Extreme Risk Protection Orders Also known as the Red Flag, or Zackary Parrish Law

• Family member or law enforcement officer petitions the court, with a preponderance of evidence and a signed affidavit under penalty of perjury, that a person (respondent) poses a significant risk to self or others.

• The court holds a hearing for a temporary ERPO. If temp ERPO is issued, respondent surrenders all firearms.

• Court must schedule 2nd hearing no later than 14 days after.

• Court appoints counsel for respondent.• If a family or household member or a law enforcement

officer establishes by clear and convincing evidence that a person poses a significant risk to self or others by having a firearm in his or her custody or control or by possessing, purchasing, or receiving a firearm, the court may issue a continuing ERPO. The ERPO prohibits the respondent from possessing, controlling, purchasing, or receiving a firearm for 364 days.

fighting back:• Boulder County Sheriff Joe Pelle supports ERPO,

testified in support of the bill not only this year, but last session as well. Joe’s son, Jeff, a Douglas County Deputy, was also shot and was in recovery for months from severe injuries sustained in the same incident that killed Parrish.

• Zachary Parrish’s former boss, Douglas County Sheriff Tony Spurlock, has been one of the most vocal advocates of the bill and says he believes it could have prevented Parrish’s death.

every 10 firearms that are seized. Colorado has the nation’s 10th highest suicide rate, and half of all suicides in the state in 2017 involved a firearm.

• John Ferrugia, PBS Anchor, won a Dupont Award for his Insight piece, “Imminent Danger” — about Colorado’s Red Flag laws, including an interview with the parents of James Holmes and the mother of gunman Matthew Riehl, who believes Deputy Zack Parrish would be alive today if Colorado had a red flag law.

...and there’s this:• In Colorado, a 2019 poll of Republican voters found that

60 percent generally support red flag laws. • If a law enforcement officer refuses to do their job

the court then decides if that officer is in contempt. And if someone is shot or killed as a result of neglect of duty, that officer can be sued by the family.

WE ASK: If sued, who pays the penalty, the officer or the taxpayers?

Is that officer ever subject to criminal charges?

• Attempts to amend and weaken the bill: Adding a petition clause so that there is the option to repeal it on the ballot. Changing the reform of the COGCC. Lowering the percentage threshold of mineral rights owners within a pooling application, who agree to forced pooling from 50+% to 45%.

voted for Prop 112, than voted for Walker Stapleton.

• Don’t let them tell you “stakeholders” didn’t have a “place at the table” and that this bill was “rushed through behind closed doors”. NOT TRUE. They had well paid O&G lobbyists outnumbering residents at our Capitol for years, session after session, influencing lawmakers to reject setbacks, mapping, inspectors, penalties and any semblance of regulation!

fighting back:Last fall, Colorado had the second highest voter turnout in the nation — and we all know that was no small task! (It’s also known as The Will of The People) If we worked so hard to GOTV, we must protect and honor the result!

The“R word” was originally intended to remove someone who was “unfit” for office, not to undo democracy.

Special elections are also very expensive. (Say this often!) Extremists don’t get to thwart our democratic process. If they don’t like their representation, they can put up their own candidate at the next normal election cycle.
