ABOUT THE COLLEGE

Modern College Of Law, Mohan Nagar Ghaziabad is a self-financed college set up in the year 2003

under the aegis of Ganesh Shiksha Samiti, a registered non-profit body. The Institute runs full time

LL.B. (3 Year Course) affiliated to Chaudhary Charan Singh University, Meerut. The Modern College

of Law, has dedicated itself to search out the young men of substance and shape in their abilities to

take on the challenge ahead of them, at a global level. The alacrity of the professionals passing out

the gates of institute must catch up the speed of super computers measuring in nanosecond. And

their grey cells must store up information pools in volumes that gigabyte is but a small unit to keep

track on them. But, above all, the experts from all walks of life acting as the friends, philosophers

and guides of these vastly talented pools in the institute ingrains the humane approach that is so

highly essential for success in any discipline. With strong emphasis on justice and personality

development our students are trained to be not only efficient and smart but also technically sound.

The college is located in a sprawling campus at Mohan Nagar, Ghaziabad at a compatible distance of

10 Km from Delhi. It is very well connected by road and Train. Railway station of Sahibabad and

Ghaziabad are equidistantly located and it takes hardly 10 minutes to reach college by public

transport which is abundantly available.

The campus area of Modern College of Law is 1.217 acres and the total built up area is 3326.39 Sq

meter. On the ground floor there is Management Room, Principal Office, Technology laboratory,

Visitors Room, Health and Physical Resource Center, Library cum Reading Room, department staff

room, canteen, separate washroom facility for boys and girls and parking space. On the first floor

there is moot court, girls common room, boys common room, and class rooms. An inquiry office is

also there for the students.

Secretary Message

As a head of the College it is indeed a matter of pride for me to be associated with the First Law

Festival- Vidhotsav (A Law Fest) a National level competition organizing by the Law College. I am

proud of the law college, its Principal, teachers and especially the students who have shown

remarkable academic commitment year after year. The utility of this event from the perspective of

academic enrichment of the students of our college and also students from other colleges is beyond

speculation. I wish the organizing team of the college for grand success of the event.

It gives me immense pleasure to pen few words as a Principal of Modern College. This event of the

college, comprising several competitions at national level like Conference, Legal Essay Writing,

Legal Debate, Law Quiz, Legal Drafting & Client Counselling. Inspite of having the first Law

Festival the vigour, enthusiasm and excitement of the students is unbound. The First Law Festival-

Vidhotsav (A Law Fest) starting from 10th March 2018 promises to be one more unforgettable event

of the college. I wish my organizing team headed by Mr. Ankur Gupta (HOD, Law) good luck for the

event.

NATIONAL CONFERENCE Topic- “Need to Restore the Anticipatory Bail in U.P & Uttarakhand: Where Jail,

not Bail is a Rule”.

About Conference-

“Bail is money or some form of property that is deposited or pledged to a court, in order to secure

the release from jail of a suspect who has been arrested, with the understanding that the suspect

will return for their trial and required court appearances. Cr.P.C 1973 provides is two kind of bails:

Regular bail & Anticipatory bail. Anticipatory bail is a direction to release a person on bail, issued

even before the person is arrested. Chapter 33 of the Cr.P.C 1973 is based on the principle of “BAIL

AND NO JAIL” but actually it is not follows in U.P. & Uttarakhand as far as anticipatory bail is

concerned. As Section-438 of Cr.P.C. 1973, which lays down the provision of anticipatory bail, has

been omitted for the purpose of U.P. by a State Amendment, vide Section 9 of the U.P. Act No. 16 of

1976 with effect from 28-11-1975, which was also applies to Uttarakhand, since in 1975,

Uttarakhand was also the part of U.P.

Thousands of people in both states have suffered because of the non-availability of anticipatory bail.

In the case of registration of a criminal case with non-bailable sections of the IPC, a person has only

one option to save himself from arrest move the High Court at once. While a resident of UP has to

rush to Allahabad High Court or the Lucknow Bench of the court, a person from Uttarakhand has to

move Nainital High Court to get a stay on arrest under section 482 of the Code of Criminal

Procedure, 1973.

