    Return page 3 to the student. (Stamp the admission block and endorse "F-l" "D/S"Retain page 1 with any supporting documents stapled underneath them.Staple the Arrival portion of form 1-94 to page 1 in the lower left corner.

    1-94Endorse both portions of the 1-94 with "F-l" "D/S" and stamp them.Attach the Arrival section to the lower left corner of page 1 of 1-20A-B.

    PassportWrite the 1-94 admission number along the side the F-l visa.If the passport isvalid for more than six months from the date of admission (and thecountry is on the six-month list) admit-the student for D/S.If the passport is not valid for six months from the date of admission (and the countryis on the six-month list)admit the student to the validity of the passport. Indicatethe passport's expiration date on the reverse of both sections of the 1-94. Thestudent will then have to apply for an extension of stay after having the passportrevalidated.If the paasport ia not valid for six months from the date of admission (andthe countryis not on the six-month list) send the alien to secondary.

    Returning M-l StudentsThis section applies Co M-l students who have previously been admitted on or after 8/1/8

    . in accordance with che revised student admission procedures. The student should presenthis passport, a valid H-l visa, a new 1-94, and eitheipage 4 of his old I-20M-H properly endorsed or a oca I-20M-N.I-20M-NIf che scudent presents a new I-20H-M endorse it in che same manner as for an initialadmission.If the scudent presents a properly endorsed page 4, recurn it co him/her.

    In order for page 4 to be properly endorsed. ALL of the requested informationunder the block "For'Reentry of Scudent" must be completed. If any of cheinformation is missing! an. 1-515 must be issued. The endorsement of thedesignated school official is valid for SUmonths.

    If a returning M-l scudent presents an I-20K-N for a school other Chan the one h* waspreviously authorized to attend, he should be carefully questioned because an M-l studetris noc allowed co transfer schools after che sixth month of his program.1-94The admission number oa the student's new 1-94 MUST be crossed out on both che arrivaland departure sections. and che original admission number MUST besubstituted for it in the appropriate spaces (Just below the now crossed out admissionnumber).If the original admission number of a returning M-l student cannot be determined, sendthe scudent to secondary.M-2 DependentsAn M-2 dependent is the spouse or minor child of an M-l scudent.An M-2 dependent traveling with the principal Is admitted for the same length of timeas the principal M-l. The I-94s will be scamped and endorsed "M-2" with the date cowhich che M-l was admitted. If an 1-515 la Issued to the 'principal, the dependents willalso be admitted for 30 days. The principal is Instructed to submit the 1 - 9 I t s o f . thedependents as well as his/her own.Do noc issue an 1-20 ID to an M-2 dependent ^b r record the admission number in the 1 passpo:An M-2 dependent traveling alone may present a page 4 of I-20M-H properly endorsed underche block "For Entry of Spouse and Children". A properly endorsed page 4 is valid for SIX months from date of endorsement. If it is not properly executed or is more than sixmonths old. issue an 1-515. Return page 4, properly endorsed or otherwise to the M-2.Do not complete the block for the admission number aa it pertains only to the M-l.Practical TrainingIn general, the same rules apply as for F-ls except that the front of the 1-94 willreflect the date that the practical training ends plus 30 days in which to depart orone year, whichever is less. An M-l may only be granted a total of SIX months forpractical training.1-515Aa 1-515 la a form which is Issued to a student whohaa atabllahed mdmieeibility, butwho a lacking or has a deficient 1-20.     Transits"C"

    The "C-l" transit alien must establish that the entry is solely for the purpose ofpassing in immediate and continuous transit through the United States to a foreigndestination and must be in possession of a ticket or other evidence showing means oftransportation- to the port of departure. The alien must have sufficient funds(either in actual possession or available to cover the journey), and a traveldocument containing a visa (or other form of permission) to enter a country otherthan the United States. The period of admission will be governed by the transitalien's itinerary, not to exceed 29 days. As a practical matter, additional timefor visits of short"duration may be granted in appropriate cases.

    "C-2" nonimmigrant applicants are those aliens applying for admission in transit to,or from, the United Nations Headquarters District In New York City. Aliens with"C-2" visas shall be admitted on the additional conditions that they proceeddirectly to the immediate vicinity of the United Nations Headquarters District, andremain there continuously, departing therefrom only If required in connection withtheir departure from the United States, an d that they have documents establishingability to enter some country other than the United States following their sojournin the United Nations Headquarters District. The immediate vicinity of the UnitedNations Headquarters District is that area lying within a twenty-five mile radijasof Columbus Circle. These aliens are issued form ER-K2 which lists the terms andconditions of their admission in^ secondary."C-2" applicants are exempt all exclusion grounds except for 212(a)(26)(27)(28)(29).

