Zambelli Fireworks is requesting permission to exhibit a fireworks display in conjunction with the Bradenton Riverwalk Regatta, on Februaty 7, 2015 at approximately 6:35 PM.

Enclosed please find the permit application, insurance documentation, site map, pyrotechnician's resume, shell listing, USCG approval, FAA Application, MSDS sheets and A TF License. Once you have reviewed this information and granted us permission to exhibit this display, please fax me a copy of the approved permit to (561) 395-0955

Please note that both the Certificate of Insurance as well as the A TF license are set to expire on 2/1/15. As soon as I receive the updated insurance templates and ATF extension letter, I will forward them directly to you.

Steps to be taken by Firework Company:

+ Contact Lockheed Martin Flight Service at (877)-487-6867 at least 48 hours (but no more than 72 hours) prior to the event to issue a Notice to Airmen (NOT AM).

+ Fireworks staff should remain vigilant to ensure that no aircraft are in the area prior to beginning the fireworks display

Our office has no objection to this event provided all the above notifications and precautions are met.

This letter disposes of the Federal Aviation Administration's interest in this matter but should not be constmed as superseding or invalidating any existing mles or regulations promulgated by any other federal, state, county or municipal govenunent, which may be required for this display.

SUM~L~RY: The Coast Guard is establishing a special local

regulation on the waters bf the Manatee River in Bradenton,

Florida during the 3rade:1ton Jl.rea Ri verwalk Regatta. The race

is scheduled to take place a:::1t:ally from 11 a.m. to 7:30 p.m. on

the first Saturday of February. The special local regulation is

necessary to protect the safety of race participants,

participant vessels, spectators, and the general public on the

navigable waters of the Cnited States during the event. The

special local regulation will restrict vessel traffic in the

waters of the Manatee River in the vicinity of Bradenton,

Florida. It will establish the !allowing two areas: en!orce~e:;t

areas #1 and #2, where all persons and vessels, except those

persons and vessels participating in the high speed boat races

The Coast Guard is establishing this Special Local

Regulation on the waters of the Gulf of Mexico in the vicinity

of Manatee River, Florida during the Bradenton Riverwalk

Regatta. On November 26, 2014, the Coast Guard published a

notice proposing this final rule. No comments were received.

The race is scheduled to take place annually from

approximately 11 a.m. to 7:30 p.m. on the first Saturday of

February. This rule is necessary to protect the safety of race

participants, participant vessels, spectators, and the general

public on the navigable waters of the United States during the

event.

3. Basis and Puroose

The legal basis for the rule is the Coast Guard's authority

to establish special local regulatio~s:

33 u.s.c. 1233.

The purpose of the rule is to provide for the safety of

life on navigable waters of the United States during the

Bradento~ Riverwalk Regatta.

C. Comments, Changes and the Final Rule

The Coas~ Guard received no comments related to this event

during the comment period.

D. Regulatory Analyses

We developed this rule after considering numerous statutes

and executive orders related to rulemaking. Below we summarize

our analyses based on a number of these statutes or executive

orders.

1. Regulatory Planning and Review

This rule is not a significant regulatory action under

section 3(£) of Executive Order 12866 1 Regulatory Planning and

Review,· as supplemented by Executive Order 13563, Improving

?..egulation and Regulatory Review, and does not require an

assessment of potential costs and benefits under section 6(a) (3)

of Executive Order 12866 or under section 1 of Executive Order

13563. The Office of Management and Budget has not reviewed it

under those Orders.

2. Imoact on Small Entities

Under the Regulatory Flexibility Act (5 u.s.c. 601-612), we

have considered the impact of this rule on small entities. The

Coast Guard certifies under 5 U.S.C. 605(b) that this rule will

not have a significant economic impact on a substantial number

of small entities.

rule does not have implications for federalism.

The Unfunded Mandates Reform Act of 1995 (2 U.S.C. 1531-

one year. Though this rule would not result in such expenditure,

We have analyzed this rule under Department of Homeland

Security Management Directive 023-01 and Commandant Instruction

Nl6475.1D, which guide the Coast Guard in complying with the

National Environmental Policy Act of 1969 (NEPA) (42 u.s.c. 4321-

4370£), and have made a determination that this action is one of

a category of actions that do not individually or cumulatively

have a significant effect on the human environment. This rule is

categorically excluded from further review under paragraph 34(h)

of Figure 2-1 of the Commandant Instruction. A environmental