A majority of people in both the states neither have the resources, nor the right contacts to get such

relief. Those who can afford it have to travel long distances and spend a lot of money in the process.

This also increases the load on High Courts of the two states. A contributing factor to the

overcrowding of jails could also be the non-availability of anticipatory bail in UP and Uttarakhand.

As in our opinion all other states of the country have provision of the anticipatory bail and Uttar

Pradesh lacks the above said provision. In this regard we would like to say that all laws made in

country should be practiced with equality along the Indian territory and the provision of

anticipatory bail being available to the people of states like Gujrat, Maharashtra, Bihar etc. and not

available to the people of Uttar Pradesh & Uttarakhand is direct violation of the fundamental rights

enshrined in the constitution of India and many of the cases in recent 42 years showcase the need

to restore the provision of the anticipatory bail in the states of Uttar Pradesh & Uttarakhand.

The above mentioned themes are not constraint, other related issues can also be explored.

Call for Papers

Research Papers are invited from academicians, practitioners, researchers, scholars & students on

the issues related to above mentioned themes. It is also proposed that the selected papers by the

committee will be published in a special volume of the conference in a form of an edited book with

ISBN No.

Guidelines for Abstract Submission

An Abstract should contain 300-350 words accompanied by a brief profile of the author/co-author

indicating his e-mail ID, contact number & official address. Abstract will be reviewed and only those

abstracts approved by the reviewers will be selected.

A softcopy of the Abstract in Microsoft Word should be mailed to only

[email protected] till 15th February, 2018. The registration form should be

attached with Abstract. Approval of Abstracts will be sent till 17th February, 2018.

Guidelines for Paper Submission

The generalized paper size kept is A4 with margin of 1.5 inch left margin and 1.5 line spacing. The

Paper should be typed on Times New Roman only with font size of 12pt. References should be given

separately at the end of the Paper & arranged alphabetically. The full length Paper both in Microsoft

Word & PDF format should be sent to only [email protected] till 24th February,

2018.

Articles received after the stipulated deadline will not be entertained for presentation in the

Conference.

Notification for the confirmation will be sent till 28th February, 2018.

Please adhere the guidelines of copyright while submitting the Papers.

NATIONAL LEGAL ESSAY WRITING COMPETITION

Rules

1. The National Legal Essay Writing Competition shall consist of only one round.

2. Participation in the competition is allowed in an individual capacity only. Neither joint

registrations nor joint submissions will be entertained.

3. The Topic/Theme of the said competition will be announced on the spot 20 minutes prior to

the commencement of the said competition.

4. Participants shall be given one common problem.

5. The Essay can be either in Hindi or English.

6. One hour will be given to the participant to draft the essay..

7. Each Draft will be judged on the following parameters-

(i) Overall Subjective Evaluation (20%).

(ii) Issues Covered & ingenuity of Ideas (20%).

(iii) Flow & structure of essay (20%).

(iv) Legal content (20%).

(v) Language (20%).

7. Organizing committee may alter /change the rules and regulations at any point of time.

8. Each participant in the Competition will receive a certificate to be awarded at the Competition

Banquet. The winner & the first runner-up will, in addition, receive a special award.

NATIONAL Legal DEBATE COMPETITION

The topic of the National Debate Competition is- “The Criminal Law (Amendment) Act, 2013

fulfills its objects in the last 5 Years.”

Rules

1. Two Speakers from an Institution (one shall speak for the motion and other against the

motion) shall be eligible to participate.

2. Each Participant shall be given maximum five (5) minutes to speak. The warning bell shall

sound after four minutes and final bell after five minutes. Exceeding the time limit shall be a

disadvantage for the team and the candidate.

