T21 Community Education Toolkit We are proud that the City of San Antonio has become the first municipality in Texas to pass a Tobacco 21 (T21) ordinance, which will prohibit the sale or providing of tobacco products to a person under 21 years of age within the city of San Antonio. This new tobacco ordinance, which goes into effect October 1, 2018, will be instrumental in reducing tobacco use in our high schools and reducing the risk of young people becoming regular smokers. Since the ordinance passed there has been an emphasis on educating the community on what this new policy means, when it takes effect, what specific products it applies to, and why it’s important. Metro Health’s T21 Community Education Workgroup has developed a collection of tools and materials to help educate community members on this important information. T21 Community Education Toolkit

San Antonio Tobacco 21 Ordinance

What is the Tobacco 21 ordinance?

This ordinance raises the minimum legal sale age of tobacco products to 21 years.

What does this mean?

Effective October 1, 2018, the new tobacco ordinance prohibits the sale or

providing of tobacco products to a person under 21 years of age within the city

of San Antonio.

Any violation may result in penalties and fines for those selling or distributing

tobacco products. There are no penalties or fines for young adults ages 18 to

20 using tobacco products.

What products does this apply to?

Tobacco products that are smoked, heated, chewed, absorbed, dissolved, inhaled, or ingested by any other

means, including, but not limited to a cigarette, a cigar, pipe tobacco, chewing tobacco, snuff, snus, an

electronic smoking device (e-cig), including liquids used in electronic smoking devices, or hookahs.

Does not include drugs, devices, or combination products authorized for sale as tobacco cessation aids by the

U.S. Food and Drug Administration, such as nicotine patches.

Why is this important?

Tobacco use is the leading cause of preventable disease, disability, and death in the U.S., according to

the CDC, killing more than 480,000 people per year.

95 percent of adult smokers began smoking before age 21, and 88 percent began before age 18.

Raising the minimum legal sale age of tobacco to 21 will help prevent young people, especially those age

15 -17, from starting to smoke.

Individuals under the age of 21 are especially vulnerable to the effects of nicotine and nicotine addiction.

This will also reduce tobacco-related deaths, disease, and health care costs.

¿Qué significa esto?

Tobacco 21 FAQ General Questions:

What is Tobacco 21 (T21)? An ordinance passed by the City of San Antonio on January 11, 2018 which raises the legal age to buy tobacco products from 18 to 21.

When does it take effect? October 1, 2018

Why is this important? Tobacco use is the leading cause of preventable disease, disability, and death in the U.S. This public health measure will delay the age of first tobacco use, reduce the risk of youth becoming regular smokers, and help keep tobacco out of schools.

What is included in the ordinance? The ordinance applies to “any product that is made from or derived from tobacco and is intended for human consumption or is likely to be consumed.” Examples of these products include but are not limited to: cigarettes, cigars, pipe tobacco, chewing tobacco, snuff, snus, hookahs, and electronic smoking devices.

What is going to happen to me in October?

You will no longer be able to buy tobacco products within the City of San Antonio limits.

Will I be fined for smoking in the city of San Antonio?

No, there is no fine or citation for smoking within the city for those 18 and older. The state laws and fines still apply for those under 18 years of age.

I want to quit smoking, how can I do that?

There is a list of cessation tools available on our website at

What am I going to have to do? You will have to post signage and stickers similar to those for the state tobacco law, train your staff on the new ordinance, and maintain employee acknowledgement forms. The signage and employee acknowledge form will be provided by Metro Health before October 1, 2018.

What will happen if one of my staff doesn’t follow the ordinance?

First, you will be issued a warning. Repeated violations will result in fines of up to $500.
