipient wishes to use this option, additional time (up to 5 business days) might be required so that the Service Provider has the correct gift cards available. ALSO NOTE: change is only available in gift card denominations, and $10 is the lowest denomination available. Therefore, any change less than $10 will have to be surrendered by the Recipient. That is, if a Service Provider needs to make $9 in change, that $9 would be sacrificed by the Recipient, and no change will be given. Again, such an arrangement is up to the Service Provider, and they are within their rights to decline to make this type of arrangement.
5) Lost or Stolen Cards Tamsen Connects or Service Providers cannot claim any responsibility for lost or stolen gift cards. Lost or stolen gift cards cannot be redeemed or refunded. If you lose a Tamsen Connects gift card, you may contact me at [email protected] to report the card as lost or stolen. If you are attempting to use a gift card and it has been reported as lost or stolen then Service Providers are not obligated to honour it. If you believe there has been an error please contact me at [email protected] and I will be able to discuss your concerns.
6) Privacy Policy Information submitted by the Purchaser when purchasing or discussing gift cards will not be sold or shared with third parties. When a Service Provider is contacted to redeem a gift card, they may wish to verify that the gift card is valid. The Service Provider can contact Tamsen Connects to determine the status of the gift card. No information about the Purchaser or Recipient will be communicated, but the status of the gift card ID number will be verified. In cases where a third party is involved (e.g., a Purchaser special orders a decorative notecard to accompany the Tamsen Connects gift card when it is sent to the Recipient) then information will pass between the decorative gift card provider and myself so that the order can be fulfilled. The information will not be sold or otherwise distributed.
7) Security Policy Payments made to Tamsen Connects are administered through a program called MoonClerk. Their security policies can be found here: http://help.moonclerk.com/customer/portal/articles/796016-‐what-‐kinds-‐of-‐security-‐measures-‐does-‐moonclerk-‐provide-‐
Note that MoonClerk uses Stripe to process payments. Stripe’s information can be found here: https://stripe.com/help/security Note that Tamsen Connects uses these financial services, which are responsible for the security of the Purchaser’s financial information. The end responsibility for the security of financial information rests with Stripe and MoonClerk. I do not ever have direct access to the Purchaser’s financial information (i.e., the Purchaser’s credit card number). By making payments through the Tamsen Connects website the Purchaser accepts the policies of MoonClerk and Stripe and also agrees that Tamsen Connects cannot be held responsible for the Purchaser’s financial information. Other information that may be submitted to Tamsen Connects through the Tamsen Connects website will be held through the SquareSpace website and privately through a password-‐protected computer system. It is unlikely that an outside source will gain access to address or email information. However, in the event of a security breach (e.g., SquareSpace is “hacked”), the Purchaser and Recipient agree not to hold Tamsen Taylor or Tamsen Connects responsible for the lost data.