3. The participants may speak either in English or in Hindi (No mixed language is allowed).

4. No abusive language shall be used.

5. Assistance from written manuscript may lead to adverse marking.

6. Unnecessary actions like thumping the rostrum/table and shouting should be avoided and

will result in deduction of marks.

7. Organizing committee may alter /change the rules and regulations at any point of time.

NATIONAL LAW QUIZ COMPETITION

Rules

1. A team shall comprise of only two students.

2. Language of quiz shall be English.

3. The participants are not allowed to use mobiles or any other electronic devices during

testing hours.

4. Organizing committee may alter /change the rules and regulations at any point of time.

5. Each participant in the Competition will receive a certificate to be awarded at the

Competition Banquet. The winning team & the first runner-up team will, in addition, receive

a special award.

6. The National Law Quiz Competition consists of the following three rounds*-

Round-I

a) Each team shall answer 5 multiple choice type questions based on General Awareness &

Current Affairs.

b) The questions shall be projected through a PowerPoint Presentation in an Audio Visual

format.

c) There shall be plus 10 for each correct answer & minus 10 for each wrong answer.

d) Teams can deny to answer any question if they want and that will not affect their marking.

However, that question will get pass to the audience.

e) 60% of the total teams shall qualify to the round-2.

Round-2

a) Each team shall answer 8 multiple choice type questions based on Law of Contract 1872,

Family Law, Constitutional Law of India, Law of Torts & Indian Penal Code 1860.

b) The questions shall be projected through a PowerPoint Presentation in an Audio Visual

format.

c) There shall be plus 10 for each correct answer & minus 10 for each wrong answer.

d) Teams can deny to answer any question if they want and that will not affect their marking.

However, that question will get pass to the audience.

e) 40% of the total teams shall qualify to the round-3 i.e. final round.

Round-3

a) Each team shall answer 10 multiple choice type questions based on Code of Criminal

Procedure 1973, Code of Civil Procedure 1908 & Law of Evidence 1872.

b) The questions shall be projected through a PowerPoint Presentation in an Audio Visual

format.

c) There shall be plus 10 for each correct answer & minus 10 for each wrong answer.

d) Teams can deny to answer any question if they want and that will not affect their

marking. However, that question will get pass to the audience.

* Rounds & number of questions can be changed according to the number of teams registered

for the event.

NATIONAL LEGAL DRAFTING COMPETITION

Rules -

1. The National Legal Drafting Competition shall consist of only one round.

2. Participation in the competition is allowed in an individual capacity only. Neither joint

registrations nor joint submissions will be entertained.

3. The Problem/Theme will be announced on the spot & 30 minutes will be given to the

participant to plan the draft & one hour to draft the document.

4. The participants shall be given one common problem.

5. The draft can be either in Hindi or English

6. Participants are encouraged to draft using Plain English/Hindi and avoid the use of

unnecessary legalese.

7. The participants are free to add certain clauses in their legal documents as they deem fit,

provided that the clauses so added, do not defeat, contradict or nullify the intention of

the problem given.

8. Each Draft will be judged on the following parameters-

i. Understanding of facts & applicable Law (30%)

ii. Language and Style of Drafting (30%);

iii. Attention and responsiveness to Client’s needs, including identification of issues and

creativity (30%)

iv. Formatting (10%);

9. Organizing committee may alter /change the rules and regulations at any point of time.

10. Each participant in the Competition will receive a certificate to be awarded at the

Competition Banquet. The winner & the first runner-up will, in addition, receive a special

award.

NATIONAL CLIENT COUNSELLING COMPETITION

The Competition simulates a law office consultation in which two law students, acting as lawyers

(attorneys/solicitors/legal practitioners), are presented with a client matter. The students are

given a brief written memorandum that identifies the general nature of the subject-matter of the

client's problem (e.g., that a client wants advice about a problem arising from the construction of a

house, that the client is facing a shoplifting charge, etc.) before the interviews are held. The students

conduct an interview with a person playing the role of the client. Students are expected to elicit the

relevant information from the client, explore with the client his or her preferred outcome, outline

the nature of the problem, and present the client with a means (or range of alternatives, if

appropriate) for resolving the problem. The interview with the client is then followed by a post

consultation period during which the students (counsel), in the absence of the client, analyze the

interview and discuss the legal and other work to be undertaken. The interview and post-

consultation period last a total of 20 (15+5) minutes. The students are evaluated by a panel of judge.

