I. OVERVIEW
The Committee on Education, Public Library and Women's Affairs convened a public hearing on, Monday, November 24, 2014 at 6:20 p.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration was Bill No. 421-32 (COR) - An act to approve amendments to Chapter 8, Title 5A, Guam Administrative Rules and Regulations. Introduced by Speaker Judith T. Won Pat, Ed.D.
Public Notice Requirements
All legal requirements for public notices were met, with requests for publication sent to all media and all Senators on November l 7, 2014 ( 5 days notice), and November 24, 2014 (48 hours notice) via email. Copies of the hearing notices are appended to the report.

Bill No. 421-32 (COR) "An act to approve amendments to Chapter 8, Title SA, Guam Administrative Rules and Regulations.''
- Speaker Won Pat Ed.D. announces that three individuals have signed up to
testify on this bill but that only one of the individuals, Lea Santos was still present to testify.
- Ms. Lea Santos is in full support of Bill 421-32. Her written testimony is appended to the committee report.
- Ms. Mary Nolte announced that she would like clarification on whether existing teachers must have a minimum satisfactory rating by their administrators. She expressed that she has not been evaluated or observed by an administrator of her school formally or informally. She explained that she is concerned that this issue would prevent her from obtaining recertification.
- l\1s. Lea Santos asked Ms. Mary Nolte if she is receiving an annual evaluation.
- !\tis. l\1ary Nolte shared that with the new standards that are in place; there should have been a number of observations that should have occurred already but have yet to take place.
- Speaker \Von Pat, Ed.D. asked Ms. Nolte if she had received an evaluation at the end of the year.
- Ms. Mary Nolte responded that there is supposed to be one at the end of the year.
- l\'1s. Mary Nolte expressed that she was provided with an evaluation last year, but two years prior to that she was not provided with one and received an automatic satisfactory. She explained that she wanted to clarify that with the new standards in place, if they do not receive any observations and evaluations each year will that mean that they are not able to recertify.
- Ms. Mary Nolte asked if the Department of Education policy is to provide an annual evaluation.
- Speaker \Von Pat, Ed.D. states that it is and that at the end of the year the school principal has to evaluate you and that you have to be given a grade of satisfactory or unsatisfactory.
- J\.ls. J\tlary Nolte asked how the administrators make their decisions without any observations?
- Ms. Lea Santos responded that what l\1s. Mary Nolte is speaking of is an issue to be taken up with the Department of Education and that it is not a certification issue. She explained that it is the assumption that the school principals are supposed to do that and if they do not then it is something that needs to be worked out with them.
- Speaker Won Pat, Ed.D. mentions that the amendments in this bill are to define such terms as satisfactory and unsatisfactory as well the requirements for educators and to define the council for educator preparations. Speaker Won Pat, Ed.D. states that "So what this is, is bringing the rules and regulations up to standards, this is updating it."
Speaker Won Pat, Ed.D. concluded the public hearing.

My name is I.ea Santos, the Executive Director of the Guam Commission For Educator Certification. lam plea'>ed to appear before you today in support of Bill No. 421-32 "AN ACT TO APPROVE AMENDME1'.'TS TO CHAPTER 8, TITLE 5A, GUAM ADMINISTRATIVE RULES AND REGULATIONS.
The bill contains various amendments, including some technical corrections that are essential to the existing law.
There are also several definitions that evolved from recent developments. With the. revision of GDOE's teacher performance evaluation, new terms were introduced that must be incorporated in GCEC' s rules and regulations. Due to the implementation of the Common Core through mom schools; ETS (Educational Testing Service} has replaced the Praxis I test with the Praxis Core Academic Skills for Educators test. Tn addition, CAEP (Council for the Accreditation of Educator Preparation) will be replacing NCA TE (National Council for Accreditation of 'teacher Education) .
.By adding the requirement for passing the Praxis II Content tests for Initial Educator certificate holders, GCEC and UOG will be aligned, P.<1ssing this test proves that the teacher is Highly Qualified and g!latantees that they have mastery nf their subject .. Moreover, through this test, Professional or Master Educator ceititkate holders can also earn an Endorsenlent in another suhject aJea"
