WELCOME TO THE VILLAGE AT RIVERWALK CONDOMINIUM COMMUNITY

You have chosen condominium living, and for some this will be your first experience in this type of community. This handbook is designed to provide general information about condo living, and a list of guidelines and regulations adopted by the board of directors to ensure the maintenance of all common areas and a quality living experience for all residents. Most people move to a condo because they no longer want the rigors of yard work and outside maintenance associated with a home on private property. In that regard your monthly fee covers major outdoor maintenance such as lawn mowing, snow removal, and the upkeep of roofs and the outside of all buildings and common property. The information in this handbook will provide a condensed overview of what is expected of unit owners in order to maintain the uniformity of appearance and general quality of life at VRW. This manual is not designed to cover all possible situations that may require board of directors’ attention, nor does it preclude any future board action to resolve individual issues of concern. VRW maintains its own website at www.villageatriverwalk.com. It is a comprehensive site that includes general information on a variety of subjects plus archived information on board minutes, financial statements and association bylaws. To create your own account log on to the website and click on the link in the left margin “Create Account.” Should you need further assistance please contact the current website administrator for help in establishing a username and password. It is the goal of the board of directors to maintain a comfortable, attractive, but generally standard outdoor living environment for all unit owners, while at the same time allowing some individuality and creativity in outside décor. Voluntary compliance with basic VRW guidelines and regulations will go a long way toward ensuring a positive living environment for all. 1

A BRIEF HISTORY

The Village at Riverwalk was originally designed as an EPCON community consisting of a clubhouse, swimming pool, and fifteen buildings with four individual units in each building (60 units). Shawnee Township approved the plans as a Planned Use Development (PUD) project and the original bylaws of VRW were signed on March 18, 2005. The project was underwritten by a group of investors from Columbus, Ohio led by Mr. Mike Zieg, and the original project developer was Mr. Terry Whaley. The first structures built were the clubhouse and swimming pool, followed by quad buildings 1 and 2 which sit aside the retention pond along Zurmehly Road. Some time later, after it was discovered that the placement of the clubhouse and swimming pool was not exactly according to the original architect drawings, a quad that was planned to be built next to the swimming pool had to be changed to a duplex because of a lack of space, thereby reducing the projected build out of VRW to 58 units. The association grew steadily from 2005 through 2008 to nine quads and one duplex, but a downturn in the economy in 2009 led to an extended period of reduced capital funding sources and forced the franchise owners to rezone the remaining property so that stand-alone units could be built. Five such units were constructed and sold between 2010 and 2014. For the first five years, the franchise owners ran VRW with input from one resident owner. However, since 75 percent of the projected build out was not yet complete after five years, the bylaws required that a local homeowner’s association then be formed to take over the administration and operation of VRW. The first board meeting of the new association took place on April 6, 2010. The board of directors consists of six unit owners with staggered three-year terms so that two members go off and two new members come on each year. In December, 2014, the franchise owners sold the remaining VRW building lots, but not the EPCON franchise, to a local investor, Mr. O. Roger Wright. Nine more stand-alone units and one more quad, which will closely resemble but not be identical to existing buildings so as not to infringe on EPCON design copyrights, will eventually complete VRW, giving the association a total of 56 units. 2

CONDO LIVING – 101

For those who are new to owning a condominium and living in a community with an association of fellow owners elected to oversee the operation of the association, here are a few guidelines to help you get accustomed to your new home. The most important thing to understand is that living in a condominium association is NOT the same as living in an apartment complex.

The homeowners association exists for the purpose of managing the common property, setting basic guidelines and regulations for the use of common facilities, and ensuring that essential services such garbage collection, lawn mowing, snow removal, pavement maintenance, and exterior unit maintenance are performed. The homeowners association does not function in the same role as a landlord. Anything that requires maintenance or repair on the inside or your home, such as heating and cooling equipment, appliances, flooring, windows and doors, is up to you to fix or replace, just as if your home sat on your own private lot. Because we live close together, the essence of a good quality of life in a condominium setting requires the respect of each of us for our neighbors. This handbook outlines a basic set of guidelines and regulations that the board of directors has adopted with just one purpose in mind – to define the framework for a quiet and pleasant living experience at VRW. The only reason penalties for violating VRW guidelines and regulations are in place is to give the board a source of recourse if common sense adherence to these few guidelines are willfully ignored. Like most condo communities, those who are inclined to socialize have several opportunities to do so here at VRW on a regular basis. For those who prefer a more personal lifestyle and aren’t into potluck dinners and other group activities, we fully respect and understand that choice. VRW ADMINISTRATION