    "D" * * M E V E R admit an alien as "D-l"wi th your admission stamp '.!!A crewmember is.defined as a person serving in any capacity on bonrd a vesselor aricraft. This classification has tvo ca tegories: a "D-l", vho will beleaving on the same vessel or airline on which he arrived, or a "D-2", whowill be departing by some means other than tbe vessel or airline of arrival.Note also that a crewmeaber who arrives in the United States aboard a privatevessel or. a i rcraft may qualify for admission as a "B-l" nonimmigrant. Theadmission of a "D-l" crewmember is recorded on f o r m 1-95. The alien's copyof the 1-95 is not lifted on departure. Instead, the alien is allowed toretain it for use on subsequent entries on the same vessel or with the sameairline.

    Every alien crewman applying for landing privileges in the United States mustmake his application in person before an immigration off icer , present whateverdocuments are required, and establish to tbe sa t i s fac t i on of the Immigrationoff icer that he is not subject to exclusion under any provision of the lawand is entitled clearly and beyond doubt to landing privileges in the UnitedStates.The inmigration officer in his discretion may grant an alien c rew m a n authoriza-t ion to land temporarily in the United States for (1) shore leave purposesduring the period of time the vessel or aircraft is in the port of arrival orother pores in the United States to which it proceeds directly without touchingat a foreign port or place, not exceeding 29 days in the aggregate, if the1migration officer is sasisfied that the crewman intends to depart on thevessel on which he arrived or on another aircraft of the same transportationline, and the crewmember's passport is surrendered for safe keeping to the m a s t eof the arriving vessel, or (2) the purpose of departing f r o m the United Statesas a crewman on a vessel other than the one on which he arrived, or departing a:a passenger by means of other transportation, within a period of 29 days, if theimmigration officer is satisfied that the crewman intends to depart in thatmanner, that definite arrangements for such departure have been made, and theimmigration officer has consented to the pay off or discharge of the crewmanf r o m the vessel on which he arrived.^A landed nonimmigrant crewman shall be ineligible for any extension of stay orfor a change of nonimmigrant classification.Unless the crewman is in possession of f o r m 1-186, the immigration officer shallgive to each nonimmigrant crewman permitted to land a copy of the f o r m 1-95presented by the crewman, endorsed to show the date and place of admission andthe type of conditional landing permit.

    All about waiversWhat is a "waiver"? What is the effect of a waiver?;

    "Waivers" refer to specific applications, filed individually, and adjudicated toremove temporarily or permanently one or more specific grounds of inadmissibility.Waivers are available to nonimmigrants pursuant to Sections 212(d)(l), (d)(3), (d)(4),and (1). Also, certain qualifying aliens are eligible for automatic waivers under sections212(m) and (o). No application or fee is required for these "automatic" waivers.Inspector's Field Manual (from Inserts). 17.5(d)When a waiver is granted, the alien receives an INS stamp on his/passport whichlists the category of the admission (in Atta's case, M-l). This stamp is issued right at thePort of Entry in the case of the nonimmigrant seeking admission into the U.S. Thewaiver is granted for the same period of time that the alien would receive if he had all of

    the appropriate documents (in the case of an M-l, up to a year). Significantly, however,the M-l status conferred by the waiver is only applicable while the alien remains in theU.S. and is abandoned when the alien leaves (unlike if the alien had a valid M-l visa).

    Th e following waivers are potentially applicable to Atta and Alshehhi 212(d)(4) - Passport andvisa requirements arewaived jointly by the Secretary

    of State and the Attorney General, under form I-193. Inspector's Field Manual (fromInserts), 17.5(d). 1-193 waivers under 212(d)(4) are generally discretionary at theINSPOE's. Inspector's Field Manual S 15.15(k)(l). On the remarks block, POEpersonnel must explain the circumstances for failure to obtain the proper documentation.Prior to September 11, 1992, concurrence from the Department of State (DOS) wasrequired for all passport and visa waivers. Now, the POE official simply marks the blockfor DOS concurrence "n/a." Inspector's Field Manual (from Inserts), 17.5(d)

    There is also a discretionary waiver for unforeseen emergencies. When an aliendoes not meet the requirements for a blanket extraordinary circumstances exception asdescribed below, the alien may apply fo r waiver under section 212(d)(4)(A) of the Actbased on an unforeseen emergency. These waiver applications are accepted andreviewed on a case-by-case basis, at the discretion of the inspecting officer. To apply fo rthis waiver, the alien must file the 1-193 form and pay the fee, currently $195.00

    In addition to discretionary waivers, an alien may also qualify for an automaticwaiver under the blanket extraordinary circumstances exception when the followingrequirements are met:

    (i) the alien's nonimmigrant visa must be facially valid;-\ ) the alien's nonimmigrant visa must correspond to the nonimmigrant class

    under which he or she seeks to be admitted;(iii) the alien timely filed an Extension of Status application;