The students are evaluated against specific criteria that emphasize the use of listening, questioning,

planning, and analytical skills in a lawyer/client interview. Once the judges have completed their

evaluation of the interview, the students are called back in and the judges provide a brief critique of

the team's handling of the consultation and post-consultation periods. A Competition topic consists

of Contract, Family Law, I.P.C. Cr.P.C, C.P.C, International Law & Law of Evidence.

RULES OF NATIONAL CLIENT COUNSELING COMPETITION (COUNSEL)

Rule 1: Entry into the competition

(a) Composition of the Team- A team composed of two law students, can participate. Students

conduct the simulated interviews in teams of two in order to provide mutual assistance and support

in researching, planning and conducting the interview.

Rule 2: The consultation situations; competition topic; applicable law; fees; team letters;

rounds; preparation; and dress.

(a) Competition Topic. A Competition topic (Contract, Family Law, I.P.C. Cr.P.C, C.P.C, International

Law & Law of Evidence) will be designated by the organizing Committee prior to the Competition.

All consultation situations will be based on this topic. Each consultation situation, however, will

involve a different client and a different situation.

(b) Fees. The discussion of fees is an integral part of any first consultation between a lawyer and a

client. Students should be judged on how they approach this problem, but not on the monetary

amount used. The participants may discuss fees at any appropriate point in the consultation. Fees

may be waived or suitably reduced only in cases of financial hardship, either for persons of low

income or for persons of ordinary income faced with very large fees. Furthermore, in view of the

comparative complexities involved and the fact that some jurisdictions do not fully address them.

(c) Assignment of Team Letters. All teams will be pre-assigned a letter designation (A, B, C, etc.)

by the Competition organizer on a random basis.

(d) There will be only one round. A round consists of teams conducting interviews with the same

client. Based on the skills demonstrated in light of the Assessment Criteria, the judges then rank the

teams.

Rule 3: Fixture of the Competition- The fixture of the competition will be decided by draw of lots

on the date of the competition.

Rule 4: the consultation and post-consultation; general format; time limits and time keeping;

and use of materials and props.

(a) Maximum time limit for the Session- Each team shall have a maximum of twenty (20) minutes

to complete the session. This session must include both a consultation session with the client and a

post-consultation.

(b) The Consultation with the Client- Each team must conduct a consultation with the client

during which the students are expected to elicit the relevant information, outline the problem, and

propose options for resolving the problem. Team members are entirely free to decide how they will

divide their work, but both students must consult with the client as a team and their plan is subject

to judging. The students may wish during their post-consultation presentation to explain why they

worked together in the way that they did.

(c) The Post-Consultation- Each team must also conduct a meaningful post-consultation

discussion between the attorneys. During this post-consultation, the students may either talk to

each other loudly enough to be overheard by the judges or dictate a file memorandum on the

interview or both. The post-consultation performance may summarize the interview, indicate the

scope of the legal work to be undertaken, and state the legal issues that should be researched.

Explanation of the position or attitude taken by the students may be useful. The students may also

feel that documentation is appropriate. For example, they may want to write a letter to the client

confirming their retention as attorneys, the fee arrangement, etc. It also may be appropriate for the

students at the conclusion of this consultation to compose a letter to opposing counsel or to the

party with whom the client is having legal problems. Such a document may be dictated at this time.

(d) Division of Time between the Consultation and Post-Consultation; Timekeeping- The

student competitors will be provided with timekeepers. Under no circumstance will a team be

allowed more than twenty (20) minutes to complete the session, including both the consultation

and the post-consultation. The timekeeper shall stop students after twenty (20) minutes regardless

of whether students are in the consultation or post-consultation process. The decision of the

timekeeper as to when the round should end is final. In determining a team's score, the judges shall

consider the way the team allocated its time and, if applicable, the team's failure to include a

meaningful post-consultation session.