Board of Directors The Village at Riverwalk Association includes all unit owners and is run by a six-person board of directors made up of unit owners. The board’s responsibilities include enforcing association bylaws, creating regulations regarding the use and upkeep of VRW common elements, and ensuring that all common elements are maintained and cared for in a manner consistent with established VRW property values. Terms Each director is elected for a three year term and directors’ terms are staggered so that two members go off the board each year and two new members are elected. Board positions are voluntary and board members receive no financial compensation. Annual Meeting VRW holds an annual meeting for all unit owners in the clubhouse sometime during the month of January at a time approved by the board of directors. A review of VRW finances, an explanation of the coming year’s budget, and election of new board members takes place at the annual meeting. Paid Employees VRW employs a business manager who prepares initial yearly budgets, keeps all financial records, hires vendors to perform maintenance tasks, and supplies financial institutions with necessary paperwork regarding requested mortgage loans or refinancing. VRW also employs a person to maintain the swimming pool. Committees VRW has three working committees – Buildings and Grounds, Clubhouse and Pool, and Social. These committees are in need of members who have an interest or expertise in these areas, but who do not necessarily wish to run for the VRW board. WHAT WE OWN INDIVIDUALLY

In a condominium, a parcel of land is divided into units (each of which is individually owned) and common elements (which are collectively owned by all the unit owners). Each unit owner receives title to a unit, together with a fractional share of all the common elements. That fractional share is called the unit owner’s common element interest. A unit and its common element interest is considered “undivided.” This means that a unit and its common element interest cannot be sold separately from each other. So, what we own is our unit and the fractional property the unit sits on.

YOURS, MINE AND OURS

The common elements consist of all the portions of the condominium which are not included within the individual units. The common elements include portions of the buildings other than the items located inside the units themselves, parking areas, the clubhouse, the swimming pool, recreation areas, etc. The association is responsible for maintaining the common areas, which includes the trees, lawns at the front of the neighborhood along Zurmehly Road, the retention ponds and surroundings, and several parcels throughout the community of what is called “useable open space.” Certain common elements are called “limited” common elements. Like the common elements, each limited common element is owned by all of the unit owners in proportion to their respective common element interest; however, the use of limited common elements may be restricted to one or more (but not all) of the unit owners. The limited common elements are areas such as sidewalks and drives immediately behind the garages. So, the area we might normally call our yard really belongs to everyone, proportionately. Please consider this when you have guests as it relates to where they park, how much noise you make, and how you may be inconveniencing your neighbor.

CONDO FEES AND WHAT THEY COVER

The VRW condo association’s fiscal year begins on January 1st and before each annual meeting of the association, the board of directors adopts the budget for the association. The board is obligated to provide each owner with a copy of the proposed budget at or prior to the annual meeting. The budget estimates the total amount considered necessary to meet the obligations for the next fiscal year. Based upon this budget, the board passes a condo fee resolution whereby each unit owner is responsible for a condominium fee in proportion to his/her common element interest. This condo fee is generally paid monthly and is due on or before the first of each month. After the 5th day of each month, a late fee may be applied. In general, the condo fee covers the following:

INSURANCE COVERAGE ON YOUR CONDO

The VRW condo association maintains an “umbrella” insurance policy that covers

the exterior of all units and all common areas. This insurance carries a reasonable deductible and covers repair and replacement costs in the event of a catastrophic disaster. The association maintains ample surplus in our “Capital Improvement” account to cover the deductible. Individual owners need to maintain a personal Condominium Insurance Policy to cover any issues that might arise in their units. The specific coverage needed is up to the individual owner and should be referred to your insurance agent.

The association is not responsible for repairs inside of a unit (such as drywall

repairs), even if caused from the exterior of the unit (such as a pipe burst or roof leak), unless damage is caused by the negligence of the association. While the association has a responsibility to take reasonable and appropriate action to promptly repair common elements upon learning of the need for a repair, the interior repairs and limited common elements are the unit owner’s responsibility in these situations. The association is not an insurer against all loss on the property.

If there is a condition such as a water leak in your unit or from a pipe serving only

your unit, you must take prompt action to resolve the problem to minimize damage to your unit and to other units. Delay on your part to resolve the problem constitutes negligence on your part. For example, you must contact a plumber to promptly correct a water leak in your unit or a pipe serving your unit to minimize damage to your unit and to other units. The association does not supply contractors to perform unit repairs. You must provide your own contractors to make necessary repairs.

If your unit is being damaged by a condition from another unit, such as a water

leak from a pipe serving another unit or a hot water heater pan leak from another unit, you must take immediate action to minimize damages and you must contact your neighbor to resolve the problem. It is important to note that any problems, such as water leaks, from another unit that affect your unit must be resolved between you and your neighbor. The association is not a mediator of your problems with neighbors. However, if a problem arises from the common elements, such as a roof leak, you must promptly notify the association of the condition, and take appropriate action to minimize any damage.

The association strongly encourages all owners and lessees to purchase a

condominium owner’s or tenant’s insurance policy to cover personal property and other portions of the unit and limited common elements which are not covered by the association’s “umbrella” hazard insurance policy. 7

SEWER POLICY AND INFORMATIOIN

VRW unit owners are responsible for paying their own quarterly sewer bills. Maintenance responsibility for underground sewer lines falls into three categories:

1. Unit owners are responsible for maintenance and repair of their individual line running from each unit to the main VRW underground sewer lines.

2. The VRW association is responsible for maintenance and repair of the underground lines running to main county sewer tap along Zurmehly Road.

3. Allen County is responsible for the maintenance and repair of the main sewer line that services VRW.

KEYS

Each unit owner/lessee is responsible for three sets of keys.

(2) House keys to the front and back door of your unit (2) Mailbox keys to your assigned mailbox (2) Clubhouse keys which open all of the external doors of the clubhouse and the

inside fitness room door If these keys are lost they must be replaced at the owner’s/lessee’s expense. When an owner/lessee sells a unit or turns the property over to a new owner/lessee, the keys listed above are to be placed in the envelope provided in this handbook and given along with the entire handbook to the new occupant. 8

RENTAL AND LEASING POLICY RENTING - VRW bylaws (Article III, Section 2, Paragraph (G) state that no unit or part thereof may be rented or used for transient or hotel purposes. This covers periods ranging from less than thirty days to one year. For example, you may not rent out a room of your unit to a boarder while living in your unit, or, if you choose to spend the winter months in a warmer climate, you may not rent your unit while you are away from Lima. LEASING - VRW bylaws (Article III, Section 2, Paragraph (G) allow for a limited number of leased units based on a owned/leased percentage of all existing units. The number of leased units is limited in order to ensure that financial institutions will continue to lend funds to potential buyers and those wishing to refinance a current mortgage. The following guidelines apply to any owner desiring to lease his/her unit:

Those wishing to lease a unit must first obtain board approval to do so. Any lease must be in writing and for a minimum of one year. Prior to commencement of the term of a lease, the unit owner must notify the

board in writing, the name or names of the tenant or tenants and the time during which the lease term will be in effect.

Lessees are required to observe all VRW rules and regulations. Lessors are responsible for the timely payment of all VRW fees and assessments

as well as for any fines or damage to common property incurred or caused by a lessee. 9

SAFETY AND SECURITY

VRW does not employ professional security personnel, and Shawnee Township police officers do not routinely patrol VRW since this is private property. Therefore it is wise for all residents to exercise normal precautions to protect themselves and their personal property. If you wish to install a personal home security system, you are free to do so at your own expense. While VRW is a generally quiet and peaceful neighborhood, one can never rule out intrusion by those with criminal intent. Therefore, it is recommended that doors be kept locked and that garage doors remain closed, especially overnight or when you are not at home. You will soon become aware of the comings and goings of your building neighbors and are asked to make them aware of any activity that seems unusual or suspicious. If you plan to be away from your unit for an extended time, it is helpful to notify a neighbor to be on the lookout for expected packages or deliveries. VRW has an established speed limit of 14 MPH. Residents are asked to drive slowly and carefully within the association because of the possibility of children at play and because so many residents use our streets for walking exercise.