(e) Use of Materials and Props. During the consultation and post-consultation, the team may use

books, notes, and other materials. The team may also use office props (Laptops, Dictaphones, files,

tissue papers etc.).

Rule 5: Judgment and ranking of teams observed.

(a) Judgment Criteria- A team of counsels will be judged on the following parameters-

A. Listening & to Understand the Problem (20%)

B. Knowledge of Law (20%)

C. Solution/ Suggestion Given by Counsel (20%)

D. Minute Details (like filling of forms etc.) (20%)

E. Team Work (20%)

(b) Judgment- The judges should provide the team with a critique of the team's handling of the

consultation in post-consultation period. This critique should focus on the Assessment Criteria.

(c) Client Not to Be Present. Clients should not be present during the post-consultation.

(d) Judges' Discussion of Each Team's Performance; Consulting with the Client Prior to Ranking;

and the Awarding of Points to the Teams Observed by Judges at the End of the Round. After the

judges have observed all teams, the judges should discuss each team's performance among

themselves. Judges are encouraged to consult with the client. Although the judges will discuss the

performance of the teams, the judges will individually rank the teams.

Rule 6: Awards. Each participant in the Competition both client & counsels will receive a certificate

to be awarded at the Competition Banquet. The winning team & the first runner-up team of

counsels. Best client & the first runner-up client will, in addition, receive a special award.

MISCELLANEOUS RULES-

1. Dress Code should be Formal & Legal attire.

2. Students pursuing Law under either five year LL.B. Course or three year LL.B. Course or one

or two year(s) LL.M. Course from Law Schools/ Colleges/ Institutions/ Universities across

India can participate in the competition.

3. Only team entries are eligible. Schools may send any number of teams; subject to condition

that In case more than two teams from the same school qualifies for the final round, the top

two teams from the school shall be allowed to go in the finals.

4. The decision of MCL with regard to the competition, eligibility, submissions, selection

criteria, results, or any other matter shall be final and binding.

5. MCL reserves reserve the right to change the rules, reschedule or cancel the programme if

the contingency arises.

6. All the rules are only inclusive and not exhaustive for the competition.

7. Rules should be strictly adhered to. Any deviation from these will attract disqualification.

8. Participants are expected to follow the discipline while in campus and accommodation

provided by the organizers.

9. Incidents of eve –teasing or any kind of misbehavior will be taken cognizance of with the

help of police, and the teams will be disqualified from further participations.

10. The participants shall not stray around once they report to the college for participations.

11. Participants must behave in a dignified manner and shall not cause any inconvenience failing

which team shall be disqualified from the Competition.

12. The decisions of the judges shall be final in the context of the result of the competitions.

13. Activity such as Drinking, Smoking etc. is Strictly prohibited in the college campus.

14. The Participants must carry with them Photo identity card of their college/ University.

REGISTRATION PROCEDURE The last date of Registration for all the events is 28th February, 2018.

Registration Fee-

I. Entire Event:

One or more than one team (s) can also be allowed from one College/Institution.

Maximum number of 3 participants along with one faculty member will be allowed in one

team.

The participants have to decide it among themselves (with reference to prescribed schedule

of event) in which of the events they are going to participate.

The last date for the confirmation of registrations is Wednesday, 28th February 2018 by an

e-mail at [email protected] containing the details of the participating college, the

team members (including the number of male and female students), and their contact

numbers with scanned copies of registration forms and also of receipt obtained on

depositing registration fees through NEFT.

The registration fees for each team will be Rs 3500/- (with accommodation) & Rs. 2500/-

(without accommodation) which is to be deposited in the account through NEFT (National

Electronic Fund Transfer) mechanism latest by 28th February, 2018.