SELLING YOUR PROPERTY When you sell your condo, the state condominium and real estate laws require that certain documents be provided at closing due to the unique nature of condominium ownership. The following is a list of these documents:

A Certificate that establishes all condo fees due have been paid Certificate of Insurance Annual Association Budget Current Capital Investment Account Balance

The association business manager will provide the title company or buyer’s agent

with this information upon request. Sellers also must provide the new owners with the following items:

Condo keys (2) (Front and Back Door) Mailbox keys (2) Clubhouse keys (2) Garage door openers (2) Condo Association Handbook All owners’ manuals for appliances, water heater, etc.

After listing your unit for sale, the following guidelines apply:

A realtor ‘FOR SALE’ sign may be placed along Zurmehly Road at the entrance to VRW.

One small ‘FOR SALE’ sign may be placed on the inside of a window in the unit being sold.

If a realtor holds an open house at your unit, an ‘OPEN HOUSE’ sign may be placed in your yard for the duration of the open house only.

VRW bylaws require any buyer of a new or presently owned property at

VRW to contribute the equivalent of two months’ current association fees to the VRW Capital Improvement Fund at the time of purchase. This is a one-time, non-refundable contribution. Sellers are required to ensure that their realtor and any prospective buyers are aware of this provision

CLUBHOUSE

The VRW clubhouse is provided for the general use of all VRW owners/lessees. The main meeting room contains a television, refrigerator, conventional oven, microwave oven, and dishwasher. The clubhouse may be rented by VRW owners/lessees for private parties. Rental rates and instructions for renting the facility are explained on the Clubhouse Rental Form in the “forms” tab of this handbook and on the VRW website. The clubhouse also includes a fitness facility that is open at any time. Rules for the fitness facility are:

- The facility is available to all owners/lessees and adult houseguests. - You must be 18 years of age to work out in the facility by yourself. - Appropriate workout attire is required (including shirts for men). - Please wipe down all equipment after usage. - When leaving please turn off all equipment, TV, lights and fans. - When leaving please make sure both doors are locked.

The Association assumes no responsibility for any accident or injury in connection with the use of the fitness facility. Use of the facility is at your own risk. Any person responsible for property damage will be held financially accountable. The fitness facility may be closed by the board of directors at any time if deemed necessary.

A gas grill is available for use by any VRW resident. It is kept in the rear of the clubhouse building. The grill should be pulled away from the building during use, but not moved away from the immediate clubhouse vicinity. Residents are asked to clean and cover the grill after use, and move it back to the area where it is stored. The propane tank is refilled by VRW. However, we ask users to notify a board member if they notice the propane level is low. Also, if you are a frequent user of the BBQ grill, please consider having the propane tank refilled yourself, as a courtesy to your neighbors and the VRW Association. 12

SWIMMING POOL INFORMATION / REGULATIONS

The pool is usually open beginning Memorial Day weekend and ending on Labor Day. Additionally, the pool may be closed if it is found to be in need of repair or if testing reveals the water is in need of chemical treatment inconsistent with safe swimming. The swimming pool water is tested frequently. If the water quality fails, the pool must be closed, treated and retested. The pool will remain closed until water quality is consistent with swimming conditions. We want everyone to enjoy the pool facility and have a safe and uninterrupted season.

The pool at VRW is not a public pool. It is intended for the private use of the owners/lessees and their out-of-town guests. While the accompanied use of the pool on special occasions by local area friends and family members is understood and permitted, routine frequent use of the pool by local area friends and family members (e.g. grown children and grandchildren) is not permitted.

Any owner/lessee has the right to insist that any person at the pool follow the posted rules and abide by the information contained in this document. Any owner/lessee may question any person using the pool regarding their identity and whom they are visiting.

Any person using the pool who is not a VRW owner/lessee or an adult child of an owner/lessee visiting from out-of-town and staying temporarily at VRW, must be accompanied at all times by an owner/lessee. Other unaccompanied persons found to be using the pool will be asked to leave immediately.

Pool users who wish to listen to music or the radio must do so using ear buds/head phones unless they are the only person at the pool, in which case they may use regular speakers. The speaker volume must be low enough so as not to be heard in the outside area of the closest condo to the pool. Another owner/lessee has the right to ask that music be turned off or down at any time.

Owners/lessees and guests are required to keep noise and splashing to a minimum. Children should be monitored at all times by a responsible adult, to make sure that they are not disrupting the peaceful use of the pool by others. If any owner/lessee feels that their enjoyment of the pool is being disrupted, they have the right to ask and expect that the behavior be discontinued. Owners/lessees are responsible for the actions of their children, grandchildren and guests.

The last 15 minutes of each hour are designated as Adult Swim Only. Children under the age of 18 must be completely out of the pool every hour during this time. The only exception is if you are the only party using the pool. All owners/lessees have the right to require that the Adult Swim rule be followed.

Anyone found in the pool area when the gate is locked or the pool is closed will be reported to the local authorities for trespassing.

The pool cannot be reserved for a private party or for the sole use of any owner/lessee. Reservation of the clubhouse for a private function does not include private use of the pool.

VRW assumes no responsibility for the safety or health of any pool user. Use of the pool is at your own risk. Persons under the influence of alcohol are not to use the pool. No grilling of any form is allowed inside the pool fence.

Any person responsible for property damage will be held financially accountable.

The Association assumes no responsibility for any accident or injury in connection with the use of the pool.

The pool may be closed by the board of directors at any time if deemed necessary.

POOL RULES

No Trespassing – Private Pool.

The pool is open 9:00 am to 10:00 pm, weather permitting

There can be no more than 6 guests per unit.

Persons under the age of 18 must be accompanied at all times by an owner/lessee.

The last 15 minutes of each hour is Adult Swim Only. Everyone under the age of 18 must be out of the pool. (Does not apply if you are the only user of the pool at the time).

No lifeguard on duty. Use the pool at your own risk

No diving, running, pushing, wrestling or rough play.

No playing on the ladder or hand railing

No glass containers or smoking in the pool area, including the area just outside the pool fence.

No pets or animals allowed in the pool area

Appropriate attire must be worn while swimming or sunbathing.

Diapered children are not permitted in the pool without leak-proof swimwear.

Persons with skin abrasions, colds, inflamed eyes, contagious conditions or infections, or wearing bandages are not to be in the pool.

If you put up an umbrella, remember to put it down when you leave.

Persons violating the pool regulations will be asked to leave the area.

There is a phone on the outside wall of the clubhouse for pool and clubhouse EMERGENCY USE only.

MAIL / PACKAGE DELIVERY

U.S. POSTAL SERVICE (USPS)

The USPS provides regular daily mail delivery to the VRW community mailboxes located directly across from the clubhouse.

The mailbox area contains four towers of sixteen individual mailboxes. At the bottom of each tower are larger “community” boxes used for small packages and items too big to fit into an individual mailbox.

Each unit owner/lessee is assigned one individual mailbox and is given two keys for that box. If you receive a small package, you will find a separately tagged key in your mailbox that opens one of the larger receptacles at the bottom of your mailbox tower. When you insert this key in the appropriate box lock, it will open that receptacle and enable you to retrieve your package. The key will then remain “locked” in that receptacle and the receptacle will stay open until the mailman releases the key from the receptacle door the next time he needs it to secure a package for another unit owner/lessee.

If you receive a package via USPS that is larger than either of the receptacles in your mailbox tower, the mailman will deliver that package to your unit.

Outgoing mail slots for cards and letters are provided in each mailbox tower. For those wishing to mail larger items or packages, you must take them to any U.S. Post Office or to the business “Goin’ Postal” which is located in the small strip mall just north of the Shawnee Road roundabout on the west side of the road.

UPS and FEDEX

UPS and FEDEX trucks are almost daily visitors to VRW. If you order anything that is delivered by either of these services, they will bring it directly to your unit.

PARKING It is important for each resident of VRW to understand that all paved roads and driveways within the association are limited common property and are not individually owned. Given the need to have these areas as clear as possible during winter months for snow removal, and during summer months for easier maneuvering of large riding mowers, owners are expected to keep their personal vehicles garaged as much as possible. For units in a quad or duplex, no more than two vehicles may be parked directly side-by-side behind your two-car garage for limited amounts of time on an as-needed basis. For stand-alone units, one or two vehicles may be parked behind your garage depending upon the length of the driveway for limited amounts of time on an as-needed basis. No vehicles are permitted to be parked at any time on any common area road within VRW, which includes back out areas between quads and along access driveways. If there is a temporary need for more parking than outlined above for personal guests, they are asked to park alongside the gravel access road north of the clubhouse and either walk or be transported by you to your individual unit while they are visiting. Parking for visitors to events in the clubhouse is provided in front of the clubhouse. Overflow parking is allowed along the gravel access road to the north of the clubhouse. No residents or guests may park at any time in the two spaces in front of the community mailboxes. Parking of boats, trailers, RV’s or motor homes on a permanent basis is not permitted on VRW property. Temporary parking for such items in an owner’s driveway is permitted during seasonal turnaround, etc. If owners have out-of-town visitors who are traveling in an RV or motor home, temporary parking of these vehicles is allowed in the area north of the mailboxes for up to one week. 17

PETS / ANIMALS

Only indoor pets are permitted at VRW. All pets are to be kept on a leash at all times when outside the home. No pet is permitted to roam freely about the property at any time. All animals/pets must be kept inside the condo overnight. Animals are not permitted to be chained/staked outside the home unless the owner is also outside at the same time. Pets are not permitted in the pool area or inside the clubhouse. Dog owners are expected to clean up after their animal immediately and to dispose of the waste in an appropriate manner.

The dog breed known as PIT BULL (pure breed or mixed breed) is not allowed on VRW property. These dogs, or any other dog breed that may develop a widespread reputation as an unprovoked biter, may not be owned or temporarily cared for by any VRW resident owner/lessee. This prohibition also extends to the pets of any visiting guests of resident owners/lessees.

REFUSE

Each unit owner is provided one large trash tote supplied by our refuse contractor. Trash pickup is scheduled for each Friday, unless a national holiday occurs earlier in a week that moves our pickup day to Saturday. Totes should be set out behind your garage on either Thursday night or early Friday morning and returned to your garage Friday evening. The association also provides a large dumpster for any overflow trash or large objects.

WINDOWS AND DOORS

The repair and upkeep of all windows, doors, and garage doors is the responsibility of each unit owner/lessee and does not fall under association maintenance responsibility.

EXTERIOR MODIFICATIONS No exterior modification of VRW units – either to the building itself or to the permanent landscape around it – is allowed without submitting an Exterior Modification Request form to the board of directors and subsequent action by the board on the request. EMR forms are available on the VRW website or in the forms section of this manual. 18

PLANTS / LANDSCAPING

Owners/lessees may add plants to the area between the sidewalk and the outside wall of their condo.

Solar powered lights under 18” tall may be added in this area if the owner/lessee desires. No electric lights and/or wiring are permitted in the area between the sidewalk and the outside wall of the condo units.

Other areas that the owner/lessee may add plants include the area around the tree and bushes at the corner of their sidewalk and the area inside their patio fence. Removal of original builder-installed landscaping is not permitted unless it is replaced, at the owner’s expense, with suitable alternative plantings. A request for any change of builder-furnished landscaping should be made by filing an external modification request with the Building and Grounds committee.

Because VRW doesn’t have a sprinkler system, the unit owners/lessees are responsible to water the landscaping around their unit. If able, residents are asked to keep the landscaped areas around their condo neat and weed-free. If plants around the condo die for lack of water, the condo owner will be required to replace them at their own expense.

Care should be taken to ensure that visible patio, sidewalk and driveway spaces are not cluttered. Grill covers, patio furniture and umbrellas should be in conservative, neutral colors, such as green, brown, beige or black.

Decorative items such as planters and benches are permitted, but should be removed for the winter months to allow for snow removal.

Bird feeders and bird baths are permitted, as long as they are kept clean and in good repair, and their presence does not attract nuisance animals such as raccoons and opossums.

Chimineas and fire pits are not permitted due to the small size of the patios and the inability to keep the sparks from flying onto the roof. There is a fire pit outside the clubhouse that is available for any owner/lessee to use. The owner/lessee is responsible for providing their own firewood, and for making sure that the fire pit is cleaned out, properly covered and ready for the next user within 24 hours of using it.

Wind chimes are not permitted due to the close proximity of the neighbors who might not enjoy the sounds they produce.

Decorative items are not permitted to be hung from or installed on the outside of the condo units or attached to the wood siding, stone, window frames or trim with the following exceptions:

Christmas decorations: Bows, pine boughs and lights may be draped from the patio fences, and wreaths may be hung on front doors.

American flag: Owners may fly an official American flag from their unit on any day during daylight hours in accordance with accepted U.S. Flag protocol. Please check with the Building and Grounds committee for the proper location for placement of a flag bracket on your unit.

Other flags, banners and signs are not permitted. Decorative banners or other flags are not to be flown or hung from your condo unit. Signs, including political or real estate signs are not to be placed in any location around the condo with the following exception: For Sale signs are permitted at the front entrance to the property (where Riverwalk Blvd. meets Zurmehly Rd.) and in one window of the unit that is for sale. If the realtor or owner is hosting an open house in an attempt to sell a unit, an Open House sign may be placed in the front yard of the condo during the hours of the open house.

PATIOS / PATIO FENCES / PAINT COLORS

All patios and patio fences are the responsibility of the unit owner for maintenance, painting, and replacement. It is recommended that wooden patio fences be painted every two years. The front doors will be painted at the same time the building undergoes its scheduled repainting. If the owner/lessee wishes to repaint the front door more often, the cost of labor and/or materials will be their own.

TV / INTERNET / TELEPHONE SERVICE

Two area companies supply VRW with television, internet and home telephone service. One is Time Warner Cable (TWC) in Lima. The other is Telephone Service Company (TSC) in Wapakoneta. The vast majority of VRW unit owners use one of these two companies for these services. The use of satellite TV delivery companies such as DISH or DIRECT TV is generally not available for VRW unit owners because of restrictions on where receiving dishes can be mounted. VRW regulations prohibit the mounting of objects such as satellite receiving dishes on unit rooftops or building sides, and companies such as DISH and DIRECT TV have told the board of directors that a single dish receptor with individual unit access for the entire VRW complex is not feasible. The only cases where the board has approved a satellite dish installation for a unit owner has been when the owner had a patio with southern exposure and when a dish installed inside the patio but below the top of the patio fence could adequately access a satellite signal. Owners are encouraged to use either TWC or TSC for their television, internet and home telephone needs.

If you have a patio that would provide sufficient satellite access with a dish not visible above the patio fence and wish to install DISH or DIRECT TV for home use, please submit an Exterior Modification Request with full details to the board for consideration. 22

ENFORCEMENT POLICY Voluntary compliance with the guidelines established in this handbook is the easiest and best way to ensure that all residents can enjoy the tranquility of lifestyle promoted at VRW. In cases where rules and guidelines are not followed or willingly ignored, the board of directors is empowered to take the following action:

1. Upon receipt of the first verifiable complaint of a violation of VRW rules or guidelines, the board will send a letter to the unit owner asking that the situation be rectified immediately.

2. If a solution to the problem is not provided by the unit owner, or a second verifiable violation of the VRW rule or guideline in question is received by the board, a $100.00 fine payable to VRW immediately will be assessed.

3. Should steps one and two not be sufficient to rectify the matter, any future violations of the same VRW rule or regulation will result in a $250.00 fine per occurrence.

This policy is adopted pursuant to the Bylaws (Code of Regulations) for The Village at Riverwalk Condominium Association and will be enforced in accordance with Article IV, Section 12 (F) outlined on page 5 of that document. While it is hoped that steps two and three listed above are never needed, unit owners are advised that if fines are levied and not paid, the board or directors has the authority to place a lien on the unit involved (Article XV, Section 5 of VRW Declaration and Bylaws) which would require payment of legitimately levied fines before any future sale of the property. 23

VRW BYLAWS

Documents known as the “Declaration Creating and Establishing a Plan for Condominium Ownership” and “Bylaws (Code of Regulations) for The Village at Riverwalk Condominium Association were created in March, 2005. They are lengthy and mostly “legal boilerplate” documents that run more than 60 pages. Most VRW owners have these documents in their possession at this time, either as original owners of their unit, or because they received them from the prior unit owner at time of purchase. Since most owners already have these documents, the board chose not to go the considerable expense of reprinting them for this handbook. If you have these documents, it is suggested that you put them in this handbook so that they will be readily available for future reference and to pass on to the next owner should you decide to sell your unit. If you do not have these documents, they are available on the VRW website. Click on the “Documents” tab, then scroll down to “Legal” and click on the words “Declaration and Bylaws.” You may print them if you wish to have a hard copy in your handbook, but that is not mandatory if you are comfortable just having the bylaws at hand via our website. 24
